  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 42875\n\n                        Reforma Declara estado de emergencia nacional por la situación provocada por\nlos efectos del Huracán ETA\n\nN° 42875-MP\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY LA MINISTRA DE LA PRESIDENCIA\n\nDe conformidad con lo dispuesto por los incisos 3) y 18)\ndel artículo 140 y 146 de la Constitución Política de la República de Costa Rica,\nlos artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de la\nAdministración Pública, N° 6227 del 02 de mayo de 1978 y la Ley Nacional de\nEmergencias y Prevención del Riesgo, N° 8488 del 22 de noviembre de 2005.\n\nConsiderando:\n\nI.-Que mediante Decreto Ejecutivo N° 42705-MP publicado\nen el Diario Oficial La Gaceta del jueves 12 de noviembre del 2020, se\ndeclara estado de emergencia nacional por la situación provocada por los\nefectos del Huracán ETA, en los siguientes cantones: provincia de San José:\nDesamparados, Puriscal, Tarrazú, Dota, Pérez Zeledón\ny León Cortés; provincia de Guanacaste: Nicoya, Nandayure\ny Hojancha; provincia de Puntarenas: Buenos Aires,\nOsa, Quepos, Golfito, Coto Brus, Parrita, Corredores\ny Garabito.\n\nII.-Que es deber máximo del Estado velar por la protección de la vida\nhumana, por la seguridad de los habitantes y, en general, por la conservación\ndel orden social.\n\nIII.-Que la Ley Nacional de Prevención de Riesgos y Atención de Emergencias\ndispone en su numeral 29 que en caso de calamidad pública ocasionada por hechos\nde la naturaleza que no puedan ser controlados, manejados ni dominados con las\npotestades ordinarias de que dispone el Gobierno, el Poder Ejecutivo podrá\ndeclarar emergencia nacional en cualquier parte del territorio nacional, a fin\nde integrar y definir las responsabilidades y funciones de todos los\norganismos, entidades públicas, privadas y poder brindar una solución acorde a\nla magnitud del desastre.\n\nIV.-Que mediante Acuerdo N° 231-11-2020, de la Sesión Extraordinaria N°\n21-11-2020 del 09 de noviembre de 2020, la Junta Directiva de la Comisión\nNacional de Prevención de Riesgos y Atención de Emergencias (CNE) recomendó al\nPoder Ejecutivo: \"la declaratoria de emergencia nacional por la\nsituación provocada por el Huracán ETA, en los siguientes cantones: Provincia\nde San José: Desamparados, Puriscal, Tarrazú, Dota,\nPérez Zeledón y León Cortés; Provincia de Guanacaste: Nicoya, Nandayure y Hojancha; Provincia\nde Puntarenas: Buenos Aires, Osa, Quepos, Golfito, Coto Brus,\nParrita, Corredores y Garabito\".\n\nV.-Que mediante informe Técnico sobre el Huracán ETA por parte del Departamento de Meteorología\nSinóptica y Aeronáutica del Instituto Metrológica Nacional de Costa Rica (IMN), emitido en febrero\nde 2021, pone en evidencia el exceso de precipitaciones que también afectaron a los cantones de\nAserrí, Mora y Acosta de la Provincia de San José, Santa Cruz y La Cruz de la provincia de\nGuanacaste, y el Distrito de Cóbano de la Provincia de Puntarenas.\n\nVI.-Que los reportes de los Comités Municipales de Emergencias (CME) y las\nMunicipalidades de estos sitios dan cuenta de los daños, perdidas y procesos de\natención de emergencias en dichos lugares y al día de hoy aún persisten los\ndaños en estos sitios que requieren obras de reconstrucción.\n\nVII.-Que en virtud de las recomendaciones e información recopiladas, la Junta Directiva de la CNE\nmediante acuerdo N° 276-12-2020, de la Sesión Extraordinaria N° 24-12-2020 del 23 de diciembre de\n2020, recomienda al Poder Ejecutivo la ampliación de la declaratoria de emergencia N° 42705, por la\nsituación provocada por el Huracán ETA para incluir a los cantones de Aserrí, Mora y Acosta de la\nProvincia de San José, Santa Cruz y La Cruz de la provincia de Guanacaste, y el Distrito de Cóbano\nde la Provincia de Puntarenas.\n\nVIII.-Que la ampliación es necesaria a fin de dar un marco jurídico que permita tomar las medidas\nnecesarias para hacer frente a los efectos que el Huracán ETA ha provocado en dichos cantones y\nmitigar las consecuencias que puedan tener su impacto sobre estos.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 42875\n\n                        Amendment Declares national state of emergency due to the situation caused by\nthe effects of Hurricane ETA\n\nNo. 42875-MP\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF THE PRESIDENCY\n\nIn accordance with the provisions of subsections 3) and 18)\nof article 140 and 146 of the Political Constitution of the Republic of Costa Rica,\narticles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law of\nPublic Administration, No. 6227 of May 2, 1978, and the National Law of\nEmergencies and Risk Prevention, No. 8488 of November 22, 2005.