  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 09\n\n                        Oficializa la subcategoría Eventos de la Categoría Productos del Programa\nPaís para la Carbono Neutralidad\n\nMINISTERIO DE AMBIENTE Y ENERGÍA\n\nN° 09-2021-MINAE\n\nLA MINISTRA DE AMBIENTE Y ENERGÍA\n\nEn uso de las facultades conferidas en los artículos 50 y\n148 de la Constitución Política; artículos 2 inciso c), 6 y 49 de la Ley\nOrgánica del Ambiente N° 7554, del 04 de octubre de 1995; artículo 27 inciso\n1), 28 inciso 2) acápite a y 240 de la Ley General de la Administración\nPública, N° 6227 del 02 de mayo de 1978; artículo 2 de la Ley Orgánica del\nMinisterio de Ambiente y Energía, N° 7152 del 05 de junio de 1990, la\nConvención Marco de Naciones Unidas sobre el Cambio Climático, Ley N° 7414 del\n13 de junio de 1994; la Ley de Aprobación del Protocolo de Kyoto\nde la Convención Marco de las Naciones Unidas sobre el Cambio Climático, N°\n8219 del 08 de marzo de 2002; el Acuerdo de París, Ley N° 9405 del 04 de\noctubre de 2016; el Decreto que oficializa el Plan de Acción de la Estrategia\nNacional de Cambio Climático, Decreto Ejecutivo N°39114-MINAE del 25 de julio\nde 2015; el Decreto que oficializa la Política Nacional de Adaptación al Cambio\nClimático, Decreto Ejecutivo N° 41091 del 20 de abril de 2018; el Decreto que\noficializa el Plan de Descarbonización Compromiso del\nGobierno del Bicentenario, Decreto Ejecutivo N° 41581 del 24 de febrero de 2019\ny los artículos 42 y 43 del Decreto Ejecutivo N° 35669-MINAET del 04 de\ndiciembre del 2009, Reglamento Orgánico del Ministerio de Ambiente y Energía.\n\nConsiderando:\n\nI.-Que el país ratificó la Convención Marco de Naciones\nUnidas sobre el Cambio Climático (CMNUCC).\n\nII.-Que Costa Rica suscribió los Objetivos de Desarrollo Sostenible\nestablecidos en la Agenda 2030 de las Naciones Unidos, cuyo objetivo trece -\nAcción por el Clima - llama a adoptar medidas urgentes para combatir el cambio\nclimático y sus efectos.\n\nIII.-Que Costa Rica firmó y ratificó el Acuerdo de París mediante la ley\nnúmero N° 9405 del 04 de octubre del 2016 y oficializó su Contribución\nNacionalmente Determinada (NDC por sus siglas en inglés).\n\nIV.-Que a través del Decreto Ejecutivo N° 41091-MINAE del 20 de abril de\n2018, fue oficializada la Política Nacional de Adaptación al Cambio Climático\n2018-2030.\n\nV.-Que por medio del Decreto Ejecutivo N° 41581-MINAE del 24 de febrero de\n2019, se oficializó el Plan de Descarbonización\nCompromiso del Gobierno del Bicentenario.\n\nVI.-Que el Plan Nacional de Desarrollo y de Inversión Pública (PNDIP) del\nBicentenario 2019-2022, emitido a través del Decreto Ejecutivo N°\n41848-MIDEPLAN del 18 de junio de 2019, establece mecanismos de gestión\naplicables a la acción climática.\n\nVII.-Que Costa Rica se encuentra en proceso de adhesión a la Organización\npara la Cooperación y Desarrollo Económico (OCDE), debiendo tomar acciones para\nel cumplimiento de un conjunto de instrumentos legales de dicha organización.\nEn materia ambiental estos instrumentos legales promueven que los países\nmiembros adopten normas y estándares internacionales, mejores prácticas y\ndirectrices de política en materia de cambio climático, biodiversidad,\ndesertificación, el deterioro de ecosistemas y la contaminación de aguas y\naire.\n\nVIII.-Que por medio del Decreto Ejecutivo N°42884- MINAE del 4 de marzo de\n2021, se creó Programa País para el Liderazgo Climático de la Dirección de\nCambio Climático del Ministerio de Ambiente y Energía integrado por los\nProgramas País de Carbono Neutralidad y de Adaptación Climática.\n\nIX.-Que el artículo 5 del Decreto Ejecutivo N° 42884-MINAE del 4 de marzo\nde 2021 establece el procedimiento para la creación y oficialización de las\ncategorías y subcategorías que componen los Programas País de Carbono\nNeutralidad y de Adaptación Climática.