y 28\ninciso 2) acápite b) de la Ley General de la Administración Pública Nº6227 del\n2 de mayo de 1978; y los artículos 2inciso c), 17 y 28 de la Ley Orgánica del\nAmbiente Nº7554 del 4 de octubre de 1995.\n\nConsiderando:\n\n1º- Que mediante Decreto Ejecutivo N°32967-MINAE, del 20 de febrero de 2006,\nse establece el \"Manual de Instrumentos Técnicos para el Proceso de\nEvaluación del Impacto Ambiental (Manual de EIA)-Parte III\", cuyo anexo N°\n1 establece el \"Procedimiento técnico para la introducción de la variable\nambiental en los planes reguladores u otra planificación de uso del\nsuelo\".\n\n2º- Que el Decreto Ejecutivo N°32967-MINAE, en su Anexo N° 1, refiere a\ngeneralidades relativas a la cartografía involucrada en el procedimiento\núnicamente en los numerales 5.14.3.1, 6.11.3 y 7.1.1. Asimismo, su anexo N° 5,\nrefiere al tema cartográfico únicamente en el Numeral 1.\n\n3º- Que el informe de la Contraloría General de la República N°\nDFOE-AE-IF-00008-2017 (Auditoría operativa acerca de la eficacia y eficiencia\ndel proceso de Evaluación Ambiental Estratégica en la SETENA), señala que \".el\nDecreto Ejecutivo N° 32967-MINAE, Manual de instrumentos técnicos para\nel proceso de evaluación de impacto ambiental (Manual de EIA)-Parte III,\ny sus anexos, no especifican los elementos técnicos que deben incluir los mapas\nde los estudios sometidos al análisis de la SETENA\".\n\n4º- Que el mismo informe de la Contraloría General de la República (N°\nDFOE-AE-IF- 00008-2017), señala que deben observarse una serie de normas\ntécnicas previamente emitidas por el ente competente en la materia, indicando:\n\n \"2.47. Al respecto, existen\nNormas técnicas de información geográfica emitidas por el Instituto Geográfico\nNacional (IGN), entre ellas la NTIG_CR01_02.2016, Catálogo de Objetos\nGeográficos para Datos Fundamentales de Costa Rica, para propiciar la\nestandarización de la información geoespacial que se genere en el país.\n\nTambién, la norma NTIG_CR04_01.2016 Perfil Oficial de Metadatos\nGeográficos de Costa Rica, la cual establece los elementos mínimos que deben\ncontener los metadatos de la cartografía que se elabore, según el formato de\nelaboración Raster o Shapefile\".\n\n5º- Que mediante directriz DIR-DIG-001-2016 del Instituto Geográfico\nNacional, se establece la Norma Técnica \"NTIG_CR01_01.2016: Sistema de\nReferencia Geodésico de Costa Rica\", en donde se señala que \"Las\ndisposiciones contenidas en esta Directriz y respectiva Norma Técnica\nson de acatamiento obligatorio\", siendo que su alcance indica que:\n\n\"La Norma Técnica NTIG_CR01_01.2016: Sistema de Referencia\nGeodésico de Costa Rica, constituye un marco de referencia de carácter general\nsobre los requisitos mínimos que deben observar los funcionarios y usuarios del\nInstituto Geográfico Nacional, y en general, el sector público (Poderes de la\nRepública, instituciones autónomas y semiautónomas, entes adscritos a\ninstituciones autónomas, empresas públicas estatales, empresas públicas no\nestatales, entes públicos no estatales, entes administradores de fondos\npúblicos, municipalidades y órganos municipales adscritos), sector privado,\npersonas físicas y público en general, productor, gestor y usuario para la\ngeorreferenciación de objetos geográficos (OG) al sistema nacional de\nreferencia de nuestro país\".\n\n6º- Que mediante directriz DIR-DIG-002-2016 del Instituto Geográfico\nNacional, se establece la Norma Técnica de Información Geográfica \"NTIG_\nCR02_01.2016: Catálogo de Objetos Geográficos para Datos Fundamentales de Costa\nRica\", siendo que el mismo \"constituye un marco de referencia\ngeneral sobre los requisitos mínimos que debe observar este Instituto,\notras entidades públicas, sector privado y público en general: productores,\ngestores y usuarios de información geográfica georreferenciada\", y\nrespecto a su obligatoriedad se ha señalado que \"Las disposiciones\ncontenidas en esta Directriz y respetiva Norma Técnica son de acatamiento\nobligatorio\".