de mayo de\n1975 y sus reformas.\n\nConsiderando:\n\n1º-Que\nmediante ley N.º 8905 se establece el Instituto Geográfico Nacional, en\nadelante IGN, como una dependencia del Registro Nacional, quien suscribirá los\ncontratos y convenios necesarios para el ejercicio de sus funciones. Asimismo,\nde conformidad con la ley N.º 59, el IGN es la dependencia científica y\ntécnica rectora de la cartografía nacional, destinada a la ejecución del Mapa\nbásico oficial y la Descripción básica geográfica de la República de Costa Rica\ny a los estudios, las investigaciones o labores y el desarrollo de políticas\nnacionales de carácter cartográfico, geográfico, geodésico, geofísico y de\níndole similar que tenga relación con dichas obras, con el fin de apoyar los\nprocesos de planificación.\n\n2º-Que la\nLey N.º 59 constituye al IGN de manera permanente y en representación del\nEstado, como la autoridad oficial en materia geodésica y de la representación\nespacial de la geografía de la República de Costa Rica, extendiéndose su\nautoridad a las actividades de cualquier orden que tengan por origen los\ntrabajos confiados a su cargo.\n\n3º-Que, de\nconformidad con lo anterior, los estudios geográficos fotointerpretativos\nforman parte de las actividades desarrolladas por el IGN.\n\n4º-Que los\nestudios geográficos fotointerpretativos\nrepresentan un proceso de análisis geográfico, en el cual se utilizan diversas\ntécnicas en el ámbito geoespacial, por ejemplo: la interpretación de\nfotografías aéreas e imágenes satelitales de la superficie terrestre y el\nestudio de la información cartográfica. Con ámbito de referencia\ngeográfica-cartográfica y no de precisión topográfica.\n\n5º-Que los\nestudios geográficos fotointerpretativos\nse elaboran en atención a solicitudes emanadas por diversas Instituciones\nPúblicas, tales como la Procuraduría General de la República (PGR), Ministerio\nPúblico, Ministerio de Ambiente y Energía (MINAE), Municipalidades, entre\notros, así como a lo interno del IGN y del Registro Nacional, y usuarios\nparticulares con minutas de calificación de planos emitidas por la Dirección\ndel Registro Inmobiliario del Registro Nacional, en las cuales en su mayoría,\ndicha solicitud es por la necesidad de determinar la existencia de manglares y\nesteros básicamente sobre aquellos sectores del país donde todavía no existe\nuna delimitación oficial de la Zona Marítimo Terrestre (ZMT).\n\n6º-Que la\ndeterminación de la existencia de manglares y esteros por parte del IGN a\ntravés de sus estudios geográficos fotointerpretativos\nestán sujeto o supeditados a las competencias de otras instituciones públicas\nacerca del resguardo del Patrimonio Natural del Estado (PNE).\n\n7º-Que la\nLey N.º 7575 denominada Ley Forestal del 13 de febrero de 1996, en su artículo\n16 establece que el Ministerio del Ambiente y Energía delimitará en el terreno,\nlos linderos de las áreas que conforman el PNE.\n\n8º-Que la\nLey N.º 6043 establece en su artículo 1 del Capítulo I, Disposiciones Generales\nque La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece\nal Estado y es inalienable e imprescriptible. Su protección, así como la de sus\nrecursos naturales, es obligación del Estado, de sus instituciones y de todos\nlos habitantes del país. Su uso y aprovechamiento están sujetos a las\ndisposiciones de esta ley.\n\n9º-Que en\nla misma Ley N° 6043, indica el artículo 11 del Capítulo I, Disposiciones\nGenerales, que la Zona pública es también, sea cual fuere su extensión, la\nocupada por todos los manglares de los litorales continentales e insulares y\nesteros del territorio nacional.\n\n10.-Que el\nDecreto Ejecutivo N.º 36786-MINAET titulado Manual para la clasificación de\ntierras dedicadas a la conservación de los recursos naturales dentro de la Zona\nMarítimo Terrestre en Costa Rica publicado en La Gaceta N.º 217 del\n11 de noviembre del 2011, establece entre sus objetivos Identificar dentro\nde la Zona Marítimo Terrestre (ZMT) aquellos terrenos que clasifiquen como\nbosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares,\nesteros, rías, marismas, lagunas costeras, pantanos, bosques anegados,\nsalitrales), para certificarlos e incorporarlos como parte del Patrimonio\nNatural del Estado (PNE).\n\n11.-Que el\nDecreto Ejecutivo N.º 36786-MINAET en el punto III.