Las áreas delimitadas constituyen manglares y esteros que, por mandato legal, forman parte del patrimonio nacional y son bienes inalienables e imprescriptibles del Estado. La base técnica del aviso incluye levantamientos topográficos y certificaciones emitidas por el Área de Conservación Osa (ACOSA) del SINAC, que clasificaron estos terrenos como Patrimonio Natural del Estado de conformidad con el Decreto Ejecutivo N° 36786-MINAET.   "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 05\n\n                        Delimitación de la zona pública correspondiente al estero-manglar preciosa y\nplatanares, Puerto Jiménez, Golfito, Puntarenas\n\nINSTITUTO GEOGRÁFICO NACIONAL\n\nDEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN\n\nDEL TERRITORIO\n\nAVISO N° 2021-05\n\nZONA MARÍTIMO TERRESTRE\n\nDelimitación de la Zona Pública Correspondiente\n\nal Estero-Manglar Preciosa y Platanares,\n\nPuerto Jiménez, Golfito, Puntarenas.\n\nCon fundamento en lo dispuesto en los artículos 140 y 240\nde la ley N° 6227 Ley General de la Administración Pública de fecha 2 de\nmayo de 1978; ley N° 59 Ley de Creación y Organización del Instituto\nGeográfico Nacional del 4 de julio de 1944; ley N° 8905 Reforma del\nartículo 2 de la ley N° 5695, Creación del Registro Nacional, y sus reformas; y\nmodificación de la ley N° 59, Creación y Organización del Instituto Geográfico\nNacional, de 4 de julio de 1944, y sus reformas de fecha 7 de diciembre del\n2010; ley N° 6043 Ley sobre la Zona Marítimo Terrestre del 2 de marzo de\n1977, con su respectivo reglamento y; artículos 2 y 3 de la ley N° 5695 Ley\nde Creación del Registro Nacional de fecha 28 de mayo de 1975 y sus\nreformas.\n\nConsiderando:\n\n1º-Que mediante ley N° 8905 se establece el Instituto\nGeográfico Nacional, en adelante IGN, como una dependencia del Registro\nNacional, quien suscribirá los contratos y convenios necesarios para el\nejercicio de sus funciones. Asimismo, de conformidad con la ley N° 59, el IGN es\nla dependencia científica y técnica rectora de la cartografía nacional,\ndestinada a la ejecución del Mapa básico oficial y la Descripción básica\ngeográfica de la República de Costa Rica y a los estudios, las investigaciones\no labores y el desarrollo de políticas nacionales de carácter cartográfico,\ngeográfico, geodésico, geofísico y de índole similar que tenga relación con\ndichas obras, con el fin de apoyar los procesos de planificación.\n\n2º-Que la ley N° 59 constituye al IGN de manera permanente y en\nrepresentación del Estado, como la autoridad oficial en materia geodésica y de\nla representación espacial de la geografía de Costa Rica, extendiéndose su\nautoridad a las actividades de cualquier orden que tengan por origen los\ntrabajos confiados a su cargo.\n\n3º-Que de conformidad con la ley N° 59; el artículo 62 del Decreto\nEjecutivo N° 7841-P denominado Reglamento a la Ley sobre la Zona Marítimo\nTerrestre se reconoce la competencia del IGN para la delimitación de la\nzona pública  de la Zona Marítimo\nTerrestre, y su oficialización a través de publicación en el Diario Oficial La\nGaceta; el artículo 63 del Decreto Ejecutivo N° 7841-P señala que El\nInstituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de\ncada porción de la zona marítimo-terrestre en que haya demarcado la zona\npública.\n\n4º-Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre, del 28 de junio del 2011, de conformidad con los artículos 18,\n19 y 20 establece que los tipos de delimitación de la zona pública de la Zona\nMarítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución a\nsaber: a) delimitación a través de la colocación de mojones y; b) delimitación\ndigital georreferenciada, que es una metodología que permite la\ngeorreferenciación de la pleamar ordinaria, a partir de coordenadas en el\nsistema de referencia oficial del país, establecido por el Decreto Ejecutivo N°\n33797-MJ-MOPT titulado Declara como datum\nhorizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de\nReferencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la\nTierra (IERS) para la época de medición 2005.83, sin que sea necesario la\ncolocación de mojones, con el fin de agilizar las delimitaciones y proporcionar\nmayor seguridad técnica a los interesados.