el Decreto que oficializa el Plan de Descarbonización Compromiso del\nGobierno del Bicen­tenario, Decreto Ejecutivo Nº 41581 del 24 de febrero de 2019 y los artículos 42\ny 43 del Decreto Ejecutivo Nº 35669-MINAET del 04 de diciembre del 2009, Reglamento Orgánico del\nMinisterio de Ambiente y Energía.\n\nConsiderando:\n\n1º-Que el país ratificó la Convención Marco de Naciones\nUnidas sobre el Cambio Climático (CMNUCC).\n\n2º-Que Costa Rica suscribió los Objetivos de Desarrollo Sostenible\nestablecidos en la Agenda 2030 de las Naciones Unidos, cuyo objetivo\ntrece-Acción por el Clima-llama a adoptar medidas urgentes para combatir el\ncambio climático y sus efectos.\n\n3º-Que Costa Rica firmó y ratificó el Acuerdo de París medi­ante la Ley\nnúmero Nº 9405 del 04 de octubre del 2016 y oficializó su Contribución\nNacionalmente Determinada (NDC por sus siglas en inglés).\n\n4º-Que a través del Decreto Ejecutivo Nº 41091-MINAE del 20 de abril de\n2018, fue oficializada la Política Nacional de Adap­tación al Cambio Climático\n2018-2030.\n\n5º-Que por medio del Decreto Ejecutivo Nº 41581-MINAE del 24 de febrero de\n2019, se oficializó el Plan de Descarbonización\nCompromiso del Gobierno del Bicentenario.\n\n6º-Que el Plan Nacional de Desarrollo y de Inversión Pública (PNDIP) del\nBicentenario 2019-2022, emitido a través del Decreto Ejecutivo Nº\n41848-MIDEPLAN del 18 de junio de 2019, establece mecanismos de gestión\naplicables a la acción climática.\n\n7º-Que Costa Rica se encuentra en proceso de adhesión a la Organización\npara la Cooperación y Desarrollo Económico (OCDE), debiendo tomar acciones para\nel cumplimiento de un con­junto de instrumentos legales de dicha organización.\nEn materia am­biental estos instrumentos legales promueven que los países miem­bros\nadopten normas y estándares internacionales, mejores prácticas y directrices de\npolítica en materia de cambio climático, biodivers­idad, desertificación, el\ndeterioro de ecosistemas y la contaminación de aguas y aire.\n\n8º-Que por medio del Decreto Ejecutivo Nº 42884-MINAE del 4 de marzo de\n2021, se creó el Programa País para el Liderazgo Climático de la Dirección de\nCambio Climático del Ministerio de Ambiente y Energía, integrado por los\nProgramas País de Carbono Neutralidad y de Adaptación Climática.\n\n9º-Que el artículo 5 del Decreto Ejecutivo Nº 42884-MINAE del 4 de marzo de\n2021 establece el procedimiento para la creación y oficialización de las\ncategorías y subcategorías que componen los Programas País de Carbono\nNeutralidad y de Adaptación Climática.\n\n10.-Que en cumplimiento de dicho procedimiento, la Direc­ción de Cambio\nClimático elaboró la documentación necesaria para la creación de la Categoría\nOrganizacional dentro del Programa País para la Carbono Neutralidad, la cual\nsometió a valoración y decisión de la Ministra de Ambiente y Energía.\n\n11.-Que una vez valorada la documentación presentada por la Dirección de\nCambio Climático, se constató que la misma cumple a cabalidad con los objetivos\ny fines del Programa País para la Car­bono Neutralidad. Por tanto,\n\nACUERDA:\n\nOFICIALIZAR LA CATEGORÍA ORGANIZACIONAL DEL\n\nPROGRAMA PAÍS PARA LA CARBONO NEUTRALIDAD\n\nArtículo 1º-Oficialícese la Categoría Organizacional del\nPro­grama País para la Carbono Neutralidad, la cual tiene por objetivo\nreconocer la adecuada gestión de las emisiones de gases de efecto invernadero\n(GEI) a organizaciones públicas y privadas; cuyo texto, documentación y\nlineamientos pueden ser accedidos vía web, en la página oficial de la Dirección\nde Cambio Climático: www.cambio­climatico.go.cr, o\nbien, en formato físico, que estará disponible en la oficina de la\nDirección de Cambio Climático del Ministerio de Ambiente y Energía.\n\n(Nota de Sinalevi: El Pro­grama País para la Carbono Neutralidad se\nextrajo del sitio web de la Dirección\nde Cambio Climático y se transcribe a continuación:)\n\nPrograma País Carbono Neutralidad\n\n(PPCN) de Costa Rica\n\nEl Programa País Carbono Neutralidad de Costa Rica (PPCN) es un mecanismo oficial para que las\norganizaciones, productos, comunidades, centros educativos y eventos se unan al objetivo de\ndescarbonización a largo plazo del país, con el fin de alcanzar cero emisiones netas para el 2050.