Se exceptúan de la presente disposición aquellas sustancias de tratamiento médico.\nd) Acampar o encender fogatas dentro de los límites del área silvestre protegida.\ne) El nudismo.\nf) Cualquier tipo de contaminación ambiental producida por residuos sólidos o líquidos.\ng) La generación de ruidos excesivos salvo los que se generen por razones administrativas.\nh) El ingreso de alimentos que contengan semillas.\ni) El ingreso de alimentos preparados.   "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 43234\n\n                        Reglamento para el ejercicio de actividades permitidas dentro de la Reserva\nBiológica Lomas Barbudal\n\nNº 43234-MINAE\n\nEL PRESIDENTE DE LA\nREPÚBLICA\n\nY LA MINISTRA DE AMBIENTE Y\nENERGÌA\n\nEn ejercicio de las\nfacultades que les confieren los artículos 50, 140 incisos 3) y 18) y 146 de la\nConstitución Política; los artículos 27 inciso 1) y 28 inciso 2) acápite b) de\nla Ley General de la Administración Pública Nº 6227 del 02 de mayo de 1978,\nartículos 1, 32 y 35 de la Ley Orgánica del Ambiente N°7554 del 4 de octubre de\n1995; artículos 1 y 3 inciso d) de la Ley del Servicio de Parques Nacionales\nN°6084 del 24 de agosto de 1977; artículos 1 y 49 de la Ley de Biodiversidad\nNº7788 del 30 de abril de 1998; artículo 1 párrafo segundo de la Ley Forestal\nNº7575 del 13 de febrero de 1996, Decreto Ejecutivo N°16849 del 23 de enero de\n1986 que Declara Reserva Biológica Lomas Barbudal; y el Reglamento a la Ley de Biodiversidad,\nDecreto Ejecutivo Nº34433-MINAE del 11 de marzo de 2008.\n\nConsiderando:\n\nPRIMERO: Que la Reserva Biológica Lomas Barbudal, fue creada mediante el Decreto Ejecutivo\nN°16849-MAG del 23 de enero de 1986.\n\nSEGUNDO: Que la Ley de Biodiversidad Nº7788 del 30 de abril de 1998, en su\nartículo 22 creó el Sistema Nacional de Áreas de Conservación (SINAC), como un\nsistema de gestión y coordinación institucional, desconcentrado y\nparticipativo, que integra las competencias en materia forestal, vida\nsilvestre, áreas protegidas y el Ministerio de Ambiente y Energía, con el fin\nde dictar políticas, planificar y ejecutar procesos, dirigidos a lograr la\nsostenibilidad en el manejo de los recursos naturales de Costa Rica.\n\nTERCERO: Que se ha dictado el Plan General de Manejo de la Reserva Biológica\nLomas Barbudal mediante resolución N° R-SINAC-CONAC-24-2016 publicada en el\nDiario Oficial la Gaceta N°211 del jueves 3 de noviembre de 2016.\n\nCUARTO: Que la Ley Orgánica del Ambiente N°7554, dispone que la creación, la conservación,\nla administración y desarrollo y la vigilancia de las Áreas Silvestres\nProtegidas, tendrán como objetivos, conservar los ambientes naturales asegurando\nel equilibrio y la continuidad de los procesos evolutivos y ecológicos de los\nque dependen algunas especies silvestres.\n\nQUINTO: Que la Ley Orgánica del Ambiente N°7554, determina las Categorías de Manejo,\nasí como las competencias, regulaciones y responsabilidades que le son\ndesignadas al Estado a través del Ministerio de Ambiente y Energía (MINAE) y el\nSINAC, para lograr el cumplimiento de los objetivos de conservación de la\nmisma.\n\nSEXTO: Que en el Plan Estratégico Quinquenio 2016-2026 del Sistema Nacional de\nÁreas de Conservación, se incluye como una acción estratégica el desarrollo del\nprograma de turismo sostenible en las áreas protegidas.\n\nSEPTIMO: Que la Política de Turismo sostenible establece que la gestión del\nturismo en las áreas silvestres protegidas (ASP) deberá desarrollarse dentro de\nun marco de sostenibilidad, integrado con sus áreas de influencia y articulado\ncon las políticas, planes y programas nacionales de conservación y turismo.\n\nOCTAVO: Que conforme a lo dictado por la política 6 de las Políticas para las\nÁreas Silvestres Protegidas del SINAC, la gestión de las áreas silvestres\nprotegidas estará sustentada en una sólida base de conocimiento científico,\ntécnico y tradicional que permita el mejoramiento continuo y mayores niveles de\neficacia y eficiencia en la conservación de la biodiversidad. Constituyéndose\nasí la investigación en una acción prioritaria dentro de la Reserva Biológica\nLomas Barbudal.