el Decreto Oficialización del Plan\nde Descarbonización Compromiso del Gobierno del\nBicentenario, Decreto Ejecutivo N° 41581 del 24 de febrero de 2019 y los\nartículos 42 y 43 del Decreto Ejecutivo Nº 35669-MINAET del 04 de diciembre del\n2009, Reglamento Orgánico del Ministerio de Ambiente y Energía.\n\nConsiderando:\n\n1º-Que el país ratificó la Convención Marco de Naciones Unidas sobre el Cambio Climático, en\nadelante CMNUCC.\n\n2º-Que nuestro país asumió el compromiso de participar en los esfuerzos de\nfortalecer el régimen establecido por la CMNUCC, a fin de contribuir a\ngarantizar una respuesta global y oportuna, con base en la información aportada\npor el Panel Intergubernamental sobre Cambio Climático (IPCC) y sobre la base\nde los principios que rigen la CMNUCC.\n\n3º-Que en el año 2007 Costa Rica lanzó su compromiso de ser carbono neutral\npara el año 2021, meta incluida en la Estrategia Nacional de Cambio Climático\n(2009) y en su Plan de Acción (2013).\n\n4º-Que Costa Rica oficializó su primer Programa País para la Carbono\nNeutralidad, por medio del Acuerdo 36-2012 MINAET del 19 de junio de 2012, el\ncual fue dejado sin efecto por el Decreto Ejecutivo Nº 41122-MINAE del 06 de\nabril de 2018 que oficializó el Programa País Carbono Neutralidad 2.0.\n\n5º-Que la norma INTE B5 \"Norma para demostrar Carbono\nNeutralidad\" fue desarrollada para permitir a toda organización, demostrar\nsu carbono neutralidad.\n\n6º-Que Costa Rica suscribió los Objetivos de Desarrollo Sostenible\nestablecidos en la Agenda 2030 de las Naciones Unidos, cuyo objetivo trece -\nAcción por el Clima - llama a adoptar medidas urgentes para combatir el cambio\nclimático y sus efectos.\n\n7º-Que Costa Rica elaboró en el año 2015, su Contribución Nacionalmente\nDeterminada (NDC por sus siglas en inglés), como parte prioritaria de la acción\nclimática, incluyendo un objetivo de mitigación de largo plazo para el año\n2050, diseñado sobre la base de la mejor ciencia disponible a ese momento y de\nsu responsabilidad global de avanzar hacia la carbono neutralidad global para\nla segunda mitad del siglo; asimismo, adquirió el compromiso de formular y\noficializar un Plan Nacional de Adaptación.\n\n8º-Que Costa Rica firmó y ratificó el Acuerdo de París mediante la ley\nnúmero N° 9405 del 04 de octubre de 2016 y oficializó su Contribución\nNacionalmente Determinada (NDC por sus siglas en inglés).\n\n9º-Que el Acuerdo de París presupone la descarbonización\nde la economía global y el logro de la neutralidad carbono en la segunda mitad\ndel siglo XXI, así como la obligación de integrar la adaptación al cambio\nclimático en los procesos socioeconómicas y ambientales pertinentes.\n\n10.-Que Costa Rica oficializó el Programa País Carbono Neutralidad 2.0, en\nlas categorías a) Organizacional y b) Cantonal, por medio del Decreto Ejecutivo\nNº 41122-MINAE del 06 de abril de 2018, cuyo objetivo general es brindar un\nmecanismo para reconocer la adecuada gestión de las emisiones de gases de\nefecto invernadero (GEI) a organizaciones públicas y privadas, con el fin de\napoyar los compromisos del país en materia de acción climática.\n\n11.-Que a través del Decreto Ejecutivo Nº 41091-MINAE del 20 de abril de\n2018, fue oficializada la Política Nacional de Adaptación al Cambio Climático\n2018-2030, cuyo objetivo general se enfoca en transitar hacia un modelo de\ndesarrollo resiliente de la sociedad costarricense,\nque evite las pérdidas humanas y modere los daños materiales generados por los\nefectos adversos del cambio climático, contribuya a la calidad de vida de las\npoblaciones más vulnerables, aproveche las oportunidades para innovar y\ntransformar los sectores productivos y asegure la continuidad de los servicios\npúblicos.\n\n12.-Que por medio del Decreto Ejecutivo Nº 41581-MINAE del 24 de febrero de\n2019, se oficializó el Plan de Descarbonización\nCompromiso del Gobierno del Bicentenario, como instrumento para trazar las\nrutas de cambio en las áreas claves para revertir el crecimiento de emisiones\nde gases de efecto invernadero, así como fomentar la modernización y\ndinamización de la economía bajo una visión de crecimiento verde.\n\n13.