los montos de pago por actividad\n\nMINISTERIO\nDE AMBIENTE Y ENERGÍA\n\nR-181-2021-MINAE.-Ministerio\nde Ambiente y Energía.- San José, a las doce horas con cinco minutos del dos de\njulio del dos mil veintiuno.-Se establece al Fondo Nacional de Financiamiento\nForestal la cantidad de hectáreas a financiar por actividad en el Programa de\nPago por Servicios Ambientales y el monto a pagar con base en los recursos\nasignados en el Presupuesto Nacional y aprobados por la Asamblea Legislativa al\ncitado Fondo.\n\nResultando:\n\nÚnico: Que para el\nejercicio 2021 el Presupuesto Nacional dispone un total de diez mil novecientos\nmillones seiscientos noventa y nueve mil cuatrocientos colones con 00/100\n(¢10.900.699.400,00) para el Programa de Pago por Servicios Ambientales, de los\ncuales en su mayoría serán utilizados para el pago de los compromisos de\ncontratos PSA de años anteriores, por lo que para el año 2021 serán reducidos\nsignificativamente los proyectos nuevos.\n\nConsiderando:\n\n1º-Que el artículo 38\ndel Reglamento a la Ley Forestal N° 7575, Decreto Ejecutivo N° 25721-MINAE, del\n17 de octubre de 1996 y sus reformas, dispone que el Ministro de Ambiente y\nEnergía como Jerarca del Ministerio de Ambiente y Energía, en funciones de la\nAdministración Forestal del Estado, emitirá anualmente mediante Resolución Ministerial,\nlas actividades a financiar en el Programa de Pago por Servicios Ambientales y\nlos montos a pagar con base en los recursos asignados en el Presupuesto\nNacional para el ejercicio del año fiscal 2021.\n\n2º-Que bajo este\nprincipio, los instrumentos financieros deben orientarse a apoyar los pilares\ndel Plan Nacional de Desarrollo y de Inversión Pública del Bicentenario\n2019-2022; no estableciendo discriminación, sino la orientación prioritaria a\nlas organizaciones de productores que apoyan los pequeños y medianos\nproductores forestales; y quienes se ubican en los cantones de mayor rezago\nsocial, considerando los objetivos de la creación del Fondo Nacional de\nFinanciamiento Forestal según la citada Ley Forestal, sin dejar de lado los\ncriterios de orden técnico establecidos.\n\n3º-Que el Plan Nacional\nde Desarrollo citado, considera como una de las metas nacionales el mantener\nbajo el Programa de Pago por Servicios Ambientales, al menos trescientas mil\nhectáreas (300.000 has), en sus diferentes actividades.\n\n4º-Que, el Ministerio\nde Ambiente y Energía ha emitido los Principios Rectores del Sector Forestal\nProductivo, mediante el Decreto Ejecutivo N° 41772-MINAE, así como los\nlineamientos a considerar en las gestiones institucionales para la reactivación\ny promoción de la reforestación en el país.\n\n5º-Que, debido al\nesquema y requisitos establecidos para la ejecución del Programa de Pago por\nServicios Ambientales y por la forma de tenencia de la tierra en el país, que\nprincipalmente está compuesta por pequeños propietarios, cuyas fincas tienen\náreas menores a 15 hectáreas, se hacen poco rentables, desmotivando a todos los\nactores propietarios, ingenieros forestales y organizaciones de productores, es\nnecesario innovar mecanismos de fomento.\n\n6º-Que, en virtud de lo\nanterior, esta Resolución establece entre otras actividades tradicionales,\ncontinuar el esfuerzo de escalar a nivel del país el mecanismo para incentivar\nque el programa de pago por servicios ambientales integre a los pequeños\nproductores en áreas menores a 15 hectáreas. Por tanto;\n\nLA MINISTRA DE AMBIENTE\nY ENERGÍA\n\nRESUELVE\n\nArtículo 1º-Establecer\nel límite de gasto al Fondo Nacional de Financiamiento Forestal, para proyectos\nnuevos a financiar por actividades y determinar los montos de pago por actividad.\n\n1. Actividades a\nfinanciar: Para el año 2021, se considerará una modalidad a financiar;\na-Recuperación de la Cobertura Forestal, que incluye las actividades de\nReforestación, Sistemas Agroforestales en Plantaciones de Aprovechamiento\nForestal y Sistemas Mixtos. Para tal fin, se establece la siguiente\ndistribución:\n\nEl Fondo Nacional de\nFinanciamiento Forestal, podrá variar la distribución establecida en el cuadro\nanterior, de acuerdo con la disponibilidad del presupuesto aprobado para el\nPrograma de Pago por Servicios Ambientales.\n\nSe faculta a FONAFIFO\npara que, en el caso de disponer recursos financieros adicionales al\npresupuesto ordinario, se pueda atender un porcentaje de las solicitudes 2021\nrecibidas, de acuerdo a la modalidad y cantidad de recursos, según las\nindicaciones de las autoridades del MINAE.\n\nDe disponer de una\nmayor asignación de recursos, según el artículo 5 de la Ley de Simplificación y\nEficiencia Tributarias N° 8114 publicada en La Gaceta N° 131, del día 9 de\njulio de 2001 y otros recursos financieros que capte el FONAFIFO para el Pago\npor Servicios Ambientales, se distribuirán según el criterio de los\nfinanciadores y del FONAFIFO. En todo caso, los recursos utilizados para estos\nfines, deberán ser incorporados en el presupuesto institucional o al\nFideicomiso 544 Fonafifo/BNCR y ser aprobados por la Asamblea Legislativa o\nContraloría General de la República.