\n\nX.-Que en cumplimiento de dicho procedimiento, la Dirección de Cambio Climático elaboró la\ndocumentación necesaria para la creación de la subcategoría Eventos de la categoría Productos del\nPrograma País para la Carbono Neutralidad, la cual sometió a valoración y decisión de la Ministra de\nAmbiente y Energía.\n\nXI.-Que una vez valorada la documentación presentada por la Dirección de\nCambio Climático, se constató que la misma cumple a cabalidad con los objetivos\ny fines del Programa País para la Carbono Neutralidad. Por tanto,\n\nACUERDA:\n\nOFICIALIZAR LA SUBCATEGORÍA EVENTOS DE LA\n\nCATEGORÍA PRODUCTOS DEL PROGRAMA PAÍS\n\nPARA LA CARBONO NEUTRALIDAD\n\nArtículo 1°-Oficialícese la subcategoría Eventos de la\nCategoría Productos del Programa País para la Carbono Neutralidad, la cual\ntiene por objetivo brindar un mecanismo oficial, avalado por el gobierno de\nCosta Rica, para reconocer la adecuada gestión de las emisiones de gases de\nefecto invernadero (GEI) en la preparación, ejecución y cierre de eventos; cuyo\ntexto, documentación y lineamientos pueden ser accedidos vía web, en la página\noficial de la Dirección de Cambio Climático: www.cambioclimatico.go.cr, o bien,\nen formato físico, que estará disponible en la oficina de la Dirección de\nCambio Climático del Ministerio de Ambiente y Energía.\n\n(Nota de Sinalevi: La Categoría Comunidades del Programa País para la Carbono Neutralidad se extrajo\ndel sitio web de la Dirección de Cambio Climático y se transcribe a continuación:)\n\nPrograma País Carbono Neutralidad\n\n(PPCN) de Costa Rica\n\nEl Programa País\nCarbono Neutralidad de Costa Rica (PPCN) es un mecanismo oficial para que las\norganizaciones, productos, comunidades, centros educativos y eventos se unan al\nobjetivo de descarbonización a largo plazo del país,\ncon el fin de alcanzar cero emisiones netas para el 2050.\n\nEl PPCN es un mecanismo\nvoluntario a nivel país que permite a las organizaciones, fabricantes de\nproductos, comunidades, centros educativos y organizadores de eventos medir sus\ninventarios de carbono, demostrar reducciones de emisiones y alcanzar una\nneutralidad de carbono verificable. Este programa pertenece a la Dirección de\nCambio Climático (DCC) del Ministerio de Ambiente y Energía (MINAE).\n\nEl programa fue creado\nen el 2012 con una categoría organizacional. Ese año, dos empresas pioneras se\nunieron a esa categoría y alcanzaron la Carbono Neutralidad al reducir y\ncompensar todas sus emisiones. En el 2018, el PPCN se reactivó con un sistema\nde reconocimiento de cinco pasos (ver \"El sistema de reconocimiento\"\npágina siguiente), el cual permite a las organizaciones avanzar en sus\nesfuerzos de descarbonización. Actualmente, más de\n200 organizaciones participan en el programa.\n\nTras el éxito de su\nprimera categoría (organizacional), el PPCN amplió su ámbito de aplicación y\nahora incluye el reconocimiento a organizaciones, fabricantes de productos,\neventos (como subcategoría dentro de los productos) e instituciones educativas\n(como subcategoría dentro de la organizacional).\n\nLas categorías del PPCN\n\nLas cinco categorías\ndel PPCN ofrecen vías para diferentes actores sociales.\n\nORGANIZACIONES\n\nLas organizaciones\npúblicas y privadas pueden unirse a esta categoría, con criterios diferenciados\nrelacionados con la complejidad de cada organización. Cada organización debe\ninformar, reducir y compensar todas las emisiones directas e indirectas de\nenergía, mientras que otras emisiones indirectas pueden informarse\nvoluntariamente. Los reconocimientos son válidos por un año, sujetos a una\nverificación anual. Los reconocimientos plus se otorgan a organizaciones\nque realizan esfuerzos extraordinarios que van más allá de los requisitos\nmínimos, como crear reducciones adicionales, desarrollar cadenas de suministro\nbajas en carbono y fomentar la participación de la sociedad civil.