2008.\n\nConsiderando:\n\nPRIMERO:\nQue\nmediante el Decreto Ejecutivo Nº11541-A del 30 de mayo de 1980, ratificado\nmediante Ley Nº6794 del 25 de agosto de 1982, se creó el Parque Nacional Palo\nVerde.\n\nSEGUNDO:\nQue la\nLey de Biodiversidad Nº7788 del 30 de abril de 1998, en su artículo 22, creó el\nSistema Nacional de Áreas de Conservación (SINAC), como un sistema de gestión y\ncoordinación institucional, desconcentrado y participativo, que integra las\ncompetencias en materia forestal, vida silvestre, áreas protegidas y el\nMinisterio de Ambiente y Energía, con el fin de dictar políticas, planificar y\nejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los\nrecursos naturales de Costa Rica.\n\nTERCERO:\nQue se\nha dictado el Plan General de Manejo del Parque Nacional Palo Verde mediante\nresolución R-SINAC-CONAC-23-2016 publicada en el Alcance Digital Nº244 del\nDiario Oficial La Gaceta N°211 del 03 de noviembre de 2016.\n\nCUARTO: Que la Ley Orgánica del\nAmbiente N°7554 del 4 de octubre de 1995, dispone que la creación, la\nconservación, la administración y desarrollo y la vigilancia de las Áreas\nProtegidas tendrán como objetivos, conservar los ambientes naturales,\nasegurando el equilibrio y la continuidad de los procesos evolutivos y\necológicos de los cuales dependen algunas especies silvestres.\n\nQUINTO: Que la Ley Orgánica del\nAmbiente N°7554 del 4 de octubre de 1995, determina las Categorías de Manejo,\nasí como las competencias, regulaciones y responsabilidades que le son\ndesignadas al Estado a través del MINAE y SINAC, para lograr el cumplimiento de\nlos objetivos de conservación de la misma.\n\nSEXTO: Que en el Plan\nEstratégico Quinquenio 2016-2026 del Sistema Nacional de Áreas de Conservación,\nse incluye como una acción estratégica, el desarrollar el programa de turismo\nsostenible en las áreas protegidas.\n\nSÉPTIMO:\nQue la\nPolítica de Turismo sostenible oficializada por el Sistema Nacional de Áreas de\nConservación establece que \".la gestión del turismo en las ASP deberá\ndesarrollarse dentro de un marco de sostenibilidad, integrado con sus áreas de\ninfluencia y articulado con las políticas, planes y programas nacionales de\nconservación y turismo\".\n\nOCTAVO: Que de conformidad con\nel artículo 18 de la Ley Forestal Nº7575, en las áreas silvestres protegidas\npor ostentar la condición de Patrimonio Natural del Estado, únicamente se\npermite las actividades de investigación, capacitación y ecoturismo, así como\nactividades necesarias para el aprovechamiento de agua para consumo humano.\n\nNOVENO: Que resulta necesario\ndictar una nueva regulación para el uso público del Parque Nacional Palo Verde,\nacorde a lo establecido en el Plan de Manejo de esta área silvestre protegida, en\nrelación con las actividades que admiten las categorías de manejo\ncorrespondientes.\n\nDÉCIMO: Que el presente\nreglamento responde a los más altos principios ambientales previstos en los\nartículos 9 y 11 de la Ley de Biodiversidad N°7788 para la adecuada conservación\ndel área silvestre protegida; cumpliéndose cabalmente con lo dispuesto en la\nDirectriz N°052-MP-MEIC.\n\nDÉCIMO\nPRIMERO: Que\nde conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso\nde Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº37045-MP-MEIC del\n22 de febrero de 2012 y sus reformas, la presente propuesta cumple con los\nprincipios de mejora regulatoria según el informe positivo DMR-DAR-INF-040-2021\ndel 16 de marzo de 2021, emitido por el Departamento de Análisis Regulatorio de\nla Dirección de Mejora Regulatoria del MEIC.\n\nPor\ntanto,\n\nDECRETAN:\n\n\"Reglamento para\nla Regulación del Uso Público del Parque Nacional Palo Verde\"\n\nCAPÍTULO I\n\nDisposiciones Generales\n\nArtículo\n1.- El\npresente Reglamento establece las disposiciones para el uso de los servicios\nbrindados, actividades permitidas, actividades restringidas y actividades\nprohibidas dentro de los límites del Parque Nacional Palo Verde.\n\nArtículo 2.- Las disposiciones del presente Reglamento y las indicaciones que emitan\nlos funcionarios del Parque Nacional Palo Verde a las personas que ingresen a\ndicha Área Silvestre Protegida, en apego a dicho instrumento y la normativa\nvigente, son de carácter obligatorio.\n\nArtículo 3.- Toda persona que ingrese al Parque Nacional Palo Verde, debe cumplir con\nlas disposiciones indicadas en el presente Reglamento, así como las órdenes que\nemitan los funcionarios con autoridad de policía del Sistema Nacional de Áreas\nde Conservación de acuerdo a lo dispuesto en la normativa vigente, en las\npolíticas, los lineamientos, las directrices y los planes del área protegida\ndebidamente emitidos de conformidad con lo dispuesto en los artículos 25\nincisos 5) y 8), y 30 incisos 5) y 6) de la Ley de Biodiversidad N°7788.\n\nArtículo 4.- El pago de las tarifas correspondientes a las actividades que se\nautoricen a la luz de la presente disposición se realizarán de conformidad con\nlo dispuesto en el Decreto Ejecutivo N°38295-MINAE denominado \"Tarifas por\nDerechos de Ingreso y otros servicios ofrecidos en las Áreas Silvestres\nProtegidas bajo la Administración del Sistema Nacional de Áreas de\nConservación\" y sus modificaciones.\n\nArtículo 5.- Para efectos del presente Reglamento se utilizarán las siguientes\nabreviaturas:\n\na) ASP: Áreas Silvestres Protegidas.\n\nb) MINAE: Ministerio de Ambiente y Energía.\n\nc) SINAC: Sistema Nacional de Áreas de Conservación.\n\nd) CORACAT: Consejo Regional del Área de Conservación Arenal Tempisque.\n\ne) ACAT: Área de Conservación Arenal Tempisque.\n\nf) PNPV: Parque Nacional Palo Verde.\n\ng) ICT: Instituto Costarricense de Turismo.\n\nArtículo 6.- Para efectos del presente Reglamento se definen los siguientes términos:\n\na. Acosar: Acción de acorralar, atrapar, perseguir o tratar de extraer de hábitat\nnatural a un animal.\n\nb. Caza: La acción, con cualquier fin, de acosar, apresar o matar animales\nsilvestres, así como la recolección de productos o subproductos derivados de\nestos.\n\nc. Fogatas: Fuego generado con palos, ramas, hojarasca, carbón o cualquier otro combustible.\n\nd. Contaminar: Alterar negativamente las condiciones naturales de un medio, paisaje, ecosistema\nya sea física o químicamente.\n\ne. Extraer: Sacar vida silvestre, sus partes, productos o derivados.\n\nf. Manipular: Operar con las manos o con cualquier instrumento especies de flora o\nfauna silvestre.\n\ng. Plan General de Manejo: Es el instrumento de planificación que permite orientar la gestión del\nPNPV hacia el cumplimiento de sus objetivos de conservación a largo plazo. Se fundamenta\nen líneas de acción estratégicas a mediano plazo y en objetivos de manejo para los\nelementos naturales y culturales incluidos dentro del área, así como en la\nrelación de estos últimos con su entorno socio ambiental. Es la base para el\ndesarrollo de otros instrumentos de planificación y reglamentación del PNPV.\n\nh. Voluntario: Persona física que de manera voluntaria y sin remuneración económica, colabora\ncon el Sistema Nacional de Áreas de Conservación (SINAC), apoyando en las acciones\ndesarrolladas por el personal del SINAC, tanto en las ASP, como en el resto de\nlas oficinas administrativas del SINAC.\n\nCAPÍTULO II\n\nDel Ingreso al Parque\nNacional Palo Verde\n\nArtículo 7.- Corresponderá a la Administración del PNPV, aprobar o denegar el ingreso\nal PNPV.\n\nArtículo 8.- El ingreso al PNPV está permitido únicamente para el ejercicio de las actividades\npermitidas de acuerdo a lo establecido en el Capítulo III del presente\nReglamento, permisionarios, contratistas o para actividades efectuadas u\norganizadas por la Administración en el ejercicio de sus competencias.\n\nArtículo 9.- El ingreso al PNPV para fines de filmación, fotografía, investigación y ecoturismo,\npodrá realizarse únicamente por la entrada oficial del PNPV ubicada en la comunidad\nde Bagaces, Distrito Bagaces, Cantón de Bagaces, Provincia de Guanacaste. Excepcionalmente\nla Administración podrá autorizar el ingreso al PNPV para fines de filmación o\ninvestigación por sectores distintos a la entrada oficial, siempre que se\ncumplan las siguientes condiciones conjuntamente:\n\na) Que se cuente con los respectivos permisos para el ejercicio de la\nactividad y se haya realizado previamente los pagos de las tarifas\ncorrespondientes.