\n\n5º-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros\naspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05,\ny su proyección cartográfica asociada CRTM05, como el sistema oficial al cual\ndeben estar referidas las coordenadas de todos los trabajos geodésicos,\ncartográficos y catastrales que se ejecuten en nuestro país, señalando\nespecíficamente en su artículo 11 que La Red Geodésica Nacional de\nReferencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05,\nconstituirán el único sistema oficial de coordenadas para la República de Costa\nRica a partir del cual se debe referenciar todos los levantamientos y\nactividades cartográficos y geodésicos que desarrollen en el Territorio\nNacional toda dependencia pública, persona o entidad privada nacional o\nextranjera que emprendan o contraten trabajos geodésicos y cartográficos,\ncontribuyéndose de esta forma a evitar el gasto público y obteniendo por otra\nparte información geográfica confiable, uniforme y comparable que sea de\nutilidad general y que apoye la toma de decisiones en los distintos niveles del\nEstado.; mientras que el artículo 7 indica que Conforme se produzcan datos\ncartográficos en el nuevo sistema de proyección cartográfica CRTM05, el\nInstituto Geográfico Nacional publicará por los medios adecuados aquella\ninformación que se ha oficializado.\n\n6º-Que el Decreto Ejecutivo N° 40962-MJP Actualización del Sistema\nGeodésico de Referencia Horizontal Oficial para Costa Rica declara en su\nartículo 1 que El sistema geodésico de referencia horizontal oficial para\nCosta Rica, denominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), para la época de\nmedición 2014.59, y en adelante, los cambios y su actualización, se regirán de\nacuerdo a las nuevas definiciones del ITRF que se implementen en la red\ncontinental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS)\ndenominada SIRGAS-CON, mientras que el artículo 2 establece que El\nsistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la\nrepresentación cartográfica del territorio nacional continental, extendido para\nefectos de aplicación de esta proyección cartográfica, hasta la línea de base\ndel mar territorial en el océano Pacífico y el mar Caribe, definida esta línea\nconforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre\nel Derecho del Mar, como punto de partida para el cómputo de la anchura máxima\nde todas las áreas marinas jurisdiccionales del Estado costarricense.\n\nPor su parte, el artículo 12 del decreto de cita, refuerza la aplicación de\nla proyección cartográfica CRTM05 como el sistema nacional de coordenadas\noficial a la cual se deben referenciar en el territorio continental de nuestro\npaís, al señalar que \"El sistema de referencia horizontal CRSIRGAS y su\nproyección cartográfica asociada CRTM05 para el territorio continental\nextendido hasta la línea de base del mar territorial y, la proyección cartográfica\n\"Universal Transversal de Mercator\" (U'TM),\nzonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano\nPacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas\npara Costa Rica, a partir del cual, se deben referenciar todos los\nlevantamientos y actividades cartográficos y geodésicos que desarrollen en el\nterritorio nacional toda dependencia pública, persona o entidad privada,\nnacional o extranjera, que emprendan o contraten trabajos geodésicos y\ncartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra\nparte, información geográfica confiable, uniforme y comparable, que sea de\nutilidad general y que apoye la toma de decisiones.\"\n\n7º-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n8º-Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona\nMarítimo Terrestre que posee el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del\nIGN sobre la Zona Marítimo Terrestre.\n\n9º-Que la GDG del IGN sobre la Zona Marítimo Terrestre se fundamenta\ntécnicamente en aplicación de la regulación establecida por: a) el\nDecreto Ejecutivo N° 7841-P; b) el Decreto Ejecutivo N° 33797-MJ-MOPT y;\nc) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET, todos previamente\ncitados.\n\n10.