Que además, son de\ninterés público las actividades destinadas a conservar, mejorar y, en lo\nposible, a recuperar la diversidad biológica del territorio nacional, para cuya\nejecución se tomarán en cuenta los parámetros definidos por el Poder Ejecutivo,\nasí como los siguientes criterios: a) La protección y la conservación de los\necosistemas naturales, la diversidad de las especies, la diversidad genética en\nel territorio nacional y la vigilancia de las zonas de reproducción; b) El\nmanejo de la diversidad biológica integrado a la planificación de cualquier\nactividad relativa a los elementos del ambiente.\n\n3º-Que según lo dispone la Ley de Biodiversidad N° 7788 del 30 de abril\nde 1998, publicada en La Gaceta N° 101 del 27 de mayo de 1998, en su\nnumeral séptimo, la biodiversidad se encuentra compuesta por la variabilidad de\norganismos vivos de cualquier fuente y contempla el conocimiento, la\ninnovación, la práctica tradicional, individual y colectiva.\n\n4º-Que según los artículos 49 y 53 de la misma Ley de Biodiversidad N°\n7788, el mantenimiento de los procesos ecológicos es un deber del Estado y los\nciudadanos. Para tal efecto, el Ministerio de Ambiente y Energía y los demás\nentes públicos pertinentes, tomando en cuenta la legislación específica vigente,\ndictarán las normas técnicas adecuadas y utilizarán mecanismos para su\nconservación. Además, la restauración, recuperación y rehabilitación de los\necosistemas, las especies y los servicios ambientales que brindan, deben ser\nfomentadas por el Ministerio de Ambiente y Energía y los demás entes públicos,\nsegún lo establece el mismo cuerpo de normas.\n\n5º-Que la Estrategia Nacional de Conservación y Uso Sostenible de la\nBiodiversidad estableció dentro de las acciones estratégicas para el país, el\ndesarrollo de experiencias de manejo activo con fines de conservación in\nsitu.\n\n6º-Que las condiciones actuales del cambio global, impulsan al Estado a\nfomentar actividades de desarrollo regenerativo que se basen en la regeneración\nde paisajes funcionales.\n\n7º-Que la ciencia investigativa cumple un rol fundamental para la toma\nde decisiones oportunas y adecuadas para la conservación.\n\n8º-Que la gestión colaborativa constituye un proceso donde se toma en\ncuenta la integración entre sociedad, ambiente y economía, con el fin de\nrestaurar la capacidad del paisaje de ofrecer bienes y servicios ecosistémicos\na la sociedad, de una manera sostenible, que es compatible con el régimen de\ngobernanza por gobierno de los bienes de dominio público.\n\n9º-Que de acuerdo con los artículos 9° y 21 del Reglamento a la Ley de\nBiodiversidad, Decreto Ejecutivo N° 34433-MINAE del 11 de marzo del 2008,\npublicado en La Gaceta N° 68 del 08 de abril del 2008, el Área de\nConservación Arenal Tempisque (ACAT) es una de las Áreas de Conservación que\nconstituyen el Sistema Nacional de Áreas de Conservación (SINAC) y por ende se\nencuentra bajo su administración.\n\n10.-Que el Estado vela por el desarrollo en el cantón de Abangares que\nmejore la calidad de vida de sus pobladores, promoviendo actividades que\nfomenten la riqueza cultural y ambiental, contribuyendo a su vez, con la\nadecuada conservación ecorregional.\n\n11.-Que mediante el Decreto Ejecutivo N° 39964-H del 21 de setiembre del\n2016, publicado en el Alcance N° 254 a La Gaceta N° 216, del 10 de\nnoviembre del 2016, se asignó al Ministerio de Ambiente y Energía, el inmueble\ninscrito con matrícula de Folio Real 124599-000 ubicado en la provincia de\nGuanacaste, cantón 7 Abangares, distrito 1 Las Juntas, caserío Santa Lucía;\ncuya naturaleza es terreno con varias edificaciones, plantaciones maderables,\náreas de regeneración natural de bosque secundario y pastos. Actualmente constituye\ninmueble inscrito a nombre del Ministerio de Ambiente y Energía, bajo\nadministración del Sistema Nacional del Áreas de Conservación, a través del\nÁrea del Conservación Arenal Tempisque.\n\n12.-Que conforme lo dicta el artículo segundo de la Ley Forestal N°\n7575, del 13 de febrero de 1996, publicada en La Gaceta N° 72 del 16 de\nabril de 1996, las plantaciones forestales tienen como objetivo principal la\nproducción y aprovechamiento de madera, ello sin perjuicio de otros objetivos\nque se determine.\n\n13.