\n\n2º-De los montos de\npago por actividad y otras condiciones:\n\n2.1. Actividad de\nReforestación: Las condiciones que regirán para el trámite de solicitudes,\npara el reconocimiento de los servicios ambientales en la actividad de\nReforestación proyecto piloto PSA + Crédito, son las siguientes:\n\na) El monto a pagar\npara la especie de rápido crecimiento referida a: Gmelina arborea, será\nde trescientos noventa mil ochocientos treinta y un colones con 00/100\n(¢390.831,00) por hectárea, desembolsado en un solo tracto del 100%, que se\nentregará por adelantado a la organización, siempre y cuando el beneficiario\nhaya consentido mediante documento formal. Para el Proyecto Piloto se\nautorizará el pago por adelantado siempre y cuando se otorgue una garantía, que\ncubra el monto total del adelanto, a satisfacción del FONAFIFO.\n\nb) Se instruye al Fondo\nNacional de Financiamiento Forestal para que incorpore en los contratos de Pago\npor Servicios Ambientales en la actividad de Reforestación, los valores mínimos\naceptables para realizar los pagos.\n\nEl Fondo Nacional de\nFinanciamiento Forestal utilizará los siguientes valores de referencia para\ntramitar los pagos correspondientes a cada año:\n\nCuadro 1. Valores de referencia mínimos\npara el diámetro (DAP) y la altura total (Htot), esperados por año para\nplantaciones de especies de rápido crecimiento (Gmelina arborea, Vochysia\nguatemalensis*, Acacia mangium, otras).\n\nCuadro 2. Valores de referencia mínimos\npara el diámetro (DAP) y la altura total (Htot) esperados por año para\nplantaciones de especies de mediano crecimiento (Tectona grandis, Pinus sp,\nCordia alliodora, Vochysia ferruginea, Eucalyptus sp, Cedrela odorata, otras).\n\n*Los valores de\nreferencia provienen de datos de parcelas permanentes de muestreo de empresas\nque reforestan aportados por la Oficina Nacional Forestal (ONF), datos de las\nparcelas que aportan los Regentes Forestales y registra el FONAFIFO, ambos, set\nde datos validados por él Dr. Edgar Ortiz Malavassi, Catedrático del Instituto\nTecnológico de Costa Rica.\n\nCuadro 3. Valores mínimos de referencia\npara el diámetro (DAP) y la altura total (Htot), esperada por año para las\nPlantaciones Forestales con Turnos de Rotación Reducidos (PFTRR), para la\nespecie Gmelina arborea y otras especies del grupo de rápido crecimiento.\n\nPara el cálculo del\nvolumen total se debe usar la siguiente ecuación: Vtot = ?/4 * (DAP)² * Htot *\nFf * N\n\nDonde:\n\nVtot = Volumen total\npor hectárea expresado en metros cúbicos.\n\n? = (pi) es la relación entre la longitud de\nuna circunferencia y su diámetro en geometría euclidiana.\n\nDAP = Diámetro a la altura de 1,3m expresado en\nmetros.\n\nHtot = Altura total expresada en metros.\n\nFf = Factor de forma igual que 0,5.\n\nN = Número de árboles por hectárea.\n\na) El Estado a través\ndel FONAFIFO, adquirirá los servicios ambientales que produzcan las\nplantaciones forestales, entendidos éstos según dispone el inciso k del\nartículo 3 de la Ley Forestal N° 7575.\n\nb) Específicamente, los\nservicios ambientales brindados por plantaciones, se pagarán según el\ncrecimiento anual de la biomasa de acuerdo con parámetros establecidos en esta\nresolución. Dichos pagos corresponden al total de años del plazo convenido; no\nobstante, a fin de permitir el establecimiento de la plantación y su\nmantenimiento, se adelantará durante los primeros cinco años.\n\nc) El Fonafifo podrá\nmodificar cuando así se solicite, aquellos contratos suscritos antes del año\n2011, que demuestren haber alcanzado una producción mínima de 13 metros cúbicos\nde incremento medio anual por hectárea. Para tales efectos, el FONAFIFO podrá\nsolicitar la información que considere pertinente.\n\n2.2 Actividad\nde Sistemas Agroforestales: Las condiciones que regirán para el trámite de\nsolicitudes, para el reconocimiento de los servicios ambientales en la\nactividad de Sistemas Agroforestales, se detallan a continuación.\n\na) El monto a pagar\nserá de mil cuatrocientos noventa y tres colones con 00/100 (¢1.493,00) por\nárbol bajo la actividad de Sistemas Agroforestales establecidos en Plantaciones\nde Aprovechamiento Forestal (PPAF), financiados mediante el crédito forestal.\nLos pagos serán distribuidos de la siguiente forma: 80% se girará una vez\nfirmado el contrato y que los árboles hayan alcanzado los 36 meses de edad; el\nrestante 20% se tramitará cuando los árboles tengan 60 meses de edad, al quinto\naño del proyecto.\n\nb) Sistemas Mixtos en\nAgroforestería para pequeños productores: Las condiciones para esta modalidad\nson: Cuando realicen actividades de protección de bosque, un pago de treinta y\nseis mil ochocientos veintitrés colones con 00/100 (¢36.823,00) por hectárea\npor año, durante un periodo de cinco años, (aquí de ser necesario se calcularán\nlas fracciones de hectáreas existentes, hasta el primer decimal. Cuando sean\náreas denudadas o en proceso de regeneración, se reconocerá un pago de\nveintitrés mil quinientos ochenta y nueve colones con 00/100 (¢23.589.00) por\nhectárea, por año durante un periodo de cinco años. Cuando realicen actividades\nde reforestación de especies maderables o de uso múltiple fuera del área\nboscosa un pago de doscientos noventa y nueve colones con 00/100 por árbol\n(¢299,00) por año durante un periodo de cinco años; se reconocerá una cantidad\nmínima de doscientos árboles plantados o árboles existentes identificados,\nhasta un máximo de dos mil doscientos árboles. En esta subactividad podrá\nrealizarse un solo contrato que comprenda las diferentes actividades y el plazo\nserá de cinco años contados a partir de la firma del contrato.