-Que la ley N° 7575 denominada Ley Forestal de 1996 en su\nartículo 16 establece que el Ministerio del Ambiente y Energía delimitará en el\nterreno, los linderos de las áreas que conforman el Patrimonio Natural del\nEstado.\n\n11.-Que la ley N° 6043 establece en su artículo 1 del CAPÍTULO I,\nDisposiciones Generales que La zona marítimo terrestre constituye parte del\npatrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su\nprotección, así como la de sus recursos naturales, es obligación del Estado, de\nsus instituciones y de todos los habitantes del país. Su uso y aprovechamiento\nestán sujetos a las disposiciones de esta ley.\n\n12.-Que según el artículo 11 de la referida ley N° 6043, establece que la Zona\npública es también, sea cual fuere su extensión, la ocupada por todos los\nmanglares de los litorales continentales e insulares y esteros del territorio\nnacional.\n\n13.-Que el Decreto Ejecutivo N° 36786-MINAET titulado Manual para la\nclasificación de tierras dedicadas a la conservación de los recursos naturales\ndentro de la Zona Marítimo Terrestre en Costa Rica publicado en La\nGaceta N° 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar\ndentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como\nbosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares,\nesteros, rías, marismas, lagunas costeras, pantanos, bosques anegados,\nsalitrales), para certificarlos e incorporarlos como parte del Patrimonio\nNatural del Estado (PNE).\n\n14.-Que el Decreto Ejecutivo N° 36786-MINAET en el punto III.-Competencias\npara la delimitación y certificación establece que La clasificación\nde los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC)\ndel Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales\nprivados debidamente acreditados por los Colegios Profesionales respectivos\npara que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase\nVII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos,\nbosques anegados, salitrales) y humedales.\n\nLa\nvalidez de los documentos de clasificación emitidos por profesionales privados\nquedará sujeta a la aprobación que emita el AC que por competencia territorial\nle corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá,\nademás, la verificación, fiscalización, deslinde y certificación de las tierras\ndel Patrimonio Natural del Estado y las zonas de protección.\n\nLa\nubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro\nde la Zona Marítimo Terrestre, debe realizarse como parte del proceso de\naprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que\nel Plan Regulador Costero es el instrumento de ordenamiento territorial, que\ndefine y ubica todas las zonas a concesionar dentro de la ZMT y para la\nclasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan\nRegulador Costero debe indicar clara y expresamente, las áreas del PNE para no\ncontabilizarlas en el área total a concesionar.\n\n15.-Que el oficio SINAC-ACOSA-PNE-AD-036-2019 de fecha 30 de\nenero del 2020 suscrito por la Licda. Ginette Jiménez\nSoto, encargada Programa Regional de PNE, y el Ing. Roberto Martínez Fernández,\nIngeniero Topógrafo del Programa Regional de PNE del Área de Conservación Osa,\ncorresponde al Informe de levantamiento topográfico de áreas de estero y\nmanglar en Playa Preciosa y Platanares, Puerto Jiménez, Golfito, con la información\ntécnica del trabajo de levantamiento realizado mediante la delimitación digital\ngeorreferenciado de cada porción de manglar y estero.\n\n16.-Que mediante el oficio SINAC-ACOSA-D-063-2020 de fecha 21 de febrero del 2020 suscrito por la\nLicda. Laura Rivera Quintanilla, directora a.i., del Área de Conservación Osa se hace entrega al IGN\nel levantamiento topográfico de áreas estero y manglar ubicadas en el sector de Preciosa y\nPlatanares, Puerto Jiménez, Golfito, Puntarenas, según la metodología establecida en el Decreto\nEjecutivo N° 35803-MINAET para proceder a realizar la respectiva oficialización de la zona pública\nde la Zona Marítimo Terrestre correspondiente a la delimitación digital realizada del estero y\nmanglar.\n\n17.-En los informes SINAC-ACOSA-PNE-AD-168-2019 de fecha 25 de julio de 2019 y el SINAC-ACOSA-PNE-\nAD-192-2019 de fecha 12 de agosto de 2019 (adendum), suscrito por la Licda. Ginette Jiménez Soto,\nencargada Programa Regional de PNE, y el Ing.