-Que de conformidad con el Reglamento a la Ley de Protección al\nCiudadano del Exceso de Requisitos y Trámites Administrativos, Decreto\nEjecutivo N° 37045-MP-MEIC y sus reformas, se determinó que la presente\npropuesta no establece ni modifica trámites, requisitos o procedimientos, que\nel administrado deba cumplir, situación por la que no se procedió con el\ntrámite de control previo. Por tanto,\n\nDecretan:\n\n\"DECLARATORIA DEL INMUEBLE INSCRITO CON\n\nMATRÍCULA DE FOLIO REAL 124599-000 DE LA\n\nPROVINCIA DE GUANACASTE, COMO FINCA\n\nEXPERIMENTAL CERRITOSPARA LA CONSERVACIÓN\n\nDE ECOSISTEMAS Y ESPECIES\n\nDEL BOSQUEHÚMEDO TROPICAL\"\n\nArtículo 1º-Declaración. Declárase al inmueble inscrito con matrícula\nde Folio Real 124599-000 de la provincia de Guanacaste, como Finca Experimental\nCerritos para la conservación de ecosistemas y especies del bosque húmedo\ntropical.\n\n \n\n Ficha articulo\n\nArtículo 2º-Objeto. La finca ubicada en la provincia de Guanacaste,\ncantón 7 Abangares, distrito 1 Las Juntas, con un área de 5.058.681.00 metros\ncuadrados, plano catastrado G0717569-2001, que es inmueble del Ministerio de\nAmbiente y Energía, con varias edificaciones, plantaciones maderables, áreas de\nregeneración natural de bosque secundario y pastos, será el objeto de la\npresente declaratoria.\n\n \n\n Ficha articulo\n\nArtículo 3º-Régimen. La Finca Experimental Cerritos para la\nconservación de ecosistemas y especies del bosque húmedo tropical, se conforma\nbajo un régimen de uso mixto según se detalla:\n\na) Sector 1: Constituido por bosques, terrenos forestales y de aptitud\nforestal; constituyendo Patrimonio Natural del Estado. Para la realización y\naprobación de actividades en este sector, rige con lo dispuesto en los\nartículos 18 y 18 Bis de la Ley Forestal N° 7575 y normativa conexa.\n\nb) Sector 2: Constituido por áreas sin cobertura forestal y con infraestructura.\nEn este sector podrá desarrollarse actividades relacionadas con cualquiera de\nlos objetivos establecidos en el presente Reglamento, siempre que bajo criterio\ntécnico de la Administración resulte procedente.\n\n \n\n Ficha articulo\n\nArtículo 4º-Administración. La Finca Experimental Cerritos para\nla conservación de ecosistemas y especies del bosque húmedo tropical, será\nadministrada por el Sistema Nacional de Áreas de Conservación, a través del\nÁrea de Conservación Arenal Tempisque.\n\n \n\n Ficha articulo\n\nArtículo 5º-Objetivos. Serán objetivos de la Finca Experimental\nCerritos para la conservación de ecosistemas y especies del bosque húmedo\ntropical, que se desarrollarán según se permita de conformidad con la\nsectorización establecida en el presente Decreto Ejecutivo:\n\na) Fomentar la conservación del ecosistema y especies de bosque húmedo\ntropical, mediante un modelo representativo y replicable de protección hacia\nespecies indicadoras, especies sombrilla, especies bandera, especies focales;\ntipos de biomas y procesos ecológicos propios de la ecorregión.\n\nb) Generar un espacio de interés científico para la experimentación como\nmecanismo para la protección efectiva de la biodiversidad ecorregional.\n\nc) Generar un modelo de desarrollo regenerativo bajo gestión colaborativa\nque integre de forma armoniosa, la protección y uso racional de los diferentes\nelementos de la diversidad biológica, incluyendo el conocimiento, las\ntradiciones y la innovación.\n\nd) Manejar los recursos naturales y ecosistemas presentes, bajo criterio\ntécnico y científico, de manera que logren mantener sus atributos ecológicos\nclave y la provisión de los servicios ecosistémicos.\n\ne) Brindar protección especial y usar sosteniblemente, el recurso hídrico\ny los sistemas acuáticos presentes en el sitio.\n\n \n\n Ficha articulo\n\nArtículo 6º-Actividades. Para el cumplimiento de los objetivos se\npodrán fomentar y desarrollar las siguientes actividades:\n\na) Mantener mediante regeneración natural, la conservación de una\nmuestra representativa de los ecosistemas originales del sitio.\n\nb) Crear un banco de semillas de especies forestales y de flora silvestre,\npropias del bosque húmedo tropical.\n\nc) Establecer un vivero con especies forestales nativas para proveer proyectos\nde reforestación en la ecorregión.\n\nd) Desarrollar experimentalmente técnicas para la rehabilitación y\nrestauración de ecosistemas y especies típicas presentes en la zona, para\ngenerar información y aprendizaje con potencial para ser transferido y usado en\nla rehabilitación o restauración de ecosistemas similares, fuera y dentro de\náreas silvestres protegidas.\n\ne) Generar conocimiento de los ecosistemas presentes a través del\ndesarrollo de investigaciones y experimentos, de manera que la información oriente\nla toma de decisiones de manejo de la finca y de la ecorregión.\n\nf) Establecer y mantener un centro de datos con información generada y\nsistematizada, de las investigaciones y procesos desarrollados en la Finca\nExperimental.