  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 060\n\n                        Establece el límite de gasto al Fondo Nacional de Financiamiento Forestal,\npara proyectos nuevos a financiar por actividades y determinar los montos de pago por actividad\n\nMINISTERIO DE AMBIENTE Y ENERGÍA\n\nR-060-2022-MINAE.-Ministerio de Ambiente y Energía.- San\nJosé, a las 8 horas con 45 minutos del 07 de marzo del 2022. Se establece al\nFondo Nacional de Financiamiento Forestal la cantidad de hectáreas a financiar\npor actividad en el Programa de Pago por Servicios Ambientales y el monto a\npagar con base en los recursos asignados.\n\nResultando:\n\nÚnico.-Que para el ejercicio 2022 el Presupuesto Nacional\ndispone un total de doce mil trescientos setenta y cuatro millones quinientos\nnueve mil ochocientos cuarenta y dos colones con 59/100 (¢12.374.509.842,59)\npara el Programa de Pago por Servicios Ambientales, los cuales serán utilizados\npara el pago de los compromisos de contratos PSA de años anteriores y la incorporación\nde nuevas hectáreas para el año 2022.\n\nConsiderando:\n\n1º-Que el artículo 38 del Reglamento a la Ley Forestal N°\n7575, Decreto Ejecutivo N° 25721-MINAE, del 17 de octubre de 1996 y sus\nreformas, dispone que el Ministro de Ambiente y Energía como Jerarca del\nMinisterio de Ambiente y Energía, en funciones de la Administración Forestal\ndel Estado, emitirá anualmente mediante Resolución Ministerial, las actividades\na financiar en el Programa de Pago por Servicios Ambientales y los montos a\npagar con base en los recursos asignados en el Presupuesto Nacional para el\nejercicio del año fiscal 2022.\n\n2º-Que bajo este principio, los instrumentos financieros deben orientarse a apoyar los pilares del\nPlan Nacional de Desarrollo y de Inversión Pública del Bicentenario (PNDIP) 2019-2022; considerando\nlos objetivos de la creación del Fondo Nacional de Financiamiento Forestal según la citada Ley\nForestal, sin dejar de lado los criterios de orden técnico establecidos.\n(https://sepse.go.cr/documentos/PNDIP-2019-2022.pdf).\n\n3º-Que el Plan Nacional de Desarrollo citado, considera como una de las\nmetas nacionales el mantener bajo el Programa de Pago por Servicios\nAmbientales, al menos trescientas mil hectáreas (300.000 has), en sus\ndiferentes actividades.\n\n4º-Que el Ministerio de Ambiente y Energía ha emitido los Principios\nRectores del Sector Forestal Productivo, mediante el Decreto Ejecutivo N°\n41772-MINAE, así como los lineamientos a considerar en las gestiones\ninstitucionales para la reactivación y promoción de la reforestación en el\npaís.\n\n5º-Que en virtud de los esfuerzos para lograr el reconocimiento\ninternacional del aporte de los bosques en la reducción de emisiones de gases\nde efecto invernadero, el Gobierno de Costa Rica, suscribe un ERPA (contrato de\ncompra venta de reducción de emisiones) con el Banco Internacional de\nReconstrucción y Fomento, el 9 de diciembre del año 2020, el cual en su plan de\ndistribución de beneficios se dispuso la creación de un mecanismo de pago por\nservicios ambientales especializado en la reducción de emisiones, el cual posee\ncondiciones diferenciadas, este instrumento es el CREF. (Contrato de Reducción\nde Emisiones Forestales).\n\nEl citado instrumento se integra a el acuerdo suscrito por el Ministerio de\nAmbiente y Energía, el 10 de febrero del 2021, con el Fondo Verde de las\nNaciones Unidas, a través de la agencia implementadora PNUD Programa de\nNaciones Unidas para el Desarrollo, denominado cuyos recursos complementaran la\nnegociación con el BIRF, antes indicado. Por tanto,\n\nLA MINISTRA DE AMBIENTE Y ENERGÍA,\n\nRESUELVE:\n\nArtículo 1º-Establecer el límite de gasto al Fondo\nNacional de Financiamiento Forestal, para proyectos nuevos a financiar por\nactividades y determinar los montos de pago por actividad.\n\n1. Actividades a financiar: Para el año 2022, se considerarán dos modalidades a financiar;\na-Recuperación de la Cobertura Forestal, que incluye las actividades de Reforestación, Regeneración\ny Sistemas Agroforestales y b-Mantenimiento de la Cobertura Forestal, que incluye Protección de\nbosque y Manejo de bosque. Para tal fin, se establece la siguiente distribución:\n\n| Modalidades de PSA | Actividad | Cantidad | | --- | --- | --- | | Recuperación de la Cobertura\nForestal* | Reforestación con especies de rápido crecimiento | 1.000 hectáreas | | Reforestación con\nespecies de mediano crecimiento | 3.000 hectáreas |  | | Plantaciones Forestales con Turnos de\nRotación Reducidos (PFTRR) | 1.000 hectáreas |  | | Regeneración Natural | 3.000 hectáreas |  | |\nEstablecimiento de árboles en Sistemas Agroforestales | 500.000 árboles |  | | Sistemas\nAgroforestales establecidos en Plantaciones de Aprovechamiento Forestal (PPAF) | 50.000 árboles |  |\n| Sistemas Mixtos en Agroforestería para micro productores | 50.400 árboles |  |\n\n \n\n| Modalidades de PSA | Actividad | Cantidad |\n| --- | --- | --- |\n| Mantenimiento de la Cobertura Forestal | Protección de Bosque | 11.720 hectáreas |\n| Protección de Bosque para el resguardo del Recurso Hídrico | 5.000 hectáreas |  |\n| Manejo de bosque** | 450 hectáreas |  |\n\n*: El Fonafifo dará trámite a\ntodas las solicitudes de ingreso que se presenten en las subactividades\nde Reforestación por 600 hectáreas y Sistemas Agroforestales, con especies\ncontenidas en los decretos ejecutivos de veda y especies amenazadas o en\npeligro de extinción (Decreto N° 25663-MINAE y Decreto N° 25700-MINAE y sus\nreformas).\n\n**: Se refieren a todas las solicitudes de ingreso con fincas en las cuales\nse ha finalizado el plan de manejo forestal a satisfacción de la Administración\nForestal del Estado (AFE).\n\nA partir del año 2022, se habilita un mecanismo derivado\ny financiado con recursos provenientes de contratos y acuerdos de Reducción de\nEmisiones producidas por los bosques; con una cantidad de 450.000 hectáreas.\nEsta actividad reconoce solo un servicio ambiental (reducción de emisiones de\ngases de efecto invernadero) en adelante, contratos CREF.\n\nEl Fondo Nacional de Financiamiento Forestal, podrá variar la distribución\nestablecida en el cuadro anterior, de acuerdo con la disponibilidad del\npresupuesto aprobado para el Programa de Pago por Servicios Ambientales.\n\nSe faculta a Fonafifo para que redistribuya los\nrecursos presupuestados de la modalidad de Recuperación de la Cobertura\nForestal no comprometidos al 26 de junio de cada año, para que se programen a\nla modalidad de Mantenimiento de la Cobertura Forestal.\n\nDe disponer de una mayor asignación de recursos, según el artículo 5 de la\nLey de Simplificación y Eficiencia Tributarias N° 8114 publicada en La Gaceta\nN° 131, del día 9 de julio de 2001 y otros recursos financieros que capte\nel Fonafifo para el Pago por Servicios Ambientales,\nse distribuirán según el criterio de los financiadores y de las autoridades del\nMinisterio (o autoridades correspondientes). En todo caso, los recursos\nutilizados para estos fines, deberán ser incorporados en el presupuesto\ninstitucional o al Fideicomiso 544 Fonafifo/BNCR y\nser aprobados por la Asamblea Legislativa o Contraloría General de la\nRepública.