\n\nb) Que al momento de ingresar, se dé aviso a la Administración del ASP.\n\nc) Que el ingreso por otro sector, aumente la efectividad en tiempo para\nrealizar la actividad aprobada.\n\nd) Que el sector por el que se pretende ingresar, no resulte de peligro\npara la integridad física.\n\nLa Administración podrá\nhabilitar como sitio oficial, Puerto Chamorro para los turistas que ingresen\npor el Río Tempisque, siempre que se cuenten con las condiciones\nadministrativas para el control de ingreso correspondiente.\n\nArtículo 10.- Todos los visitantes que deseen ingresar por razones de ecoturismo al\nPNPV, podrán hacerlo en el siguiente horario: los días que corren de lunes a\ndomingo ingresando entre las 8:00 y las 14:00 horas. En todo caso la hora\nlímite para que los turistas se presenten en el sitio de salida oficial, lo\nserá las 16:00 horas.\n\nArtículo 11.- Para efectos del ingreso al PNPV, y con el fin de demostrar su\nnacionalidad o lugar de procedencia, los visitantes deberán mostrar a los\nfuncionarios de la caseta de ingreso, la cédula de identidad, cédula de\nresidencia o pasaporte, según corresponda y cuando se amerite.\n\nArtículo 12.- En los siguientes casos, para el ingreso al PNPV, el interesado deberá\nrealizar solicitudes de permisos adicionales en los términos que seguidamente\nse indican:\n\na) Para la realización de filmación comercial, científica, educativa,\nturística o periodística, el interesado deberá realizar los trámites previstos\nen el presente Reglamento.\n\nb) Para la realización de investigación y colecta científica o académica,\ndeberá regirse por lo dispuesto en los artículos 19 y 20 del presente\nReglamento.\n\nArtículo 13.- Los funcionarios del PNPV podrán denegar el ingreso a personas, cuando\nsea aparente que se encuentren bajo los efectos de algún estupefaciente,\nsustancia psicotrópica o droga de uso no autorizado.\n\nArtículo 14.- La Administración del PNPV, permitirá el ingreso de personas en esta\nárea silvestre protegida, siguiendo las disposiciones que establezcan los\nestudios de capacidad de carga terrestre o flujo de visitación oficializados\npor el CORACAT. La Administración del PNPV, llevará un sistema de control\nactualizado, que le permitirá determinar en todo momento, el número de\nvisitantes presentes.\n\nArtículo 15.- Se permite, por excepción, el ingreso de perros que se encuentren\nadiestrados para servir como guías a visitantes con condición de ceguera o\ndeficiencia visual grave.\n\nCAPÍTULO III\n\nSECCIÓN I\n\nRegulación de Actividades\nPermitidas dentro del Parque Nacional Palo Verde\n\nArtículo 16.- Según lo establecido en el Plan General de Manejo del Parque Nacional\nPalo Verde, así como en la normativa vigente, únicamente se permite a los\nadministrados las actividades de investigación, capacitación y ecoturismo, así\ncomo las actividades de manejo activo reguladas en los Decretos Ejecutivos\nN°27345-MINAE del 18 de agosto de 1998 y N°39786 -MINAE del 22 de abril de\n2016.\n\nArtículo 17.- Para efectos de autorización y aplicación de las actividades permitidas\nen el presente reglamento se considerará con carácter vinculante la\nzonificación establecida en el Plan General de Manejo del PNPV; de conformidad\ncon la siguiente clasificación:\n\na) Zona de protección absoluta (ZPA).\n\nb) Zona de uso especial (ZUE).\n\nc) Zona de uso restringido (ZUR).\n\nd) Zona de Amortiguamiento (ZA).\n\ne) Zona de Uso Público (ZUP) (uso extensivo y uso intensivo).\n\nSECCIÓN II\n\nDel Ejercicio de la Investigación\n\nArtículo 18.- Las actividades de investigación y de colecta científica y académica\nestán permitidas dentro de toda la zonificación geográfica del PNPV. Para el\nejercicio de dicha actividad, el interesado deberá contar con los permisos y licencias\nrespectivas debidamente emitidas y vigentes.\n\nArtículo 19.- Las actividades de investigación y de colecta científica y académica, se\nregirán según lo establecido en el Decreto Ejecutivo N°32553-MINAE del 29 de\nmarzo de 2005 denominado \"Manual de Procedimientos para realizar\nInvestigación en Biodiversidad y Recursos Culturales en las Áreas de\nConservación\" y en la Ley de Conservación de la Vida Silvestre N°7317 o en\nsu defecto, en la normativa vigente que rija dicha actividad en las ASP.\n\nArtículo 20.- Las investigaciones que requieran acceso a los elementos bioquímicos y genéticos\nde la biodiversidad se regirán de acuerdo a lo dispuesto en la Ley de\nBiodiversidad Nº7788 y su reglamento.\n\nArtículo 21.- Adicionalmente a las obligaciones a las que el investigador se encuentre\nsometido de acuerdo a las normas referidas en los artículos anteriores;\naquellas investigaciones cuyos resultados sean catalogados por la\nAdministración de relevancia para la conservación y el manejo de los\necosistemas o especies presentes en el PNPV; el investigador deberá realizar\nuna exposición presencial al personal de PNPV, al culminar la investigación.\nPara tal efecto deberá coordinar con el Administrador del ASP a efectos de determinar\nla fecha y lugar. La presentación deberá contener como mínimo:\n\na) Resultados obtenidos durante la investigación.\n\nb) Recomendaciones para la gestión del área protegida a la luz de los\nhallazgos encontrados.\n\nArtículo 22.- Durante el periodo de ejecución de las investigaciones y sin necesidad\nde dar aviso al investigador, la Dirección del ACAT, la Dirección de ASP del\nACAT o la Administración del PNPV, podrán designar funcionarios para la\nfiscalización de la investigación a afectos de controlar que se realice\nsiguiendo la metodología autorizada.\n\nSECCIÓN III\n\nDel Ejercicio del\nEcoturismo\n\nArtículo 23.- Las actividades de ecoturismo en el PNPV se regularán de la siguiente\nmanera:\n\na) En la Zona de Protección Absoluta se encuentra totalmente prohibido el\nejercicio de la actividad ecoturística.\n\nb) En la Zona de Uso Restringido únicamente se autorizará ecoturismo\nespecializado por excepción y para ello deberá contarse con autorización del\nAdministrador del ASP, quien definirá los términos y condiciones que deberán\ncumplirse en caso de aprobar la actividad.\n\nc) En la Zona de Uso Público de uso extensivo, se permiten las siguientes\nactividades de ecoturismo: caminatas efectuadas con guía turístico en grupos no\nmayores a quince personas y turismo especializado. Constituyen sectores de uso\npúblico de uso extensivo:\n\nc.1) El sector denominado \"Sitio Arqueológico La Espuela y Palo Verde\" que\ncomprende los sitios La Espuela y Palo Verde. En este sector únicamente se\npermite únicamente el ecoturismo especializado.\n\nc.2) El sector denominado \"Senderos - Miradores\" que comprende los sitios:\nSendero Cerro Pelón, La Venada, sendero Sonzapote y La Martilla.\n\nc.3) El sector denominado \"Torres de observación de ave\" que comprende los\nsitios: Sector cercano a la antigua pista de aterrizaje y sector Catalina.\n\nc.4) El sector denominado \"Sitios de interés geológico\" que comprende los\nsitios: Cueva del Tigre, Piedra Hueca, Los Tajos (Jocote, Negrito, Catalina y\nBorde del Bebedero (Las Palmitas)), La Bocana, Cerro Alvarado, La Cantera.\n\nc.5) El sector denominado \"Arboretum\" ubicado adyacente a la Zona de Uso\nEspecial, específicamente en el sector Puesto Administrativo Palo Verde.\n\nd) En la Zona de Uso Público de uso intensivo, se permiten las siguientes\nactividades de ecoturismo: caminatas, observación de flora y fauna, filmación y\nfotografía. Constituyen sectores de uso público de uso intensivo:\n\nd.1) El sector denominado \"Área administrativa Palo Verde\" que comprende\ntorre de observación de aves, corral, sitio conocido como área de acampar y\nPuerto Chamorro.\n\nd.2) El sector denominado \"Sendero-Miradores\" que comprenden los sitios\nSendero y Mirador La Cantera, Sendero y mirador La Roca, Sendero y mirador\nGuayacán, sendero y mirador El Cactus, Sendero el Pizote y Sendero El Mapache,\nsendero elevado.