\n\n7º- Que mediante directriz DIR-DIG-003-2016 del Instituto Geográfico\nNacional, se establece la Norma Técnica de Información Geográfica \"NTIG_\nCR03_01.2016: Modelo de datos geográficos de Costa Rica, escalas 1:1.000, 1:5.000\ny 1:25.000\", siendo que así se \"constituye un marco de referencia\ngeneral sobre los requisitos mínimos que debe observar este Instituto,\notras entidades públicas, sector privado y público en general: productores,\ngestores y usuarios de información geográfica georreferenciada\", y\nrespecto a su obligatoriedad se ha señalado que \"Las disposiciones\ncontenidas en esta Directriz y respetiva Norma Técnica son de\nacatamiento obligatorio\".\n\n8º- Que mediante directriz DIR-DIG-004-2016 del Instituto Geográfico Nacional,\nse establece la Norma Técnica de Información Geográfica\n\"NTIG_CR04_01.2016: Perfil Oficial de Metadatos Geográficos de Costa\nRica\", siendo que dicha norma técnica \"constituye un marco de\nreferencia de carácter general sobre los requisitos mínimos que deben\nobservar los funcionarios y usuarios del Instituto Geográfico Nacional, y en\ngeneral, el sector público (Poderes de la República, instituciones\nautónomas y semiautónomas, entes adscritos a instituciones autónomas,\nempresas públicas estatales, empresas públicas no estatales, entes\npúblicos no estatales, entes administradores de fondos públicos, municipalidades\ny órganos municipales adscritos), sector privado, personas físicas y público\nen general, productor, gestor y usuario para la descripción de datos\ngeográficos, informe sobre su contenido, ofrezca al usuario la posibilidad de\ntener trazabilidad sobre su origen (fuentes, autor, etc.) y facilite la\nbúsqueda de información geográfica de una forma rápida y eficaz\". Respecto\na su obligatoriedad se ha señalado que \"Las disposiciones contenidas\nen esta Directriz y respetiva Norma Técnica son de acatamiento\nobligatorio\".\n\n9º- Que, según consulta efectuada por la SETENA al Instituto Geográfico\nNacional, ese ente técnico ha indicado en oficio DIG-0567-2017 del 7 de\ndiciembre de 2017 que \".el Catálogo de Objetos Geográficos para\nDatos Fundamentales de Costa Rica (NTIG_CR02_01.2016), el Sistema de\nReferencia Geodésico de Costa Rica (NTIG_CR01_01.2016), el Modelo de\nDatos Geográficos de Costa Rica Escalas 1:1.000, 1:5.000 y 1:25.000\n(NTIG_CR03_01.2016) y el Perfil Oficial de Metadatos Geográficos de Costa\nRica (NTIG_CR04_01.2016), forman parte directa e indirectamente de los\nrequisitos que deben aplicarse en los estudios de Índices de Fragilidad\nAmbiental (IFA´s) realizados por la SETENA, para el cumplimiento de la\nDisposición 4.9 contenida en el Informe N° DFOE-AE-IF-00008 2017 del 14 de\njulio de 2017 emitido por la Contraloría General de la República.\"\n\n10º- Que en el mismo oficio DIG-0567-2017 del 7 de diciembre de 2017, el\nInstituto Geográfico Nacional indica que la SETENA debe elaborar y someter a\nvalidación de dicho ente, el Catálogo de Objetos Geográficos Temáticos de\ninterés específico para la SETENA, pero que en tanto este proceso se\ndesarrolla, SETENA debe hacer referencia a las normas del Catálogo de Objetos\nGeográficos para Datos Fundamentales de Costa Rica (NTIG_CR02_01.2016) y el\nModelo de Datos Geográficos de Costa Rica Escalas 1:1.000, 1:5.000 y 1:25.000\n(NTIG_CR03_01.2016), cuando se refieran a objetos geográficos que se encuentran\nincluidos total o parcialmente en la versión publicada y oficial. Asimismo, se\nindica que la SETENA debe aplicar por completo las normas: Sistema de\nReferencia Geodésico de Costa Rica (NTIG_CR01_01.2016) y el Perfil Oficial de\nMetadatos Geográficos de Costa Rica (NTIG_CR04_01.2016).\n\n11º-Que, de conformidad con el Reglamento a la Ley de Protección al\nCiudadano del Exceso de Requisitos y Trámites Administrativos, Decreto\nEjecutivo Nº 37045-MP-MEIC y sus reformas, la presente propuesta cumple con los\nprincipios de mejora regulatoria según el informe positivo DMR-DAR-INF-050-2020\ndel 02 de septiembre de 2020, emitido por la Dirección de Mejora Regulatoria\ndel MEIC.