-Que el Plan de Descarbonización Compromiso\ndel Gobierno del Bicentenario fue declarado de interés público y nacional por\nel Decreto Ejecutivo N° 41561-MP-MINAE del 07 de febrero de 2019.\n\n14.-Que el Programa Nacional de Etiquetado Ambiental y de Eficiencia\nEnergética de Costa Rica fue oficializado por medio del Acuerdo 006-2019-MINAE\ndel 22 de febrero de 2019, cuyo objetivo general es establecer las condiciones\nde gestión de las etiquetas ambientales y energéticas en Costa Rica, mientras\nque el Reglamento para el derecho y uso de una etiqueta ambiental de Costa Rica\n(EACR) o una etiqueta de eficiencia energética (EECR) en un producto o servicio,\nse oficializó a través de la Resolución R-274-2019MINAE de las nueve horas\nveinte minutos del 22 de octubre de 2019.\n\n15.-Que el Plan Nacional de Desarrollo y de Inversión Pública (PNDIP) del\nBicentenario 2019-2022, emitido a través del Decreto Ejecutivo Nº\n41848-MIDEPLAN del 18 de junio de 2019, establece mecanismos de gestión\naplicables a la acción climática y dispone como objetivos del área estratégica\nInfraestructura, Movilidad y Ordenamiento Territorial, los siguientes: Aumentar\nla resiliencia a los impactos del cambio climático de la sociedad\ncostarricense, mediante la aplicación de acciones de adaptación basada en\ncomunidades y ecosistemas; contribuir a la conservación, el uso sostenible y la\nresiliencia de la biodiversidad; y contribuir a la carbono neutralidad con el\naporte del sector forestal y sectores claves como el transporte público,\nagropecuario y fomentando la participación de los gobiernos locales para la\nmitigación ante el cambio climático.\n\n16.-Que Costa Rica se encuentra en proceso de adhesión a la Organización\npara la Cooperación y Desarrollo Económico (OCDE), debiendo tomar acciones para\nel cumplimiento de un conjunto de instrumentos legales de dicha organización.\nEn materia ambiental estos instrumentos legales promueven que los países\nmiembros adopten normas y estándares internacionales, mejores prácticas y\ndirectrices de política en materia de cambio climático, biodiversidad,\ndesertificación, el deterioro de ecosistemas y la contaminación de aguas y\naire.\n\n17.-Que la acción climática, que incluye enfoques de mitigación y\nadaptación, es un eje transversal para la economía, la sociedad, y de un nuevo\nmodelo de desarrollo, basado en la descarbonización y\nen la generación de resiliencia, como pilares para garantizar competitividad y\ncrecimiento incluyente.\n\n18.-Que el Programa País Carbono Neutralidad 2.0 forma parte de los\nesfuerzos que realiza el país en su rol de líder en materia ambiental y en\nconcordancia con los objetivos de mitigación del país en el contexto de la\nEstrategia Nacional de Cambio Climático y su Plan de Acción, los compromisos\ninternacionales establecidos en la Contribución Nacionalmente Determinada (NDC)\ny el Acuerdo de París.\n\n19.-Que dado el éxito del Programa País Carbono Neutralidad 2.0 para empresas,\ninstituciones, organizaciones, municipios y distritos, así como la necesidad de\nmejora continua, se requiere de su reformulación, a efectos de actualizar las\ncategorías existentes, así como la expansión de su alcance hacia nuevas\ncategorías y subcategorías de carbono neutralidad.\n\n20.-Que como parte de los esfuerzos de liderazgo del país en materia\nambiental y con el fin de apoyar el cumplimiento de los objetivos de adaptación\nincluidos en la Estrategia Nacional de Cambio Climático y su Plan de Acción, la\nPolítica Nacional de Adaptación al Cambio Climático, y el Plan Nacional de\nDesarrollo y de Inversión Pública (PNDIP) del Bicentenario 2019-2022, en\nrespuesta a los compromisos internacionales adquiridos en la Contribución\nNacionalmente Determinada (NDC por sus siglas en inglés) y en el Acuerdo de\nParís, y con la finalidad de avanzar en la planificación y la implementación de\nmedidas de adaptación al cambio climático, se hace necesario poner en\nfuncionamiento un Programa País para la Adaptación Climática.\n\n21.-Que a través del Programa País para la Adaptación Climática se propone\nla elaboración de un sistema de reconocimientos, autorizado y avalado por la\nDirección de Cambio Climático del Ministerio de Ambiente y Energía, para\nincentivar la acción climática desde la adaptación.\n\n22.