\n\nd.3) El sector denominado \"Caseta Negritos\" que comprende caseta de\ninformación y cobro de admisión y servicios sanitarios.\n\nd.4) El sector denominado \"Caminos de acceso principales\" que comprenden las\nrutas de acceso que conectan los sectores de \"Caseta Negritos\" con el Sector\nAdministrativo y Puerto Chamorro, además unen el cruce hacia el sector Catalina\ny este con el límite de la Hacienda Rancho Horizontes.\n\nd.5) El sector denominado \"Sitios de interés cultural\" que comprende sitios\ncercanos al corral, \"La Mulera\" y edificios históricos cercanos a la\nadministración; las pilas y antiguos canales de abastecimiento de agua en los\nsitios de Palo Verde, Catalina, Avellanal y Sonzapote.\n\nd.6) El sector denominado \"Torres de observación de aves\" que comprende las\ndos torres que están construidas en el sector de Palo Verde.\n\nArtículo 24.- Todo el que esté interesado en desarrollar caminatas guiadas bajo el\nconcepto indicado en el inciso c) del artículo anterior, deberá presentar\nsolicitud de autorización de ingreso al ASP. La solicitud deberá ser presentada\ncon al menos 15 días naturales de antelación a la fecha en que se pretende\nrealizar la actividad y contener los siguientes requisitos:\n\na) Nombre del solicitante.\n\nb) Nombre del guía turístico, número de identificación y número de\ncredencial de guía de turismo asignada por el ICT, en caso de que corresponda.\n\nc) Cantidad de ecoturistas que pretenden ingresar.\n\nd) Fecha en la que se pretende efectuar la actividad académica.\n\ne) Firma del solicitante.\n\nf) Lugar para notificaciones.\n\nEn caso de que la solicitud\nse encuentre incompleta, se realizará una única prevención escrita al\nsolicitante para que complete los requisitos omitidos en la solicitud o para\nque aclare o subsane la información otorgando un plazo razonable de hasta diez\ndías hábiles para completar o aclarar. Dicha prevención suspenderá\ntemporalmente el plazo para resolver. En caso de que la prevención no sea\natendida por el solicitante se procederá con el archivo del trámite.\n\nArtículo 25.- Habiéndose cumplido los requisitos establecidos en el artículo 24 del\npresente Reglamento, la Administración del PNPV procederá a autorizar o denegar\nla solicitud mediante resolución administrativa debidamente fundamentada, misma\nque deberá emitirse en un plazo no mayor a los 5 días naturales una vez\ncumplidos todos los requisitos. En caso de que bajo debido razonamiento no sea\nposible autorizar la actividad para la fecha solicitada el Administrador\nsugerirá en el mismo acto administrativo, otra fecha para que sea considerada\npor el interesado.\n\nArtículo 26.- Los funcionarios del ACAT debidamente identificados, sin previo aviso, podrán\nacompañar a los turistas, cuando lo estimen conveniente, con el fin de\nfiscalizar, controlar y monitorear las actividades que estos realicen, así como\npara orientar y brindar información ambiental a los visitantes. Esta labor\npodrá ser realizada también por voluntarios, pero estos no podrán ejercer\nacciones propias de la autoridad de policía.\n\nSECCIÓN IV\n\nDel Ejercicio de la\nAcademia\n\nArtículo 27.- El ejercicio de la academia podrá ejercerse en las zonas de uso público\ndel PNPV sin requerimiento adicional al pago de tarifa por derecho de ingreso.\n\nArtículo 28.- Los sectores denominados \"zonas de humedal sujetas a un manejo activo\" y\n\"esteros\" definidos por el Plan General de Manejo como zonas de uso\nrestringido, podrán ser utilizados como aula abierta por centros académicos u\norganizaciones no gubernamentales. Esta actividad se restringe en los\nsiguientes términos:\n\na) Los grupos deberán estar integrados por un máximo de 30 personas.\n\nb) Durante la actividad no podrá manipularse vida silvestre.\n\nc) Solicitud de autorización ante la Administración del PNPV. La solicitud\ndeberá ser presentada con al menos una semana de antelación a la fecha en que\nse pretende realizar la actividad y contener los siguientes requisitos:\n\n1- Nombre del centro académico u organización no gubernamental.\n\n2- Objetivos específicos que se pretenden cumplir con la actividad\nacadémica.\n\n3- Cantidad de estudiantes que pretenden ingresar.\n\n4- Fecha en que se pretende efectuar la actividad académica.\n\n5- Firma del docente responsable de la actividad académica o de la\nDirección del Centro Académico u organización no gubernamental.\n\n6- Lugar para notificaciones.\n\nEn caso de que la solicitud\nse encuentre incompleta se realizará una única prevención escrita al\nsolicitante para que complete los requisitos omitidos en la solicitud o para\nque aclare o subsane la información, otorgándose un plazo razonable de hasta\ndiez días hábiles para completar o aclarar. Dicha prevención suspenderá\ntemporalmente el plazo para resolver. En caso de que la prevención no sea\natendida por el solicitante, se procederá con el archivo del trámite.\n\nArtículo 29.- Habiéndose cumplido los requisitos establecidos en el artículo anterior\ndel presente Reglamento, la Administración del PNPV procederá a autorizar o\ndenegar la solicitud mediante resolución administrativa debidamente\nfundamentada, misma que deberá emitirse en un plazo no mayor a los 10 días\nnaturales una vez cumplidos todos los requisitos. En caso de que bajo debido\nrazonamiento no sea posible autorizar la actividad académica para la fecha\nsolicitada, el Administrador sugerirá en el mismo acto administrativo otra\nfecha para que sea considerada por el interesado.\n\nArtículo 30.- La Administración del PNPV podrá integrar en todo caso hasta tres funcionarios\ninstitucionales o voluntarios a la actividad académica como mecanismo de gestión\ndel conocimiento. En ningún caso el centro educativo u organización no gubernamental\nautorizada, podrá realizar cobro alguno por la presencia de estas personas asignadas\npor la Administración para participar en la actividad.\n\nArtículo 31.- La Administración podrá autorizar la impartición de cursos\nespecializados, los que se tramitarán mediante permisos de uso o contratación\nde servicios no esenciales según corresponda, de conformidad con las normas que\nregulan la materia.\n\nSECCIÓN V\n\nDel Ejercicio de la\nFilmación\n\nArtículo 32.- La filmación dentro del PNPV está permitida en los términos previstos en\nel Decreto Ejecutivo Nº38295-MINAE del 15 de enero de 2014 y sus reformas. Esta\nactividad podrá ser realizada únicamente en las siguientes circunstancias:\n\na) Por quienes realizando otra actividad que les haya sido autorizada deseen\nrealizar filmación con el único fin de mantener un recuerdo.\n\nb) Las actividades de filmación periodística debidamente autorizadas por el\nAdministrador del PNPV.\n\nc) Las actividades de filmación comercial, científica, educativa o\nturística debidamente autorizadas por la Dirección del ACAT en las zonas\npermitidas por el Plan General de Manejo.\n\nArtículo 33.- Para realizar las actividades de filmación comercial, científica,\neducativa o turística, el usuario deberá tramitar con un plazo de antelación de\nun mínimo de 15 días naturales, un permiso ante la Dirección del ACAT y pagar\nla tarifa correspondiente. La Dirección del ACAT otorgará o denegará el permiso\nsolicitado mediante resolución debidamente fundamentada, que se emitirá en un\nplazo máximo de 10 días naturales posterior a la presentación de la solicitud.\nDicha solicitud deberá contener los siguientes datos:\n\na) Nombre y calidades del solicitante. En caso de que el solicitante sea\nuna persona jurídica la solicitud deberá estar suscrita por el representante\nlegal o en su defecto por quien posea poder general o especial que le otorgue\nfacultades suficientes para realizar la solicitud.\n\nb) Fines del material a ser filmado.\n\nc) Indicación de la cantidad de días que se pretende realizar filmación.\n\nd) Indicar lugar para notificaciones.\n\nAdemás, deberá adjuntarse a\nla solicitud los siguientes documentos:\n\n1) Certificación registral de la personería jurídica\n\n2) Copia del guion de filmación.