  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 43399\n\n                        Reforma Reglamento de la Estructura Organizativa del Servicio Fitosanitario\ndel Estado\n\nN° 43399-MAG\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AGRICULTURA Y GANADERÍA\n\nEn ejercicio de las facultades que les\nconfieren los artículos 140, incisos 3), 8), 18) y 20), y 146 de la\nConstitución Política, los artículos 25, 28 párrafo 2, inciso b) de la Ley\nGeneral de la Administración Pública, Ley Nº 6227 del 02 de mayo de 1978, la\nLey de Fomento a la Producción Agropecuaria (FODEA) y Orgánica del Ministerio\nde Agricultura y Ganadería, Ley Nº 7064 del 29 de abril de 1987 y la Ley Nº\n7664 del 8 de abril de 1997, Ley de Protección Fitosanitaria; y\n\nConsiderando:\n\n1º-Que mediante Decreto Ejecutivo Nº\n36801-MAG del 20 de septiembre de 2011, se crea el Reglamento de la Estructura\nOrganizativa del Servicio Fitosanitario del Estado, necesario para la adecuada\nejecución de sus funciones y competencias encomendadas en la Ley Nº 7664 del 8\nde abril de 1997, Ley de Protección Fitosanitaria.\n\n2º-Que en el decreto mencionado\nanteriormente, se estableció en el artículo 4, la misión del Servicio\nFitosanitario del Estado, y en el artículo 5 su visión, siendo que estos\nelementos del marco estratégico de la institución cambian a través del tiempo.\n\n3º-Que durante el año 2021, el Servicio\nFitosanitario del Estado se encuentra en planteamiento de un nuevo Plan Estratégico\nInstitucional, en el cual se debe readecuar la misión y visión de la\ninstitución; y que dicha actividad, se lleva a cabo de manera periódica, al\nvencimiento de cada Plan Estratégico Institucional.\n\n4º-Que se hace contraproducente ajustar la\nmisión y la visión en el decreto ejecutivo Nº 36801-MAG del 20 de septiembre de\n2011, con cada revisión periódica del marco estratégico de la institución, ya\nque conlleva un gasto innecesario de recursos.\n\n5º-Que de conformidad con los párrafos\nsegundo y tercero del artículo 12 del Reglamento a la Ley de Protección al\nCiudadano del Exceso de Requisitos y Trámites Administrativos, Decreto\nEjecutivo N° 37045-MP-MEIC del 22 de febrero de 2012; el presente Decreto\nEjecutivo no crea ni modifica trámites, requisitos o procedimientos por lo que,\nno requiere del Trámite de Mejora Regulatoria.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 43399\n\n                        Amendment to the Regulation on the Organizational Structure of the State Phytosanitary Service\n\nNo. 43399-MAG\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF AGRICULTURE AND LIVESTOCK\n\nIn exercise of the powers conferred upon them by Articles 140, subsections 3), 8), 18), and 20), and 146 of the Political Constitution, Articles 25, 28 paragraph 2, subsection b) of the General Law on Public Administration, Law No. 6227 of May 2, 1978, the Law for the Promotion of Agricultural Production (FODEA) and Organic Law of the Ministry of Agriculture and Livestock, Law No. 7064 of April 29, 1987, and Law No. 7664 of April 8, 1997, Law on Phytosanitary Protection; and\n\nConsidering:\n\n1º—That through Executive Decree No. 36801-MAG of September 20, 2011, the Regulation on the Organizational Structure of the State Phytosanitary Service was created, necessary for the proper execution of its functions and competencies entrusted in Law No. 7664 of April 8, 1997, Law on Phytosanitary Protection.\n\n2º—That in the aforementioned decree, Article 4 established the mission of the State Phytosanitary Service, and Article 5 its vision, given that these elements of the institution's strategic framework change over time.\n\n3º—That during the year 2021, the State Phytosanitary Service was in the process of formulating a new Institutional Strategic Plan, in which the mission and vision of the institution must be readjusted; and that said activity is carried out periodically, upon the expiration of each Institutional Strategic Plan.\n\n4º—That it is counterproductive to adjust the mission and vision in Executive Decree No. 36801-MAG of September 20, 2011, with each periodic review of the institution's strategic framework, as it entails an unnecessary expenditure of resources.\n\n5º—That in accordance with the second and third paragraphs of Article 12 of the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012; this Executive Decree does not create or modify procedures, requirements, or processes, and therefore, does not require the Regulatory Improvement Process.
