Conservación.-Área de Conservación Arenal Huetar Norte,\nDirección Regional.\n\nResultando:\n\n1º-Que, de conformidad con el artículo 22 de la Ley de\nBiodiversidad número 7788 del 27 de mayo de 1998, se crea el Sistema Nacional\nde Áreas de Conservación, en adelante SINAC, con personería jurídica propia,\ncomo un sistema de gestión y coordinación institucional, desconcentrado y\nparticipativo, que integra las competencias en materia forestal, vida silvestre\ny áreas protegidas, con el fin de dictar políticas, planificar y ejecutar\nprocesos dirigidos a lograr la sostenibilidad en el manejo de los recursos\nnaturales de Costa Rica.\n\n2º-Que, es política prioritaria del SINAC facilitar y\npromover acciones que conlleven a la protección, conservación y manejo\nsostenible de los recursos naturales y la biodiversidad presentes en las Áreas\nSilvestres Protegidas, en adelante las ASP, de las Áreas de Conservación.\n\n3º-Que, de conformidad con el artículo 8 del Decreto\nEjecutivo N° 40054-MINAE del 21 de diciembre del 2016, el Área de Conservación\nArenal Huetar Norte (inciso X) en adelante ACAHN, es parte de la organización y\ncon las competencias del SINAC en sus territorios respectivamente.\n\n4º-Que, es competencia del SINAC a través de cada Área\nde Conservación, la administración y protección de las ASP a lo largo de todo\nel territorio nacional.\n\nConsiderando:\n\n1º-Que, el Refugio Nacional de Vida Silvestre Bosque\nAlegre, de propiedad mixta, en adelante Refugio Bosque Alegre, fue creado\nmediante Decreto Ejecutivo N° 22847-MIRENEM del 19 de enero de 1994, con el fin\nde proteger las lagunas Hule y Congo, las cuales constituyen un humedal\nlacustrino que alberga gran diversidad de flora y fauna silvestre autóctonas,\nmás la protección del área de recarga acuífera que alberga dicha área silvestre\nprotegida.\n\n2º-Que, el Consejo Nacional de Áreas de Conservación\n(CONAC) aprobó en firme el Plan General de Manejo del RNMVSBA, mediante\nresolución R-SINAC-CONAC-112-2017; el cual fue elaborado por el Área de\nConservación Central en su momento, siendo que el Refugio pertenecía a los\nlímites de dicha AC para ese entonces.\n\n3º-Que, el decreto ejecutivo N° 36515-MINAET,\nestablecía en su artículo 25 la prohibición de pescar dentro de la Laguna del\nHule, ubicada en el Refugio Bosque Alegre, el cual actualmente se encuentra\nvencido.\n\n4º-Que, el decreto ejecutivo N° 32633 Reglamento a Ley\nde Conservación de la Vida Silvestre para Pesca y Refugios Nacionales de Vida\nSilvestre, el cual mantiene algunos de sus artículos vigentes, establece en su\nnumeral 151 que El MINAE a través del SINAC, podrá autorizar dentro de los\nlímites de los Refugios de Propiedad Mixta y Refugios de Propiedad Privada, de\nconformidad con los principios de desarrollo sostenible planteados en los\nplanes de manejo, actividades de interés público o social y cualquier otra\nactividad que el SINAC considere pertinente compatibles con las políticas de\nConservación y desarrollo sustentable.\n\n5º-Que, Ley de Pesca y Acuicultura N° 8436 en su\nnumeral 9, establece que el ejercicio de la actividad pesquera en la parte\ncontinental e insular, en las reservas forestales, zonas protectoras, refugios\nnacionales de vida silvestre y humedales, estará restringido de conformidad con\nlos planes de manejo, que determine para cada zona el Ministerio de Ambiente y\nEnergía.\n\n6º-Que, el Plan General de Manejo para el Refugio\nBosque Alegre, no establece la posibilidad, ni la prohibición de que se realice\nla actividad de pesca dentro de las lagunas y demás cuerpos de agua que forman\nparte de esta ASP.\n\n7º-Que, no se conocen estudios técnicos-científicos\ncon información que demuestren viabilidad o inviabilidad de permitir la\nactividad pesquera dentro de las lagunas y demás cuerpos de agua que forman\nparte del Refugio Bosque Alegre.\n\n8º-Que, a pesar de que no existe criterio positivo\npara autorizar la pesca dentro del Refugio Bosque Alegre, se conoce que\npersonas aledañas a la comunidad y visitantes, realizan la actividad pesquera\nindiscriminadamente en las lagunas del ASP, para lo cual se desconoce el\nimpacto o afectación que esta actividad pueda estar ocasionando a las\npoblaciones de peces que habitan en estos ecosistemas.\n\n9º-Que, al no haber suficiente conocimiento científico\nante un potencial impacto y afectación a la biodiversidad, conviene aplicarse\nlos principios 1 y 2 de la Ley de Biodiversidad N° 7788:\n\ntext-align:justify'>\"1.-Criterio Por tanto,\n\nLA DIRECCIÓN DEL ÁREA DE CONSERVACIÓN\n\nARENAL HUETAR NORTE,\n\nRESUELVE:\n\nline-height:10.05pt'>Único: prohibir la pesca dentro de\nlas lagunas Hule, Bosque Alegre y Congo, así como en los demás cuerpos de agua,\nque forman parte del Refugio Nacional de Vida Silvestre Mixto Bosque Alegre,\nhasta que se cuenten con los estudios técnicos y científicos requeridos para\nrealizar dicha actividad.\n\nRige a partir de\nsu publicación.", "body_en_text": "throughout the entire text\n\n -\n\n Full Text of Regulation 012\n\n Prohibits fishing within the Hule, Bosque Alegre, and Congo lagoons, as well as\nin the other bodies of water that form part of the Bosque Alegre Mixed National Wildlife Refuge\n\nNATIONAL SYSTEM OF CONSERVATION AREAS\n\nResolution No. SINAC-ACAHN-DR-R-012-2022.