-Competencias para la\ndelimitación y certificación establece que La clasificación de los\nterrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del\nSistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados\ndebidamente acreditados por los Colegios Profesionales respectivos para que\nclasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y\nVIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques\nanegados, salitrales) y humedales.\n\nLa\nvalidez de los documentos de clasificación emitidos por profesionales privados\nquedará sujeta a la aprobación que emita el AC que por competencia territorial\nle corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá,\nademás, la verificación, fiscalización, deslinde y certificación de las tierras\ndel Patrimonio Natural del Estado y las zonas de protección.\n\nLa\nubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro\nde la Zona Marítimo Terrestre, debe realizarse como parte del proceso de\naprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que\nel Plan Regulador Costero es el instrumento de ordenamiento territorial, que\ndefine y ubica todas las zonas a concesionar dentro de la ZMT y para la\nclasificación de ésta a nivel de los planos de catastro. Likewise,\nin accordance with Law No. 59, the IGN is the scientific and technical\nunit governing national cartography, intended for the execution of the official\nbasic Map and the basic geographic Description of the Republic of Costa Rica\nand for the studies, research or work and the development of national\npolicies of a cartographic, geographic, geodetic, geophysical and\nsimilar nature that are related to said works, in order to support\nplanning processes.\n\n2nd.-That\nLaw No. 59 constitutes the IGN permanently and in representation of the\nState, as the official authority in geodetic matters and in the spatial\nrepresentation of the geography of the Republic of Costa Rica, its\nauthority extending to activities of any kind originating from the\nwork entrusted to its charge.\n\n3rd.-That, in\naccordance with the foregoing, the photointerpretative geographic studies\nform part of the activities carried out by the IGN.\n\n4th.-That the\nphotointerpretative geographic studies\nrepresent a process of geographic analysis, in which various\ntechniques in the geospatial field are used, for example: the interpretation of\naerial photographs and satellite images of the terrestrial surface and the\nstudy of cartographic information. With a geographic-cartographic\nreference scope and not topographic precision.\n\n5th.-That the\nphotointerpretative geographic studies\nare prepared in response to requests emanating from various Public\nInstitutions, such as the Office of the Attorney General (Procuraduría General de la República, PGR), the Public\nMinistry, the Ministry of Environment and Energy (MINAE), Municipalities, among\nothers, as well as internally within the IGN and the National Registry, and\nprivate users with plan qualification memos issued by the Directorate of the\nReal Property Registry of the National Registry, in which, for the most part,\nsaid request is due to the need to determine the existence of mangroves and\nestuaries (esteros), basically in those sectors of the country where an official\ndelimitation of the Maritime Terrestrial Zone (Zona Marítimo Terrestre, ZMT) does not yet exist.\n\n6th.-That the\ndetermination of the existence of mangroves and estuaries (esteros) by the IGN through its photointerpretative geographic studies is subject to or contingent upon the powers of other public institutions\nregarding the protection of the State's Natural Heritage (Patrimonio Natural del Estado, PNE).\n\n7th.-That\nLaw No. 7575, called the Forestry Law (Ley Forestal) of February 13, 1996, in its article\n16 establishes that the Ministry of Environment and Energy shall delimit, on the ground,\nthe boundaries of the areas that make up the PNE.\n\n8th.-That\nLaw No. 6043 establishes in its article 1 of Chapter I, General Provisions\nthat the maritime terrestrial zone constitutes part of the national heritage, belongs\nto the State and is inalienable and imprescriptible. Its use and exploitation are subject to the\nprovisions of this law.\n\n9th.-That in\nthe same Law No. 6043, article 11 of Chapter I, General\nProvisions, indicates that the public Zone also comprises, whatever its extension, that\noccupied by all the mangroves of the continental and insular coastlines and\nestuaries (esteros) of the national territory.\n\n10.