\n\nCentros educativos\npreescolares, escuelas primarias y colegios de secundaria pueden optar por esta\ncategoría diferenciada, la cual posee criterios específicos y sencillos para\neste tipo de organizaciones, pero con un mayor enfoque en la sensibilización de\nla población estudiantil, su personal administrativo y sus familias.\n\nLas empresas pueden\ncrear un análisis del ciclo de vida para productos específicos y así reducir y\ncompensar su huella de carbono. Cada empresa que diseñe, desarrolle, distribuya\no comercialice un producto debe estimar su huella de carbon\ny compensarla, incluso antes de ingresar al mercado, generando una declaración\nde producto ambiental verificada y confiable. Los reconocimientos finales se\notorgan después de la verificación.\n\nLa huella de carbono de\nlos eventos en esta subcategoría incluye todo, desde la planificación hasta la\nejecución del evento, incluyendo las actividades de cierre. Los eventos reciben\nun reconocimiento preliminar \"en progreso\" antes y durante su\nejecución. Los reconocimientos definitivos se otorgan después de la\nfinalización, una vez verificada, y, si es necesario, se toman medidas\nadicionales.\n\nLa categoría cantonal\npermite a los municipios y distritos medir y gestionar las emisiones en sus\nterritorios. La mayoría de las fuentes de emisiones están sujetas a un informe\nobligatorio, el cual incluye el transporte vial, el uso de energía en los\nedificios y la industria, la agricultura y los residuos, así como otros tipos\nde uso de la tierra.\n\nSUBCATEGORÍA: CENTROS\nEDUCATIVOS\n\nCentros educativos\npreescolares, escuelas primarias y colegios de secundaria pueden optar por esta\ncategoría diferenciada, la cual posee criterios específicos y sencillos para\neste tipo de organizaciones, pero con un mayor enfoque en la sensibilización de\nla población estudiantil, su personal administrativo y sus familias.\n\nPRODUCTOS\n\nLas empresas pueden\ncrear un análisis del ciclo de vida para productos específicos y así reducir y\ncompensar su huella de carbono. Una parte interesada\nindirecta es el público general, el cual utiliza la información del programa\npara tomar mejores decisiones en cuanto a las organizaciones, productos o\nactividades con las que se involucra.\n\nCualquier organización\nparticipante, fabricante de productos, comunidad, centro educativo y\norganizador de evento participante en el PPCN se convierte en una parte implementadora.\nSon responsables de producir su inventario de carbono y tomar cualquier acción\nde reducción o compensación requerida para su respectivo reconocimiento.\n\nLa parte verificadora\ndebe revisar el inventario y las medidas adoptadas por la parte implementadora\ny proporcionar un informe. La parte verificadora debe\nestar acreditada ante el Ente Costarricense de Acreditación (ECA).\n\nLa Dirección de Cambio\nClimático es responsable de supervisar el programa y otorgar los\nreconocimientos, una vez realizada la declaración oficial de las partes\nverificadoras.\n\nResultados\n\nEl PPCN ha sido un\ncomponente clave de la acción climática en Costa Rica, con resultados\ncuantificables y verificables desde su creación. Therefore,\n\nAGREES:\n\nTO OFFICIALIZE THE EVENTS SUBCATEGORY OF THE\n\nPRODUCTS CATEGORY OF THE COUNTRY PROGRAM\n\nFOR CARBON NEUTRALITY\n\nArticle 1.-Officialize the Events subcategory of the\nProducts Category of the Country Program for Carbon Neutrality, which\nhas the objective of providing an official mechanism, endorsed by the government of\nCosta Rica, to recognize the adequate management of greenhouse gas\n(GHG) emissions in the preparation, execution, and closure of events; whose\ntext, documentation, and guidelines can be accessed via the web, on the official\npage of the Climate Change Directorate: www.cambioclimatico.go.cr, or else,\nin physical format, which will be available at the office of the Climate Change\nDirectorate of the Ministry of Environment and Energy.