se procedió a llenar la Sección I denominada\n\"Control Previo de Mejora Regulatoria\" del \"Formulario de\nEvaluación Costo Beneficio\", siendo que la evaluación de la propuesta\nnormativa dio resultado negativo y que no contiene trámites, requisitos ni\nprocedimientos, por lo que se determinó que no se requería proseguir con el\nanálisis regulatorio de cita.\n\nPor tanto,\n\nDECRETAN:\n\nReforma los artículos 11, 13 párrafo segundo, 23 inciso p), 24, 28\ninciso p), 33, 34, 35,\n\ny 37 y derogatoria del artículo 36 del Decreto Ejecutivo N° 31857-MAG\n\"Reglamento\n\na la Ley del Instituto Nacional de Innovación y Transferencia en\nTecnología\n\nAgropecuaria (INTA), del 19 de mayo del 2004.\n\nArtículo 1º.- Refórmese los artículos 11,13 párrafo segundo, 23\ninciso p), 24, 28 inciso p), 33, 34, 35 y 37 del Decreto Ejecutivo No.\n31857-MAG de 19 de mayo del 2004 \"Reglamento a la Ley del Instituto\nNacional de Innovación y Transferencia en TecnologíaAgropecuaria (INTA).\"\npara que se lean de la siguiente manera:\n\n\"Artículo 11. -El INTA estará conformado por los siguientes\nórganos:\n\na) Una Junta Directiva conformada por siete miembros y un fiscal, y dos\nUnidades de naturaleza asesora, constituidas por una Auditoría Interna y una\nContraloría de Servicios.\n\nb) Una Dirección Ejecutiva, conformada por el Director(a) Ejecutivo (a)\ny cuatro Unidades constituidas por tres Unidades de carácter asesor, una Unidad\nde Planificación Institucional, una Unidad de Asesoría Jurídica y una Unidad de\nCooperación Técnica y una Unidad de Gestión de Información Técnica de carácter\noperativo.\n\nc) Una Dirección de Investigación y Desarrollo Tecnológico que estará\nconformada por los siguientes Departamentos:\n\n1. Departamento de Estaciones Experimentales el cual se divide en\ncuatro unidades a saber: Unidad Estación Experimental Enrique Jiménez Núñez\n(Región Chorotega), Unidad Estación Experimental Los Diamantes (Región Caribe),\nUnidad Estación Experimental Carlos Durán (Región Central Oriental) y Unidad\nEstación Experimental La Managua (Región Pacífico Central).\n\n5. Departamento de Estudios Básicos de Tierras.\n\nd) Una Dirección Administrativa Financiera que consta de los\nsiguientes tres Departamentos:\n\n1. Departamento de Proveeduría.\n\n2. Departamento de Servicios Generales y,\n\n3. Departamento de Administración de Recursos.\"\n\n\"Artículo 13. -El Instituto tendrá una Junta Directiva compuesta\npor siete miembros, en quienes recaerá la máxima dirección. Estará integrada de\nla siguiente manera: (.)\n\nA las sesiones de la Junta Directiva deberá asistir el Director\nEjecutivo del Instituto, quien tendrá voz, pero no voto. De igual manera el\nfiscal designado por la Junta Directiva. (.)\n\nArtículo 23. -Las funciones, los deberes, atribuciones y\nresponsabilidades de la Junta Directiva del Instituto son: (.)\n\np. Las funciones que se detallan en el Reglamento Interno de Funcionamiento\nde la Junta Directiva del Instituto Nacional de Innovación y Transferencia en\nTecnología Agropecuaria.\n\nArtículo 24. -Los órganos asesores de la Junta Directiva serán la\nAuditoría Interna y la Contraloría de Servicios, ambos dependerán\nJerárquicamente de la Junta Directiva, y asistirán a las sesiones cuando ésta\nlo solicite.\n\nLa Auditoria Interna fiscalizará con independencia funcional y de\ncriterio, las operaciones y la efectividad en la administración del riesgo, el\ncontrol y los procesos de dirección, así como asesorar en el ámbito de su\ncompetencia, contribuyendo en forma positiva y constructiva a la protección de\nlos recursos, el fortalecimiento del sistema de control interno y el logro de\nlos objetivos institucionales.\n\nFuncionará y se organizará de conformidad con lo señalado en el Capítulo\nIV de la Ley General de Control Interno Nº 8292, el Reglamento a dicha Ley, el\nReglamento de Organización y Funcionamiento de la Auditoría Interna y las\nnormas técnicas y disposiciones que emita la Contraloría General de la\nRepública. La Junta Directiva del INTA definirá y establecerá mediante\nacuerdos, las regulaciones de tipo administrativo aplicables al (la) Auditor(a)\nInterno (a) en los términos que señala el Artículo 24 de la Ley Nº 8292. El\n(la) Auditor (a) Interno (a) deberá presentar a la Junta Directiva el Plan\nAnual de Trabajo, un Informe Anual de su ejecución y del estado de\nrecomendaciones y disposiciones, sin perjuicio de que se elaboren otros\ninformes, en caso de que las circunstancias lo ameriten. Cuando lo considere\nnecesario, y sin detrimento de lo señalado en el Capítulo IV de la Ley Nº 8292,\nla Junta Directiva solicitará al (la) Auditor (a) Interno(a) incluir en el Plan\nAnual de Trabajo, auditorías o estudios especiales.\n\nLa Contraloría de Servicios funcionará y se organizará de conformidad\ncon las disposiciones del Capítulo II, Sección III de la Ley 9158 y el Capítulo\nIV del Decreto Ejecutivo 39096-PLAN y el Reglamento de Creación, Funcionamiento\ny Operación de la Contraloría de Servicios del Instituto Nacional de Innovación\ny Transferencia en Tecnología Agropecuaria, publicado en el Diario Oficial La\nGaceta N° 208, del 29 de octubre de 2014.\n\nArtículo 28. -Son atribuciones y deberes del Director Ejecutivo:\n(.)\n\np. Asignar funciones y responsabilidades a su equipo asesor y de apoyo\nconformado por la Unidad de Asesoría Jurídica del Instituto, la Unidad de\nPlanificación Institucional y la Unidad de Cooperación Técnica, así como lo\nconcerniente a las Áreas de Tecnologías de Información y Comunicación e Imagen Institucional.\n\nArtículo 33. -Las Unidades de carácter asesor de la Dirección\nEjecutiva serán la Unidad de Asesoría Jurídica, la Unidad de Cooperación\nTécnica y la Unidad de Planificación Institucional.\n\n1). Unidad de Planificación Institucional le corresponde\norientar el proceso de planificación estratégico y operativo del INTA en\nfunción de sus objetivos. Tendrá a su cargo las siguientes funciones:\n\na) Proponer lineamientos de política y acciones estratégicas y\noperativas para el INTA.\n\nb) Coordinar y participar activamente en la formulación del Plan\nEstratégico Institucional (PEI), como instrumento de mediano y largo plazo.\n\nc) Elaborar y proponer al jerarca institucional el Plan Operativo Anual\n(POA) y articular el Anteproyecto Anual de Presupuesto Institucional, de\nacuerdo con el Plan\nNacional de Desarrollo y de Inversión Pública (PNDIP)(*), el PEI y la\nlegislación vigente, para garantizar su financiamiento.\n\n(*)(Nota de Sinalevi: Así modificada su denominación por el inciso a) del artículo 43 del Reglamento\npara la Implementación de la Ley N°10441 del 13 de marzo del 2024 y el Funcionamiento del Sistema\nNacional de Inversión Pública, aprobado mediante decreto ejecutivo N° 45163 del 8 de agosto del\n2025. Anteriormente se indicaba \"Plan Nacional de Desarrollo (PND)\")\n\nd) Formular e implementar el Programa Estratégico Institucional de\nInversiones Públicas, con el apoyo de las Unidades Ejecutoras de la institución\nen el marco del Subsistema de Inversión Pública.\n\n \n\ne) Ser parte del sistema de seguimiento y evaluación (SINE) para la\nevaluación de la gestión gubernamental en relación con el desempeño\ninstitucional, el desarrollo del país y el bienestar ciudadano, por medio de un\nprocedimiento de análisis, monitoreo y evaluación de los resultados de las\nmetas establecidas en el PND, Plan Sectorial y en otros instrumentos de\nplanificación\n\nf) Aplicar los mecanismos de coordinación por parte de MIDEPLAN, Ministerio\nde Hacienda y Contraloría General de la República, para vincular los procesos\nde planificación, programación, ejecución presupuestaria, seguimiento y\nevaluación, y rendición de cuentas.\n\ng) Definir, implementar, aplicar y evaluar indicadores de eficiencia y\neficacia técnico administrativa y de impacto institucional, que permitan\nverificar la operación del Instituto.\n\nh) Acompañar, establecer la normativa, brindar asesoría y formar parte\nactiva en la formulación de programas y proyectos de inversión y planes de\nacción institucionales, así como los proyectos de investigación, alineados a\nlos Planes Estratégico Institucional, Plan sectorial y Plan Nacional de\nDesarrollo.\n\ni) Dar seguimiento a los convenios y contratos que suscribe el INTA que\ntengan relación directa con la ejecución de proyectos, así como seguimiento y\nevaluación técnica, administrativa y financiera a los proyectos.