\n\n2. De los montos de pago por actividad y otras\ncondiciones:\n\n2.1. Actividad de Reforestación: Las condiciones\nque regirán para el trámite de solicitudes, para el reconocimiento de los\nservicios ambientales en la actividad de Reforestación, son las siguientes:\n\na) El monto a pagar para las especies de rápido crecimiento referidas a: Gmelina arborea, Acacia\nmangium, Vochysia guatemalensis y Vochysia hondurensis, será de setecientos veintiséis mil\ncuatrocientos tres colones con 00/100 (¢726.403) por hectárea, desembolsados durante un período de\ncinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 20% el segundo\naño, 15% el tercer año, 10% el cuarto año y 5% el quinto año.\n\nb) El monto a pagar para las especies de mediano crecimiento referidas a: Tectona grandis, Pinus sp,\nCordia alliodora, Vochysia ferruginea, Eucalyptus sp y Cedrela odorata, será de ochocientos\ndiecinueve mil treinta y seis colones con 00/100 (¢819.036) por hectárea, desembolsados durante un\nperíodo de cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 20% el\nsegundo año, 15% el tercer año, 10% el cuarto año y 5% el quinto año.\n\nc) El monto a pagar para especies nativas contenidas en los Decretos\nEjecutivos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de\nnoviembre de 1996, será de un millón doscientos veintiocho mil quinientos\ncincuenta y seis colones con 00/100 (¢1.228.556) por hectárea, desembolsados\ndurante un período de cinco años. Los pagos serán distribuidos de la siguiente\nforma: 50% el primer año, 20% el segundo año, 15% el tercer año, 10% el cuarto\naño y 5% el quinto año.\n\nd) El monto a pagar para las Plantaciones Forestales con Turnos de Rotación\nReducidos (PFTRR) para especies de rápido crecimiento para embalaje, será de\ntrescientos noventa mil ochocientos treinta y un colones con 00/100 (¢390.831)\npor hectárea. Los pagos serán distribuidos de la siguiente forma: 50% el primer\naño, 25% el segundo año y 25% el cuarto año.\n\ne) Las condiciones que regirán para el trámite de solicitudes, para el\nreconocimiento de los servicios ambientales en la actividad de Reforestación\nproyecto piloto PSA más Crédito, son las siguientes:\n\ni. El monto a pagar para el proyecto piloto PSA más Crédito con la especie\nde rápido crecimiento referida a: Gmelina arborea, será de trescientos noventa mil ochocientos\ntreinta y un colones con 00/100 (¢390.831,00) por hectárea, desembolsado en un\nsolo tracto del 100%, que se entregará por adelantado a la organización,\nsiempre y cuando el beneficiario haya consentido mediante documento formal.\nPara el Proyecto Piloto se autorizará el pago por adelantado siempre y cuando\nse otorgue una garantía, que cubra el monto total del adelanto, a satisfacción\ndel Fonafifo.\n\nf) Plantaciones Forestales establecidas con recursos propios para pago por\nresultados. Los montos a pagar serán los establecidos, en los incisos a, b, y c\nanteriores. Los montos serán distribuidos de la siguiente forma: con la firma\ndel contrato un 50%, doce, veinticuatro, treinta y seis y cuarenta y ocho meses\ndespués de dicha firma un 20%, 15%, 10% y 5% respectivamente. Los contratos\ntendrán la vigencia prevista en el artículo 2 incisos a y b de esta resolución,\npero se reconocerán los años de existencias de estas plantaciones; hasta un máximo\nde 3 años de establecidas.\n\ng) Las personas físicas o jurídicas que deseen reforestar en áreas mayores\nal tope establecido en el Reglamento a la Ley Forestal, Decreto N° 25721-MINAE\ny sus Reformas, podrán aplicar en un esquema especial de financiamiento,\npudiendo duplicar el tope de 750 hectáreas, siempre y cuando los recursos\ndisponibles no sean utilizados por los pequeños productores. Los montos a pagar\nserán los establecidos, en los incisos a, b, y c anteriores.\n\nh) Se instruye al Fondo Nacional de Financiamiento Forestal para que incorpore en los contratos de\nPago por Servicios Ambientales en la actividad de Reforestación y Sistemas Agroforestales en bloque,\nlos valores mínimos aceptables para realizar los pagos.\n\nEl Fondo Nacional de Financiamiento Forestal utilizará\nlos siguientes valores de referencia para tramitar los pagos correspondientes a\ncada año:\n\nCuadro 1. Dichos pagos corresponden al total de años del\nplazo convenido; no obstante, a fin de permitir el establecimiento de la\nplantación y su mantenimiento, se adelantará durante los primeros cinco años.\n\nc) El Fonafifo podrá modificar cuando así se\nsolicite, aquellos contratos suscritos antes del año 2012, que demuestren haber\nalcanzado una producción mínima de 13 metros cúbicos de incremento medio anual\npor hectárea. Para tales efectos, el Fonafifo podrá\nsolicitar la información que considere pertinente.\n\n2.2. Actividad de Regeneración Natural: Las condiciones que regirán\npara el trámite de solicitudes, para el reconocimiento de los servicios\nambientales en la actividad de Regeneración Natural, que se desarrollen en\náreas denudadas, sin cobertura forestal, con fuentes semilleras\ncercanas, en áreas en proceso de regeneración que no cumplen con la definición\nde bosque y libres de pastoreo; se detallan a continuación.\n\na) El monto a pagar en Regeneración Natural, será de\nciento diecisiete mil novecientos cuarenta y ocho colones con 00/100 (¢117.948)\npor hectárea, desembolsados en cinco pagos anuales de 20% durante un período de\ncinco años.\n\n2.3. Actividad de Sistemas Agroforestales: Las condiciones que\nregirán para el trámite de solicitudes, para el reconocimiento de los servicios\nambientales en la actividad de Sistemas Agroforestales, se detallan a\ncontinuación.\n\na) El monto a pagar será de mil seis colones con 00/100 (¢1.006) por árbol, integrados a Sistemas\nAgroforestales y desembolsados durante un período de cinco años. Los pagos serán distribuidos de la\nsiguiente forma: 50% el primer año, 25% el tercero año y 25% el año quinto.\n\nb) El monto a pagar será de mil cuatrocientos noventa y un colones con\n00/100 (¢1.491) por árbol, integrados a Sistemas Agroforestales, estrictamente\ncon especies nativas contenidas en los Decretos Ejecutivos N° 25663-MINAE del 8\nde octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, desembolsados\ndurante un período de cinco años. Los pagos serán distribuidos de la siguiente\nforma: 50% el primer año, 25% el tercero año y 25% el año quinto.\n\nc) El monto a pagar será de mil cuatrocientos noventa y un colones con\n00/100 (¢1.491,00) por árbol bajo la actividad de Sistemas Agroforestales\nestablecidos en Plantaciones de Aprovechamiento Forestal (PPAF), financiados\nmediante el crédito forestal. Los pagos serán distribuidos de la siguiente\nforma: 80% se girará una vez firmado el contrato y que los árboles hayan\nalcanzado los 36 meses de edad; el restante 20% se tramitará cuando los árboles\ntengan 60 meses de edad, al quinto año del proyecto.