la Convención Marco de Naciones Unidas sobre el Cambio\nClimático, ratificada mediante la Ley N°7414 del 13 de junio de 1994; la\nAprobación del Protocolo de Kyoto de la Convención\nMarco de las Naciones Unidas sobre el Cambio Climático, ratificado mediante la\nLey N°8219 del 08 de marzo de 2002; el Acuerdo de París ratificado mediante la\nLey N°9405 del 04 de octubre de 2016; y los artículos 42 y 43 del Reglamento\nOrgánico del Ministerio de Ambiente y Energía, Decreto Ejecutivo N°35669-MINAET\ndel 04 de diciembre de 2009.\n\nConsiderando:\n\nI.-Que de conformidad con lo dispuesto en el artículo 50\nde la Constitución Política, el Estado debe procurar el mayor bienestar a todos\nlos habitantes del país, además de preservar el derecho a disfrutar de un\nambiente sano y ecológicamente equilibrado, lo cual comprende para su\nrealización, el efectivo acceso a información ambiental, que además ha sido\nconsiderado un principio fundamental del derecho ambiental.\n\nII.-Que los artículos 27 y 30 de la Carta Magna prevén el\nlibre acceso a la información que se encuentre en poder de las instituciones\nestatales, sujeta a los límites allí previstos.\n\nIII.-Que el artículo 7 de la Constitución Política de la\nRepública de Costa Rica, establece que los tratados públicos, los convenios\ninternacionales y los concordatos, debidamente aprobados por la Asamblea\nLegislativa, tendrán desde su promulgación o desde el día que ellos designen,\nautoridad superior a las leyes.\n\nIV.-Que la Sala Constitucional a través de su\njurisprudencia ha determinado que \"...el Derecho Internacional de los\nDerechos Humanos en nuestro ordenamiento jurídico, a diferencia de los otros\ninstrumentos del Derecho Internacional, no tienen únicamente un valor superior\na la Ley de acuerdo con el artículo 7° constitucional, sino que sus\ndisposiciones, en la medida en que brinden mayor cobertura, protección o tutela\nde un determinado derecho, deben prevalecer por sobre éstos; lo anterior\nteniendo en cuenta lo dispuesto en el artículo 48 de la Constitución\nPolítica...\" (Resolución Nº 2007-01682 de las 10:34 horas del 9 de\nfebrero del 2007).\n\nV.-Que el Principio 10 de la Declaración de Río sobre el\nMedio Ambiente y el Desarrollo de 1992, establece que se requiere que todas las\npersonas tengan acceso adecuado a la información ambiental de que dispongan las\nautoridades públicas, con el fin de facilitar los procesos de participación\npública en asuntos ambientales.\n\nVI.-Que Costa Rica ratificó la Convención Marco de\nNaciones Unidas sobre el Cambio Climático mediante la Ley N°7414 del 13 de\njunio de 1994 y el Acuerdo de París mediante la Ley N°9405 del 04 de octubre de\n2016, y que bajo este último, se crea el Marco Reforzado de Transparencia para\nel Apoyo y la Acción, que solicita a los países brindar información sobre el\nprogreso y el avance hacia el cumplimiento de la meta de las Contribuciones\nNacionalmente Determinadas.\n\nVII.-Que en consonancia con los compromisos de\ntransparencia adquiridos por el país bajo la Convención Marco de las Naciones\nUnidas sobre el Cambio Climático en sus decisiones 17/CP.8, 1/CP.16 y 2/CP.17,\nCosta Rica debe suministrar y brindar información transparente, exacta, consistente,\nexhaustiva y comparable sobre las emisiones por fuentes y absorciones por\nsumideros y que por tanto, debe reportar un inventario nacional de gases de\nefecto invernadero como parte de sus comunicaciones nacionales y de los\ninformes bienales de actualización.\n\nVIII.-Que en diciembre de 2020, Costa Rica presentó su II\nContribución Nacionalmente Determinada y como parte de los compromisos\nadquiridos por medio del Acuerdo de París, el país se establece la meta titular\nde: \".fortalecer las condiciones de resiliencia social, económica y\nambiental del país ante los efectos del cambio climático, mediante el\ndesarrollo de capacidades e información para la toma de decisiones, la\ninclusión de criterios de adaptación en instrumentos de financiamiento y\nplanificación, la adaptación de los servicios públicos, sistemas productivos e\ninfraestructura y la implementación de soluciones basadas en naturaleza.\".\nEn razón de lo anterior, la meta que se propone cumplir es por medio del\nSistema Nacional de Métrica de Cambio Climático (en adelante SINAMECC), como\nuno de los sistemas de información climática claves para su eficacia.\n\nIX.-Que Costa Rica ha sido invitada formalmente a\nintegrarse como Estado parte de la Organización para la Cooperación y el\nDesarrollo Económicos (OCDE), tras haberse sometido con éxito a las revisiones\ntécnicas de 22 Comités de la OCDE y ha puesto en marcha importantes reformas\nque han permitido al país armonizar su legislación, políticas y prácticas con\nlas normas de la OCDE, en esferas tales como la competencia, las estadísticas,\nla lucha contra el cohecho, el gobierno corporativo de las empresas públicas,\nlos mercados financieros, la transparencia fiscal y la gestión de productos\nquímicos industriales, entre otros que, como parte de los requerimientos de\ningreso, indican la necesidad de contar con sistemas nacionales de información\ne indicadores ambientales apropiados.\n\nX.-Que en el marco de la Ley Orgánica del Ambiente\nN°7554, el Estado propiciará la puesta en marcha de un sistema de información\ncon indicadores ambientales, destinados a medir la evolución y la correlación\ncon los indicadores económicos y sociales para el país. Que dicha ley\nigualmente requiere preparar un Informe del Estado del Ambiente, para el cual\nse requiere generar información y productos en materia de la mitigación y\nadaptación al cambio climático.\n\nXI.-Que la Ley de Protección de la Persona frente al\ntratamiento de sus datos personales Nº 8968, y su Reglamento, tienen como\nobjetivo, garantizar a cualquier persona, independientemente de su\nnacionalidad, residencia o domicilio, el respeto a sus derechos fundamentales,\nconcretamente, su derecho a la autodeterminación informativa en relación con su\nvida o actividad privada y demás derechos de la personalidad, así como la\ndefensa de su libertad e igualdad con respecto al tratamiento automatizado o\nmanual de los datos correspondientes a su persona o bienes, para lo que se\nestablece la necesidad de procedimientos para el adecuado tratamiento de sus\ndatos, los cuales se registran ante la Agencia de Protección de Datos.\n\nXII.-Que la Ley del Sistema de Estadística Nacional\nNº9694 del 04 de junio de 2019, tiene por objeto \".regular el Sistema\nde Estadística Nacional, las instituciones que lo componen, fijar las normas\nbásicas para su adecuada coordinación y la obtención de información que permita\nel desarrollo estadístico de manera veraz y oportuna.\"\n\nXIII.-Que atendiendo el cumplimiento de un desarrollo\nsostenible en forma integral, se ha plasmado en el Plan Nacional de Desarrollo\ne Inversión Pública 2019-2022, garantizar el desarrollo y bienestar humano,\npromoviendo un uso adecuado de los recursos naturales y una repartición justa y\nequitativa de sus beneficios con una participación local que asegure la\ntransparencia y lucha contra la corrupción. Lo anterior ligado a los Objetivos\nde Desarrollo Sostenible (ODS) establecidos en la Agenda 2030 por las Naciones\nUnidas en el 2015 y al Pacto Nacional por los Objetivos de Desarrollo\nsostenible firmado el 9 de setiembre del 2016 por los Poderes Supremos de la\nRepública.\n\nXIV.-Que mediante el Decreto Ejecutivo N°41561-MP-MINAE\ndel 07 de febrero de 2019, se emitió la Declaratoria de Interés Público y\nNacional del \"Plan de Descarbonización\nCompromiso del Gobierno del Bicentenario\".\n\nXV.-Que mediante el Decreto Ejecutivo N°41581-MINAE del\n24 de febrero de 2019, se oficializó el Plan de Descarbonización\nde Compromiso del Gobierno del Bicentenario, como la base para la construcción\ndel Plan Nacional de Desarrollo e Inversiones Públicas (2018-2022), y el Plan\nEstratégico Costa Rica 2050 (Estrategia de Largo Plazo), lo cual alimentará el\nsistema de ambición y transparencia del país, y será la base para la\nactualización y mejora de nuestras próximas Contribuciones Nacionalmente\nDeterminadas o NDCs.\n\nXVI.