\n\n(Note from Sinalevi: The Communities Category of the Country Program for Carbon Neutrality was extracted\nfrom the website of the Climate Change Directorate and is transcribed below:)\n\nCosta Rica Country Carbon Neutrality Program\n\n(PPCN)\n\nThe Costa Rica Country\nCarbon Neutrality Program (PPCN) is an official mechanism for\norganizations, products, communities, educational centers, and events to join the\ncountry's long-term decarbonization goal,\nin order to achieve net-zero emissions by 2050.\n\nThe PPCN is a voluntary\nmechanism at the country level that allows organizations, product manufacturers,\ncommunities, educational centers, and event organizers to measure their\ncarbon inventories, demonstrate emission reductions, and achieve a\nverifiable carbon neutrality. This program belongs to the Climate Change\nDirectorate (DCC) of the Ministry of Environment and Energy (MINAE).\n\nThe program was created\nin 2012 with an organizational category. That year, two pioneering companies\njoined that category and achieved Carbon Neutrality by reducing and\noffsetting all their emissions. In 2018, the PPCN was reactivated with a\nfive-step recognition system (see \"The Recognition System\"\nnext page), which allows organizations to advance in their\ndecarbonization efforts. Currently, more than\n200 organizations participate in the program.\n\nFollowing the success of its\nfirst category (organizational), the PPCN expanded its scope of application and\nnow includes recognition for organizations, product manufacturers,\nevents (as a subcategory within products), and educational institutions\n(as a subcategory within the organizational category).\n\nThe PPCN Categories\n\nThe five categories\nof the PPCN offer pathways for different social actors.\n\nORGANIZATIONS\n\nPublic and private\norganizations can join this category, with differentiated criteria\nrelated to the complexity of each organization. Each organization must\nreport, reduce, and offset all direct and indirect energy\nemissions, while other indirect emissions can be voluntarily reported.\nRecognitions are valid for one year, subject to annual\nverification. An indirect stakeholder\nis the general public, which uses the program's information\nto make better decisions regarding the organizations, products, or\nactivities with which it engages.\n\nAny participating\norganization, product manufacturer, community, educational center, and\nevent organizer participant in the PPCN becomes an implementing party.\nThey are responsible for producing their carbon inventory and taking any\nreduction or offsetting action required for their respective\nrecognition.\n\nThe verifying party\nmust review the inventory and the measures adopted by the implementing party\nand provide a report. Each category has its own verification\ncycle, which ranges from one to three years. The verifying party must\nbe accredited before the Costa Rican Accreditation Entity (ECA).\n\nThe Climate Change\nDirectorate is responsible for overseeing the program and granting\nrecognitions, once the official declaration has been made by the\nverifying parties.\n\nResults\n\nThe PPCN has been a\nkey component of climate action in Costa Rica, with quantifiable\nand verifiable results since its creation. Until that\ntime, verifications may proceed as long as the body\nholds accreditation in the standard INTE-ISO 14065:2015 with a scope in any\nof the other categories of the Country Program for Carbon Neutrality and technical\nadmissibility by the accrediting entity for the verification of the HCP scope.\n\nArticle 3.-It shall become effective upon its publication in the Official Gazette La\nGaceta.\n\nSan José, on the\n29th day of April, two thousand twenty-one."
