zona pública correspondiente a la ría\n\ndel Escaramojo del distrito La Cruz, cantón\n\nLa Cruz, provincia Guanacaste\"\n\nCon fundamento en lo dispuesto en los artículos 140 y\n240, inciso 1 de la Ley N° 6227 Ley General de la Administración Pública de\nfecha 2 de mayo de 1978, Ley N° 59 Ley de Creación del Instituto Geográfico\nNacional vigencia del 1° de enero de 1945, Ley N° 8905 Ley de traslado del\nInstituto Geográfico Nacional al Registro Nacional de fecha 7 de diciembre del\n2010, Ley N° 6043 Ley sobre la Zona Marítimo Terrestre del 2 de marzo de 1977,\ncon su respectivo reglamento y artículos 2 y 3 de la Ley N°5695 Ley de Creación\ndel Registro Nacional de fecha 28 de mayo de 1975 y sus reformas.\n\nConsiderando:\n\n1.-Que mediante Ley N° 8905 se establece el Instituto\nGeográfico Nacional, en adelante IGN, como una dependencia del Registro\nNacional, suscribirá los contratos y convenios necesarios para el ejercicio de\nsus funciones. Asimismo, se establece que el IGN será la dependencia científica\ny técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa\nbásico oficial y la Descripción básica geográfica de la República de Costa Rica\ny a los estudios, las investigaciones o labores y el desarrollo de políticas\nnacionales de carácter cartográfico, geográfico, geodésico, geofísico y de\níndole similar que tenga relación con dichas obras, con el fin de apoyar los\nprocesos de planificación.\n\n2.-Que de conformidad con Ley N° 59 Ley de IGN, lo\nconstituye de manera permanente y en representación del Estado, como la\nautoridad oficial en materia geodésica y de la representación espacial de la\ngeografía de la República, extendiéndose su autoridad a las actividades de\ncualquier orden que tengan por origen los trabajos confiados a su cargo.\n\n3.-Que de conformidad con Ley N° 59 Ley de IGN, y en\nel artículo 62 del Reglamento a la Ley N° 6043, se reconoce la competencia del\nIGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su\noficialización a través de publicación en el Diario Oficial La Gaceta,\nmientras que el artículo 63 del mismo Reglamento, señala que \"El Instituto\nGeográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción\nde la zona marítimo-terrestre en que haya demarcado la zona pública\".\n\n4.-Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET\n\"Reglamento de Especificaciones para la Delimitación de la zona pública de la\nZona Marítimo Terrestre\", del 14 de julio del 2011, se establece según el\nartículo 18° tipos de delimitación, el IGN podrá acudir a dos metodologías de\nejecución, que se indican en los artículos 19 y 20, correspondientes a la\ndelimitación de la zona pública de la Zona Marítimo Terrestre a través de la\ncolocación de mojones y/o a la delimitación digital georreferenciada, esto con\nel fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a\nlos interesados.\n\n5.-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el\ncual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia\nHorizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema\noficial al cual deben estar referidas las coordenadas de todos los trabajos\ngeodésicos, cartográficos y catastrales que se ejecuten en nuestro país,\nseñalando específicamente en artículo 11 que: \"La Red Geodésica Nacional de\nReferencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05,\nconstituirán el único sistema oficial de coordenadas para la República de Costa\nRica a partir del cual se debe referenciar todos los levantamientos y\nactividades cartográficos y geodésicos que desarrollen en el Territorio\nNacional toda dependencia pública, persona o entidad privada nacional o\nextranjera.\" ; mientras que el artículo 7 indica que \"Conforme se\nproduzcan datos cartográficos en el nuevo sistema de proyección cartográfica\nCRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados\naquella información que se ha oficializado.\"\n\n6.-Que el Decreto Ejecutivo N° 40962-MJP\n\"Actualización del Sistema Geodésico de Referencia Horizontal Oficial para\nCosta Rica\" declara que: \"El sistema geodésico de referencia horizontal\noficial para Costa Rica, denominado como CR05 y su materialización mediante la\nRed Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de\nreferencia horizontal oficial para la República de Costa Rica.\" , mientras\nque \"El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial\npara la representación cartográfica del territorio nacional continental.\" Por\nsu parte, el artículo 12 del decreto de cita, refuerza la aplicación de la\nproyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial\na la cual se deben referenciar en el territorio continental de nuestro país, al\nseñalar que \".todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el territorio nacional toda dependencia pública,\npersona o entidad privada, nacional o extranjera, que emprendan o contraten\ntrabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público\ny obteniendo, por otra parte, información geográfica confiable, uniforme y\ncomparable, que sea de utilidad general y que apoye la toma de decisiones en\nlos distintos niveles del Estado.\"\n\nPor su parte, el artículo 12 del decreto de cita,\nrefuerza la aplicación de la proyección cartográfica CRTM05 como el sistema\nnacional de coordenadas oficial a la cual se deben referenciar en el territorio\ncontinental de nuestro país, al señalar que El sistema de referencia\nhorizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el\nterritorio continental extendido hasta la línea de base del mar territorial y,\nla proyección cartográfica \"Universal Transversal de Mercator\" (U'TM), zonas 16\ny 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico\ny el mar Caribe, constituirán el único sistema oficial de coordenadas para la\nRepública de Costa Rica, a partir del cual, se deben referenciar todos los\nlevantamientos y actividades cartográficos y geodésicos que desarrollen en el\nterritorio nacional toda dependencia pública, persona o entidad privada,\nnacional o extranjera, que emprendan o contraten trabajos geodésicos y\ncartográficos.