El\nConsejo Nacional de Áreas de Conservación, de\n\nconformidad al Acuerdo N°16\nde la Sesión Ordinaria N°11-2021 del 09 de noviembre\n\ndel 2021, y en cumplimiento\ndel artículo 12 inciso d) del Reglamento a la Ley de\n\nBiodiversidad N°7788,\nDecreto Ejecutivo N°34433-MINAE, aprueba y emite el\n\npresente:\n\nResumen Ejecutivo del Plan\nGeneral de Manejo de la Reserva\n\nBiológica del Bicentenario\nde la República Pájaro Campana\n\nRESULTANDO:\n\nPRIMERO: Que de conformidad con el artículo 22 de la Ley de Biodiversidad número\n7788 del 27 de mayo de 1998, se crea el Sistema Nacional de Áreas de\nConservación, con personería jurídica propia, como un sistema de gestión y\ncoordinación institucional, desconcentrado y participativo, que integra las\ncompetencias en materia forestal, vida silvestre y áreas protegidas, con el fin\nde dictar políticas, planificar y ejecutar procesos dirigidos a lograr la\nsostenibilidad en el manejo de los recursos naturales de Costa Rica.\n\nSEGUNDO: Que es política prioritaria de EL SINAC facilitar y promover acciones\nque conlleven a la protección, conservación y manejo sostenible de los recursos\nnaturales y la biodiversidad presentes en las Áreas Silvestres Protegidas, en\nadelante las ASP, de las Áreas de Conservación.\n\nTERCERO: Que es competencia del Sistema Nacional de Áreas de Conservación a\ntravés de cada Área de Conservación, la administración y protección de las\nÁreas Silvestres Protegidas a lo largo de todo el territorio nacional.\n\nCUARTO: Que de conformidad con los artículos 23 y 28 de la Ley de Biodiversidad\nN° 7788 y los artículos 9 y 21 de su reglamento, Decreto Ejecutivo\nN°34433-MINAE, publicado en la Gaceta N°68 del 8 de abril de 2008, el Área de\nConservación Amistad Pacífico, en adelante denominada ACLA-P, es parte de la\norganización del SINAC y se encarga de aplicar la legislación vigente en\nmateria de recursos naturales, dentro de su demarcación geográfica.\n\nCONSIDERANDO:\n\nPRIMERO: Que la Reserva Biológica del Bicentenario de la República fue creada\nmediante Decreto Ejecutivo N° 42615 del 07 de setiembre del 2020 y con fecha de\nvigencia desde el 17 de febrero del 2021, con una extensión de 5 075 hectáreas.\n\nSEGUNDO: Que el Plan de Manejo de las Áreas Silvestres Protegidas (ASP) es el instrumento\norientador para una efectiva administración y manejo de los elementos naturales\ny culturales presentes en dichas áreas y de la dinámica socio ambiental ligada\na estos. Además, es la herramienta técnica por medio de la cual cada ASP\nestablece las directrices de manejo para el uso de los gestores, administradores\ny grupos de interés, por lo tanto, la primera instancia que debe realizar la\nvalidación de la propuesta de manejo son las autoridades del Área de\nConservación, así como las instancias oficiales de participación social\nestablecidas en ellas, sean estas los Consejos Regionales y Comités Locales, de\nconformidad con la Ley de Biodiversidad N°7788.\n\nTERCERO: Los Planes de Manejo tienen como objetivo el servir como un instrumento\nde planificación y operación para implementar las medidas apropiadas de manejo\ny conservación de las áreas silvestres protegidas, promoviendo la participación\nde la sociedad en especial de las comunidades locales a través de diferentes\nprocesos.\n\nCUARTO: Que el Consejo Nacional de Áreas de Conservación (CONAC), aprobó el \"Manual\nde Procedimientos para la Publicación de las Planes de Manejo de las Áreas Silvestres\nProtegidas del Sistema Nacional de Áreas de Conservación\", mediante\nAcuerdo N° 17, tornado en Sesión Extraordinaria N° 06-2008 del 04 de agosto del\n2008.