-Que a efectos de potenciar de forma integral la acción climática desde\nlos enfoques de mitigación y adaptación, se requiere crear un Programa País\npara el Liderazgo Climático, a cargo de la Dirección de Cambio Climático, integrado\npor un Programa País para la Carbono Neutralidad y un Programa País para la\nAdaptación Climática.\n\n23.-Que el Ministro de Ambiente y Energía ejerce la rectoría política en materia ambiental y lo\ncorrespondiente a los temas relativos al cambio climático; por lo que podrá en el ejercicio de sus\nfunciones, ordenar las actividades de la Dirección del Cambio Climático, establecidas en el\nReglamento Orgánico Institucional, como órgano para el seguimiento del cambio climático y la\nmitigación y adaptación a sus efectos.\n\n24.-Que el Ministerio de Ambiente y Energía requiere de un procedimiento\nágil que permita crear, modificar y oficializar las distintas categorías y\nsubcategorías de los programas país, mientras que la Dirección de Cambio\nClimático precisa de un mecanismo que facilite la modificación y actualización\nde los documentos y lineamientos para la participación en los mismos.\n\n25.-Que los programas que integran el Programa País para el Liderazgo\nClimático tienen una naturaleza estrictamente voluntaria, en virtud de la cual,\nlas organizaciones, cantones y/o concejos de distrito, centros educativos y\ndemás participantes que opten por adherirse a las distintas categorías y\nsubcategorías con el fin de obtener los reconocimientos que otorgan, se\ncomprometen voluntariamente a cumplir con sus trámites y requerimientos,\nencontrándose, en todo momento, facultados para desistir libremente de los\nmismos, renunciando con ello a los beneficios que brindan.\n\n26.-Que de conformidad con el artículo 12 del Decreto Ejecutivo Nº\n37045-MP-MEIC del 22 de febrero de 2012 \"Reglamento a la Ley de Protección\nal Ciudadano del Exceso de Requisitos y Trámites Administrativos\" y sus\nreformas, se considera que por la naturaleza estrictamente voluntaria del\nPrograma País para el Liderazgo Climático y los programas país que lo integran,\nno es necesario completar la Sección I denominada Control Previo de Mejora\nRegulatoria, que conforma el formulario de Evaluación Costo Beneficio, toda vez\nque los mismos no establecen trámites ni requerimientos que el administrado\ntenga que obtener de la Administración Central. Por tanto,\n\nDecretan:\n\n\"CREACIÓN DEL PROGRAMA PAÍS\n\nPARA EL LIDERAZGO CLIMÁTICO\n\nDE LA DIRECCIÓN DE CAMBIO\n\nCLIMÁTICO\"\n\nArtículo 1º-Créase el Programa País para el Liderazgo Climático\nde la Dirección de Cambio Climático del Ministerio de Ambiente y Energía, cuyo\nobjetivo es potenciar, de forma integral, la acción climática desde los\nenfoques de mitigación y adaptación.\n\nEl Programa País para el Liderazgo Climático se encuentra integrado por el\nPrograma País para la Carbono Neutralidad y por el Programa País para la\nAdaptación Climática.\n\nArtículo\n2º-El Programa País para la Carbono Neutralidad tiene por objetivo brindar un\nmecanismo para reconocer la adecuada gestión de las emisiones de gases de\nefecto invernadero categorías y subcategorías.\n\nLa\ndocumentación necesaria para la creación de las categorías y subcategorías será\nelaborada por la Dirección de Cambio Climático, la cual someterá a valoración y\ndecisión del Ministro o Ministra de Ambiente y Energía según corresponda.\n\nLa aprobación\ny oficialización de las categorías y subcategorías, así como sus modificaciones\nposteriores, se hará a través de un acuerdo emitido por el Ministro o Ministra\nsegún corresponda, el cual será publicado en el Diario Oficial La Gaceta.\n\nArtículo 6º-La información relacionada con cada una de las categorías y subcategorías, incluyendo\nlos documentos y lineamientos para la participación en los programas país, estará disponible, vía\nweb, en la página oficial de la Dirección de Cambio Climático: www.cambioclimatico.go.cr, así como\nen formato físico, en la oficina de Dirección de Cambio Climático del Ministerio de Ambiente y\nEnergía y será ampliamente difundida por los mecanismos que la Dirección de Cambio Climático estime\nconvenientes para garantizar su adecuada diseminación.