Asimismo, se establece que el Instituto Geográfico Nacional será la\ndependencia científica y técnica rectora de la cartografía nacional, destinada\na la ejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el\ndesarrollo de políticas nacionales de carácter cartográfico, geográfico,\ngeodésico, geofísico y de índole similar que tenga relación con dichas obras,\ncon el fin de apoyar los procesos de planificación.\n\nII.-Que de conformidad con la Ley N° 59 Ley de IGN, lo constituye de\nmanera permanente y en representación del Estado, como la autoridad oficial en\nmateria geodésica y de la representación espacial de la geografía de la\nRepública, extendiéndose su autoridad a las actividades de cualquier orden que\ntengan por origen los trabajos confiados a su cargo.\n\nIII.-Que de conformidad con la Ley N° 59 Ley de IGN, y en el artículo 62\ndel Reglamento a la Ley N° 6043, se reconoce la competencia del IGN para la\ndelimitación de la zona pública de la Zona Marítimo Terrestre, y su\noficialización a través de publicación en el Diario Oficial La Gaceta,\nmientras que el artículo 63 del mismo Reglamento, señala que \"El Instituto\nGeográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción\nde la zona marítimo-terrestre en que haya demarcado la zona pública\".\n\nIV.-Que en el Decreto Ejecutivo N° 36642-MP-MOPTMINAET \"Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre\", del 14 de julio del 2011, se establece según el artículo 18° tipos\nde delimitación, el IGN podrá acudir a dos metodologías de ejecución, que se\nindican en los artículos 19 y 20, correspondientes a la delimitación de la zona\npública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o\na la delimitación digital georreferenciada, esto con el fin de agilizar las\ndelimitaciones y proporcionar mayor seguridad técnica a los interesados.\n\nV.-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, del 6 de junio del\n2007, el cual entre otros aspectos determina, a la Red Geodésica Nacional de\nReferencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como\nel sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos\ngeodésicos, cartográficos y catastrales que se ejecuten en nuestro país,\nseñalando específicamente en artículo 11 que: \"La Red Geodésica Nacional de\nReferencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05,\nconstituirán el único sistema oficial de coordenadas para la República de Costa\nRica a partir del cual se debe referenciar todos los levantamientos y\nactividades cartográficos y geodésicos que desarrollen en el Territorio Nacional\ntoda dependencia pública, persona o entidad privada nacional o extranjera.\";\nmientras que el artículo 7 indica que: \"Conforme se produzcan datos\ncartográficos en el nuevo sistema de proyección cartográfica CRTM05, el\nInstituto Geográfico Nacional publicará por los medios adecuados aquella\ninformación que se ha oficializado.\"\n\nVI.-Que el Decreto Ejecutivo N° 40962-MJP \"Actualización del Sistema\nGeodésico de Referencia Horizontal Oficial para Costa Rica\" declara que: \"El\nsistema geodésico de referencia horizontal oficial para Costa Rica, denominado\ncomo CR05 y su materialización mediante la Red Geodésica Nacional, cambia en\nsus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la\nRepública de Costa Rica.\" , mientras que \"El sistema de proyección\ncartográfica CRTM05 seguirá siendo el oficial para la representación\ncartográfica del territorio nacional continental.\"\n\nPor su parte, el artículo 12 del decreto de cita, refuerza la aplicación\nde la proyección cartográfica CRTM05 como el sistema nacional de coordenadas\noficial a la cual se deben referenciar en el territorio continental de nuestro\npaís, al señalar que \".todos los levantamientos y actividades cartográficos\ny geodésicos que desarrollen en el territorio nacional toda dependencia\npública, persona o entidad privada, nacional o extranjera, que emprendan o\ncontraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el\ngasto público y obteniendo, por otra parte, información geográfica confiable,\nuniforme y comparable, que sea de utilidad general y que apoye la toma de\ndecisiones en los distintos niveles del Estado.\"\n\nVII.-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\nVIII.-Que el artículo 75 de la Ley N° 6043 sobre la Zona Marítimo\nTerrestre, señala: \"La Junta de Administración Portuaria y de Desarrollo\nEconómico de la Vertiente Atlántica continuará con el dominio sobre los\nterrenos que le fueron traspasados en virtud del artículo 41, inciso b) de la\nley N° 5337 de 27 de agosto de 1973, excepto en la zona marítimo terrestre\ncorrespondiente a ambos lados del sistema de canales principales que unen los\npuertos de Moín y Barra del Colorado. En esa zona regirán con pleno vigor las estipulaciones\nde esta ley.