\n\nQUINTO: Que el CONAC en Acuerdo N° 8 de la Sesión Extraordinaria N° 02-2011 del\n02 de mayo del 2011 acordó modificar el Acuerdo N° 17 de la Sesión\nExtraordinaria N° 06-2008 del 04 de agosto del 2008, para que la zonificación\ndefinida en el Plan General de Manejo se publique integralmente.\n\nSEXTO: Que en febrero del 2018 el Área de Conservación La Amistad Pacifico en\nconjunto con la Asociación Costa Rica por Siempre (CRXS) elaboraron los\ntérminos de referencia para la creación del plan de manejo de la RBPC.\n\nSEPTIMO: Que, en diciembre del 2019, la Asociación Costa Rica por Siempre (CRXS),\ncontrató a la Fundación de Parques Nacionales, como facilitador para el proceso\nde la creación del PGM de la Reserva Biológica del Bicentenario de la República\n- Pájaro Campana.\n\nOCTAVO: Que, en enero del año 2020, a través del oficio SINAC-ACLA-P-D-002-2020,\nla Dirección del Área de Conservación Amistad Pacífico, conformo la Comisión Técnica\nCoordinadora que servirá como enlace y dará seguimiento a la formulación del PGM\nde la RBPC.\n\nNOVENO: Que el Comité Técnico del Área de Conservación Amistad Pacífico aprueba\nel Plan de Manejo de la RBPC, según Acuerdo Nº02 de la minuta de reunión del 9\nde junio del 2021.\n\nDECIMO: Que mediante oficio SINAC-ACLA-P-GASP-053-2021 se notifica el acuerdo N°02\nde del Comité Científico Técnico realizado el 09 de junio del 2021 en donde se aprueba\nel Plan General de Manejo de la RBBRPC.\n\nDECIMO PRIMERO: Que el Plan General de Manejo de la RBBRPC fue aprobado por el Consejo\nRegional del Área de Conservación Amistad Pacífico (CORACLAP), mediante Acuerdo\nN°08 de la Sesión Ordinaria Nº03-2021 efectuada el nueve de junio de dos mil\nveintiuno.\n\nDECIMO SEGUNDO: Que el CONAC aprobó el Plan de Manejo de la RBPC, mediante Acuerdo Nº16\nde la Sesión Ordinaria Nº11-2021 celebrada el 09 de noviembre de 2021.\n\nPor tanto,\n\nEL SECRETARIO EJECUTIVO DEL\n\nCONSEJO NACIONAL DE AREAS\nDE CONSERVACION\n\nRESUELVE:\n\nPRIMERO: Publicar el siguiente Resumen Ejecutivo del Plan General de Manejo de la\nReserva Biológica del Bicentenario de la República Pájaro Campana, a efectos de\nsu oficialización:\n\na) Objetivo general:\n\nGestionar la conservación y\nel uso sostenible de los elementos focales de manejo priorizados en la Reserva\nBiológica del Bicentenario de la República-Pájaro Campana, integrando la\nparticipación de los diferentes actores sociales y la articulación interinstitucional.\n\nb) Objetivos estratégicos\n\n1. Coordinar e implementar\nactividades que permitan la gestión de los recursos naturales de la reserva\nbiológica.\n\nc) Zonificación de la\nReserva Biológica del Bicentenario de la República Pájaro Campana\n\nLa Guía para el diseño y\nformulación del plan general de manejo de las áreas silvestres protegidas de\nCosta Rica (SINAC, 2016) propone cuatro tipos de zonas vinculadas a la propiedad\nde la tierra, marco legal y otros factores que pueden determinar su\nfactibilidad y que son aplicables a la Reserva Biológica.\n\nLa zonificación de la\nReserva Biológica se llevó a cabo mediante la realización de tres actividades\nconsecutivas (FPN, 2020i), (FPN, 2020j), (FPN, 2021a). En primera instancia, se\nidentificaron sitios prioritarios para conservación de recursos naturales en la\nRBPC.\n\nEn la identificación de\nsitios prioritarios para conservación de recursos naturales se consideraron las\nsiguientes características biofísicas o atributos del territorio: área para protección\nde recurso hídrico, uso de la tierra, pendiente del terreno y patrimonio\nnatural del estado.\n\nEn el siguiente cuadro se\ndetalla la zonificación de la RBPC.\n\nCuadro 1. Zonas de intervención de la RBPC, área y porcentaje\n\nFigura 1. Zonificación de\nla RBPC\n\nA continuación, se presenta\na detalle la zonificación de la RBPC según el nivel de intervención.