Técnica, hecho\nen San José, el 23 de julio de 1965, aprobado mediante Ley número 3654 del 23\nde diciembre de 1965 y enmendado por sus Protocolos de fecha 13 de marzo de\n1986 y del 18 de diciembre de 2006, establece la facultad de las Partes de\nconcertar Acuerdos especiales referentes a distintos proyectos.\n\n2.- Que el\npresente Acuerdo especial derivado del Convenio de Cooperación Técnica\nmencionado, bajo la modalidad de canje de notas ha sido formalizado con el\ndeseo de fortalecer e intensificar los lazos de amistad y cooperación que\nexisten entre ambos países.\n\n3. Que el\npresente Canje de Notas, conforme con los artículos 121 inciso 4 y 140 inciso\n10 de la Constitución Política, es un protocolo de menor rango derivado del\nConvenio y sus enmiendas mencionadas.\n\nPor\ntanto,\n\nDECRETAN:\n\n\"Promulgación del\npresente Acuerdo bajo la modalidad de Canje de Notas entre la\n\nRepública de Costa Rica\ny la República Federal de Alemania sobre el proyecto\n\n\"Vías\ntransformadoras bajas en emisiones de carbono y resilientes\nal clima en Costa Rica\n\n(Transforma)\".\n\nArtículo\n1.- Promulgar teniendo como vigente para los efectos internos y externos, el\npresente Acuerdo bajo la modalidad de Canje de Notas entre la República de\nCosta Rica y la República Federal de Alemania sobre el proyecto \"Vías\ntransformadoras bajas en emisiones de carbono y resilientes\nal clima en Costa Rica (Transforma)\", cuyo texto literal es el siguiente:\n\n \n\n  \n\nExcelentísima\nSeñora:\n\nTengo el\nhonor de dirigirme o Su Excelencia, en ocasión de hacer referencia a su atento\nnoto Ref.: WZ468.40/15, de fecho 7 de abril de 2021, que dice lo siguiente:\n\n«En cumplimiento del Convenio sobre Cooperación Técnico concertado entre el Gobierno de lo República\nFederal de Alemania y el Gobierno de la República de Costa Rica del 23 de julio de 1965, en lo\nredacción de los Protocolos de Enmiendo del 13 de marzo de 1986 y del 18 de diciembre de 2006, tengo\nel honor de proponer a Vuestro Excelencia, en nombre del Gobierno de la Repúblico Federal de\nAlemania, el siguiente Acuerdo sobre el proyecto \"Vías transformadoras bajos en emisiones de carbono\ny resilientes al clima en Costo Rico (Transforma)\" en el morco de lo Iniciativa Internacional de\nProtección del Clima del Ministerio Federal de Medio Ambiente, Protección de lo Naturaleza y\nSeguridad Nuclear:\n\n1. El\nGobierno de\nla República Federal de Alemania\ny el Gobierno de lo República de Costa Rico fomentarán conjuntamente\nel proyecto \"Vías transformadoras bajos en emisiones de carbono y resilientes al clima\nen Costa Rica (Transforma)\".\n\nsi después de examinado\nresulta susceptible de apoyo.\n\n2. El\nobjetivo del proyecto es contribuir o la protección del clima y al desarrollo\nsostenible en lo República de Costa Rica o través de lo\nconservación y uso sostenible de los ecosistemas marinos.\n\n3. El\nGobierno de /a\nRepública Federal de Alemania facilitará recursos humanos y realizará\nprestaciones materiales y, si procede, aportaciones financieros para el\nproyecto por un monto total de hasta 12 500 000 euros (en letras: doce millones\n\nquinientos mil euros).\n\nConfirmará\nla ejecución del proyecto o lo Deutsche Gesellschaft fur lnternationale Zusommenorbeit (Gil) GmbH.\n\n4. Por\nparte del Gobierno de lo República de Costo Rica será responsable de la\nejecución del proyecto el Ministerio de Ambiente y Energía (MINAE).\n\n5. Los\ndetalles del proyecto y de las prestaciones y obligaciones respectivas\nse fijarán en un contrato de ejecución y, si procede, de financiación\nque habrá de ser concertado entre la GIZ y la Institución o\nla que el Gobierno de la República\n\nde Costa Rica .encargue\nlo ejecución del proyecto y que estará sujeto a las\ndisposiciones legales vigentes en lo República Federal de Alemania.\n\n6. El\ncompromiso del Gobierno de la República Federal de Alemania para\nel proyecto quedará sin efecto si el contrato de ejecución y,\nsi procede, de financiación mencionado en el párrafo 5 no se concierta\nhasta el 31 de diciembre de 2024.\n\n7. El Gobierno\nde la República de Costa Rica eximirá los materiales,\nvehículos, bienes y equipos importados en la República de Costa Rica\npara el proyecto mencionado en el párrafo 1 por encargo y a expensas del Gobierno de la\nRepública Federal de Alemania, así como a los respectivos repuestos\nque se utilicen para el proyecto mencionado en el párrafo 1 de todos los derechos de\nimportación y exportación, así como de licencias, tasas portuarios,\nderechos de almacenaje y demás gravámenes públicos y asegurará\nque pasen aduana sin demoro.