y el\nartículo 70 inciso e) sub inciso 2) del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº\n34433-MINAE del 11 de marzo del 2008.\n\nConsiderando:\n\n1º-Que mediante el Decreto Ejecutivo Nº18186-MIRENEM del 02 de mayo de 1988, se declara el Refugio\nde Fauna Silvestre Finca de la Hacienda la Avellana, categoría privada, en ese entonces propiedad de\nla sociedad Limago S.A., con cédula jurídica número 3-101015522-36, finca del Partido de Alajuela\nmatrícula de folio real 2-43996-001-010, plano catastrado A-0688965-1987.\n\n2º-Que el inmueble que\nconforma el citado Refugio, se encuentra inscrito en el Registro de la\nPropiedad, según el folio real que se describe a continuación: Partido de\nAlajuela, matrícula 2-43996 derechos 001, 002, 003, 004, 005, 006, 007, 008,\n009, 010, plano catastrado A-0688965-1987, cuya naturaleza actual es terreno\npara construir con tres casas, situada en el distrito Coyolar, cantón Orotina,\nprovincia de Alajuela, con una medida de cuatro millones cuatrocientos ochenta\ny dos mil ciento ochenta y seis metros con cincuenta y tres decímetros\ncuadrados y cuyo propietario registral es el señor Alejandro Harting González\nArellano cédula identidad 1-0989-0947.\n\n3º-Que en fecha 08 de marzo de 2021, el señor Álvaro González Niehaus apoderado generalísimo de la\nSociedad Limago S.A y apoderado especial de Alejandro Harting González Arellano cédula de identidad\n1-0989-0947, presentó un escrito al Área de Conservación Pacífico Central (ACOPAC) solicitando la\ndesafectación del Refugio de Fauna Silvestre Finca de la Hacienda la Avellana y manifestó que desde\nel año 2007 se realizó la solicitud para el trámite de desafectación del Refugio, lo anterior\nfundamentado en el artículo 4 del Decreto que promulgó su creación y que literalmente indica:\n\"Artículo 4º En caso de que los propietarios tomen la decisión de cambiar el destino al refugio,\ndeben de notificar a la Dirección General de Vida Silvestre, con un año de anticipación por lo\nmenos, para hacer los trámites correspondientes ante la Asamblea Legislativa\". Ante el requerimiento\nrecién expuesto se emitió el criterio legal número ACOPAC-AL-RESAGO-024-2007 donde se concluyó sobre\nla procedencia de desafectación del Refugio, sin embargo, no se culminó el proceso mediante la\npromulgación del decreto ejecutivo correspondiente.\n\n4º-Que mediante informe de\ninspección N° SINACACOPAC- DASP-113-2021 suscrito por la señora Liliana Rubí Jiménez\nquien desempeña el cargo de Directora de Áreas Silvestres Protegidas del\nACOPAC, se recomienda: \"Teniendo la solicitud de los propietarios del inmueble\nque constituye el Refugio de categoría privada de querer desafectar el área\ntotal de la finca, el departamento de Áreas Silvestres Protegidas no tiene\ninconveniente alguno para que se proceda a efectuar el trámite correspondiente\npara desafectar el refugio vía decreto, según lo estipulado en el decreto de\ncreación de dicho refugio\".\n\n5º-Que mediante oficio SINAC-ACOPAC-D-506-2021, de fecha diecisiete de agosto del dos mil veintiuno,\nel Director del Área de Conservación Pacífico Central del Sistema Nacional de Áreas de Conservación\n(SINAC), aceptó la solicitud de desafectación presentado por el propietario registral del Refugio\nNacional Vida Silvestre Privado Hacienda Avellana categoría privada, propiedad de Alejandro Harting\nGonzález Arellano cédula de identidad 1-989-947, con base en la recomendación legal y técnica\npresentes en el expediente administrativo y además, brindó el visto bueno para la promulgación del\npresente decreto ejecutivo.\n\n6º-Que de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos\ny Trámites Administrativos, Decreto Ejecutivo Nº37045-MP-MEIC y sus reformas, se determinó que la\npresente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el\nadministrado deba cumplir, situación por la que no se procedió con el trámite de control previo. In the event that the owners decide to change the purpose of the refuge,\nthey must notify the Dirección General de Vida Silvestre at least one year in advance,\nto carry out the corresponding procedures before the Legislative Assembly\". In response to the request\njust set forth, legal opinion number ACOPAC-AL-RESAGO-024-2007 was issued, which concluded that\nthe de-designation of the Refuge was admissible; however, the process was not completed through the\npromulgation of the corresponding executive decree.\n\n4º-That by means of inspection report\nNo. SINACACOPAC- DASP-113-2021 signed by Mrs. Liliana Rubí Jiménez,\nwho holds the position of Director of Protected Wilderness Areas of\nACOPAC, it is recommended: \"Having the request from the owners of the property\nconstituting the Refuge of private category wanting to de-designate the full\narea of the farm, the Protected Wilderness Areas department has\nno objection whatsoever to proceeding with the corresponding process\nto de-designate the refuge via decree, as stipulated in the decree of\ncreation of said refuge\".\n\n5º-That by means of official communication SINAC-ACOPAC-D-506-2021, dated seventeen August two thousand twenty-one,\nthe Director of the Central Pacific Conservation Area of the National System of Conservation Areas\n(SINAC), accepted the de-designation request submitted by the registered owner of the\nPrivate National Wildlife Refuge Hacienda Avellana, private category, owned by Alejandro Harting\nGonzález Arellano, identity card 1-989-947, based on the legal and technical recommendations\npresent in the administrative case file, and furthermore, granted approval for the promulgation of the\npresent executive decree.\n\n6º-That in accordance with the Regulation to the Law for the Protection of the Citizen from the Excess of\nRequirements and Administrative Procedures, Executive Decree No. 37045-MP-MEIC and its amendments, it was determined that the\npresent proposal does not establish or modify procedures, requirements, or processes that the\nadministered party must comply with, a situation for which the prior review process was not carried out.
