  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 255\n\n                        Creación del área marina de pesca responsable Papagayo y su plan de\nordenamiento pesquero\n\nINSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA\n\nAJDIP/255-2021.-Puntarenas, a los veinticuatro días del\nmes de noviembre de dos mil veintiuno.\n\nConsiderando:\n\n1º-Que la Junta Directiva del INCOPESCA aprobó mediante\nAcuerdo N° AJDIP/138-2008, del 4 de abril del 2008 y el Decreto Ejecutivo N°\n35502-MAG el \"Reglamento para el establecimiento de las Áreas Marinas\nde Pesca Responsable (AMPR) y declaración de interés público nacional las Áreas\nMarinas de Pesca Responsable\", la Asociación de Pescadores Artesanales\nde la zona, presentaron la solicitud formal a la Junta Directiva del Instituto\nCostarricense de Pesca y Acuicultura (Incopesca) para\naprobar la conformación del grupo de trabajo y la elaboración del Plan de\nOrdenamiento Pesquero del Área Marina de Pesca Responsable Papagayo.\n\n2º-Que conforme el acuerdo tomado en la sesión N° 035-2021 del 20 de agosto\ndel 2021, en el Acuerdo AJDIP/186-2021, se instruye a la Presidencia Ejecutiva\ndel Incopesca, para que la Dirección de Ordenamiento\nPesquero y Acuícola presente ante esta junta, el estado y análisis del Área\nMarina de Pesca Responsable Papagayo.\n\n3º-Que en seguimiento al acuerdo de Junta Directiva AJDIP/186-2021, se\nrecibe al funcionario José Miguel Carvajal Rodríguez, Jefe del Departamento de\nInvestigación del Incopesca, con la presentación del\noficio INCOPESCA-DOPA-DINV-047-2021 en relación al documento del Área Marina de\nPesca Responsable Papagayo, en el cual incorporan algunas observaciones y\ncomentarios realizados en conjunto por los funcionarios del Departamento de\nInvestigación del Incopesca, las cuales se acogen\nmediante el acuerdo de Junta Directiva En de sesión ordinaria N° 37- 2021 del\n25 de agosto de 2021 y se solicita en un plazo de tres meses presentar ante la\nJunta Directiva las correcciones propuestas en el documento final del Área\nMarina de Pesca Responsable Papagayo.\n\n4º-Que el artículo N° 50 de la Constitución\nPolítica establece la obligación del Estadio de procurar el mayor bienestar a todos los habitantes\ndel país, organizando y estimulando la producción y el más adecuado reparto\nde la riqueza. También se reconoce el derecho de toda\npersona a un ambiente sano\ny ecológicamente equilibrado.\n\n5º-Corresponde al INCOPESCA como institución pública rectora de la pesca y\nla acuicultura en nuestro país, establecer medidas de ordenamiento para el\naprovechamiento sostenible de los recursos hidrobiológicos, proteger áreas de\nreproducción, reclutamiento y alimentación, que favorezcan el incremento de las\nespecies y el aumento de su biomasa, para garantizar la sostenibilidad del\nrecurso.\n\n6º-El Código de Conducta para la Pesca Responsable, Decreto Ejecutivo N°\n27919-MAG reconoce en su artículo N° 6, la importante contribución de la pesca\nartesanal en pequeña escala a la generación de empleo, ingresos y seguridad\nalimentaria. Hence the need for the State to appropriately manage\nthe right of fishermen and fisherwomen, adopting regulatory measures\nthat favor the management and conservation of fishery resources in the waters\nof national jurisdiction.
