Asimismo, de conformidad con la Ley Nº 59, el IGN es\nla dependencia científica y técnica rectora de la cartografía nacional,\ndestinada a la ejecución del Mapa básico oficial y la Descripción básica\ngeográfica de la República de Costa Rica y a los estudios, las investigaciones\no labores y el desarrollo de políticas nacionales de carácter cartográfico,\ngeográfico, geodésico, geofísico y de índole similar que tenga relación con\ndichas obras, con el fin de apoyar los procesos de planificación.\n\n2º-Que la Ley Nº 59 constituye al IGN de manera permanente y en\nrepresentación del Estado, como la autoridad oficial en materia geodésica y de\nla representación espacial de la geografía de la República de Costa Rica,\nextendiéndose su autoridad a las actividades de cualquier orden que tengan por\norigen los trabajos confiados a su cargo.\n\n3º-Que de conformidad con la Ley Nº 59; el artículo 62 del Decreto\nEjecutivo N° 7841-P denominado Reglamento a la Ley sobre la Zona Marítimo\nTerrestre se reconoce la competencia del IGN para la delimitación de la\nzona pública de la Zona Marítimo Terrestre, y su oficialización a través de\npublicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto\nEjecutivo N° 7841-P señala que El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona marítimo\nterrestre en que haya demarcado la zona pública.\n\n4º-Que en el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre, del 28 de junio del 2011, de conformidad con los artículos 18,\n19 y 20 establece que los tipos de delimitación de la Zona Pública de la Zona\nMarítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución a\nsaber: a) delimitación a través de la colocación de mojones y; b) delimitación\ndigital georreferenciada, que es una metodología que permite la\ngeorreferenciación de la pleamar ordinaria, a partir de coordenadas en el\nsistema de referencia oficial del país, establecido por el Decreto Ejecutivo Nº\n33797-MJ-MOPT titulado Declara como datum\nhorizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de\nReferencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la\nTierra (IERS) para la época de medición 2005.83, sin que sea necesario la\ncolocación de mojones, con el fin de agilizar las delimitaciones y proporcionar\nmayor seguridad técnica a los interesados.\n\n5º-Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros\naspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05,\ny su proyección cartográfica asociada CRTM05, como el sistema oficial al cual\ndeben estar referidas las coordenadas de todos los trabajos geodésicos,\ncartográficos y catastrales que se ejecuten en nuestro país, señalando\nespecíficamente en su artículo 11 que La Red Geodésica Nacional de\nReferencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05,\nconstituirán el único sistema oficial de coordenadas para la República de Costa\nRica a partir del cual se debe referenciar todos los levantamientos y\nactividades cartográficos y geodésicos que desarrollen en el Territorio\nNacional toda dependencia pública, persona o entidad privada nacional o\nextranjera que emprendan o contraten trabajos geodésicos y cartográficos,\ncontribuyéndose de esta forma a evitar el gasto público y obteniendo por otra\nparte información geográfica confiable, uniforme y comparable que sea de\nutilidad general y que apoye la toma de decisiones en los distintos niveles del\nEstado.; mientras que el artículo 7 indica que Conforme se produzcan datos\ncartográficos en el nuevo sistema de proyección cartográfica CRTM05, el\nInstituto Geográfico Nacional publicará por los medios adecuados aquella\ninformación que se ha oficializado.\n\n6º-Que el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema\nGeodésico de Referencia Horizontal Oficial para Costa Rica declara en su\nartículo 1 que El sistema geodésico de referencia horizontal oficial para Costa\nRica, denominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), para la época de\nmedición 2014.59, y en adelante, los cambios y su actualización, se regirán de\nacuerdo a las nuevas definiciones del ITRF que se implementen en la red\ncontinental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS)\ndenominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de\nproyección cartográfica CRTM05 seguirá siendo el oficial para la representación\ncartográfica del territorio nacional continental, extendido para efectos de\naplicación de esta proyección cartográfica, hasta la línea de base del mar\nterritorial en el océano Pacífico y el mar Caribe, definida esta línea conforme\na los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el\nDerecho del Mar, como punto de partida para el cómputo de la anchura máxima de\ntodas las áreas marinas jurisdiccionales del Estado costarricense.\n\nPor su parte, el artículo 12 del decreto de cita, refuerza la aplicación de\nla proyección cartográfica CRTM05 como el sistema nacional de coordenadas\noficial a la cual se deben referenciar en el territorio continental de nuestro\npaís, al señalar que El sistema de referencia horizontal CRSIRGAS y su\nproyección cartográfica asociada CRTM05 para el territorio continental\nextendido hasta la línea de base del mar territorial y, la proyección\ncartográfica \"Universal Transversal de Mercator\"\n(UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el\nocéano Pacífico y el mar Caribe, constituirán el único sistema oficial de\ncoordenadas para la República de Costa Rica, a partir del cual, se deben\nreferenciar todos los levantamientos y actividades cartográficos y geodésicos\nque desarrollen en el territorio nacional toda dependencia pública, persona o\nentidad privada, nacional o extranjera, que emprendan o contraten trabajos\ngeodésicos y cartográficos, contribuyéndose a evitar el gasto público y\nobteniendo, por otra parte, información geográfica confiable, uniforme y\ncomparable, que sea de utilidad general y que apoye la toma de decisiones en\nlos distintos niveles del Estado.\n\n7º-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n8º-Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona\nMarítimo Terrestre que posee el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del\nInstituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre.\n\n9º-Que la GDG del IGN sobre la Zona Marítimo Terrestre se fundamenta\ntécnicamente en aplicación de la regulación establecida por: a) el Decreto\nEjecutivo Nº 7841-P; b) el Decreto Ejecutivo Nº 33797-MJMOPT y; c) el Decreto\nEjecutivo Nº 36642-MP-MOPT-MINAET, todos previamente citados.\n\n10.-Que la Ley Nº 6043 establece en su artículo 1 del Capítulo I,\nDisposiciones Generales que La zona marítimo terrestre constituye parte del patrimonio\nnacional, pertenece al Estado y es inalienable e imprescriptible. Su\nprotección, así como la de sus recursos naturales, es obligación del Estado, de\nsus instituciones y de todos los habitantes del país. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical entity governing national cartography, intended for the execution of the official Basic Map and the Basic Geographic Description of the Republic of Costa Rica, and for studies, research, or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.\n\n2º—That Law No. 59 establishes the IGN permanently and on behalf of the State, as the official authority in geodetic matters and in the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any kind originating from the work entrusted to its charge.\n\n3º—That in accordance with Law No. 59; Article 62 of Executive Decree No. 7841-P, called Regulation to the Law on the Maritime Terrestrial Zone, recognizes the competence of the IGN for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta; Article 63 of Executive Decree No. 7841-P states that the National Geographic Institute shall publish a notice in the Official Gazette for each portion of the maritime terrestrial zone in which it has demarcated the public zone.\n\n4º—That Executive Decree No. 36642-MP-MOPT-MINAET, Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone, of June 28, 2011, in accordance with Articles 18, 19, and 20, establishes the types of delimitation of the Public Zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, namely: a) delimitation through the placement of boundary markers (mojones) and; b) georeferenced digital delimitation, which is a methodology that allows the georeferencing of the ordinary high-water mark (pleamar ordinaria), based on coordinates in the official reference system of the country, established by Executive Decree No. 33797-MJ-MOPT titled Declares as the official horizontal datum for Costa Rica, the CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, without the need for placing boundary markers (mojones), in order to expedite delimitations and provide greater technical certainty to interested parties.\n\n5º—That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral work carried out in our country must be referenced, specifically stating in its Article 11 that the National Geodetic Horizontal Reference Network CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities developed in the National Territory by any public agency, person, or private national or foreign entity that undertakes or contracts geodetic and cartographic work must be referenced, thereby contributing to avoiding public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information that is of general utility and supports decision-making at different levels of the State; whereas Article 7 states that As cartographic data is produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish, through appropriate means, that information which has been officialized.\n\n6º—That Executive Decree No. 40962-MJP, Update of the Official Horizontal Reference Geodetic System for Costa Rica, declares in its Article 1 that The official horizontal reference geodetic system for Costa Rica, called CR05 and its materialization through the National Geodetic Network, changes its initials to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, changes and its updating shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) called SIRGAS-CON, while Article 2 establishes that The cartographic projection system CRTM05 shall continue to be the official one for the cartographic representation of the national continental territory, extended for the purposes of applying this cartographic projection, to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum width of all jurisdictional marine areas of the Costa Rican State.\n\nOn the other hand, Article 12 of the cited decree reinforces the application of the cartographic projection CRTM05 as the official national coordinate system to which references must be made in the continental territory of our country, by stating that The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea and, the \"Universal Transverse Mercator\" (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities developed in the national territory by any public agency, person, or private entity, national or foreign, that undertakes or contracts geodetic and cartographic work must be referenced, contributing to avoiding public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information, which is of general utility and supports decision-making at the different levels of the State.\n\n7º—That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of drafting regulatory plans (planes reguladores), the approval of surveying plans, the granting of concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal land-use planning (ordenamiento territorial costero).\n\n8º—That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone.\n\n9º—That the IGN's GDG on the Maritime Terrestrial Zone is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P; b) Executive Decree No. 33797-MJMOPT; and c) Executive Decree No. 36642-MP-MOPT-MINAET, all previously cited.\n\n10.—That Law No. 6043 establishes in its Article 1 of Chapter I, General Provisions, that The maritime terrestrial zone constitutes part of the national patrimony, belongs to the State, and is inalienable and imprescriptible. Its protection, as well as that of its natural resources, is an obligation of the State, its institutions, and all the inhabitants of the country. Colorado, have been registered in the Georeferenced Digital Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN.\n\n5º—Takes effect as of its publication.\n\nIssued in Curridabat on the 10th day of September of the year 2021." }
