del\n2021.\n\nResultando:\n\n1º-Que el artículo 22 de la Ley de Biodiversidad Nº 7788,\npublicada en La Gaceta Nº 101 del 27 de mayo de 1998 establece al\nSistema Nacional de Áreas de Conservación, como una institución desconcentrada\ny participativa, con personalidad jurídica instrumental, que integra las\ncompetencias en materia forestal, vida silvestre, áreas silvestres protegidas,\nprotección y conservación del uso de cuencas hidrográficas y sistemas hídricos,\ndel Ministerio de Ambiente y Energía (MINAE), con el fin de dictar políticas,\nplanificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el\nmanejo de los recursos naturales de Costa Rica.\n\n2º-Que la Ley de Conservación de Vida Silvestre N° 7317 del 30 de octubre\nde 1992 y sus reformas tiene como objetivo regular la vida silvestre, normando\nsu conservación y manejo.\n\nConsiderando:\n\n1°-Que el artículo 50 de la Constitución Política\nreconoce el derecho a un ambiente sano y ecológicamente equilibrado, siendo que\neste derecho incluye la conservación, uso y manejo sostenible de la\nbiodiversidad y la justa y equitativa distribución de beneficios derivados de\nesta, asegurando la mayor participación de todos los ciudadanos. Siendo la vida\nsilvestre un elemento de la biodiversidad, el cual es prioritario y sustantivo,\nsu importancia es incuestionable, por su valor intrínseco y sus aportes para\nlograr un ambiente sano y ecológicamente equilibrado, así como su rol\nfundamental en la economía y el desarrollo de este país.\n\n2°-Que el artículo 16 de la Ley General de la Administración Pública\nestablece que los actos de la Administración deben dictarse apegados a las\nreglas unívocas de la ciencia, la técnica, a principios elementales de\njusticia, lógica o conveniencia.\n\n3°-Que para todo efecto legal de acuerdo con la Ley 8454, la firma digital\nemitida por una autoridad certificadora registrada tiene la equivalencia\njurídica de una firma manuscrita, según el artículo 4 que indica:\n\"Artículo 4º-Calificación jurídica y fuerza probatoria. Los documentos\nelectrónicos se calificarán como públicos o privados, y se les reconocerá fuerza\nprobatoria en las mismas condiciones que a los documentos físicos\". De\nconformidad con el artículo 8 de la Ley Nº 8220, no podrá solicitarse al\ninteresado que requiera un trámite la presentación de certificaciones, copias\nde información que ya posea otra institución, según los medios legales\npreestablecidos.\n\n4°-Que la Ley de Conservación de Vida Silvestre del 30 de octubre de 1992\ntiene como finalidad establecer las regulaciones sobre la vida silvestre,\nnormando su conservación y manejo. El artículo 3 declara el dominio público de\nla fauna silvestre, y el artículo 4 declara la producción, manejo, extracción y\ncomercialización, industrialización y uso del material genético de la flora y\nfauna silvestres sus partes, productos y subproductos de interés público y\npatrimonio nacional, sujetos a regulación estatal.\n\n5°-Que el artículo 12 de la Ley de Conservación de Vida Silvestre faculta\nal Poder Ejecutivo para establecer, por medio del Reglamento de esta Ley, los\nprocedimientos y requisitos necesarios para la conservación de la vida\nsilvestre continental o insular, acuática o terrestre, en todo el territorio\nnacional.\n\n6°-Que mediante Ley 9106 del 20 de diciembre de 2012 se reformó la Ley de Conservación de Vida\nSilvestre. Esta reforma fue promovida por iniciativa popular, integrando cambios significativos en\nla visión y el paradigma del país en materia de vida silvestre, incluyendo los trámites relacionados\na permisos de importación y exportación de organismos de vida silvestre, sus partes, productos y\nderivados.\n\n7°-Que mediante la Ley Nº 7638, se crea el Ministerio de Comercio Exterior\ny Promotora de Comercio Exterior y en su artículo 8 inciso c), se indica la\nresponsabilidad de PROCOMER de administrar un sistema de ventanilla única de\ncomercio exterior, que centralice y agilice los trámites de importación y\nexportación. Establece adicionalmente, para las instituciones públicas que\nintervengan en tales trámites que estarán obligadas a prestar su colaboración a\nla Promotora.\n\n8°-Que para los trámites de exportación e importación que el Sistema\nNacional de Áreas de Conservación debe tramitar, se basará en el cumplimiento\ndel artículo 2 inciso d) del Decreto Ejecutivo Nº 33452, denominado Reglamento\ndel Sistema de Ventanilla Única de Comercio Exterior.\n\n9°-Que el Consejo Nacional de Áreas de Conservación (CONAC), requiere\npublicar el Lineamiento para la automatización de los trámites de exportación\ncon fines comerciales de especímenes de vida silvestre, provenientes de sitios\nde manejo autorizados por el Sistema Nacional de Áreas de Conservación (SINAC),\ncon la finalidad que la Administración y demás involucrados en el trámite de\nexportación de especímenes de vida silvestre desde Costa Rica, cuenten con\nprocedimientos estandarizados para el uso sostenible de la vida silvestre en\nlas diversas Oficinas Subregionales del Sistema Nacional de Áreas de\nConservación.