\n\nEl PPCN es un mecanismo voluntario a\nnivel país que permite a las organizaciones, fabricantes de productos,\ncomunidades, centros educativos y organizadores de eventos medir sus\ninventarios de carbono, demostrar reducciones de emisiones y alcanzar una neutralidad\nde carbono verificable. Este programa pertenece a la Dirección de Cambio Climático\n(DCC) del Ministerio de Ambiente y Energía (MINAE).\n\nEl programa fue creado en el 2012\ncon una categoría organizacional. Ese año, dos empresas pioneras se unieron a\nesa categoría y alcanzaron la Carbono Neutralidad al reducir y compensar todas\nsus emisiones. En el 2018, el PPCN se reactivó con un sistema de reconocimiento\nde cinco pasos (ver \"El sistema de reconocimiento\" página siguiente), el cual\npermite a las organizaciones avanzar en sus esfuerzos de descarbonización.\nActualmente, más de 200 organizaciones participan en el programa.\n\nTras el éxito de su primera\ncategoría (organizacional), el PPCN amplió su ámbito de aplicación y ahora\nincluye el reconocimiento a organizaciones, fabricantes de productos, eventos\n(como subcategoría dentro de los productos) e instituciones educativas (como subcategoría\ndentro de la organizacional).\n\nLas categorías del PPCN\n\nLas cinco categorías del PPCN\nofrecen vías para diferentes actores sociales.\n\nORGANIZACIONES\n\nLas organizaciones públicas y\nprivadas pueden unirse a esta categoría, con criterios diferenciados\nrelacionados con la complejidad de cada organización. Cada organización debe\ninformar, reducir y compensar todas las emisiones directas e indirectas de\nenergía, mientras que otras emisiones indirectas pueden informarse\nvoluntariamente. Los reconocimientos son válidos por un año, sujetos a una\nverificación anual. Los reconocimientos plus se otorgan a organizaciones\nque realizan esfuerzos extraordinarios que van más allá de los requisitos\nmínimos, como crear reducciones adicionales, desarrollar cadenas de suministro\nbajas en carbono y fomentar la participación de la sociedad civil.\n\nCentros educativos preescolares,\nescuelas primarias y colegios de secundaria pueden optar por esta categoría\ndiferenciada, la cual posee criterios específicos y sencillos para este tipo de\norganizaciones, pero con un mayor enfoque en la sensibilización de la población\nestudiantil, su personal administrativo y sus familias.\n\nLas empresas pueden crear un\nanálisis del ciclo de vida para productos específicos y así reducir y compensar\nsu huella de carbono. Cada empresa que diseñe, desarrolle, distribuya o\ncomercialice un producto debe estimar su huella de carbon\ny compensarla, incluso antes de ingresar al mercado, generando una declaración\nde producto ambiental verificada y confiable. Los reconocimientos finales se\notorgan después de la verificación.\n\nLa huella de carbono de los eventos\nen esta subcategoría incluye todo, desde la planificación hasta la ejecución\ndel evento, incluyendo las actividades de cierre. Los eventos reciben un\nreconocimiento preliminar \"en progreso\" antes y durante su ejecución.\nLos reconocimientos definitivos se otorgan después de la finalización, una vez\nverificada, y, si es necesario, se toman medidas adicionales.\n\nLa categoría cantonal permite a los\nmunicipios y distritos medir y gestionar las emisiones en sus territorios. El sistema de reconocimientos describe las etapas que deben\nseguir organizaciones, fabricantes de productos, comunidades, centros\neducativos y organizadores de eventos para alcanzar la carbono neutralidad.\nEste sistema proporciona un camino claro hacia la carbono neutralidad,\nincluyendo dos categorías plus, las cuales reconocen esfuerzos sobresalientes.\n\nAdemás, brinda a cada organización\nparticipante, fabricante de productos, comunidad, centro educativo y\norganizador de eventos la oportunidad de contribuir de acuerdo con sus\nrespectivas circunstancias y capacidades, y a la vez establece un camino claro\nde superación personal.\n\n¿Quién participa en el programa?\n\nEl PPCN tiene cuatro tipos directos\nde participantes: la parte implementadora, la entidad de verificación, el\norganismo de acreditación y la DCC. Una parte interesada indirecta es el público\ngeneral, el cual utiliza la información del programa para tomar mejores\ndecisiones en cuanto a las organizaciones, productos o actividades con las que\nse involucra.\n\nCualquier organización participante,\nfabricante de productos, comunidad, centro educativo y organizador de evento\nparticipante en el PPCN se convierte en una parte implementadora. Son\nresponsables de producir su inventario de carbono y tomar cualquier acción de\nreducción o compensación requerida para su respectivo reconocimiento.