—National\nSystem of Conservation Areas.—Arenal Huetar Norte Conservation Area,\nRegional Directorate.\n\nWhereas:\n\n1º—That, in accordance with Article 22 of the Biodiversity\nLaw No. 7788 of May 27, 1998, the National System\nof Conservation Areas, hereinafter SINAC, was created, with its own legal personality,\nas a decentralized and participatory institutional management and coordination system,\nwhich integrates competencies in forestry, wildlife,\nand protected areas, in order to issue policies, plan, and execute\nprocesses aimed at achieving sustainability in the management of the natural\nresources of Costa Rica.\n\n2º—That, it is a priority policy of SINAC to facilitate and\npromote actions that lead to the protection, conservation, and sustainable\nmanagement of the natural resources and biodiversity present in the Protected\nWilderness Areas, hereinafter the ASP, of the Conservation Areas.\n\n3º—That, in accordance with Article 8 of Executive\nDecree No. 40054-MINAE of December 21, 2016, the Arenal Huetar Norte\nConservation Area (subsection X), hereinafter ACAHN, is part of the organization and\nhas the competencies of SINAC in their respective territories.\n\n4º—That, the administration and protection of the ASP throughout\nthe entire national territory is the competence of SINAC through each Conservation\nArea.\n\nConsidering:\n\n1º—That, the Bosque Alegre National Wildlife Refuge,\nof mixed ownership, hereinafter Bosque Alegre Refuge, was created\nthrough Executive Decree No. 22847-MIRENEM of January 19, 1994, for the purpose\nof protecting the Hule and Congo lagoons, which constitute a lacustrine\nwetland that harbors a great diversity of native wild flora and fauna,\nplus the protection of the aquifer recharge area that harbors said protected\nwilderness area.\n\n2º—That, the National Council of Conservation Areas\n(CONAC) firmly approved the General Management Plan for the RNMVSBA, by means of\nresolution R-SINAC-CONAC-112-2017; which was prepared by the Central\nConservation Area at the time, given that the Refuge belonged to the\nboundaries of said AC during that period.\n\n3º—That, Executive Decree No. 36515-MINAET\nestablished in its Article 25 the prohibition of fishing within the Hule\nLagoon, located in the Bosque Alegre Refuge, which is currently\nexpired.\n\n4º—That, Executive Decree No. 32633, Regulation to the Wildlife\nConservation Law for Fishing and National Wildlife Refuges,\nwhich maintains some of its articles in force, establishes in its\nsection 151 that MINAE, through SINAC, may authorize, within the\nboundaries of Mixed Ownership Refuges and Private Property Refuges, in\naccordance with the principles of sustainable development set forth in\nmanagement plans, activities of public or social interest and any other\nactivity that SINAC considers pertinent, compatible with the policies of\nConservation and sustainable development.\n\n5º—That, the Fishing and Aquaculture Law No. 8436, in its\nsection 9, establishes that the exercise of fishing activity in the continental\nand insular parts, in forest reserves, protective zones, national\nwildlife refuges, and wetlands, shall be restricted in accordance with\nthe management plans determined for each zone by the Ministry of Environment and\nEnergy.\n\n6º—That, the General Management Plan for the Bosque Alegre\nRefuge does not establish the possibility, nor the prohibition, of carrying out\nthe fishing activity within the lagoons and other bodies of water that form\npart of this ASP.\n\n7º—That, no technical-scientific studies are known\nwith information demonstrating the feasibility or infeasibility of allowing\nthe fishing activity within the lagoons and other bodies of water that form\npart of the Bosque Alegre Refuge.\n\n8º—That, even though there is no positive criterion\nto authorize fishing within the Bosque Alegre Refuge, it is known that\npeople from the neighboring community and visitors carry out fishing activity\nindiscriminately in the lagoons of the ASP, for which the\nimpact or effect that this activity may be causing to the\nfish populations that inhabit these ecosystems is unknown.\n\n9º—That, given the lack of sufficient scientific knowledge\nregarding a potential impact and effect on biodiversity, it is advisable to apply\nprinciples 1 and 2 of the Biodiversity Law No. 7788:\n\ntext-align:justify'>\"1.-Preventive criterion: it is recognized that it is of vital\nimportance to anticipate, prevent, and attack the causes of biodiversity\nloss or its threats.\n\n2.-Precautionary criterion or in dubio pro natura: when\nthere is danger or threat of serious or imminent damage to the elements of\nbiodiversity and the knowledge associated with them, the absence of scientific\ncertainty shall not be used as a reason to postpone the adoption of\neffective protection measures.\"\n\n10.—That, based on the legal opinion of the\nLegal Advisory Office of the Arenal Huetar Norte Conservation Area,\nSINAC-ACAHN-AJ-14-2022, which recommends prohibiting fishing within the\nLagoons found within the Bosque Alegre Refuge, until such time\nas the technical and scientific studies that validate the possibility of carrying\nout the fishing activity are available, with the necessary restrictions for the\nprotection of the existing ecosystems.