\n\n3º-Actualización de\nlos montos a pagar. Los montos establecidos por actividad dentro del\nPrograma de Pago por Servicios Ambientales, se actualizarán anualmente con el\nÍndice de Precios al Consumidor (IPC), calculado por el Instituto Nacional de\nEstadística y Censo (INEC), al cierre del período del año anterior.\n\nArtículo 2°. Se\ninstruye al Fondo Nacional de Financiamiento Forestal para que incorpore en los\ncontratos de Pago por Servicios Ambientales las siguientes condiciones:\n\n1. De los plazos de vigencia\nde los contratos: Los plazos de vigencia de los contratos de Pago por Servicios\nAmbientales, generados por la sub actividad que corresponde a la modalidad de\nrecuperación de cobertura forestal serán los siguientes:\n\na) Los contratos\ncorrespondientes a la sub actividad de Plantaciones Forestales con Turnos de\nRotación Reducidos (PFTRR), tendrán una vigencia de seis años a partir de su\nfirma.\n\nb) Los contratos\ncorrespondientes a la sub actividad de Sistemas Agroforestales establecidos en\nPlantaciones de Aprovechamiento Forestal (PPAF) tendrán una vigencia de 5 años;\nsin embargo, dado que ya están plantados se les reconocerán retroactivamente\ntres años por su establecimiento previo.\n\nc) Los contratos correspondientes\na la sub actividad de Sistemas Mixtos en Agroforestería para micro productores\ntendrán una vigencia de 5 años a partir de su firma.\n\n2. Consideraciones\nEspeciales. Condiciones establecidas para los montos y actividades de las\nsolicitudes PSA:\n\n2.1. Se faculta al\nFondo Nacional de Financiamiento Forestal a establecer actividades y montos\ndiferenciados a los señalados en esta resolución, de conformidad con acuerdos,\nconvenios o contratos o proyectos específicos con entidades, que aporten\nrecursos financieros al Programa de Pago por Servicios Ambientales, que\nreconozcan montos y condiciones diferentes a los establecidos para los\ndiferentes servicios ambientales; para estos proyectos no aplicarán los\ncriterios de priorización que se detallaron anteriormente, sino los pactados en\ncada convenio. Los pagos se realizarán siempre y cuando se tenga disponibilidad\npresupuestaria para cubrir los compromisos adquiridos mediante el Programa de\nPago por Servicios Ambientales.\n\n2.2. Los montos\npendientes por pagar para los contratos de años anteriores, se regirán según lo\nestablecido en los Decretos Ejecutivos y Resoluciones Administrativas\ncorrespondientes para cada año.\n\n2.3. Para cubrir el\ncosto de inscripción del contrato ante el Registro Público, el Fondo Nacional\nde Financiamiento Forestal retendrá en el primer desembolso del monto total del\ncontrato un 0,6%.\n\n2.4. Los recursos\nrecuperados en virtud de los incumplimientos de contratos de pago por servicios\nambientales o las devoluciones o finiquitos, serán transferidos al Fideicomiso\n544 FONAFIFO/BNCR y serán presupuestados para la ejecución de nuevas\nactividades de fomento de pequeños y medianos productores.\n\n2.5. El proyecto deberá\ncontar con un regente durante toda vigencia del contrato de pago por servicios\nambientales. El formulario de regencia podrá inscribirse ante el Colegio de\nIngenieros Agrónomos, por la totalidad del plazo del contrato de pago por\nservicios ambientales, o por períodos anuales o quinquenales según disponga el\npropietario del inmueble. Cualquiera que sea la forma de pago, siempre deberá\naportarse el formulario de regencia debidamente inscrito; salvo en aquellos\ncasos que, se haya determinado que el proyecto será supervisado directamente\npor el Fondo Nacional de Financiamiento Forestal; a través de sus funcionarios\no por medio de consultores.\n\n2.6. Sin perjuicio de\notras disposiciones, el o los beneficiarios deberán aportar un informe de\nregencia anual emitido por un regente forestal para el trámite de pago; o\neventualmente un informe de visita de campo emitido por un profesional\nforestal, en aquellos proyectos que no cuenten con regentes. Adicionalmente,\npara los contratos de Reforestación de rápido crecimiento, deberá presentar los\ninformes de visita, donde certifique el estado de los proyectos en los años 8 y\n10 a partir de su fecha de plantación; para los proyectos de mediano\ncrecimiento y otras especies deberán presentar dichos informes al año 8, 12 y\n16, a partir de su fecha de plantación.