\n\nd) Sistemas Mixtos en Agroforestería para pequeños\nproductores: Las condiciones para esta modalidad son: Cuando realicen\nactividades de protección de bosque, un pago de treinta y seis mil ochocientos\nveintitrés colones con 00/100 (¢36.823,00) por hectárea por año, durante un\nperiodo de cinco años, (aquí de ser necesario se calcularán las fracciones de\nhectáreas existentes, hasta el primer decimal. Cuando sean áreas denudadas o en\nproceso de regeneración, se reconocerá un pago de veintitrés mil quinientos\nochenta y nueve colones con 00/100 (¢23.589,00) por hectárea, por año durante\nun periodo de cinco años. Cuando realicen actividades de reforestación de\nespecies maderables o de uso múltiple fuera del área boscosa un pago de\ndoscientos noventa y nueve colones con 00/100 por árbol (¢299,00) por año, durante\nun periodo de cinco años; se reconocerá una cantidad mínima de doscientos\nárboles plantados o árboles existentes identificados, hasta un máximo de dos\nmil doscientos árboles. En esta subactividad podrá\nrealizarse un solo contrato que comprenda las diferentes actividades y el plazo\nserá de cinco años contados a partir de la firma del contrato.\n\n2.4. Actividad de Protección de Bosque: Las\ncondiciones que regirán para el trámite de solicitudes, para el reconocimiento\nde los servicios ambientales en la actividad de Protección de Bosque, se\ndetallan a continuación:\n\na) El monto a pagar será de trescientos sesenta y ocho mil doscientos\nveintinueve colones con 00/100 (¢368.229) desembolsados en diez pagos anuales\nde 10% durante un período de diez años. Cuando se trate de solicitudes que se\nubiquen dentro de las zonas de importancia hídrica, identificadas por el\nInstituto Costarricense de Acueductos y Alcantarillados, la Dirección de Aguas\ny el Fonafifo, se reconocerá un monto adicional de\nnoventa y dos mil sesenta y dos colones (¢92.062) colones por hectárea,\ndesembolsados en diez pagos anuales de 10% durante un período de diez años.\nEste monto adicional se aplicará hasta agotar el presupuesto asignado en esta\nactividad.\n\nb) El monto a pagar en proyectos de Manejo de bosque será de ciento cuarenta y tres mil ochocientos\ncuarenta y un colones con 00/100 (¢143.841) por hectárea, desembolsados en cinco pagos anuales de\n20% durante un período de cinco años.\n\n2.5. Contratos de Reducción de Emisiones Forestales (CREF). Las\ncondiciones que regirán para el trámite de solicitudes, para el reconocimiento\nde Reducción de emisiones forestales, se detallan a continuación:\n\na) El monto a pagar será de dieciocho dólares 00/100 ($18) por hectárea por\naño. Bajo este esquema el pago es retroactivo una vez que se haya verificado\nque efectivamente la reducción de emisiones se dio.\n\nb) El máximo de hectáreas a contratar será de 450.000 para bosques\nprivados, este monto podrá aumentar si existe disponibilidad de recursos de\nfinanciamiento externo para este ese fin.\n\nc) El plazo de los contratos podrá ser retroactivo al año 2018, y su\nvigencia será hasta diciembre del 2024, pues así fue acordado con el Banco\nInternacional de Reconstrucción y Fomento (BIRF) financiador parcial de los\nproyectos. Con fundamento en lo indicado en el considerando quinto de la\npresente resolución.\n\n3. Actualización de los montos a pagar. Los montos establecidos por\nactividad dentro del Programa de Pago por Servicios Ambientales, se\nactualizarán anualmente con el Índice de Precios al Consumidor (IPC), calculado\npor el Instituto Nacional de Estadística y Censo (INEC), al cierre del período\ndel año anterior. Para el caso de los CREF, como el pago se estima en dólares\nel monto a pagar está sujeto al tipo de cambio establecido por el BCCR a la\nfecha de pago correspondiente.\n\nArtículo 2º-Se instruye al Fondo Nacional de\nFinanciamiento Forestal para que incorpore en los contratos de Pago por\nServicios Ambientales las siguientes condiciones:\n\n1. De los plazos de vigencia de los contratos: Los plazos de vigencia de\nlos contratos de Pago por Servicios Ambientales, generados por las actividades\nque corresponden a las modalidades de recuperación y/o mantenimiento de\ncobertura forestal serán los siguientes:\n\na) Los contratos correspondientes a la actividad de Reforestación mediante\nel establecimiento de las especies de rápido crecimiento, tendrán una vigencia\nde diez años a partir de su firma.\n\nb) Los contratos correspondientes a la actividad de Reforestación que\nincorporen especies de mediano crecimiento y las especies nativas contenidas en\nlos Decretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de\nnoviembre de 1996, su vigencia será de dieciséis años, a partir de su firma;\nincluyendo los contratos de reforestación con recursos propios y los contratos\nde reforestación que superen el tope establecido.\n\nc) Los contratos correspondientes a la subactividad\nde Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR), tendrán\nuna vigencia de seis años.\n\nd) Los contratos correspondientes a la actividad de establecimiento de\nárboles en Sistemas Agroforestales con especies de rápido, mediano y con las\nespecies nativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de\n1996 y N° 25700MINAE del 15 de noviembre de 1996, tendrán una vigencia de cinco\naños a partir de su firma.\n\ne) Los contratos correspondientes a la subactividad de Sistemas Agroforestales establecidos en\nPlantaciones de Aprovechamiento Forestal (PPAF) tendrán una vigencia de 5 años;\nsin embargo, dado que ya están plantados se les reconocerán retroactivamente\ntres años por su establecimiento previo.\n\nf) Los contratos correspondientes a la subactividad de Sistemas Mixtos en Agroforestería\npara micro productores tendrán una vigencia de 5 años a partir de su firma.\n\ng) Los contratos correspondientes a la actividad de\nestablecimiento de árboles en Sistemas Agroforestales relacionados a convenios\nu otros donantes o socios tendrán una vigencia de cinco años a partir de su\nfirma.\n\nh) Los contratos correspondientes a la actividad de\nRegeneración Natural tendrán una vigencia de cinco años a partir de su firma.\n\ni) Los contratos correspondientes a la actividad de\nManejo de bosque, tendrán una vigencia de cinco años a partir de su firma. De\nprevio a la firma del contrato, deberá constar en el expediente de PSA la\ncertificación emitida por el SINAC del cierre técnico del plan de manejo, según\nlos Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios,\nCriterios e Indicadores, Código de Prácticas y Manual de Procedimientos,\nDecreto Ejecutivo N° 27388-MINAE publicado el 2 de noviembre de 1998, y el\nDecreto Ejecutivo N° 34559-MINAE publicado en La Gaceta N° 115, del día\n16 de junio de 2008.