\n\nPor tanto;\n\nDECRETAN:\n\n\"Especificaciones para Cartografía de la Variable Ambiental en\nPlanes de\n\nOrdenamiento Territorial\"\n\nArtículo 1°. Objetivo. El presente Reglamento tiene por objetivo detallar\nlos numerales 5.14.3.1, 6.11.3 y 7.1.1 del Anexo 1 y el numeral 1 del Anexo 5,\ntodos ellos del Decreto Ejecutivo N°32967-MINAE \"Manual de Instrumentos\nTécnicos para el Proceso de Evaluación del Impacto Ambiental (Manual de\nEIA)-Parte III\" y de conformidad con el marco de referencia vigente que el\nInstituto Geográfico Nacional (IGN) ha establecido para el país, mediante las\ndirectrices DIR-DIG-001-2016; DIR-DIG-002-2016, DIR-DIG-003- 2016 y\nDIR-DIG-004-2016; a fin de que la información geográfica que SETENA requiera\ncomo parte de los estudios técnicos de la incorporación de la variable\nambiental en planes de ordenamiento territorial, se elabore y presente conforme\na las normas técnicas vigentes establecidas por el IGN.\n\nArtículo 2°. Ámbito de Aplicación. Para todo tipo de plan de ordenamiento\nterritorial (con excepción de los Planes de Manejo de Refugios Mixtos de Vida\nSilvestre), la cartografía de la incorporación de la variable ambiental se\nagrupa en 5 temáticas: 1. Geoaptitud, 2. Bioaptitud, 3. Edafoaptitud, 4.\nAntropoaptitud, 5. Otros: IFA integrado, IFA subclase, Zonificación ambiental,\nCondición de uso de la tierra.\n\nPara el caso de los Planes de Manejo de los Refugios Mixtos de Vida\nSilvestre, el detalle técnico de los requerimientos de la cartografía, serán\nseñalados por la Comisión Plenaria de la SETENA en la respectiva Resolución de\nContenidos Mínimos de Referencia para cada caso en particular.\n\nArtículo 3. Cartografía para todo tipo de plan de ordenamiento\nterritorial (con excepción de los Planes de Manejo de Refugios Mixtos de Vida\nSilvestre). La siguiente tabla detalla la cartografía mínima que estos planes\ndeberán contener:\n\n \n\n| | 1. In this regard, there are\nTechnical norms of geographic information issued by the National Geographic\nInstitute (IGN), among them NTIG_CR01_02.2016, Catalog of Geographic\nObjects for Fundamental Data of Costa Rica, to promote the\nstandardization of geospatial information generated in the country.\n\nAlso, the norm NTIG_CR04_01.2016 Official Profile of Geographic\nMetadata of Costa Rica, or partially in the published and official version. All cartography\nfor the incorporation of the environmental variable that is presented before SETENA shall\nbe submitted in two formats: digital and printed.\n\nIn the case of the digital format, it must be submitted as shapefiles,\nraster, or another similar format compatible with the QGIS program; on an external\nstorage device such as a USB, DVD, or similar that can remain\nat SETENA as part of the administrative file kept for each case or\nplan.\n\nIn the case of the printed format, each map must be submitted in a\nmaximum size of double letter, properly folded and as part of the corresponding\ntechnical study (environmental fragility index, environmental scoping\nanalysis, sustainable development regulation). In cases where the proponent\nso requires, they may additionally provide an atlas containing the\nmaps printed at whatever size they deem necessary to improve the detail of the\ncartographic representation.\n\nArticle 5. Compliance with the current technical directives of the\nNational Geographic Institute. The Catalog of Geographic Objects for Fundamental\nData of Costa Rica (NTIG_CR02_01.2016) and the Geographic Data\nModel of Costa Rica Scales 1:1,000, 1:5,000, and 1:25,000\n(NTIG_CR03_01.2016), shall be applied when the cartography refers to geographic\nobjects that are totally or partially included in the published and official\nIGN version; this while the Catalog of Thematic Geographic\nObjects of specific interest to SETENA is developed\nby said Secretariat and validated by the IGN.\n\nThe Geodetic Reference System of Costa Rica (NTIG_CR01_01.2016) and\nthe Official Profile of Geographic Metadata of Costa Rica (NTIG_CR04_01.2016),\nshall be applied in all cases.\n\nArticle 6.