\"\n\nIX.-Que el Instituto Geográfico Nacional, a través de su Dirección,\nemitió el oficio IGN/DG-98065 de fecha 02 de abril de 1998 denominado Dictamen\nsobre Sistema Fluvial de Canales de Tortuguero, Limón, el cual indica:\n\n\"En base al\nPronunciamiento C-191-96 con fecha del 27 de noviembre de 1996 de la\nProcuraduría General de la Republica, sobre el régimen jurídico del territorio\ndel litoral Caribe a lo largo de los canales de Tortuguero y la competencia\nterritorial administrativa de JAPDEVA, MINAE o los Concejos Municipales de la\nregión; donde se indica que: .\"En lo que toca a la determinación de cuales\ncanales entre los puertos de Moin y Barra del Colorado deben entenderse como\nprincipales para aplicación de esta nueva normativa, debe recurrirse al Instituto\nGeográfico Nacional, .\", y a solicitud del Concejo Municipal de Pococí, por el\nAcuerdo N° 17, Artículo VII de la Sesión Ordinaria N° 04 del 08 de enero de\n1998, relativo a la condición geográfica de la zona de Tortuguero respecto a la\nLey N° 6043 de la Zona Marítimo Terrestre y a su reglamento, el Instituto\nGeográfico Nacional determina, de acuerdo a su competencia y al estudio\nrealizado con datos oficiales registrados e información técnica de campo\ndisponible que:\n\n1. El sistema fluvial de canales de Tortuguero está constituido por la\nred hidrográfica de canales artificiales y cauces naturales de orden primario o\nde orden secundario, que se extiende desde puerto Moín en la ciudad de Limón,\nhasta el poblado de Barra del Colorado en Pococí, a lo largo del litoral Caribe\nde Costa Rica.\n\n2. Para efectos de aplicación de la Ley N° 6043 y su Reglamento, los\ncanales principales corresponden a los cursos de agua que unen por vía fluvial\nen ruta directa ambos sitios geográficos indicados en el punto anterior; los cuales\nson utilizados para todo tipo de navegación y el transporte en general. En esta\ncondición se encuentran varios canales sin nombre oficial particular y las siguientes\nvías fluviales: río Moín, río Las Vueltas, boca río Matina (un sector), estero\nMadre de Dios, boca río Pacuare (un sector), estero Pacuare, boca rio\nParismina, estero Parismina, caño Negro, laguna Tortuguero (hasta isla Cuatro\nEsquinas), laguna Penitencia, caño Palacio, caño Penitencia, laguna Samay (un\nsector) y boca rio Colorado.\"\n\n3. Los canales, cauces o lagunas de orden secundario corresponden a los\nrestantes cursos de agua integrados en este sistema fluvial, que se encuentran\nfuera de la ruta principal indicada en el punto anterior y que sirven también\ncomo vía navegable para comunicar otros sitios geográficos. En esta condición\nse encuentran entre otras las siguientes vías fluviales: río Toro, río Pascual,\nlaguna Plaset, caño González, laguna Urivano, río Madre de Dios, río Chiquero,\nlaguna Caldera, caño Soto, caño California, caño Aguas Negras, caño Sierpe,\ncaño Sérvulo, río Tortuguero, caño Mora, caño Chiquero, caño Palma, río Palacio,\ncaño Suertecita, caño Suerte, río Penitencia, caño Moreno, caño Madre, caño\nYak, etc. Los cursos de agua de este orden que se encuentren afectados por las\nmareas en diferente forma, presentando la línea de la pleamar ordinaria, tienen\nla aplicación de las normas establecidas por la Ley N° 6043 y su Reglamento\nsegún corresponda al régimen jurídico.\n\n4. Las bocas de los principales ríos se encuentran afectados por el\nflujo y reflujo de las mareas en su condición de rías, esteros o lagunas\ncosteras, presentado en sus bordes la línea de la pleamar ordinaria. Esta\nsituación determina la aplicación de las normas establecidas en la Ley N° 6043\ny su Reglamento, de acuerdo con el régimen jurídico bajo el que se encuentren\nel territorio aledaño respectivo. En caso de aplicarse la delimitación de la\nzona pública inalienable se demarcarán los cincuenta metros desde la línea de la\npleamar ordinaria en los márgenes de esas unidades geográficas. la influencia\nde las mareas se presenta en: boca río Moín, boca río Matina, boca río Pacuare,\nboca río Parismina, laguna Jalova (boca río Sierpe), laguna de Tortuguero (boca\nrío/ laguna Tortuguero hasta isla Cuatro Esquinas), laguna Samay (brazo río\nColorado) y boca río\n\nColorado\".\n\nX.