\n\nNOVENO: Que técnicamente la categoría de manejo Reserva Biológica, constituye\nuna categoría de manejo restrictiva de manera que las actividades deben ser\nreguladas de manera estricta para garantizar la conservación de los elementos\nfocales de manejo.\n\nDÉCIMO: Que resulta necesario dictar normas que regulen el ejercicio de las\nactividades permitidas dentro de la Reserva Biológica Lomas Barbudal, de\nacuerdo a lo establecido en el Plan General de Manejo de esta área silvestre\nprotegida, en relación con las actividades que técnicamente admite la categoría\nde manejo.\n\nDÉCIMO PRIMERO: Que el presente reglamento responde a los más altos principios ambientales\nprevistos en los artículos 9 y 11 de la Ley de Biodiversidad N°7788, para la adecuada\nconservación del área silvestre protegida; cumpliéndose cabalmente con lo dispuesto\nen la Directriz N°052-MP-MEIC.\n\nDÉCIMO SEGUNDO: Que de conformidad con el Reglamento a la Ley de Protección al Ciudadano\ndel Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº37045-MP-MEIC\ny sus reformas, la presente propuesta cumple con los principios de mejora\nregulatoria según el informe positivo DMR-DAR-INF-063-2021 del 12 de mayo de 2021,\nemitido por el Departamento de Análisis Regulatorio de la Dirección de Mejora Regulatoria\ndel MEIC.\n\nPor tanto,\n\nDECRETAN:\n\n\"Reglamento para el Ejercicio\nde Actividades Permitidas dentro de la Reserva Biológica\n\nLomas Barbudal\"\n\nCAPÍTULO I\n\nDisposiciones Generales\n\nArtículo 1.- El presente Reglamento establece las disposiciones para el uso de los\nservicios brindados, actividades permitidas, actividades restringidas y\nactividades prohibidas dentro de los límites de la Reserva Biológica Lomas\nBarbudal.\n\nArtículo 2.- Las disposiciones del presente Reglamento y las indicaciones que emitan\nlos funcionarios de la Reserva Biológica Lomas Barbudal a las personas que\ningresen a dicha Área Silvestre Protegida, en apego a dicho instrumento y la\nnormativa vigente, son de carácter obligatorio.\n\nArtículo 3.- Toda persona que ingrese a la Reserva Biológica Lomas Barbudal , debe\ncumplir las disposiciones indicadas en el presente Reglamento, así como las\nórdenes que emitan los funcionarios con autoridad de policía del Sistema\nNacional de Áreas de Conservación de acuerdo a lo dispuesto en la normativa\nvigente así como en las políticas, los lineamientos, las directrices y los\nplanes del área protegida debidamente emitidos de conformidad con lo dispuesto\nen los artículos 25 incisos 5) y 8) y numeral 30 incisos 5) y 6) de la Ley de Biodiversidad\nN°7788.\n\nArtículo 4.- El pago de las\ntarifas correspondientes a las actividades que se autoricen a la luz de la\npresente disposición se realizarán de conformidad con lo dispuesto en el\nDecreto Ejecutivo N°38295-MINAE del 15 de enero de 2014 y sus reformas\ndenominado \"Tarifas por Derechos de Ingreso y otros servicios ofrecidos en las\nÁreas Silvestres Protegidas bajo la Administración del Sistema Nacional de\nÁreas de Conservación\".\n\nArtículo 5.- Para efectos del presente Reglamento se utilizarán las siguientes\nnomenclaturas y abreviaturas:\n\na) MINAE: Ministerio de Ambiente y Energía\n\nb) SINAC: Sistema Nacional de Áreas de Conservación.\n\nc) CORACAT: Consejo Regional del Área de Conservación Arenal Tempisque.\n\nd) ACAT: Área de Conservación Arenal Tempisque.\n\ne) RBLB: Reserva Biológica Lomas Barbudal.\n\nf) ICT: Instituto Costarricense de Turismo.\n\nArtículo 6.- Para efectos del presente Reglamento se definen los siguientes términos:\n\na. Academia: Actividad orientada a la enseñanza o capacitación en conocimientos\nteórico prácticos de los componentes de la biodiversidad.\n\nb. Acosar: Acción de acorralar, atrapar, perseguir o tratar de extraer de hábitat\nnatural a un animal.\n\nc. Aula abierta: Sitio al aire libre en el que se realiza el ejercicio de la academia.\n\nd. Caza: La acción, con cualquier fin, de acosar, apresar o matar\nanimales silvestres, así como la recolección de productos o subproductos\nderivados de estos.\n\ne. Fogatas: Fuego generado con palos, ramas, hojarasca, carbón y\notros combustibles.\n\nf. Contaminar: Alterar negativamente las condiciones naturales de\nun medio, paisaje, ecosistema, sea física o químicamente.\n\ng. Extraer: Sacar vida silvestre, sus partes, productos o derivados.\n\nh. Manipular: Operar con las manos o con cualquier instrumento especies de flora o\nfauna silvestre.