artículos 140 y\n240 de la ley N° 6227 Ley General de la Administración Pública de fecha\n2 de mayo de 1978; ley N° 59 Ley de Creación y Organización del Instituto\nGeográfico Nacional del 4 de julio y 3 de la ley\nN° 5695 Ley de Creación del Registro Nacional de fecha 28 de mayo de\n1975 y sus reformas.\n\nConsiderando:\n\n1.-Que mediante ley N° 8905 se establece el Instituto\nGeográfico Nacional, en adelante IGN, como una dependencia del Registro\nNacional, quien suscribirá los contratos y convenios necesarios para el\nejercicio de sus funciones. Asimismo, de conformidad con la ley N° 59, el IGN es\nla dependencia científica y técnica rectora de la cartografía nacional, destinada\na la ejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el\ndesarrollo de políticas nacionales de carácter cartográfico, geográfico,\ngeodésico, geofísico y de índole similar que tenga relación con dichas obras,\ncon el fin de apoyar los procesos de planificación.\n\n2.-Que la ley N° 59 constituye al IGN de manera\npermanente y en representación del Estado, como la autoridad oficial en materia\ngeodésica y de la representación espacial de la geografía de la República de\nCosta Rica, extendiéndose su autoridad a las actividades de cualquier orden que\ntengan por origen los trabajos confiados a su cargo.\n\n3.-Que de conformidad con la ley N° 59; el artículo 62\ndel Decreto Ejecutivo N° 7841-P denominado Reglamento a la Ley sobre la Zona\nMarítimo Terrestre se reconoce la competencia del IGN para la delimitación\nde la zona pública de la Zona Marítimo Terrestre, y su oficialización a través\nde publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto\nEjecutivo N.° 7841-P señala que El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública.\n\n4.-Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET\nReglamento de Especificaciones para la Delimitación de la zona pública de la\nZona Marítimo Terrestre, del 28 de junio del 2011, de conformidad con los\nartículos 18, 19 y 20 establece que los tipos de delimitación de la Zona\nPública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías\nde ejecución a saber: a) delimitación a través de la colocación de mojones y;\nb) delimitación digital georreferenciada, que es una metodología que permite la\ngeorreferenciación de la pleamar ordinaria, a partir de coordenadas en el\nsistema de referencia oficial del país, establecido por el Decreto Ejecutivo N°\n33797-MJ-MOPT titulado Declara como datum horizontal oficial para Costa\nRica, el CR05, enlazado al Marco Internacional de Referencia Terrestre\n(ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para\nla época de medición 2005.83, sin que sea necesario la colocación de mojones,\ncon el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica\na los interesados.\n\n5.-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el\ncual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia\nHorizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema\noficial al cual deben estar referidas las coordenadas de todos los trabajos\ngeodésicos, cartográficos y catastrales que se ejecuten en nuestro país,\nseñalando específicamente en su artículo 11 que La Red Geodésica Nacional de\nReferencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05,\nconstituirán el único sistema oficial de coordenadas para la República de Costa\nRica a partir del cual se debe referenciar todos los levantamientos y\nactividades cartográficos y geodésicos que desarrollen en el Territorio\nNacional toda dependencia pública, persona o entidad privada nacional o\nextranjera que emprendan o contraten trabajos geodésicos y cartográficos,\ncontribuyéndose de esta forma a evitar el gasto público y obteniendo por otra\nparte información geográfica confiable, uniforme y comparable que sea de\nutilidad general y que apoye la toma de decisiones en los distintos niveles del\nEstado.; mientras que el artículo 7 indica que Conforme se produzcan datos\ncartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto\nGeográfico Nacional publicará por los medios adecuados aquella información que\nse ha oficializado.\n\n6.-Que el Decreto Ejecutivo N° 40962-MJP Actualización\ndel Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara\nen su artículo 1 que El sistema geodésico de referencia horizontal oficial para\nCosta Rica, denominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), para la época de\nmedición 2014.59, y en adelante, los cambios y su actualización, se regirán de\nacuerdo a las nuevas definiciones del ITRF que se implementen en la red continental\ndel Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada\nSIRGAS-CON, mientras que el artículo 2 establece que El sistema de proyección\ncartográfica CRTM05 seguirá siendo el oficial para la representación\ncartográfica del territorio nacional continental, extendido para efectos de\naplicación de esta proyección cartográfica, hasta la línea de base del mar\nterritorial en el océano Pacífico y el mar Caribe, definida esta línea conforme\na los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el\nDerecho del Mar, como punto de partida para el cómputo de la anchura máxima de\ntodas las áreas marinas jurisdiccionales del Estado costarricense.