\n\nArtículo\n7º-Los documentos y lineamientos para la participación en las distintas\ncategorías y subcategorías de los programas país, serán revisados y\nactualizados, al menos cada tres años, por parte de la Dirección de Cambio\nClimático, de acuerdo con los avances y mejoras en las metodologías y\nlineamientos utilizados y las necesidades del país, de las organizaciones,\ncantones y/o concejos de distrito, centros de educativos y demás participantes.\n\nUna vez revisados y actualizados,\nla Dirección de Cambio Climático, además de hacerlos accesibles por las vías\nestablecidas en el artículo 6 de este decreto, los comunicará, vía correo\nelectrónico, a cada una de las organizaciones, cantones y/o concejos de\ndistrito, centros de educativos y demás participantes que se encuentren\nsuscritos a los programas país.\n\nArtículo\n8º-Deróguese el Decreto Ejecutivo N° 41122-MINAE del 06 de abril de 2018,\npublicado en La Gaceta N° 93 del 28 de mayo de 2018.\n\nTransitorio\nI.-Las organizaciones, cantones y/o concejos de distrito, centros\neducativos y demás participantes, podrán optar por los reconocimientos de los\nprogramas país, una vez que las respectivas categorías y subcategorías sean\noficializadas de acuerdo al procedimiento establecido en el artículo 5 de 42884-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nUsing the powers conferred by articles 140, subsections 3) and 18), 50 and 146 of the Political Constitution; article 27 subsection 1), 28 subsection 2) paragraph b) and 240 of the General Law on Public Administration, N° 6227 of May 2, 1978; articles 2 paragraph c), 6 and 49 of the Organic Environmental Law N° 7554, of October 4, 1995; article 2 of the Organic Law of the Ministry of Environment and Energy, N° 7152 of June 5, 1990, the United Nations Framework Convention on Climate Change, Law N° 7414 of June 13, 1994; the Law Approving the Kyoto Protocol to the United Nations Framework Convention on Climate Change, N° 8219 of March 8, 2002; the Paris Agreement, Law N° 9405 of October 4, 2016; the Decree that formalizes the Action Plan of the National Climate Change Strategy, Executive Decree N° 39114-MINAE of July 25, 2015; the National Climate Change Adaptation Policy, Executive Decree N°41091 of April 20, 2018; the Decree Formalizing the Decarbonization Plan Commitment of the Bicentennial Government, Executive Decree N° 41581 of February 24, 2019 and articles 42 and 43 of Executive Decree Nº 35669-MINAET of December 4, 2009, Organic Regulations of the Ministry of Environment and Energy.\n\nConsidering:\n\n1º-That the country ratified the United Nations Framework Convention on Climate Change, hereinafter UNFCCC.\n\n2º-That our country assumed the commitment to participate in the efforts to strengthen the regime established by the UNFCCC, in order to contribute to guaranteeing a global and timely response, based on the information provided by the Intergovernmental Panel on Climate Change (IPCC) and on the basis of the principles governing the UNFCCC.\n\n3º-That in 2007 Costa Rica launched its commitment to be carbon neutral by 2021, a goal included in the National Climate Change Strategy (2009) and in its Action Plan (2013).\n\n4º-That Costa Rica formalized its first Country Program for Carbon Neutrality, through Agreement 36-2012 MINAET of June 19, 2012, which was rendered without effect by Executive Decree Nº 41122-MINAE of April 6, 2018 that formalized the Country Program Carbon Neutrality 2.0.\n\n5º-That the standard INTE B5 \"Standard for Demonstrating Carbon Neutrality\" was developed to allow any organization to demonstrate its carbon neutrality.\n\n6º-That Costa Rica endorsed the Sustainable Development Goals established in the United Nations 2030 Agenda, whose goal thirteen - Climate Action - calls for adopting urgent measures to combat climate change and its effects.\n\n7º-That in 2015, Costa Rica prepared its Nationally Determined Contribution (NDC), as a priority part of climate action, including a long-term mitigation objective for the year 2050, designed based on the best science available at that time and its global responsibility to advance towards global carbon neutrality for the second half of the century; likewise, it acquired the commitment to formulate and formalize a National Adaptation Plan.