\n\nj) Los contratos correspondientes a la actividad de Protección\nde Bosque y Recurso Hídrico tendrán una vigencia de diez años a partir de su\nfirma.\n\n2. Consideraciones Especiales. Condiciones establecidas para los\nmontos y actividades de las solicitudes PSA:\n\n2.1. Se faculta al Fondo Nacional de Financiamiento Forestal\na establecer actividades y montos diferenciados a los señalados en esta\nresolución, de conformidad con acuerdos, convenios o contratos o proyectos\nespecíficos con entidades, que aporten recursos financieros al Programa de Pago\npor Servicios Ambientales, que reconozcan montos y condiciones diferentes a los\nestablecidos para los diferentes servicios ambientales; para estos proyectos no\naplicarán los criterios de priorización que se detallaron anteriormente, sino\nlos pactados en cada convenio. Los pagos se realizarán siempre y cuando se\ntenga disponibilidad presupuestaria para cubrir los compromisos adquiridos\nmediante el Programa de Pago por Servicios Ambientales.\n\n2.2. Los montos pendientes por pagar para los contratos\nde años anteriores, se regirán según lo establecido en los Decretos Ejecutivos\ny Resoluciones Administrativas correspondientes para cada año.\n\n2.3. Para cubrir el costo de inscripción del contrato\nante el Registro Público, el Fondo Nacional de Financiamiento Forestal retendrá\nen el primer desembolso del monto total del contrato un 0,6%. Para el caso de\nlos contratos CREF al ser un proyecto basado en resultados y retroactivo, no se\nles aplicará la deducción por cuanto no se inscriben en el Registro Público.\n\n2.4. Los recursos recuperados en virtud de los incumplimientos de contratos\nde pago por servicios ambientales o las devoluciones o finiquitos, serán\ntransferidos al Fideicomiso 544-3 FONAFIFO/BNCR y serán presupuestados para la\nejecución de nuevas actividades de fomento de pequeños y medianos productores.\n\n2.5. El proyecto deberá contar con un regente durante toda la vigencia del\ncontrato de pago por servicios ambientales. El formulario de regencia podrá\ninscribirse ante el Colegio de Ingenieros Agrónomos, por la totalidad del plazo\ndel contrato de pago por servicios ambientales, o por períodos anuales o\nquinquenales según disponga el propietario del inmueble. Cualquiera que sea la\nforma de pago, siempre deberá aportarse el formulario de regencia debidamente\ninscrito; salvo en aquellos casos que, se haya determinado que el proyecto será\nsupervisado directamente por el Fondo Nacional de Financiamiento Forestal; a\ntravés de sus funcionarios o personal de apoyo contratado.\n\n2.6. Sin perjuicio de otras disposiciones, el o los beneficiarios deberán\naportar un informe de regencia anual emitido por un regente forestal para el\ntrámite de pago; o eventualmente un informe técnico emitido por un profesional\nforestal, para aquellos proyectos que no aplica la figura del regente forestal.\nAdicionalmente, para los contratos de Reforestación de rápido crecimiento,\ndeberá presentar los informes de visita, donde certifique el estado de los\nproyectos en los años 8 y 10 a partir de su fecha de plantación; para los\nproyectos de mediano crecimiento y otras especies deberán presentar dichos\ninformes al año 8, 12 y 16, a partir de su fecha de plantación.\n\n2.7. Sin perjuicio de otras acciones que representen incumplimiento a las obligaciones del contrato,\npara los contratos de Reforestación de rápido crecimiento o bloques a partir de los 12 meses y para\nlas plantaciones de mediano crecimiento o bloques a partir de los 24 meses de establecida la\nplantación, se considera incumplido el contrato si la plantación no presenta el crecimiento mínimo\nestablecido en el artículo 1 inciso 2.1, o el indicado de previo en el estudio técnico respectivo\npara otras especies. Como consecuencia de este incumplimiento, el productor no recibirá el pago\ncorrespondiente a este año, siendo que el Fondo Nacional de Financiamiento Forestal debe suspender\nlos pagos respectivos y dar por terminado el contrato con responsabilidad para el beneficiario\nprevio cumplimiento del debido proceso. En casos muy calificados, basados en estudios y/o informes\nde los encargados de Oficinas Regionales de Fonafifo, se podría proceder con el pago respectivo y\ncontinuar con el contrato aun con índices de crecimiento menor, siempre y cuando estos no obedezcan\na incumplimientos, por la mala selección del sitio, de la especie, o sea producto de un inadecuado\nmanejo de la plantación.\n\n2.8. Como principio general, serán motivo de eximente de\nresponsabilidad por incumplimiento del contrato, el caso fortuito, la fuerza\nmayor, el hecho de un tercero como eximentes generales debidamente comprobadas\ny valoradas a juicio del Fonafifo. De igual forma, se\nprocederá cuando el propietario de la plantación demuestre que una plaga o\nenfermedad afectó la plantación y que las acciones oportunamente realizadas no\nlograron erradicarla, siempre y cuando estén documentadas en el expediente de\nPSA y tengan el aval de la Oficina Regional. Se procederá de igual manera\ncuando el daño sea producto de un incendio que no pudo ser controlado a pesar\nde las medidas preventivas reportadas.\n\n2.9. No podrán ejecutarse proyectos en fincas que hayan\nsido objetos de plagas, enfermedades, o incendios; en tal supuesto la finca no\npodrá ser sujeto de contratos en Reforestación y/o Sistemas Agroforestales en\nbloque, en un plazo de 3 años, a partir del último contrato finalizado por esta\ncausa.\n\n2.10. En relación a las plagas y enfermedades que afecten\nlas plantaciones forestales, la Junta Directiva de Fonafifo,\ndeterminará lineamientos para abordar y resolver estos supuestos.\n\n2.11. El Fonafifo, será el\nresponsable de monitorear las plantaciones forestales que ingresen al Programa,\ndebiendo no solo hacer un seguimiento a nivel regional, sino un protocolo de\ncontrol, mediante un mecanismo aleatorio de visitas según su capacidad técnica\ny administrativa, de acuerdo a la disponibilidad de recursos presupuestados. De\nigual forma, deberá custodiar la información de las parcelas permanentes de\nmediciones de las plantaciones, a fin de sustentar los pagos y respaldar las\nfijaciones de carbono y otros gases de efecto invernadero.\n\n2.12. Para uniformizar la información requerida de las parcelas permanentes de plantaciones y\nbloques, el Fonafifo emitirá el formato del contenido de la base de datos en Excel, para que los\nregentes lo remitan anualmente con los datos individuales de diámetros y alturas. El archivo se\nencuentra disponible en el sitio web de Fonafifo (www.fonafifo.go.cr) para su descarga.\n\n2.13. En caso de que en las solicitudes presentadas se\ndeterminara la existencia de traslapes o desplazamiento entre ellas y/o con\notras fincas, el Fonafifo valorará de acuerdo a\ncriterios técnicos y legales la aprobación o no de las solicitudes de ingreso.