\n\ni. Plan General de Manejo: Instrumento de planificación que permite orientar la gestión de la RBLB\nhacia el cumplimiento de sus objetivos de conservación a largo plazo. Se fundamenta\nen líneas de acción estratégicas a mediano plazo y en objetivos de manejo para los\nelementos naturales y culturales incluidos dentro del área, así como en la\nrelación de estos últimos con su entorno socio ambiental. Es la base para el\ndesarrollo de otros instrumentos de planificación y reglamentación de la RBLB.\n\nj. Voluntario: se refiere a la persona física que de manera voluntaria y sin\nremuneración económica, colabora con el Sistema Nacional de Áreas de\nConservación (SINAC), apoyando en las acciones desarrolladas por el personal\ndel SINAC, tanto en las Áreas Silvestres Protegidas (ASP), como en el resto de\nlas oficinas administrativas del SINAC.\n\nCAPÍTULO II\n\nDel Ingreso a la Reserva Biológica Lomas Barbudal\n\nArtículo 7.- Corresponderá a la Administración de la RBLB, aprobar o denegar el\ningreso a la RBLB.\n\nArtículo 8.- El ingreso a la RBLB está permitido únicamente para el ejercicio de las actividades\npermitidas de acuerdo a lo establecido en el Capítulo III del presente\nReglamento o para actividades efectuadas por la Administración Pública en el\nejercicio de sus competencias.\n\nArtículo 9.- El ingreso a la RBLB para fines de filmación, fotografía, investigación\ny ecoturismo, podrá realizarse únicamente por la entrada oficial de la RBLB\nubicada en San Ramón de Bagaces, Guanacaste u otro puesto operativo oficial que\nla Administración establezca oficialmente.\n\nArtículo 10.- Toda persona física que desee ingresar por razones de ecoturismo a la\nRBLB podrá hacerlo en el siguiente horario: los días que corren de lunes a\ndomingo ingresando entre las 8:00 y las 16:00 horas. En todo caso la hora\nlímite para presentarse en el sitio de salida oficial lo será las 16:30 horas.\n\nCAPÍTULO II\n\nDel Ingreso a la Reserva\nBiológica Lomas Barbudal\n\nArtículo 11.- Para efectos\nel ingreso a la RBLB; y con el fin de demostrar su nacionalidad o lugar de\nprocedencia, los (as) visitantes deberán mostrar a los (as) funcionarios (as)\nde la caseta de ingreso, la cédula de identidad, cédula de residencia o\npasaporte, según corresponda y cuando se amerite.\n\nArtículo 12.- En los siguientes casos, para el ingreso a la RBLB, el interesado deberá\nrealizar solicitudes de permisos adicionales en los términos que seguidamente\nse indican:\n\na) Para la realización de filmación comercial, científica, educativa,\nturística o periodística, el interesado deberá realizar los trámites previstos\nen la sección V del Capítulo III del presente Reglamento.\n\nb) Para la realización de investigación y colecta científica o académica\ndeberá regirse por lo dispuesto en los artículos 19 y 20 del presente\nReglamento.\n\nc) Para la realización de caminatas guiadas independientemente de su fin,\nel interesado deberá realizar el trámite previsto en los artículos 24 y 25 del\npresente Reglamento.\n\nArtículo 13.- Los funcionarios de la RBLB podrán denegar el ingreso a personas cuando sea\naparente que se encuentren bajo los efectos de algún estupefaciente, sustancia psicotrópica\no droga de uso no autorizado.\n\nArtículo 14.- La Administración de la RBLB, permitirá el ingreso de personas en esta\nárea protegida, siguiendo las disposiciones que establezcan los estudios de\ncapacidad de carga terrestre o flujo de visitación oficializados por el\nCORACAT. La Administración de la RBLB, llevará un sistema de control\nactualizado, que le permitirá determinar en todo momento, el número de\nvisitantes presentes.\n\nArtículo 15.- Dentro de la Reserva Biológica Lomas Barbudal, no se permitirá el\ningreso de bicicletas, caballos ni vehículos de ningún tipo, salvo para labores\nde control y vigilancia, prevención de incendios, atención de emergencias o por\nautorización expresa de la Administración de la RBLB o la Dirección del ACAT.\nLas entradas por los sectores de Agua Fría, Balas de Cañon, Papayito,\nMarañonal, Madroño, Cabuyo y Las Mesas, tendrán portones que limitarán el\nacceso a la Reserva Biológica Lomas Barbudal.\n\nCAPÍTULO III\n\nRegulación de Actividades\nPermitidas dentro de la Reserva Biológica Lomas\n\nBarbudal\n\nSECCIÓN I\n\nDe las actividades permitidas\n\nArtículo 16.