aprovechamiento maderable.\n\n3º-Que por Acuerdo N° 12 tomado en la sesión ordinaria N° 03-2022 del\nConsejo Nacional de Áreas de Conservación, celebrada el 8 de marzo del 2022, se\nemite la presente resolución.\n\nConsiderando:\n\n1º-Que la Constitución Política de la República de Costa\nRica, indica que su artículo 50 que \"El Estado procurará el mayor\nbienestar a todos los habitantes del país, organizando y estimulando la\nproducción y el más adecuado reparto de la riqueza.\" Por lo que los\nprocesos de producción y aprovechamiento maderable en el país deben ser\natendidos bajo lo antes indicado.\n\n2º-Según la Ley Forestal N° 7575, se establece \". como función\nesencial y prioritaria del Estado, velar por la conservación, protección y\nadministración de los bosques naturales y por la producción, el\naprovechamiento, la industrialización y el fomento de los recursos forestales\ndel país destinados a ese fin, de acuerdo con el principio de uso adecuado y\nsostenible de los recursos naturales renovables.\".\n\n3º-Que la misma Ley Forestal, según lo establecido en el artículo 5°,\ndefine la rectoría del sector al Ministerio de Ambiente y Energía, siendo que\ndebe ejercerla mediante la \".Administración Forestal del Estado de\nconformidad con esta ley y su reglamento.\".\n\n4º-Que dentro de las responsabilidades de la Administración Forestal del\nEstado se establece la de \"Coordinar el control forestal y fiscal con\nlas autoridades de policía, las municipalidades y el Ministerio de\nHacienda\", según inciso f) del artículo 6°.\n\n5º-Que la norma supra citada en el artículo 56 define \"No se podrá\nmovilizar madera en trozas, escuadrada ni aserrada proveniente de bosque ni de\nplantación, si no se cuenta con la documentación respectiva.\"\n\n6º-Que el Reglamento a la Ley Forestal, Decreto Ejecutivo N° 25721-MINAE establece en su artículo\n3°, que \"El Ministerio de Ambiente y Energía, será el rector del Sector Forestal y realizará sus\nfunciones por medio del Sistema Nacional de Áreas de Conservación (SINAC).\", según reforma generada\na dicho artículo mediante el Decreto Ejecutivo N° 42344-MINAE, del 10 de junio de 2020.\n\n7º-Que el artículo 22 de la Ley de Biodiversidad N° 7788 del 30 de abril de\n1998, crea el Sistema Nacional de Áreas de Conservación (en adelante SINAC)\ncomo un órgano desconcentrado y participativo que integra las competencias en\nmateria forestal, vida silvestre, áreas silvestres protegidas y conservación\ndel uso de cuencas hidrográficas y sistemas hídricos, con el fin de dictar\npolíticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad\nde los recursos naturales.\n\n8º-Que de acuerdo con el artículo 6° de la Ley General de la Administración\nPública, las principales fuentes del Ordenamiento Jurídico Administrativo son\nla Constitución Política, los acuerdos internacionales y las leyes de la\nRepública.\n\n9º-Que en el artículo 28 de la Ley Forestal N° 7575 establece que \".las\nplantaciones forestales, incluidos los sistemas agroforestales y los árboles\nplantados individualmente y sus productos, no requerirá permiso de corta,\ntransporte, industrialización ni exportación.\".\n\n10.-Que en el artículo 31 de la Ley Forestal N° 7575 exige para el trasiego\nde madera proveniente de plantaciones forestales un certificado de origen\nexpedido por el regente forestal.\n\n11.-Según la Ley General de la Administración Pública N° 6227, se indica en\nel inciso 1) del artículo N° 146 que \"La Administración tendrá potestad\nde ejecutar por sí, sin recurrir a los Tribunales, los actos administrativos\neficaces, válidos o anulables, aún contra la voluntad o resistencia del\nobligado, sujeta a la responsabilidad que pudiera resultar.\".\n\n12.-Que el artículo 147 de la Ley General de la Administración Pública\nestablece que \"Los derechos de la Administración provenientes de su\ncapacidad de derecho público serán también ejecutivos por los mismos medios que\nesta Ley señala para la ejecución de los actos administrativos.\". Por\ntanto,\n\nEL SECRETARIO EJECUTIVO\n\nDEL CONCEJO NACIONAL DE ÁREAS\n\nDE CONSERVACIÓN, RESUELVE:\n\nArtículo 1º-Objetivo. AREAS\n\nR-SINAC-CONAC-011-2022.—National System of Conservation Areas, at two hours fifteen minutes on March 11, 2022.\n\nWhereas:\n\n1º—That through official communications SINAC-SE-DT-006 and SINAC-SE-DT-016 the Technical Directorate of the Executive Secretariat reports on the imminent shortage situation of orange-colored plates in SINAC.\n\n2º—That the risk of shortage of orange-colored plates materialized, making it necessary to provide a timely response to society in order to maintain the well-being of the country's inhabitants, organizing and stimulating timber production and harvesting.\n\n3º—That by Agreement No. 12 taken at the ordinary session No. 03-2022 of the National Council of Conservation Areas, held on March 8, 2022, the present resolution is issued.