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text Standard 05\n\n                        Delimitation of the public area corresponding to the Preciosa and\nPlatanares estuary-mangrove, Puerto Jiménez, Golfito, Puntarenas\n\nINSTITUTO GEOGRÁFICO NACIONAL\n\nDEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN\n\nDEL TERRITORIO\n\nNOTICE No. 2021-05\n\nZONA MARÍTIMO TERRESTRE\n\nDelimitation of the Public Area Corresponding\nto the Preciosa and Platanares Estuary-Mangrove,\nPuerto Jiménez, Golfito, Puntarenas.\n\nBased on the provisions set forth in Articles 140 and 240\nof Law No. 6227, Ley General de la Administración Pública, dated May 2,\n1978; Law No. 59, Ley de Creación y Organización del Instituto\nGeográfico Nacional, dated July 4, 1944; Law No. 8905, Reforma del\nartículo 2 de la ley N° 5695, Creación del Registro Nacional, and its amendments; and\nmodification of Law No. 59, Creación y Organización del Instituto Geográfico\nNacional, dated July 4, 1944, and its amendments dated December 7,\n2010; Law No. 6043, Ley sobre la Zona Marítimo Terrestre, dated March 2,\n1977, with its respective regulation; and Articles 2 and 3 of Law No. 5695, Ley\nde Creación del Registro Nacional, dated May 28, 1975, and its\namendments.\n\nConsidering:\n\n1º-That Law No. 8905 establishes the Instituto\nGeográfico Nacional, hereinafter IGN, as a unit of the Registro\nNacional, which shall enter into the contracts and agreements necessary for the\nexercise of its functions. Likewise, pursuant to Law No. 59, the IGN is\nthe scientific and technical unit governing national cartography,\nresponsible for the execution of the official Basic Map and the basic geographic\nDescription of the Republic of Costa Rica, and for the studies, investigations,\nor labors and the development of national policies of a cartographic,\ngeographic, geodetic, geophysical, and similar nature related to\nsaid works, in order to support planning processes.\n\n2º-That Law No. 59 permanently establishes the IGN, in\nrepresentation of the State, as the official authority in geodetic matters and\nthe spatial representation of the geography of Costa Rica, its authority\nextending to activities of any nature originating from the\ntasks entrusted to its charge.\n\n3º-That in accordance with Law No. 59; Article 62 of Decreto\nEjecutivo N° 7841-P, titled Reglamento a la Ley sobre la Zona Marítimo\nTerrestre, recognizes the competence of the IGN for the delimitation of the\npublic area of the Zona Marítimo\nTerrestre, and its officialization through publication in the official gazette La\nGaceta; Article 63 of Decreto Ejecutivo N° 7841-P states that The\nInstituto Geográfico Nacional shall publish a notice in the official gazette, for\neach portion of the zona marítimo-terrestre in which it has demarcated the public\narea.\n\n4º-That in Decreto Ejecutivo N° 36642-MP-MOPT-MINAET, Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre, dated June 28, 2011, in accordance with Articles 18,\n19, and 20, it establishes the types of delimitation of the public area of the Zona\nMarítimo Terrestre; the IGN may use two methodologies for implementation, namely: a) delimitation through the placement of boundary markers (mojones) and; b) georeferenced digital delimitation, which is a methodology that allows the\ngeoreferencing of the ordinary high-water mark (pleamar ordinaria), based on coordinates in the\nofficial reference system of the country, established by Decreto Ejecutivo N°\n33797-MJ-MOPT, titled Declara como datum\nhorizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de\nReferencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la\nTierra (IERS) para la época de medición 2005.83, without the need for\nthe placement of boundary markers (mojones), in order to expedite delimitations and provide\ngreater technical certainty to interested parties.