\n\nAl momento de presentación\nde la solicitud, deberá presentarse la cédula de identidad del solicitante en\ncaso de persona física o del representante legal en caso de persona jurídica, a\nefectos de que el funcionario que recibe la gestión verifique la identidad y\ndeje constancia de ello.\n\nEn caso de que la solicitud\nse encuentre incompleta se realizará una única prevención escrita al\nsolicitante para que complete los requisitos omitidos en la solicitud o para\nque aclare o subsane la información, otorgándose para ello un plazo razonable\nde hasta diez días hábiles para completar o aclarar. Dicha prevención\nsuspenderá temporalmente el plazo para resolver. En caso de que la prevención\nno sea atendida por el solicitante se procederá con el archivo del trámite.\n\nArtículo 34.- La filmación periodística (con fines noticiosos) requerirá una\nautorización escrita por parte del Administrador del PNPV. Para tal efecto el\ninteresado deberá solicitar la autorización llenando el formulario que para tal\nefecto se dispondrá en la Administración del PNPV y que contendrá lo siguiente:\na) Nombre y calidades del solicitante. En caso de que pertenezca a un medio de\ncomunicación, detallar las calidades de la empresa. b) Fines del material a\nfilmar. c) Indicación del lugar para notificaciones. El plazo para aprobación por\nparte de la Administración, será de dos horas.\n\nAl momento de presentación\nde la solicitud deberá presentarse la cédula de identidad del solicitante y\ncopia del documento que le acredite como periodista del medio de comunicación a\nefectos de que el funcionario que recibe la gestión verifique la identidad y\ndeje constancia de ello.\n\nArtículo 35.- Si por razones de mantenimiento, protección o conservación se restringen\nlos permisos de filmación, tendrá prioridad la filmación por motivos de\ninvestigación científica y de actividades de manejo, sobre la filmación\ncomercial.\n\nArtículo 36.- Las filmaciones de aficionados que pretendan únicamente la preservación\nde un recuerdo de la visita al ASP, estarán exentas de pago de tarifa según lo\ndispuesto en el Decreto Ejecutivo N°38295-MINAE del 15 de enero de 2014 y sus\nreformas, con la salvedad de que las mismas no podrán ser utilizadas para fines\ncomerciales o de lucro.\n\nArtículo 37.- Se encuentra prohibida la filmación con drones dentro del PNPV, excepto cuando\nla filmación es realizada por la Administración o si los fines son científicos\ny ello se encuentra debidamente contemplado dentro de la metodología de la\ninvestigación que haya sido debidamente aprobada por la Dirección del ACAT.\n\nSECCIÓN VI\n\nActividades Prohibidas\n\nArtículo 38.- Respecto a las especies de vida silvestre, dentro del PNPV queda\nestrictamente prohibido a los visitantes:\n\na) El comercio y trasiego de cualquier producto de vida silvestre de origen\nacuático y terrestre.\n\nb) Pescar, cazar, extraer, manipular, acosar, y hostigar a individuos de\ncualquier tipo de especies animales acuáticas o terrestres.\n\nc) Extraer y manipular organismos de cualquier tipo de especies vegetales\nacuáticas o terrestres.\n\nd) Extraer y manipular cualquier especie perteneciente al reino Fungi\n(hongos).\n\ne) Extraer cualquier tipo de material orgánico o inorgánico, incluyendo\nmaterial arqueológico, arena, piedras para cualquier tipo de uso.\n\nf) El uso de jaulas para la observación de fauna, salvo para fines\ncientíficos o educativos, siempre y cuando, cuenten con el permiso respectivo\notorgado por la autoridad competente.\n\ng) Alimentar a los organismos acuáticos y terrestres.\n\nh) El ingresar con cualquier tipo de mascotas al ASP.\n\ni) Uso de artefactos con sonidos similares a especies de fauna para hacer\n\"llamados\" o atraer a las especies.\n\nSolamente se permitirá el\nejercicio de dichas conductas cuando se efectúen con fines científicos,\neducativos o de manejo por parte de personal del SINAC o investigadores, que cuenten\ncon la respectiva autorización.\n\nArtículo 39.- En relación con el uso del PNPV, queda absolutamente prohibido:\n\na) Realizar cualquier tipo de marca en árboles, rocas y cualquier otro\nelemento dentro de los límites del PNPV.\n\nb) La portación ni el uso de ningún tipo de arma (sean estas de fuego,\narmas blancas, armas de aire comprimido o resorte, flechas de liga, arbaletas,\no cualquier tipo de arma hechiza), excepto que éstas se usen con fines de\nmanejo autorizado por el ACAT o el control y vigilancia ejercido por el Estado.\n\nc) La venta y consumo de drogas. Se exceptúan de la presente disposición,\naquellas sustancias de tratamiento médico.\n\nd) Acampar o encender fogatas dentro de los límites del ASP.\n\ne) El nudismo.\n\nf) Cualquier tipo de contaminación ambiental producida por residuos sólidos\no líquidos.\n\ng) La generación de ruidos excesivos salvo los que se generen por razones\nadministrativas.\n\nh) El ingreso de alimentos que contengan semillas.\n\ni) Desviarse fuera del ancho de los senderos durante las caminatas guiadas.\n\nArtículo 40.- Quedan prohibidas de forma general todas aquellas actividades que se encuentren\nasí consideradas por la normativa ambiental vigente o que constituyan contravenciones\no delitos según el ordenamiento jurídico nacional.\n\nCAPÍTULO IV\n\nPotestades de la Administración\n\nArtículo 41.- Los funcionarios de la oficina regional del ACAT y los funcionarios del\nPNPV, constituyen el personal encargado de velar por el cumplimiento de la\nnormativa jurídica vigente para todas las actividades que se realicen dentro de\nlas ASP, sin perjuicio de las facultades de otros cuerpos policiales y órganos\njudiciales.\n\nArtículo 42.- La Administración del PNPV podrá realizar evaluaciones periódicas sobre\nla calidad en el servicio de guiado de turistas por parte de guías generales,\nespecializados y locales; siendo que de encontrar irregularidades, así lo\ncomunicará al Departamento respectivo del Instituto Costarricense de Turismo\npara lo que corresponda.\n\nArtículo 43.- La Dirección del ACAT, previa recomendación del Comité Técnico\nCientífico, tiene la potestad de autorizar la apertura de nuevos sitios\ndestinados para la realización de las actividades previstas en el presente\nReglamento, así como cerrar aquellos sitios de uso restringido que considere\nnecesarios para fines de manejo o conservación.\n\nArtículo 44.- La administración del PNPV puede, en cualquier momento, restringir las actividades\ny sitios de uso público, ello siguiendo los principios que rigen en materia ambiental\ny los objetivos establecidos en el Plan de Manejo del ASP. Si la restricción\nrequiere ser aplicada para un plazo mayor de un mes, la dictará y la pondrá en\nconocimiento del Comité Técnico Científico del Área de Conservación para que\nrecomiende a la Dirección del ACAT prorrogar su vigencia por el tiempo que se\nconsidere necesario, a la luz de los principios que rigen la materia ambiental\ny la sana crítica.\n\nArtículo 45.- El personal del PNPV, debidamente identificado, podrá cuando lo estime necesario,\nrealizar cualquier otra inspección que la Administración considere necesaria\npara dar cumplimiento al presente Reglamento y la normativa conexa.\n\nArtículo 46.- La Dirección del ACAT tendrá la potestad de ordenar el cierre temporal o\npermanente de las actividades permitidas en el PNPV, si mediante el criterio del\npersonal técnico del PNPV, o de especialistas, a través del monitoreo ambiental\ny otras actividades técnicas propuestas en el Plan de Manejo, o en otros\nestudios técnicos necesarios para el adecuado manejo de los recursos\nbiológicos, se detecte algún impacto negativo o deterioro en la integridad de\nlos mismos o en correcta aplicación de los principios preventivo y precautorio\nque rigen la materia. También podrá ordenarse el cierre cuando sea necesario para\nla ejecución de las acciones recomendadas por los programas de manejo, cuyo\nbuen desarrollo pudiera ser afectado por la presencia de visitantes en el ASP.\n\nArtículo 47.- En caso de emergencia, la Administración del PNPV tendrá la potestad de ejecutar\nel plan de contingencia establecido para tal fin, con el propósito de\nsalvaguardar la integridad física de los usuarios y funcionarios. and the Regulation to the Biodiversity Law, Executive\nDecree No. 34433-MINAE of March 11, 2008.