-That\nExecutive Decree No. 36786-MINAET, titled Manual for the classification of\nlands dedicated to the conservation of natural resources within the Maritime\nTerrestrial Zone in Costa Rica, published in La Gaceta No. 217 of\nNovember 11, 2011, establishes among its objectives to Identify within\nthe Maritime Terrestrial Zone (ZMT) those lands that classify as\nforests, of forestry aptitude (Class VII and VIII soils), wetlands (mangroves,\nestuaries (esteros), rias, marshes, coastal lagoons, swamps, flooded forests,\nsalt flats), to certify them and incorporate them as part of the State's Natural Heritage (PNE).\n\n11.-That\nExecutive Decree No. 36786-MINAET in point III.-Powers for\ndelimitation and certification establishes that The classification of\nlands within the ZMT shall correspond to the Conservation Areas (Áreas de Conservación, AC) of the\nNational System of Conservation Areas (SINAC) and to private professionals\nduly accredited by the respective Professional Associations to\nclassify forests, lands of forestry aptitude (Class VII and\nVIII soils), (mangroves, estuaries (esteros), rias, marshes, coastal lagoons, swamps, flooded\nforests, salt flats) and wetlands.\n\nThe\nvalidity of the classification documents issued by private professionals\nshall be subject to the approval issued by the AC with the corresponding\nterritorial competence. The ACs of SINAC with jurisdiction in the ZMT shall also be\ncompetent for the verification, control, demarcation (deslinde) and certification of the lands\nof the State's Natural Heritage and the protection zones.\n\nThe\nlocation and delimitation of the areas of the State's Natural Heritage within\nthe Maritime Terrestrial Zone must be carried out as part of the\napproval process of the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since\nthe Coastal Regulatory Plan is the territorial planning instrument\nthat defines and locates all the zones to be concessioned within the ZMT and for\nits classification at the level of cadastre plans. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so as not to\ncount them within the total area to be concessioned.\n\n12.-That in\nLaw No. 6227, General Public Administration Law, its article 140\nindicates that The administrative act shall produce its effect after being communicated to the\nadministered party, except if it only grants rights, in which case it\nshall produce them from the moment it is adopted, a provision that must necessarily\nbe related to article No. 240 of the same regulatory body, which\ndefines the suitable instrument for communicating acts of a generic nature by\nindicating that General acts shall be communicated by publication and\nspecific ones by notification.\n\nIt is hereby communicated:\n\nFirst.-The photointerpretative geographic studies\ndeveloped by the IGN related to the recognition and existence of the\nestuaries (esteros) and mangroves of the country, are constituted as technical support reports\nsolely and exclusively for the Public Institutions of the country, internally within the\nIGN and the National Registry, as well as for private users with\nplan qualification memos issued by the Directorate of the Real Property\nRegistry of the National Registry.\n\nSecond.-The\nphotointerpretative geographic studies are carried out based on photointerpretative\nanalysis from the collection of aerial photographs, satellite images and\nthe national cartography available to the IGN.\n\nThird.-The\nphotointerpretative geographic studies are carried out\nwithin the geographic and cartographic scope and therefore do not have\ntopographic-type precisions.\n\nFourth.-Due to their precisions,\nthe photointerpretative geographic studies\nare technical inputs that help in the\ndetermination of estuaries (esteros) and mangroves observable in aerial photographs,\nsatellite images and the national cartography, and therefore do not fulfill a\nbinding function regarding the declaration of PNE, the latter being of\nexclusive competence of MINAE.\n\nFifth.-We proceed to instruct\nand communicate through this notice to the general citizenry, to\nacademia, to the public and private sector, to the municipalities, and to any\nother national or international entity, that the photointerpretative geographic studies\nprepared by the IGN are for the purposes set forth in this publication.\n\nSixth.-It takes effect from its\npublication.\n\nGiven in\nCurridabat-San José, on the 5th day of the month of April of the year 2022." }
