  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 008\n\n                        Delimitación de zona pública de un sector del Estero/Manglar Changua en el\nDistrito Bahía Ballena, Cantón Osa, provincia Puntarenas\n\nINSTITUTO GEOGRÁFICO NACIONAL\n\nDEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN\n\nDEL TERRITORIO\n\nAVISO Nº 2021-008\n\nZONA MARÍTIMO TERRESTRE\n\nDelimitación de zona pública de un sector del Estero /\nManglar Changua en el Distrito Bahía Ballena,\n\nCantón Osa, Provincia Puntarenas\n\nCon fundamento en lo dispuesto en los artículos 140 y 240\nde la ley Nº 6227 Ley General de la Administración Pública de fecha 2 de\nmayo de 1978; ley Nº 59 Ley de Creación y Organización del Instituto Geográfico\nNacional del 4 de julio de 1944; ley Nº 8905 Reforma del artículo 2 de la ley\nN° 5695, Creación del Registro Nacional, y sus reformas; y modificación de la\nley N° 59, Creación y Organización del Instituto Geográfico Nacional, de 4 de\njulio de 1944, y sus reformas de fecha 7 de diciembre del 2010; ley Nº 6043 Ley\nsobre la Zona Marítimo Terrestre del 2 de marzo de 1977, con su respectivo\nreglamento y; artículos 2 y 3 de la ley Nº 5695 Ley de Creación del Registro\nNacional de fecha 28 de mayo de 1975 y sus reformas.\n\nConsiderando:\n\n1°-Que mediante ley Nº 8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una\ndependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el\nejercicio de sus funciones. Asimismo, de conformidad con la ley Nº 59, el IGN es la dependencia\ncientífica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico\noficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las\ninvestigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico,\ngeográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin\nde apoyar los procesos de planificación.\n\n2º-Que la ley Nº 59 constituye al IGN de manera permanente y en\nrepresentación del Estado, como la autoridad oficial en materia geodésica y de\nla representación espacial de la geografía de la República de Costa Rica,\nextendiéndose su autoridad a las actividades de cualquier orden que tengan por\norigen los trabajos confiados a su cargo.\n\n3º-Que de conformidad con la ley N.º 59; el artículo 62 del Decreto\nEjecutivo N° 7841-P denominado Reglamento a la Ley sobre la Zona Marítimo\nTerrestre se reconoce la competencia del IGN para la delimitación de la\nzona pública de la Zona Marítimo Terrestre, y su oficialización a través de\npublicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto\nEjecutivo N° 7841-P señala que El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública.\n\n4º-Que en el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre, del 28 de junio del 2011, de conformidad con los artículos 18,\n19 y 20 establece que los tipos de delimitación de la Zona Pública de la Zona\nMarítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución a\nsaber: a) delimitación a través de la colocación de mojones y; b) delimitación\ndigital georreferenciada, que es una metodología que permite la\ngeorreferenciación de la pleamar ordinaria, a partir de coordenadas en el\nsistema de referencia oficial del país, establecido por el Decreto Ejecutivo\nN.º 33797-MJ-MOPT titulado Declara como datum\nhorizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de\nReferencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la\nTierra (IERS) para la época de medición 2005.83, sin que sea necesario la\ncolocación de mojones, con el fin de agilizar las delimitaciones y proporcionar\nmayor seguridad técnica a los interesados.\n\n5º-Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros\naspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05,\ny su proyección cartográfica asociada CRTM05, como el sistema oficial al cual\ndeben estar referidas las coordenadas de todos los trabajos geodésicos,\ncartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente\nen su artículo 11 que La Red Geodésica Nacional de Referencia Horizontal\nCR05 y el sistema de proyección cartográfica CRTM05, constituirán el único\nsistema oficial de coordenadas para la República de Costa Rica a partir del\ncual se debe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública,\npersona o entidad privada nacional o extranjera que emprendan o contraten\ntrabajos geodésicos y cartográficos, contribuyéndose de esta forma a evitar el\ngasto público y obteniendo por otra parte información geográfica confiable,\nuniforme y comparable que sea de utilidad general y que apoye la toma de\ndecisiones en los distintos niveles del Estado.; mientras que el artículo 7 indica\nque Conforme se produzcan datos cartográficos en el nuevo sistema de proyección\ncartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios\nadecuados aquella información que se ha oficializado.