\n\nConsidering:\n\nFIRST:\nThat\nby Executive Decree No. 11541-A of May 30, 1980, ratified\nby Law No. 6794 of August 25, 1982, Palo Verde National\nPark was created.\n\nSECOND:\nThat the\nBiodiversity Law No. 7788 of April 30, 1998, in its article 22, created the\nNational System of Conservation Areas (SINAC), as a decentralized and participatory institutional management and coordination system, which integrates\ncompetencies in forestry, wildlife, protected areas, and the\nMinistry of Environment and Energy, in order to issue policies, plan, and\nexecute processes aimed at achieving sustainability in the management of\nCosta Rica's natural resources.\n\nTHIRD:\nThat\nthe General Management Plan for Palo Verde National Park has been issued through\nresolution R-SINAC-CONAC-23-2016 published in Digital Supplement No. 244 of\nthe Official Gazette La Gaceta No. 211 of November 3, 2016.\n\nFOURTH: That the Organic Environmental\nLaw No. 7554 of October 4, 1995, provides that the creation,\nconservation, administration, development, and surveillance of Protected\nAreas shall have as objectives, conserving natural environments,\nensuring the balance and continuity of the evolutionary and\necological processes upon which some wild species depend.\n\nFIFTH: That the Organic Environmental\nLaw No. 7554 of October 4, 1995, determines the Management Categories,\nas well as the competencies, regulations, and responsibilities designated\nto the State through MINAE and SINAC, to achieve compliance with\nits conservation objectives.\n\nSIXTH: That in the Five-Year Strategic\nPlan 2016-2026 of the National System of Conservation Areas,\ndeveloping the sustainable tourism program in protected areas is included as a strategic action.\n\nSEVENTH:\nThat the\nSustainable Tourism Policy formalized by the National System of Conservation Areas establishes that \".tourism management in the ASP must\nbe developed within a sustainability framework, integrated with its\nareas of influence and articulated with national conservation\nand tourism policies, plans, and programs.\"\n\nEIGHTH: That in accordance with\narticle 18 of the Forest Law No. 7575, in protected wild areas\nfor holding the status of State Natural Heritage, only\nresearch, training, and ecotourism activities are permitted, as well as\nactivities necessary for the use of water for human consumption.\n\nNINTH: That it is necessary\nto issue a new regulation for the public use of Palo Verde National Park,\nin accordance with the provisions of the Management Plan for this protected wild area, in\nrelation to the activities permitted by the corresponding\nmanagement categories.\n\nTENTH: That this\nregulation responds to the highest environmental principles set forth in\narticles 9 and 11 of the Biodiversity Law No. 7788 for the adequate conservation\nof the protected wild area; fully complying with the provisions of\nDirective No. 052-MP-MEIC.\n\nELEVENTH:\nThat\nin accordance with the Regulation to the Law for the Protection of Citizens from\nExcess Requirements and Administrative Procedures, Executive Decree No. 37045-MP-MEIC of\nFebruary 22, 2012, and its amendments, this proposal complies with the\nprinciples of regulatory improvement according to the positive report DMR-DAR-INF-040-2021\nof March 16, 2021, issued by the Department of Regulatory Analysis of\nthe Directorate of Regulatory Improvement of MEIC.\n\nTherefore,\n\nTHEY DECREE:\n\n\"Regulation for\nthe Regulation of Public Use of Palo Verde National Park\"\n\nCHAPTER I\n\nGeneral Provisions\n\nArticle\n1.- This\nRegulation establishes the provisions for the use of the services\nprovided, permitted activities, restricted activities, and\nprohibited activities within the limits of Palo Verde National Park.\n\nArticle 2.- The provisions of this Regulation and the instructions issued by\nthe officials of Palo Verde National Park to persons entering\nsaid Protected Wild Area, in adherence to said instrument and the current\nregulations, are mandatory.\n\nArticle 3.- Every person who enters Palo Verde National Park must comply with\nthe provisions indicated in this Regulation, as well as the orders\nissued by officials with police authority of the National System of Conservation Areas\nin accordance with the provisions of the current regulations, in the\npolicies, guidelines, directives, and plans of the protected area\nduly issued in accordance with the provisions of articles 25\nsubsections 5) and 8), and 30 subsections 5) and 6) of the Biodiversity Law No. 7788.\n\nArticle 4.- Payment of the fees corresponding to the activities that are\nauthorized in light of this provision shall be made in accordance with\nthe provisions of Executive Decree No. 38295-MINAE named \"Fees for\nEntry Rights and other services offered in Protected Wild\nAreas under the Administration of the National System of Conservation Areas\" and its modifications.\n\nArticle 5.- For the purposes of this Regulation, the following\nabbreviations shall be used:\n\na) ASP: Protected Wild Areas.\n\nb) MINAE: Ministry of Environment and Energy.\n\nc) SINAC: National System of Conservation Areas.\n\nd) CORACAT: Regional Council of the Arenal Tempisque Conservation Area.\n\ne) ACAT: Arenal Tempisque Conservation Area.\n\nf) PNPV: Palo Verde National Park.\n\ng) ICT: Costa Rican Tourism Institute.\n\nArticle 6.- For the purposes of this Regulation, the following terms are defined:\n\na. Harass (Acosar): The action of cornering, trapping, pursuing, or attempting to extract from its natural habitat an animal.\n\nb. Hunting (Caza): The action, for any purpose, of harassing, capturing, or killing wild animals, as well as the collection of products or by-products derived from them.\n\nc. Campfires (Fogatas): Fire generated with sticks, branches, leaf litter, charcoal, or any other fuel.\n\nd. Contaminate (Contaminar): To negatively alter the natural conditions of an environment, landscape, or ecosystem, whether physically or chemically.\n\ne. Extract (Extraer): To remove wildlife, its parts, products, or derivatives.\n\nf. Manipulate (Manipular): To handle with hands or with any instrument species of wild flora or fauna.\n\ng. General Management Plan: This is the planning instrument that guides the management of the PNPV towards the fulfillment of its long-term conservation objectives. It is based on medium-term strategic lines of action and on management objectives for the natural and cultural elements included within the area, as well as on the relationship of the latter with their socio-environmental surroundings. It is the basis for the development of other planning and regulatory instruments for the PNPV.\n\nh. Volunteer: A natural person who voluntarily and without economic remuneration collaborates with the National System of Conservation Areas (SINAC), supporting the actions developed by SINAC personnel, both in the ASP and in the rest of the administrative offices of SINAC.\n\nCHAPTER II\n\nOn Entry to Palo Verde\nNational Park\n\nArticle 7.- It shall be the responsibility of the Administration of the PNPV to approve or deny entry to the PNPV.\n\nArticle 8.- Entry to the PNPV is permitted only for the exercise of the permitted activities according to the provisions of Chapter III of this Regulation, for permit holders, contractors, or for activities carried out or organized by the Administration in the exercise of its competencies.\n\nArticle 9.- Entry to the PNPV for the purposes of filming, photography, research, and ecotourism may be made only through the official entrance of the PNPV located in the community of Bagaces, Bagaces District, Canton of Bagaces, Province of Guanacaste. Exceptionally, the Administration may authorize entry to the PNPV for filming or research purposes through sectors other than the official entrance, provided that the following conditions are met jointly:\n\na) That the respective permits for the exercise of the activity are possessed and the corresponding fees have been previously paid.\n\nb) That at the time of entry, notice is given to the Administration of the ASP.