-Que el Instituto Geográfico Nacional, a través de su Dirección,\nemitió el oficio IGN/DG-98066 de fecha 02 de abril de 1998 denominado Dictamen\nsobre Islas Costeras del Litoral Caribe de Costa Rica, Limón, el cual indica:\n\n\"En base al Pronunciamiento C-191-96 con fecha del 27 de noviembre de\n1996 de la Procuraduría General de la Republica, sobre el régimen jurídico del\nterritorio del litoral Caribe a lo largo de los canales de Tortuguero y la competencia\nterritorial administrativa de JAPDEVA, MINAE o los Concejos Municipales de la\nregión; donde se indica que: .\" En lo que toca a la determinación de cuales\ncanales entre los puertos de Moín y Barra del Colorado deben entenderse como\nprincipales para aplicación de esta nueva normativa, debe recurrirse al\nInstituto Geográfico Nacional, .\", y a solicitud del Concejo Municipal de\nPococí, por el Acuerdo N° 17, Articulo VII de la Sesión Ordinaria N° 04 del 08\nde enero de 1998, relativo a la condición geográfica de la zona de Tortuguero\nrespecto a la Ley N° 6043 de la Zona Marítimo Terrestre y a su reglamento, el\nInstituto Geográfico Nacional determina, de acuerdo a su competencia y al\nestudio realizado con datos oficiales registrados e información técnica de campo\ndisponible que:\n\n1. Las unidades geográficas existentes a lo largo del litoral Caribe en\nla provincia de Limón, entre los sitios de Puerto Moín y el poblado de Barra\ndel Colorado, ubicadas entre los canales principales del sistema fluvial de\ncanales de Tortuguero y la costa frente al Mar Caribe, son islas según los\nestudios ejecutados, tomando en cuenta el criterio oficial de Pronunciamiento\nC-038-97 con fecha 12 de marzo de 1997 de la Procuraduría General de la Republica.\n\n2. La Zona Pública Inalienable debe demarcarse en toda la extensión de\nesos litorales insulares, considerando el frente oceánico y los canales,\nesteros, rías o lagunas costeras existentes, de acuerdo con el ordenamiento\njurídico establecido y según el régimen administrativo bajo el que se encuentre\nel territorio insular respectivo.\n\n3. En relación con su posición geográfica, estas islas se encuentran\nubicadas hacia el interior del continente a partir de la línea de costa. Por lo\ntanto, todas tienen la condición de \"islas continentales\", con origen derivado por\nseparación de la tierra firme al construir el sistema de canalización de\nTortuguero. La mayoría de islas presentan de manera parcial algunas\ncaracterísticas de \"islas oceánicas\", relativas a la influencia permanente del oleaje\ny las corrientes marinas en toda la extensión litoral marino.\n\n4. Estas islas costeras del Caribe no poseen nombres oficiales en la\ncartografía nacional. Isla Samay (entre Samay y boca Colorado).\n\nXII.-Que la información digital georreferenciada sobre delimitación de\nla zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina\nGeodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional\n(IGN) sobre la Zona Marítimo Terrestre (ZMT).\n\nXIII.-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto\nGeográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta\ntécnicamente en aplicación de la regulación establecida por: a) el Decreto\nEjecutivo Nº 7841-P \"Reglamento a la Ley Nº 6043 sobre la Zona Marítimo\nTerrestre\", b) el Decreto Ejecutivo Nº 33797-MJ-MOPT \"Declara como datum\nhorizontal oficial para Costa Rica, el CR05, y su proyección cartográfica\nasociada, CRTM05\", y c) el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET\n\"Reglamento de Especificaciones para la Delimitación de la zona pública de la\nZona Marítimo Terrestre\".\n\nXIV.-Mediante el informe técnico SINAC-ACTo- DASP-001-2021 de fecha 15\nde enero de 2021 sobre delimitación del sistema estuarino (manglares, marismas,\nrías, esteros y estuarios) en Tortuguero fue realizado por el Área de\nConservación Tortuguero, el cual considera las características ecológicas\npresentes en el sitio de estudio correspondiente al ecosistema de la Laguna\nTortuguero, la misma corresponde a un sistema de humedal, y se clasifica como Sistema\nEstuarino: incluye hábitats de aguas profundas y tierras adyacentes con influencia\nde mareas, a menudo semi-encerradas por tierra, donde el agua oceánica es\ndiluida por agua dulce que corre desde tierra adentro (manglares, marismas,\nrías, esteros y estuarios).\n\nXV.-El Instituto Geográfico Nacional, utilizó la metodología de \"Delimitación\nDigital Georreferenciada\" para delimitar la zona pública de la zona marítimo\nterrestre correspondiente a la ría de la Laguna Tortuguero, el cual pertenece\nal ecosistema estuarino de Tortuguero, ubicada en el distrito 06 Colorado,\ncantón 02 Pococí de la provincia de Limón.\n\nXVI.-Que la delimitación realizada cuenta con aval técnico interno\nconforme al oficio N° DIG-TOT-0067-2021 del 12 de febrero de 2021, emitido por\nel Subproceso de Límites Oficiales del Departamento Topográfico y Observación\ndel Territorio del Instituto Geográfico Nacional.