\n\nLa parte verificadora debe revisar\nel inventario y las medidas adoptadas por la parte implementadora y\nproporcionar un informe. Cada categoría tiene su propio ciclo de verificación,\nel cual oscila entre uno y tres años. La parte verificadora debe estar acreditada\nante el Ente Costarricense de Acreditación (ECA).\n\nLa Dirección de Cambio Climático es\nresponsable de supervisar el programa y otorgar los reconocimientos, una vez\nrealizada la declaración oficial de las partes verificadoras.\n\nResultados\n\nEl PPCN ha sido un componente clave\nde la acción climática en Costa Rica, con resultados cuantificables y\nverificables desde su creación. Los aspectos más destacados de su trabajo\nincluyen:\n\n·       \nMás de 200\norganizaciones, 21 municipios y 2 distritos se han unido al programa desde el\n2012.\n\n·       \nEl PPCN se menciona explícitamente\ncomo una acción clave en el Plan Nacional de Descarbonización\nde Costa Rica.\n\n·       \nLos municipios participantes\nrepresentan el 38% del territorio de Costa Rica e incluyen el 42% de su\npoblación.\n\n·       \nEn el 2015, el equivalente a 875.711\ntoneladas de CO2 fueron reportadas por las organizaciones participantes en el\nprograma. Esto significa que el equivalente al 8% de las emisiones nacionales\nde ese año en Costa Rica fueron reportadas al PPCN.\n\n·       \nMás de 1.700 personas han sido\ncapacitadas a través de la categoría organizacional del PPCN, y 400 más en la\ncategoría cantonal.\n\n·       \nSolo entre el 2017 y 2020, las\norganizaciones participantes en el PPCN invirtieron más de $14.9 millones en\nsus propias acciones de reducción de fondos (como paneles solares, uso\neficiente de energía y vehículos). Solo esto representa las acciones de 161\norganizaciones, las cuales informaron esos datos.\n\n·       \nEl beneficio social del PPCN es de\nmás de $45 millones. Con un costo social de carbono de $42 por tonelada, el\nPPCN ha contribuido en gran medida a la sociedad. the Decree that officializes the Decarbonization Plan Commitment of the\nBicentennial Government, Executive Decree No. 41581 of February 24, 2019 and articles 42\nand 43 of Executive Decree No. 35669-MINAET of December 4, 2009, Organic Regulation of the\nMinistry of Environment and Energy.\n\nConsidering:\n\n1º-That the country ratified the United Nations Framework Convention on\nClimate Change (UNFCCC).\n\n2º-That Costa Rica subscribed to the Sustainable Development Goals\nestablished in the United Nations 2030 Agenda, whose goal\nthirteen-Climate Action-calls for adopting urgent measures to combat\nclimate change and its effects.\n\n3º-That Costa Rica signed and ratified the Paris Agreement through Law\nnumber No. 9405 of October 4, 2016 and officialized its Nationally\nDetermined Contribution (NDC).\n\n4º-That through Executive Decree No. 41091-MINAE of April 20,\n2018, the National Climate Change Adaptation Policy\n2018-2030 was officialized.\n\n5º-That through Executive Decree No. 41581-MINAE of February 24,\n2019, the Decarbonization Plan\nCommitment of the Bicentennial Government was officialized.\n\n6º-That the Bicentennial National Development and Public Investment Plan (PNDIP)\n2019-2022, issued through Executive Decree No.\n41848-MIDEPLAN of June 18, 2019, establishes management mechanisms\napplicable to climate action.\n\n7º-That Costa Rica is in the process of accession to the Organization\nfor Economic Cooperation and Development (OECD), and must take actions for\ncompliance with a set of legal instruments of said organization.\nIn environmental matters, these legal instruments promote that member\ncountries adopt international norms and standards, best practices, and policy\nguidelines on climate change, biodiversity, desertification, the\ndeterioration of ecosystems, and water and air pollution.\n\n8º-That through Executive Decree No. 42884-MINAE of March 4,\n2021, the Country Program for Climate Leadership of the Climate Change Directorate\nof the Ministry of Environment and Energy was created, composed of the\nCountry Programs for Carbon Neutrality and Climate Adaptation.\n\n9º-That article 5 of Executive Decree No. 42884-MINAE of March 4,\n2021 establishes the procedure for the creation and officialization of the\ncategories and subcategories that make up the Country Programs for Carbon\nNeutrality and Climate Adaptation.