\n\nc) That entry through another sector increases the time-effectiveness for carrying out the approved activity.\n\nd) That the sector through which entry is intended does not pose a danger to physical integrity.\n\nThe Administration may enable\nPuerto Chamorro as an official site for tourists entering\nvia the Tempisque River, provided that the administrative conditions\nfor the corresponding entry control exist.\n\nArticle 10.- All visitors wishing to enter the PNPV for ecotourism reasons may do so during the following schedule: from Monday to Sunday, entering between 8:00 AM and 2:00 PM. In any case, the deadline for tourists to present themselves at the official exit point shall be 4:00 PM.\n\nArticle 11.- For the purposes of entry to the PNPV, and in order to prove their nationality or place of origin, visitors must show the officials at the entry booth their identity card, residence card, or passport, as applicable and when warranted.\n\nArticle 12.- In the following cases, for entry to the PNPV, the interested party must make requests for additional permits in the terms indicated below:\n\na) For conducting commercial, scientific, educational, tourism, or journalistic filming, the interested party must carry out the procedures provided for in this Regulation.\n\nb) For conducting research and scientific or academic collection, the provisions of articles 19 and 20 of this Regulation shall apply.\n\nArticle 13.- The officials of the PNPV may deny entry to persons when it is apparent that they are under the influence of some narcotic, psychotropic substance, or unauthorized drug.\n\nArticle 14.- The Administration of the PNPV shall permit the entry of persons into this protected wild area, following the provisions established by the terrestrial carrying capacity or visitation flow studies formalized by CORACAT. The Administration of the PNPV shall maintain an updated control system, which will allow it to determine, at all times, the number of visitors present.\n\nArticle 15.- By exception, the entry of dogs that are trained to serve as guides for visitors with blindness or severe visual impairment is permitted.\n\nCHAPTER III\n\nSECTION I\n\nRegulation of Activities\nPermitted within Palo Verde National Park\n\nArticle 16.- According to the provisions of the General Management Plan of Palo Verde National Park, as well as the current regulations, only research, training, and ecotourism activities are permitted to the administered parties, as well as active management activities regulated in Executive Decrees No. 27345-MINAE of August 18, 1998, and No. 39786-MINAE of April 22, 2016.\n\nArticle 17.- For the purposes of authorization and application of the activities permitted in this regulation, the zoning established in the General Management Plan of the PNPV shall be considered binding; in accordance with the following classification:\n\na) Strict protection zone (ZPA).\n\nb) Special use zone (ZUE).\n\nc) Restricted use zone (ZUR).\n\nd) Buffer Zone (ZA).\n\ne) Public Use Zone (ZUP) (extensive use and intensive use).\n\nSECTION II\n\nOn the Exercise of Research\n\nArticle 18.- Research and scientific and academic collection activities are permitted within the entire geographical zoning of the PNPV. To exercise said activity, the interested party must possess the respective duly issued and current permits and licenses.\n\nArticle 19.- Research and scientific and academic collection activities shall be governed by the provisions of Executive Decree No. 32553-MINAE of March 29, 2005, named \"Manual of Procedures for Conducting Research on Biodiversity and Cultural Resources in Conservation Areas\" and by the Wildlife Conservation Law No. 7317, or failing that, by the current regulations governing said activity in the ASP.\n\nArticle 20.- Research requiring access to the biochemical and genetic elements of biodiversity shall be governed in accordance with the provisions of the Biodiversity Law No. 7788 and its regulation.\n\nArticle 21.- In addition to the obligations to which the researcher is subject according to the norms referred to in the preceding articles; for those investigations whose results are classified by the Administration as relevant to the conservation and management of the ecosystems or species present in the PNPV, the researcher must make an in-person presentation to the PNPV staff upon completion of the research. To this effect, they must coordinate with the Administrator of the ASP to determine the date and location. The presentation must contain at a minimum:\n\na) Results obtained during the research.\n\nb) Recommendations for the management of the protected area in light of the findings.\n\nArticle 22.- During the execution period of the research and without the need to notify the researcher, the Directorate of ACAT, the Directorate of ASP of ACAT, or the Administration of the PNPV, may designate officials for the oversight of the research to control that it is carried out following the authorized methodology.\n\nSECTION III\n\nOn the Exercise of\nEcotourism\n\nArticle 23.- Ecotourism activities in the PNPV shall be regulated as follows:\n\na) In the Strict Protection Zone, the exercise of ecotourism activity is strictly prohibited.\n\nb) In the Restricted Use Zone, only specialized ecotourism shall be authorized by exception, and for this, authorization must be obtained from the Administrator of the ASP, who shall define the terms and conditions to be met in case of approving the activity.\n\nc) In the Public Use Zone of extensive use, the following ecotourism activities are permitted: guided walks with a tour guide in groups of no more than fifteen people, and specialized tourism. The public use sectors of extensive use are:\n\nc.1) The sector called \"La Espuela and Palo Verde Archaeological Site\" which includes the La Espuela and Palo Verde sites. Only specialized ecotourism is permitted in this sector.\n\nc.2) The sector called \"Trails - Viewpoints\" which includes the sites: Cerro Pelón Trail, La Venada, Sonzapote Trail, and La Martilla.\n\nc.3) The sector called \"Bird observation towers\" which includes the sites: Sector near the old airstrip and Catalina sector.\n\nc.4) The sector called \"Geological interest sites\" which includes the sites: Cueva del Tigre, Piedra Hueca, Los Tajos (Jocote, Negrito, Catalina and Borde del Bebedero (Las Palmitas)), La Bocana, Cerro Alvarado, La Cantera.\n\nc.5) The sector called \"Arboretum\" located adjacent to the Special Use Zone, specifically in the Palo Verde Administrative Post sector.\n\nd) In the Public Use Zone of intensive use, the following ecotourism activities are permitted: walks, observation of flora and fauna, filming, and photography. The public use sectors of intensive use are:\n\nd.1) The sector called \"Palo Verde Administrative area\" which includes the bird observation tower, corral, site known as camping area, and Puerto Chamorro.\n\nd.2) The sector called \"Trail-Viewpoints\" which includes the sites: La Cantera Trail and Viewpoint, La Roca Trail and Viewpoint, Guayacán Trail and Viewpoint, El Cactus Trail and Viewpoint, El Pizote Trail, and El Mapache Trail, elevated trail.\n\nd.3) The sector called \"Negritos Booth\" which includes the information and admission collection booth and sanitary services.\n\nd.4) The sector called \"Main access roads\" which includes the access routes connecting the \"Negritos Booth\" sectors with the Administrative Sector and Puerto Chamorro, and also join the intersection towards the Catalina sector and this with the boundary of Hacienda Rancho Horizontes.\n\nd.5) The sector called \"Cultural interest sites\" which includes sites near the corral, \"La Mulera,\" and historical buildings near the administration; the basins and old water supply channels at the Palo Verde, Catalina, Avellanal, and Sonzapote sites.\n\nd.6) The sector called \"Bird observation towers\" which includes the two towers built in the Palo Verde sector.\n\nArticle 24.