\n\nj) Mantener actualizada la base de datos de bienes adquiridos producto\nde la ejecución de los proyectos.\n\nk) Mantener estadísticas de las actividades de la institución\n(investigación, servicios, transferencia)\n\nl) Analizar, proponer, coordinar y ejecutar el diseño y rediseño de los\nprocesos de organización y administrativos para una adecuada gestión\ninstitucional, en cumplimiento a las funciones y disposiciones normativas\nestablecidas\n\nm) Desarrollar todas aquellas acciones que se deriven del cumplimiento\nde las funciones institucionales en relación con el SNP.\n\nn) Documentar, registrar y sistematizar la información de los planes,\nprogramas y proyectos.\n\no) Asesorar, apoyar, y formular proyectos estratégicos y prioritarios\npara el INTA, según directrices de la Dirección Ejecutiva, a las direcciones y\ndepartamentos del INTA interesados en la presentación de proyectos.\n\np) Mantener estrecha relación y coordinación con SEPSA y otras\ninstancias del Sector Agropecuario y de Ciencia y Tecnología.\n\nq) Coadyuvar en la redacción del informe para la rendición de cuentas a\nla sociedad costarricense.\n\nr) Cumplir las políticas, funciones, responsabilidades, procedimientos,\nmodelos de medición y metodología para la administración y control de los\ndistintos tipos de riesgo a que están expuestos los procesos de la Institución,\ncomo resultado de su operatividad.\n\ns) Revisar y validar formalmente la información suministrada por las\ndependencias en los formularios, matrices u otro documento específico que se\nrequiera en cada proceso.\n\nt) Coordinar la autoevaluación que conduzcan al perfeccionamiento del\nSistema de Control Interna del cual es responsable.\n\nu) Supervisar la implementación de registros o archivos permanentes y\ncentralizados de la documentación que respalde las acciones realizadas para\ncumplir con cada uno de los diferentes procesos de la institución.\n\nv) Cualquier otra que le asigne la Dirección Ejecutiva.\n\n2). Unidad de Asesoría Jurídica. Le corresponde asesorar y emitir criterios\nde manera eficaz y eficiente, en aquellos asuntos jurídicos sometidos a su\nconocimiento, conforme a la normativa nacional e internacional vigente a todo\nel Sector Agropecuario.\n\nEsta Unidad Asesora dependerá jerárquicamente de la Dirección Ejecutiva\ny tendrá a sucargo las siguientes funciones:\n\na) Asesorar y orientar al Jerarca en su quehacer para mejorar el aporte\njurídico dentro del proceso de toma de decisiones cuando así lo requiera.\n\nb) Brindar asesoría y acompañamiento a la Dirección Ejecutiva en el área\njurídica sobre las competencias y actos que realice el INTA en relación con los\nprocedimientos a seguir de conformidad con la Ley General de la Administración\nPública y la demás normativa aplicable.\n\nc) Elaborar proyectos de Ley, Decretos Ejecutivos, reglamentos u otros\ninstrumentos legales.\n\nd) Asesorar al personal del INTA en la aplicación de la normativa\nnacional e internacional en materia jurídica agroalimentaria.\n\ne) Garantizar la objetividad, imparcialidad y uniformidad de los\ncriterios emitidos por el INTA.\n\nf) Contribuir con los procesos de rendición de cuentas y evaluación de\nla gestión.\n\ng) Acompañar los procesos externos donde medien acciones de carácter\njurídico legal en defensa de los intereses institucionales a nivel judicial y\nadministrativo.\n\nh) Procurar soluciones alternativas a los conflictos que se originen en\nlas relaciones laborales inter orgánicas.\n\ni) Facilitar el acceso a la información jurídica confiable mediante los\nrecursos tecnológicos para la toma de decisiones institucionales.\n\nj) Atender, investigar, analizar, resolver, proponer y redactar\nconsultas y disposiciones de carácter jurídico.\n\nk) Elaborar y revisar las resoluciones, convenios, contratos, acuerdos,\nprocedimientos y cualquier otro documento jurídico que deba suscribir el INTA.\n\nl) Atender las instrucciones del jerarca en procedimientos\nadministrativos.\n\nm)Atender cualquier otra función que le sea asignada de carácter\njurídico.\n\n3). Unidad de Cooperación Técnica. Le corresponde identificar, planificar,\ncoordinar, programar y apoyar la obtención de recursos de Cooperación\nInternacional (técnica y financiera) y de pre-inversión, que requiere el INTA,\nde manera que contribuya al desarrollo eficaz y eficiente de la Institución, de\nlos productores agropecuarios y del Sector Agropecuario. Tendrá a su cargo las\nsiguientes funciones:\n\na) Participar activamente en los procesos y actividades de planificación\nestratégica y operativa del INTA.\n\nb) Recopilar, caracterizar y mantener actualizada la información sobre\nfuentes de cooperación técnica, de financiamiento, y contactos de organismos\nnacionales e internacionales, públicos o privados.\n\nc) Coordinar a lo interno del INTA y con otras direcciones del MAG e\ninstituciones de sector agropecuario, la identificación y formulación de\nproyectos integrales, mutidisciplinarios, interinstitucionales e\ninternacionales, según se amerite.\n\nd) Mantener un portafolio de convenios y cartas de entendimiento con universidades\ny centros de investigación a nivel internacional.\n\ne) Gestionar recursos con las fuentes de cooperación y financiera\nidentificadas y definir contactos para la eficiente tramitación y ejecución de\nlos proyectos.\n\nf) Mantener una estricta coordinación con los Ministerios de\nPlanificación Nacional y Política Económica, de Comercio Exterior, de\nRelaciones Exteriores y Culto y con entes de cooperación técnica y financiera\nde índole internacional, bilateral y multilateral.\n\ng) Establecer protocolos internos para llevar a cabo las negociaciones y\nformalización de tratados o convenios nacionales o internacionales.\n\nh) Tramitar los informes requeridos por los entes cooperantes nacionales\ne internacionales, y por cualquier otra dependencia que así lo requiera.\n\ni) Mantener actualizado el inventario de proyectos en trámite y en\nejecución.\n\nj) Proponer el establecimiento de convenios o similares de interés del\nINTA con instituciones públicas o privadas nacionales o internacionales\n\nk) Solicitar y canalizar las solicitudes de recursos al nivel interno\ndel INTA.\n\nl) Mantener constante comunicación con los representantes regionales del\nINTA, para identificar y establecer vínculos de cooperación con organizaciones\ny empresas.\n\nm) Promover la asociatividad y el trabajo colaborativo para el\ndesarrollo de proyectos de investigación e innovación.\n\nn) Representar al INTA ante las diversas instituciones u organizaciones\npor delegación del Director Ejecutivo\n\no) Cualquier otra que le asigne la Dirección Ejecutiva.\n\nArtículo 34. -La Unidad Gestión de Información Técnica\n(U.G.I.T.) es la Unidad de carácter operativo de la Dirección Ejecutiva que\nserá la encargada de acopiar, clasificar, ordenar, seleccionar, conservar,\nadministrar y facilitar mediante informes técnicos, la información generada en\ncada proceso de innovación (investigación, validación, verificación, estudios\nespeciales, servicios y transferencia) ordenada en archivos físico y digital; y\nclasificada en expedientes de acuerdo a un código alfanumérico. Funcionará y se\norganizará de conformidad con lo señalado en el Reglamento de Gestión de la\nInformación Técnica del Instituto Nacional de Innovación y Transferencia en\nTecnología Agropecuaria (INTA).\n\nArtículo 35. -Dirección de Investigación y Desarrollo Tecnológico. Esta Dirección\nagrupa la parte técnica de la institución y está conformada por cinco\nDepartamentos: el Departamento de Investigación e Innovación, Departamento de\nTransferencia de Tecnología, Departamento de Laboratorios, Departamento de\nEstaciones Experimentales y Departamento de Estudios Básicos de Tierras. A esta\nDirección le corresponde brindar apoyo a los investigadores para la generación\nde tecnología, la transferencia de tecnología, la prestación de servicios de\ninvestigación en laboratorios, estaciones experimentales y en la gestión los\nestudios básicos de la tierra, con el fin de responder eficientemente a las\ndemandas de los usuarios de los servicios. Las funciones de esta Dirección son:\n\n1. De la Dirección de Investigación y Desarrollo Tecnológico. A esta Dirección le\ncorresponde:\n\na) Participar activamente en los procesos y actividades de planificación\nestratégica y operativa del INTA.