\n\nPor su parte, el artículo 12 del decreto de cita,\nrefuerza la aplicación de la proyección cartográfica CRTM05 como el sistema\nnacional de coordenadas oficial a la cual se deben referenciar en el territorio\ncontinental de nuestro país, al señalar que \"El sistema de referencia\nhorizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el\nterritorio continental extendido hasta la línea de base del mar territorial y,\nla proyección cartográfica \"Universal Transversal de Mercator\" (U'TM), zonas 16\ny 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico\ny el mar Caribe, constituirán el único sistema oficial de coordenadas para la\nRepública de Costa Rica, a partir del cual, se deben referenciar todos los\nlevantamientos y actividades cartográficos y geodésicos que desarrollen en el\nterritorio nacional toda dependencia pública, persona o entidad privada,\nnacional o extranjera.\"\n\n7.-Que la georreferenciación al sistema nacional de\ncoordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo\nTerrestre, posibilita la correcta delimitación de la zona pública a los efectos\nde la elaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n8.-Que la información digital georreferenciada sobre\ndelimitación de la zona pública de la Zona Marítimo Terrestre que posee el IGN,\nse le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto\nGeográfico Nacional (IGN) sobre la Zona Marítimo Terrestre.\n\n9.-Que la GDG del IGN sobre la Zona Marítimo Terrestre\nse fundamenta técnicamente en aplicación de la regulación establecida por: a)\nel Decreto Ejecutivo N.º 7841-P; b) el Decreto Ejecutivo N° 33797-MJ-MOPT y; c)\nel Decreto Ejecutivo N° 36642-MP-MOPT-MINAET, todos previamente citados.\n\n10.-Que la ley\nN° 7575 denominada Ley Forestal del 13 de febrero de 1996 en su artículo 16\nestablece que el Ministerio del Ambiente y Energía delimitará en el terreno,\nlos linderos de las áreas que conforman el Patrimonio Natural del Estado.\n\n11.-Que la ley N° 6043 establece en su artículo 1 del\nCapítulo I, que: La zona marítimo terrestre constituye parte del patrimonio\nnacional, pertenece al Estado y es inalienable e imprescriptible. Su\nprotección, así como la de sus recursos naturales, es obligación del Estado, de\nsus instituciones y de todos los habitantes del país. Su uso y aprovechamiento\nestán sujetos a las disposiciones de esta ley.\n\n12.-Que según el artículo 11 del Capítulo I, de la ley\nN° 6043, establece que la Zona pública es también, sea cual fuere su extensión,\nla ocupada por todos los manglares de los litorales continentales e insulares y\nesteros del territorio nacional.\n\n13.-Que el Decreto Ejecutivo N° 36786-MINAET titulado Manual\npara la clasificación de tierras dedicadas a la conservación de los recursos\nnaturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La\nGaceta N° 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar\ndentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como\nbosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares,\nesteros, rías, marismas, lagunas costeras, pantanos, bosques anegados,\nsalitrales), para certificarlos e incorporarlos como parte del Patrimonio\nNatural del Estado (PNE).\n\n14.-Que el Decreto Ejecutivo N° 36786-MINAET en el\npunto III.-Competencias para la delimitación y certificación establece que\nLa clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de\nConservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a\nprofesionales privados debidamente acreditados por los Colegios Profesionales\nrespectivos para que clasifiquen los bosques, terrenos de aptitud forestal\n(suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas\ncosteras, pantanos, bosques anegados, salitrales) y humedales.\n\nLa validez de los documentos de clasificación emitidos\npor profesionales privados quedará sujeta a la aprobación que emita el AC que\npor competencia territorial le corresponda. A las AC del SINAC con jurisdicción\nen la ZMT les competerá, además, la verificación, fiscalización, deslinde y\ncertificación de las tierras del Patrimonio Natural del Estado y las zonas de\nprotección.