\n\n10.-That in compliance with said procedure, the Climate Change\nDirectorate prepared the documentation necessary for the creation of the Organizational\nCategory within the Country Program for Carbon Neutrality, which it\nsubmitted for evaluation and decision by the Minister of Environment and Energy.\n\n11.-That once the documentation presented by the Climate Change\nDirectorate was evaluated, it was verified that it fully complies with the objectives\nand purposes of the Country Program for Carbon Neutrality. Therefore,\n\nAGREES:\n\nTO OFFICIALIZE THE ORGANIZATIONAL CATEGORY OF THE\n\nCOUNTRY PROGRAM FOR CARBON NEUTRALITY\n\nArticle 1º-Officialize the Organizational Category of the\nCountry Program for Carbon Neutrality, which aims to\nrecognize the adequate management of greenhouse gas (GHG) emissions\nby public and private organizations; whose text, documentation, and\nguidelines can be accessed via the web, on the official page of the Climate Change Directorate: www.cambioclimatico.go.cr, or\nin physical format, which will be available at the office of the\nClimate Change Directorate of the Ministry of Environment and Energy.\n\n(Sinalevi Note: The Country Program for Carbon Neutrality was\nextracted from the website of the Climate Change Directorate\nand is transcribed below:)\n\nCountry Program for Carbon Neutrality\n\n(PPCN) of Costa Rica\n\nThe Country Program for Carbon Neutrality (PPCN) of Costa Rica is an official mechanism for\norganizations, products, communities, educational centers, and events to join the country's long-term\ndecarbonization goal, in order to achieve net-zero emissions by 2050.\n\nThe PPCN is a voluntary country-level\nmechanism that allows organizations, product manufacturers,\ncommunities, educational centers, and event organizers to measure their\ncarbon inventories, demonstrate emission reductions, and achieve verifiable carbon\nneutrality. This program belongs to the Climate Change Directorate\n(DCC) of the Ministry of Environment and Energy (MINAE).\n\nThe program was created in 2012\nwith an organizational category. That year, two pioneering companies joined\nthat category and achieved Carbon Neutrality by reducing and offsetting all\ntheir emissions. In 2018, the PPCN was reactivated with a five-step recognition\nsystem (see \"The recognition system\" next page), which\nallows organizations to advance in their decarbonization efforts.\nCurrently, more than 200 organizations participate in the program.\n\nFollowing the success of its first\ncategory (organizational), the PPCN expanded its scope of application and now\nincludes recognition for organizations, product manufacturers, events\n(as a subcategory within products), and educational institutions (as a subcategory\nwithin the organizational).\n\nThe PPCN Categories\n\nThe five categories of the PPCN\noffer pathways for different social actors.\n\nORGANIZATIONS\n\nPublic and private\norganizations can join this category, with differentiated criteria\nrelated to the complexity of each organization. Each organization must\nreport, reduce, and offset all direct and indirect energy\nemissions, while other indirect emissions may be reported\nvoluntarily. Recognitions are valid for one year, subject to\nannual verification. Plus recognitions are granted to organizations\nthat undertake extraordinary efforts that go beyond the minimum\nrequirements, such as creating additional reductions, developing low-carbon supply chains, and fostering civil society participation.\n\nPreschool educational centers,\nprimary schools, and secondary schools can opt for this differentiated\ncategory, which has specific and simple criteria for this type of\norganization, but with a greater focus on raising awareness among the\nstudent population, their administrative staff, and their families.\n\nCompanies can create a\nlife cycle analysis for specific products and thus reduce and offset\ntheir carbon footprint. Each company that designs, develops, distributes, or\nmarkets a product must estimate its carbon footprint\nand offset it, even before entering the market, generating a verified and reliable environmental\nproduct declaration. The\nmajority of emission sources are subject to mandatory reporting, which\nincludes road transport, energy use in buildings and\nindustry, agriculture and waste, as well as other types of land\nuse.