- Anyone interested in developing guided walks under the concept indicated in subsection c) of the preceding article must submit a request for entry authorization to the ASP. The request must be submitted at least 15 calendar days prior to the date on which the activity is intended to be carried out and must contain the following requirements:\n\na) Name of the applicant.\n\nb) Name of the tour guide, identification number, and tour guide credential number assigned by the ICT, if applicable.\n\nc) Number of ecotourists intending to enter.\n\nd) Date on which the academic activity is intended to be carried out.\n\ne) Signature of the applicant.\n\nf) Place for notifications.\n\nIn the event that the request\nis incomplete, a single written notice shall be made to the\napplicant to complete the omitted requirements in the request or\nto clarify or correct the information, granting a reasonable period of up to ten\nbusiness days to complete or clarify. Said notice shall temporarily\nsuspend the period to resolve. In case the notice is not\naddressed by the applicant, the procedure shall be archived.\n\nArticle 25.- Having fulfilled the requirements established in article 24 of this Regulation, the Administration of the PNPV shall proceed to authorize or deny the request through a duly reasoned administrative resolution, which must be issued within a period not exceeding 5 calendar days once all requirements are fulfilled. In case that, under due reasoning, it is not possible to authorize the activity for the requested date, the Administrator shall suggest in the same administrative act another date to be considered by the interested party.\n\nArticle 26.- Properly identified ACAT officials, without prior notice, may accompany tourists, when they deem it convenient, in order to supervise, control, and monitor the activities they carry out, as well as to guide and provide environmental information to visitors. This work may also be carried out by volunteers, but they may not exercise actions inherent to police authority.\n\nSECTION IV\n\nOn the Exercise of\nAcademia\n\nArticle 27.- The exercise of academia may be carried out in the public use zones of the PNPV without any additional requirement beyond the payment of the entry fee.\n\nArticle 28.- The sectors called \"wetland zones subject to active management\" and \"esteros\" defined by the General Management Plan as restricted use zones, may be used as an open classroom by academic centers or non-governmental organizations. This activity is restricted in the following terms:\n\na) Groups shall be composed of a maximum of 30 people.\n\nb) During the activity, wildlife may not be manipulated.\n\nc) Request for authorization before the Administration of the PNPV. The request must be submitted at least one week prior to the date on which the activity is intended to be carried out and must contain the following requirements:\n\n1- Name of the academic center or non-governmental organization.\n\n2- Specific objectives to be achieved with the academic activity.\n\n3- Number of students intending to enter.\n\n4- Date on which the academic activity is intended to be carried out.\n\n5- Signature of the instructor responsible for the academic activity or of the Director of the Academic Center or non-governmental organization.\n\n6- Place for notifications.\n\nIn the event that the request\nis incomplete, a single written notice shall be made to the\napplicant to complete the omitted requirements in the request or\nto clarify or correct the information, granting a reasonable period of up to ten\nbusiness days to complete or clarify. Said notice shall temporarily\nsuspend the period to resolve. In case the notice is not\naddressed by the applicant, the procedure shall be archived.\n\nArticle 29.- Having fulfilled the requirements established in the preceding article of this Regulation, the Administration of the PNPV shall proceed to authorize or deny the request through a duly reasoned administrative resolution, which must be issued within a period not exceeding 10 calendar days once all requirements are fulfilled. In case that, under due reasoning, it is not possible to authorize the academic activity for the requested date, the Administrator shall suggest in the same administrative act another date to be considered by the interested party.\n\nArticle 30.- The Administration of the PNPV may integrate in any case up to three institutional officials or volunteers into the academic activity as a knowledge management mechanism. In no case may the authorized educational center or non-governmental organization make any charge for the presence of these persons assigned by the Administration to participate in the activity.\n\nArticle 31.- The Administration may authorize the imparting of specialized courses, which shall be processed through use permits or contracting of non-essential services as applicable, in accordance with the norms regulating the matter.\n\nSECTION V\n\nOn the Exercise of\nFilming\n\nArticle 32.- Filming within the PNPV is permitted under the terms provided in Executive Decree No. 38295-MINAE of January 15, 2014, and its amendments. This activity may only be carried out under the following circumstances:\n\na) By those who, while carrying out another activity that has been authorized to them, wish to film for the sole purpose of keeping a memory.\n\nb) Journalistic filming activities duly authorized by the Administrator of the PNPV.\n\nc) Commercial, scientific, educational, or tourism filming activities duly authorized by the Directorate of ACAT in the zones permitted by the General Management Plan.\n\nArticle 33.- To carry out commercial, scientific, educational, or tourism filming activities, the user must process, with a minimum of 15 calendar days in advance, a permit before the Directorate of ACAT and pay the corresponding fee. The Directorate of ACAT shall grant or deny the requested permit through a duly reasoned resolution, to be issued within a maximum period of 10 calendar days after submission of the request. Said request must contain the following information:\n\na) Name and qualifications of the applicant. If the applicant is a legal entity, the request must be signed by the legal representative, or failing that, by whoever holds a general or special power of attorney granting sufficient authority to make the request.\n\nb) Purposes of the material to be filmed.\n\nc) Indication of the number of days filming is intended to be carried out.\n\nd) Indicate place for notifications.\n\nFurthermore, the following documents must be attached to\nthe request:\n\n1) Registry certification of the legal personality.\n\n2) Copy of the filming script.\n\nAt the time of submission\nof the request, the identity card of the applicant, in the case of a natural person, or of the legal representative, in the case of a legal entity, must be presented, so that the official receiving the procedure verifies the identity and leaves record of it.\n\nIn the event that the request\nis incomplete, a single written notice shall be made to the\napplicant to complete the omitted requirements in the request or\nto clarify or correct the information, granting a reasonable period\nof up to ten business days to complete or clarify. Said notice\nshall temporarily suspend the period to resolve. In case the notice is not\naddressed by the applicant, the procedure shall be archived.\n\nArticle 34.- Journalistic filming (for news purposes) shall require written authorization from the Administrator of the PNPV. To this effect, the interested party must request authorization by completing the form that for such purpose will be available at the Administration of the PNPV, which shall contain the following: a) Name and qualifications of the applicant. If they belong to a media outlet, detail the qualifications of the company. b) Purposes of the material to be filmed. c) Indication of the place for notifications. The period for approval by the Administration shall be two hours.\n\nAt the time of submission\nof the request, the identity card of the applicant and a copy of the document accrediting them as a journalist of the media outlet must be presented, so that the official receiving the procedure verifies the identity and leaves record of it.