\n\nLa ubicación y delimitación de las áreas del\nPatrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe\nrealizarse como parte del proceso de aprobación del Plan Regulador Costero\n(PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el\ninstrumento de ordenamiento territorial, que define y ubica todas las zonas a\nconcesionar dentro de la ZMT y para la clasificación de ésta a nivel de los\nplanos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y\nexpresamente, las áreas del PNE para no contabilizarlas en el área total a\nconcesionar.\n\n15.-Que mediante el oficio ACT-OR-T-794-2021 de fecha\n15 de julio de 2021, suscrito por el Sr. Fabián Bonilla Salguero, Ingeniero del\nÁrea de Conservación Tempisque del Sistema de Áreas de Conservación del\nMinisterio de Ambiente y Energía, dirigido a Ing. Law No. 59, Law for the Creation and Organization of the National\nGeographic Institute, dated July 4, 1944; Law No. 8905, Reform of\nArticle 2 of Law No. 5695, Creation of the National Registry, and its\namendments; and amendment of Law No. 59, Creation and Organization of the National\nGeographic Institute, of July 4, 1944, and its amendments, dated December 7,\n2010; Law No. 6043, Law on the Maritime Terrestrial Zone of\nMarch 2, 1977, with its respective regulation and; articles 2 and 3 of Law\nNo. 5695, Law for the Creation of the National Registry, dated May 28,\n1975 and its amendments.\n\nConsidering:\n\n1.-That by means of Law No. 8905, the National\nGeographic Institute, hereinafter IGN, is established as a dependency of the National\nRegistry, which shall sign the contracts and agreements necessary for the\nexercise of its functions. Likewise, in accordance with Law No. 59, the IGN is\nthe scientific and technical dependency governing national cartography, destined\nfor the execution of the official Basic Map and the basic geographic Description of the\nRepublic of Costa Rica, and for studies, investigations or work, and the\ndevelopment of national policies of a cartographic, geographic,\ngeodetic, geophysical, and similar nature related to said works,\nwith the purpose of supporting planning processes.\n\n2.-That Law No. 59 constitutes the IGN permanently\nand in representation of the State, as the official authority in geodetic\nmatters and of the spatial representation of the geography of the Republic of\nCosta Rica, its authority extending to activities of any order that\noriginate from the work entrusted to its charge.\n\n3.-That in accordance with Law No. 59; Article 62\nof Executive Decree No. 7841-P, called Regulation to the Law on the Maritime\nTerrestrial Zone, recognizes the competence of the IGN for the delimitation\nof the public zone of the Maritime Terrestrial Zone, and its formalization through\npublication in the Official Gazette La Gaceta; Article 63 of Executive\nDecree No. 7841-P indicates that the National Geographic Institute must\npublish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\n\n4.-That in Executive Decree No. 36642-MP-MOPT-MINAET,\nRegulation of Specifications for the Delimitation of the public zone of the\nMaritime Terrestrial Zone, dated June 28, 2011, in accordance with\nArticles 18, 19, and 20, it establishes that for the types of delimitation of the Public\nZone of the Maritime Terrestrial Zone, the IGN may resort to two execution\nmethodologies, namely: a) delimitation through the placement of boundary markers (mojones) and;\nb) georeferenced digital delimitation, which is a methodology that allows the\ngeoreferencing of the ordinary high tide line (pleamar ordinaria) based on coordinates in the\nofficial reference system of the country, established by Executive Decree No.\n33797-MJ-MOPT, titled \"Declares CR05 as the official horizontal datum for Costa\nRica, linked to the International Terrestrial Reference Frame\n(ITRF2000) of the International Earth Rotation Service (IERS) for\nthe measurement epoch 2005.83,\" without the need for placing boundary markers (mojones),\nin order to expedite delimitations and provide greater technical security\nto interested parties.\n\n5.-That in Executive Decree No. 33797-MJ-MOPT, which,\namong other aspects, determines the National Geodetic Horizontal Reference Network\nCR05, and its associated cartographic projection CRTM05, as the official\nsystem to which the coordinates of all geodetic, cartographic, and cadastral\nwork executed in our country must be referenced,\nspecifically indicating in its Article 11 that \"The National Geodetic Horizontal\nReference Network CR05 and the CRTM05 cartographic projection system\nshall constitute the single official coordinate system for the Republic of Costa\nRica, based on which all cartographic and geodetic surveys and\nactivities developed in the National Territory by any public agency,\nperson, or national or foreign private entity that undertakes or contracts\ngeodetic and cartographic work must be referenced,\nthus contributing to avoiding public expenditure and, on the other hand, obtaining\nreliable, uniform, and comparable geographic information that is of\ngeneral utility and supports decision-making at different levels of the State.