\n\ng) Desarrollar actividades académicas.\n\nh) Desarrollar un programa de ciencia ciudadana.\n\ni) Crear y consolidar un aula ambiental, para acciones de investigación\ny capacitación.\n\nj) Realizar actividades de gestión colaborativa que constituyan al sitio\ncomo un espacio de interacción cultural, social y ambiental.\n\nk) Establecer plantaciones con especies forestales que permitan la\ncaptura de CO2.\n\nl) Desarrollar proyectos productivo-ambientales comunitarios que\nfomenten el desarrollo socioambiental de las comunidades de influencia.\n\nm) Realizar actividades de ecoturismo.\n\nn) Otras actividades acordes con los objetivos de la \"Finca Experimental\npara la conservación de ecosistemas y especies del bosque húmedo tropical\" que\nsean de posible aplicación conforme las normas que rigen la materia.\n\nEstas actividades se administrarán y desarrollarán según se permita, de\nconformidad con la sectorización establecida en el presente Decreto Ejecutivo y\nmediante los mecanismos de gestión previstos en la normativa.\n\n \n\n Ficha articulo\n\nArtículo 7º-Ordenamiento Ambiental. Las Actividades que se\nrealicen en el marco de los objetivos establecidos en el presente Decreto\nEjecutivo, deberán respetar el actual uso de suelo existente de los diferentes\nsectores del inmueble.\n\nSe exceptúan de la presente disposición, las áreas destinadas a plantaciones\nforestales que podrán ser aprovechadas y en las que posteriormente se podrán\nestablecer nuevas plantaciones forestales o restablecer ecosistemas de bosque\nhúmedo tropical, mediante regeneración natural o bajo técnicas de restauración\no rehabilitación.\n\n \n\n Ficha articulo\n\nArtículo 8º-Planificación. Para el desarrollo de actividades deberá\nelaborarse un Plan de Gestión de la Finca Experimental.\n\n \n\n Ficha articulo\n\nArtículo 9º-Modelo y mecanismos de gestión. Para el cumplimiento\nde los objetivos, se establecerá un modelo de gestión colaborativa que fomente\nla participación ciudadana y la cooperación con otros órganos de la\nAdministración Pública Centralizada y Descentralizada, organizaciones no\ngubernamentales y sector privado. Para tal efecto podrán suscribirse convenios,\nemitirse permisos de uso, concesionarse instalaciones, así como aplicar cualquier\notra figura autorizada y reglamentada por el ordenamiento jurídico vigente.\n\n \n\n Ficha articulo\n\nArtículo 10.-Mecanismo de sostenibilidad financiera. That furthermore, activities aimed at conserving, improving, and, where possible, recovering the biological diversity of the national territory are of public interest, for whose execution the parameters defined by the Executive Branch, as well as the following criteria, shall be taken into account: a) The protection and conservation of natural ecosystems, species diversity, genetic diversity in the national territory, and the monitoring of reproduction zones; b) The management of biological diversity integrated into the planning of any activity related to environmental elements.\n\n3º—That as provided by the Biodiversity Law N° 7788 of April 30, 1998, published in La Gaceta N° 101 of May 27, 1998, in its seventh article, biodiversity is composed of the variability of living organisms from any source and includes knowledge, innovation, and traditional, individual, and collective practice.\n\n4º—That according to articles 49 and 53 of the same Biodiversity Law N° 7788, the maintenance of ecological processes is a duty of the State and its citizens. For this purpose, the Ministry of Environment and Energy (MINAE) and the other relevant public entities, taking into account the specific legislation in force, shall issue the appropriate technical standards and use mechanisms for their conservation. Furthermore, the restoration, recovery, and rehabilitation of ecosystems, species, and the environmental services they provide must be promoted by MINAE and other public entities, as established in the same body of norms.\n\n5º—That the National Strategy for the Conservation and Sustainable Use of Biodiversity established, within the strategic actions for the country, the development of active management experiences for in situ conservation purposes.\n\n6º—That the current conditions of global change drive the State to promote regenerative development activities based on the regeneration of functional landscapes.\n\n7º—That investigative science plays a fundamental role in making timely and appropriate decisions for conservation.