  "body_en_text": "in the entirety of the text\n\n-\n\nComplete Text of Norm 43488\n\nDeclares of public utility for the interests of the State the Association Aves de Osa Investigación y Conservación\n\nNo. 43488-MJP\n\n(This executive decree was rendered void by Article 1 of executive decree No. 45259 of September 17, 2025)\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF JUSTICE AND PEACE\n\nPursuant to the provisions of Articles 140, subsection 18) and 146 of the Political Constitution, Article 32 of the Law of Associations No. 218 of August 8, 1939, and Articles 27 and following of the Regulation to the Law of Associations No. 29496-J, published in La Gaceta No. 96 of May 21, 2001, as well as the provisions of Article 3, subsection ch) of the Income Tax Law No. 7092 and Articles 103 and 104 of the Code of Tax Norms and Procedures No. 4755.\n\nConsidering\n\nI.-That Article 32 of the Law of Associations No. 218 of August 8, 1939 and its amendments, grants the Executive Power the authority to declare of public utility simple, federated, or confederated associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to addressing a social need.\n\nII.-That the Administering Association Aves de Osa Investigación y Conservación, legal entity identification number 3-002-683144, was registered in the Registry of Associations of the National Public Registry since June 16, 2014, volume 2013, entry 304107.\n\nIII.-That the purposes pursued by the association, according to its bylaws, are: \"a) Promote the conservation of birds on the Península de Osa. b) Make all necessary efforts to achieve the conservation of native and migratory bird species on the Península de Osa. c) Protect birds from poachers and from diseases that by the hand of man may affect their habitat. d) Create habitats for birds through the acquisition of properties that allow observation, care, transit, and permanence of birds in areas of the Península de Osa. e) Carry out an annual bird count that allows maintaining detailed information about bird populations and migratory conditions, in the zone of influence of Parque Nacional Corcovado\".\n\nIV.-That such purposes address a social need of the highest order, for which they deserve the support of the Costa Rican State.\n\nDecree\n\nDECLARATION OF PUBLIC UTILITY OF THE ASSOCIATION AVES DE OSA INVESTIGACIÓN Y CONSERVACIÓN\n\nArticle 1.-Declare of public utility for the interests of the State the Association Aves de Osa Investigación y Conservación; legal entity identification number 3-002-683144.\n\nArticle 2.-It is the duty of the Association to annually render a management report before the Ministerio de Justicia y Paz, in accordance with what is indicated in Article 32 of the Regulation to the Law of Associations.\n\nArticle 3.-The revenues and the equity of the association that are destined in their entirety and exclusively for public or charitable purposes and that are in no case distributed directly or indirectly among its members, shall be exempt from the income tax; conversely, that part that does not have this destination, or that is distributed in any manner among its associates, shall be subject to the imposition of this tax.\n\nArticle 4.-It is the responsibility of the Tax Administration to control and supervise the correct fulfillment of the tax obligations of the association, in accordance with the provisions of Articles 103 and 104 of the Code of Tax Norms and Procedures.\n\nArticle 5.-Once this decree is published, the interested parties must notarize and file the respective certified copy before the Registry of Associations of the National Registry, for its respective registration.\n\nArticle 6.-It shall take effect as of its publication.\n\nGiven at the Presidency of the Republic.-San José, On the second day of the month of December of two thousand twenty-one."