\";\nwhile Article 7 indicates that \"As cartographic data are produced\nin the new CRTM05 cartographic projection system, the National\nGeographic Institute shall publish by appropriate means that information which\nhas been made official.\"\n\n6.-That Executive Decree No. 40962-MJP, Update\nof the Official Horizontal Geodetic Reference System for Costa Rica, declares\nin its Article 1 that \"The official horizontal geodetic reference system for\nCosta Rica, called CR05 and its materialization through the National Geodetic\nNetwork, changes its acronym to CRSIRGAS, as the official horizontal reference\nsystem for the Republic of Costa Rica, linked to the International\nTerrestrial Reference Frame ITRF2008 (IGb08), for the measurement\nepoch 2014.59, and henceforth, changes and their update shall be governed\naccording to the new ITRF definitions implemented in the continental network\nof the Geocentric Reference System for the Americas (SIRGAS) called\nSIRGAS-CON,\" while Article 2 establishes that \"The CRTM05 cartographic projection\nsystem shall continue to be the official system for the cartographic\nrepresentation of the continental national territory, extended, for the purposes of\napplication of this cartographic projection, to the baseline of the territorial\nsea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance\nwith Articles 5, 6, and 7 of the United Nations Convention on the\nLaw of the Sea, as the starting point for calculating the maximum width of\nall jurisdictional marine areas of the Costa Rican State.\"\n\nFor its part, Article 12 of the cited decree\nreinforces the application of the CRTM05 cartographic projection as the\nofficial national coordinate system to which all work must be referenced in the continental\nterritory of our country, by indicating that \"The horizontal reference\nsystem CRSIRGAS and its associated cartographic projection CRTM05 for the\ncontinental territory extended to the baseline of the territorial sea, and\nthe 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16\nand 17 for the jurisdictional marine and insular areas in the Pacific Ocean\nand the Caribbean Sea, shall constitute the single official coordinate system for the\nRepublic of Costa Rica, based on which all\ncartographic and geodetic surveys and activities developed in the\nnational territory by any public agency, person, or private entity,\nnational or foreign, must be referenced.\"\n\n7.-That georeferencing to the national coordinate\nsystem as a mechanism to delimit the public zone of the Maritime Terrestrial\nZone enables the correct delimitation of the public zone for the purposes\nof developing regulatory plans (planes reguladores), endorsing survey plans (planos de agrimensura),\ngranting concessions in the Restricted Zone, and other aspects of\ncoastal land-use planning (ordenamiento territorial costero).\n\n8.-That the georeferenced digital information on the\ndelimitation of the public zone of the Maritime Terrestrial Zone held by the IGN\nis called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National\nGeographic Institute (IGN) on the Maritime Terrestrial Zone.\n\n9.-That the GDG of the IGN on the Maritime Terrestrial Zone\nis technically based on the application of the regulation established by: a)\nExecutive Decree No. 7841-P; b) Executive Decree No. 33797-MJ-MOPT and; c)\nExecutive Decree No. 36642-MP-MOPT-MINAET, all previously cited.\n\n10.-That Law\nNo. 7575, called the Forestry Law (Ley Forestal), dated February 13, 1996, in its Article 16\nestablishes that the Ministry of Environment and Energy shall delimit on the ground\nthe boundaries of the areas that constitute the Natural Heritage of the State (Patrimonio Natural del Estado).\n\n11.-That Law No. 6043 establishes in its Article 1 of\nChapter I that: \"The maritime terrestrial zone constitutes part of the national\nheritage, belongs to the State, and is inalienable and imprescriptible. Its\nprotection, as well as that of its natural resources, is the obligation of the State, of\nits institutions, and of all the inhabitants of the country. Its use and exploitation\nare subject to the provisions of this law.\"\n\n12.