\n\n2.7. Sin perjuicio de\notras acciones que representen incumplimiento a las obligaciones del contrato,\npara los contratos de Reforestación de rápido crecimiento o bloques a partir de\nlos 12 meses y para las plantaciones de mediano crecimiento o bloques a partir\nde los 24 meses de establecida la plantación, se considera incumplido el\ncontrato si la plantación no presenta el crecimiento mínimo establecido en el\nartículo 1 inciso 2.1, o el indicado de previo en el estudio técnico respectivo\npara otras especies. Como consecuencia de este incumplimiento, el productor no\nrecibirá el pago correspondiente a este año, siendo que el Fondo Nacional de\nFinanciamiento Forestal debe suspender los pagos respectivos y dar por\nterminado el contrato con responsabilidad para el beneficiario previo\ncumplimiento del debido proceso. En casos muy calificados, basados en estudios\ny/o informes de los encargados de Oficinas Regionales de FONAFIFO, se podría\nproceder con el pago respectivo y continuar con el contrato aun con índices de\ncrecimiento menor, siempre y cuando estos no obedezcan a incumplimientos, por\nla mala selección del sitio, de la especie, o sea producto de un inadecuado\nmanejo de la plantación.\n\n2.8. Como principio\ngeneral, serán motivo de eximente de responsabilidad por incumplimiento del\ncontrato, el caso fortuito, la fuerza mayor, el hecho de un tercero como\neximentes generales debidamente comprobadas y valoradas a juicio del FONAFIFO.\nDe igual forma, se procederá cuando el propietario de la plantación demuestre\nque una plaga o enfermedad afectó la plantación y que las acciones\noportunamente realizadas no lograron erradicarla, siempre y cuando estén\ndocumentadas en el expediente de PSA y tengan el aval de la Oficina Regional.\nSe procederá de igual manera cuando el daño sea producto de un incendio que no\npudo ser controlado a pesar de las medidas preventivas reportadas.\n\n2.9. No podrán\nejecutarse proyectos en fincas que hayan sido objetos de plagas, enfermedades,\no incendios; en tal supuesto la finca no podrá ser sujeto de contratos en\nReforestación y/o Sistemas Agroforestales en bloque, en un plazo de 3 años, a\npartir del último contrato finalizado por esta causa.\n\n2.10. En relación a las\nplagas y enfermedades que afecten las plantaciones forestales, la Junta\nDirectiva de Fonafifo, determinará lineamientos para abordar y resolver estos\nsupuestos.\n\n2.11. El FONAFIFO, será\nel responsable de monitorear las plantaciones forestales que ingresen al\nPrograma, debiendo no solo hacer un seguimiento a nivel regional, sino un\nprotocolo de control, mediante un mecanismo aleatorio de visitas según su\ncapacidad técnica y administrativa, de acuerdo a la disponibilidad de recursos\npresupuestados. De igual forma, deberá custodiar la información de las parcelas\npermanentes de mediciones de las plantaciones, a fin de sustentar los pagos y\nrespaldar las fijaciones de carbono y otros gases de efecto invernadero.\n\n2.12. Para uniformizar\nla información requerida de las parcelas permanentes de plantaciones y bloques,\nel FONAFIFO emitirá el formato del contenido de la base de datos en Excel, para\nque los regentes lo remitan anualmente con los datos individuales de diámetros\ny alturas. El archivo se encuentra disponible en el sitio web de Fonafifo para\nsu descarga.\n\n2.13. En caso de que en\nlas solicitudes presentadas se determinara la existencia de traslapes o\ndesplazamiento entre ellas y/o con otras fincas, el Fonafifo valorará de\nacuerdo a criterios técnicos y legales la aprobación o no de las solicitudes de\ningreso.\n\n2.14. En el caso de las\nsolicitudes de ingreso de Reforestación que involucren mezclas de especies de\nrápido, mediano y/o en vías de extinción, se deberá generar contratos\nseparados, en virtud de las diferencias de crecimiento que se presentan entre\nestos grupos de especies. Además, los proyectos que estén conformados por\nespecies nativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de\n1996 y N° 25700-MINAE del 15 de noviembre de 1996, deberá contener el 100% de\nlos árboles de las especies contenidas en los mencionados decretos; de lo\ncontrario tendrá un valor en función del monto menor establecido para\nReforestación.\n\n2.15. Los proyectos\nfinanciados con los recursos de convenios u otros donantes o socios tendrán los\nservicios de regencia financiados con recursos de este convenio, o los que se\nestablezcan con otros donantes o socios.\n\n2.16. En el caso de las\nsolicitudes de ingreso que se presenten para acceder al Programa de Pago por\nServicios Ambientales, deben de contener la información de contacto (correo\nelectrónico, número de teléfono, dirección) del dueño o dueños del inmueble.\nSin esta información la administración estimará como incompleta la solicitud y\nprocederá a señalarla, para que el solicitante proceda a completarla, de no\nsuministrar la información se procederá con su archivo. El Fonafifo realizará\nel trámite de pago de los contratos con morosidad según lo establecido en la\nLey N° 9686 y sus modificaciones; en donde, la CCSS estableció el procedimiento\nque las instituciones del Estado deben de seguir ante beneficiarios morosos con\nla CCSS.\n\nArtículo 3º-Rige a\npartir de su publicación.