\n\n5º-That in Decreto Ejecutivo N° 33797-MJ-MOPT, which, among other\naspects, determines the Red Geodésica Nacional de Referencia Horizontal CR05,\nand its associated cartographic projection CRTM05, as the official system to which\nthe coordinates of all geodetic,\ncartographic, and cadastral works carried out in our country must be referenced, specifically\nstating in its Article 11 that The Red Geodésica Nacional de\nReferencia Horizontal CR05 and the CRTM05 cartographic projection system\nshall constitute the single official coordinate system for the Republic of Costa\nRica, to which all cartographic and geodetic surveys and activities developed within the National\nTerritory by any public entity, private person, or national or\nforeign entity that undertake or contract geodetic and cartographic\nworks must be referenced,\nthus contributing to the avoidance of public spending and, on the other\nhand, obtaining reliable, uniform, and comparable geographic information that is of\ngeneral utility and supports decision-making at the different levels of the\nState; whereas Article 7 states that As cartographic\ndata are produced in the new CRTM05 cartographic projection system, the\nInstituto Geográfico Nacional shall publish, through appropriate means, that\ninformation which has been officialized.\n\n6º-That Decreto Ejecutivo N° 40962-MJP, Actualización del Sistema\nGeodésico de Referencia Horizontal Oficial para Costa Rica, declares in its\nArticle 1 that The official horizontal geodetic reference system for\nCosta Rica, named CR05 and its materialization through the Red Geodésica\nNacional, changes its acronym to CRSIRGAS, as the official horizontal reference\nsystem for the Republic of Costa Rica, linked to the Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), for the measurement epoch\n2014.59, and henceforth, its changes and updating shall be governed\naccording to the new ITRF definitions implemented in the continental\nnetwork of the Sistema de Referencia Geocéntrico para las Américas (SIRGAS),\ncalled SIRGAS-CON, while Article 2 establishes that The\nCRTM05 cartographic projection system shall continue to be the official one for the\ncartographic representation of the continental national territory, extended for\nthe purposes of applying this cartographic projection, up to the baseline\nof the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined\nin accordance with Articles 5, 6, and 7 of the United Nations Convention on\nthe Law of the Sea, as the starting point for calculating the maximum width\nof all jurisdictional marine areas of the Costa Rican State.\n\nIn turn, Article 12 of the cited decree reinforces the application of\nthe CRTM05 cartographic projection as the official national coordinate\nsystem to which all surveys must be referenced in the continental territory of our\ncountry, by stating that \"The CRSIRGAS horizontal reference system and its\nassociated cartographic projection CRTM05 for the continental territory\nextended to the baseline of the territorial sea, and the cartographic projection\n\"Universal Transversal de Mercator\" (UTM),\nzones 16 and 17 for the jurisdictional marine and insular areas in the\nPacific Ocean and the Caribbean Sea, shall constitute the single official coordinate system\nfor Costa Rica, to which\nall cartographic and geodetic surveys and activities developed within the\nnational territory by any public entity, private person, or\nnational or foreign entity that undertake or contract geodetic and\ncartographic works must be referenced, contributing to the avoidance of public spending and obtaining, on the other\nhand, reliable, uniform, and comparable geographic information that is of\ngeneral utility and supports decision-making.\"\n\n7º-That georeferencing to the national coordinate system as\na mechanism for delimiting the public area of the Zona Marítimo Terrestre\nenables the correct delimitation of the public area for the purposes of\nthe preparation of regulatory plans (planes reguladores), the approval of survey plans (planos de agrimensura), the\ngranting of concessions in the restricted area (Zona Restringida), and other aspects of\ncoastal territorial planning (ordenamiento territorial costero).\n\n8º-That the georeferenced digital information on the delimitation of the public area of the Zona\nMarítimo Terrestre held by the IGN is called the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the\nIGN on the Zona Marítimo Terrestre.\n\n9º-That the GDG of the IGN on the Zona Marítimo Terrestre is technically based\non the application of the regulations established by: a)\nDecreto Ejecutivo N° 7841-P; b) Decreto Ejecutivo N° 33797-MJ-MOPT; and\nc) Decreto Ejecutivo N° 36642-MP-MOPT-MINAET, all previously\ncited.