\n\nThe Recognition System\n\nThe PPCN is built around a\nfive-step recognition system, which rewards\ndecarbonization actions through their official\nand public recognition. The recognition system allows citizens,\nconsumers, and other organizations to identify the participants and their level\nof commitment. The recognition system describes the stages that\norganizations, product manufacturers, communities, educational\ncenters, and event organizers must follow to achieve carbon neutrality.\nThis system provides a clear path towards carbon neutrality,\nincluding two plus categories, which recognize outstanding efforts.\n\nIn addition, it gives each participating\norganization, product manufacturer, community, educational center, and\nevent organizer the opportunity to contribute according to their\nrespective circumstances and capacities, while also establishing a clear path\nfor self-improvement.\n\nWho Participates in the Program?\n\nThe PPCN has four direct types\nof participants: the implementing party, the verification entity, the\naccreditation body, and the DCC. An indirect interested party is the general\npublic, which uses the program's information to make better\ndecisions regarding the organizations, products, or activities it\nengages with.\n\nAny participating organization,\nproduct manufacturer, community, educational center, and event organizer\nparticipating in the PPCN becomes an implementing party. They are\nresponsible for producing their carbon inventory and taking any reduction\nor offset action required for their respective recognition.\n\nThe verifying party must review\nthe inventory and the measures adopted by the implementing party and\nprovide a report. Each category has its own verification cycle,\nwhich ranges from one to three years. The verifying party must be accredited\nbefore the Costa Rican Accreditation Body (ECA).\n\nThe Climate Change Directorate is\nresponsible for supervising the program and granting the recognitions, once\nthe official declaration has been made by the verifying parties.\n\nResults\n\nThe PPCN has been a key component\nof climate action in Costa Rica, with quantifiable and\nverifiable results since its creation. The highlights of its work\ninclude:\n\n· \nMore than 200\norganizations, 21 municipalities, and 2 districts have joined the program since\n2012.\n\n· \nThe PPCN is explicitly mentioned\nas a key action in Costa Rica's National Decarbonization\nPlan.\n\n· \nThe participating municipalities\nrepresent 38% of Costa Rica's territory and include 42% of its\npopulation.\n\n· \nIn 2015, the equivalent of 875,711\ntonnes of CO2 were reported by the organizations participating in the\nprogram. This means that the equivalent of 8% of that year's national emissions in Costa Rica were reported to the PPCN.\n\n· \nMore than 1,700 people have been\ntrained through the PPCN's organizational category, and 400 more in the\ncantonal category.\n\n· \nBetween 2017 and 2020 alone, the\norganizations participating in the PPCN invested more than $14.9 million in\ntheir own fund reduction actions (such as solar panels, efficient\nenergy use, and vehicles). This alone represents the actions of 161\norganizations, which reported that data.\n\n· \nThe social benefit of the PPCN is\nmore than $45 million. With a social cost of carbon of $42 per tonne, the\nPPCN has contributed greatly to society. Close to the equivalent of\n630,761 tonnes of carbon dioxide have been reduced or offset since\n2012, and another 449,674 tonnes have been removed.\n\nArticle 2º-In accordance with Transitional Provision III of Executive Decree No. 42884-MINAE of March\n4, 2021, the organizations, cantons and/or district councils, educational centers, and other\nparticipants that currently participate in this category under Executive Decree No.\n41122-MINAE, or that enter for the first time in 2021 in the organizational or community\ncategories, have a term of one year, counted from the publication of this agreement\nin the Official Gazette La Gaceta, to comply with the new provisions and requirements established\nby the category officialized in article one of this agreement.\n\nArticle 3º-Publish in the Official Gazette La Gaceta.\n\nIt takes effect upon its publication in the Official Gazette La\nGaceta.\n\nSan\nJosé, on the 19th day of April, two thousand twenty-one." }