\n\nb) Ejercer la jefatura inmediata de los Jefes de Departamento y\nsupervisión del personal de la Dirección a su cargo.\n\nc) Consolidar, priorizar y dar respuesta a las necesidades de\ninvestigación, innovación y transferencia de tecnología que demandan los\nusuarios en los ámbitos local, regional y nacional.\n\nd) Coordinar, asesorar y orientar la investigación y la transferencia de\ntecnología agropecuaria, para cumplir con los objetivos y metas establecidas en\nlas políticas institucionales.\n\ne) Participar de manera activa en la revisión y supervisión de proyectos\nde investigación, innovación y transferencia de tecnología.\n\nf) Mantener estrecha vinculación con el Sistema Nacional de\nInvestigación y Transferencia de Tecnología Agropecuaria (SNITTA), los\nservicios de información del sector agropecuario, la Dirección Nacional de\nExtensión Agropecuaria y otros organismos nacionales y externos, dedicados a la\ngeneración de ciencia y tecnología.\n\ng) Formular y elaborar documentos técnicos y administrativos para los\njerarcas.\n\nh) Rendir cuentas a las autoridades superiores.\n\ni) Cualquier otra que le asigne la Dirección Ejecutiva.\n\n2. Del Departamento de Investigación e Innovación. Este Departamento\ncuenta con cinco Unidades que son: Unidad de Granos Básicos, Unidad de\nHortalizas, Unidad de Raíces y Tubérculos, Unidad de Frutales y Unidad\nPecuaria. A este departamento le corresponde:\n\na) Identificar y priorizar las necesidades de investigación e innovación\nde tecnología agropecuaria al nivel local, regional y nacional, de acuerdo con\nel sistema productivo particular tomando en cuenta la agrocadena.\n\nb) Formular y ejecutar proyectos de investigación e innovación,\nutilizando el método científico en el área de su competencia alcanzando los\nobjetivos y metas propuestas en beneficio de los productores.\n\nc) Validar la tecnología generada de los proyectos de su competencia,\nque permita valorar su pertinencia técnica y mejorar la efectividad de su\nadopción por parte de los usuarios.\n\nd) Asesorar en áreas específicas complementarias de investigación\nagropecuaria, tales como protección de cultivos, mejoramiento genético,\nagronomía, bioestadística, socio economía y otras relacionadas.\n\ne) Participar activamente en los procesos y actividades de planificación\nestratégica y operativa del INTA.\n\nf) Coordinar y colaborar con el Departamento de Transferencia de\nTecnología, la difusión de las opciones tecnológicas generadas por el INTA.\n\ng) Desarrollar vínculos con el Sistema Nacional de Investigación y\nTransferencia de Tecnología Agropecuaria -SNITTA-, los servicios de información\ndel Sector Agropecuario, la Dirección Nacional de Extensión Agropecuaria y\notros organismos dedicados a la ciencia y tecnología del Sector Agropecuario y\nen el nivel científico nacional e internacional.\n\nh) Formular el consolidado del PAO/ Presupuesto y Plan de compras.\n\ni) Elaborar informes anuales, semestrales y técnicos.\n\nj) Coordinar reuniones y sesiones de trabajo con los grupos técnicos\nintegrantes de cada unidad y de otras unidades para la elaboración de proyectos\nde investigación e innovación.\n\nk) Redactar artículos científicos u otras publicaciones técnicas a fin\nde divulgar apropiadamente la labor del INTA en el ámbito nacional e\ninternacional.\n\nl) Cualquier otra que le asigne la Dirección de Investigación y\nDesarrollo Tecnológico.\n\n3. Del Departamento de Transferencia de Tecnología. Las funciones de\neste Departamento son:\n\na) Recopilar, caracterizar y sistematizar las opciones tecnológicas\nverificadas y/o validadas para transferirlas a los diferentes usuarios.\n\nb) Alimentar y actualizar permanentemente las plataformas técnicas\ninstitucionales de información tecnológica.\n\nc) Diseñar, coordinar, organizar y ejecutar eventos de capacitación y\ndifusión de la información tecnológica a través de los diferentes servicios de\nextensión estatales y privados.\n\nd) Solicitar, centralizar y canalizar solicitudes de recursos al nivel\ninterno del INTA.\n\ne) Diseñar y aplicar las metodologías, mecanismos y herramientas de\ngestión de conocimiento, información, comunicación y transferencia de acuerdo\ncon los diferentes usuarios y tipologías de producción.\n\nf) Promover, auspiciar y difundir la publicación de documentos técnicos.\n\ng) Mantener estrecha coordinación con el Sistema Nacional de\nInvestigación y Transferencia de Tecnología Agropecuaria SNITTA-, los servicios\nde información del Sector Agropecuario y el servicio de extensión del Estado.\n\nh) Promover alianzas con organizaciones de productores, instituciones\npúblicas y privadas de carácter nacional e internacional, en materia de su\ncompetencia.\n\ni) Cualquier otra que le asigne la Jefatura de la Dirección.\n\n4. Del Departamento de Laboratorios. A este departamento le corresponde la\nimplementación de metodologías, el análisis de muestras, emisión de\ndiagnósticos, la multiplicación in vitro de germoplasma y ejecución de estudios\nespecíficos que complementen las líneas de investigación, innovación y\nvalidación de la Dirección de Investigación y Desarrollo Tecnológico por lo que\ncontará con personal multidisciplinario, profesionales y técnicos formados en\nlos diferentes campos de acción que aseguren su competencia.\n\nEl Departamento estará conformado por áreas laboratoriales que le\npermitan ejecutar las siguientes funciones:\n\na) Desarrollar los procedimientos e implementar metodologías para\nanálisis y diagnósticos en fitoprotección, nutrición animal, química y física\nde suelos, plantas y aguas, características química y microbiológica de insumos\nagrícolas y abonos orgánicos, entre otros requeridos en la institución que\nsoporten el respaldo científico de las investigaciones.\n\nb) Acompañar el mejoramiento genético asistido por marcadores\nmoleculares.\n\nc) Desarrollar e implementar técnicas de reproducción masiva de\ngermoplasma de interés.\n\nd) Apoyar el desarrollo y ejecución de propuestas de investigación según\nlos lineamientos institucionales.\n\ne) Desarrollar y actualizar los procedimientos y actividades técnicas y\nadministrativas del Departamento.\n\nf) Brindar servicios a usuarios en el área de su competencia según las\ntarifas autorizadas por la Junta Directiva.\n\ng) Coordinar con el Departamento de Transferencia de Tecnología la\ncapacitación a funcionarios y Usuarios en materias de su competencia.\n\nh) Coordinar con otras dependencias internas o externas a fin de\nejecutar actividades especiales requeridas en el sector agropecuario, de\nacuerdo con las competencias y capacidades del Departamento.\n\ni) Desarrollar otras funciones que le asigne el superior jerárquico.\n\n5. Del Departamento de Estaciones Experimentales. Este Departamento se\nencuentra sub dividido en cuatro estaciones, Estación Experimental Enrique\nJiménez Núñez (Región Chorotega), Estación Experimental Los Diamantes (Región\nCaribe), Estación Experimental Carlos Durán (Región Central Oriental), Estación\nExperimental La Managua (Región Pacífico Central), cada una con nivel de\nunidad, las cuales se diferencian por su especificidad en el abordaje de temas\ny cultivos con base a su ubicación geográfica (regiones agro climáticas), las\ncuales apoyarán la investigación, innovación y validación que desarrolle la\nDirección de Investigación y Desarrollo Tecnológico. A este departamento le\ncorresponde:\n\na) Brindar servicios al sector agropecuario de acuerdo a sus necesidades\ncolocando productos de alta calidad e importancia para el sector.\n\nb) Contribuir al mejoramiento y la sostenibilidad del sector\nagropecuario, por medio de la generación, innovación, validación, investigación\ny difusión de tecnología, en beneficio de la sociedad costarricense.\n\nc) Coordinar con el Departamento de Transferencia de Tecnología la\ncapacitación a funcionarios y usuarios en materias de su competencia.\n\nd) Apoyar la investigación, innovación y validación que lideran\nfuncionarios de la Dirección de Investigación y Desarrollo Tecnológico.\n\ne) Conservar las colecciones de germoplasma para abastecer de material\ngenético de calidad a la investigación y la producción nacional.