-Que para el cumplimiento y seguimiento de los\nObjetivos de Desarrollo Sostenible, se promulgó el Decreto Ejecutivo\nN°40203-PLAN-RE-MINAE del 15 de febrero de 2017, denominado \"Gobernanza e\nImplementación de los Objetivos de Desarrollo Sostenible en Costa Rica\" con\nel fin de establecer una estructura organizacional para planificar, implementar\ny dar seguimiento en Costa Rica a los 17 Objetivos de Desarrollo Sostenible (en\nadelante los ODS), y sus 169 metas conexas y a la Agenda 2030 para el\nDesarrollo Sostenible de las Naciones Unidas.\n\nXVII.-Que el Estado Costarricense ha promovido la\nfilosofía del Gobierno Abierto y promoción de los Datos Abiertos en el sector\npúblico, mediante el Decreto Ejecutivo N°38994-MP-PLAN¬MICITT del 29 de abril\nde 2015, denominado \"Fomento del Gobierno Abierto en la Administración\nPública y Creación de la Comisión Nacional por un Gobierno Abierto\", así\ncomo por medio del Decreto Ejecutivo N°40199-MP del 27 de abril de 2017,\ndenominado \"Establece la Apertura de los Datos Públicos\" como\nmedio para alcanzar una mayor transparencia, una política de datos abiertos y\nun mayor acceso ciudadano a la información. En el marco de estas políticas e\niniciativas de Gobierno Abierto, se requiere contar con un sistema de\ninformación especializado para el cambio climático que permita conocer el\navance de las políticas relevantes y sus impactos sobre las emisiones y\nabsorciones en todos los sectores de su economía. Lo anterior, con el propósito\nde evaluar la política existente, con el fin de determinar su eficacia y, según\nsea apropiado, proponer al Estado modificaciones a las políticas existentes o\nnuevas políticas, para así poder dar cumplimiento a las metas nacionales de\nmitigación y adaptación al cambio climático.\n\nXVIII.-Que la Dirección de Cambio Climático de\nconformidad con el artículo 40 del Reglamento Orgánico del Ministerio de\nAmbiente y Energía, Decreto Ejecutivo N°35669- MINAE del 04 de diciembre de\n2009, tiene como función, entre otras, coordinar y establecer el Sistema\nNacional de Métrica para el monitoreo, evaluación y seguimiento del Programa\nNacional de Cambio Climático, por medio de la información y gestión del\nconocimiento a nivel nacional, así como coordinar y dar seguimiento a los\nplanes ministeriales, organizacionales y sectoriales para el cambio climático,\npromoviendo el establecimiento de estándares que alimenten el Sistema Nacional\nde Métrica.\n\nXIX.-Que mediante Decreto Ejecutivo Nº29540-MINAE del 11\nde mayo de 2001, denominado \"Constituye el Centro Nacional de\nInformación Geoambiental como un órgano de la\nDirección General de Hidrocarburos del Ministerio de Ambiente y Energía\" se\ncrea el Centro Nacional de Información Geoambiental\n(CENIGA) como un órgano especializado del Ministerio de Ambiente y Energía, que\ntiene dentro de sus objetivos: desarrollar los instrumentos legales y coordinar\npara la conformación y operación del Sistema Nacional de Información Ambiental\n(SINIA) y la Red Nacional de Información Ambiental (RENIA); y desarrollar el\nsistema oficial de estadísticas e indicadores ambientales nacionales.\n\nXX.-Que mediante Decreto Ejecutivo N°41127-MINAE del 09\nde abril de 2018, se crea el Sistema Nacional de Métrica del Cambio Climático\n(SINAMECC) bajo la coordinación, operación y ejecución de la Dirección de\nCambio Climático (DCC) y, se establece el funcionamiento del mismo como la\nplataforma oficial de coordinación y vinculación institucional y sectorial del\nEstado costarricense, para facilitar la gestión y distribución del conocimiento\ne información en materia de cambio climático. El SINAMECC operará como un\nsub-módulo del Sistema Nacional de Información Ambiental (SINIA) y estará\nvinculado al Sistema de Estadística Nacional (SEN).\n\nXXI.-Que tras más de 2 años de promulgado el Decreto\nEjecutivo N°41127-MINAE del 09 de abril de 2018, se ha considerado pertinente\nderogar este cuerpo normativo, en razón de la existencia de nuevas tendencias\nen materia de compilación , gestión y divulgación de datos climáticos, al ser\nésta, un área en constante evolución dadas sus características y relevancia\nactual, así como para efectos de proveer a la Dirección de Cambio Climático con\nlas normas habilitantes necesarias para ejecutar las funciones encomendadas en\nel citado Reglamento y cumplir con los compromisos nacionales e internacionales\nen la materia.\n\nXXII.-Que de conformidad con el Reglamento a la Ley de\nProtección al Ciudadano del Exceso de Requisitos y Trámites Administrativos,\nDecreto Ejecutivo N°37045-MP-MEIC del 22 de febrero de 2012 y sus reformas, se\ndeterminó que la presente propuesta no establece ni modifica trámites,\nrequisitos o procedimientos, que el administrado deba cumplir, situación por la\nque no se procedió con el trámite de control previo. Por tanto;\n\nDecretan:\n\n\"Creación y Operación del Sistema Nacional de\nMétrica\n\nde Cambio Climático\"\n\nArtículo 1º-Creación y Objeto. Créese el Sistema\nNacional de Métrica de Cambio Climático (SINAMECC), que se constituye en la\nplataforma oficial de coordinación y vinculación institucional y sectorial del\nEstado costarricense, para facilitar la compilación, gestión y divulgación del\nconocimiento e información en materia de cambio climático.\n\nEl SINAMECC operará como un sub-módulo del Sistema Nacional de Información\nAmbiental y por ende, formará parte del Sistema de Estadística Nacional. La\ncoordinación, operación y ejecución de las funciones establecidas en el\npresente decreto ejecutivo, estará bajo la responsabilidad y competencia de la\nDirección de Cambio Climático (DCC).\n\nArtículo\n2º-Abreviaturas. Para efectos del presente decreto, se deben considerar\nlas siguientes abreviaturas:\n\na) CENIGA:\nCentro Nacional de Información Geoambiental.\n\nb) CMNUCC:\nConvención Marco de Naciones Unidas sobre el Cambio Climático.\n\nc) DCC:\nDirección de Cambio Climático.\n\nd) IMN:\nInstituto Meteorológico Nacional.\n\ne) INEC:\nInstituto Nacional de Estadísticas y Censos.\n\nf) INGEI:\nInventario Nacional de Gases de Efecto Invernadero.\n\ng) MINAE:\nMinisterio de Ambiente y Energía.\n\nh) NDC (por\nsus siglas en inglés): Contribución Nacionalmente Determinada.\n\ni) OCDE:\nOrganización para la Cooperación y Desarrollo Económico.\n\nj) ODS:\nObjetivos de Desarrollo Sostenible.\n\nk) SEN:\nSistema de Estadística Nacional.\n\nl) SEPLASA:\nSecretaría de Planificación Sectorial de Ambiente.\n\nm) SINAMECC:\nSistema Nacional de Métrica de Cambio Climático.\n\nn) SINIA:\nSistema Nacional de Información Ambiental.\n\nArtículo\n3º-Definiciones. Para efectos del presente decreto y de los procesos de\ncompilación, gestión y divulgación de información en materia de cambio\nclimático, se deben considerar las siguientes definiciones:\n\na) Acción\nclimática: instrumentos de política, proyectos, programas o actividades que\ninciden sobre la crisis climática, articulando aspectos de mitigación y\nadaptación al cambio climático y su financiamiento, potenciando los beneficios\nen bienestar de las personas y de los ecosistemas.\n\nb) Adaptación:\nacciones e intervenciones públicas o privadas de cara a los impactos probables\ndel cambio climático y variabilidad climática, tendientes a reducir condiciones\nde vulnerabilidad, que permitan moderar daños, evitar pérdidas y aprovechar las\noportunidades, para potenciar la resiliencia de sistemas económicos, sociales y\nambientales, a escala nacional, regional y local.\n\nc) Contribución\nNacionalmente Determinada: Las NDC (por sus siglas en inglés), son\ncompromisos voluntarios de los países ante la CMNUCC, solicitadas en el Acuerdo\nde París, artículo cuatro, párrafo dos, con los que se busca mantener el\naumento de la temperatura media mundial muy por debajo de 2ºC con respecto a\nlos niveles preindustriales.\n\nLa NDC de Costa Rica\nentró en vigencia en el 2016 con la ratificación del Acuerdo de París. La\nprimera actualización de la NDC fue presentada por Costa Rica ante la CMNUCC en\nel 2020 con metas en mitigación y adaptación. La NDC, además genera compromisos\nde reporte periódicos del avance ante la CMNUCC.\n\nd) Doble\nContabilidad: en el contexto de la mitigación al cambio climático, se\nrefiere a situaciones en las que la misma reducción o remoción de gases de\nefecto invernadero, se utiliza más de una vez para demostrar el avance hacia\nlas metas de mitigación.\n\ne) Mitigación:\nes la acción de reducir las emisiones de gases de efecto invernadero y/o de\naumentar las absorciones de dióxido de carbono.