\n\n2.14. En el caso de las solicitudes de ingreso de\nReforestación que involucren mezclas de especies de rápido, mediano y/o en vías\nde extinción, se deberá generar contratos separados, en virtud de las\ndiferencias de crecimiento que se presentan entre estos grupos de especies.\nAdemás, los proyectos que estén conformados por especies nativas contenidas en\nlos Decretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de\nnoviembre de 1996, deberá contener el 100% de los árboles de las especies\ncontenidas en los mencionados decretos; de lo contrario tendrá un valor en\nfunción del monto menor establecido para Reforestación.\n\n2.15. En el caso de las solicitudes de ingreso que se\npresenten para acceder al Programa de Pago por Servicios Ambientales, deben de\ncontener la información de contacto (correo electrónico, número de teléfono,\ndirección) del dueño o dueños del inmueble. Sin esta información la\nadministración estimará como incompleta la solicitud y procederá a señalarla,\npara que la persona solicitante proceda a completarla, de no suministrar la\ninformación se procederá con su archivo. Dicha información es fundamental para\nel proceso de notificación del programa de PSA.\n\n2.16. Las plantaciones forestales y árboles individuales de especies en\npeligro de extinción sembrados con financiamiento de contratos de servicios\nambientales podrán ser aprovechados con fundamento en el artículo 28 de la Ley\nForestal.\n\n2.17. Los proyectos de Reforestación y SAF bloques de los años 2016, 2017,\n2018, 2019 y 2020 serán valorados de acuerdo a los parámetros de crecimiento\nestablecidos en la resolución ministerial R-167-2019- MINAE, publicados en La\nGaceta N° 138 del 23 de julio del 2019.\n\n2.18. El Fonafifo realizará el trámite de pago de\nlos contratos con morosidad según lo establecido en la Ley N° 9686 y sus\nmodificaciones; en donde, la CCSS estableció el procedimiento que las\ninstituciones del Estado deben de seguir ante beneficiarios morosos con la\nCCSS.\n\n3. Consideraciones Especiales de los proyectos CREF.\n\nLos Proyectos de los contratos CREF serán tramitados y\nregulados según el Manual que será emitido a esos efectos.\n\nArtículo 3º-Rige a partir de su\npublicación.",

The number of hectares to be financed\nper activity under the Payment for Environmental Services Program and the amount\nto be paid based on the allocated resources are hereby established for the\nNational Forest Financing Fund.\n\nWhereas:\n\nSole.-That for the 2022 fiscal year, the National Budget\nallocates a total of twelve billion three hundred seventy-four million five\nhundred nine thousand eight hundred forty-two colones and 59/100 (¢12,374,509,842.59)\nfor the Payment for Environmental Services Program, which will be used\nfor the payment of commitments from PSA contracts of previous years and the incorporation\nof new hectares for the year 2022.\n\nConsidering:\n\n1st-That Article 38 of the Regulations to the Forestry Law No.\n7575, Executive Decree No. 25721-MINAE, of October 17, 1996, and its amendments,\nprovides that the Minister of Environment and Energy, as the Head of the\nMinistry of Environment and Energy, acting as the State Forestry Administration,\nshall issue annually, by Ministerial Resolution, the activities\nto be financed under the Payment for Environmental Services Program and the amounts to\nbe paid based on the resources allocated in the National Budget for the\n2022 fiscal year.\n\n2nd-That under this principle, financial instruments must be oriented to support the pillars of the\nNational Development and Public Investment Plan for the Bicentennial (PNDIP) 2019-2022; considering\nthe objectives of the creation of the National Forest Financing Fund according to the cited Forestry\nLaw, without disregarding the established technical criteria.\n(https://sepse.go.cr/documentos/PNDIP-2019-2022.pdf).\n\n3rd-That the cited National Development Plan considers as one of the\nnational goals to maintain under the Payment for Environmental Services\nProgram at least three hundred thousand hectares (300,000 ha), in its\ndifferent activities.\n\n4th-That the Ministry of Environment and Energy has issued the Guiding\nPrinciples for the Productive Forestry Sector, through Executive Decree No.\n41772-MINAE, as well as the guidelines to be considered in institutional\nefforts for the reactivation and promotion of reforestation in the\ncountry.\n\n5th-That by virtue of efforts to achieve international\nrecognition of the contribution of forests to the reduction of greenhouse gas\nemissions, the Government of Costa Rica signed an ERPA (Emission Reductions\nPurchase Agreement) with the International Bank for\nReconstruction and Development, on December 9, 2020, which, in its benefit-\nsharing plan, provided for the creation of a payment for\nenvironmental services mechanism specialized in emission reductions, which has\ndifferentiated conditions; this instrument is the CREF (Forest Emission Reductions Contract).\n\nThe aforementioned instrument is integrated into the agreement signed by the Ministry of\nEnvironment and Energy, on February 10, 2021, with the Green Climate\nFund of the United Nations, through the implementing agency UNDP United Nations\nDevelopment Programme, whose resources will complement the\nnegotiation with the IBRD, indicated above. Therefore,\n\nTHE MINISTER OF ENVIRONMENT AND ENERGY,\n\nRESOLVES:\n\nArticle 1st-To establish the spending limit for the National\nForest Financing Fund, for new projects to be financed by\nactivities and to determine the payment amounts per activity.\n\n1. Activities to be financed: For the year 2022, two modalities to be financed will be considered:\na-Recovery of Forest Cover (Recuperación de la Cobertura Forestal), which includes the activities of Reforestation, Regeneration,\nand Agroforestry Systems, and b-Maintenance of Forest Cover (Mantenimiento de la Cobertura Forestal), which includes Forest Protection\nand Forest Management. In any case, the resources\nused for these purposes must be incorporated into the institutional\nbudget or into the Trust 544 Fonafifo/BNCR and\nbe approved by the Legislative Assembly or the Comptroller General of the\nRepublic.\n\n2. Of the payment amounts per activity and other\nconditions:\n\n2.1. Reforestation Activity: The conditions\nthat will govern the processing of applications for the recognition of\nenvironmental services under the Reforestation activity are as follows:\n\na) The amount to be paid for fast-growing species, referring to: Gmelina arborea, Acacia\nmangium, Vochysia guatemalensis, and Vochysia hondurensis, will be seven hundred twenty-six thousand\nfour hundred three colones and 00/100 (¢726,403) per hectare, disbursed over a period of\nfive years. Payments will be distributed as follows: 50% the first year, 20% the second\nyear, 15% the third year, 10% the fourth year, and 5% the fifth year.