del\nartículo 2 de la ley N° 5695, Creación del Registro Nacional, y sus\nreformas; y modificación de la ley N° 59, Creación y Organización del Instituto\nGeográfico Nacional, de 4 de julio de 1944, y sus reformas de fecha 7 de\ndiciembre del 2010; ley N.º 6043 Ley sobre la Zona Marítimo Terrestre del\n2 de marzo de 1977, con su respectivo reglamento y; artículos 2 y 3 de la ley\nN.º 5695 Ley de Creación del Registro Nacional de fecha 28 de mayo de 1975 y\nsus reformas.\n\nConsiderando:\n\n1º-Que mediante ley Nº 8905 se establece el Instituto\nGeográfico Nacional, en adelante IGN, como una dependencia del Registro\nNacional, quien suscribirá los contratos y convenios necesarios para el\nejercicio de sus funciones. Asimismo, de conformidad con la ley Nº 59, el IGN es\nla dependencia científica y técnica rectora de la cartografía nacional,\ndestinada a la ejecución del Mapa básico oficial y la Descripción básica\ngeográfica de la República de Costa Rica y a los estudios, las investigaciones\no labores y el desarrollo de políticas nacionales de carácter cartográfico,\ngeográfico, geodésico, geofísico y de índole similar que tenga relación con\ndichas obras, con el fin de apoyar los procesos de planificación.\n\n2º-Que la ley Nº 59 constituye al IGN de manera permanente y en representación\ndel Estado, como la autoridad oficial en materia geodésica y de la\nrepresentación espacial de la geografía de la República de Costa Rica,\nextendiéndose su autoridad a las actividades de cualquier orden que tengan por\norigen los trabajos confiados a su cargo.\n\n3º-Que de conformidad con la ley N.º 59; el artículo 62 del Decreto\nEjecutivo Nº 7841-P denominado Reglamento a la Ley sobre la Zona Marítimo\nTerrestre se reconoce la competencia del IGN para la delimitación de la\nzona pública e la Zona Marítimo Terrestre, y su oficialización a través de\npublicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto\nEjecutivo Nº 7841-P señala que El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre\nen que haya demarcado la zona pública.\n\n4º-Que en el Decreto Ejecutivo Nº 36642-MP-MOPT-MINAET Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre,\ndel 28 de junio del 2011, de conformidad con los artículos 18, 19 y 20\nestablece que los tipos de delimitación de la Zona Pública de la Zona Marítimo\nTerrestre, el IGN podrá acudir a dos metodologías de ejecución a saber: a) delimitación\na través de la colocación de mojones y; b) delimitación digital\ngeorreferenciada, que es una metodología que permite la georreferenciación de\nla pleamar ordinaria, a partir de coordenadas en el sistema de referencia\noficial del país, establecido por el Decreto Ejecutivo N.º 33797-MJ-MOPT\ntitulado. Declara como datum horizontal oficial\npara Costa Rica, el CR05, enlazado al Marco Internacional de Referencia\nTerrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS)\npara la época de medición 2005.83, sin que sea necesario la colocación de\nmojones, con el fin de agilizar las delimitaciones y proporcionar mayor\nseguridad técnica a los interesados.\n\n5º-Que en el Decreto Ejecutivo N.º 33797-MJ-MOPT, el cual entre otros\naspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05,\ny su proyección cartográfica asociada CRTM05, como el sistema oficial al cual\ndeben estar referidas las coordenadas de todos los trabajos geodésicos,\ncartográficos y catastrales que se ejecuten en nuestro país, señalando\nespecíficamente en su artículo 11 que La Red Geodésica Nacional de\nReferencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05,\nconstituirán el único sistema oficial de coordenadas para la República de Costa\nRica a partir del cual se debe referenciar todos los levantamientos y actividades\ncartográficos y geodésicos que desarrollen en el Territorio Nacional toda\ndependencia pública, persona o entidad privada nacional o extranjera que\nemprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose de\nesta forma a evitar el gasto público y obteniendo por otra parte información\ngeográfica confiable, uniforme y comparable que sea de utilidad general y que\napoye la toma de decisiones en los distintos niveles del Estado.; mientras que\nel artículo 7 indica que Conforme se produzcan datos cartográficos en el nuevo\nsistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional\npublicará por los medios adecuados aquella información que se ha oficializado.\n\n6º-Que el Decreto Ejecutivo N.