\n\nf) Medios\nde implementación: apoyo recibido y apoyo brindado en términos de recursos\nfinancieros, fomento de capacidades y transferencia tecnológica, cuyo efecto\nesperado es reducir las emisiones netas de efecto invernadero y/o aumentar la\nresiliencia a los impactos de la variabilidad climática y el cambio climático\nproyectado. Esto incluye recursos públicos y privados, nacionales e\ninternacionales.\n\ng) Prospectiva\nde acción climática: es el proceso de utilización de técnicas cuantitativas\ny/o cualitativas, para analizar y/o evaluar de manera sistemática una o más\ncaracterísticas plausibles del futuro, con el fin de desarrollar insumos en\napoyo de modificaciones y/o nuevas políticas para la mitigación y adaptación al\ncambio climático.\n\nArtículo\n4º-Ámbito de aplicación. Los fines del SINAMECC y las funciones establecidas\nen el presente Decreto para la DCC, se fundamentan en el cumplimiento de\nobligaciones nacionales e internacionales del Estado costarricense, en materia\nde compilación, gestión y divulgación de datos e información sobre cambio\nclimático.\n\nPor medio\ndel SINAMECC se compilarán y gestionarán los conjuntos de datos e información\nproducidos en materia de cambio climático, sea por el Estado y sus\ninstituciones, por el sector privado, la academia o la sociedad civil, cuando\nmedie entre alguno de estos y la DCC, acuerdos de transferencia y uso de\nconjuntos de datos, convenios de cooperación, alianzas público-privadas, cartas\nde entendimiento o cualquier otro instrumento jurídico, según corresponda con\ncada régimen jurídico aplicable.\n\nLa\ninformación que se compilará gestionará y divulgará será la de tipo histórico,\nestadístico o científico, por lo cual no es parte del objeto y ámbito de\naplicación del presente Decreto Ejecutivo, la compilación, gestión o\ndivulgación de datos personales, con la salvedad que se indicará en el artículo\n6 de este Decreto Ejecutivo.\n\nArtículo 5.\nNaturaleza de la información a ser integrada en el SINAMECC. El SINAMECC\nintegra la información relevante a la mitigación y adaptación al cambio\nclimático, medios de implementación y los impactos generados por el cambio\nclimático y la acción climática en el desarrollo sostenible y en cumplimiento\nde los ODS.\n\nArtículo\n6º-Garantía de protección de la información. Ley de Protección de la\nPersona frente al tratamiento de sus datos personales Nº8968 y la Ley del\nSistema de Estadística Nacional Nº9694. De forma excepcional a lo dispuesto\nen el artículo 4 de este Decreto Ejecutivo, cuando una persona física o\njurídica se presente ante la DCC para brindar voluntariamente información\nvinculada con la materia del SINAMECC y en ese acto medien datos personales, se\ngarantizará por parte de la DCC la protección de los datos personales con apego\na la Ley número 8968 y su reglamento, así como por lo dispuesto en los\nartículos 10, 20, 21 y 22 de la Ley Nº 9694 en cuanto a la confidencialidad\nestadística.\n\nPara asegurar lo\nantes establecido, la DCC creará e inscribirá ante la Agencia de Protección de\nDatos de los Habitantes los correspondientes protocolos para el tratamiento de\nlos datos personales y el resguardo de la autodeterminación informativa.\n\nArtículo\n7º-Fines estratégicos del SINAMECC. El SINAMECC, por medio de la DCC\ncumplirá con los siguientes fines:\n\na) Acceso\nde información. El SINAMECC, compilará, gestionará, divulgará y, en sentido\namplio, facilitará el acceso, por solicitud o de forma oficiosa, de toda\naquella información relacionada con el cambio climático y la acción climática\nnacional, proveniente de instituciones públicas, actores del sector privado y\nsociedad civil.\n\nb) Facilitar\nla toma de decisiones basadas en datos. El SINAMECC aportará datos que\npermitan analizar opciones de mejora de políticas, planes y otras acciones\nclimáticas, así como para el diseño de nuevos instrumentos; además, el SINAMECC\nfacilitará las herramientas para la diseminación de los resultados de los\nanálisis.\n\nc) Seguimiento\nde acciones climáticas. Por medio del SINAMECC, se apoyarán los procesos de\nmonitoreo, reporte, verificación y evaluación de las acciones climáticas\nregistradas en el sistema. El SINAMECC, velará por que la información contenida\nen su plataforma sea veraz, actual, transparente y científicamente rigurosa.\n\nd) Mejora\ncontinua. El SINAMECC promoverá la innovación, mejora continua y adopción\nde mejores metodologías según los avances de la ciencia y en coordinación con\nlos actores involucrados, para garantizar el correcto funcionamiento del\nSistema.\n\ne) Facilitación\nen la construcción de reportes relacionados con cambio climático. El\nSINAMECC facilitará el acceso a la información para la construcción transparente\nde reportes nacionales e internacionales relacionados con cambio climático,\nincluyendo el progreso del cumplimiento de la Contribución Nacionalmente\nDeterminada.\n\nArtículo\n8º-Herramienta oficial para el INGEI. El SINAMECC será la herramienta y\nmedio oficial del SINIA, para compilar, gestionar y divulgar, según\ncorresponda, las emisiones por fuentes y las absorciones por sumideros a nivel\nnacional en el marco de los compromisos internacionales adquiridos en materia\nde cambio climático. Para el cumplimiento de este objetivo, la DCC coordinará\ncon las instituciones competentes en la materia.\n\nArtículo\n9º-Coordinación del SINAMECC. El cumplimiento de los fines del SINAMECC\ny del resto de disposiciones establecidas en el presente Decreto, estarán bajo\nla competencia de la DCC.\n\nLa DCC será\nla responsable de compilar, validar y elaborar la comunicación con las\nentidades públicas y privadas competentes, así como de reportar y comunicar\nante los instrumentos internacionales, de los que sea Punto Focal, la información\nrelacionada con cambio climático cubierta por este Decreto.\n\nArtículo\n10.-Funciones de la DCC. Para el cumplimiento de los fines del SINAMECC\ny del resto de disposiciones establecidas en el presente Decreto, la DCC\ncumplirá las siguientes funciones:\n\na) Compilación,\ngestión y divulgación de información. Compilar, gestionar y divulgar la\ninformación sobre la mitigación y adaptación al cambio climático en Costa Rica,\nlos medios de implementación, así como la información necesaria para mostrar la\nrelación con el desarrollo sostenible y los ODS asociados a la implementación\nde la acción climática, cuando sea pertinente.\n\nb) Integración.\nIntegrar la información pertinente al SINIA, para su posterior incorporación al\nSEN, con el fin de adquirir carácter de datos oficiales, de conformidad con lo\nestablecido en dichos sistemas, y promover su uso por otras instituciones\nestatales, el sector privado y la sociedad civil.\n\nc) Facilitación\nde información climática. Facilitar la preparación de informes nacionales\nde cambio climático, de las Comunicaciones Nacionales, los Informes Bienales de\nActualización y los Informes Bienales de Transparencia ante la CMNUCC, en\ncoordinación con otras entidades competentes, considerando también otros\ninformes a ser requeridos por el Marco Reforzado de Transparencia para la\nAcción y el Apoyo del Acuerdo de París para países en desarrollo, para la OCDE\ncuando proceda, y para el seguimiento de los ODS.\n\nd) Registro\nde acciones climáticas. Facilitar el registro de acciones climáticas, tanto\nlas relacionadas con adaptación como con mitigación, incluyendo información\npertinente relacionada con los impactos generados por éstas en relación con el\ndesarrollo sostenible y los ODS.\n\ne) Administración\nde la plataforma tecnológica. El SINAMECC, contará con una plataforma\ntecnológica para la compilación, gestión y divulgación de la información\nmateria del presente Decreto. La DCC, deberá garantizar la sostenibilidad de la\nplataforma, así como su continuidad y adaptación a las mejores técnicas y\ntendencias tecnológicas y de gestión de datos.\n\nf) Facilitación\nde información. Facilitar el acceso y uso de la información contenida en el\nSINAMECC tanto en el sector público como en la academia, la sociedad civil y el\nsector privado.\n\ng) Seguimiento\nde metas climáticas. Generar la información para medir el progreso en las\nmetas climáticas del país, según se definan en la NDC y aquellas que sean\nadquiridas posteriormente de conformidad con el Acuerdo de París, incluyendo la\nEstrategia de desarrollo a largo plazo bajo en emisiones de gases de efecto\ninvernadero y demás estrategias y planes nacionales y sectoriales relevantes.