\"\n\n7.-Que la georreferenciación al sistema nacional de\ncoordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo\nTerrestre, posibilita la correcta delimitación de la zona pública a los efectos\nde la elaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n8.-Que la información digital georreferenciada sobre\ndelimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el\nIGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del IGN sobre la\nZona Marítimo Terrestre (ZMT).\n\n9.-Que la GDG del IGN sobre la Zona Marítimo Terrestre\n(ZMT) se fundamenta técnicamente en aplicación de la regulación establecida\npor: a) el Decreto Ejecutivo N°. 7841-P \"Reglamento a la Ley N° 6043 sobre la\nZona Marítimo Terrestre\", b) el Decreto Ejecutivo N° 33797-MJ-MOP y c) el\nDecreto Ejecutivo N°. 36642-MP-MOPT-MINAET ya previamente citados.\n\n10.-Que el artículo 16° de la Ley Forestal, Ley N°.7575\ndel 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía\ndelimitará en el terreno los linderos de las áreas que conforman el Patrimonio\nNatural del Estado.\n\n11.-Que según el artículo 69 de la ley N° 276, Ley de\nAguas, menciona: Por zona marítima se entiende el espacio de las costas de\nla República que baña el mar en su flujo y reflujo y los terrenos inmediatos\nhasta la distancia de una milla, o sean mil seiscientos setenta y dos metros,\ncontados desde la línea que marque la marea alta.\n\nEsta zona\nmarítima se extiende también por las márgenes de los ríos hasta el sitio en que\nsean navegables o se hagan sensibles las mareas, con un ancho de doscientos\nmetros desde cada orilla, contados desde la línea que marque la marea alta.\n\n12.-Que mediante la certificación N° SINAC-SE-IRT-049\nde fecha 09 de febrero del 2018, firmada por Jacklyn Rivera Wong en carácter de\ncoordinadora del Programa Nacional de Humedales, establece el alcance de la ría\ndel Río Escaramojo en el distrito 01 La Cruz, cantón 10 La Cruz, de la\nprovincia 05 Guanacaste.\n\n13.-El IGN, utilizó la metodología de \"Delimitación\nDigital Georreferenciada\" para delimitar la zona pública de la Zona Marítimo\nTerrestre en la ría del Río Escaramojo, ubicado en el distrito 01° La Cruz, cantón\n10° La Cruz de la provincia de 05° Guanacaste.\n\n14.-Que la delimitación realizada cuenta con aval\ntécnico interno del IGN, conforme al oficio N° DIG-TOT-0750-2021 del 01 de\ndiciembre de 2021, emitido por el Subproceso de Límites Oficiales del Departamento\nTopográfico y Observación del Territorio del IGN.\n\n15.-Que el artículo 140 de la Ley N° 6227 Ley General\nde la Administración Pública, señala que \"el acto administrativo producirá\nsu efecto después de comunicado al administrado, excepto si le concede\núnicamente derechos, en cuyo caso lo producirá desde que se adopte\",\ndisposición que necesariamente debe relacionarse con el numeral 240) del mismo\ncuerpo normativo, mismo que define el instrumento idóneo para comunicar actos\nde naturaleza genérica al señalar que: \"Se comunicaran por publicación los\nactos generales y por notificación, los concretos\".\n\nCOMUNICA:\n\n1°-El IGN, utilizó la metodología de \"Delimitación\nDigital Georreferenciada\" para delimitar la zona pública de la Zona Marítimo\nTerrestre en la ría del Río Escaramojo, Likewise, it is established that the IGN shall be the scientific and technical dependency governing national cartography, destined for the execution of the official basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.\n\n2.-That in accordance with Law N° 59 IGN Law, it is constituted permanently and on behalf of the State as the official authority in geodetic matters and for the spatial representation of the geography of the Republic, its authority extending to activities of any kind originating from the works entrusted to its charge.\n\n3.-That in accordance with Law N° 59 IGN Law, and in article 62 of the Regulation to Law N° 6043, the competence of the IGN is recognized for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while article 63 of the same Regulation states that \"The National Geographic Institute must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\n4.-That in Executive Decree N° 36642-MP-MOPT-MINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\", of July 14, 2011, it is established according to article 18° types of delimitation, the IGN may resort to two execution methodologies, indicated in articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.\n\n5.-That in Executive Decree N° 33797-MJ-MOPT, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in article 11 that: \"The National Geodetic Network of Horizontal Reference CR05 and the CRTM05 cartographic projection system shall constitute the only official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed within the National Territory by any public dependency, person, or private entity, national or foreign, must be referenced.\"; while article 7 indicates that \"As cartographic data is produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish by appropriate means that information which has been made official.\"\n\n6.