- Según lo establecido en el Plan General de Manejo de la Reserva Biológica\nLomas Barbudal así como la normativa vigente, únicamente se permite a los administrados\nlas actividades de investigación, capacitación y ecoturismo de bajo impacto.\n\nArtículo 17.- Para efectos de autorización y aplicación de las actividades permitidas\nen el presente Reglamento, se considerará con carácter vinculante la\nzonificación establecida en el Plan General de Manejo de la RBLB; de\nconformidad con la siguiente clasificación:\n\na) Zona de protección absoluta (ZPA).\n\nb) Zona de uso especial (ZUE).\n\nc) Zona de uso restringido (ZUR).\n\nd) Zona de Amortiguamiento (ZA).\n\nSECCIÓN II\n\nDel Ejercicio de la\nInvestigación\n\nArtículo 18.- Las actividades de investigación y de colecta científica y académica\nestán permitidas dentro de toda la zonificación geográfica de la Reserva\nBiológica Lomas Barbudal. Para el ejercicio de dicha actividad el interesado\ndeberá contar con los permisos y licencias respectivas debidamente emitidas y\nvigentes.\n\nArtículo 19.- Las actividades de investigación y de colecta científica y académica se\nregirán según lo establecido en el Decreto Ejecutivo N°32553-MINAE del 29 de\nmarzo de 2005 denominado \"Manual de Procedimientos para realizar\nInvestigación en Biodiversidad y Recursos Culturales en las Áreas de\nConservación\" y en la Ley de Conservación de Vida Silvestre N° 7317 y sus\nreformas, o en su defecto, en la normativa vigente que rija dicha actividad en\nlas áreas silvestres protegidas.\n\nArtículo 20.- Las investigaciones que requieran acceso a los elementos bioquímicos y genéticos\nde la biodiversidad se regirán de acuerdo a lo dispuesto en la Ley de\nBiodiversidad N°7788 y su reglamento.\n\nArtículo 21.- Adicionalmente a las obligaciones a las que el investigador se encuentre\nsometido de acuerdo a las normas referidas en los artículos anteriores; en\naquellas investigaciones que a criterio de la administración sus resultados\nsean de relevancia para la conservación y el manejo de los ecosistemas y/o\nespecies presentes en la RBLB; el investigador deberá realizar una exposición\npresencial al personal de la RBLB al culminar la investigación. Para tal efecto\ndeberá coordinar con el Administrador del Área Protegida a efectos de\ndeterminar la fecha y lugar. La presentación deberá contener como mínimo:\n\na) Resultados obtenidos durante la investigación.\n\nb) Recomendaciones para la gestión del área protegida a la luz de los\nhallazgos encontrados.\n\nArtículo 22.- Durante el periodo de ejecución de las investigaciones y sin necesidad\nde dar aviso al investigador, la Dirección del ACAT, la Dirección del ASP del\nACAT o la Administración de la RBLB, podrán designar funcionarios para la\nfiscalización de la investigación a afectos de controlar que se realice siguiendo\nla metodología autorizada.\n\nSECCIÓN III\n\nDel Ejercicio del Ecoturismo\n\nArtículo 23.- Las actividades de ecoturismo están permitidas en la RBLB en los\nsiguientes términos:\n\na) En la Zona de Protección Absoluta se encuentra totalmente prohibido el\nejercicio de toda actividad ecoturística.\n\nb) En la Zona de Uso Restringido únicamente se autorizará ecoturismo\nrestringido y por excepción. De acuerdo a la siguiente relación de actividades\npor zona:\n\nb.1. Caminatas Guiadas: En los senderos denominados Gigantes del Bosque, La\nCatarata, El Toledo, El Corral, Caoba, sendero de investigación.\n\nb.2. Ingreso y baño en cuerpos de agua: En el sector La Poza.\n\n--*--\n\nArtículo 24.- Las caminatas guiadas con fines ecoturísticos se restringen en los\nsiguientes términos:\n\na) Toda persona que ejerza actividades como guía de turismo dentro de la\nReserva Biológica Lomas Barbudal, deberá contar con la credencial de guía de\nturismo emitida por el Instituto Costarricense de Turismo para lo cual deberá\ncumplir ante esa instancia el proceso y requisitos de acreditación según lo\ndispuesto en el Reglamento de los guías de turismo, Decreto Ejecutivo\nN°41369-MEIC-TUR.\n\nb) El uniforme que usen los guías de turismo en esta área protegida no\npodrá ser en ningún momento semejante o parecido en color de camisa y pantalón\ncon el de las personas funcionarias de la Administración de la Reserva\nBiológica Lomas Barbudal.