\n\nh) Coordinación\nestratégica. Coordinar con otros procesos y entidades públicas o privadas\nclave, relacionados con acción climática, para facilitar estratégicamente el\nuso, transferencia e incorporación de datos en el SINAMECC, así como el\nintercambio de conocimientos, en las materias cubiertas por este Decreto.\n\nArtículo\n11.-Del Comité Consultivo. El SINAMECC contará con la asesoría y acompañamiento\nde un Comité Consultivo que estará conformado por un representante de la DCC,\nun representante de la SEPLASA, un representante del CENIGA, un representante\ndel IMN y un representante del INEC, y tendrá las siguientes funciones:\n\na) Recomendar.\nBrindar recomendaciones para la correcta y continua operación del SINAMECC,\nincluyendo la planeación y obtención de recursos, para asegurar los flujos de\ninformación y para la convocatoria de equipos técnicos ad hoc.\n\nb) Enlazar.\nServir de enlace y canal de comunicación con las respectivas instituciones u\nórganos a las cuales pertenecen los representantes incluidos en el Comité,\ncuando proceda.\n\nc) Integración\nde sistemas. Coadyuvar en la coordinación para incluir información del\nSINAMECC en el SINIA y el SEN.\n\nd) Preparar\ninformes. Coadyuvar en la preparación de informes y reportes nacionales\nsegún los objetivos y materias cubiertas por el SINAMECC, de acuerdo con sus\náreas de competencia.\n\ne) Divulgar\ninformación. Proponer mecanismos y herramientas para maximizar la\ndivulgación de la información contemplada en el SINAMECC, a los diferentes\nactores.\n\nf) Recomendación\nsobre guías. Recomendar sobre el contenido de las Guías para la operación\ndel SINAMECC.\n\ng) Sostenibilidad\ndel SINAMECC. Las instituciones que conforman el Comité Consultivo velarán\nde forma colaborativa, por la sostenibilidad, continuidad y mejora continua del\nSINAMECC, desde el ámbito de sus competencias, capacidades instaladas y\nrecursos existentes.\n\nEl Comité\nConsultivo del SINAMECC será coordinado por la DCC y cumplirá sus funciones\nante la solicitud expresa de la DCC. De considerarse necesario, el Comité\nConsultivo, podrá convocarse a sesiones de coordinación, de lo contrario y, de\nforma preferente, sus funciones serán cumplidas mediante comunicaciones\nescritas formales.\n\nLas\ninstituciones que conforman el Comité Consultivo velarán de forma colaborativa,\npor la sostenibilidad, continuidad y mejora continua del SINAMECC.\n\nArtículo\n12.-Principios y características de operación del SINAMECC. El\nfuncionamiento del SINAMECC, así como todo proceso de compilación, gestión y\ndivulgación de los datos e información en materia de cambio climático, se rige\npor los siguientes principios y características, basados en los principios de\ntransparencia del Acuerdo de París.\n\na) Transparencia.\nEntendida como la aplicación de metodologías e hipótesis claras en los procesos\nde compilación, gestión y divulgación, para facilitar la reproducción y\nevaluación de la información gestionada, por parte de los usuarios y contrapartes\ndel Sistema.\n\nb) Consistencia.\nLos procesos de compilación, gestión y divulgación de información deberán ser\ncoherentes y consistentes a lo interno de sus procesos y elementos,\ninteranualmente.\n\nc) Comparabilidad.\nLa compilación y gestión de los datos e información, deberá procurar, en todo\nmomento, evitar la doble contabilidad y promover la comparabilidad de los\nmismos.\n\nd) Completitud.\nLos procesos de compilación, gestión y divulgación de información deberán\nabarcar información relevante a la mitigación y adaptación al cambio climático,\nmedios de implementación y los impactos generados por el cambio climático y la\nacción climática en desarrollo sostenible y en cumplimiento de los ODS.\n\ne) Exactitud.\nExactitud es una medida relativa del grado en que una estimación se aproxima al\nvalor real. Las estimaciones deben ser exactas en el sentido de que no queden\nsistemáticamente por encima o por debajo de los valores de referencia.\n\nf) Coordinación\nentre actores. Coordinación necesaria para evitar duplicar procedimientos y\nsolicitudes y hacer más eficiente la compilación, gestión y divulgación de los\ndatos.\n\ng) Libre\nacceso a la información. En cuanto a los datos, procesos y resultados\ndesarrollados a lo interno del SINAMECC, así como en su código fuente, deberá\nexistir libre acceso para las contrapartes y la ciudadanía en general, en línea\ncon los esfuerzos para promover un Gobierno Abierto en Costa Rica.\n\nh)\nSostenibilidad de los flujos de información. Se velará porque los datos que se\ningresen al sistema tengan sostenibilidad en el tiempo para fortalecer las\noportunidades de análisis y utilidad de la información\n\ni) Mejora\ncontinua. Entendida como la búsqueda, promoción y generación de mejores\ndatos, la calidad de los mismos y las herramientas de gestión y análisis.\n\nArtículo\n13.-Guías y Protocolos del SINAMECC. La DCC producirá las Guías\nnecesarias para facilitar la participación de los diferentes actores en el\ndesarrollo del Sistema y para definir los procesos y procedimientos\nfundamentales del SINAMECC con el fin de asegurar el buen funcionamiento del\nmismo. Estas Guías, serán obligatorias para quienes provean información al\nSINAMECC y podrán ser accedidas en la página web del SINAMECC (www.\nsinamecc.go.cr).\n\nLa DCC\naprobará las guías para la operación del SINAMECC, tomando en consideración, en\ncaso de que existan, las recomendaciones recibidas por parte del Comité\nConsultivo. Las Guías, serán revisadas y actualizadas periódicamente en línea\ncon el principio de mejora continua y serán divulgadas por los mecanismos que\nla DCC estime convenientes para garantizar su adecuada diseminación y uso\ndemocrático.\n\nEl SINAMECC\nintegrará la información proveniente de otros sistemas, sean estos públicos o\nprivados, que produzcan datos, utilizando para ellos los protocolos,\nlineamientos y orientaciones establecidas por el Sistema en particular mediante\nlas respectivas Guías a ser emitidas de conformidad con este artículo.\n\nArtículo\n14.-Cooperación interinstitucional. Los órganos del Poder Ejecutivo,\ndentro del marco de sus competencias legales, deberán poner a disposición y\ncompartir en el SINAMECC la información que generen y gestionen, relacionada\ncon la mitigación y adaptación al cambio climático, así como los medios de\nimplementación y los impactos generados por estos en relación con el desarrollo\nsostenible y los ODS, asociados a la implementación de la acción climática del\npaís, de conformidad con las Guías establecidas para tal efecto en el artículo\nanterior.\n\nAsimismo,\nel MINAE, podrá celebrar convenios de cooperación para la generación y\nsuministro de información con otros actores institucionales, sociedad civil,\ncentros de investigación y academia, sector privado, organizaciones no\ngubernamentales, entidades de cooperación internacional, municipalidades y comunidades\nlocales, los cuales contendrán las cláusulas y disposiciones necesarias para\npermitir la operación y funcionamiento del Sistema y para resguardar los\nintereses legítimos y los derechos de las contrapartes.\n\nArtículo\n15.-Financiamiento y apoyo de otras instituciones. Las entidades\npúblicas y privadas, incluyendo organismos nacionales e internacionales podrán,\nen la medida de sus posibilidades y dentro de la normativa jurídica vigente,\ncontribuir con el aporte de recursos económicos, logísticos y técnicos para el\nfuncionamiento del SINAMECC. Las diferentes instituciones públicas que tengan\nel mandato legal de generar información relacionada con el ámbito del SINAMECC,\nvelarán por que se incluya en sus planes anuales operativos y otras estrategias\nde planificación, el financiamiento de las actividades relacionadas con su\nparticipación y apoyo al SINAMECC.\n\nArtículo\n16.-Libre acceso a la información generada. La información y productos\nincluidos en el SINAMECC, serán de carácter público y acceso libre y gratuito,\ncon las excepciones previstas en la Constitución Política y la normativa legal\nvigente, siempre que el acceso a dicha información no ponga en riesgo o amenace\nel ambiente.\n\nEn caso de\ndenegar el acceso a la información, se emitirá un acto fundamentado, conforme\nlo dispuesto por el artículo 274 de la Ley General de la Administración Pública\nN°6227. Se respetará en todo caso la autoría de la información incluida en el\nSistema de conformidad con lo dispuesto en la normativa aplicable.\n\nArtículo\n17.