Que del informe técnico IN-0006-IE-2021, citado y que sirve de base para\nla presente resolución, conviene extraer lo siguiente:\n\n[.]\n\nII. ANÁLISIS DEL ASUNTO\n\n1. En el \"Por Tanto III\" de la resolución RE-0132-IE-2020, en el pliego\ntarifario del sistema de distribución del ICE, en la columna de categoría\ntarifaria de la tarifa T-RE: Tarifa residencial, se indicó por error un bloque\npor consumo de energía (kWh) de 151-370 en los términos en que se detalla a\ncontinuación:\n\nAl respecto, lo correcto tuvo que haber sido registrar un bloque de\n251-370. 2. En el \"Por Tanto III\" de la misma resolución, en el pliego\ntarifario del sistema de distribución del ICE, en la columna de categoría\ntarifaria para las tarifas T-MT: Tarifa media tensión y T-MTb: Tarifa media\ntensión b, en el apartado de \"Por consumo de potencia (kW)\", se indicó por\nerror la unidad de kWh, en los términos en que se muestra a continuación:\n\nAl respecto, lo correcto tuvo que haberse registrar por \"cada kW\".\n\n3. La Ley General de la Administración Pública en el artículo 157\nestablece que [.] En cualquier tiempo podrá la Administración rectificar los\nerrores materiales o de hecho y los aritméticos [.].\n\n[.]\n\nII. Que de conformidad con lo señalado en los resultandos y considerandos precedentes\ny en el mérito de los autos, lo procedente es rectificar el pliego tarifario\ndel sistema de distribución del ICE en el \"Por Tanto III\" de la\nresolución RE-0132-IE-2020; tal y como se dispone.\n\nPOR TANTO\n\nLA INTENDENCIA DE ENERGÍA\n\nRESUELVE:\n\nI. Rectificar el pliego tarifario del sistema de distribución del ICE en el\n\"Por Tanto III\" de la resolución RE-0132-IE-2020, según lo señalado en\nel apartado II de este documento para la tarifa T-RE: Tarifa residencial, para\nque se lea de la siguiente manera:\n\nII. In the \"Por Tanto III\" of the same resolution, in the tariff schedule for the ICE distribution system, in the tariff category column for tariffs T-MT: Medium voltage tariff (Tarifa media tensión) and T-MTb: Medium voltage tariff b (Tarifa media tensión b), in the section \"For power consumption (kW)\" (Por consumo de potencia), the unit kWh was erroneously indicated, in the terms shown below:\n\nIn this regard, the correct entry should have been recorded per \"each kW\".\n\n3. That in accordance with the foregoing whereases and considerings and on the merits of the case record, it is appropriate to rectify the tariff schedule for the ICE distribution system in the \"Por Tanto III\" of resolution RE-0132-IE-2020; as is hereby ordered.\n\nTHEREFORE\n\nTHE INTENDENCIA DE ENERGÍA\n\nRESOLVES:\n\nI. To rectify the tariff schedule for the ICE distribution system in the \"Por Tanto III\" of resolution RE-0132-IE-2020, as indicated in section II of this document for tariff T-RE: Residential tariff (Tarifa residencial), so that it reads as follows:\n\nII. To rectify the tariff schedule for the ICE distribution system in the \"Por Tanto III\" of resolution RE-0132-IE-2020, as indicated in section II of this document, for tariffs T-MT: Medium voltage tariff (Tarifa media tensión) and T-MTb: Medium voltage tariff b (Tarifa media tensión b), so that they read as follows:\n\nIII. To maintain the remainder of resolution RE-0132-IE-2020 unchanged.\n\nIn compliance with the provisions of Articles 245 and 345 of the General Law of Public Administration (LGAP), it is hereby informed that the ordinary remedies of revocation and appeal and the extraordinary remedy of review may be filed against this resolution.