\n\nXVII.-Que el IGN-RN realizó la delimitación de ambas márgenes del\nsistema estuarino dictaminado por ACTO-SINACMINAE, de acuerdo con el oficio\nDIG-TOT-0345-2020 del 18 de agosto 2020 emitido por Subproceso de Límites\nOficiales del Departamento Topográfico y Observación del Territorio del\nInstituto Geográfico Nacional.\n\nXVIII.-Que el artículo 140 de la Ley N° 6227 General de la Administración\nPública señala que \"el acto administrativo producirá su efecto después de\ncomunicado al administrado, excepto si le concede únicamente derechos, en cuyo\ncaso lo producirá desde que se adopte\", disposición que necesariamente debe\nrelacionarse con el numeral 240) del mismo cuerpo normativo, mismo que define\nel instrumento idóneo para comunicar actos de naturaleza genérica al señalar\nque: \"Se comunicaran por publicación los actos generales y por notificación,\nlos concretos\". Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical and similar nature related to said works, in order to support planning processes.\n\nII.—That in accordance with Law No. 59, the IGN Law, it constitutes it permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any order originating from the work entrusted to its charge.\n\nIII.—That in accordance with Law No. 59, the IGN Law, and in article 62 of the Regulation to Law No. 6043, the competence of the IGN for the delimitation of the public zone of the Maritime Terrestrial Zone is recognized, and its officialization through publication in the Official Gazette La Gaceta, while article 63 of the same Regulation states that \"The National Geographic Institute shall publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\nIV.—That in Executive Decree No. 36642-MP-MOPTMINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\", of July 14, 2011, it is established according to article 18° types of delimitation, the IGN may resort to two execution methodologies, indicated in articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through digital georeferenced delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.\n\nV.—That in Executive Decree No. 33797-MJ-MOPT, of June 6, 2007, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic and cadastral works executed in our country must be referenced, specifically stating in article 11 that: \"The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05, shall constitute the sole official coordinate system for the Republic of Costa Rica from which all cartographic and geodetic surveys and activities developed in the National Territory by any public agency, person or private national or foreign entity must be referenced.\"; while article 7 indicates that: \"As cartographic data is produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish by appropriate means that information which has been officialized.\"\n\nVI.—That Executive Decree No. 40962-MJP \"Update of the Official Horizontal Geodetic Reference System for Costa Rica\" declares that: \"The official horizontal geodetic reference system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica.\" , while \"The cartographic projection system CRTM05 shall continue to be the official one for the cartographic representation of the continental national territory.\"\n\nFor its part, article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which must be referenced in the continental territory of our country, by stating that \".all cartographic and geodetic surveys and activities developed in the national territory by any public agency, person or private entity, national or foreign, that undertake or contract geodetic and cartographic work, contributing to avoid public expenditure and obtaining, on the other hand, reliable, uniform and comparable geographic information, which is of general utility and supports decision-making at the different levels of the State.\"\n\nVII.—That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone, enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), approving surveying plans, granting concessions in the Restricted Zone and other aspects of coastal territorial planning (ordenamiento territorial costero).\n\nVIII.—That article 75 of Law No. 6043 on the Maritime Terrestrial Zone, states: \"The Board of Port Administration and Economic Development of the Atlantic Slope shall continue with dominion over the lands that were transferred to it by virtue of article 41, subsection b) of law No. 5337 of August 27, 1973, except in the maritime terrestrial zone corresponding to both sides of the system of main canals connecting the ports of Moín and Barra del Colorado. In that zone, the stipulations of this law shall apply with full force.