  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 42786\n\n                        Declara de utilidad pública para los intereses del Estado la Asociación\nAdministradora del Acueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón\n\nN° 42786-MJP\n\n(Este decreto\nejecutivo fue derogado por el artículo 1° del decreto ejecutivo N° 44852 del 4\nde diciembre del 2024)\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY LA MINISTRA DE JUSTICIA Y PAZ\n\nCon fundamento en lo dispuesto en los artículos 140,\ninciso 18) y 146 de la Constitución Política, en el artículo 32 de la Ley de\nAsociaciones N° 218 del 8 de agosto de 1939, los artículos 27 y siguientes del\nReglamento a la Ley de Asociaciones N° 29496-J, publicado en La Gaceta N°\n96 del 21 de mayo del 2001, así como lo establecido en el artículo 3, inciso\nch) de la Ley de Impuesto sobre la Renta N° 7092 y en los artículos 103 y 104\nde Código de Normas y Procedimientos Tributarios N° 4755.\n\nConsiderando:\n\nI.-El artículo 32 de la Ley de Asociaciones N° 218 del 8\nde agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de\ndeclarar de utilidad pública a las asociaciones simples, federadas o\nconfederadas, cuyo desarrollo y actividades sean particularmente útiles para\nlos intereses del Estado y que por ello contribuyan a solventar una necesidad\nsocial.\n\nII.-La Asociación Administradora del Acueducto y Alcantarillado Sanitario\nde San Lorenzo Siquirres Limón, cédula de persona\njurídica número 3-002-678149, se inscribió en el Registro de Asociaciones del\nRegistro Nacional, desde el día 27 de enero del 2014, al tomo 2013, asiento\n178424.\n\nIII.-Los fines que persigue la Asociación Administradora del Acueducto y\nAlcantarillado Sanitario de San Lorenzo Siquirres\nLimón, cédula de persona jurídica número 3-002-678149, según sus estatutos son:\n\"a) Administrar, operar, dar mantenimientos, desarrollo y condiciones\nal acueducto, de conformidad con las disposiciones y reglamentos que al\nrespecto emite el Instituto Costarricense de Acueductos y Alcantarillados, que\nserán de acatamiento obligatorio. b) Obtener la participación efectiva de la\ncomunidad, en la construcción, operación, mantenimiento y desarrollo del\nacueducto. c) Colaboración en los programas y campañas de índole educativa que\nse emprendan. d) Ayudar a explicar y divulgar en la comunidad las disposiciones\ny reglamentos del Instituto Costarricense de Acueductos y Alcantarillados. e)\nCooperar con los planes, proyectos y obras que emprenda el Instituto\nCostarricense de Acueductos y Alcantarillado en la comunidad. f) Participar en\nasuntos relativos a la administración, conservación y explotación racional de las\naguas; control de la contaminación o alteración, definición de las medidas y\nacciones necesarias para la protección de las cuentas hidrográficas y la\nestabilidad ecológica. g) Velar porque todos los sistemas sus instalaciones de\nacueductos o alcantarillados sanitario, cumplan los principios básicos del\nservicio público tanto en calidad, cobertura, eficiencia, racionalización de\ngastos, etc. h) Otorgar los servicios públicos en forma eficiente, igualitaria\ny oportuna a todos sus usuarios sin distinción de ninguna naturaleza. (.)\".\n(Folio 18)\n\nIV.-Tales fines solventan una necesidad social de primer orden, por lo cual\nmerecen el apoyo del Estado costarricense.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norma 42786\n\n                        Declares of public utility for the interests of the State the Administrative\nAssociation of the Aqueduct and Sanitary Sewer System of San Lorenzo Siquirres Limón\n\nN° 42786-MJP\n\n(This executive decree was repealed by article 1 of executive decree N° 44852 of December 4, 2024)\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF JUSTICE AND PEACE\n\nPursuant to the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Law of Associations N° 218 of August 8, 1939, articles 27 and following of the Regulation to the Law of Associations N° 29496-J, published in La Gaceta N° 96 of May 21, 2001, as well as the provisions of article 3, subsection ch) of the Income Tax Law N° 7092 and articles 103 and 104 of the Code of Tax Norms and Procedures N° 4755.\n\nConsidering:\n\nI.-Article 32 of the Law of Associations N° 218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility simple, federated or confederated associations, whose development and activities are particularly useful for the interests of the State and which thereby contribute to solving a social need.\n\nII.-The Administrative Association of the Aqueduct and Sanitary Sewer System of San Lorenzo Siquirres Limón, legal entity identification number 3-002-678149, was registered in the Associations Registry of the National Registry, as of January 27, 2014, in volume 2013, entry 178424.\n\nIII.-The purposes pursued by the Administrative Association of the Aqueduct and Sanitary Sewer System of San Lorenzo Siquirres Limón, legal entity identification number 3-002-678149, according to its bylaws are: \"a) To administer, operate, maintain, develop and provide conditions to the aqueduct, in accordance with the provisions and regulations issued in this regard by the Costa Rican Institute of Aqueducts and Sewer Systems, which shall be mandatory. b) To obtain the effective participation of the community, in the construction, operation, maintenance and development of the aqueduct. c) Collaboration in educational programs and campaigns that are undertaken. d) To help explain and disseminate in the community the provisions and regulations of the Costa Rican Institute of Aqueducts and Sewer Systems. e) To cooperate with the plans, projects and works undertaken by the Costa Rican Institute of Aqueducts and Sewer Systems in the community. f) To participate in matters relating to the administration, conservation and rational exploitation of waters; control of contamination or alteration, definition of the measures and actions necessary for the protection of hydrographic accounts and ecological stability. g) To ensure that all systems and their aqueduct or sanitary sewer installations comply with the basic principles of public service in terms of quality, coverage, efficiency, rationalization of expenses, etc. h) To provide public services efficiently, equally and timely to all its users without distinction of any nature. (.)\". (Folio 18)\n\nIV.-Such purposes solve a social need of the first order, for which they deserve the support of the Costa Rican State. Therefore,\n\nDecree\n\nDECLARATION OF PUBLIC UTILITY\n\nFOR THE ADMINISTRATIVE ASSOCIATION\n\nOF THE AQUEDUCT AND SANITARY SEWER SYSTEM\n\nOF SAN LORENZO\n\nSIQUIRRES LIMÓN\n\nArticle 1º-Declare of public utility for the interests of the State the Administrative Association of the Aqueduct and Sanitary Sewer System of San Lorenzo Siquirres Limón, legal entity identification number 3-002-678149.\n\nArticle 2º-It is the duty of the association to render an annual management report to the Ministry of Justice and Peace, in accordance with the provisions of article 32 of the Regulation to the Law of Associations.\n\nArticle 3º-The income and assets of the association that are allocated entirely and exclusively for public or charitable purposes and that in no case are distributed directly or indirectly among its members, shall be exempt from income tax; on the contrary, that part which does not have this purpose, or is distributed in any way among its associates, shall be subject to the imposition of this tax.\n\nArticle 4º-It is the responsibility of the Tax Administration to control and supervise the correct fulfillment of the tax obligations of the association, in accordance with the provisions of articles 103 and 104 of the Code of Tax Norms and Procedures.\n\nArticle 5º-Once this decree is published, the interested parties must notarize and present the respective testimony before the Associations Registry of the National Registry, for its respective registration.\n\nArticle 6º-It takes effect as of its publication.\n\nGiven at the Presidency of the Republic.