\n\nf) Articular el desarrollo de proyectos de investigación, innovación,\nvalidación, transferencia y producción que realiza el INTA.\n\ng) Atender las necesidades de información, asesoría, servicios y\nproductos tecnológicos agropecuarias de los técnicos y productores.\n\nh) Captar las necesidades de investigación, innovación y transferencia\nde tecnología para el análisis integral de la demanda en el INTA y la\nelaboración del Plan Anual Táctico y Anual Operativo de cada estación, para\natender con información, capacitación, servicios y productos a la investigación\ny producción.\n\ni) Establecer Centros de Información y de capacitación a profesionales,\ntécnicos y agricultores en las diferentes zonas agroecológicas, en coordinación\ncon el Departamento de Transferencia de Tecnología.\n\nj) Desarrollar proyectos de acuerdo a necesidades de la región mediante\niniciativa Institucional o en coordinación con otras Instituciones o instancias\ndel área de influencia o el país.\n\nk) Realizar las gestiones pertinentes para la operación de cada uno de\nlos rubros, proyectos o programas desarrollados en cada unidad, a fin de velar\npor la respectiva fiscalización y uso eficiente de los recursos.\n\nl) Realizar ventas de servicios de investigación agropecuaria de\nconformidad con lo estipulado siempre y cuando, no menoscabe la atención de las\ndemandas de investigaciones de interés social.\n\nm)Velar por el cuido y resguardo de los semovientes y cultivos que se\nencuentran en sus Estaciones Experimentales, así como su venta cuando proceda,\nde conformidad con Reglamento Interno para la Venta de Servicios y Bienes\naccesorios y las tarifas aprobadas por la Junta Directiva del INTA.\n\nn) Cualquier otra que le sea asignada por la Jefatura Inmediata.\n\n6. Del Departamento de Estudios Básicos de Tierras. Con sustento en lo\nestipulado en el Artículo 20 de la ley N°8149, este Departamento coadyuvará en\nla realización de estudios relativos al uso conforme del suelo, clasificación y\nzonificación agroecológica de los cultivos, así como la planificación y\nordenamiento territorial con una participación en la elaboración y ejecución de\nlos planes nacionales de manejo, conservación y recuperación de suelos, como lo\nestablece la ley para el Uso, Manejo y Conservación de Suelos número 7779 y su\nReglamento, de igual manera colaborará con la Dirección de Investigación y\nDesarrollo Tecnológico, en las investigaciones e innovaciones que se\ndesarrollen.\n\nA este departamento le corresponde:\n\na) Realizar las investigaciones y estudios relativos a lo autorizado en\nlos Artículos 6 incisos a), b) y c), 27, 49 y 66 de la Ley N°7779 y de los\ndecretos ejecutivos N°29375-MAG-MINAE-S-H-MOPT y N°30636-MAG, en materia de uso\nconforme del suelo, emisión de criterio técnico para autorizaciones y permisos.\n\nb) Vender servicios a usuarios en el área de su competencia según las\ntarifas autorizadas por la Junta Directiva.\n\nc) Realizar levantamientos semidetallados de suelos y capacidad de uso\nde las tierras agroecológicas del país, así como la zonificación agroecológica\nde los cultivos, en el marco de la planificación y ordenamiento territorial,\napoyando la ejecución de los Planes Nacionales de manejo, conservación y\nrecuperación de suelos.\n\nd) Colaborar con la Dirección de Investigación y Desarrollo Tecnológico\ndel INTA, en las investigaciones e innovaciones que se desarrollen.\n\ne) Solicitar, centralizar y canalizar las solicitudes de recursos al\nnivel interno del INTA.\n\nf) Mantener las bases de datos actualizadas y disponibles para los\nusuarios en materia de suelos, tierras y aguas correspondiente a la información\ngenerada por el INTA.\n\ng) Participar en los estudios de zonificación agropecuaria en el ámbito\nnacional, regional o local, para contribuir a orientar la producción en forma\neficiente.\n\nh) Mantener actualizado el sistema de información geográfico para\nfacilitar el ordenamiento territorial en el mediano y largo plazos.\n\ni) Cualquier otra que le asigne la Jefatura de la Dirección.\n\nArtículo 37.-Dirección Administrativa-Financiera. Le corresponde\ncoordinar y tomar decisiones en temas administrativos propios del INTA, así\ncomo ser el enlace con otras instituciones y entidades para la planeación y\nejecución de presupuesto, gestión de recursos, aprovisionamiento de bienes y\nservicios, comunicación, planeación y desarrollo de programas y proyectos.\n\nEsta Dirección contará con tres Unidades Administrativas: el\nDepartamento de Proveeduría, el Departamento de Servicios Generales y el\nDepartamento de Administración de Recursos. A esta Dirección le corresponden\nlas siguientes funciones:\n\na) Planear, coordinar y supervisar las funciones administrativas de\napoyo, necesarias para alcanzar el adecuado funcionamiento técnico,\nadministrativo y financiero del\n\nINTA.\n\nb) Elaborar y tramitar en coordinación con el resto de dependencias del\nINTA los presupuestos ordinarios y extraordinarios; así como los informes de\nejecución correspondientes.\n\nc) Elaborar en coordinación con los Departamentos competentes los\nestudios y propuestas para la actualización y ajuste de tarifas por pago de\nproductos y servicios del INTA, las cuales deben ser aprobadas por la Junta\nDirectiva.\n\nd) Proponer a la Dirección Ejecutiva los proyectos de reglamentos,\nmanuales, procedimientos e instructivos necesarios para la gestión\nadministrativa y financiera del INTA.\n\ne) Rendir cuentas a las autoridades superiores del INTA.\n\nf) Administrar los recursos físicos y financieros del INTA.\n\ng) Velar porque el INTA mantenga una adecuada posición financiera.\n\nh) Cualquier otra que le asigne la Dirección Ejecutiva.\n\n2. Del Departamento de Proveeduría. Su funcionamiento se encuentra amparado en la\nLey de Contratación Administrativa Número 7494 y su Reglamento; es el\nDepartamento competente para tramitar los procedimientos de contratación\nadministrativa que interesen al Instituto, así como para realizar los procesos\nde almacenamiento y distribución o tráfico de bienes y llevar un inventario\npermanente de todos sus bienes. Funcionará y se organizará de conformidad con\nlo señalado en el Reglamento para el Funcionamiento de las Proveedurías\nInstitucionales de los Ministerios del Gobierno Número 30640-H y el Reglamento\npara el registro y control de bienes de la administración central y reforma\nReglamento a la Ley de la Administración Financiera de la República y\nPresupuestos Públicos Número 40797-H, así como demás normativa atinente.\n\n3. Del Departamento de Servicios Generales. Rige a partir de su publicación en el Diario\nOficial.\n\nDado en la Presidencia de la República a los veinte días del mes de\noctubre del año dos mil veinte.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Regulation 42683\n\n Amendment to the Regulation of the Law of the National Institute of Innovation and\nTransfer in Agricultural Technology (INTA)\n\nFull Text record: 17ACD1\n\nNº 42683-MAG\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF AGRICULTURE AND LIVESTOCK\n\nIn exercise of the powers established in articles 140, subsections 3),\n18) and 20, 146 of the Political Constitution; articles 25, 27 and 28 subsection 2.\nParagraph b), of Law Nº 6227 of May 2, 1978, General Law of Public\nAdministration and Law Nº 8149 of November 5, 2001, Law Creating the National\nInstitute of Innovation and Transfer in Agricultural Technology.\n\nWHEREAS:\n\n1º-That Law Nº 8149 of November 5, 2001, published on November\n22, 2001 in La Gaceta Nº 225, creates the National Institute of Innovation and\nTransfer in Agricultural Technology -INTA- as a body of maximum\ndeconcentration of the Ministry of Agriculture and Livestock.\n\n2º-That the objective of the Institute established by Law is to contribute to\nthe improvement and sustainability of the Agricultural Sector, through the\ngeneration, innovation, validation, research and dissemination of technology, for the\nbenefit of Costa Rican society with a projection to the international\ncommunity.\n\n3º-That it is necessary to update the organizational structure of the\ninstitution and obtain improvements in its actions within the framework of the\nagricultural sector, so that the institution adapts to the needs of its\nusers and this allows for effective service provision and development of\nagricultural research since the current organizational structure is\nnot suitable to respond to the current needs and demands of the agricultural sector,\nas well as to achieve the reduction of institutional procedures, improvement in\ndecision-making and the control and monitoring of institutional\nresults.