\n\n8. El Gobierno de la República\nde Costa Rico eximirá o la\nGIZ de todos los impuestos directos que se devenguen en la República\nde Costa Rica en relación con lo concertación y el cumplimiento del\ncontrato de ejecución y, si procede, de financiación  mencionado en el párrafo 5.\n\n9. El\nGobierno de la República de Costa Rica reembolsará o solicitud de la\nGIZ el impuesto sobre el valor añadido u otros Impuestos indirectos\nsimilares que hayan sido aplicados en la República de Costa\nRica sobre objetos adquiridos y servicios utilizados en relación con la\nconcertación  y el\ncumplimiento del controlo de ejecución y, si procede, de financiación\nmencionado en el párrafo 5. Los impuestos especiales al consumo que\nse hayan aplicado en este contexto serán asumidos por el Gobierno de\nla República de Costa Rica siguiendo una solicitud.\n\n10. El presente\nAcuerdo se aplicará también a ampliaciones, así como a\ncofinanciaciones por parle de otros donantes del proyecto\nespecificado en el párrafo 1 y a futuros proyectos de seguimiento en\ncaso de que ambos Gobiernos deseen continuar el fomento. Los compromisos\ndel Gobierno de la República Federal de Alemania relativos a\nlo concesión de fomento respecto a proyectos de seguimiento y ampliaciones\ndel proyecto se transmitirán mediante comunicado del Gobierno de la República\nFederal de Alemania en el que se hará referencia al\npresente Acuerdo.\n\n11. Por\nlo demás,  se aplicarán también\nal presente Acuerdo las disposiciones del arribo especificado Convenio\nde Cooperación Técnico del 23 de Julio de 1965, en la redacción de\nlos Protocolas de Enmienda del 13 de marzo de 1986 y del 18 de\ndiciembre de 2006.\n\n12. El\nobjetivo del proyecto es contribuir a la protección del clima y al desarrollo\nsostenible en la República de Costa Rica a través de la conservación y uso\nsostenible de los ecosistemas marinos.\n\n3. El\nGobierno de la República Federal de Alemania facilitará recursos humanos y\nrealizará prestaciones materiales y, si procede, aportaciones financieras para\nel\n\n4. proyecto\npor un monto total de hasta 12 500 000 euros (en letras: doce millones\nquinientos mil euros).\n\nConfiará la\nejecución del proyecto a la Deutsche Gesellschaft fur Internationale\nZusammenarbeit (GIZ) GmbH.\n\n5. Por\nparte del Gobierno de la República de Costa Rica será responsable de la\nejecución del proyecto el Ministerio\nde Ambiente y Energía (MINAE).\n\n6. Los\ndetalles del proyecto y de las prestaciones y obligaciones respectivas se\nfijarán en un contrato de ejecución y, si procede, de financiación que habrá de\nser concertado entre la GIZ y la institución a la que el Gobierno de la\nRepública de Costa Rica encargue la ejecución del proyecto y que estará sujeto\na las disposiciones legales vigentes en la República Federal de Alemania.\n\n7. El\nGobierno de la República de Costa Rica eximirá a los materiales, vehículos,\nbienes y equipos importados en la República de Costa Rica para el proyecto\nmencionado en el párrafo 1 por encargo y a expensas del Gobierno de la\nRepública Federal de Alemania, así como a los respectivos repuestos que se\nutilicen para el proyecto mencionado en el párrafo 1 de todos los derechos de\nimportación y exportación, así como de licencias, tasas portuarias, derechos de\nalmacenaje y demás\ngravámenes públicos, y asegurará\nque pasen aduana sin demora.\n\n9, El\nGobierno de la República de Costa Rica eximirá a la GIZ de todos los impuestos\ndirectos que se devenguen en la República de Costa Rica en relación con la\nconcertación y el cumplimiento\ndel contrato de ejecución y, si\nprocede, d financiación mencionado en el párrafo 5.\n\n10. El Gobierno de la República de Costa Rica reembolsará a solicitud de la GIZ el impuesto sobre el\nvalor añadido u otros impuestos indirectos similares que hayan sido aplicados en la República de\nCosta Rica sobre objetos adquiridos y servicios utilizados en relación con la concertación y el\ncumplimiento del contrato de ejecución y, si procede, de financiación mencionado en el párrafo 5.\nLos impuestos especiales al consumo que se hayan aplicado en este contexto serán asumidos por el\nGobierno de la República de Costa Rica siguiendo una solicitud.