\n\nConsidering:\n\nI.—That through Executive Decree No. 42705-MP published\nin the Official Gazette La Gaceta on Thursday, November 12, 2020, a\nnational state of emergency is declared due to the situation caused by the\neffects of Hurricane ETA, in the following cantons: province of San José:\nDesamparados, Puriscal, Tarrazú, Dota, Pérez Zeledón\nand León Cortés; province of Guanacaste: Nicoya, Nandayure\nand Hojancha; province of Puntarenas: Buenos Aires,\nOsa, Quepos, Golfito, Coto Brus, Parrita, Corredores\nand Garabito.\n\nII.—That the supreme duty of the State is to ensure the protection of human\nlife, the safety of the inhabitants, and, in general, the conservation\nof social order.\n\nIII.—That the National Law of Risk Prevention and Emergency Response\nprovides in its numeral 29 that in the event of a public calamity caused by acts\nof nature that cannot be controlled, managed, or overcome with the ordinary\npowers available to the Government, the Executive Branch may\ndeclare a national emergency in any part of the national territory, in order\nto integrate and define the responsibilities and functions of all\nbodies, public entities, private entities, and to provide a solution commensurate with\nthe magnitude of the disaster.\n\nIV.—That through Agreement No. 231-11-2020, of the Extraordinary Session No.\n21-11-2020 of November 9, 2020, the Board of Directors of the National\nCommission for Risk Prevention and Emergency Response (CNE) recommended to the\nExecutive Branch: \"the declaration of national emergency due to the\nsituation caused by Hurricane ETA, in the following cantons: Province\nof San José: Desamparados, Puriscal, Tarrazú, Dota,\nPérez Zeledón and León Cortés; Province of Guanacaste: Nicoya, Nandayure and Hojancha; Province\nof Puntarenas: Buenos Aires, Osa, Quepos, Golfito, Coto Brus,\nParrita, Corredores and Garabito\".\n\nV.—That through a Technical report on Hurricane ETA from the Department of Synoptic\nand Aeronautical Meteorology of the National Meteorological Institute of Costa Rica (IMN), issued in February\nof 2021, it demonstrated the excess rainfall that also affected the cantons of\nAserrí, Mora and Acosta of the Province of San José, Santa Cruz and La Cruz of the province of\nGuanacaste, and the District of Cóbano of the Province of Puntarenas.\n\nVI.—That the reports of the Municipal Emergency Committees (CME) and the\nMunicipalities of these locations account for the damages, losses, and emergency\nresponse processes in said places, and to this day the\ndamages still persist in these sites, requiring reconstruction works.\n\nVII.—That by virtue of the recommendations and information gathered, the Board of Directors of the CNE,\nthrough agreement No. 276-12-2020, of the Extraordinary Session No. 24-12-2020 of December 23,\n2020, recommends to the Executive Branch the expansion of the emergency declaration No. 42705, due to the\nsituation caused by Hurricane ETA, to include the cantons of Aserrí, Mora and Acosta of the\nProvince of San José, Santa Cruz and La Cruz of the province of Guanacaste, and the District of Cóbano\nof the Province of Puntarenas.\n\nVIII.—That the expansion is necessary in order to provide a legal framework that allows the necessary\nmeasures to be taken to address the effects that Hurricane ETA has caused in said cantons and\nmitigate the consequences that its impact may have on them. Therefore,\n\nThey Decree:\n\nAMENDMENT TO ARTICLE 1 OF EXECUTIVE DECREE\n\nNo. 42705-MP \"NATIONAL STATE OF EMERGENCY\n\nDUE TO THE SITUATION CAUSED BY THE\n\nEFFECTS OF HURRICANE ETA\"\n\nArticle 1.—Article 1 of Executive\nDecree No. 42705-MP of November 10, 2020, is amended to read as\nfollows:\n\n\"A national state of emergency is declared due to the situation caused by the effects of Hurricane\nETA, in the following cantons: province of San José: Desamparados, Puriscal, Tarrazú, Dota, Pérez\nZeledón, León Cortés, Aserrí, Mora and Acosta; province of Guanacaste: Nicoya, Nandayure, Hojancha,\nSanta Cruz and La Cruz; province of Puntarenas: Buenos Aires, Osa, Quepos, Golfito, Coto Brus,\nParrita, Corredores, Garabito and the District of Cóbano of the Canton of Puntarenas\".\n\nArticle 2.—It shall be effective as of its publication in the Official\nGazette La Gaceta.\n\nGiven at the Presidency of the Republic.—San José, on the twenty-third day of February of two\nthousand twenty-one."