\n\n4º- That by means of Official Letters DM-689-17 of October 11, 2017 and\nDM-1185-2019 of August 12, 2019, the Ministerial Office of the\nMinistry of National Planning and Economic Policy (MIDEPLAN) approved the\nnew organizational structure of the National Institute of Innovation and\nTransfer in Agricultural Technology (INTA) and by means of official letter\nMIDEPLAN-DM-OF-413-2020 of April 8, 2020 approved the change in\nnomenclature of the Department of Basic Land Studies.\n\n5º- That in accordance with the second and third paragraphs of article\n12 bis of the Regulation to the Law for the Protection of Citizens from Excessive\nAdministrative Requirements and Procedures, Executive Decree N° 37045-MP-MEIC of\nFebruary 22, 2012; Section I called\n\"Prior Control of Regulatory Improvement\" of the \"Cost-Benefit\nEvaluation Form\" was completed, with the evaluation of the regulatory\nproposal yielding a negative result and containing no procedures, requirements, or\nprocedures, so it was determined that it was not necessary to continue with the\naforementioned regulatory analysis.\n\nTherefore,\n\nTHEY DECREE:\n\nAmendment of articles 11, 13 second paragraph, 23 subsection p), 24, 28\nsubsection p), 33, 34, 35,\n\nand 37 and repeal of article 36 of Executive Decree N° 31857-MAG\n\"Regulation\n\nto the Law of the National Institute of Innovation and Transfer in\n\nAgricultural Technology (INTA), of May 19, 2004.\n\nArticle 1º.- Amend articles 11, 13 second paragraph, 23\nsubsection p), 24, 28 subsection p), 33, 34, 35 and 37 of Executive Decree No.\n31857-MAG of May 19, 2004 \"Regulation to the Law of the National Institute of\nInnovation and Transfer in Agricultural Technology (INTA).\"\nso that they read as follows:\n\n\"Article 11. -INTA shall be composed of the following\nbodies:\n\na) A Board of Directors composed of seven members and a comptroller, and two\nAdvisory Units, consisting of an Internal Audit and a\nService Comptrollership.\n\nb) An Executive Directorate, composed of the Executive Director\nand four Units consisting of three advisory Units, an\nInstitutional Planning Unit, a Legal Advisory Unit and a\nTechnical Cooperation Unit and a Technical Information Management Unit of an operational\nnature.\n\nc) A Directorate of Research and Technological Development which shall be\ncomposed of the following Departments:\n\n1. Department of Research and Innovation, composed of\nfive units, Basic Grains Unit, Vegetables Unit, Roots\nand Tubers Unit, Fruit Crops Unit and Livestock Unit.\n\n2. Department of Technology Transfer.\n\n3. Department of Laboratories.\n\n4. Department of Experimental Stations which is divided into\nfour units, namely: Enrique Jiménez Núñez Experimental Station Unit\n(Chorotega Region), Los Diamantes Experimental Station Unit (Caribbean Region),\nCarlos Durán Experimental Station Unit (Central Eastern Region) and La Managua\nExperimental Station Unit (Central Pacific Region).\n\n5. Department of Basic Land Studies.\n\nd) A Financial Administrative Directorate consisting of the\nfollowing three Departments:\n\n1. Procurement Department.\n\n2. General Services Department and,\n\n3. Resource Administration Department.\"\n\n\"Article 13. -The Institute shall have a Board of Directors composed\nof seven members, in whom the highest direction shall reside. It shall be integrated\nas follows: (.)\n\nThe Executive Director of the Institute must attend the\nsessions of the Board of Directors, having a voice but no vote. Likewise, the\ncomptroller designated by the Board of Directors. (.)\n\nArticle 23. -The functions, duties, powers and\nresponsibilities of the Institute's Board of Directors are: (.)\n\np. The functions detailed in the Internal Rules of Procedure\nof the Board of Directors of the National Institute of Innovation and Transfer in\nAgricultural Technology.\n\nArticle 24. -The advisory bodies to the Board of Directors shall be the\nInternal Audit and the Service Comptrollership, both of which shall depend\nhierarchically on the Board of Directors, and shall attend sessions when it\nso requests.\n\nThe Internal Audit shall oversee, with functional and criteria independence,\nthe operations and the effectiveness of risk administration,\ncontrol and governance processes, as well as advise within its scope\nof competence, contributing positively and constructively to the protection of\nresources, the strengthening of the internal control system and the achievement of\ninstitutional objectives.\n\nIt shall function and be organized in accordance with the provisions of Chapter\nIV of the General Law of Internal Control Nº 8292, the Regulation to said Law, the\nRegulation of Organization and Operation of the Internal Audit and the\ntechnical standards and provisions issued by the Comptroller General of the\nRepublic. The Board of Directors of INTA shall define and establish through\nagreements, the administrative regulations applicable to the Internal\nAuditor in the terms indicated by Article 24 of Law Nº 8292. The\nInternal Auditor must present to the Board of Directors the Annual\nWork Plan, an Annual Report of its execution and the status of\nrecommendations and provisions, without prejudice to the preparation of other\nreports, should circumstances warrant it. When it deems it\nnecessary, and without detriment to the provisions of Chapter IV of Law Nº 8292,\nthe Board of Directors shall request the Internal Auditor to include in the Annual\nWork Plan, special audits or studies.\n\nThe Service Comptrollership shall function and be organized in accordance\nwith the provisions of Chapter II, Section III of Law 9158 and Chapter\nIV of Executive Decree 39096-PLAN and the Regulation for the Creation, Operation\nand Functioning of the Service Comptrollership of the National Institute of Innovation and\nTransfer in Agricultural Technology, published in the Official Gazette La\nGaceta N° 208, of October 29, 2014.\n\nArticle 28. -The powers and duties of the Executive Director are:\n(.)\n\np. Assign functions and responsibilities to his/her advisory and support team\ncomposed of the Institute's Legal Advisory Unit, the Institutional\nPlanning Unit and the Technical Cooperation Unit, as well as matters\nconcerning the Information and Communication Technologies and Institutional Image Areas.\n\nArticle 33. -The advisory Units of the Executive\nDirectorate shall be the Legal Advisory Unit, the Technical\nCooperation Unit and the Institutional Planning Unit.\n\n1). Institutional Planning Unit is responsible for\nguiding the strategic and operational planning process of INTA in\naccordance with its objectives. It shall be in charge of the following functions:\n\na) Propose policy guidelines and strategic and operational\nactions for INTA.\n\nb) Coordinate and actively participate in the formulation of the Institutional\nStrategic Plan (PEI), as a medium- and long-term instrument.\n\nc) Prepare and propose to the institutional head the Annual Operational Plan\n(POA) and articulate the Preliminary Draft Annual Institutional Budget, in\naccordance with the National Public\nDevelopment and Investment Plan (PNDIP)(*), the PEI and the\nlegislation in force, to guarantee its financing.\n\n(*)(Note from Sinalevi: Name thus modified by subsection a) of article 43 of the Regulation\nfor the Implementation of Law N°10441 of March 13, 2024 and the Operation of the National\nPublic Investment System, approved by executive decree N° 45163 of August 8,\n2025. Previously it was stated as \"National Development Plan (PND)\")\n\nd) Formulate and implement the Strategic Institutional\nPublic Investment Program, with the support of the institution's Executing Units\nwithin the framework of the Public Investment Subsystem.