\n\nc) El guía deberá contar con una acreditación de reconocimiento previo del\nsitio emitida por la Administración de la Reserva Biológica Lomas Barbudal. Tal\nacreditación se otorgará de acuerdo a lo estipulado en el artículo 26 del\npresente Reglamento.\n\nd) Los grupos deberán estar integrados por un máximo de 15 personas por\nguía.\n\ne) Durante la actividad de ecoturismo no podrá utilizarse aeronaves no\ntripuladas (drones).\n\nArtículo 25.- Toda persona interesada en desarrollar caminatas guiadas bajo el\nconcepto indicado en el artículo anterior, deberá presentar solicitud de\nautorización de ingreso al área protegida. La solicitud deberá ser presentada\ncon al menos 15 días naturales de antelación a la fecha en que se pretende\nrealizar la actividad y contener los siguientes requisitos:\n\na) Nombre y calidades del solicitante. En caso de que el solicitante sea\nuna persona jurídica la solicitud deberá estar suscrita por el representante\nlegal o en su defecto por quien posea poder general o especial que le otorgue\nfacultades suficientes para realizar la solicitud.\n\nb) Nombre del guía turístico, número de identificación y número de\ncredencial de guía de turismo asignada por el Instituto Costarricense de\nTurismo (ICT).\n\nc) Cantidad de ecoturistas que conforman el grupo.\n\nd) Fecha en la que se pretende efectuar la actividad.\n\ne) Número de la acreditación de reconocimiento previo del sitio emitida por\nla Administración de la RBLB.\n\nf) Firma del solicitante.\n\ng) Medio para recibir notificaciones.\n\nArtículo 26.- En caso de que el guía turístico no cuente con la acreditación a la que\nrefiere el inciso e) del artículo anterior, una vez recibida la solicitud, el\nAdministrador de la RBLB comunicará, en un plazo de tres días hábiles al\ninteresado la fecha y hora en que deberá realizar la gira de reconocimiento en\ncompañía de un funcionario de la RBLB. Al culminar la gira de reconocimiento se\nemitirá la debida acreditación que tendrá una vigencia de 3 años.\n\nArtículo 27.- En caso de que la solicitud sea presentada de manera incompleta se\nprevendrá al solicitante para que en un plazo máximo de 3 días hábiles presente\nlos requisitos faltantes, subsane cualquier información requerida; bajo\napercibiendo del archivo de la solicitud en caso de no cumplimiento.\n\nHabiéndose cumplido los\nrequisitos establecidos en el artículo 25 del presente Reglamento, la\nAdministración de la RBLB procederá a autorizar o denegar la solicitud mediante\nresolución administrativa debidamente fundamentada, misma que deberá emitirse\nen un plazo no mayor a cinco días naturales una vez cumplidos todos los\nrequisitos. En caso de que bajo debido razonamiento no sea posible autorizar la\nactividad ecoturística para la fecha solicitada, el Administrador sugerirá en\nel mismo acto administrativo otra fecha para que sea considerada por el\ninteresado.\n\nArtículo 28.- El ingreso y baño en el sector La Poza, está únicamente permitido a los ecoturistas\nlocales por constituir un uso cultural del sitio. El ejercicio de esta\nactividad no requiere guía turístico.\n\nArtículo 29.- Para bañarse en el sector de La Poza se aplican las siguientes\ndisposiciones:\n\na) No se permite el uso de jabón, champú, repelentes u otros químicos durante\nel ingreso al agua. Tampoco se autoriza el lavado de ropa o zapatos con jabones\nu otros detergentes.\n\nb) No se permiten las escenas amorosas o el uso de lenguaje obsceno que\natente contra la estadía y la moral de los demás visitantes.\n\nc) No se permite el uso de neumáticos o artículos que se utilicen para\nflotar, excepto chaleco salvavidas o flotadores ligados al cuerpo.\n\nd) No se permite lanzarse de los bordes del río, árboles o rocas para\npracticar acciones tipo \"clavados\".\n\ne) En el sector de La Poza y áreas cercanas, no se permite efectuar fogatas\nni desarrollar actividades de comida campestre.\n\nf) El ecoturista que realice el ingreso a La Poza, lo realiza bajo su\nexclusiva responsabilidad.\n\nArtículo 30.- Las personas funcionarias del ACAT debidamente identificadas, sin previo\naviso, podrán acompañar a los ecoturistas, cuando lo estimen conveniente, con\nel fin de fiscalizar, controlar y monitorear las actividades que estos\nrealicen, así como para orientar y brindar información ambiental a los visitantes.