Por tanto;\n\n\n\n\n\nDECRETAN:\n\n\n\n\n\nREGLAMENTO PARA LA DESIGNACION DE LOS\n\n\n\n\n\nREPRESENTANTES DE LA COMISIÓN NACIONAL\n\n\n\n\n\nPARA LA PREVENCIÓN Y ATENCION DE AHOGAMIENTOS\n\n\n\n\n\nESTABLECIDOS EN LOS INCISOS F) Y G)\n\n\n\n\n\nDEL ARTÍCULO 5 DE LA LEY N° 9780\n\n\n\n\n\nArtículo 1º-Objeto. Este reglamento establece el procedimiento a cargo del Instituto Costarricense\nde Turismo, (en adelante ICT), para coordinar la designación de los representantes de la Comisión\nNacional para la Prevención y Atención de Ahogamientos, (en adelante la Comisión), establecidos en\nlos incisos f) y g) del artículo 5 de la Ley \"Implementación de las Unidades de Guardavidas en las\nPlayas Nacionales\", Ley N° 9780 del 19 de diciembre de 2019 (en adelante Ley 9780).\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 2º-Registro de las Organizaciones establecidas en el inciso f) del artículo 5 de la Ley\n9780. Las organizaciones sin fines de lucro, legalmente constituidas en el país para labores de\nguardavidas en playas nacionales (en adelante las organizaciones), que deseen participar en la\ndesignación de un representante de entre ellas para integrar la Comisión, deberán registrarse ante\nel ICT. El ICT habilitara en su página electrónica institucional, un espacio para dicho registro y\nun correo electrónico a fin de recibir las solicitudes de registro, de lo cual dará aviso mediante\nuna publicación en un diario de circulación nacional, en el que señalara el plazo para el proceso de\ninscripción, el cual será de un mes. A fin de ser registradas, las organizaciones deberán realizar\nuna solicitud en la que indicaran su nombre complete, el de sus representantes legales con sus\ncalidades, un correo electrónico designado para recibir notificaciones por parte del ICT y una\ncertificación digital vigente que permita la verificación por parte del ICT, de su inscripción ante\nel Registro Nacional como organización sin fines de lucro, según los objetivos de su acta\nconstitutiva. Una vez finalizado el plazo de inscripción, el ICT contara con un mes para verificar\nla información de las solicitudes de registro y conformar el mismo con aquellas que cumplieron con\nlos requisitos citados. Este \"Registro de Organizaciones de Guardavidas\" una vez conformado, estará\ndisponible al público en la página institucional del ICT.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 3º-Registro de las Municipalidades y Concejos Municipales de distrito establecidos en el\ninciso g) del artículo 5 de la Ley 9780. El ICT realizara de oficio un registro de las\nMunicipalidades y Concejos Municipales de distrito de las zonas costeras por cada una de las\nprovincias de Limón, Puntarenas y Guanacaste (en adelante los gobiernos locales), en el cual\nconstara el nombre complete, calidades y correo electrónico para recibir comunicaciones del ICT, de\nlos alcaldes o intendentes distritales competentes. Este Registro estará disponible al público en la\npágina institucional del ICT.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 4º-Procedimiento de designación. Una vez constituidos los registros señalados en los\nartículos 2 y 3 de este Reglamento y en el plazo de diez días naturales posteriores al día en que\nestén disponibles al público en su página institucional, el ICT les comunicara a las organizaciones\ny gobiernos locales registrados, a sus correos electrónicos acreditados, la apertura del plazo de un\nmes para que remitan al ICT, la designación por escrito o por documento con firma digital y por\nacuerdo de los registrados, de sus candidates a representantes ante la Comisión. Esta designación,\nde acuerdo al artículo 5 de la Ley 9780 será de un candidato o candidata para representante titular\ny de un candidate o candidata para representante suplente por cada sector. En ambos casos, la\ndesignación por acuerdo de candidates, deberá ser enviada al ICT en el plazo de un mes contado a\npartir de día siguiente al recibo de la comunicación del ICT y motivarse en un análisis de idoneidad\na criterio de las organizaciones y gobiernos locales representados. El ICT podrá comprobar en\ncualquier momento, la veracidad de las candidaturas por acuerdo que se acrediten, mediante consulta\na los registrados.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 5º-Envió de candidatos designados a la Presidencia de la Republica para su nombramiento.