º 40962-MJP Actualización del Sistema\nGeodésico de Referencia Horizontal Oficial para Costa Rica declara en su\nartículo 1 que El sistema geodésico de referencia horizontal oficial para Costa\nRica, denominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), para la época de\nmedición 2014.59, y en adelante, los cambios y su actualización, se regirán de\nacuerdo a las nuevas definiciones del ITRF que se implementen en la red\ncontinental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS)\ndenominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de\nproyección cartográfica CRTM05 seguirá siendo el oficial para la representación\ncartográfica del territorio nacional continental, extendido para efectos de\naplicación de esta proyección cartográfica, hasta la línea de base del mar\nterritorial en el océano Pacífico y el mar Caribe, definida esta línea conforme\na los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el\nDerecho del Mar, como punto de partida para el cómputo de la anchura máxima de\ntodas las áreas marinas jurisdiccionales del Estado costarricense.\n\nPor su parte, el artículo 12 del decreto de cita, refuerza la aplicación de\nla proyección cartográfica CRTM05 como el sistema nacional de coordenadas\noficial a la cual se deben referenciar en el territorio continental de nuestro\npaís, al señalar que El sistema de referencia horizontal CRSIRGAS y su\nproyección cartográfica asociada CRTM05 para el territorio continental\nextendido hasta la línea de base del mar territorial y, la proyección\ncartográfica \"Universal Transversal de Mercator\"\n(U'TM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el\nocéano Pacífico y el mar Caribe, constituirán el único sistema oficial de\ncoordenadas para la República de Costa Rica, a partir del cual, se deben\nreferenciar todos los levantamientos y actividades cartográficos y geodésicos\nque desarrollen en el territorio nacional toda dependencia pública, persona o\nentidad privada, nacional o extranjera, que emprendan o contraten trabajos\ngeodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo,\npor otra parte, información geográfica confiable, uniforme y comparable, que\nsea de utilidad general y que apoye la toma de decisiones en los distintos\nniveles del Estado.\n\n7º-Que la georreferenciación al sistema nacional de coordenadas como mecanismo\npara delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la\ncorrecta delimitación de la zona pública a los efectos de la elaboración de\nplanes reguladores, el visado de planos de agrimensura, el otorgamiento de\nconcesiones en la Zona Restringida y otros aspectos de ordenamiento territorial\ncostero.\n\n8º-Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona\nMarítimo Terrestre que posee el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del\nInstituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre.\n\n9º-Que la GDG del IGN sobre la Zona Marítimo Terrestre se fundamenta\ntécnicamente en aplicación de la regulación establecida por: a) el Decreto\nEjecutivo N.º 7841- P; b) el Decreto Ejecutivo Nº 33797-MJ-MOPT y; c) el\nDecreto Ejecutivo N.º 36642-MP-MOPT-MINAET, todos previamente citados.\n\n10.-Que la ley Nº 7575 denominada Ley Forestal del 13 de febrero de 1996 en\nsu artículo 16 establece que el Ministerio del Ambiente y Energía delimitará en\nel terreno, los linderos de las áreas que conforman el Patrimonio Natural del\nEstado.\n\n11.-Que la ley Nº 6043 establece en su artículo 1 del CAPÍTULO I,\nDisposiciones Generales que La zona marítimo terrestre constituye parte del\npatrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Su\nprotección, así como la de sus recursos naturales, es obligación del Estado, de\nsus instituciones y de todos los habitantes del país. Su uso y aprovechamiento\nestán sujetos a las disposiciones de esta ley.\n\n12.-Que según el artículo 11 del CAPÍTULO\nI, Disposiciones Generales\nde la ley Nº 6043, establece que la Zona pública es también,\nsea cual fuere su extensión, la ocupada por todos\nlos manglares de los litorales continentales\ne insulares y esteros del territorio nacional.\n\n13.-Que el Decreto Ejecutivo N.º 36786-MINAET titulado Manual para la\nclasificación de tierras dedicadas a la conservación de los recursos naturales\ndentro de la Zona Marítimo Terrestre en Costa Rica publicado en La\nGaceta N.º 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar\ndentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como\nbosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares,\nesteros, rías, marismas, lagunas costeras, pantanos, bosques anegados,\nsalitrales), para certificarlos e incorporarlos como parte del Patrimonio\nNatural del Estado (PNE).