\n\nConsidering:\n\n1º—That the Political Constitution of the Republic of Costa Rica, indicates in its Article 50 that \"The State shall procure the greatest well-being for all the inhabitants of the country, organizing and stimulating production and the most adequate distribution of wealth.\" Therefore, timber production and harvesting processes in the country must be addressed under the foregoing.\n\n2º—According to the Forest Law No. 7575 (Ley Forestal), it is established \"... as an essential and priority function of the State, to ensure the conservation, protection and administration of natural forests and the production, harvesting, industrialization and promotion of forest resources in the country destined for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources.\"\n\n3º—That the same Forest Law (Ley Forestal), as established in Article 5, defines the stewardship of the sector to the Ministry of Environment and Energy, which must exercise it through the \"...State Forest Administration in accordance with this law and its regulations.\"\n\n4º—That within the responsibilities of the State Forest Administration is established that of \"Coordinating forest control and oversight with police authorities, the municipalities and the Ministry of Finance,\" according to subparagraph f) of Article 6.\n\n5º—That the above-cited norm in Article 56 defines \"Timber in logs, squared or sawn from forest or plantation may not be transported unless it is accompanied by the respective documentation.\"\n\n6º—That the Regulations to the Forest Law, Executive Decree No. 25721-MINAE (Decreto Ejecutivo 25721) establishes in its Article 3, that \"The Ministry of Environment and Energy shall be the steward of the Forest Sector and shall carry out its functions through the National System of Conservation Areas (SINAC),\" according to the amendment made to said article through Executive Decree No. 42344-MINAE (Decreto Ejecutivo 42344), of June 10, 2020.\n\n7º—That Article 22 of the Biodiversity Law No. 7788 of April 30, 1998, creates the National System of Conservation Areas (hereinafter SINAC) as a deconcentrated and participatory body that integrates competencies in forest matters, wildlife, protected wilderness areas and conservation of the use of watersheds and hydrological systems, in order to issue policies, plan and execute processes aimed at achieving the sustainability of natural resources.\n\n8º—That in accordance with Article 6 of the General Law of Public Administration, the principal sources of Administrative Legal Ordering are the Political Constitution, international agreements and the laws of the Republic.\n\n9º—That Article 28 of the Forest Law No. 7575 (Ley Forestal) establishes that \"...forest plantations, including agroforestry systems and individually planted trees and their products, shall not require a permit for harvesting, transport, industrialization or export.\"\n\n10.—That Article 31 of the Forest Law No. 7575 (Ley Forestal) requires for the hauling of timber originating from forest plantations a certificate of origin issued by the forest regent (regente forestal).\n\n11.—According to the General Law of Public Administration No. 6227 (Ley General de la Administración Pública), it is indicated in subparagraph 1) of Article 146 that \"The Administration shall have the power to enforce by itself, without resorting to the Courts, effective, valid or annullable administrative acts, even against the will or resistance of the obligor, subject to any resulting liability.\"\n\n12.—That Article 147 of the General Law of Public Administration (Ley General de la Administración Pública) establishes that \"The rights of the Administration arising from its public-law capacity shall also be enforceable by the same means that this Law indicates for the enforcement of administrative acts.\" Therefore,\n\nTHE EXECUTIVE SECRETARY\n\nOF THE NATIONAL COUNCIL OF\n\nCONSERVATION AREAS, RESOLVES:\n\nArticle 1—Objective. To establish, in the face of the shortage of orange-colored plates, a transitory mechanism that safeguards the correct application of the provisions of Articles 28 and 31 of the Forest Law (Ley Forestal), for carrying out the transport of timber originating from forest plantations, including agroforestry systems and individually planted trees and their products.\n\nArticle 2—Validation of the certificate of origin and the timber transport guide as security mechanisms. All Conservation Areas of the country, in compliance with the provisions of the Forest Law (Ley Forestal), shall have as a security and traceability mechanism the certificate of origin issued by the forest regent (regente forestal) and the timber transport guides, as applicable.\n\nArticle 3—Use of orange-colored plates. Conservation Areas that still have an inventory of orange-colored plates must continue their use until stocks are exhausted.\n\nArticle 4—Use of the guides and plates module of SICAF.