\n\n8º—That collaborative management (gestión colaborativa) constitutes a process where the integration between society, environment, and economy is considered, with the aim of restoring the landscape's capacity to provide ecosystem goods and services to society in a sustainable manner, which is compatible with the government-based governance regime for public domain assets.\n\n9º—That in accordance with articles 9 and 21 of the Regulations to the Biodiversity Law, Executive Decree N° 34433-MINAE of March 11, 2008, published in La Gaceta N° 68 of April 8, 2008, the Arenal Tempisque Conservation Area (ACAT) is one of the Conservation Areas that constitute the National System of Conservation Areas (SINAC) and is therefore under its administration.\n\n10.—That the State ensures development in the canton of Abangares that improves the quality of life of its inhabitants, promoting activities that foster cultural and environmental wealth, thereby contributing to adequate ecoregional conservation.\n\n11.—That by Executive Decree N° 39964-H of September 21, 2016, published in Supplement N° 254 to La Gaceta N° 216 of November 10, 2016, the property registered under Real Folio registration number 124599-000, located in the province of Guanacaste, canton 7 Abangares, district 1 Las Juntas, hamlet Santa Lucía, was assigned to MINAE; whose nature is land with various buildings, timber plantations, areas of natural regeneration of secondary forest, and pastures. It currently constitutes a property registered in the name of MINAE, under the administration of SINAC, through the Arenal Tempisque Conservation Area.\n\n12.—That as dictated by the second article of the Forestry Law N° 7575, of February 13, 1996, published in La Gaceta N° 72 of April 16, 1996, forest plantations (plantaciones forestales) have the main objective of timber production and utilization, without prejudice to other objectives that may be determined.\n\n13.—That in accordance with the Regulations to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree N° 37045-MP-MEIC and its amendments, it was determined that this proposal does not establish or modify procedures, requirements, or processes that the administered party must comply with, a situation for which the prior control procedure was not carried out. The Cerritos Experimental Farm for the conservation of ecosystems and species of the tropical humid forest is formed under a mixed-use regime (régimen de uso mixto) as detailed:\n\na) Sector 1: Consisting of forests, forest lands, and lands of forest aptitude; constituting Natural Heritage of the State. For carrying out and approving activities in this sector, the provisions of articles 18 and 18 Bis of the Forestry Law N° 7575 and related regulations apply.\n\nb) Sector 2: Consisting of areas without forest cover (cobertura forestal) and with infrastructure. Activities related to any of the objectives established in these Regulations may be developed in this sector, provided that, under the technical criteria of the Administration, it is deemed appropriate.\n\n \n Article fact sheet\n\nArticle 4º—Administration. The Cerritos Experimental Farm for the conservation of ecosystems and species of the tropical humid forest shall be administered by the National System of Conservation Areas (SINAC), through the Arenal Tempisque Conservation Area.\n\n \n Article fact sheet\n\nArticle 5º—Objectives. The objectives of the Cerritos Experimental Farm for the conservation of ecosystems and species of the tropical humid forest, which shall be developed as permitted in accordance with the sectorization (sectorización) established in this Executive Decree, shall be:\n\na) Promote the conservation of the tropical humid forest ecosystem and species, through a representative and replicable model of protection for indicator species, umbrella species, flagship species, focal species; types of biomes, and ecological processes characteristic of the ecoregion.\n\nb) Generate a space of scientific interest for experimentation as a mechanism for the effective protection of ecoregional biodiversity.\n\nc) Generate a regenerative development model under collaborative management that harmoniously integrates the protection and rational use of the different elements of biological diversity, including knowledge, traditions, and innovation.\n\nd) Manage the natural resources and ecosystems present, under technical and scientific criteria, so that they manage to maintain their key ecological attributes and the provision of ecosystem services.\n\ne) Provide special protection and sustainably use the water resources and aquatic systems present at the site.