\n\nEn cumplimiento del oficio\nDirectriz-011-2020 del 23 de septiembre del 2020, se incorpora la siguiente\nleyenda: \"Revisado el documento anterior, sea la resolución R-181-2021-MINAE el\nmismo reúne todos los requisitos del ordenamiento jurídico, no existe nulidad o\nimpedimento alguno para su firma.\" De conformidad con el oficio DG-OF-081-2021.", "body_en_text": "throughout the entire text\n\n -\n\n Complete Text of Norm 181\n\n Establishes the spending limit for the National Forest Financing Fund,\nfor new projects to be financed by activity and determines the payment amounts per activity\n\nMINISTRY\nOF ENVIRONMENT AND ENERGY\n\nR-181-2021-MINAE.-Ministry\nof Environment and Energy.- San José, at twelve hours and five minutes on the second of\nJuly, two thousand twenty-one.- The National Forest Financing Fund\nis hereby established the number of hectares to be financed per activity in the\nPayment for Environmental Services Program and the amount to be paid based on the resources\nallocated in the National Budget and approved by the Legislative Assembly for the\naforementioned Fund.\n\nResulting:\n\nSole: That for the\n2021 fiscal year, the National Budget provides a total of ten billion nine hundred\nmillion six hundred ninety-nine thousand four hundred colones with 00/100\n(¢10,900,699,400.00) for the Payment for Environmental Services Program, of\nwhich the majority will be used for the payment of commitments from\nPES contracts from previous years, so for the year 2021, new projects will be\nsignificantly reduced.\n\nConsidering:\n\n1º-That Article 38\nof the Regulation to the Forest Law No. 7575, Decreto Ejecutivo No. 25721-MINAE, of\nOctober 17, 1996, and its amendments, provides that the Minister of Environment and\nEnergy, as Head of the Ministry of Environment and Energy, acting as the\nState Forest Administration, shall annually issue, by Ministerial Resolution,\nthe activities to be financed in the Payment for Environmental Services Program and\nthe amounts to be paid based on the resources allocated in the National\nBudget for the 2021 fiscal year.\n\n2º-That under this\nprinciple, financial instruments must be oriented to support the pillars\nof the National Development and Public Investment Plan of the Bicentennial\n2019-2022; not establishing discrimination, but rather priority orientation to\nproducer organizations supporting small and medium\nforest producers; and those located in the cantons of greatest social\nbackwardness, considering the objectives of the creation of the National\nForest Financing Fund according to the aforementioned Forest Law, without neglecting\nthe established technical criteria.\n\n3º-That the aforementioned National Development\nPlan considers as one of the national goals to maintain\nunder the Payment for Environmental Services Program at least three hundred thousand\nhectares (300,000 has), in its different activities.\n\n4º-That the Ministry\nof Environment and Energy has issued the Guiding Principles of the Productive\nForest Sector, through Decreto Ejecutivo No. 41772-MINAE, as well as the\nguidelines to consider in institutional actions for the reactivation\nand promotion of reforestation in the country.\n\n5º-That, due to the\nscheme and requirements established for the execution of the Payment for\nEnvironmental Services Program and because of the form of land tenure (tenencia de la tierra) in the country, which\nis mainly composed of small owners, whose farms have\nareas smaller than 15 hectares, they become unprofitable, discouraging all\nactors: owners, forest engineers, and producer organizations, it is\nnecessary to innovate promotion mechanisms.\n\n6º-That, by virtue of the\nforegoing, this Resolution establishes, among other traditional activities,\nto continue the effort to scale at the country level the mechanism to incentivize\nthe Payment for Environmental Services Program to integrate small\nproducers in areas smaller than 15 hectares. Therefore;\n\nTHE MINISTER OF ENVIRONMENT\nAND ENERGY\n\nRESOLVES\n\nArticle 1º-To establish\nthe spending limit for the National Forest Financing Fund, for new\nprojects to be financed by activity and to determine the payment amounts per activity.\n\n1. Activities to\nfinance: For the year 2021, one modality to be financed will be considered;\na-Recovery of Forest Cover (Recuperación de la Cobertura Forestal), which includes the activities of\nReforestation, Agroforestry Systems (Sistemas Agroforestales) in Forest Harvesting\nPlantations (Plantaciones de Aprovechamiento Forestal), and Mixed Systems (Sistemas Mixtos). For this purpose, the following\ndistribution is established:\n\nThe National Forest\nFinancing Fund may vary the distribution established in the table\nabove, according to the availability of the approved budget for the\nPayment for Environmental Services Program.\n\nFONAFIFO is empowered\nto, in the event of having additional financial resources beyond the\nordinary budget, address a percentage of the 2021\nrequests received, according to the modality and quantity of resources, as per\nthe instructions of the MINAE authorities.