\n\nZona de Mínima Intervención\n\nDos usos de la tierra están\npermitidos en la Zona de Mínima Intervención: conservación y caminos de acceso.\nCabe destacar que estos últimos corresponden a tres senderos existentes en el\nárea silvestre protegida.\n\nZona de Baja Intervención\n\nEn el caso de la Zona de\nBaja Intervención, también son dos los usos de la tierra permitidos:\nconservación y caminos de acceso. El primero se ubica prácticamente en toda el\nárea de la reserva biológica, mientras que el segundo está muy localizado hacia\nel sureste.\n\nZona de Alta Intervención\n\nEn la Zona de Alta\nIntervención se permiten actividades dirigidas a la conservación. Tal uso se\ndistribuye en pequeñas áreas hacia el oeste y sur de la reserva biológica.\n\nSEGUNDO: El Plan General de Manejo la Reserva Biológica del Bicentenario de la\nRepública Pájaro Campana tendrá una vigencia de 10 años (2021-2030), sin\nembargo, se recomienda que se realice una evaluación de medio término a los 5\naños para proponer reajustes al plan.\n\nTERCERO: Publicar en la página Web institucional del SINAC,\nhttp://www.sinac.go.cr, el documento completo del Plan General de Manejo de la\nReserva Biológica Pájaro Campana.\n\nCUARTO: Rige a partir de su\npublicación en el Diario Oficial La Gaceta.",

Furthermore, it is the technical tool through which each ASP establishes the management guidelines for use by managers, administrators, and interest groups; therefore, the first instance that must validate the management proposal are the authorities of the Conservation Area, as well as the official social participation bodies established therein, be these the Regional Councils and Local Committees, in accordance with the Biodiversity Law No. 7788.\n\nTHIRD: The Management Plans aim to serve as a planning and operational instrument to implement the appropriate measures for the management and conservation of protected wild areas, promoting the participation of society, especially local communities, through different processes.\n\nFOURTH: That the National Council of Conservation Areas (CONAC) approved the \"Procedures Manual for the Publication of Management Plans of the Protected Wild Areas of the National System of Conservation Areas\", by Agreement No. 17, taken in Extraordinary Session No. 06-2008 of August 4, 2008.\n\nFIFTH: That CONAC, in Agreement No. 8 of Extraordinary Session No. 02-2011 of May 2, 2011, agreed to modify Agreement No. 17 of Extraordinary Session No. 06-2008 of August 4, 2008, so that the zoning (zonificación) defined in the General Management Plan is published integrally.\n\nSIXTH: That in February 2018, the La Amistad Pacifico Conservation Area, jointly with the Costa Rica Por Siempre Association (CRXS), prepared the terms of reference for the creation of the management plan for the RBPC.\n\nSEVENTH: That in December 2019, the Costa Rica Por Siempre Association (CRXS) contracted the Fundación de Parques Nacionales as a facilitator for the process of creating the PGM for the Bicentennial Republic Biological Reserve - Pájaro Campana.\n\nEIGHTH: That in January 2020, through official communication SINAC-ACLA-P-D-002-2020, the Directorate of the Amistad Pacífico Conservation Area formed the Coordinating Technical Commission that will serve as a liaison and follow up on the formulation of the PGM of the RBPC.\n\nNINTH: That the Technical Committee of the Amistad Pacífico Conservation Area approves the Management Plan of the RBPC, according to Agreement No. 02 of the meeting minutes of June 9, 2021.\n\nTENTH: That through official communication SINAC-ACLA-P-GASP-053-2021, Agreement No. 02 of the Technical Scientific Committee held on June 9, 2021, where the General Management Plan of the RBBRPC is approved, was notified.