\n\n8º-That Costa Rica signed and ratified the Paris Agreement through law number N° 9405 of October 4, 2016 and formalized its Nationally Determined Contribution (NDC).\n\n9º-That the Paris Agreement presupposes the decarbonization of the global economy and the achievement of carbon neutrality in the second half of the 21st century, as well as the obligation to integrate climate change adaptation into relevant socioeconomic and environmental processes.\n\n10.-That Costa Rica formalized the Country Program Carbon Neutrality 2.0, in the categories a) Organizational and b) Cantonal, through Executive Decree Nº 41122-MINAE of April 6, 2018, whose general objective is to provide a mechanism to recognize the adequate management of greenhouse gas (GHG) emissions by public and private organizations, in order to support the country's commitments regarding climate action.\n\n11.-That through Executive Decree Nº 41091-MINAE of April 20, 2018, the National Climate Change Adaptation Policy 2018-2030 was formalized, whose general objective focuses on transitioning towards a resilient development model for Costa Rican society, that avoids human losses and moderates the material damages generated by the adverse effects of climate change, contributes to the quality of life of the most vulnerable populations, seizes opportunities to innovate and transform productive sectors, and ensures the continuity of public services.\n\n12.-That through Executive Decree Nº 41581-MINAE of February 24, 2019, the Decarbonization Plan Commitment of the Bicentennial Government was formalized, as an instrument to chart the routes of change in key areas to reverse the growth of greenhouse gas emissions, as well as to promote the modernization and revitalization of the economy under a green growth vision.\n\n13.-That the Decarbonization Plan Commitment of the Bicentennial Government was declared of public and national interest by Executive Decree N° 41561-MP-MINAE of February 7, 2019.\n\n14.-That the National Program for Environmental Labeling and Energy Efficiency of Costa Rica was formalized through Agreement 006-2019-MINAE of February 22, 2019, whose general objective is to establish the management conditions for environmental and energy labels in Costa Rica, while the Regulation for the right and use of an environmental label of Costa Rica (EACR) or an energy efficiency label (EECR) on a product or service was formalized through Resolution R-274-2019MINAE of nine hours twenty minutes of October 22, 2019.\n\n15.-That the National Development and Public Investment Plan (PNDIP) of the Bicentennial 2019-2022, issued through Executive Decree Nº 41848-MIDEPLAN of June 18, 2019, establishes management mechanisms applicable to climate action and sets as objectives of the strategic area Infrastructure, Mobility and Territorial Planning, the following: Increase the resilience of Costa Rican society to the impacts of climate change, through the application of adaptation actions based on communities and ecosystems; contribute to the conservation, sustainable use and resilience of biodiversity; and contribute to carbon neutrality with the contribution of the forestry sector and key sectors such as public transport, agriculture and livestock, and by promoting the participation of local governments for climate change mitigation.\n\n16.-That Costa Rica is in the process of accession to the Organisation for Economic Co-operation and Development (OECD), and must take actions for compliance with a set of legal instruments of that organization. In environmental matters, these legal instruments promote that member countries adopt international norms and standards, best practices, and policy guidelines on climate change, biodiversity, desertification, ecosystem degradation, and water and air pollution.\n\n17.-That climate action, which includes mitigation and adaptation approaches, is a cross-cutting axis for the economy, society, and a new development model, based on decarbonization and the generation of resilience, as pillars to guarantee competitiveness and inclusive growth.\n\n18.-That the Country Program Carbon Neutrality 2.0 forms part of the efforts made by the country in its role as an environmental leader and in accordance with the country's mitigation objectives in the context of the National Climate Change Strategy and its Action Plan, the international commitments established in the Nationally Determined Contribution (NDC) and the Paris Agreement.