\n\n14.-Que el Decreto Ejecutivo N.º 36786-MINAET en el punto III.-Competencias\npara la delimitación y certificación establece que La clasificación\nde los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC)\ndel Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales\nprivados debidamente acreditados por los Colegios Profesionales respectivos\npara que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase\nVII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos,\nbosques anegados, salitrales) y humedales.\n\nLa validez de\nlos documentos de clasificación emitidos por profesionales privados quedará\nsujeta a la aprobación que emita el AC que por competencia territorial le\ncorresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá,\nademás, la verificación, fiscalización, deslinde y certificación de las tierras\ndel Patrimonio Natural del Estado y las zonas de protección.\n\nLa ubicación y\ndelimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona\nMarítimo Terrestre, debe realizarse como parte del proceso de aprobación del\nPlan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan\nRegulador Costero es el instrumento de ordenamiento territorial, que define y\nubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de\nésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero\ndebe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en\nel área total a concesionar.\n\n15.-Que mediante el oficio SINAC-ACOSA-D-393-2021 de fecha 23 de junio del\n2021 suscrito por la Sra. Laura Rivera Quintanilla, Directora a. í. del Área de\nConservación Osa del Sistema de Áreas de Conservación del Ministerio de\nAmbiente y Energía, se solicita el visto bueno por parte del Instituto\nGeográfico Nacional para la publicación de los trabajos de delimitación a cargo\ndel Ing. Likewise, in accordance with Law No. 59, the IGN is\nthe scientific and technical body governing national cartography,\ntasked with the execution of the official Basic Map and the basic geographical\nDescription of the Republic of Costa Rica and with the studies, research,\nor work and the development of national policies of a cartographic,\ngeographical, geodetic, geophysical, and similar nature related to\nsaid works, in order to support planning processes.\n\n2º—That Law No. 59 establishes the IGN permanently and on behalf\nof the State, as the official authority in geodetic matters and the\nspatial representation of the geography of the Republic of Costa Rica,\nits authority extending to activities of any kind that originate\nfrom the works entrusted to its charge.\n\n3º—That in accordance with Law No. 59; Article 62 of the Executive\nDecree No. 7841-P called Regulation to the Law on the Maritime Terrestrial\nZone recognizes the competence of the IGN for the demarcation of the\npublic zone (zona pública) of the Maritime Terrestrial Zone (Zona Marítimo Terrestre), and its officialization through\npublication in the Official Gazette La Gaceta; Article 63 of the Executive\nDecree No. 7841-P indicates that The National Geographic Institute must\npublish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone\nin which it has demarcated the public zone (zona pública).\n\n4º—That in Executive Decree No. 36642-MP-MOPT-MINAET Regulation of\nSpecifications for the Demarcation of the public zone (zona pública) of the Maritime Terrestrial Zone (Zona Marítimo Terrestre),\nof June 28, 2011, in accordance with Articles 18, 19, and 20,\nit establishes the types of demarcation of the Public Zone (Zona Pública) of the Maritime Terrestrial\nZone, the IGN may use two execution methodologies, namely: a) demarcation\nthrough the placement of boundary markers (mojones) and; b) georeferenced digital\ndemarcation, which is a methodology that allows the georeferencing of\nthe ordinary high-water mark (pleamar ordinaria), based on coordinates in the official reference system\nof the country, established by Executive Decree No. 33797-MJ-MOPT\ntitled. Declares as the official horizontal datum\nfor Costa Rica, the CR05, linked to the International Terrestrial Reference\nFrame (ITRF2000) of the International Earth Rotation Service (IERS)\nfor the measurement epoch 2005.83, without the need for the placement of\nboundary markers (mojones), in order to expedite demarcations and provide greater\ntechnical security to interested parties.