\nEsta labor podrá ser realizada también por voluntarios, pero estos no podrán\nejercer acciones propias de la función policial.\n\nSECCIÓN IV\n\nDel Ejercicio de la\nAcademia\n\nArtículo 31.- Los senderos determinados por el Plan General de Manejo como zonas de\nuso restringido podrán ser utilizados como aula abierta por centros académicos\nu organizaciones no gubernamentales. Esta actividad se restringe en los\nsiguientes términos:\n\na) El docente que guie la actividad deberá contar con acreditación de reconocimiento\nprevio del sitio emitida por la Administración de la Reserva Biológica Lomas\nBarbudal. Tal acreditación se otorgará de acuerdo a lo estipulado en el\nartículo 33 del presente Reglamento.\n\nb) Los grupos deberán estar integrados por un máximo de 30 personas.\n\nc) Durante la actividad no podrá manipularse vida silvestre o material\ngeológico. El docente deberá utilizar equipo especial como binoculares,\ntelescopio, guía de aves, plantas, insectos u otras guías de grupos taxonómicos\npara mostrar los elementos de la naturaleza que desee mostrar con principal\ninterés a los estudiantes.\n\nSe exceptúa de lo\nestablecido en el inciso c) anterior, aquellos casos en que el docente cuente con\npermiso de investigación o colecta académica; en tal caso, podrá el investigador\nrealizar la manipulación o captura siguiendo las reglas establecidas en el\npermiso o licencia que haya sido emitido por el SINAC.\n\nArtículo 24.- Las caminatas guiadas\ncon fines ecoturísticos se restringen en los siguientes términos:\n\na) Toda persona que ejerza actividades como guía de turismo dentro de la Reserva Biológica Lomas\nBarbudal, deberá contar con la credencial de guía de turismo emitida por el Instituto Costarricense\nde Turismo para lo cual deberá cumplir ante esa instancia el proceso y requisitos de acreditación\nsegún lo dispuesto en el Reglamento de los guías de turismo, Decreto Ejecutivo N°41369-MEIC-TUR.\n\nb) El uniforme que usen\nlos guías de turismo en esta área protegida no podrá ser en ningún momento\nsemejante o parecido en color de camisa y pantalón con el de las personas\nfuncionarias de la Administración de la Reserva Biológica Lomas Barbudal.\n\nc) El guía deberá contar\ncon una acreditación de reconocimiento previo del sitio emitida por la\nAdministración de la Reserva Biológica Lomas Barbudal.\nTal acreditación se otorgará de acuerdo a lo estipulado en el artículo 26 del\npresente Reglamento.\n\nd) Los grupos deberán\nestar integrados por un máximo de 15 personas por guía.\n\ne) Durante la actividad de\necoturismo no podrá utilizarse aeronaves no tripuladas (drones).\n\nArtículo 25.- Toda persona interesada\nen desarrollar caminatas guiadas bajo el concepto indicado en el artículo\nanterior, deberá presentar solicitud de autorización de ingreso al área\nprotegida. La solicitud deberá ser presentada con al menos 15 días naturales de\nantelación a la fecha en que se pretende realizar la actividad y contener los\nsiguientes requisitos:\n\na) Nombre y calidades del\nsolicitante. En caso de que el solicitante sea una persona jurídica la\nsolicitud deberá estar suscrita por el representante legal o en su defecto por\nquien posea poder general o especial que le otorgue facultades suficientes para\nrealizar la solicitud.\n\nb) Nombre del guía\nturístico, número de identificación y número de credencial de guía de turismo\nasignada por el Instituto Costarricense de Turismo (ICT).\n\nc) Cantidad de ecoturistas que conforman el grupo.\n\nd) Fecha en la que se\npretende efectuar la actividad.\n\ne) Número de la\nacreditación de reconocimiento previo del sitio emitida por la Administración\nde la RBLB.\n\nf) Firma del solicitante.\n\ng) Medio para recibir\nnotificaciones.\n\nArtículo 26.- En caso de que el guía\nturístico no cuente con la acreditación a la que refiere el inciso e) del\nartículo anterior, una vez recibida la solicitud, el Administrador de la RBLB\ncomunicará, en un plazo de tres días hábiles al interesado la fecha y hora en\nque deberá realizar la gira de reconocimiento en compañía de un funcionario de\nla RBLB. Al culminar la gira de reconocimiento se emitirá la debida\nacreditación que tendrá una vigencia de 3 años.