-Interés público. Se declara de interés público el establecimiento y\noperación del SINAMECC.\n\nArtículo\n18. Derogatoria. Deróguese el Decreto Ejecutivo Nº41127-MINAE del 09 de abril\nde 2018 denominado \"Creación y operación del Sistema Nacional de Métrica del cambio\nClimático\".\n\nArtículo\n19.-Vigencia. Rige a partir de su publicación.\n\nDado en la\nPresidencia de la República.-San José, el trece de abril del año dos mil\nveintiuno.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Regulation 42961\n\n Creation and Operation of the National Climate Change Metrics System\n\nNo. 42961-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nUsing the powers conferred by articles 50, 140 subsections 3) and 18), and 146 of the Political Constitution; article 49 of the Organic Environmental Law No. 7554 of October 4, 1995; article 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law of Public Administration No. 6227 of May 2, 1978; the United Nations Framework Convention on Climate Change, ratified by Law No. 7414 of June 13, 1994; the Approval of the Kyoto Protocol to the United Nations Framework Convention on Climate Change, ratified by Law No. 8219 of March 8, 2002; the Paris Agreement ratified by Law No. 9405 of October 4, 2016; and articles 42 and 43 of the Organic Regulation of the Ministry of Environment and Energy, Executive Decree No. 35669-MINAET of December 4, 2009.\n\nConsidering:\n\nI.-That in accordance with the provisions of article 50 of the Political Constitution, the State must procure the greatest well-being for all the inhabitants of the country, in addition to preserving the right to enjoy a healthy and ecologically balanced environment, which includes for its realization, effective access to environmental information, which has also been considered a fundamental principle of environmental law.\n\nII.-That articles 27 and 30 of the Magna Carta provide for free access to information held by state institutions, subject to the limits provided therein.\n\nIII.-That article 7 of the Political Constitution of the Republic of Costa Rica establishes that public treaties, international conventions, and concordats, duly approved by the Legislative Assembly, shall have, from their promulgation or from the day they designate, authority superior to the laws.\n\nIV.-That the Constitutional Chamber, through its jurisprudence, has determined that \"...International Human Rights Law in our legal system, unlike other instruments of International Law, not only has a value superior to the Law according to article 7 of the Constitution, but its provisions, to the extent that they provide greater coverage, protection, or guardianship of a determined right, must prevail over them; the foregoing taking into account the provisions of article 48 of the Political Constitution...\" (Resolution No. 2007-01682 of 10:34 hours on February 9, 2007).\n\nV.-That Principle 10 of the 1992 Rio Declaration on Environment and Development establishes that all persons must have adequate access to environmental information held by public authorities, in order to facilitate public participation processes in environmental matters.\n\nVI.-That Costa Rica ratified the United Nations Framework Convention on Climate Change through Law No. 7414 of June 13, 1994, and the Paris Agreement through Law No. 9405 of October 4, 2016, and that under the latter, the Enhanced Transparency Framework for Action and Support is created, which requests that countries provide information on progress and advancement toward meeting the goal of the Nationally Determined Contributions.\n\nVII.-That in accordance with the transparency commitments acquired by the country under the United Nations Framework Convention on Climate Change in its decisions 17/CP.8, 1/CP.16, and 2/CP.17, Costa Rica must supply and provide transparent, accurate, consistent, exhaustive, and comparable information on emissions by sources and absorptions by sinks and therefore, must report a national greenhouse gas inventory as part of its national communications and biennial update reports.\n\nVIII.-That in December 2020, Costa Rica presented its II Nationally Determined Contribution and as part of the commitments acquired through the Paris Agreement, the country establishes the headline goal of: \".strengthening the conditions of social, economic, and environmental resilience of the country in the face of the effects of climate change, through the development of capacities and information for decision-making, the inclusion of adaptation criteria in financing and planning instruments, the adaptation of public services, productive systems, and infrastructure, and the implementation of nature-based solutions.\". By reason of the foregoing, the goal it proposes to meet is through the National Climate Change Metrics System (hereinafter SINAMECC), as one of the key climate information systems for its effectiveness.\n\nIX.-That Costa Rica has been formally invited to join as a State party to the Organisation for Economic Co-operation and Development (OECD), after having successfully undergone the technical reviews of 22 OECD Committees and has implemented important reforms that have allowed the country to harmonize its legislation, policies, and practices with OECD standards, in areas such as competition, statistics, the fight against bribery, corporate governance of public enterprises, financial markets, fiscal transparency, and the management of industrial chemicals, among others that, as part of the entry requirements, indicate the need for appropriate national environmental information systems and indicators.\n\nX.-That within the framework of the Organic Environmental Law No. 7554, the State shall promote the implementation of an information system with environmental indicators, intended to measure evolution and correlation with economic and social indicators for the country. That said law likewise requires preparing a State of the Environment Report, for which it is necessary to generate information and products regarding climate change mitigation and adaptation (mitigación y adaptación al cambio climático).\n\nXI.-That the Law for the Protection of the Person regarding the processing of their personal data No. 8968, and its Regulation, have the objective of guaranteeing to any person, regardless of their nationality, residence, or domicile, respect for their fundamental rights, specifically, their right to informational self-determination in relation to their private life or activity and other personality rights, as well as the defense of their freedom and equality with respect to the automated or manual processing of data corresponding to their person or property, for which the need for procedures for the adequate processing of their data is established, which are registered with the Data Protection Agency.\n\nXII.-That the Law of the National Statistics System No. 9694 of June 4, 2019, has the purpose of \".regulating the National Statistics System (Sistema de Estadística Nacional), the institutions that compose it, setting the basic rules for its adequate coordination and the obtaining of information that allows statistical development in a truthful and timely manner.\"\n\nXIII.-That attending to the fulfillment of sustainable development in an integral manner, it has been embodied in the National Development and Public Investment Plan 2019-2022, to guarantee human development and well-being, promoting an adequate use of natural resources and a fair and equitable distribution of their benefits with local participation that ensures transparency and the fight against corruption. The foregoing linked to the Sustainable Development Goals (SDGs) established in the 2030 Agenda by the United Nations in 2015 and to the National Pact for the Sustainable Development Goals signed on September 9, 2016, by the Supreme Powers of the Republic.\n\nXIV.-That through Executive Decree No. 41561-MP-MINAE of February 7, 2019, the Declaration of Public and National Interest of the \"Decarbonization Plan Commitment of the Bicentennial Government\" was issued.\n\nXV.-That through Executive Decree No. 41581-MINAE of February 24, 2019, the Decarbonization Plan of Commitment of the Bicentennial Government was formalized, as the basis for the construction of the National Development and Public Investment Plan (2018-2022), and the Strategic Plan Costa Rica 2050 (Long-Term Strategy), which will feed the country's ambition and transparency system, and will be the basis for updating and improving our next Nationally Determined Contributions or NDCs.