\"\n\nIX.—That the National Geographic Institute, through its Directorate, issued official communication IGN/DG-98065 dated April 2, 1998 denominated Ruling on the Fluvial System of the Tortuguero Canals, Limón, which indicates:\n\n\"Based on Pronouncement C-191-96 dated November 27, 1996 of the Attorney General's Office of the Republic, on the legal regime of the Caribbean littoral territory along the Tortuguero canals and the territorial administrative competence of JAPDEVA, MINAE or the Municipal Councils of the region; where it is indicated that: .\"Regarding the determination of which canals between the ports of Moin and Barra del Colorado should be understood as principal for the application of this new regulation, the National Geographic Institute must be consulted, .\", and at the request of the Municipal Council of Pococí, by Agreement No. 17, Article VII of Ordinary Session No. 04 of January 8, 1998, relating to the geographic condition of the Tortuguero zone with respect to Law No. 6043 of the Maritime Terrestrial Zone and its regulation, the National Geographic Institute determines, according to its competence and the study carried out with registered official data and available technical field information that:\n\n1. The fluvial system of the Tortuguero canals is constituted by the hydrographic network of artificial canals and natural channels of primary order or secondary order, extending from port Moín in the city of Limón, to the town of Barra del Colorado in Pococí, along the Caribbean littoral of Costa Rica.\n\n2. For the purposes of applying Law No. 6043 and its Regulation, the principal canals correspond to the watercourses that connect by direct river route both geographic sites indicated in the previous point; which are used for all types of navigation and transport in general. In this condition are found several canals without an official particular name and the following waterways: río Moín, río Las Vueltas, boca río Matina (a sector), estero Madre de Dios, boca río Pacuare (a sector), estero Pacuare, boca rio Parismina, estero Parismina, caño Negro, laguna Tortuguero (up to isla Cuatro Esquinas), laguna Penitencia, caño Palacio, caño Penitencia, laguna Samay (a sector) and boca rio Colorado.\"\n\n3. The secondary order canals, channels or lagoons correspond to the remaining watercourses integrated into this fluvial system, which are located outside the main route indicated in the previous point and that also serve as a navigable way to communicate other geographic sites. In this condition, among others, are found the following waterways: río Toro, río Pascual, laguna Plaset, caño González, laguna Urivano, río Madre de Dios, río Chiquero, laguna Caldera, caño Soto, caño California, caño Aguas Negras, caño Sierpe, caño Sérvulo, río Tortuguero, caño Mora, caño Chiquero, caño Palma, río Palacio, caño Suertecita, caño Suerte, río Penitencia, caño Moreno, caño Madre, caño Yak, etc. The watercourses of this order that are affected by the tides in different ways, presenting the ordinary high-water line (línea de la pleamar ordinaria), are subject to the application of the norms established by Law No. 6043 and its Regulation according to the corresponding legal regime.\n\n4. The mouths of the main rivers are affected by the flow and ebb of the tides in their condition as rías, esteros or coastal lagoons, presenting on their edges the ordinary high-water line. This situation determines the application of the norms established in Law No. 6043 and its Regulation, according to the legal regime under which the respective adjoining territory is found. In case of applying the delimitation of the inalienable public zone, the fifty meters from the ordinary high-water line on the banks of those geographic units shall be demarcated. The geographic units existing along the Caribbean littoral in the province of Limón, between the sites of Puerto Moín and the town of Barra del Colorado, located between the principal canals of the fluvial system of the Tortuguero canals and the coast facing the Caribbean Sea, are islands according to the studies executed, taking into account the official criterion of Pronouncement C-038-97 dated March 12, 1997 of the Attorney General's Office of the Republic.\n\n2. The Inalienable Public Zone must be demarcated along the entire extent of those insular littorals, considering the ocean front and the existing canals, esteros, rías or coastal lagoons, in accordance with the established legal order and according to the administrative regime under which the respective insular territory is found.