\n\n \n\ne) Be part of the monitoring and evaluation system (SINE) for the\nevaluation of governmental management in relation to institutional\nperformance, the country's development and citizen welfare, through a\nprocedure of analysis, monitoring and evaluation of the results of the\ngoals established in the PND, Sectoral Plan and other planning\ninstruments\n\nf) Apply the coordination mechanisms by MIDEPLAN, Ministry\nof Finance and Comptroller General of the Republic, to link the processes\nof planning, programming, budget execution, monitoring and\nevaluation, and accountability.\n\ng) Define, implement, apply and evaluate indicators of technical-administrative efficiency and\neffectiveness and institutional impact, which allow\nverifying the operation of the Institute.\n\nh) Accompany, establish regulations, provide advice and be an active\npart in the formulation of investment programs and projects and institutional action\nplans, as well as research projects, aligned with\nthe Institutional Strategic Plans, Sectoral Plan and National\nDevelopment Plan.\n\ni) Follow up on the agreements and contracts signed by INTA that\nare directly related to project execution, as well as technical,\nadministrative and financial monitoring and evaluation of the projects.\n\nj) Keep the database of assets acquired as a result\nof project execution updated.\n\nk) Maintain statistics of the institution's activities\n(research, services, transfer)\n\nl) Analyze, propose, coordinate and execute the design and redesign of\norganizational and administrative processes for adequate institutional\nmanagement, in compliance with established functions and regulatory\nprovisions\n\nm) Develop all those actions derived from the fulfillment of\ninstitutional functions in relation to the SNP.\n\nn) Document, record and systematize the information of plans,\nprograms and projects.\n\no) Advise, support, and formulate strategic and priority projects\nfor INTA, according to directives of the Executive Directorate, for the directorates and\ndepartments of INTA interested in submitting projects.\n\np) Maintain close relationship and coordination with SEPSA and other\ninstances of the Agricultural Sector and Science and Technology.\n\nq) Contribute to the drafting of the report for accountability to\nCosta Rican society.\n\nr) Comply with the policies, functions, responsibilities, procedures,\nmeasurement models and methodology for the administration and control of the\ndifferent types of risk to which the Institution's processes are exposed,\nas a result of its operation.\n\ns) Formally review and validate the information provided by\nthe units in the forms, matrices or other specific document\nrequired in each process.\n\nt) Coordinate the self-evaluation that leads to the improvement of the\nInternal Control System for which it is responsible.\n\nu) Supervise the implementation of permanent and centralized records or files\nof the documentation supporting the actions taken to\ncomply with each of the institution's different processes.\n\nv) Any other assigned by the Executive Directorate.\n\n2). Legal Advisory Unit. It is responsible for advising and issuing criteria\neffectively and efficiently, on those legal matters submitted for its\nknowledge, in accordance with the national and international regulations in force for the entire\nAgricultural Sector.\n\nThis Advisory Unit shall depend hierarchically on the Executive Directorate\nand shall be in charge of the following functions:\n\na) Advise and guide the Head in their work to improve the legal\ncontribution within the decision-making process when so required.\n\nb) Provide advice and support to the Executive Directorate in the legal\narea on the competencies and acts carried out by INTA in relation to the\nprocedures to be followed in accordance with the General Law of Public\nAdministration and other applicable regulations.\n\nc) Draft bills, Executive Decrees, regulations or other\nlegal instruments.\n\nd) Advise INTA personnel on the application of national\nand international regulations in agri-food legal matters.\n\ne) Guarantee the objectivity, impartiality and uniformity of the\ncriteria issued by INTA.\n\nf) Contribute to the processes of accountability and evaluation of\nmanagement.\n\ng) Accompany external processes involving legal-legal actions\nin defense of institutional interests at the judicial and\nadministrative level.\n\nh) Seek alternative solutions to conflicts that arise in\ninter-organizational labor relations.\n\ni) Facilitate access to reliable legal information through\ntechnological resources for institutional decision-making.\n\nj) Address, investigate, analyze, resolve, propose and draft\nconsultations and provisions of a legal nature.\n\nk) Prepare and review resolutions, agreements, contracts,\nprocedures and any other legal document that INTA must sign.\n\nl) Address the instructions of the head in administrative\nprocedures.\n\nm) Attend to any other function assigned that is of a\nlegal nature.\n\n3). Technical Cooperation Unit. It is responsible for identifying, planning,\ncoordinating, programming and supporting the procurement of International\nCooperation resources (technical and financial) and pre-investment, required by INTA,\nin a way that contributes to the effective and efficient development of the Institution,\nagricultural producers and the Agricultural Sector. It shall be in charge of the\nfollowing functions:\n\na) Actively participate in the strategic and operational planning\nprocesses and activities of INTA.\n\nb) Collect, characterize and keep updated information on\nsources of technical and financial cooperation, and contacts of national\nand international organizations, public or private.\n\nc) Coordinate internally within INTA and with other directorates of the MAG and\ninstitutions of the agricultural sector, the identification and formulation of\ncomprehensive, multidisciplinary, inter-institutional and\ninternational projects, as warranted.\n\nd) Maintain a portfolio of agreements and memoranda of understanding with universities\nand research centers at the international level.\n\ne) Manage resources with the identified cooperation and financial\nsources and define contacts for the efficient processing and execution of\nprojects.\n\nf) Maintain strict coordination with the Ministries of\nNational Planning and Economic Policy, Foreign Trade,\nForeign Affairs and Worship and with technical and financial cooperation entities\nof an international, bilateral and multilateral nature.\n\ng) Establish internal protocols for carrying out negotiations and\nformalizing national or international treaties or agreements.\n\nh) Process the reports required by national and international\ncooperating entities, and by any other unit that so requires.\n\ni) Keep the inventory of projects in process and in\nexecution updated.\n\nj) Propose the establishment of agreements or similar of interest\nto INTA with public or private national or international institutions\n\nk) Request and channel resource requests at the internal level\nof INTA.\n\nl) Maintain constant communication with INTA's regional representatives,\nto identify and establish cooperation links with organizations\nand companies.\n\nm) Promote associativity and collaborative work for the\ndevelopment of research and innovation projects.\n\nn) Represent INTA before various institutions or organizations\nby delegation of the Executive Director\n\no) Any other assigned by the Executive Directorate.\n\nArticle 34. -The Technical Information Management Unit\n(U.G.I.T.) is the operational Unit of the Executive Directorate which\nshall be responsible for collecting, classifying, ordering, selecting, preserving,\nadministering and facilitating, through technical reports, the information generated in\neach innovation process (research, validation, verification, special\nstudies, services and transfer) organized in physical and digital files; and\nclassified in case files according to an alphanumeric code. It shall function and\nbe organized in accordance with the provisions of the Regulation for the Management of\nTechnical Information of the National Institute of Innovation and Transfer in\nAgricultural Technology (INTA).