\n\nXVI.-That for the fulfillment and monitoring of the Sustainable Development Goals, Executive Decree No. 40203-PLAN-RE-MINAE of February 15, 2017, was promulgated, called \"Governance and Implementation of the Sustainable Development Goals in Costa Rica\" with the purpose of establishing an organizational structure to plan, implement, and monitor in Costa Rica the 17 Sustainable Development Goals (hereinafter the SDGs), and their 169 related targets and the United Nations 2030 Agenda for Sustainable Development.\n\nXVII.-That the Costa Rican State has promoted the philosophy of Open Government and promotion of Open Data in the public sector, through Executive Decree No. 38994-MP-PLAN-MICITT of April 29, 2015, called \"Promotion of Open Government in Public Administration and Creation of the National Commission for an Open Government\", as well as through Executive Decree No. 40199-MP of April 27, 2017, called \"Establishes the Opening of Public Data\" as a means to achieve greater transparency, an open data policy, and greater citizen access to information. Within the framework of these Open Government policies and initiatives, it is necessary to have a specialized climate change information system that allows understanding the progress of relevant policies and their impacts on emissions and absorptions (absorciones) in all sectors of its economy. The foregoing, for the purpose of evaluating existing policy, in order to determine its effectiveness and, as appropriate, propose modifications to existing policies or new policies to the State, in order to comply with the national climate change mitigation and adaptation goals.\n\nXVIII.-That the Directorate of Climate Change (Dirección de Cambio Climático), in accordance with article 40 of the Organic Regulation of the Ministry of Environment and Energy, Executive Decree No. 35669-MINAE of December 4, 2009, has the function, among others, of coordinating and establishing the National Metrics System for monitoring, evaluation, and follow-up of the National Climate Change Program, through information and knowledge management at the national level, as well as coordinating and following up on ministerial, organizational, and sectoral plans for climate change, promoting the establishment of standards that feed the National Metrics System.\n\nXIX.-That through Executive Decree No. 29540-MINAE of May 11, 2001, called \"Constitutes the National Geo-Environmental Information Center as an organ of the General Directorate of Hydrocarbons of the Ministry of Environment and Energy\", the National Geo-Environmental Information Center (CENIGA) is created as a specialized organ of the Ministry of Environment and Energy, which has among its objectives: developing the legal instruments and coordinating for the formation and operation of the National Environmental Information System (SINIA) and the National Environmental Information Network (RENIA); and developing the official system of national environmental statistics and indicators.\n\nXX.-That through Executive Decree No. 41127-MINAE of April 9, 2018, the National Climate Change Metrics System (SINAMECC) is created under the coordination, operation, and execution of the Directorate of Climate Change (DCC) and, its operation is established as the official platform for institutional and sectoral coordination and linkage of the Costa Rican State, to facilitate the management and distribution of knowledge and information on climate change matters. The SINAMECC will operate as a sub-module of the National Environmental Information System (SINIA) and will be linked to the National Statistics System (SEN).\n\nXXI.-That after more than 2 years since the promulgation of Executive Decree No. 41127-MINAE of April 9, 2018, it has been considered pertinent to repeal this regulatory body, due to the existence of new trends in the compilation, management, and disclosure of climate data, this being an area in constant evolution given its characteristics and current relevance, as well as for the purpose of providing the Directorate of Climate Change with the enabling rules necessary to execute the functions entrusted in the aforementioned Regulation and comply with national and international commitments on the matter.\n\nXXII.-That in accordance with the Regulation to the Law for the Protection of the Citizen from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, and its amendments, it was determined that the present proposal does not establish or modify procedures, requirements, or formalities that the administered party must comply with, a situation for which the prior control procedure was not carried out. Therefore;\n\nThey decree:\n\n\"Creation and Operation of the National\n\nClimate Change Metrics System\"\n\nArticle 1-Creation and Purpose. Create the National Climate Change Metrics System (SINAMECC), which is constituted as the official platform for institutional and sectoral coordination and linkage of the Costa Rican State, to facilitate the compilation, management, and disclosure of knowledge and information on climate change matters.\n\nThe SINAMECC will operate as a sub-module of the National Environmental Information System and therefore, will form part of the National Statistics System. The coordination, operation, and execution of the functions established in this executive decree will be under the responsibility and competence of the Directorate of Climate Change (DCC).\n\nArticle 2-Abbreviations. For the purposes of this decree, the following abbreviations must be considered:\n\na) CENIGA: National Geo-Environmental Information Center.\n\nb) CMNUCC: United Nations Framework Convention on Climate Change.\n\nc) DCC: Directorate of Climate Change.\n\nd) IMN: National Meteorological Institute.\n\ne) INEC: National Institute of Statistics and Censuses.\n\nf) INGEI: National Greenhouse Gas Inventory.\n\ng) MINAE: Ministry of Environment and Energy.\n\nh) NDC (for its acronym in English): Nationally Determined Contribution.\n\ni) OECD: Organisation for Economic Co-operation and Development.\n\nj) ODS: Sustainable Development Goals.\n\nk) SEN: National Statistics System.\n\nl) SEPLASA: Secretariat of Sectoral Planning for the Environment.\n\nm) SINAMECC: National Climate Change Metrics System.\n\nn) SINIA: National Environmental Information System.\n\nArticle 3-Definitions. For the purposes of this decree and the processes of compilation, management, and disclosure of information on climate change matters, the following definitions must be considered:\n\na) Climate action (Acción climática): policy instruments, projects, programs, or activities that affect the climate crisis, articulating aspects of mitigation and adaptation to climate change and their financing, enhancing the benefits in the well-being of people and ecosystems.\n\nb) Adaptation (Adaptación): public or private actions and interventions in the face of the probable impacts of climate change and climate variability, tending to reduce vulnerability conditions, that allow moderating damages, avoiding losses, and taking advantage of opportunities, to enhance the resilience of economic, social, and environmental systems, at a national, regional, and local scale.\n\nc) Nationally Determined Contribution (Contribución Nacionalmente Determinada): The NDCs are voluntary commitments of countries before the CMNUCC, requested in the Paris Agreement, article four, paragraph two, with which it is sought to keep the increase in the global average temperature well below 2ºC with respect to pre-industrial levels.\n\nThe NDC of Costa Rica entered into force in 2016 with the ratification of the Paris Agreement. The first update of the NDC was presented by Costa Rica before the CMNUCC in 2020 with goals in mitigation and adaptation. The NDC also generates commitments for periodic reporting of progress before the CMNUCC.\n\nd) Double counting (Doble Contabilidad): in the context of climate change mitigation, it refers to situations in which the same reduction or removal of greenhouse gases is used more than once to demonstrate progress towards mitigation goals.\n\ne) Mitigation (Mitigación): is the action of reducing greenhouse gas emissions and/or increasing carbon dioxide absorptions.