\n\n3. In relation to their geographic position, these islands are located towards the interior of the continent from the coastline. Therefore, all have the condition of \"continental islands\", with a derived origin from the separation of the mainland upon building the canalization system of Tortuguero. The majority of islands partially present some characteristics of \"oceanic islands\", relative to the permanent influence of waves and marine currents along the entire marine littoral extent.\n\n4. These coastal islands of the Caribbean do not have official names in the national cartography. The National Geographic Institute shall present to the National Nomenclature Commission the following names for their approval and respective registration:\n\na) Isla Moín (between puerto Moín and boca Matina).\n\nb) Isla Matina (between boca Matina and canal northwest of laguna Urivano).\n\nc) Isla Madre de Dios (between canal and boca Parismina).\n\nd) Isla Pacuare (between boca Pacuare and boca Parismina).\n\ne) Isla Parismina (between boca Parismina and laguna Jolova).\n\nf) Isla Tortuguero (between boca Jolova and boca Tortuguero).\n\ng) Isla Palma (between boca Tortuguero and laguna Samay).\n\nh) Isla Penitencia (between caño Palma and caño Penitencia).\n\ni) Isla Samay (between Samay and boca Colorado).\"\n\nXI.—That the National Nomenclature Commission, in ordinary session No. 234, held on September 3, 1998, in its fifteenth article, acknowledged a request submitted by the National Geographic Institute, based on official communication IGN/ DG-98066 dated April 2, 1998, approving the following names of geographic features:\n\n1. Isla Moín (between puerto Moín and boca Matina).\n\n2. Isla Matina (between boca Matina and canal northwest of laguna Urivano).\n\n3. Isla Madre de Dios (between canal and boca Parismina).\n\n4. Isla Pacuare (between boca Pacuare and boca Parismina).\n\n5. Isla Parismina (between boca Parismina and laguna Jolova).\n\n6. Isla Tortuguero (between boca Jolova and boca Tortuguero).\n\n7. Isla Palma (between boca Tortuguero and laguna Samay).\n\n8. Isla Penitencia (between caño Palma and caño Penitencia).\n\n9. Isla Samay (between Samay and boca Colorado).\n\nXII.—That the georeferenced digital information on delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is denominated the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\nXIII.—That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P \"Regulation to Law No. 6043 on the Maritime Terrestrial Zone\", b) Executive Decree No. 33797-MJ-MOPT \"Declares as the official horizontal datum for Costa Rica, CR05, and its associated cartographic projection, CRTM05\", and c) Executive Decree No. 36642-MP-MOPT-MINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\".\n\nXIV.—By means of technical report SINAC-ACTo- DASP-001-2021 dated January 15, 2021 on delimitation of the estuarine system (mangroves, marshlands, rías, esteros and estuaries) in Tortuguero, it was carried out by the Tortuguero Conservation Area (Área de Conservación Tortuguero), which considers the ecological characteristics present in the study site corresponding to the Tortuguero Lagoon ecosystem, the same corresponds to a wetland system, and is classified as an Estuarine System: includes deepwater habitats and adjacent lands with tidal influence, often semi-enclosed by land, where ocean water is diluted by freshwater running off from inland (mangroves, marshlands, rías, esteros and estuaries).\n\nXV.—The National Geographic Institute used the \"Digital Georeferenced Delimitation\" methodology to delimit the public zone of the maritime terrestrial zone corresponding to the ría of the Tortuguero Lagoon, which belongs to the estuarine ecosystem of Tortuguero, located in district 06 Colorado, canton 02 Pococí of the province of Limón.\n\nXVI.—That the delimitation carried out has internal technical endorsement according to official communication No. DIG-TOT-0067-2021 of February 12, 2021, issued by the Official Limits Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute.\n\nXVII.—That the IGN-RN carried out the delimitation of both banks of the estuarine system determined by ACTO-SINACMINAE, in accordance with official communication DIG-TOT-0345-2020 of August 18, 2020 issued by the Official Limits Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute.\n\nXVIII.—That article 140 of Law No. 6227 General Law of Public Administration states that \"the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from when it is adopted,\" a provision that must necessarily be related to numeral 240) of the same normative body, which defines the ideal instrument for communicating acts of a