\n\n11. El presente Acuerdo se aplicara también a ampliaciones, así como a\ncofinanciaciones por parte de otros donantes, del proyecto especificado en el\npárrafo 1 y a futuros proyectos de seguimiento en caso de que ambos Gobiernos\ndeseen continuar el fomento. That this Exchange of Notes, in accordance with Articles 121 subsection 4 and 140 subsection 10 of the Political Constitution, is a protocol of lesser rank derived from the aforementioned Convention and its amendments.\n\nTherefore,\n\nTHEY DECREE:\n\n\"Promulgation of this Agreement under the Exchange of Notes modality between the\nRepublic of Costa Rica and the Federal Republic of Germany regarding the project\n'Low-carbon and climate-resilient transformative pathways\nin Costa Rica (Transforma)'.\n\nArticle 1.- To promulgate, having as in force for internal and external purposes, this Agreement under the Exchange of Notes modality between the Republic of Costa Rica and the Federal Republic of Germany regarding the project \"Low-carbon and climate-resilient transformative pathways in Costa Rica (Transforma)\", whose literal text is as follows:\n\nMadam Ambassador:\n\nI have the honor to address Your Excellency, on the occasion of referring to your attentive note Ref.: WZ468.40/15, dated April 7, 2021, which reads as follows:\n\n\"In compliance with the Convention on Technical Cooperation concluded between the Government of the Federal Republic of Germany and the Government of the Republic of Costa Rica on July 23, 1965, as amended by the Protocols of Amendment of March 13, 1986, and December 18, 2006, I have the honor to propose to Your Excellency, on behalf of the Government of the Federal Republic of Germany, the following Agreement regarding the project 'Low-carbon and climate-resilient transformative pathways in Costa Rica (Transforma)' within the framework of the International Climate Initiative of the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety:\n\n1. On behalf of the Government of the Republic of Costa Rica, the Ministry of Environment and Energy (MINAE) shall be responsible for the execution of the project.\n\n5. The details of the project and the respective inputs and obligations shall be laid down in an execution contract and, where appropriate, financing contract to be concluded between GIZ and the institution tasked by the Government of the Republic\n\nof Costa Rica with the execution of the project, which shall be subject to the legal provisions in force in the Federal Republic of Germany.\n\n6. The commitment of the Government of the Federal Republic of Germany for the project shall lapse if the execution contract and, where appropriate, the financing contract mentioned in paragraph 5 are not concluded by December 31, 2024.\n\n7. The Government of the Republic of Costa Rica shall exempt materials, vehicles, goods, and equipment imported into the Republic of Costa Rica for the project mentioned in paragraph 1 by order and at the expense of the Government of the Federal Republic of Germany, as well as the corresponding spare parts used for the project mentioned in paragraph 1, from all import and export duties, as well as from licenses, port fees, storage charges, and other public levies, and shall ensure their customs clearance without delay.\n\n8. The Government of the Republic of Costa Rica shall exempt GIZ from all direct taxes accruing in the Republic of Costa Rica in connection with the conclusion and performance of the execution contract and, where appropriate, the financing contract mentioned in paragraph 5.\n\n9. The Government of the Republic of Costa Rica shall, at the request of GIZ, reimburse the value-added tax or other similar indirect taxes that may have been levied in the Republic of Costa Rica on objects purchased and services used in connection with the conclusion and performance of the execution contract and, where appropriate, the financing contract mentioned in paragraph 5. Special consumption taxes that may have been levied in this context shall be borne by the Government of the Republic of Costa Rica upon request.\n\n10. This Agreement shall also apply to expansions, as well as to co-financing by other donors of the project specified in paragraph 1 and to future follow-up projects should both Governments wish to continue the promotion. The commitments of the Government of the Federal Republic of Germany regarding the granting of promotion for follow-up projects and project expansions shall be transmitted via communication from the Government of the Federal Republic of Germany, in which explicit reference shall be made to this Agreement.\n\n11.