-That according to Article 11 of Chapter I of Law\nNo. 6043, it establishes that the Public Zone is also, whatever its extent,\nthat occupied by all the mangroves of the continental and insular coastlines and\nestuaries (esteros) of the national territory.\n\n13.-That Executive Decree No. 36786-MINAET, titled Manual\nfor the classification of lands dedicated to the conservation of natural\nresources within the Maritime Terrestrial Zone in Costa Rica, published in La\nGaceta No. 217 of November 11, 2011, establishes among its objectives to \"Identify\nwithin the Maritime Terrestrial Zone those lands that classify as\nforests, of forestry aptitude (forestry aptitude (suelos Clase VII y VIII)), wetlands (mangroves,\nestuaries (esteros), rias (rías), salt marshes (marismas), coastal lagoons (lagunas costeras), swamps (pantanos), flooded forests (bosques anegados),\nsalt flats (salitrales)), in order to certify them and incorporate them as part of the\nNatural Heritage of the State (Patrimonio Natural del Estado, PNE).\"\n\n14.-That Executive Decree No. 36786-MINAET, in\npoint III.-Competencies for delimitation and certification, establishes that\n\"The classification of lands within the MTZ shall correspond to the Conservation\nAreas (Áreas de Conservación, AC) of the National System of Conservation Areas (SINAC) and to\nprivate professionals duly accredited by the respective Professional\nAssociations (Colegios Profesionales) to classify forests, lands of forestry aptitude\n(forestry aptitude (suelos Clase VII y VIII)), (mangroves, estuaries (esteros), rias (rías), salt marshes (marismas), coastal lagoons (lagunas\ncosteras), swamps (pantanos), flooded forests (bosques anegados), salt flats (salitrales)), and wetlands.\n\nThe validity of the classification documents issued\nby private professionals shall be subject to the approval issued by the AC that,\nby territorial competence, corresponds. The ACs of SINAC with jurisdiction\nin the MTZ shall also be responsible for the verification, oversight, demarcation (deslinde), and\ncertification of the lands of the Natural Heritage of the State and the protection\nzones.\n\nThe location and delimitation of the areas of the\nNatural Heritage of the State within the Maritime Terrestrial Zone must\nbe carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador\nCostero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the\ninstrument of land-use planning (ordenamiento territorial) that defines and locates all the zones to\nbe concessioned within the MTZ, and for its classification at the level of\ncadastral plans (planos de catastro). Therefore, the Coastal Regulatory Plan must clearly and\nexpressly indicate the PNE areas so as not to count them in the total area to\nbe concessioned.\"\n\n15.-That by means of official letter ACT-OR-T-794-2021, dated\nJuly 15, 2021, signed by Mr. Fabián Bonilla Salguero, Engineer of the\nTempisque Conservation Area of the System of Conservation Areas of the\nMinistry of Environment and Energy, addressed to Engineer Omar Sotelo Porras of the\nNational Geographic Institute, approval (visto bueno) is granted to the survey carried out\nby the company Topografía Reyes Sociedad Anónima, legal identification number (cédula jurídica) No.\n3-101246302.\n\n16.-That by means of the report called \"Survey Report\nCarried Out by the Company Topografía Francisco Reyes\"\nprepared by José Francisco Reyes Cordero, identification number (cédula) No. 1-0965-0870, of the\ncompany Topografía Francisco Reyes Sociedad Anónima, at the request of Laura\nPatricia Camacho Solís, identification number (cédula) 1-1660-0541, in her capacity as Special\nAttorney-in-Fact (Apoderada Especial) of the company Santa Lucía de Zona Azul Sociedad de Responsabilidad\nLimitada, with legal identification the\nTopographic and Territory Observation Department of the IGN, the\nDirectorate of the National Geographic Institute was informed that the work carried out by\nthe company Topografía Francisco Reyes Sociedad Anónima has the technical\nendorsement for its publication.\n\n18.-That Article 140 of Law No. 6227 indicates that \"The\nadministrative act shall produce its effect after being communicated to the administered party,\nexcept if it grants only rights, in which case it shall produce it from\nthe time it is adopted,\" a provision that must necessarily be related to Article\n240 of the same regulatory body, which defines the ideal instrument for\ncommunicating acts of a generic nature by indicating that \"General\nacts shall be communicated by publication, and specific ones by notification.\"\n\nCOMMUNICATES:\n\n1°-The National Geographic Institute publishes, in the sector\nof Pochote, located in district 05 Paquera, of canton 01 Puntarenas, of the\nprovince 06