\n\nArticle 35. -Directorate of Research and Technological Development. This Directorate\ngroups the technical part of the institution and is composed of five\nDepartments: the Department of Research and Innovation, Department of\nTechnology Transfer, Department of Laboratories, Department of\nExperimental Stations and Department of Basic Land Studies. This\nDirectorate is responsible for providing support to researchers for the generation\nof technology, the transfer of technology, the provision of research\nservices in laboratories, experimental stations and in the management of\nbasic land studies, in order to efficiently respond to the\ndemands of service users. The functions of this Directorate are:\n\n1. Directorate of Research and Technological Development. This Directorate is\nresponsible for:\n\na) Actively participating in the strategic and operational planning\nprocesses and activities of INTA.\n\nb) Exercising immediate supervision over the Department Heads and\nsupervision of the personnel of the Directorate under its charge.\n\nc) Consolidating, prioritizing and responding to the needs for\nresearch, innovation and transfer of technology demanded by\nusers at the local, regional and national levels.\n\nd) Coordinating, advising and guiding agricultural research and\ntechnology transfer, to meet the objectives and goals established in\ninstitutional policies.\n\ne) Actively participating in the review and supervision of projects\nfor research, innovation and transfer of technology.\n\nf) Maintaining close connections with the National System of\nAgricultural Technology Research and Transfer (SNITTA), the\ninformation services of the agricultural sector, the National Directorate of\nAgricultural Extension and other national and external organizations dedicated to the\ngeneration of science and technology.\n\ng) Formulating and drafting technical and administrative documents for the\nheads.\n\nh) Rendering accounts to superior authorities.\n\ni) Any other assigned by the Executive Directorate.\n\n2. Department of Research and Innovation. This Department\nhas five Units which are: Basic Grains Unit, Vegetables\nUnit, Roots and Tubers Unit, Fruit Crops Unit and Livestock\nUnit. This department is responsible for:\n\na) Identifying and prioritizing the needs for research and innovation\nof agricultural technology at the local, regional and national level, in accordance with\nthe particular production system taking into account the agricultural chain.\n\nb) Formulating and executing research and innovation projects,\nusing the scientific method in its area of competence, achieving the\nproposed objectives and goals for the benefit of producers.\n\nc) Validating the technology generated from projects within its competence,\nallowing assessment of its technical relevance and improving the effectiveness of its\nadoption by users.\n\nd) Advising in specific complementary areas of agricultural\nresearch, such as crop protection, genetic improvement,\nagronomy, biostatistics, socio-economics and other related areas.\n\ne) Actively participating in the strategic and operational planning\nprocesses and activities of INTA.\n\nf) Coordinating and collaborating with the Department of Technology\nTransfer, the dissemination of technological options generated by INTA.\n\ng) Developing links with the National System of Agricultural\nTechnology Research and Transfer -SNITTA-, the information services\nof the Agricultural Sector, the National Directorate of Agricultural Extension and\nother organizations dedicated to science and technology of the Agricultural Sector and\nat the national and international scientific level.\n\nh) Formulating the consolidated PAO/Budget and Procurement Plan.\n\ni) Preparing annual, semi-annual and technical reports.\n\nj) Coordinating meetings and working sessions with the technical groups\ncomprising each unit and other units for the development of\nresearch and innovation projects.\n\nk) Drafting scientific articles or other technical publications in order\nto appropriately disseminate the work of INTA at the national and\ninternational level.\n\nl) Any other assigned by the Directorate of Research and\nTechnological Development.\n\n3. Department of Technology Transfer. The functions of\nthis Department are:\n\na) Collecting, characterizing and systematizing verified\nand/or validated technological options to transfer them to different users.\n\nb) Permanently feeding and updating the institutional technical\nplatforms for technological information.\n\nc) Designing, coordinating, organizing and executing training and\ndissemination events for technological information through the different\nstate and private extension services.\n\nd) Requesting, centralizing and channeling resource requests at the internal\nlevel of INTA.\n\ne) Designing and applying methodologies, mechanisms and tools for\nknowledge management, information, communication and transfer according\nto the different users and production typologies.\n\nf) Promoting, sponsoring and disseminating the publication of technical documents.\n\ng) Maintaining close coordination with the National System of Agricultural\nTechnology Research and Transfer -SNITTA-, the information services\nof the Agricultural Sector and the state extension service.\n\nh) Promoting alliances with producer organizations, public\nand private institutions of a national and international nature, in matters of\nits competence.\n\ni) Any other assigned by the Head of the Directorate.\n\n4. Department of Laboratories. This department is responsible for the\nimplementation of methodologies, the analysis of samples, issuance of\ndiagnoses, the in vitro multiplication of germplasm and execution of specific\nstudies that complement the lines of research, innovation and\nvalidation of the Directorate of Research and Technological Development, therefore it\nshall have multidisciplinary personnel, professionals and technicians trained in\nthe different fields of action to ensure their competence.\n\nThe Department shall be composed of laboratory areas that\nallow it to execute the following functions:\n\na) Develop procedures and implement methodologies for\nanalysis and diagnoses in plant protection, animal nutrition, soil, plant and water chemistry and\nphysics, chemical and microbiological characteristics of agricultural\ninputs and organic fertilizers, among others required in the institution to\nsupport the scientific backing of research.\n\nb) Support genetic improvement assisted by molecular\nmarkers.\n\nc) Develop and implement techniques for the mass reproduction of\ngermplasm of interest.\n\nd) Support the development and execution of research proposals according to\ninstitutional guidelines.\n\ne) Develop and update the technical and administrative\nprocedures and activities of the Department.\n\nf) Provide services to users in its area of competence according to the\nrates authorized by the Board of Directors.\n\ng) Coordinate with the Department of Technology Transfer the\ntraining of officials and Users in matters of its competence.\n\nh) Coordinate with other internal or external units in order to\nexecute special activities required in the agricultural sector, in\naccordance with the competencies and capacities of the Department.\n\ni) Perform other functions assigned by the hierarchical superior.\n\n5. Department of Experimental Stations. This Department is\nsub-divided into four stations, Enrique\nJiménez Núñez Experimental Station (Chorotega Region), Los Diamantes Experimental Station (Caribbean\nRegion), Carlos Durán Experimental Station (Central Eastern Region),\nLa Managua Experimental Station (Central Pacific Region), each at the unit\nlevel, which are differentiated by their specificity in addressing themes\nand crops based on their geographic location (agro-climatic regions), which\nshall support the research, innovation and validation developed by the\nDirectorate of Research and Technological Development. This department\nis responsible for:\n\na) Providing services to the agricultural sector according to its needs\nby placing high-quality products of importance for the sector.\n\nb) Contributing to the improvement and sustainability of the\nagricultural sector, through the generation, innovation, validation, research\nand dissemination of technology, for the benefit of Costa Rican society.\n\nc) Coordinating with the Department of Technology Transfer the\ntraining of officials and users in matters of its competence.\n\nd) Supporting the research, innovation and validation led by\nofficials of the Directorate of Research and Technological Development.