\n\n19.-That given the success of the Country Program Carbon Neutrality 2.0 for companies, institutions, organizations, municipalities and districts, as well as the need for continuous improvement, its reformulation is required, for the purpose of updating the existing categories, as well as expanding its scope towards new categories and subcategories of carbon neutrality.\n\n20.-That as part of the country's leadership efforts in environmental matters and in order to support the fulfillment of the adaptation objectives included in the National Climate Change Strategy and its Action Plan, the National Climate Change Adaptation Policy, and the National Development and Public Investment Plan (PNDIP) of the Bicentennial 2019-2022, in response to the international commitments acquired in the Nationally Determined Contribution (NDC) and in the Paris Agreement, and with the purpose of advancing in the planning and implementation of climate change adaptation measures, it is necessary to put into operation a Country Program for Climate Adaptation.\n\n21.-That through the Country Program for Climate Adaptation, the development of a recognition system is proposed, authorized and endorsed by the Climate Change Directorate of the Ministry of Environment and Energy, to incentivize climate action from adaptation.\n\n22.-That in order to comprehensively enhance climate action from the mitigation and adaptation approaches, it is required to create a Country Program for Climate Leadership, in charge of the Climate Change Directorate, composed of a Country Program for Carbon Neutrality and a Country Program for Climate Adaptation.\n\n23.-That the Minister of Environment and Energy exercises political stewardship in environmental matters and in issues relating to climate change; therefore, in the exercise of his/her duties, he/she may order the activities of the Climate Change Directorate, established in the Institutional Organic Regulations, as the body for monitoring climate change and the mitigation of and adaptation to its effects.\n\n24.-That the Ministry of Environment and Energy requires an agile procedure that allows for the creation, modification and formalization of the different categories and subcategories of the country programs, while the Climate Change Directorate requires a mechanism that facilitates the modification and updating of the documents and guidelines for participation in them.\n\n25.-That the programs that make up the Country Program for Climate Leadership have a strictly voluntary nature, by virtue of which, the organizations, cantons and/or district councils, educational centers and other participants that choose to adhere to the different categories and subcategories in order to obtain the recognitions they grant, voluntarily commit to complying with their procedures and requirements, being, at all times, empowered to freely desist from them, thereby renouncing the benefits they provide.\n\n26.-That in accordance with article 12 of Executive Decree Nº 37045-MP-MEIC of February 22, 2012 \"Regulation to the Law for Citizen Protection from Excessive Requirements and Administrative Procedures\" and its reforms, it is considered that due to the strictly voluntary nature of the Country Program for Climate Leadership and the country programs that comprise it, it is not necessary to complete Section I called Prior Control of Regulatory Improvement, which makes up the Cost-Benefit Evaluation form, since they do not establish procedures or requirements that the administered party has to obtain from the Central Administration. Therefore,\n\nThey decree:\n\n\"CREATION OF THE COUNTRY PROGRAM\n\nFOR CLIMATE LEADERSHIP\n\nOF THE CLIMATE CHANGE\n\nDIRECTORATE\"\n\nArticle 1º-The Country Program for Climate Leadership of the Climate Change Directorate of the Ministry of Environment and Energy is hereby created, whose objective is to comprehensively enhance climate action from the mitigation and adaptation approaches.\n\nThe Country Program for Climate Leadership is composed of the Country Program for Carbon Neutrality and the Country Program for Climate Adaptation.