\n\nIf a greater\nallocation of resources is available, according to Article 5 of the Law of Tax\nSimplification and Efficiency No. 8114 published in La Gaceta No. 131, of July\n9, 2001, and other financial resources that FONAFIFO secures for the Payment for\nEnvironmental Services, they will be distributed according to the criteria of\nthe financiers and FONAFIFO. In any case, the resources used for these\npurposes must be incorporated into the institutional budget or the\nFONAFIFO/BNCR Trust 544 and be approved by the Legislative Assembly or\nthe Comptroller General of the Republic.\n\n2º-Of the payment amounts\nper activity and other conditions:\n\n2.1. Reforestation Activity:\nThe conditions that will govern the processing of requests,\nfor the recognition of environmental services in the Reforestation\nactivity, PES + Credit pilot project, are the following:\n\na) The amount to pay\nfor the fast-growing species referred to as: Gmelina arborea, will be\nthree hundred ninety thousand eight hundred thirty-one colones with 00/100\n(¢390,831.00) per hectare, disbursed in a single 100% installment, which\nwill be delivered in advance to the organization, provided that the beneficiary\nhas consented through a formal document. For the Pilot Project, advance\npayment will be authorized provided that a guarantee is granted, covering\nthe total amount of the advance, to the satisfaction of FONAFIFO.\n\nb) The National Forest\nFinancing Fund is instructed to incorporate into the Payment for\nEnvironmental Services contracts for the Reforestation activity, the minimum\nacceptable values for making payments.\n\nThe National Forest\nFinancing Fund will use the following reference values to\nprocess the payments corresponding to each year:\n\nTable 1. Minimum reference values\nfor diameter (DBH) and total height (Htot), expected per year for\nplantations of fast-growing species (Gmelina arborea, Vochysia\nguatemalensis*, Acacia mangium, others).\n\nTable 2. Minimum reference values\nfor diameter (DBH) and total height (Htot) expected per year for\nplantations of medium-growth species (Tectona grandis, Pinus sp,\nCordia alliodora, Vochysia ferruginea, Eucalyptus sp, Cedrela odorata, others).\n\n*The reference\nvalues come from data from permanent sampling plots of\nreforesting companies provided by the National Forest Office (ONF), data from\nplots provided by Forest Managers (Regentes Forestales) and recorded by FONAFIFO, both sets\nof data validated by Dr. Edgar Ortiz Malavassi, Professor at the Instituto\nTecnológico de Costa Rica.\n\nTable 3. Minimum reference values\nfor diameter (DBH) and total height (Htot), expected per year for\nForest Plantations with Reduced Rotation Cycles (Plantaciones Forestales con Turnos de Rotación Reducidos, PFTRR), for the\nspecies Gmelina arborea and other species of the fast-growing group.\n\nFor the calculation of the\ntotal volume, the following equation must be used: Vtot = ?/4 * (DBH)² * Htot *\nFf * N\n\nWhere:\n\nVtot = Total volume\nper hectare expressed in cubic meters.\n\n? = (pi) is the relationship between the length of\na circumference and its diameter in Euclidean geometry.\n\nDBH = Diameter at breast height of 1.3m expressed in\nmeters.\n\nHtot = Total height expressed in meters.\n\nFf = Form factor equal to 0.5.\n\nN = Number of trees per hectare.\n\na) The State, through\nFONAFIFO, will acquire the environmental services produced by\nforest plantations, understood as such according to subsection k of\nArticle 3 of the Forest Law No. 7575.\n\nb) Specifically, the\nenvironmental services provided by plantations will be paid according to the\nannual growth of the biomass in accordance with the parameters established in this\nresolution. Said payments correspond to the total years of the agreed term;\nhowever, in order to allow the establishment of the plantation and its\nmaintenance, it will be advanced during the first five years.\n\nc) Fonafifo may\nmodify, when so requested, those contracts signed before the year\n2011 that demonstrate having reached a minimum production of 13 cubic meters\nof mean annual increment per hectare. For such purposes, FONAFIFO may\nrequest the information it deems pertinent.\n\n2.2 Activity\nof Agroforestry Systems (Sistemas Agroforestales): The conditions that will govern the processing of\nrequests for the recognition of environmental services in the\nAgroforestry Systems activity are detailed below.\n\na) The amount to pay\nwill be one thousand four hundred ninety-three colones with 00/100 (¢1,493.00) per\ntree under the Agroforestry Systems activity established in Forest Harvesting\nPlantations (Plantaciones de Aprovechamiento Forestal, PPAF), financed through forest credit.\nThe payments will be distributed as follows: 80% will be disbursed once\nthe contract is signed and the trees have reached 36 months of age; the\nremaining 20% will be processed when the trees are 60 months of age, in the fifth\nyear of the project.