\n\n6º-Que el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema\nGeodésico de Referencia Horizontal Oficial para Costa Rica declara en su\nartículo 1 que El sistema geodésico de referencia horizontal oficial para Costa\nRica, denominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como Sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), para la época de\nmedición 2014.59, y en adelante, los cambios y su actualización, se regirán de\nacuerdo a las nuevas definiciones del ITRF que se implementen en la red\ncontinental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS)\ndenominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de\nproyección cartográfica CRTM05 seguirá siendo el oficial para la representación\ncartográfica del territorio nacional continental, extendido para efectos de\naplicación de esta proyección cartográfica, hasta la línea de base del mar\nterritorial en el océano Pacífico y el mar Caribe, definida esta línea conforme\na los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el\nDerecho del Mar, como punto de partida para el cómputo de la anchura máxima de\ntodas las áreas marinas jurisdiccionales del Estado costarricense.\n\nPor su parte, el artículo 12 del decreto de cita, refuerza la aplicación de\nla proyección cartográfica CRTM05 como el sistema nacional de coordenadas\noficial a la cual se deben referenciar en el territorio continental de nuestro\npaís, al señalar que El sistema de referencia horizontal CRSIRGAS y su\nproyección cartográfica asociada CRTM05 para el territorio continental\nextendido hasta la línea de base del mar territorial y, la proyección\ncartográfica \"Universal Transversal de Mercator\"\n(U'TM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el\nocéano Pacífico y el mar Caribe, constituirán el único sistema oficial de\ncoordenadas para la República de Costa Rica, a partir del cual, se deben\nreferenciar todos los levantamientos y actividades cartográficos y geodésicos\nque desarrollen en el territorio nacional toda dependencia pública, persona o\nentidad privada, nacional o extranjera, que emprendan o contraten trabajos\ngeodésicos y cartográficos, contribuyéndose a evitar el gasto público y\nobteniendo, por otra parte, información geográfica confiable, uniforme y\ncomparable, que sea de utilidad general y que apoye la toma de decisiones en\nlos distintos niveles del Estado.\n\n7º-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n8º-Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona\nMarítimo Terrestre que posee el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del\nInstituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre.\n\n9º-Que la GDG del IGN sobre la Zona Marítimo Terrestre se fundamenta\ntécnicamente en aplicación de la regulación establecida por: a) el Decreto\nEjecutivo N.º 7841-P; b) el Decreto Ejecutivo N.º 33797-MJ-MOPT y; c) el\nDecreto Ejecutivo Nº 36642-MP-MOPT-MINAET, todos previamente citados.\n\n10.-Que la ley Nº 7575 denominada Ley Forestal del 13 de febrero de 1996 en\nsu artículo 16 establece que el Ministerio del Ambiente y Energía delimitará en\nel terreno, los linderos de las áreas que conforman el Patrimonio Natural del\nEstado.\n\n11.-Que la ley Nº 6043 establece en su artículo 1 del Capítulo I,\nDisposiciones Generales que La zona marítimo terrestre constituye parte del\npatrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su\nprotección, así como la de sus recursos naturales, es obligación del Estado, de\nsus instituciones y de todos los habitantes del país. Su uso y aprovechamiento\nestán sujetos a las disposiciones de esta ley.\n\n12.-Que según el artículo 11 del Capítulo I, Disposiciones Generales de la\nley N.º 6043, establece que la Zona pública es también, sea cual fuere su\nextensión, la ocupada por todos los manglares de los litorales continentales e\ninsulares y esteros del territorio nacional.\n\n13.-Que el Decreto Ejecutivo Nº 36786-MINAET titulado Manual para la\nclasificación de tierras dedicadas a la conservación de los recursos naturales\ndentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta N.º\n217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar\ndentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como\nbosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares,\nesteros, rías, marismas, lagunas costeras, pantanos, bosques anegados,\nsalitrales), para certificarlos e incorporarlos como parte del Patrimonio\nNatural del Estado (PNE).\n\n14.-Que el Decreto Ejecutivo N.º 36786-MINAET en el punto III-Competencias\npara la delimitación y certificación establece que La clasificación de los\nterrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del\nSistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados\ndebidamente acreditados por los Colegios Profesionales respectivos para que\nclasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y\nVIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques\nanegados, salitrales) y humedales.