\n\ne) Conserving germplasm collections to supply quality\ngenetic material for research and national production.\n\nf) Articulating the development of research, innovation,\nvalidation, transfer and production projects carried out by INTA.\n\ng) Addressing the needs for information, advice, services and\nagricultural technological products of technicians and producers.\n\nh) Capturing the needs for research, innovation and transfer\nof technology for the comprehensive analysis of demand at INTA and the\npreparation of the Annual Tactical and Annual Operational Plan of each station, to\naddress information, training, services and products for research\nand production.\n\ni) Establishing Information and Training Centers for professionals,\ntechnicians and farmers in the different agroecological zones, in coordination\nwith the Department of Technology Transfer.\n\nj) Developing projects according to the needs of the region through\nInstitutional initiative or in coordination with other Institutions or entities\nin the area of influence or the country.\n\nk) Carrying out the relevant procedures for the operation of each of the\nline items, projects or programs developed in each unit, in order to ensure\nthe respective oversight and efficient use of resources.\n\nl) Conducting sales of agricultural research services in\naccordance with what is stipulated, as long as it does not undermine the attention to\nsocially relevant research demands.\n\nm) Ensuring the care and safeguarding of livestock and crops that are\nin its Experimental Stations, as well as their sale when appropriate,\nin accordance with the Internal Regulation for the Sale of Services and\nAncillary Goods and the rates approved by the Board of Directors of INTA.\n\nn) Any other assigned by the Immediate Supervisory Head.\n\n6. Department of Basic Land Studies. Based on what is\nstipulated in Article 20 of Law N°8149, this Department shall contribute to\nconducting studies related to the proper use of land, agroecological classification\nand zoning of crops, as well as land-use planning\nand territorial planning with a participation in the preparation and execution of\nnational plans for soil management, conservation and recovery, as\nestablished by the Law for the Use, Management and Conservation of Soils number 7779 and its\nRegulation, likewise it shall collaborate with the Directorate of Research and\nTechnological Development, in the research and innovations that are\ndeveloped.\n\nThis department is responsible for:\n\na) Conduct investigations and studies related to what is authorized in Articles 6 subsections a), b) and c), 27, 49 and 66 of Law No. 7779 and of Executive Decrees No. 29375-MAG-MINAE-S-H-MOPT and No. 30636-MAG, regarding conforming land use (uso conforme del suelo), issuance of technical criteria for authorizations and permits.\n\nb) Sell services to users in its area of competence according to the rates authorized by the Board of Directors.\n\nc) Conduct semi-detailed soil surveys and agroecological land capability (capacidad de uso de las tierras) assessments of the country, as well as agroecological zoning (zonificación agroecológica) of crops, within the framework of land-use planning and land management (planificación y ordenamiento territorial), supporting the execution of the National Plans for soil management, conservation, and recovery.\n\nd) Collaborate with the INTA Directorate of Research and Technological Development in the research and innovations developed.\n\ne) Request, centralize, and channel resource requests at INTA’s internal level.\n\nf) Maintain updated databases available to users regarding soils, lands, and waters corresponding to the information generated by INTA.\n\ng) Participate in agricultural zoning studies at the national, regional, or local level to contribute to efficiently guiding production.\n\nh) Keep the geographic information system updated to facilitate land management (ordenamiento territorial) in the medium and long terms.\n\ni) Any other duty assigned by the Directorate Head.\n\nArticle 37.—Administrative-Financial Directorate. It is responsible for coordinating and making decisions on INTA’s own administrative matters, as well as serving as the liaison with other institutions and entities for budget planning and execution, resource management, procurement of goods and services, communication, and the planning and development of programs and projects.\n\nThis Directorate shall have three Administrative Units: the Procurement Department, the General Services Department, and the Resource Administration Department. This Directorate has the following functions:\n\na) Plan, coordinate, and supervise the administrative support functions necessary to achieve the proper technical, administrative, and financial functioning of\n\nINTA.\n\nb) Prepare and process, in coordination with the rest of INTA’s units, the ordinary and extraordinary budgets; as well as the corresponding execution reports.\n\nc) Prepare, in coordination with the competent Departments, the studies and proposals for updating and adjusting rates for the payment of INTA products and services, which must be approved by the Board of Directors.\n\nd) Propose to the Executive Directorate the draft regulations, manuals, procedures, and instructions necessary for INTA’s administrative and financial management.\n\ne) Render accounts to INTA’s higher authorities.\n\nf) Administer INTA’s physical and financial resources.\n\ng) Ensure that INTA maintains an adequate financial position.\n\nh) Any other duty assigned by the Executive Directorate.\n\n2. The Procurement Department. Its operation is governed by the Administrative Contracting Law Number 7494 and its Regulations; it is the Department competent to process the administrative contracting procedures of interest to the Institute, as well as to carry out the processes of storage and distribution or movement of goods and to keep a permanent inventory of all its assets. It shall function and be organized in accordance with the provisions of the Regulation for the Operation of Institutional Procurement Departments of the Government Ministries Number 30640-H and the Regulation for the registration and control of assets of the central administration and reform Regulation to the Law of the Financial Administration of the Republic and Public Budgets Number 40797-H, as well as other applicable regulations.\n\n3. The General Services Department. This Department has the following functions:\n\na) Prepare and manage the approval and application of the procedure manuals for its processes.\n\nb) Plan, direct, coordinate, and supervise the technical and administrative activities related to the provision of transportation services.\n\nc) Design and implement the administrative processes required for the proper functioning of the Institute.\n\nd) Establish and execute general and preventive maintenance plans for equipment, movable, and immovable property.\n\ne) Any other duty assigned by its immediate Supervisor.\n\n4. The Resource Administration Department. This Department has the following functions:\n\na) Prepare and manage the corresponding approvals of the regulations, procedure manuals, and instructions that are necessary in administrative, financial, budgetary, and accounting matters.\n\nb) Prepare and apply the regulations and manuals necessary to regulate the service relationship between INTA and its officials, to foster a healthy work environment and achieve the optimization of human resources.\n\nc) Prepare the accounting and budget records and prepare the corresponding statements and reports in accordance with accepted standards and techniques regarding PAO-Presupuesto.\n\nd) Control and safeguard financial resources and movable and immovable property.\n\ne) Coordinate the formulation of the budget with the Institutional Planning Unit and other INTA Directorates.\n\nf) Process and negotiate with the appropriate parties the budgets necessary for the proper functioning of INTA.\n\ng) Any other duty assigned by the Head of the Administrative-Financial Directorate.\n\nArticle 2.—Article 36 of Executive Decree No. 31857-MAG of May 19, 2004, \"Regulation to the Law of the National Institute of Innovation and Transfer\n\n in Agricultural Technology (INTA),\" is repealed.\n\nArticle 3.—Effective Date.
