Aprobar la reforma a los artículos 15 inciso b),\nartículo 24, artículo 26 inciso b) y artículo 40 incisos d) y e) del Reglamento\nde Prestación de Servicios de Agua Potable, Alcantarillado Sanitario e\nHidrantes, de la Empresa de Servicios Públicos de Heredia Sociedad Anónima\naprobado por la Junta Directiva de esta empresa el 19 de noviembre del año 2019\nmediante acuerdo JD 250-2019 y publicado el 04 de diciembre del 2019 en el\nAlcance N° 270, La Gaceta N° 231; y reforma según acuerdo JD 127-2021 y\npublicado el 09 de julio de 2021 en La Gaceta N° 132 - Reglamentos; se\nreforma para que se apliquen de la siguiente manera:\n\nArtículo 15.-De los requisitos para la solicitud de\ndisponibilidad de servicios\n\nDicha solicitud debe realizarse en la Plataforma de Servicios de la Empresa\nde Servicios Públicos de Heredia o en la oficina regional; para el otorgamiento\nde la disponibilidad de agua potable, el propietario del inmueble deberá\ncumplir con la presentación de los siguientes requisitos\n\na) Solicitud firmada por el dueño de la propiedad indicando claramente el\nnúmero de finca y número de plano catastrado, la naturaleza del proyecto que\npretende desarrollar, el propósito de la certificación de disponibilidad y\nseñalar medio y/o lugar para recibir notificaciones.\n\nb) En caso de persona física, deberá presentar la cédula de identidad o\ndocumento de residencia o pasaporte vigente en caso de ser extranjero, para\nsu verificación.\n\nc) En caso de personas jurídicas, certificación de personería jurídica\nvigente, con un máximo de 30 días de emitida. Tratándose de certificaciones\ndigitales, conforme a la vigencia legal respectiva.\n\nd) Una copia del plano catastrado.\n\ne) Certificación literal de la propiedad (original).\n\nEn caso, que se soliciten más de tres servicios de\ndisponibilidad simultáneos en una misma finca, se deberán acoger a los\nrequisitos que se encuentran regulados en el Reglamento de Dotación de\nServicios a Urbanizaciones, Fraccionamientos y Condominios, extensiones de\nRedes y su Financiamiento, de la Empresa de Servicios Públicos de Heredia,\nSociedad Anónima.\n\nDicha solicitud debe realizarse en la Plataforma de Servicios de la Empresa\nde Servicios Públicos de Heredia o en la oficina regional.\n\nArtículo 24.-De los requisitos para la solicitud de un servicio nuevo de agua potable por parte del\ntitular del inmueble.\n\nDicha solicitud debe realizarse en la Plataforma de Servicios de la Empresa\nde Servicios Públicos de Heredia o en la oficina regional; para el otorgamiento\nde un nuevo servicio, el propietario del inmueble deberá cumplir con la\npresentación de los siguientes requisitos:\n\na) Documento Solicitud de Trámites, disponible en la Plataforma de\nservicios de la ESPH S.A., debidamente completado y firmado por el propietario\nregistral apoderado, o el albacea, según corresponda, así como llenar el\ndocumento: Contrato para la Prestación del Servicio de Acueducto y/o\nAlcantarillado Sanitario entre la Empresa de Servicios Públicos de Heredia S.A.\ny sus abonados (Debe indicar en la Plataforma de Servicios de la ESPH S.A., si\ntambién incluye el servicio de aguas residuales).\n\nb) En caso de persona física, deberá presentar la cédula\nde identidad o documento de residencia vigente.\n\nc) En caso de personas jurídicas, certificación de\npersonería vigente con un máximo de 30 días de emitida. Tratándose de\ncertificaciones digitales, conforme a la vigencia legal respectiva,\nidentificación vigente.\n\nd) Que el solicitante no tenga deudas con la ESPH S.A.\n(Esta condición se verifica a lo interno de la institución).\n\ne) Copia del plano de catastro.\n\nf) Certificación literal de la propiedad (original).\n\ng) Documento Consentimiento informado debidamente firmado,\ndisponible en la Plataforma de Servicios.\n\nh) Cancelación en Plataforma de Servicios de la ESPH S.A., del costo de la\ninstalación del servicio. (Esta condición se\nverifica a lo interno de la institución).\n\ng) En caso, que no pueda presentarse el titular, las firmas del formulario\ny del consentimiento informado deben venir autenticadas por abogado o presentar\nun poder protocolizado.\n\nSi existiere un monto pendiente en el rubro de cuentas\npor cobrar, el propietario del inmueble deberá cancelarlo antes que la ESPH\nS.A. proceda a ejecutar la solicitud.\n\nLa respuesta a esta solicitud se realiza en forma inmediata en la\nplataforma con un plazo máximo de un día de resolución.\n\n2.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 4109\n\n                        Reform of the Regulation for the Provision of Potable Water,\nSanitary Sewerage, and Fire Hydrant Services of the Public Services Company of Heredia\n\nPUBLIC SERVICES COMPANY OF HEREDIA S.A.\n\nThe Board of Directors of the Public Services Company of\nHeredia S.A., in session number four thousand one hundred nine-C dated August ninth\nof the year two thousand twenty-one, in its fourth article, subsection 10, through\nBoard Agreements JD one hundred sixty-four dash two thousand\ntwenty-one, modifies article 15 subsection b), article 24, article 26 subsection b), and\narticle 40 subsections d) and e) of the Regulation for the Provision of Potable Water,\nSanitary Sewerage, and Fire Hydrant Services of the Public Services Company of\nHeredia Sociedad Anónima as follows:\n\nBoard Agreement JD 164-2021\n\n1. To approve the reform to articles 15 subsection b),\narticle 24, article 26 subsection b), and article 40 subsections d) and e) of the Regulation\nfor the Provision of Potable Water, Sanitary Sewerage, and\nFire Hydrant Services of the Public Services Company of Heredia Sociedad Anónima,\napproved by the Board of Directors of this company on November 19 of the year 2019\nthrough board agreement JD 250-2019 and published on December 04, 2019 in\nSupplement No. 270, La Gaceta No. 231; and reform according to board agreement JD 127-2021 and\npublished on July 09, 2021 in La Gaceta No. 132 - Regulations; it is\nreformed so that they are applied in the following manner:\n\nArticle 15.