\n\nLa validez de los documentos de clasificación emitidos por profesionales\nprivados quedará sujeta a la aprobación que emita el AC que por competencia\nterritorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les\ncompeterá, además, la verificación, fiscalización, deslinde y certificación de\nlas tierras del Patrimonio Natural del Estado y las zonas de protección.\n\nLa ubicación y delimitación de las áreas del Patrimonio Natural del Estado\ndentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de\naprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que\nel Plan Regulador Costero es el instrumento de ordenamiento territorial, que\ndefine y ubica todas las zonas a concesionar dentro de la ZMT y para la\nclasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan\nRegulador Costero debe indicar clara y expresamente, las áreas del PNE para no\ncontabilizarlas en el área total a concesionar.\n\n15.-Que en mediante oficio SINAC-ACOSA-PNE-AD-124-2020 de fecha 03 de\njunio de 2020 emitido por el Área de Conservación Osa, se lleva a cabo la\nverificación de delimitación de Estero-Manglar, Finca Rancho La Merced\nrealizado por la Ing. Melissa Uribe Mora descrito en el informe Delimitación\ndel ecosistema Estero-Manglar correspondiente a zona pública en sector de Playa\nHermosa, Bahía Ballena, Osa.\n\n16.-Que mediante el oficio SINAC-ACOSA-D-389-2020 de fecha 25 de\nagosto de 2020 suscrito por la Sra. Laura Rivera Quintanilla directora a. í.\ndel Área de Conservación Osa del Sistema de Áreas de Conservación del\nMinisterio de Ambiente y Energía, dirigido a la Sra. Marta Aguilar Varela\ndirectora del Instituto Geográfico Nacional, se otorga visto bueno al\nlevantamiento realizado por la Ing. Melissa Uribe Mora, según los informes\ntécnicos elaborados mediante los oficios SINAC-ACOSA-PNE-AD-124-2020 y\nSINAC-ACOSA-PNE-AD-160-2020, realizados por los funcionarios Ing. Top. Roberto\nMartínez Fernández, Ing. Forestal Ginette Jiménez\nSoto, Ing. Forestal Javier García Rodríguez y el Bach. Jorge Andrés Quesada\nBadilla del área de Conservación Osa, con base en el Decreto Ejecutivo N.º\n36786-MINAET.\n\n17.-Que mediante el informe denominado \"Delimitación del\necosistema Estero-Manglar correspondiente a zona pública en sector de Playa\nHermosa, Bahía Ballena, Osa\" elaborado por la Ing. Melissa Uribe\nMora, en su momento funcionaria de la empresa INCOPOAS Sociedad Anónima, a\nsolicitud de Walter Odio Victory, número de cédula\n9-0008- 0897, Representante Legal de Rancho La Merced, se presenta al IGN la información\ntécnica del levantamiento topográfico para la delimitación del ecosistema\nEstero-Manglar Changua correspondiente a zona pública en sector de Playa\nHermosa, Bahía Ballena, Puntarenas.\n\n18.-Que mediante el oficio DIG-TOT-0050-2021 de fecha 09 de febrero de\n2021, emitido por el Subproceso de Límites Oficiales del Departamento\nTopográfico y Observación del   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 008\n\n                        Delimitation of the public zone of a sector of the Estero/Manglar Changua in the\nBahía Ballena District, Osa Canton, Puntarenas Province\n\nINSTITUTO GEOGRÁFICO NACIONAL\n\nDEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN\n\nDEL TERRITORIO\n\nNOTICE No. 2021-008\n\nMARITIME TERRESTRIAL ZONE\n\nDelimitation of the public zone of a sector of the Estero /\nManglar Changua in the Bahía Ballena District,\n\nOsa Canton, Puntarenas Province\n\nBased on the provisions of Articles 140 and 240\nof Law No. 6227, the General Public Administration Law of May 2,\n1978; Law No. 59, the Law for the Creation and Organization of the Instituto Geográfico\nNacional of July 4, 1944; Law No. 8905, Reform of Article 2 of Law\nNo. 5695, Creation of the National Registry, and its reforms; and modification of\nLaw No. 59, Creation and Organization of the Instituto Geográfico Nacional, of July\n4, 1944, and its reforms of December 7, 2010; Law No. 6043, the Law\non the Maritime Terrestrial Zone of March 2, 1977, with its respective\nregulation; and Articles 2 and 3 of Law No. 5695, the Law for the Creation of the National\nRegistry of May 28, 1975, and its reforms.\n\nConsidering:\n\n1.—That through Law No. 8905, the Instituto Geográfico Nacional, hereinafter IGN, is established as an\noffice of the National Registry, which shall sign the contracts and agreements necessary for the\nexercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific\nand technical office governing national cartography, destined for the execution of the official Base Map\nand the basic geographic Description of the Republic of Costa Rica, and for studies,\nresearch or work, and the development of national policies of a cartographic,\ngeographic, geodetic, geophysical, and similar nature related to said works, in order\nto support planning processes.\n\n2.