\n\n10.-That Law No. 7575, titled Ley Forestal of 1996, in its\nArticle 16, establishes that the Ministerio del Ambiente y Energía shall delimit on the\nground the boundaries of the areas that make up the Patrimonio Natural del\nEstado.\n\n11.-That Law No. 6043 establishes in its Article 1 of CHAPTER I,\nDisposiciones Generales, that The zona marítimo terrestre constitutes part of the\nnational patrimony, belongs to the State, and is inalienable and imprescriptible. Its\nprotection, as well as that of its natural resources, is the obligation of the State,\nof its institutions, and of all the inhabitants of the country. Its use and exploitation\nare subject to the provisions of this law.\n\n12.-That according to Article 11 of the aforementioned Law No. 6043, it establishes that the Public\nArea (Zona pública) is also, whatever its extent may be, that occupied by all\nmangroves of the continental and insular coastlines and estuaries (esteros) of the national\nterritory.\n\n13.-That Decreto Ejecutivo N° 36786-MINAET, titled Manual para la\nclasificación de tierras dedicadas a la conservación de los recursos naturales\ndentro de la Zona Marítimo Terrestre en Costa Rica, published in La\nGaceta No. 217 of November 11, 2011, establishes among its objectives, to Identify\nwithin the Zona Marítimo Terrestre those lands that classify as\nforests, of forest aptitude (Class VII and VIII soils), wetlands (mangroves,\nestuaries (esteros), rias, salt marshes (marismas), coastal lagoons, swamps,\nflooded forests, salt flats (salitrales)), in order to certify them and incorporate them as part of the Patrimonio Natural\ndel Estado (PNE).\n\n14.-That Decreto Ejecutivo N° 36786-MINAET, in point III.-Competencias\npara la delimitación y certificación, establishes that The classification\nof lands within the ZMT shall correspond to the Áreas de Conservación (AC)\nof the Sistema Nacional de Áreas de Conservación (SINAC) and to private professionals\nduly accredited by the respective Professional Associations (Colegios Profesionales)\nto classify forests, forest aptitude lands (Class\nVII and VIII soils), (mangroves, estuaries (esteros), rias, salt marshes (marismas), coastal lagoons, swamps,\nflooded forests, salt flats (salitrales)), and wetlands.\n\nThe\nvalidity of the classification documents issued by private professionals\nshall be subject to the approval issued by the AC with the corresponding territorial\njurisdiction. The ACs of SINAC with jurisdiction over the ZMT shall also have the responsibility\nfor the verification, inspection (fiscalización), demarcation (deslinde), and certification of the lands\nof the Patrimonio Natural del Estado and the protection zones.\n\nThe\nlocation and delimitation of the areas of the Patrimonio Natural del Estado within\nthe Zona Marítimo Terrestre must be carried out as part of the\napproval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since\nthe Coastal Regulatory Plan is the territorial planning instrument (instrumento de ordenamiento territorial) that\ndefines and locates all the areas to be concessioned within the ZMT and for\nthe classification thereof at the level of cadastral plans (planos de catastro). Therefore, the Coastal\nRegulatory Plan must clearly and expressly indicate the PNE areas so that they are not\ncounted in the total area to be concessioned.\n\n15.-That official letter SINAC-ACOSA-PNE-AD-036-2019, dated January\n30, 2020, signed by Licda. Ginette Jiménez\nSoto, head of the PNE Regional Program, and Ing. Roberto Martínez Fernández,\nSurveying Engineer (Ingeniero Topógrafo) of the PNE Regional Program of the Área de Conservación Osa,\ncorresponds to the Informe de levantamiento topográfico de áreas de estero y\nmanglar in Playa Preciosa and Platanares, Puerto Jiménez, Golfito, with the technical\ninformation of the survey work carried out through the georeferenced digital delimitation\nof each mangrove and estuary (estero) portion.\n\n16.