\nRecibidas de conformidad las designaciones de los candidatos a representantes titular y suplente en\nla Comisión según lo indicado en los incisos f) y g) del artículo 5 de la Ley 9780, el ICT hará\nformal traslado de las mismas junto con su análisis de idoneidad, a la Presidencia de la Republica.\nEsto dentro del plazo máximo de cinco días hábiles posteriores a su recepción. Corresponderá a la\nPresidencia de la Republica según lo que establece el párrafo final del artículo 5 de la Ley 9780,\nnombrar y juramentar a los representantes de la Comisión, nombramientos que serán válidos por dos\naños a partir de su juramentación.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 6º-Reapertura del procedimiento de Registro y de Designación. Dentro de los seis meses\nprevios al vencimiento de los nombramientos vigentes de los representantes ante la Comisión\nestablecidos en los incisos f) y g) del artículo 5 de la Ley 9780, el ICT hará una reapertura del\nprocedimiento de \"Registro y Designación\" establecido en los artículos 2, 3 y 4 de este Reglamento.\nUna vez recibidas de conformidad las nuevas designaciones de candidaturas, el ICT procederá a su\nenvió a la Presidencia de la Republica para su nombramiento al finalizar el periodo correspondiente\ny de acuerdo a lo que establece el artículo 5 de este Reglamento. El ICT procederá de igual manera\nen el caso de que en forma anticipada a su vencimiento de dos años, los nombramientos de los\nrepresentantes titulares y suplentes de la Comisión regulados ente este Reglamento, se vieran\ninterrumpidos o dejados sin efecto por la Presidencia de la Republica.\n\n\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 7º-Plazo para la implementación de los Registros. Rige en quince días contados a partir del primer día del mes siguiente a su\npublicación en el Diario Oficial La Gaceta.\n\n\n\n\n\nDado en la Presidencia de la República.-San José, a los veintisiete días del mes de agosto del año\ndos mil veinte.\n\n\n\n\n\n \n\n\n\n\n\nFicha articulo\n\n\n\n\n\nFecha de generación: 25/3/2026 16:00:14\n\nIr al principio del documento", "body_en_text": "Remember that Control F is an option that allows you to search the entire text\n\n\nGo to the end of the document\n\n- You are viewing the latest version of the regulation -\n\nRegulation for the designation of the representatives of the National Commission for the Prevention and\nAttention of Drownings established in subsections F) and G) of Article 5 of Law No. 9780\n\n\nNo. 42688-MP-TUR\n\n\n\n\n\nTHE PRESIDENT OF THE REPUBLIC,\n\n\n\n\n\nTHE MINISTER OF THE PRESIDENCY\n\n\n\n\n\nAND THE MINISTER OF TOURISM\n\n\n\n\n\nPursuant to the powers and authorities conferred by Articles 140, subsections 3), 18) and\n146 of the Political Constitution of November 7, 1949; Article 28 of the General Law of\nPublic Administration, Law No. 6227 of May 2, 1978 and its amendments; and Articles 2 and 4\nof the Organic Law of the Costa Rican Tourism Institute, Law No. 1917 of July 30, 1955 and its\namendments.\n\n\n\n\n\nConsidering\n\n\n\n\n\nI.-That, the Costa Rican Tourism Institute (hereinafter:\n\n\n\n\n\nICT) according to Article 4 of its Organic Law, Law No. 1917 of July 30, 1955 and its amendments (hereinafter: Law 1917), has as its main purpose to increase tourism in the country,\npromoting tourism activity and overseeing visitor care.\n\n\n\n\n\nII.-That, the ICT, in accordance with the provisions of Article 5, subsection g), of Law 1917, has among\nits functions that of: \"Protecting by all means at its disposal the interests of\nvisitors, ensuring them a pleasant stay in the country,\" while the second paragraph of\nArticle 38 of Law 1917 establishes that: \"Regarding the protection of tourists contemplated in the\npresent Law, Costa Ricans who travel for health, recreation, or rest purposes to other places within the national territory different from their residence are also understood as tourists.\"\n\n\n\n\n\nIII.-That, Article 4 of the Law \"Implementation of Lifeguard Units on National Beaches,\" Law No. 9780, of December 19, 2019, (hereinafter: Law 9780), creates the National Commission for the Prevention and Attention of Drownings, hereinafter the Commission, as a technical body attached to the ICT, responsible for defining the guidelines and actions for the prevention and attention of drownings, through the implementation of lifeguard units and informational signage on national beaches.