\n\nf) Means of implementation (Medios de implementación): support received and support provided in terms of financial resources, capacity building, and technology transfer, the expected effect of which is to reduce net greenhouse gas emissions and/or increase resilience to the impacts of climate variability and projected climate change. This includes public and private, national and international resources.\n\ng) Climate action foresight (Prospectiva de acción climática): is the process of using quantitative and/or qualitative techniques to systematically analyze and/or evaluate one or more plausible characteristics of the future, in order to develop inputs in support of modifications and/or new policies for climate change mitigation and adaptation.\n\nArticle 4-Scope of application. The purposes of the SINAMECC and the functions established in this Decree for the DCC are based on the fulfillment of national and international obligations of the Costa Rican State, in the matter of compilation, management, and disclosure of data and information on climate change.\n\nBy means of the SINAMECC, the data and information sets produced on climate change matters will be compiled and managed, whether by the State and its institutions, the private sector, academia, or civil society, when data transfer and use agreements, cooperation agreements, public-private partnerships, memoranda of understanding, or any other legal instrument exist between any of these and the DCC, as appropriate under each applicable legal regime.\n\nThe information to be compiled, managed, and disclosed will be of a historical, statistical, or scientific type, therefore the compilation, management, or disclosure of personal data is not part of the purpose and scope of application of this Executive Decree, with the exception that will be indicated in article 6 of this Executive Decree.\n\nArticle 5. Nature of the information to be integrated into the SINAMECC. The SINAMECC integrates information relevant to climate change mitigation and adaptation, means of implementation, and the impacts generated by climate change and climate action on sustainable development and in compliance with the ODS.\n\nArticle 6-Guarantee of information protection. Law for the Protection of the Person regarding the processing of their personal data No. 8968 and the Law of the National Statistics System No. 9694. Exceptionally to the provisions of article 4 of this Executive Decree, when a natural or legal person appears before the DCC to voluntarily provide information linked to the subject matter of the SINAMECC and in that act personal data are involved, the protection of personal data will be guaranteed by the DCC in compliance with Law number 8968 and its regulations, as well as by the provisions of articles 10, 20, 21, and 22 of Law No. 9694 regarding statistical confidentiality.\n\nTo ensure the aforementioned, the DCC will create and register before the Data Protection Agency of the Inhabitants the corresponding protocols for the processing of personal data and the safeguarding of informational self-determination.\n\nArticle 7-Strategic purposes of the SINAMECC. The SINAMECC, through the DCC, will fulfill the following purposes:\n\na) Access to information. The SINAMECC will compile, manage, disclose, and, in a broad sense, facilitate access, upon request or ex officio, to all information related to climate change and national climate action, coming from public institutions, private sector actors, and civil society.\n\nb) Facilitate data-driven decision-making. The SINAMECC will provide data that allow analyzing options for improving policies, plans, and other climate actions, as well as for the design of new instruments; in addition, the SINAMECC will facilitate the tools for the dissemination of the analysis results.\n\nc) Monitoring of climate actions. Through the SINAMECC, the processes of monitoring, reporting, verification, and evaluation of the climate actions registered in the system will be supported. The SINAMECC will ensure that the information contained in its platform is truthful, current, transparent, and scientifically rigorous.\n\nd) Continuous improvement. The SINAMECC will promote innovation, continuous improvement, and adoption of best methodologies according to scientific advances and in coordination with the actors involved, to guarantee the correct functioning of the System.\n\ne) Facilitation in the construction of reports related to climate change. The SINAMECC will facilitate access to information for the transparent construction of national and international reports related to climate change, including the progress of compliance with the Nationally Determined Contribution.\n\nArticle 8-Official tool for the INGEI. The SINAMECC will be the official tool and medium of the SINIA, to compile, manage, and disclose, as appropriate, emissions by sources and absorptions by sinks at the national level within the framework of the international commitments acquired on climate change matters. For the fulfillment of this objective, the DCC will coordinate with the competent institutions on the matter.\n\nArticle 9-Coordination of the SINAMECC. The fulfillment of the purposes of the SINAMECC and the rest of the provisions established in this Decree will be under the competence of the DCC.\n\nThe DCC will be responsible for compiling, validating, and preparing communication with competent public and private entities, as well as reporting and communicating to international instruments, for which it is the Focal Point, the information related to climate change covered by this Decree.\n\nArticle 10-Functions of the DCC. For the fulfillment of the purposes of the SINAMECC and the rest of the provisions established in this Decree, the DCC will fulfill the following functions:\n\na) Compilation, management, and disclosure of information. Compile, manage, and disclose information on climate change mitigation and adaptation in Costa Rica, the means of implementation, as well as the information necessary to show the relationship with sustainable development and the ODS associated with the implementation of climate action, when pertinent.\n\nb) Integration. Integrate pertinent information into the SINIA, for its subsequent incorporation into the SEN, in order to acquire the character of official data, in accordance with the provisions established in said systems, and promote its use by other state institutions, the private sector, and civil society.\n\nc) Facilitation of climate information. Facilitate the preparation of national climate change reports, National Communications, Biennial Update Reports, and Biennial Transparency Reports before the CMNUCC, in coordination with other competent entities, also considering other reports to be required by the Enhanced Transparency Framework for Action and Support of the Paris Agreement for developing countries, for the OECD when applicable, and for the monitoring of the ODS.\n\nd) Registry of climate actions. Facilitate the registry of climate actions, both those related to adaptation and mitigation, including pertinent information related to the impacts generated by these in relation to sustainable development and the ODS.\n\ne) Administration of the technological platform. The SINAMECC will have a technological platform for the compilation, management, and disclosure of the information matter of this Decree. The DCC must guarantee the sustainability of the platform, as well as its continuity and adaptation to the best techniques and technological and data management trends.\n\nf) Facilitation of information. Facilitate access to and use of the information contained in the SINAMECC in the public sector as well as in academia, civil society, and the private sector.\n\ng) Monitoring of climate goals. Generate information to measure progress on the country's climate goals, as defined in the NDC and those that are subsequently acquired in accordance with the Paris Agreement, including the Long-term low greenhouse gas emission development strategy and other relevant national and sectoral strategies and plans.\n\nh) Strategic coordination. Coordinate with other key processes and public or private entities, related to climate action, to strategically facilitate the use, transfer, and incorporation of data into the SINAMECC, as well as the exchange of knowledge, in the matters covered by this Decree.