\n\n10.-Que el Consejo Nacional de Áreas de Conservación (CONAC) en Acuerdo N°\n13 de la Sesión Ordinaria N° 4-2021, celebrada el 13 de abril del 2021, acordó\npublicar el Lineamiento para la automatización de los trámites de exportación\ncon fines comerciales de especímenes de vida silvestre, provenientes de sitios\nde manejo autorizados por el Sistema Nacional de Áreas de Conservación (SINAC).\nPor tanto,\n\nEL CONSEJO NACIONAL DE ÁREAS DE CONSERVACIÓN\n\nDEL SISTEMA NACIONAL DE AREAS DE CONSERVACION\n\nEmite el presente lineamiento para la automatización de\nlos trámites de exportación con fines comerciales de especímenes de vida\nsilvestre, sus partes o derivados provenientes de sitios de manejo autorizados\npor el Sistema Nacional de Áreas de Conservación (SINAC)\n\nI.-Introducción\n\nEl presente lineamiento es un documento que debe tener claro la\nAdministración y demás involucrados en el uso sostenible de la vida silvestre\nen Costa Rica, con el fin de estandarizar los procedimientos para el trámite de\nexportaciones con fines comerciales de especímenes de vida silvestre por parte\nde las Áreas de Conservación del Sistema Nacional de Áreas de Conservación\n(SINAC).\n\nEste lineamiento regula la automatización de los trámites de exportación\ncon fines comerciales de especímenes de vida silvestre, sus partes o derivados\nprovenientes de los sitios de manejo autorizados por el Sistema Nacional de\nÁreas de Conservación (SINAC).\n\nII.-Aspectos Legales del Manejo de Vida Silvestre en Costa Rica\n\nEl artículo 14 del Decreto Ejecutivo Nº 40548-MINAE, Reglamento a la Ley de\nConservación de la Vida Silvestre, establece los requisitos para el trámite de\nlas solicitudes de exportación de especímenes de vida silvestre, sus partes o\nderivados con fines comerciales, sin embargo, es muy importante aprovechar los\nprocesos de automatización de las plataformas de exportación e importación que\nse realizan en el país.\n\nDebido al\nproceso de automatización de los permisos de exportación a otorgar, el SINAC\ndesarrolla el presente lineamiento para aprovechar las bondades del Sistema de\nVentanilla Única de Comercio Exterior (VUCE) de PROCOMER. Formulario de solicitud debidamente lleno y firmado digitalmente en el\nSistema VUCE vigente. Según el Anexo 1 de la presente resolución.\n\n2. En caso de que el solicitante sea extranjero sin identificación\nnacional, debe aportar en el Sistema VUCE, copia certificada del pasaporte\nvigente. Para estos efectos la copia certificada se recibirá con firma digital.\n\n3. En caso de que el solicitante sea una persona jurídica, debe aportar en\nel Sistema VUCE, una certificación de personería jurídica con no más de tres\nmeses de haber sido emitida. Para estos efectos la certificación se recibirá\ncon firma digital.\n\n4. En caso de ocupantes reconocidos de terrenos bajo la administración del\nINDER, que vayan a realizar exportaciones de especímenes de vida silvestre, sus\npartes o derivados la solicitud debe incluir el acuerdo en firme de la Junta\nDirectiva del Instituto, en el cual se autorice al solicitante a realizar la\nactividad que se pretende desarrollar. Dicha autorización firmada digitalmente\ndeberá ser aportada en el Sistema VUCE.\n\n5. Cuando la exportación la pretenda realizar una persona distinta al\npropietario del inmueble, se debe presentar un documento jurídicamente válido\nque demuestre que el solicitante tiene la autorización expresa del propietario\no facultades suficientes para realizar la actividad que se pretenda. Dicha\nautorización firmada digitalmente deberá ser aportada en el Sistema VUCE.\n\n6. Estar al día en sus obligaciones como patrono o certificación de no\npatrono emitida por la CCSS conforme al artículo 74 de la Ley Constitutiva de\nla CCSS, No. 17. El funcionario del SINAC generará la Certificación del SICERE\ny la aportará al VUCE para el expediente digital.\n\n7. Documento técnico, que en el caso de las exportaciones se recibirá el certificado de origen\nseñalado en el artículo 202 inciso K del Decreto Ejecutivo Nº 40548-MINAE. Para su presentación en\nel VUCE, se recibirá como válido por parte del SINAC dicho certificado en formato digital, con la\nrespectiva firma digital emitida por una autoridad certificadora registrada, para lo cual, el\nregente autorizado deberá contar con la firma digital personal. Para la presentación en el VUCE, el\nformulario de certificado de origen que deberá utilizarse es el establecido en el Anexo 2 de la\npresente resolución.\n\n8. Autorización de comercialización de los especímenes de interés,\nproductos o subproductos emitida por parte del Área de Conservación, para\ncuando se trate de especies declaradas en peligro de extinción, con población\nreducida o incluidas en el Apéndice I y II de CITES. Según lo establecido en el\nartículo 112 del Decreto Ejecutivo Nº 40548-MINAE.