—That Law No. 59 establishes the IGN, on a permanent basis and in\nrepresentation of the State, as the official authority in geodetic matters and\nthe spatial representation of the geography of the Republic of Costa Rica,\nits authority extending to activities of any nature that originate\nfrom the work entrusted to its charge.\n\n3.—That in accordance with Law No. 59, Article 62 of Executive Decree\nNo. 7841-P, named the Regulation to the Law on the Maritime Terrestrial\nZone, recognizes the IGN's competence for the delimitation of the\npublic zone of the Maritime Terrestrial Zone, and its officialization through\npublication in the Official Gazette La Gaceta; Article 63 of Executive\nDecree No. 7841-P indicates that the Instituto Geográfico Nacional shall\npublish a notice in the Official Gazette, for each portion of the maritime\nterrestrial zone in which it has demarcated the public zone.\n\n4.—That in Executive Decree No. 36642-MP-MOPT-MINAET, the Regulation of\nSpecifications for the Delimitation of the public zone of the Maritime Terrestrial\nZone, of June 28, 2011, in accordance with Articles 18,\n19, and 20, it establishes that for the types of delimitation of the Public Zone of the Maritime\nTerrestrial Zone, the IGN may use two execution methodologies,\nnamely: a) delimitation through the placement of boundary markers (mojones); and b) georeferenced digital\ndelimitation, which is a methodology that allows the\ngeoreferencing of the ordinary high-water mark (pleamar ordinaria), based on coordinates in the\nofficial reference system of the country, established by Executive Decree\nNo. 33797-MJ-MOPT titled Declares as the official horizontal\ndatum for Costa Rica, the CR05, linked to the International Terrestrial\nReference Frame (ITRF2000) of the International Earth Rotation\nService (IERS) for the measurement epoch 2005.83, without the need for the\nplacement of boundary markers, in order to expedite delimitations and provide\ngreater technical security to interested parties.\n\n5.—That in Executive Decree No. 33797-MJ-MOPT, which among other\naspects determines the National Geodetic Horizontal Reference Network CR05,\nand its associated cartographic projection CRTM05, as the official system to which\nthe coordinates of all geodetic,\ncartographic, and cadastral work executed in our country must be referenced, specifically indicating\nin its Article 11 that The National Geodetic Horizontal Reference Network\nCR05 and the CRTM05 cartographic projection system shall constitute the only\nofficial coordinate system for the Republic of Costa Rica, from which\nall cartographic and geodetic surveys and activities carried out in the National Territory by any public office, person, or private entity, national or foreign, that undertake or contract\ngeodetic and cartographic work must be referenced, thereby contributing to avoiding public\nexpenditure and, on the other hand, obtaining reliable, uniform,\nand comparable geographic information that is of general utility and supports decision-making\nat the different levels of the State; whereas Article 7 indicates\nthat As cartographic data are produced in the new CRTM05 cartographic projection\nsystem, the Instituto Geográfico Nacional shall publish by appropriate\nmeans that information which has been officialized.\n\n6.—That Executive Decree No. 40962-MJP, Update of the Official Horizontal\nGeodetic Reference System for Costa Rica, declares in its\nArticle 1 that The official horizontal geodetic reference system for Costa\nRica, denominated as CR05 and its materialization through the National Geodetic\nNetwork, changes its acronym to CRSIRGAS, as the official Horizontal Reference\nSystem for the Republic of Costa Rica, linked to the International\nTerrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch\n2014.59, and henceforth, changes and its update shall be governed\naccording to the new ITRF definitions implemented in the continental\nnetwork of the Geocentric Reference System for the Americas (SIRGAS)\ndenominated SIRGAS-CON, while Article 2 establishes that The CRTM05 cartographic\nprojection system shall continue to be the official one for the cartographic representation\nof the continental national territory, extended for the purposes of\napplying this cartographic projection, up to the baseline of the territorial\nsea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance\nwith Articles 5, 6, and 7 of the United Nations Convention on the\nLaw of the Sea, as the starting point for calculating the maximum width of\nall jurisdictional marine areas of the Costa Rican State.