\n\nArticle 11-The Advisory Committee. The SINAMECC will have the advisory and accompanying support of an Advisory Committee (Comité Consultivo) that will be comprised of a representative of the DCC, a representative of SEPLASA, a representative of CENIGA, a representative of IMN, and a representative of INEC, and will have the following functions:\n\na) Recommend. Provide recommendations for the correct and continuous operation of the SINAMECC, including planning and obtaining resources, to ensure information flows and for the convening of ad hoc technical teams.\n\nb) Liaise. Serve as a liaison and communication channel with the respective institutions or organs to which the representatives included in the Committee belong, when appropriate.\n\nc) Integration of systems. Contribute to coordination to include information from the SINAMECC in the SINIA and the SEN.\n\nd) Prepare reports. Contribute to the preparation of national reports and documents according to the objectives and matters covered by the SINAMECC, in accordance with their areas of competence.\n\ne) Disclose information. Propose mechanisms and tools to maximize the disclosure of the information contemplated in the SINAMECC to different actors.\n\nf) Recommendation on guides. Recommend on the content of the Guides for the operation of the SINAMECC.\n\ng) Sustainability of the SINAMECC. The institutions that make up the Advisory Committee will collaboratively ensure the sustainability, continuity, and continuous improvement of the SINAMECC, from the scope of their competencies, installed capacities, and existing resources.\n\nThe Advisory Committee of the SINAMECC will be coordinated by the DCC and will fulfill its functions upon the express request of the DCC. If deemed necessary, the Advisory Committee may convene coordination sessions; otherwise, and preferably, its functions will be fulfilled through formal written communications.\n\nThe institutions that make up the Advisory Committee will collaboratively ensure the sustainability, continuity, and continuous improvement of the SINAMECC.\n\nArticle 12-Principles and characteristics of operation of the SINAMECC. The functioning of the SINAMECC, as well as any process of compilation, management, and disclosure of data and information on climate change matters, is governed by the following principles and characteristics, based on the transparency principles of the Paris Agreement.\n\na) Transparency. Understood as the application of clear methodologies and assumptions in the compilation, management, and disclosure processes, to facilitate the reproduction and evaluation of the managed information by the users and counterparts of the System.\n\nb) Consistency. The compilation, management, and disclosure processes of information must be coherent and consistent internally within their processes and elements, interannually.\n\nc) Comparability. The compilation and management of data and information must seek, at all times, to avoid double counting and promote the comparability thereof.\n\nd) Completeness. The compilation, management, and disclosure processes of information must cover information relevant to climate change mitigation and adaptation, means of implementation, and the impacts generated by climate change and climate action on sustainable development and in compliance with the ODS.\n\ne) Accuracy. Accuracy is a relative measure of the degree to which an estimate approaches the true value. Estimates must be accurate in the sense that they are not systematically above or below the reference values.\n\nf) Coordination among actors. Necessary coordination to avoid duplicating procedures and requests and to make the compilation, management, and disclosure of data more efficient.\n\ng) Free access to information. As for the data, processes, and results developed internally within the SINAMECC, as well as in its source code, there must be free access for counterparts and citizens in general, in line with efforts to promote an Open Government in Costa Rica.\n\nh) Sustainability of information flows. It shall be ensured that the data entered into the system have sustainability over time to strengthen the opportunities for analysis and usefulness of the information.\n\ni) Continuous improvement (Mejora continua). Understood as the search for, promotion of, and generation of better data, the quality thereof, and the management and analysis tools.\n\nArticle 13.- SINAMECC Guides and Protocols. The DCC shall produce the necessary Guides (Guías) to facilitate the participation of the different actors in the development of the System and to define the fundamental processes and procedures of the SINAMECC in order to ensure its proper functioning. These Guides shall be mandatory for those who provide information to the SINAMECC and may be accessed on the SINAMECC website (www.sinamecc.go.cr).\n\nThe DCC shall approve the guides for the operation of the SINAMECC, taking into consideration, if any, the recommendations received from the Advisory Committee (Comité Consultivo). The Guides shall be reviewed and updated periodically in line with the principle of continuous improvement (mejora continua) and shall be disseminated through the mechanisms that the DCC deems appropriate to guarantee their adequate dissemination and democratic use.\n\nThe SINAMECC shall integrate information coming from other systems, whether public or private, that produce data, using for this purpose the protocols, guidelines, and orientations established by the System, particularly through the respective Guides to be issued in accordance with this article.\n\nArticle 14.- Inter-institutional cooperation. The bodies of the Executive Branch, within the framework of their legal competencies, must make available and share in the SINAMECC the information they generate and manage, related to climate change mitigation and adaptation, as well as the means of implementation and the impacts generated by these in relation to sustainable development and the SDGs, associated with the implementation of the country's climate action, in accordance with the Guides established for such purpose in the preceding article.\n\nLikewise, MINAE may enter into cooperation agreements for the generation and supply of information with other institutional actors, civil society, research centers and academia, the private sector, non-governmental organizations, international cooperation entities, municipalities, and local communities, which shall contain the necessary clauses and provisions to allow the operation and functioning of the System and to safeguard the legitimate interests and rights of the counterparties.\n\nArticle 15.- Financing and support from other institutions. Public and private entities, including national and international organizations, may, to the extent of their possibilities and within the current legal framework, contribute by providing economic, logistical, and technical resources for the functioning of the SINAMECC. The different public institutions that have the legal mandate to generate information related to the scope of the SINAMECC shall ensure that financing for the activities related to their participation in and support for the SINAMECC is included in their annual operational plans and other planning strategies.\n\nArticle 16.- Free access to the generated information. The information and products included in the SINAMECC shall be of a public nature and freely and gratuitously accessible, with the exceptions provided for in the Political Constitution and current legal regulations, provided that access to said information does not put the environment at risk or threaten it.\n\nIn the event of denying access to the information, a reasoned act shall be issued, in accordance with the provisions of Article 274 of the General Law on Public Administration No. 6227. The authorship of the information included in the System shall be respected in all cases, in accordance with the provisions of applicable regulations.\n\nArticle 17.- Public interest. The establishment and operation of the SINAMECC is declared of public interest.\n\nArticle 18. Repeal. Executive Decree No. 41127-MINAE of April 9, 2018, entitled \"Creation and operation of the National Climate Change Metrics System,\" is hereby repealed.\n\nArticle 19.- Effective date. It shall take effect upon its publication.\n\nIssued at the Presidency of the Republic.- San José, on the thirteenth day of April of the year two thousand twenty-one." }