\n\n9. Visto bueno del Área de Conservación para la exportación de especímenes\nde fauna silvestre declarada como silvestre por su país de origen y no\nincluidas en los apéndices de CITES. As wildlife\nis an element of biodiversity, which is a priority and substantive element,\nits importance is unquestionable, due to its intrinsic value and its contributions to\nachieving a healthy and ecologically balanced environment, as well as its\nfundamental role in the economy and development of this country.\n\n2°-That Article 16 of the General Law of Public Administration\nestablishes that the acts of the Administration must be issued in accordance with\nthe unequivocal rules of science, technique, and elementary principles of\njustice, logic, or convenience.\n\n3°-That for all legal purposes in accordance with Law 8454, the digital\nsignature issued by a registered certification authority has the legal\nequivalence of a handwritten signature, according to Article 4 which states:\n\"Article 4º-Legal Qualification and Probative Force. Electronic\ndocuments shall be classified as public or private, and shall be recognized as having probative\nforce under the same conditions as physical documents.\" In\naccordance with Article 8 of Law No. 8220, the interested party requiring a procedure may not be asked\nfor the presentation of certifications or copies of information already held by another institution,\naccording to the pre-established legal means.\n\n4°-That the Wildlife Conservation Law of October 30, 1992,\nhas the purpose of establishing regulations on wildlife,\nstandardizing its conservation and management. Article 3 declares the public domain of\nwildlife fauna, and Article 4 declares the production, management, extraction and\ncommercialization, industrialization and use of the genetic material of wild\nflora and fauna, their parts, products and subproducts, to be of public interest and\nnational patrimony, subject to state regulation.\n\n5°-That Article 12 of the Wildlife Conservation Law empowers\nthe Executive Branch to establish, through the Regulation of this Law, the\nprocedures and requirements necessary for the conservation of\ncontinental or insular, aquatic or terrestrial wildlife, throughout the national\nterritory.\n\n6°-That through Law 9106 of December 20, 2012, the Wildlife Conservation\nLaw was amended. This amendment was promoted by popular initiative, integrating significant changes in\nthe country's vision and paradigm regarding wildlife, including the procedures related\nto import and export permits for wildlife organisms, their parts, products, and\nderivatives.\n\n7°-That through Law No. 7638, the Ministry of Foreign Trade\nand the Foreign Trade Promoter are created, and in its Article 8, subsection c), the\nresponsibility of PROCOMER is indicated to administer a single-window system for\nforeign trade, which centralizes and streamlines import and\nexport procedures. It additionally establishes that the public institutions that\nintervene in such procedures will be obliged to provide their collaboration to\nthe Promoter.\n\n8°-That for the export and import procedures that the National\nSystem of Conservation Areas must process, it will be based on compliance\nwith Article 2, subsection d) of Executive Decree No. 33452, called the Regulation\nof the Single Window System for Foreign Trade.\n\n9°-That the National Council of Conservation Areas (CONAC) needs to\npublish the Guideline for the automation of export procedures\nfor commercial purposes of wildlife specimens, originating from management\nsites authorized by the National System of Conservation Areas (SINAC),\nwith the purpose that the Administration and other parties involved in the\nexport procedure for wildlife specimens from Costa Rica, have\nstandardized procedures for the sustainable use of wildlife\nin the various Subregional Offices of the National System of Conservation\nAreas.\n\n10.-That the National Council of Conservation Areas (CONAC) in Agreement No.\n13 of the Ordinary Session No. 4-2021, held on April 13, 2021, agreed\nto publish the Guideline for the automation of export procedures\nfor commercial purposes of wildlife specimens, originating from management\nsites authorized by the National System of Conservation Areas (SINAC).\nTherefore,\n\nTHE NATIONAL COUNCIL OF CONSERVATION AREAS\n\nOF THE NATIONAL SYSTEM OF CONSERVATION AREAS\n\nIssues the present guideline for the automation of\nexport procedures for commercial purposes of wildlife\nspecimens, their parts or derivatives originating from management sites authorized\nby the National System of Conservation Areas (SINAC)\n\nI.-Introduction\n\nThe present guideline is a document that must be clear to the\nAdministration and other parties involved in the sustainable use of wildlife\nin Costa Rica, in order to standardize the procedures for the\nexport process for commercial purposes of wildlife specimens by\nthe Conservation Areas of the National System of Conservation Areas\n(SINAC).