\n\nFor its part, Article 12 of the cited decree reinforces the application of\nthe CRTM05 cartographic projection as the official national coordinate\nsystem to which all work must be referenced in the continental territory of our\ncountry, by indicating that The horizontal reference system CRSIRGAS and its\nassociated cartographic projection CRTM05 for the continental territory\nextended to the baseline of the territorial sea, and the\n\"Universal Transverse Mercator\"\n(UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the\nPacific Ocean and the Caribbean Sea, shall constitute the only official coordinate\nsystem for the Republic of Costa Rica, from which\nall cartographic and geodetic surveys and activities carried out in the national territory by any public office, person, or private entity, national or foreign, that undertake or contract\ngeodetic and cartographic work must be referenced, contributing to avoiding public expenditure\nand obtaining, on the other hand, reliable, uniform,\nand comparable geographic information that is of general utility and supports decision-making\nat the different levels of the State.\n\n7.—That georeferencing to the national coordinate system as a\nmechanism to delimit the public zone of the Maritime Terrestrial Zone\nenables the correct delimitation of the public zone for the purposes of\npreparing regulatory plans (planes reguladores), the approval of survey plans (visado de planos de agrimensura), the\ngranting of concessions in the Restricted Zone (Zona Restringida), and other aspects of\ncoastal territorial planning (ordenamiento territorial costero).\n\n8.—That the georeferenced digital information on the delimitation of the public zone of the Maritime\nTerrestrial Zone held by the IGN is denominated the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the\nInstituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone.\n\n9.—That the GDG of the IGN on the Maritime Terrestrial Zone is technically\nbased on the application of the regulations established by: a) Executive\nDecree No. 7841-P; b) Executive Decree No. 33797-MJ-MOPT; and c)\nExecutive Decree No. 36642-MP-MOPT-MINAET, all previously cited.\n\n10.—That Law No. 7575, named the Forestry Law (Ley Forestal) of February 13, 1996, in\nits Article 16 establishes that the Ministry of Environment and Energy shall delimit on\nthe ground the boundaries of the areas that constitute the Natural Heritage of the State (Patrimonio Natural del Estado).\n\n11.—That Law No. 6043 establishes in its Article 1 of Chapter I,\nGeneral Provisions, that The maritime terrestrial zone constitutes part of the\nnational heritage, belongs to the State, and is inalienable and imprescriptible. Its\nprotection, as well as that of its natural resources, is the obligation of the State, its\ninstitutions, and all the inhabitants of the country. Its use and exploitation\nare subject to the provisions of this law.\n\n12.—That according to Article 11 of Chapter I, General Provisions of\nLaw No. 6043, it establishes that the Public Zone is also, whatever its\nextension, that occupied by all the mangroves of the continental and insular\ncoastlines and estuaries (esteros) of the national territory.\n\n13.—That Executive Decree No. 36786-MINAET, titled Manual for the\nclassification of lands dedicated to the conservation of natural resources\nwithin the Maritime Terrestrial Zone in Costa Rica, published in La Gaceta No.\n217 of November 11, 2011, establishes among its objectives To identify\nwithin the Maritime Terrestrial Zone those lands that classify as\nforests, of forestry aptitude (soils Class VII and VIII), wetlands (mangroves,\nestuaries, rias, salt marshes (marismas), coastal lagoons, swamps, flooded forests,\nsalt flats (salitrales)), to certify them and incorporate them as part of the Natural\nHeritage of the State (Patrimonio Natural del Estado, PNE).\n\n14.—That Executive Decree No. 36786-MINAET in point III-Competencies\nfor delimitation and certification establishes that The classification of\nlands within the ZMT shall correspond to the Conservation Areas (Áreas de Conservación, AC) of the\nNational System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) and to duly accredited private professionals\nby the respective Professional Associations to\nclassify forests, lands of forestry aptitude (Class VII and VIII\nsoils), (mangroves, estuaries, rias, salt marshes, coastal lagoons, swamps, flooded\nforests, salt flats) and wetlands.\n\nThe validity of the classification documents issued by private\nprofessionals shall be subject to the approval issued by the AC that by territorial\ncompetence corresponds. The ACs of SINAC with jurisdiction in the ZMT\nshall also be responsible for the verification, oversight, demarcation (deslinde), and certification of\nthe lands of the Natural Heritage of the State and the protection zones.\n\nThe location and delimitation of the areas of the Natural Heritage of the State\nwithin the Maritime Terrestrial Zone must be carried out as part of the\napproval process of the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, because\nthe Coastal Regulatory Plan is the territorial planning instrument that\ndefines and locates all the zones to be concessioned within the ZMT and for\nthe classification of this at the level of cadastral plans (planos de catastro).