\n\nb) Mixed Systems (Sistemas Mixtos) in\nAgroforestry for small producers: The conditions for this modality are:\nWhen carrying out forest protection activities, a payment of thirty-\nsix thousand eight hundred twenty-three colones with 00/100 (¢36,823.00) per hectare\nper year, for a period of five years, (here, if necessary, fractions of existing hectares will be calculated, up to the first decimal. When\nthey are denuded or regenerating areas, a payment of\ntwenty-three thousand five hundred eighty-nine colones with 00/100 (¢23,589.00) per\nhectare, per year, for a period of five years, will be recognized. When carrying out\nreforestation activities with timber or multiple-use species outside the\nforested area, a payment of two hundred ninety-nine colones with 00/100 per tree\n(¢299.00) per year for a period of five years; a minimum\nquantity of two hundred planted trees or identified existing trees, up to a maximum of two thousand two hundred trees, will be recognized. In this sub-activity, a\nsingle contract may be executed that includes the different activities and the term\nwill be five years counted from the signing of the contract.\n\n3º-Updating of\nthe payment amounts. The amounts established per activity within the\nPayment for Environmental Services Program will be updated annually using the\nConsumer Price Index (CPI), calculated by the National Institute of\nStatistics and Census (INEC), at the end of the previous year's period.\n\nArticle 2°. The\nNational Forest Financing Fund is instructed to incorporate into the\nPayment for Environmental Services contracts the following conditions:\n\n1. Of the validity periods\nof the contracts: The validity periods of the Payment for Environmental Services\ncontracts generated by the sub-activity corresponding to the modality of\nrecovery of forest cover (recuperación de cobertura forestal) will be as follows:\n\na) The contracts\ncorresponding to the sub-activity of Forest Plantations with Reduced Rotation\nCycles (PFTRR) will have a validity of six years from their\nsigning.\n\nb) The contracts\ncorresponding to the sub-activity of Agroforestry Systems established in\nForest Harvesting Plantations (PPAF) will have a validity of 5 years;\nhowever, given that they are already planted, they will be recognized retroactively\nfor three years for their prior establishment.\n\nc) The contracts corresponding\nto the sub-activity of Mixed Systems in Agroforestry for micro-producers\nwill have a validity of 5 years from their signing.\n\n2. Special\nConsiderations. Conditions established for the amounts and activities of\nPES requests:\n\n2.1. The\nNational Forest Financing Fund is empowered to establish activities and\ndifferentiated amounts from those indicated in this resolution, in accordance with\nagreements, covenants, or specific contracts or projects with entities that\ncontribute financial resources to the Payment for Environmental Services Program, which\nrecognize amounts and conditions different from those established for the\ndifferent environmental services; for these projects, the\nprioritization criteria detailed above will not apply, but rather those agreed upon in\neach covenant. Payments will be made provided there is\nbudgetary availability to cover the commitments acquired through the\nPayment for Environmental Services Program.\n\n2.2. The amounts\npending payment for contracts from previous years will be governed according to what is\nestablished in the corresponding Decretos Ejecutivos and Administrative\nResolutions for each year.\n\n2.3. To cover the\ncost of registering the contract with the Public Registry, the National Forest\nFinancing Fund will withhold 0.6% from the first disbursement of the total\ncontract amount.\n\n2.4. The resources\nrecovered by virtue of breaches of Payment for Environmental\nServices contracts, or returns or final settlements, will be transferred to the\nFiduciary Trust 544 FONAFIFO/BNCR and will be budgeted for the execution of new\npromotion activities for small and medium producers.\n\n2.5. The project must\nhave a manager (regente) throughout the validity of the Payment for Environmental\nServices contract. The management (regencia) form may be registered with the Colegio de\nIngenieros Agrónomos for the entire term of the Payment for\nEnvironmental Services contract, or for annual or five-year periods as determined by the\nproperty owner. Whatever the form of payment, the\nduly registered management (regencia) form must always be provided, except in those\ncases where it has been determined that the project will be directly supervised\nby the National Forest Financing Fund, through its officials\nor through consultants.\n\n2.6. Without prejudice to\nother provisions, the beneficiary or beneficiaries must provide an\nannual management report (informe de regencia) issued by a forest manager (regente forestal) for the payment processing;\nor eventually a field visit report issued by a\nforestry professional, for those projects that do not have managers (regentes). Additionally,\nfor fast-growing Reforestation contracts, they must present\nvisit reports certifying the status of the projects at years 8 and\n10 from their planting date; for medium-\ngrowth projects and other species, they must present such reports at year 8, 12,\nand 16 from their planting date.