-That Executive Decree N° 40962-MJP \"Update of the Official Horizontal Reference Geodetic System for Costa Rica\" declares that: \"The official horizontal reference geodetic system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica.\", while \"The CRTM05 cartographic projection system shall continue to be the official one for the cartographic representation of the continental national territory.\" In turn, article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by stating that \"...all cartographic and geodetic surveys and activities developed in the national territory by any public dependency, person or private entity, national or foreign, that undertake or contract geodetic and cartographic works, contributing to avoiding public expense and obtaining, on the other hand, reliable, uniform, and comparable geographic information, which is of general utility and supports decision-making at different levels of the State.\"\n\nIn turn, article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by stating that \"The CRSIRGAS horizontal reference system and its associated CRTM05 cartographic projection for the continental territory extended to the baseline of the territorial sea, and the 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the only official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the national territory by any public dependency, person or private entity, national or foreign, that undertake or contract geodetic and cartographic works must be referenced.\"\n\n7.-That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of the preparation of regulatory plans, the approval of cadastral survey plans, the granting of concessions in the Restricted Zone (Zona Restringida) and other aspects of coastal land-use planning.\n\n8.-That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the IGN on the Maritime Terrestrial Zone (ZMT).\n\n9.-That the GDG of the IGN on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree N°. 7841-P \"Regulation to Law N° 6043 on the Maritime Terrestrial Zone\", b) Executive Decree N° 33797-MJ-MOP and c) Executive Decree N°. 36642-MP-MOPT-MINAET, already previously cited.\n\n10.-That article 16° of the Forestry Law (Ley Forestal), Law N°. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that make up the Natural Heritage of the State.\n\n11.-That according to article 69 of Law N° 276, Water Law, it mentions: \"Maritime zone is understood as the space of the coasts of the Republic that the sea bathes in its ebb and flow and the immediate lands up to the distance of one mile, that is one thousand six hundred seventy-two meters, counted from the line marking the high tide.\n\nThis maritime zone also extends along the banks of rivers up to the site where they are navigable or the tides become perceptible, with a width of two hundred meters from each shore, counted from the line marking the high tide.\"\n\n12.-That by means of certification N° SINAC-SE-IRT-049 dated February 9, 2018, signed by Jacklyn Rivera Wong in her capacity as coordinator of the National Wetlands Program, it establishes the extent of the Escaramojo River estuary in district 01 La Cruz, canton 10 La Cruz, of province 05 Guanacaste.\n\n13.-The IGN used the \"Georeferenced Digital Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in the Escaramojo River estuary, located in district 01° La Cruz, canton 10° La Cruz of province 05° Guanacaste.\n\n14.-That the completed delimitation has the internal technical endorsement of the IGN, in accordance with official communication N° DIG-TOT-0750-2021 of December 1, 2021, issued by the Official Limits Subprocess of the Topographic and Territory Observation Department of the IGN.\n\n15.-That article 140 of Law N° 6227 General Law on Public Administration states that \"the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce them from the moment it is adopted,\" a provision that must necessarily be related to numeral 240) of the same normative body, which defines the appropriate instrument for communicating acts of a generic nature by stating that: \"General acts shall be communicated by publication and specific acts by notification.\"\n\nCOMMUNICATES:\n\n1°-The IGN used the \"Georeferenced Digital Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in the Escaramojo River estuary, located in district 01° La Cruz, canton 10° La Cruz of province 05° Guanacaste based on official communication SINAC-SE-IRT049 dated February 9, 2018 signed by Jacklyn Rivera Wong in her capacity as Coordinator of the National Wetlands Program.\n\n2°-The public zone of the Maritime Terrestrial Zone corresponding to the Escaramojo River, located in district 01° La Cruz, canton 10° La Cruz of province 05° Guanacaste, is given in the official cartographic projection system of Costa Rica CRTM05, under the following coordinates:\n\n| CRTM05 Coordinates | North (m) | East (m) |\n| --- | --- | --- |\n| Escaramojo River Estuary | 1220975.00 | 317698.00 |\n\n3°-The sectors located in district 01° La Cruz of canton 10° La Cruz, of province 05° Guanacaste that to date have delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official condition.\n\n4°-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone corresponding to the Escaramojo River estuary, located in district 01° La Cruz, canton 10° La Cruz of province 05° Guanacaste, have been registered in the Georeferenced Digital Geodatabase (GDG) of the IGN on the Maritime Terrestrial Zone (ZMT), in a vector format shape file, under the coding:\n\nRN/IGN_GDG-IGN-ZMT_Rias.\n\n5°-Takes effect from its publication.\n\nGiven in Curridabat, San José, on the 24th day of the month of February of the year 2022." }