\n\n \n Article fact sheet\n\nArticle 6º—Activities. For the fulfillment of the objectives, the following activities may be promoted and developed:\n\na) Maintain, through natural regeneration, the conservation of a representative sample of the original ecosystems of the site.\n\nb) Create a seed bank of forest species and wild flora native to the tropical humid forest.\n\nc) Establish a nursery with native forest species to supply reforestation projects in the ecoregion.\n\nd) Experimentally develop techniques for the rehabilitation and restoration of ecosystems and typical species present in the area, to generate information and learning with the potential to be transferred and used in the rehabilitation or restoration of similar ecosystems, outside and inside protected wild areas.\n\ne) Generate knowledge of the present ecosystems through the development of research and experiments, so that the information guides decision-making for the management of the farm and the ecoregion.\n\nf) Establish and maintain a data center with information generated and systematized from the research and processes developed at the Experimental Farm.\n\ng) Develop academic activities.\n\nh) Develop a citizen science program.\n\ni) Create and consolidate an environmental classroom for research and training actions.\n\nj) Carry out collaborative management activities that establish the site as a space for cultural, social, and environmental interaction.\n\nk) Establish plantations with forest species that allow CO2 capture.\n\nl) Develop community productive-environmental projects that promote the socio-environmental development of the communities of influence.\n\nm) Carry out ecotourism activities.\n\nn) Other activities consistent with the objectives of the \"Experimental Farm for the conservation of ecosystems and species of the tropical humid forest\" that are potentially applicable in accordance with the regulations governing the matter.\n\nThese activities shall be administered and developed as permitted, in accordance with the sectorization established in this Executive Decree and through the management mechanisms provided for in the regulations.\n\n \n Article fact sheet\n\nArticle 7º—Environmental Management. The activities carried out within the framework of the objectives established in this Executive Decree must respect the current existing land use (uso de suelo) of the different sectors of the property.\n\nExempted from this provision are areas destined for forest plantations that may be utilized and in which new forest plantations may subsequently be established or tropical humid forest ecosystems reestablished, through natural regeneration or under restoration or rehabilitation techniques.\n\n \n Article fact sheet\n\nArticle 8º—Planning. For the development of activities, a Management Plan for the Experimental Farm must be prepared.\n\n \n Article fact sheet\n\nArticle 9º—Management model and mechanisms. For the fulfillment of the objectives, a collaborative management model shall be established that promotes citizen participation and cooperation with other bodies of the Centralized and Decentralized Public Administration, non-governmental organizations, and the private sector. For this purpose, agreements may be signed, use permits issued, facilities concessioned, as well as any other authorized figure regulated by the current legal system applied.\n\n \n Article fact sheet\n\nArticle 10.—Financial sustainability mechanism. Complementarily to the ordinary budget, to guarantee financial sustainability, the resources coming from the following concepts shall be for the exclusive use of the management of the Experimental Farm for the conservation of ecosystems and species of the tropical humid forest:\n\nA) Sale of Environmental Services (Servicios Ambientales).\n\nB) Collection from fees (canon) for use permits.\n\nC) Collection from fees (tarifas) for administrative contracting.\n\nD) Funds from the sustainable use of forest plantations, complying with the provisions of the Forestry Law and applicable regulatory norms; and conducting the sale through public auction (remate), following the rules established in the Administrative Contracting Law and its Regulations.\n\nE) Collection from public prices (precios públicos) established within the framework of the development of activities under this Decree.\n\n \n Article fact sheet\n\nArticle 11.—Geographic demarcation. SINAC, through the Arenal Tempisque Conservation Area, shall carry out the geographic demarcation of the sectors established in article 3 of this Executive Decree, within a period of 6 months, counted from the publication of this regulation.\n\n \n Article fact sheet\n\nArticle 12.—Effectiveness.