\n\n\n\n\n\nIV.-That, Article 5 of Law 9780 states that the Presidency of the Republic shall form and swear in the Commission, which will be composed of representatives designated, based on suitability, from the following institutions or organizations, whose term of appointment will be two years:\n\n\n\n\n\na) The ICT, which will chair it.\n\n\n\n\n\nb) The Costa Rican Red Cross.\n\n\n\n\n\nc) The Ministry of Public Security.\n\n\n\n\n\nd) The National Chamber of Tourism (CANATUR).\n\n\n\n\n\ne) The Ministry of Health.\n\n\n\n\n\nf) A representative of non-profit organizations, legally constituted for lifeguard work on national beaches.\n\n\n\n\n\ng) A representative for each of the provinces of Limón, Puntarenas, and Guanacaste, from the municipalities and the district municipal councils of the coastal zones.\n\n\n\n\n\nV.-That, in accordance with the provisions of Article 5 of Law 9780, the ICT will be responsible for coordinating the designation of the representatives indicated in subsections f) and g) of the cited article, and the procedure for this will be defined by regulation; therefore, this Executive Decree aims to fulfill said legal mandate.\n\n\n\n\n\nVI.-That, pursuant to Articles 12, 13, and 14 of the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Law No. 8220 of March 4, 2002 and its amendment, this proposal for an Executive Decree, by not creating, modifying, or establishing requirements or processes that the administered party must comply with, does not require the verification procedure for compliance with the principles of procedure simplification (cost and benefit form) before the Directorate of Regulatory Improvement of the Ministry of Economy, Industry and Commerce, which was ratified by that Directorate through Report DMR-DAR-INF-024-2020 of May 11, 2020, and official communication DMR-OF-250-2020 of May 18, 2020.\n\n\n\n\n\nVII.-That, this Executive Decree was approved by the Board of Directors of the ICT, by agreement taken in Virtual Ordinary Session No. 6118, Article 5, Subsection I, held on May 25, 2020. Therefore;\n\n\n\n\n\nTHEY DECREE:\n\n\n\n\n\nREGULATION FOR THE DESIGNATION OF THE\n\n\n\n\n\nREPRESENTATIVES OF THE NATIONAL COMMISSION\n\n\n\n\n\nFOR THE PREVENTION AND ATTENTION OF DROWNINGS\n\n\n\n\n\nESTABLISHED IN SUBSECTIONS F) AND G)\n\n\n\n\n\nOF ARTICLE 5 OF LAW No. 9780\n\n\n\n\n\nArticle 1.-Purpose. This regulation establishes the procedure under the responsibility of the Costa Rican Tourism Institute, (hereinafter ICT), to coordinate the designation of the representatives of the National Commission for the Prevention and Attention of Drownings, (hereinafter the Commission), established in subsections f) and g) of Article 5 of the Law \"Implementation of Lifeguard Units on National Beaches,\" Law No. 9780 of December 19, 2019 (hereinafter Law 9780).\n\n\n\n\n\n\n\n \n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 2.-Registry of the Organizations established in subsection f) of Article 5 of Law 9780. Non-profit organizations, legally constituted in the country for lifeguard work on national beaches (hereinafter the organizations), wishing to participate in the designation of a representative from among them to join the Commission, must register with the ICT. The ICT will enable a space for said registration on its institutional website, and an email address to receive registration requests, of which it will give notice through a publication in a newspaper of national circulation, stating the deadline for the registration process, which will be one month. To be registered, the organizations must submit a request indicating their full name, that of their legal representatives with their qualifications, an email address designated to receive notifications from the ICT, and a current digital certification that allows the ICT to verify their registration with the National Registry as a non-profit organization, according to the objectives of their articles of incorporation. Once the registration deadline has ended, the ICT will have one month to verify the information in the registration requests and to form the registry with those that met the cited requirements. This \"Registry of Lifeguard Organizations\" once formed, will be available to the public on the institutional website of the ICT.