\n\n2.7. Without prejudice to\nother actions that represent a breach of the contract obligations,\nfor fast-growing Reforestation contracts or blocks starting from\n12 months, and for medium-growth plantations or blocks starting from\n24 months of the plantation's establishment, the\ncontract is considered breached if the plantation does not present the minimum growth established in\nArticle 1, subsection 2.1, or that previously indicated in the respective technical study\nfor other species. As a consequence of this breach, the producer will not\nreceive the payment corresponding to that year, and the National Forest\nFinancing Fund must suspend the respective payments and terminate\nthe contract with liability for the beneficiary, following\ndue process. In highly qualified cases, based on studies\nand/or reports from the officials of FONAFIFO Regional Offices, the\nrespective payment could be made and the contract continued even with lower\ngrowth indices, provided that these are not due to breaches, to\nthe poor selection of the site, the species, or are the product of inadequate\nmanagement of the plantation.\n\n2.8. As a general\nprinciple, grounds for exemption from liability for breach of\ncontract will be fortuitous event, force majeure, the act of a third party as\ngeneral exonerations duly proven and assessed at the discretion of FONAFIFO.\nThe same shall apply when the plantation owner demonstrates\nthat a pest or disease affected the plantation and that the actions\ntimely taken did not manage to eradicate it, provided they are\ndocumented in the PES file and have the approval of the Regional Office.\nThe same shall apply when the damage is the product of a fire that\ncould not be controlled despite the reported preventive measures.\n\n2.9. Projects may not\nbe executed on farms that have been subject to pests, diseases,\nor fires; in such a case, the farm may not be subject to\nReforestation and/or block Agroforestry Systems contracts for a period of 3 years, from\nthe last contract terminated for this cause.\n\n2.10. Regarding\npests and diseases affecting forest plantations, the\nBoard of Directors of Fonafifo will determine guidelines to address and resolve these\nsituations.\n\n2.11. FONAFIFO will be\nresponsible for monitoring the forest plantations that enter the\nProgram, needing not only to follow up at the regional level but also to implement a\ncontrol protocol, through a random mechanism of visits according to its\ntechnical and administrative capacity, according to the availability of\nbudgeted resources. Likewise, it must safeguard the information from the\npermanent measurement plots of the plantations to support the payments and\nback the carbon and other greenhouse gas sequestration.\n\n2.12. To standardize\nthe required information from the permanent plantation and block plots,\nFONAFIFO will issue the content format of the database in Excel, for\nthe managers (regentes) to submit annually with the individual data of diameters\nand heights. The file is available on the Fonafifo website for\ndownload.\n\n2.13. In the event that in\nthe submitted requests the existence of overlaps or\ndisplacement between them and/or with other farms is determined, Fonafifo will assess\naccording to technical and legal criteria the approval or not of the\nentry requests.\n\n2.14. In the case of\nReforestation entry requests involving mixtures of\nfast-growing, medium-growing, and/or endangered species, separate\ncontracts must be generated, by virtue of the growth differences that occur between\nthese groups of species. Additionally, projects that are composed of\nnative species contained in Decretos No. 25663-MINAE of October 8,\n1996, and No. 25700-MINAE of November 15, 1996, must contain 100% of\nthe trees of the species contained in the aforementioned decrees; otherwise\nit will have a value based on the lower amount established for\nReforestation.\n\n2.15. Projects\nfinanced with resources from covenants or other donors or partners will have the\nmanagement (regencia) services financed with resources from this covenant, or those established\nwith other donors or partners.\n\n2.16. In the case of\nentry requests submitted to access the Payment for\nEnvironmental Services Program, they must contain the contact information (email,\ntelephone number, address) of the property owner or owners.\nWithout this information, the administration will deem the request incomplete and\nproceed to flag it, so that the applicant can complete it; if\nthe information is not provided, it will be archived. Said information is\nfundamental for the PPSA notification process.\n\n2.17. Forest plantations\nand individual trees of endangered species planted\nwith financing from environmental services contracts may be\nharvested (aprovechados) based on Article 28 of the Forest Law.\n\n2.18. Reforestation\nand block SAF projects from the years 2016, 2017, 2018, and 2019 will be assessed\naccording to the growth parameters established in the ministerial\nresolution R-167-2019-MINAE, published in La Gaceta No. 138 of July 23,\n2019.\n\n2.19.