-Of the requirements for the service availability\nrequest\n\nSaid request must be submitted on the Services Platform of the\nPublic Services Company of Heredia or at the regional office; for the granting\nof potable water availability, the property owner must\ncomply with the presentation of the following requirements:\n\na) Request signed by the property owner clearly indicating the\nfarm (finca) number and cadastral map number, the nature of the project\nintended to be developed, the purpose of the availability certification, and\nindicating the means and/or place to receive notifications.\n\nb) In the case of a natural person, the identity card, or\nresidence document, or valid passport in the case of a foreigner, must be presented for\nverification.\n\nc) In the case of legal entities, a valid certification of legal status (personería jurídica),\nissued no more than 30 days prior. In the case of digital certifications,\nin accordance with the respective legal validity.\n\nd) A copy of the cadastral map.\n\ne) Literal certification of the property (original).\n\nIn the event that more than three simultaneous availability\nservices are requested on a single farm (finca), they must adhere to\nthe requirements regulated in the Regulation for the Provision of\nServices to Urbanizations, Subdivisions, and Condominiums, Network\nExtensions, and their Financing, of the Public Services Company of Heredia,\nSociedad Anónima.\n\nSaid request must be submitted on the Services Platform of the\nPublic Services Company of Heredia or at the regional office.\n\nArticle 24.-Of the requirements for the request for a new potable water service by the\nproperty titleholder.\n\nSaid request must be submitted on the Services Platform of the\nPublic Services Company of Heredia or at the regional office; for the granting\nof a new service, the property owner must comply with the\npresentation of the following requirements:\n\na) Transaction Request (Solicitud de Trámites) document, available on the\nServices Platform of ESPH S.A., duly completed and signed by the registered\nowner, authorized representative, or the executor (albacea), as applicable, as well as completing the\ndocument: Contract for the Provision of Aqueduct and/or\nSanitary Sewerage Service between the Public Services Company of Heredia S.A.\nand its subscribers (Must indicate on the Services Platform of ESPH S.A., if\nit also includes the wastewater service).\n\nb) In the case of a natural person, a valid identity card\nor residence document must be presented.\n\nc) In the case of legal entities, a valid legal status (personería)\ncertification, issued no more than 30 days prior, must be presented. In the case of\ndigital certifications, in accordance with the respective legal validity,\nvalid identification.\n\nd) That the applicant has no debts with ESPH S.A.\n(This condition is verified internally by the institution).\n\ne) Copy of the cadastral map.\n\nf) Literal certification of the property (original).\n\ng) Duly signed Informed Consent (Consentimiento informado) document,\navailable on the Services Platform.\n\nh) Payment on the Services Platform of ESPH S.A., of the cost of the\nservice installation. ESPH S.A. has five (5) business days for\nthe connection of the new potable water service and ten (10) business days for the\nnew wastewater service, as long as the applicant meets the\nrequired technical conditions.\n\nArticle 26.-Of the requirements for the request for a\nnew service by the possessor of an unregistered property.\n\nTo provide the aqueduct and wastewater service in the case of\npossessors on unregistered lands, and when technically feasible, the\napplicant must appear on the Services Platform of the\nPublic Services Company of Heredia or at the regional office and meet the\nfollowing requirements:\n\na) Transaction Request (Solicitud de Trámites) document, available on the\nservices platform of ESPH S.A., duly completed and signed by the registered\nowner, authorized representative, or the executor (albacea), as applicable, as well as the document\nContract for the Provision of Aqueduct and/or Sanitary Sewerage Service\nbetween the Public Services Company of Heredia S.A. and its\nsubscribers. (This condition is\nverified internally by the institution).\n\nh) Duly signed Informed Consent (Consentimiento Informado) document.\n\nESPH S.A. has 5 business days for the connection\nof the new potable water service and 10 business days, counted from the day\nafter the corresponding application is received satisfactorily, for the\nnew wastewater service, as long as the applicant meets the\nrequired technical conditions.\n\nArticle 40.-Change of name on your account.\n\nTo make\nsaid request, the interested party must appear on the Services Platform of the\nPublic Services Company of Heredia or at the regional office; the\nuser must meet the following requirements:\n\na) Fill out the transaction request form.\n\nb) Indicate the contract number or numbers to which the\nname change procedure must be applied.\n\nc) Duly signed informed consent (consentimiento informado) document.\n\nd) Identity card of the current property owner, valid\nresidence document, or valid passport in the case of a foreigner, for\nverification.\n\nIf it is a legal entity, the legal status (personería jurídica) and the\nidentity card of the legal representative must also be presented.\n\ne) Literal certification of the property (original).\n\nf) The billing cannot have pending receipts. (This condition is\nverified internally by the institution).\n\ng) In the event that the titleholder cannot appear, the signatures on the form\nand the informed consent must be authenticated by a lawyer, or a notarized power of attorney\nmust be presented.\n\nIf there is a pending amount in the accounts\nreceivable category, the property owner must pay it before ESPH\nS.A. proceeds to execute the request.\n\nThe response to this request is given immediately on the\nplatform, with a maximum resolution period of one day.\n\n2. Publish in the Official Gazette La Gaceta.\n\n3. Firm agreement."