\n\nArticle 35.- If for maintenance, protection, or conservation reasons, filming permits are restricted, filming for scientific research purposes and management activities shall have priority over commercial filming.\n\nArticle 36.- Amateur filming intended solely for preserving a memory of the visit to the ASP shall be exempt from fee payment as provided in Executive Decree No. 38295-MINAE of January 15, 2014, and its amendments, with the proviso that the same may not be used for commercial or profit-making purposes.\n\nArticle 37.- Drone filming within the PNPV is prohibited, except when the filming is carried out by the Administration or if the purposes are scientific and this is duly contemplated within the research methodology that has been duly approved by the Directorate of ACAT.\n\nSECTION VI\n\nProhibited Activities\n\nArticle 38.- Regarding wildlife species, within the PNPV, the following is strictly prohibited for visitors:\n\na) The trade and trafficking of any wildlife product of aquatic and terrestrial origin.\n\nb) Fishing, hunting, extracting, manipulating, harassing (acosar), and molesting individuals of any type of aquatic or terrestrial animal species.\n\nc) Extracting and manipulating organisms of any type of aquatic or terrestrial plant species.\n\nd) Extracting and manipulating any species belonging to the Fungi kingdom (mushrooms).\n\ne) Extracting any type of organic or inorganic material, including archaeological material, sand, stones for any type of use.\n\nf) The use of cages for fauna observation, unless for scientific or educational purposes, provided that the respective permit granted by the competent authority is held.\n\ng) Feeding aquatic and terrestrial organisms.\n\nh) Entering the ASP with any type of pets.\n\ni) Use of devices with sounds similar to fauna species to make \"calls\" or attract species.\n\nThe exercise of such behaviors shall only be permitted when carried out for scientific, educational, or management purposes by SINAC personnel or researchers who possess the respective authorization.\n\nArticle 39.- In relation to the use of the PNPV, the following is absolutely prohibited:\n\na) Making any type of mark on trees, rocks, and any other element within the limits of the PNPV.\n\nb) The carrying or use of any type of weapon (be they firearms, bladed weapons, compressed air or spring weapons, slingshot arrows, crossbows, or any type of improvised weapon), except when these are used for management purposes authorized by ACAT or for control and surveillance exercised by the State.\n\nc) The sale and consumption of drugs. Excepted from this provision are those substances for medical treatment.\n\nd) Camping or lighting campfires (fogatas) within the limits of the ASP.\n\ne) Nudism.\n\nf) Any type of environmental contamination produced by solid or liquid waste.\n\ng) The generation of excessive noise except that generated for administrative reasons.\n\nh) The entry of food containing seeds.\n\ni) Deviating outside the width of the trails during guided walks.\n\nArticle 40.- Generally prohibited are all those activities that are so considered by current environmental regulations or that constitute contraventions or crimes according to the national legal system.\n\nCHAPTER IV\n\nPowers of the Administration\n\nArticle 41.- The officials of the regional office of ACAT and the officials of PNPV constitute the personnel responsible for ensuring compliance with the legal regulations in force for all activities carried out within the ASP, without prejudice to the powers of other police forces and judicial bodies.\n\nArticle 42.- The Administration of PNPV may conduct periodic evaluations of the quality of tourist guiding services provided by general, specialized, and local guides; and if irregularities are found, it shall communicate them to the respective Department of the Instituto Costarricense de Turismo for appropriate action.\n\nArticle 43.- The Directorate of ACAT, upon prior recommendation of the Scientific Technical Committee (Comité Técnico Científico), has the power to authorize the opening of new sites intended for carrying out the activities provided for in these Regulations, as well as to close those restricted-use sites it deems necessary for management or conservation purposes.\n\nArticle 44.- The administration of PNPV may, at any time, restrict activities and public-use sites, following the principles governing environmental matters and the objectives established in the Management Plan (Plan de Manejo) of the ASP. If the restriction needs to be applied for a period longer than one month, it shall issue it and bring it to the attention of the Scientific Technical Committee of the Conservation Area (Área de Conservación) so that it may recommend to the Directorate of ACAT to extend its validity for the time deemed necessary, in light of the principles governing environmental matters and sound judgment (sana crítica).\n\nArticle 45.- Properly identified PNPV personnel may, when deemed necessary, carry out any other inspection that the Administration considers necessary to enforce these Regulations and related regulations.\n\nArticle 46.- The Directorate of ACAT shall have the power to order the temporary or permanent closure of permitted activities in PNPV if, through the judgment of PNPV technical personnel, or specialists, via environmental monitoring and other technical activities proposed in the Management Plan, or in other technical studies necessary for the proper management of biological resources, any negative impact or deterioration to their integrity is detected or in the correct application of the preventive and precautionary principles governing the matter. Closure may also be ordered when necessary for the execution of actions recommended by management programs, the proper development of which could be affected by the presence of visitors in the ASP.\n\nArticle 47.- In the event of an emergency, the Administration of PNPV shall have the power to execute the contingency plan established for that purpose, to safeguard the physical integrity of users and officials. These administrative provisions may include the partial or total closure of the ASP, for the time deemed convenient.\n\nArticle 48.- Any official of ACAT may expel from the boundaries of PNPV those persons who, while present in the ASP, engage in prohibited activities or fail to obey provisions issued by officials in the timely performance of their duties. Likewise, the authorization to remain and undertake activities may be suspended due to adverse weather conditions or any other duly justified reason, without this generating liability for the Administration.\n\nArticle 49.- Without exception, every visitor must comply with the safety and orientation instructions given by the official, guide, or authorized teacher in charge of the group. Failure to comply with this provision shall be grounds for suspending the authorization to remain within the protected area.\n\nArticle 50.- The Administration of PNPV may authorize entry and exit times different from those established for the exercise of ecotourism pursuant to Article 10 of these Regulations, when the purpose of entry is filming or research; this upon a duly justified prior request from the permit holder.\n\nCHAPTER V\n\nFinal Provisions\n\nArticle 51.- The stipulated prohibitions shall be sanctioned in accordance with the provisions of Article 9 of the National Parks Service Law No. 6084, in Chapters XI and XII of the Wildlife Conservation Law No. 7317 and its amendments, as well as with the application of any other sanctioning regulation in force on the date of the events.\n\nArticle 52.- Active management activities within Palo Verde National Park shall be governed in accordance with the regulations established for that purpose and the specific administrative acts that the Directorate of ACAT or the Administration of PNPV issue on the matter according to their competencies.\n\nArticle 53.- It shall take effect upon its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic.