\n\n\n\n\n\n\n\n \n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 3.-Registry of the Municipalities and District Municipal Councils established in subsection g) of Article 5 of Law 9780. The ICT will ex officio create a registry of the Municipalities and District Municipal Councils of the coastal zones for each of the provinces of Limón, Puntarenas, and Guanacaste (hereinafter the local governments), which will contain the full name, qualifications, and email address to receive communications from the ICT, of the competent mayors or district intendants. This Registry will be available to the public on the institutional website of the ICT.\n\n\n\n\n\n\n\n \n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 4.-Designation Procedure. Once the registries indicated in Articles 2 and 3 of this Regulation are constituted and within ten calendar days following the day they are made available to the public on its institutional website, the ICT will notify the registered organizations and local governments, at their accredited email addresses, of the opening of a one-month period to send the ICT the written designation, or by digitally signed document and by agreement of the registered parties, of their candidates for representatives before the Commission. This designation, according to Article 5 of Law 9780, will be of one candidate for a full representative and one candidate for an alternate representative for each sector. In both cases, the designation of candidates by agreement must be sent to the ICT within one month from the day following receipt of the ICT's communication, and must be justified by a suitability analysis at the discretion of the organizations and local governments represented. The ICT may verify at any time the veracity of the candidacies by agreement that are accredited, by consulting the registered parties.\n\n\n\n\n\n\n\n \n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 5.-Transmission of designated candidates to the Presidency of the Republic for their appointment. Upon duly receiving the designations of the candidates for full and alternate representatives on the Commission as indicated in subsections f) and g) of Article 5 of Law 9780, the ICT will formally forward them, together with its suitability analysis, to the Presidency of the Republic. This shall be done within a maximum period of five business days after their receipt. It shall be the responsibility of the Presidency of the Republic, according to the provisions of the final paragraph of Article 5 of Law 9780, to appoint and swear in the representatives of the Commission, appointments that will be valid for two years from their swearing-in.\n\n\n\n\n\n\n\n \n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 6.-Reopening of the Registration and Designation procedure. Within six months prior to the expiration of the valid appointments of the representatives before the Commission established in subsections f) and g) of Article 5 of Law 9780, the ICT will reopen the \"Registration and Designation\" procedure established in Articles 2, 3, and 4 of this Regulation. Once the new candidacy designations are duly received, the ICT will proceed to send them to the Presidency of the Republic for appointment upon the conclusion of the corresponding period and according to the provisions of Article 5 of this Regulation. The ICT will proceed in the same manner in the event that, prior to their two-year expiration, the appointments of the full and alternate representatives of the Commission regulated by this Regulation are interrupted or rendered void by the Presidency of the Republic.\n\n\n\n\n\n\n\n \n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 7.-Deadline for the implementation of the Registries. The ICT will have a period of one calendar month from the entry into force of this Regulation for the implementation of the system for receiving requests for the \"Registry of Lifeguard Organizations\" and for the ex officio creation of the \"Registry of the Municipalities and District Municipal Councils of the coastal zones for each of the provinces of Limón, Puntarenas, and Guanacaste.\"\n\n\n\n\n\n\n\n \n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 8.-Effective Date.