-That through official letter SINAC-ACOSA-D-063-2020, dated February 21, 2020, signed by\nLicda. Laura Rivera Quintanilla, acting director of the Área de Conservación Osa, the\ntopographic survey of the estuary (estero) and mangrove areas located in the Preciosa sector and\nPlatanares, Puerto Jiménez, Golfito, Puntarenas, is delivered to the IGN,\naccording to the methodology established in Decreto\nEjecutivo N° 35803-MINAET, in order to proceed with the respective officialization of the public area\nof the Zona Marítimo Terrestre corresponding to the digital delimitation carried out for the estuary (estero) and\nmangrove.\n\n17.-In reports SINAC-ACOSA-PNE-AD-168-2019 dated July 25, 2019, and SINAC-ACOSA-PNE-\nAD-192-2019 dated August 12, 2019 (addendum), signed by Licda. Ginette Jiménez Soto,\nhead of the PNE Regional Program, and Ing. Roberto Martínez Fernández, Surveying Engineer (Ingeniero Topógrafo) of the\nPNE Regional Program of the Área de Conservación Osa, the technical information is described regarding the\ncharacterization, identification, and delimitation of the estuary (estero) and mangrove ecosystems digitally delimited\nin the Preciosa sector, Platanares, Puerto Jiménez, Golfito, Puntarenas, and which\ncorrespond to a correction and modification of the areas to be officialized.\n\n18.-Through certifications SINAC-ACOSA-D-CERT-022-2019 of\nAugust nineteen, 2019, and SINAC-ACOSA-PNE-044-2019 of\nAugust nineteen, 2019, the estuary (estero) and mangrove areas of the\nPreciosa and Platanares sector in Puerto Jiménez, Golfito, Puntarenas, are delimited, which\nform part of the Patrimonio Nacional del Estado.\n\n19.-That the georeferenced digital delimitation of the estuary (estero)\nand mangrove portions in the Preciosa and Platanares sector, Puerto Jiménez, Golfito,\nPuntarenas, carried out by the Área de Conservación Osa, has technical endorsement\npursuant to official letter DIG-TOT-0075-2021 of February 16, 2021, issued\nby the Subproceso de Límites Oficiales of the Departamento Topográfico y\nObservación del Territorio of the IGN.\n\n20.-That Article 140 of Law No. 6227 states that The administrative\nact shall produce its effect after it has been communicated to the administered party, except\nif it grants only rights, in which case it shall produce it from the moment it is\nadopted, a provision that must necessarily be related to Article\n240 of the same normative body, which defines the suitable instrument for\ncommunicating acts of a generic nature by stating that General acts shall be communicated\nby publication and specific ones by notification.\n\nCommunicates:\n\nFirst.-The IGN publishes in the Preciosa and\nPlatanares sector the estuary (estero) and mangrove portions, located in district 02\nPuerto Jiménez, canton 07 Golfito, province 06 Puntarenas,\nby means of the methodology used and validated by the Área de Conservación Osa\n(ACOSA) to delimit the public area of the Zona Marítimo Terrestre through\nthe georeferenced digital delimitation.\n\nSecond.-The public area of the Zona Marítimo Terrestre delimited in the\nPuerto Jiménez sector, located in Preciosa and Platanares, corresponds to the\nestuary (estero) and mangrove portions carried out through the georeferenced digital\ndelimitation, in accordance with Decretos Ejecutivos N° 35803-MINAET and N°\n36786-MINAET.\n\nThird.-The delimitation of the estuary (estero) and mangrove in the sector\nknown as Preciosa and Platanares, Puerto Jiménez, Golfito, Puntarenas, is published,\ncorresponding to the Patrimonio Natural del Estado officialized through\ncertification SINAC-ACOSA-PNE-044-2019 and SINAC-ACOSA-D-CERT-022-2019,\nboth dated August 19, 2019, in accordance with reports SINAC-ACOSA-PNE-AD-168-2019,\nSINAC-ACOSA-PNE-AD-192-2019, and SINAC-ACOSA-PNE-AD-036-2019.\n\nFourth.-The official technical data of the georeferenced digital delimitation of the public area\nof the Zona Marítimo Terrestre of the estuary-mangrove sector located in Preciosa-Platanares, district\n02 Puerto Jiménez, canton 07 Golfito, province 06 Puntarenas, have been recorded in the\nDigital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the IGN on the Zona Marítimo Terrestre (ZMT), in a\nfile in vector shape format, under the code: RN/IGN_GDG-IGN-ZMT digital lines.\n\nFifth: It takes effect as of its publication.\n\nDone in Curridabat, San José, on the 26th day of August of the year 2021."