\n\nb) The amount to be paid for medium-growing species, referring to: Tectona grandis, Pinus sp,\nCordia alliodora, Vochysia ferruginea, Eucalyptus sp, and Cedrela odorata, will be eight hundred\nnineteen thousand thirty-six colones and 00/100 (¢819,036) per hectare, disbursed over a\nperiod of five years. Payments will be distributed as follows: 50% the first year, 20% the\nsecond year, 15% the third year, 10% the fourth year, and 5% the fifth year.\n\nc) The amount to be paid for native species included in Executive\nDecrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15,\n1996, will be one million two hundred twenty-eight thousand five hundred\nfifty-six colones and 00/100 (¢1,228,556) per hectare, disbursed\nover a period of five years. Payments will be distributed as follows:\n50% the first year, 20% the second year, 15% the third year, 10% the fourth\nyear, and 5% the fifth year.\n\nd) The amount to be paid for Forest Plantations with Reduced Rotation\nCycles (PFTRR) for fast-growing species for packaging will be\nthree hundred ninety thousand eight hundred thirty-one colones and 00/100 (¢390,831)\nper hectare. Payments will be distributed as follows: 50% the first\nyear, 25% the second year, and 25% the fourth year.\n\ne) The conditions that will govern the processing of applications for the\nrecognition of environmental services under the Reforestation activity,\nPSA plus Credit pilot project, are as follows:\n\ni. The amount to be paid for the PSA plus Credit pilot project with the fast-growing\nspecies referred to as: Gmelina arborea, will be three hundred ninety thousand eight hundred\nthirty-one colones and 00/100 (¢390,831.00) per hectare, disbursed in a\nsingle installment of 100%, which will be delivered in advance to the organization,\nprovided that the beneficiary has consented by formal document.\nFor the Pilot Project, advance payment will be authorized provided\na guarantee is given, covering the total amount of the advance, to the satisfaction\nof Fonafifo.\n\nf) Forest Plantations established with own resources for payment by\nresults. The amounts to be paid will be those established in subsections a, b, and c\nabove. The amounts will be distributed as follows: upon signing\nthe contract, 50%; twelve, twenty-four, thirty-six, and forty-eight months\nafter said signing, 20%, 15%, 10%, and 5% respectively. The contracts\nwill have the term provided for in Article 2, subsections a and b of this resolution,\nbut the years of existence of these plantations will be recognized, up to a maximum\nof 3 years from establishment.\n\ng) Natural or legal persons wishing to reforest in areas larger\nthan the limit established in the Regulations to the Forestry Law, Decree No. 25721-MINAE\nand its Amendments, may apply under a special financing scheme,\nbeing able to double the limit of 750 hectares, provided that the available\nresources are not used by small producers. The amounts to be paid\nwill be those established in subsections a, b, and c above.\n\nh) The National Forest Financing Fund is instructed to incorporate into the\nPayment for Environmental Services contracts for the Reforestation and Agroforestry Systems in block activities,\nthe minimum acceptable values for making payments.\n\nThe National Forest Financing Fund will use\nthe following reference values to process the payments corresponding to\neach year:\n\nTable 1. Said payments correspond to the total number of years of the\nagreed term; however, in order to allow the establishment of the\nplantation and its maintenance, payment will be advanced during the first five years.\n\nc) Fonafifo may modify, when so\nrequested, those contracts signed before 2012 that demonstrate having\nreached a minimum production of 13 cubic meters of mean annual increment\nper hectare. For such purposes, Fonafifo may\nrequest the information it deems pertinent.\n\n2.2. Natural Regeneration Activity: The conditions that will govern\nthe processing of applications for the recognition of environmental\nservices under the Natural Regeneration activity, carried out in\ndenuded areas, without forest cover (cobertura boscosa), with nearby seed sources,\nin areas undergoing regeneration that do not meet the definition\nof forest and are free of grazing, are detailed below.\n\na) The amount to be paid for Natural Regeneration will be\none hundred seventeen thousand nine hundred forty-eight colones and 00/100 (¢117,948)\nper hectare, disbursed in five annual payments of 20% over a period of\nfive years.\n\n2.3. Agroforestry Systems Activity: The conditions that\nwill govern the processing of applications for the recognition of environmental\nservices under the Agroforestry Systems activity are detailed below.\n\na) The amount to be paid will be one thousand six colones and 00/100 (¢1,006) per tree, integrated into Agroforestry\nSystems and disbursed over a period of five years. Payments will be distributed as\nfollows: 50% the first year, 25% the third year, and 25% the fifth year.\n\nb) The amount to be paid will be one thousand four hundred ninety-one colones and\n00/100 (¢1,491) per tree, integrated into Agroforestry Systems, strictly\nwith native species included in Executive Decrees No. 25663-MINAE of October 8,\n1996, and No. 25700-MINAE of November 15, 1996, disbursed\nover a period of five years. Payments will be distributed as follows:\n50% the first year, 25% the third year, and 25% the fifth year.\n\nc) The amount to be paid will be one thousand four hundred ninety-one colones and\n00/100 (¢1,491.00) per tree under the Agroforestry Systems activity\nestablished in Forest Harvest Plantations (PPAF), financed\nthrough forest credit. Payments will be distributed as follows:\n80% will be disbursed once the contract is signed and the trees have\nreached 36 months of age; the remaining 20% will be processed when the trees\nare 60 months of age, in the fifth year of the project.\n\nd) Mixed Agroforestry Systems for small\nproducers: The conditions for this modality are: When carrying out\nforest protection activities, a payment of thirty-six thousand eight hundred\ntwenty-three colones and 00/100 (¢36,823.00) per hectare per year, during a\nperiod of five years (here, if necessary, fractions of\nexisting hectares will be calculated, up to the first decimal). When they are denuded areas or areas in\nthe process of regeneration, a payment of twenty-three thousand five hundred\neighty-nine colones and 00/100 (¢23,589.00) per hectare per year will be recognized,\nduring a period of five years. When carrying out reforestation activities with\ntimber or multi-use species outside the forested area, a payment of\ntwo hundred ninety-nine colones and 00/100 (¢299.00) per tree per year, during\na period of five years; a minimum quantity of two hundred\nplanted trees or identified existing trees will be recognized, up to a maximum of two\nthousand two hundred trees. Under this sub-activity, a\nsingle contract may be executed covering the different activities, and the term\nwill be five years starting from the signing of the contract.