\n\nELEVENTH: That the General Management Plan of the RBBRPC was approved by the Regional Council of the Amistad Pacífico Conservation Area (CORACLAP), through Agreement No. 08 of Ordinary Session No. 03-2021 held on June 9, two thousand twenty-one.\n\nTWELFTH: That CONAC approved the Management Plan of the RBPC, through Agreement No. 16 of Ordinary Session No. 11-2021 held on November 9, 2021.\n\nTherefore,\n\nTHE EXECUTIVE SECRETARY OF THE\n\nNATIONAL COUNCIL OF CONSERVATION AREAS\n\nRESOLVES:\n\nFIRST: To publish the following Executive Summary of the General Management Plan for the Bicentennial Republic Pájaro Campana Biological Reserve, for the purposes of its formalization:\n\na) General objective:\n\nTo manage the conservation and sustainable use of the prioritized focal management elements in the Bicentennial Republic-Pájaro Campana Biological Reserve, integrating the participation of different social actors and inter-institutional coordination.\n\nb) Strategic objectives\n\n1. Promote the development of governance models and participation mechanisms for the implementation of the general management plan of the Bicentennial Republic-Pájaro Campana Biological Reserve and for assertive decision-making.\n\n2. Manage financial, technical, and human resources that facilitate sustainability in the management of the biological reserve.\n\n3. Coordinate and implement activities that enable the management of the natural resources of the biological reserve.\n\nc) Zoning of the Bicentennial Republic Pájaro Campana Biological Reserve\n\nThe Guide for the design and formulation of the general management plan for the protected wild areas of Costa Rica (SINAC, 2016) proposes four types of zones linked to land ownership, the legal framework, and other factors that may determine their feasibility and that are applicable to the Biological Reserve.\n\nThe zoning of the Biological Reserve was carried out through three consecutive activities (FPN, 2020i), (FPN, 2020j), (FPN, 2021a). In the first instance, priority sites for the conservation of natural resources in the RBPC were identified.\n\nIn identifying priority sites for natural resource conservation, the following biophysical characteristics or territory attributes were considered: area for water resource protection, land use, terrain slope, and natural state heritage.\n\nThe following chart details the zoning of the RBPC.\n\nTable 1. Intervention zones of the RBPC, area, and percentage\n\nFigure 1. Zoning of the RBPC\n\nBelow, the zoning of the RBPC is presented in detail according to the level of intervention.\n\nMinimum Intervention Zone\n\nTwo land uses are permitted in the Minimum Intervention Zone: conservation and access roads. It should be noted that the latter correspond to three existing trails in the protected wild area.\n\nLow Intervention Zone\n\nIn the case of the Low Intervention Zone, two land uses are also permitted: conservation and access roads. The former is located practically throughout the entire area of the biological reserve, while the latter is very localized towards the southeast.\n\nHigh Intervention Zone\n\nIn the High Intervention Zone, activities directed at conservation are permitted. Such use is distributed in small areas towards the west and south of the biological reserve.\n\nSECOND: The General Management Plan for the Bicentennial Republic Pájaro Campana Biological Reserve will have a validity of 10 years (2021-2030); however, it is recommended that a mid-term evaluation be carried out at 5 years to propose readjustments to the plan.\n\nTHIRD: To publish the complete document of the General Management Plan for the Pájaro Campana Biological Reserve on the institutional website of SINAC, http://www.sinac.go.cr.\n\nFOURTH: It becomes effective upon its publication in the Official Gazette La Gaceta."