\n\n5º—That in Executive Decree No. 33797-MJ-MOPT, which among other\naspects determines, the National Geodetic Network of Horizontal Reference CR05,\nand its associated cartographic projection CRTM05, as the official system to which\nthe coordinates of all geodetic,\ncartographic, and cadastral works executed in our country must be referenced, specifically\nstating in its Article 11 that The National Geodetic Network of\nHorizontal Reference CR05 and the cartographic projection system CRTM05,\nwill constitute the only official coordinate system for the Republic of Costa\nRica, based on which all cartographic and geodetic surveys and activities\ncarried out within the National Territory must be referenced by any\npublic agency, person, or private national or foreign entity that\nundertakes or contracts geodetic and cartographic works, thereby contributing\nto avoiding public expenditure and obtaining, on the other hand, reliable,\nuniform, and comparable geographic information that is of general utility and that\nsupports decision-making at the different levels of the State.; b) Executive Decree No. 33797-MJ-MOPT and; c)\nExecutive Decree No. 36642-MP-MOPT-MINAET, all previously cited.\n\n10.—That Law No. 7575 called Forestry Law (Ley Forestal) of February 13, 1996, in\nits Article 16 establishes that the Ministry of Environment and Energy will demarcate on\nthe ground, the boundaries of the areas that make up the State's Natural Heritage (Patrimonio Natural del Estado).\n\n11.—That Law No. 6043 establishes in its Article 1 of CHAPTER I,\nGeneral Provisions that The maritime terrestrial zone (zona marítimo terrestre) constitutes part of the\nnational heritage, belongs to the State, and is inalienable and imprescriptible. Its\nprotection, as well as that of its natural resources, is an obligation of the State, of\nits institutions, and of all the inhabitants of the country. Its use and exploitation\nare subject to the provisions of this law.\n\n12.—That according to Article 11 of CHAPTER\nI, General Provisions\nof Law No. 6043, it establishes that the public zone (zona pública) is also,\nwhatever its extension, that occupied by all\nthe mangroves of the continental\nand insular coastlines and estuaries (esteros) of the national territory.\n\n13.—That Executive Decree No. 36786-MINAET titled Manual for the\nclassification of lands dedicated to the conservation of natural resources\nwithin the Maritime Terrestrial Zone (Zona Marítimo Terrestre) in Costa Rica published in La\nGaceta No. 217 of November 11, 2011, establishes among its objectives To identify\nwithin the Maritime Terrestrial Zone (Zona Marítimo Terrestre) those lands that classify as\nforests, of forestry aptitude (suelos Clase VII y VIII), wetlands (humedales) (mangroves,\nestuaries (esteros), rias (rías), salt marshes (marismas), coastal lagoons, swamps,\nflooded forests, salt flats (salitrales)), to certify them and incorporate them as part of the State's\nNatural Heritage (Patrimonio Natural del Estado, PNE).\n\n14.—That Executive Decree No. 36786-MINAET in point III.—Competencies\nfor demarcation and certification establishes that The classification\nof lands within the ZMT will correspond to the Conservation Areas (AC)\nof the National System of Conservation Areas (SINAC) and to private\nprofessionals duly accredited by the respective Professional Associations\nto classify forests, lands of forestry aptitude (suelos Clase\nVII y VIII) (mangroves, estuaries (esteros), rias (rías), salt marshes (marismas), coastal lagoons, swamps,\nflooded forests, salt flats (salitrales)) and wetlands (humedales).\n\nThe validity of\nclassification documents issued by private professionals will be\nsubject to the approval issued by the AC that corresponds by territorial\ncompetence. The ACs of SINAC with jurisdiction in the ZMT will also be competent\nfor the verification, supervision, boundary determination (deslinde), and certification of lands\nof the State's Natural Heritage (Patrimonio Natural del Estado) and the protection zones.\n\nThe location and\ndemarcation of the areas of the State's Natural Heritage (Patrimonio Natural del Estado) within the Maritime\nTerrestrial Zone (Zona Marítimo Terrestre), must be carried out as part of the approval process for the\nCoastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal\nRegulatory Plan is the territorial planning instrument that defines and\nlocates all the zones to be concessioned within the ZMT and for the classification\nof the latter at the cadastral plan level.