\n\nThis guideline regulates the automation of export procedures\nfor commercial purposes of wildlife specimens, their parts or derivatives\noriginating from management sites authorized by the National System of\nConservation Areas (SINAC).\n\nII.-Legal Aspects of Wildlife Management in Costa Rica\n\nArticle 14 of Executive Decree No. 40548-MINAE, Regulation to the\nWildlife Conservation Law, establishes the requirements for processing\nrequests for the export of wildlife specimens, their parts or\nderivatives for commercial purposes, however, it is very important to take advantage of the\nautomation processes of the export and import platforms\ncarried out in the country.\n\nDue to the\nautomation process of the export permits to be granted, SINAC\ndevelops this guideline to take advantage of the benefits of the\nSingle Window System for Foreign Trade (VUCE) of PROCOMER. SINAC will use, as\nof the publication of this resolution, the system in force according to the\nversion and officialization thereof by PROCOMER. For this, the exporter\nmust have the corresponding digital signature, whether at a personal level or from the\nauthorized legal representative, so that they can carry out the relevant\nprocedure.\n\nIn accordance with\nArticles 14, 112, 116, 181, 182, 169 and 202 of Executive Decree No.\n40548-MINAE, SINAC will receive as a technical document for the\nexport procedure the certificate of origin indicated in Article 202, subsection K of the\nsame decree. For its presentation in the VUCE, said certificate will be received as valid by\nSINAC in digital format, with the respective\ndigital signature issued by a registered certification authority, for which purpose, the\nauthorized regent must have a personal digital signature.\n\nIII.-General guidelines for the export procedure for commercial\npurposes of wildlife specimens originating from management sites\nauthorized by SINAC.\n\nThe interested party must submit:\n\n1. Application form duly completed and digitally signed in the\ncurrent VUCE System. According to Annex 1 of this resolution.\n\n2. In the event that the applicant is a foreigner without national\nidentification, they must provide in the VUCE System a certified copy of their current\npassport. For these purposes, the certified copy will be received with a digital signature.\n\n3. In the event that the applicant is a legal entity, they must provide in\nthe VUCE System a certification of legal standing issued no more than three\nmonths prior. For these purposes, the certification will be received\nwith a digital signature.\n\n4. In the case of recognized occupants of lands under the administration of\nINDER, who are going to export wildlife specimens, their\nparts or derivatives, the application must include the final agreement of the\nInstitute's Board of Directors, in which the applicant is authorized to carry out the\nactivity intended to be developed. Said digitally signed authorization\nmust be provided in the VUCE System.\n\n5. When the export is intended to be carried out by a person other than the\nproperty owner, a legally valid document must be submitted\ndemonstrating that the applicant has the express authorization of the owner\nor sufficient powers to carry out the intended activity. Said\ndigitally signed authorization must be provided in the VUCE System.\n\n6. Be up to date with their obligations as an employer or have a certification of non-employer\nstatus issued by the CCSS in accordance with Article 74 of the Constitutive Law of\nthe CCSS, No. 17. The SINAC official will generate the SICERE Certification\nand provide it to the VUCE for the digital file.\n\n7. Technical document, which in the case of exports will be the certificate of origin\nindicated in Article 202, subsection K of Executive Decree No. 40548-MINAE. For its presentation in\nthe VUCE, said certificate will be received as valid by SINAC in digital format, with the\nrespective digital signature issued by a registered certification authority, for which purpose, the\nauthorized regent must have a personal digital signature. For the presentation in the VUCE, the\ncertificate of origin form that must be used is the one established in Annex 2 of the\npresent resolution.\n\n8. Commercialization authorization for the specimens of interest,\nproducts, or subproducts issued by the Conservation Area, for\nwhen it concerns species declared in danger of extinction, with reduced\npopulations, or included in Appendices I and II of CITES. As established in\nArticle 112 of Executive Decree No. 40548-MINAE.\n\n9. Approval (Visto Bueno) of the Conservation Area for the export of\nwildlife fauna specimens declared as wild by their country of origin and\nnot included in the CITES appendices. When applicable.\n\nIV.-Effective from its Publication in the Official Gazette La\nGaceta.\n\nLet it be published." }