\n\nArtículo 27.- En caso de que la\nsolicitud sea presentada de manera incompleta se prevendrá al solicitante para\nque en un plazo máximo de 3 días hábiles presente los requisitos faltantes,\nsubsane cualquier información requerida; bajo apercibiendo del archivo de la\nsolicitud en caso de no cumplimiento.\n\nHabiéndose cumplido los\nrequisitos establecidos en el artículo 25 del presente Reglamento, la\nAdministración de la RBLB procederá a autorizar o denegar la solicitud mediante\nresolución administrativa debidamente fundamentada, misma que deberá emitirse\nen un plazo no mayor a cinco días naturales una vez cumplidos todos los\nrequisitos. En caso de que bajo debido razonamiento no sea posible autorizar la\nactividad ecoturística para la fecha solicitada, el Administrador sugerirá en\nel mismo acto administrativo otra fecha para que sea considerada por el\ninteresado.\n\nArtículo 28.- El ingreso y baño en el\nsector La Poza, está únicamente permitido a los ecoturistas\nlocales por constituir un uso cultural del sitio. El ejercicio de esta\nactividad no requiere guía turístico.\n\nArtículo 29.- Para bañarse en el\nsector de La Poza se aplican las siguientes disposiciones:\n\na) No se permite el uso de\njabón, champú, repelentes u otros químicos durante el ingreso al agua. Tampoco\nse autoriza el lavado de ropa o zapatos con jabones u otros detergentes.\n\nb) No se permiten las\nescenas amorosas o el uso de lenguaje obsceno que atente contra la estadía y la\nmoral de los demás visitantes.\n\nc) No se permite el uso de\nneumáticos o artículos que se utilicen para flotar, excepto chaleco salvavidas\no flotadores ligados al cuerpo.\n\nd) No se permite lanzarse\nde los bordes del río, árboles o rocas para practicar acciones tipo\n\"clavados\".\n\ne) En el sector de La Poza\ny áreas cercanas, no se permite efectuar fogatas ni desarrollar actividades de\ncomida campestre.\n\nf) El ecoturista\nque realice el ingreso a La Poza, lo realiza bajo su exclusiva responsabilidad.\n\nArtículo 30.- Las personas\nfuncionarias del ACAT debidamente identificadas, sin previo aviso, podrán\nacompañar a los ecoturistas, cuando lo estimen\nconveniente, con el fin de fiscalizar, controlar y monitorear las actividades\nque estos realicen, así como para orientar y brindar información ambiental a\nlos visitantes. Esta labor podrá ser realizada también por voluntarios, pero\nestos no podrán ejercer acciones propias de la función policial.\n\nSECCIÓN IV\n\nDel Ejercicio de la Academia\n\nArtículo 31.- Los senderos\ndeterminados por el Plan General de Manejo como zonas de uso restringido podrán\nser utilizados como aula abierta por centros académicos u organizaciones no\ngubernamentales. Esta actividad se restringe en los siguientes términos:\n\na) El docente que guie la\nactividad deberá contar con acreditación de reconocimiento previo del sitio\nemitida por la Administración de la Reserva Biológica Lomas Barbudal.\nTal acreditación se otorgará de acuerdo a lo estipulado en el artículo 33 del\npresente Reglamento.\n\nb) Los grupos deberán\nestar integrados por un máximo de 30 personas.\n\nc) Durante la actividad no\npodrá manipularse vida silvestre o material geológico. El docente deberá\nutilizar equipo especial como binoculares, telescopio, guía de aves, plantas,\ninsectos u otras guías de grupos taxonómicos para mostrar los elementos de la\nnaturaleza que desee mostrar con principal interés a los estudiantes.\n\nSe exceptúa de lo\nestablecido en el inciso c) anterior, aquellos casos en que el docente cuente\ncon permiso de investigación o colecta académica; en tal caso, podrá el\ninvestigador realizar la manipulación o captura siguiendo las reglas\nestablecidas en el permiso o licencia que haya sido emitido por el SINAC.\n\nArtículo\n32.- Todo\ncentro académico u organización no gubernamental que esté interesado en\ndesarrollar actividades de aula abierta bajo el concepto indicado en el\nartículo anterior, deberá presentar la solicitud de autorización ante la Administración\ndel Área Silvestre Protegida. La solicitud deberá ser presentada con al menos\nun mes de antelación a la fecha en que se pretende realizar la actividad y\ncontener los siguientes requisitos:\n\na) Nombre del centro\nacadémico u organización no gubernamental y nombre y calidades del\n\ndocente que\nrealizará la actividad.