\n\n2.4. Forest Protection Activity: The\nconditions that will govern the processing of applications for the recognition\nof environmental services under the Forest Protection activity are\ndetailed below:\n\na) The amount to be paid will be three hundred sixty-eight thousand two hundred\ntwenty-nine colones and 00/100 (¢368,229), disbursed in ten annual payments\nof 10% over a period of ten years. For applications that are\nlocated within water importance zones, identified by the\nCosta Rican Institute of Aqueducts and Sewers, the Water Directorate,\nand Fonafifo, an additional amount of\nninety-two thousand sixty-two colones (¢92,062) per hectare will be recognized,\ndisbursed in ten annual payments of 10% over a period of ten years.\nThis additional amount will be applied until the budget allocated for this\nactivity is exhausted.\n\nb) The amount to be paid for Forest Management projects will be one hundred forty-three thousand eight hundred\nforty-one colones and 00/100 (¢143,841) per hectare, disbursed in five annual payments of\n20% over a period of five years.\n\n2.5. Forest Emission Reduction Contracts (CREF). The\nconditions that will govern the processing of applications for the recognition\nof Forest Emission Reductions are detailed below:\n\na) The amount to be paid will be eighteen dollars 00/100 ($18) per hectare per\nyear. Under this scheme, the payment is retroactive once it has been verified\nthat the emission reduction effectively occurred.\n\nb) The maximum number of hectares to be contracted will be 450,000 for private\nforests; this amount may increase if external financing resources are available\nfor this purpose.\n\nc) The term of the contracts may be retroactive to the year 2018, and its\nvalidity will be until December 2024, as was agreed with the International\nBank for Reconstruction and Development (IBRD), partial financier of the\nprojects. Based on what is indicated in the fifth considering of this\nresolution.\n\n3. Updating of payment amounts. The amounts established by\nactivity within the Payment for Environmental Services Program will be\nupdated annually with the Consumer Price Index (CPI), calculated\nby the National Institute of Statistics and Census (INEC), at the close of the\nprevious year's period. In the case of CREFs, since the payment is estimated in dollars,\nthe amount to be paid is subject to the exchange rate established by the BCCR on the\ncorresponding payment date.\n\nArticle 2nd-The National Forest\nFinancing Fund is instructed to incorporate the following conditions into the Payment for\nEnvironmental Services contracts:\n\n1. Of the terms of the contracts: The terms of\nthe Payment for Environmental Services contracts, generated by the activities\ncorresponding to the modalities of recovery and/or maintenance of\nforest cover (cobertura boscosa), will be as follows:\n\na) Contracts corresponding to the Reforestation activity through\nthe establishment of fast-growing species will have a term\nof ten years from their signing.\n\nb) Contracts corresponding to the Reforestation activity that\nincorporate medium-growing species and native species included in\nDecrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15,\n1996, will have a term of sixteen years from their signing;\nincluding reforestation contracts with own resources and reforestation\ncontracts exceeding the established limit.\n\nc) Contracts corresponding to the sub-activity\nof Forest Plantations with Reduced Rotation Cycles (PFTRR) will have\na term of six years.\n\nd) Contracts corresponding to the activity of establishing\ntrees in Agroforestry Systems with fast-growing, medium-growing species, and with\nnative species included in Decrees No. 25663-MINAE of October 8,\n1996, and No. 25700MINAE of November 15, 1996, will have a term of five\nyears from their signing.\n\ne) Contracts corresponding to the sub-activity of Agroforestry Systems established in\nForest Harvest Plantations (PPAF) will have a term of 5 years;\nhowever, since they are already planted, they will be recognized retroactively\nthree years for their prior establishment.\n\nf) Contracts corresponding to the sub-activity of Mixed Agroforestry Systems\nfor micro-producers will have a term of 5 years from their signing.\n\ng) Contracts corresponding to the activity of\nestablishing trees in Agroforestry Systems related to agreements\nor other donors or partners will have a term of five years from their\nsigning.\n\nh) Contracts corresponding to the Natural Regeneration activity\nwill have a term of five years from their signing.\n\ni) Contracts corresponding to the Forest\nManagement activity will have a term of five years from their signing. Prior\nto the signing of the contract, the PSA file must contain the\ncertification issued by SINAC of the technical closure of the management plan, according\nto the Sustainability Standards for Natural Forest Management: Principles,\nCriteria and Indicators, Code of Practices and Procedures Manual,\nExecutive Decree No. 27388-MINAE published on November 2, 1998, and\nExecutive Decree No. 34559-MINAE published in La Gaceta No. 115, on\nJune 16, 2008.\n\nj) Contracts corresponding to the Forest\nProtection and Water Resources activity will have a term of ten years from their\nsigning.\n\n2. Special Considerations. Conditions established for the\namounts and activities of PSA applications:\n\n2.1. The National Forest Financing Fund is empowered\nto establish activities and differentiated amounts from those indicated in this\nresolution, in accordance with agreements, covenants, contracts, or specific\nprojects with entities that contribute financial resources to the Payment\nfor Environmental Services Program, recognizing amounts and conditions different from those\nestablished for the different environmental services; for these projects, the\nprioritization criteria detailed above will not apply, but\nrather those agreed upon in each covenant. Payments will be made provided there\nis budget availability to cover the commitments acquired\nthrough the Payment for Environmental Services Program.\n\n2.2. The amounts pending payment for contracts\nfrom previous years will be governed by the provisions established in the Executive Decrees\nand Administrative Resolutions corresponding to each year.\n\n2.3. To cover the cost of registering the contract\nwith the Public Registry, the National Forest Financing Fund will withhold\n0.6% from the first disbursement of the total contract amount. In the case of\nCREF contracts, as it is a results-based and retroactive project, the\ndeduction will not be applied because they are not registered in the Public Registry.