\n\nArticle 2º-The Country Program for Carbon Neutrality has the objective of providing a mechanism to recognize the adequate management of greenhouse gas (GHG) emissions by different actors, in order to support the country's commitments in climate action.\n\nArticle 3º-The Country Program for Climate Adaptation has the objective of recognizing the adequate planning and implementation of climate change adaptation measures, in order to reduce vulnerability and build resilience in Costa Rica to the impacts of climate change.\n\nArticle 4º-The Climate Change Directorate of the Ministry of Environment and Energy is the entity in charge of the Country Program for Climate Leadership and its attached programs: Country Program for Carbon Neutrality and Country Program for Climate Adaptation.\n\nArticle 5º-The Country Programs for Carbon Neutrality and Climate Adaptation are composed of categories and subcategories.\n\nThe necessary documentation for the creation of the categories and subcategories will be prepared by the Climate Change Directorate, which will submit it for assessment and decision by the Minister of Environment and Energy as applicable.\n\nThe approval and formalization of the categories and subcategories, as well as their subsequent modifications, will be done through an agreement issued by the Minister as applicable, which will be published in the Official Gazette La Gaceta.\n\nArticle 6º-The information related to each of the categories and subcategories, including the documents and guidelines for participation in the country programs, will be available, via the web, on the official page of the Climate Change Directorate: www.cambioclimatico.go.cr, as well as in physical format, at the office of the Climate Change Directorate of the Ministry of Environment and Energy and will be widely disseminated through the mechanisms that the Climate Change Directorate deems appropriate to guarantee its adequate dissemination.\n\nArticle 7º-The documents and guidelines for participation in the different categories and subcategories of the country programs will be reviewed and updated, at least every three years, by the Climate Change Directorate, in accordance with the advances and improvements in the methodologies and guidelines used and the needs of the country, the organizations, cantons and/or district councils, educational centers and other participants.\n\nOnce reviewed and updated, the Climate Change Directorate, in addition to making them accessible through the means established in article 6 of this decree, will communicate them, via email, to each of the organizations, cantons and/or district councils, educational centers and other participants that are subscribed to the country programs.\n\nArticle 8º-Executive Decree N° 41122-MINAE of April 6, 2018, published in La Gaceta N° 93 of May 28, 2018, is hereby repealed.\n\nTransitory I.-The organizations, cantons and/or district councils, educational centers and other participants may opt for the recognitions of the country programs, once the respective categories and subcategories are formalized according to the procedure established in article 5 of this decree.\n\nTransitory II.-The recognitions that have been granted under Executive Decree N° 41122-MINAE will remain valid until their expiration.\n\nTransitory III.-The organizations, cantons and/or district councils, educational centers and other participants that currently participate in the Country Program Carbon Neutrality 2.0 under Executive Decree N° 41122-MINAE, will have a transition period of one year, counted from the publication of the respective ministerial agreement that formalizes the category in which they participate, to comply with the provisions established therein.\n\nTransitory IV.-The organizations, cantons and/or district councils, educational centers and other participants that opt for the renewal of the recognitions granted under Executive Decree N° 41122-MINAE, must comply with the provisions established in the respective categories that are formalized under article 5 of this decree.\n\nArticle 9º-It takes effect upon its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic.-San José, on the fourth of March of the year two thousand twenty-one." }