\n\n2.4. Resources recovered by virtue of breaches of payment\nfor environmental services contracts, or refunds or settlements, will be\ntransferred to the Trust 544-3 FONAFIFO/BNCR and will be budgeted for the\nexecution of new promotion activities for small and medium-sized producers.\n\n2.5. The project must have a regent during the entire term of the\npayment for environmental services contract. The regency form may\nbe registered with the College of Agronomic Engineers for the entire duration\nof the payment for environmental services contract, or for annual or\nfive-year periods as determined by the property owner. Whatever the\nform of payment, the duly\nregistered regency form must always be provided, except in those cases where it has been determined that the project will be\nsupervised directly by the National Forest Financing Fund,\nthrough its officials or contracted support personnel.\n\n2.6. Without prejudice to other provisions, the beneficiary or beneficiaries must\nprovide an annual regency report issued by a forest regent for the\npayment process; or eventually a technical report issued by a forest\nprofessional, for those projects where the figure of the forest regent does not apply.\nAdditionally, for fast-growing Reforestation contracts,\nthey must submit inspection reports certifying the status of the\nprojects at years 8 and 10 from their planting date; for\nmedium-growing projects and other species, they must submit said\nreports at year 8, 12, and 16, from their planting date.\n\n2.7. Without prejudice to other actions representing a breach of the contract obligations,\nfor fast-growing Reforestation or block contracts starting at 12 months, and for\nmedium-growing plantations or blocks starting at 24 months after the plantation is\nestablished, the contract is considered breached if the plantation does not present the minimum growth\nestablished in Article 1, subsection 2.1, or that previously indicated in the respective technical study\nfor other species. As a consequence of this breach, the producer will not receive the payment\ncorresponding to that year, and the National Forest Financing Fund must suspend\nthe respective payments and terminate the contract with liability for the beneficiary,\nfollowing due process. In highly qualified cases, based on studies and/or reports\nfrom the managers of Fonafifo Regional Offices, the respective payment may proceed and\nthe contract may continue, even with lower growth rates, provided these are not due\nto breaches, poor site or species selection, or result from inadequate\nmanagement of the plantation.\n\n2.8. As a general principle, acts of God,\nforce majeure, and the act of a third party shall be grounds for exemption from\nliability for breach of contract, as general exemptions duly proven\nand assessed at the discretion of Fonafifo. The same shall be done\nwhen the plantation owner demonstrates that a pest or\ndisease affected the plantation and that timely actions taken did not\nsucceed in eradicating it, provided they are documented in the\nPSA file and have the endorsement of the Regional Office. The same shall be done\nwhen the damage is the result of a fire that could not be controlled despite\nreported preventive measures.\n\n2.9. Projects may not be executed on farms that have\nbeen subject to pests, diseases, or fires; in such a case, the farm may\nnot be subject to Reforestation and/or Agroforestry Systems in Block contracts\nfor a period of 3 years, starting from the last contract terminated for this\nreason.\n\n2.10. Regarding pests and diseases affecting\nforest plantations, the Board of Directors of Fonafifo\nshall determine guidelines to address and resolve these situations.\n\n2.11. Fonafifo shall be\nresponsible for monitoring forest plantations that enter the Program,\nand must not only conduct follow-up at the regional level but also a control\nprotocol, through a random mechanism of visits according to its technical\nand administrative capacity, in accordance with the availability of budgeted resources. In\nthe same way, it must safeguard the information from the permanent\nmeasurement plots of the plantations, in order to support the payments and back the\ncarbon and other greenhouse gas sequestration.\n\n2.12. To standardize the information required from the permanent plots of plantations and\nblocks, Fonafifo will issue the content format for the database in Excel, so that the\nregents send it annually with the individual diameter and height data. The file is\navailable on the Fonafifo website (www.fonafifo.go.cr) for download.\n\n2.13. In the event that overlaps or displacement are determined to exist among the submitted applications and/or with other properties, Fonafifo shall assess, according to technical and legal criteria, the approval or rejection of the entry applications.\n\n2.14. In the case of Reforestation entry applications involving mixtures of fast-growing, medium-growing, and/or endangered species, separate contracts must be generated, due to the growth differences that occur among these groups of species. Furthermore, projects composed of native species included in Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, must contain 100% of the trees of the species included in the aforementioned decrees; otherwise, it shall have a value based on the lower amount established for Reforestation.\n\n2.15. In the case of entry applications submitted to access the Payment for Environmental Services Program (Programa de Pago por Servicios Ambientales), they must contain the contact information (email address, telephone number, address) of the property owner or owners. Without this information, the administration shall deem the application incomplete and shall proceed to flag it, so that the applicant may proceed to complete it; if the information is not provided, the application shall be archived. Said information is essential for the notification process of the PSA program.\n\n2.16. Forest plantations and individual trees of endangered species planted with funding from environmental services contracts may be harvested based on Article 28 of the Forestry Law (Ley Forestal).\n\n2.17. Reforestation and block Agroforestry Systems (SAF) projects from the years 2016, 2017, 2018, 2019, and 2020 shall be assessed according to the growth parameters established in ministerial resolution R-167-2019-MINAE, published in La Gaceta No. 138 of July 23, 2019.\n\n2.18. Fonafifo shall process the payment of contracts with delinquency in accordance with the provisions of Law No. 9686 and its amendments; wherein, the CCSS established the procedure that State institutions must follow regarding beneficiaries delinquent with the CCSS.\n\n3. Special Considerations for CREF Projects.\n\nCREF contract projects shall be processed and regulated according to the Manual to be issued for those purposes.\n\nArticle 3.—It shall become effective upon its publication."