\n\nb) Objetivos específicos\nque se pretenden cumplir con la actividad académica.\n\nc) Cantidad de estudiantes\nque conforman el grupo.\n\nd) Fecha en que se\npretende efectuar la actividad académica.\n\ne) Número de la\nacreditación de reconocimiento previo del sitio emitida por la Administración\nde la RBLB.\n\nf) Firma del docente\nresponsable de la actividad académica con visto bueno de la Dirección del\nCentro Académico u organización no gubernamental.\n\ng) Medio para recibir\nnotificaciones.\n\nArtículo 33.- En caso de que el docente que\nguiará el grupo no cuente con la acreditación a la que refiere el inciso e) del\nartículo anterior, una vez recibida la solicitud, el Administrador de la RBLB\ncomunicará en un plazo de tres días hábiles al interesado, la fecha y hora en\nque deberá realizar la gira de reconocimiento en compañía de un funcionario de\nla RBLB. Al culminar la gira de reconocimiento se emitirá la debida\nacreditación que tendrá una vigencia de 5 años.\n\nArtículo 34.-\nHabiéndose cumplido los requisitos establecidos en el artículo 32 del presente\nReglamento, la Administración de la RBLB procederá a autorizar o denegar la solicitud\nmediante resolución administrativa debidamente fundamentada, misma que deberá\nemitirse en un plazo no mayor a los diez días naturales, una vez cumplidos\ntodos los requisitos. En caso de que la solicitud se encuentre incompleta, se\nrealizará una única prevención escrita al solicitante para que complete los\nrequisitos omitidos en la solicitud o para que aclare o subsane la información\notorgando un plazo razonable de hasta diez días para completar o aclarar. Dicha\nprevención suspenderá temporalmente el plazo para resolver. En caso de que la\nprevención no sea atendida por el solicitante, se procederá con el archivo del\ntrámite. En caso de que bajo debido razonamiento no sea posible autorizar la\nactividad académica para la fecha solicitada, el Administrador sugerirá en el\nmismo acto administrativo otra fecha para que sea considerada por el\ninteresado.\n\nArtículo 35.- La\nAdministración de la RBLB podrá integrar en todo caso hasta tres funcionarios\ninstitucionales o voluntarios a la actividad académica como mecanismo de gestión\ndel conocimiento. En ningún caso el centro educativo u organización no\ngubernamental autorizada podrá realizar cobro alguno por la presencia de estas\npersonas asignadas por la Administración para participar en la actividad.\n\nSECCIÓN V\n\nDel Ejercicio de la Filmación\n\nArtículo\n36.- La filmación dentro de la RBLB está permitida en los términos previstos en\nel Decreto Ejecutivo N°38295-MINAE. Esta actividad podrá ser realizada\núnicamente en las siguientes circunstancias: a) Por quienes realizando otra\nactividad que les haya sido autorizada, deseen realizar filmación con el único\nfin de mantener un recuerdo.\n\nb) Las\nactividades de filmación comercial, científica, educativa o turística\ndebidamente autorizadas por la Dirección del ACAT en las zonas permitidas por\nel Plan General de Manejo.\n\nc) Las\nactividades de filmación periodística debidamente autorizadas por el\nAdministrador de la RBLB.\n\nSi por\nrazones de mantenimiento, protección o conservación, se restringen los permisos\nde filmación, tendrá prioridad la filmación por motivos de investigación\ncientífica y de actividades de manejo sobre la filmación comercial.\n\nArtículo\n37.- Para realizar las actividades de filmación comercial, científica,\neducativa o turística el usuario deberá tramitar con un plazo de antelación de\nun mínimo de 15 días naturales, un permiso ante la Dirección del ACAT y pagar\nla tarifa correspondiente. La Dirección del ACAT otorgará o denegará el permiso\nsolicitado, mediante resolución debidamente fundamentada, la cual se emitirá en\nun plazo máximo de 10 días naturales posterior a la presentación de la\nsolicitud realizada de forma completa y correcta.\n\nDicha\nsolicitud deberá contener los siguientes datos:\n\na) Nombre y\ncalidades del solicitante. En caso de que el solicitante sea una persona\njurídica, la solicitud deberá estar suscrita por el representante legal o en su\ndefecto por quien posea poder general o especial que le otorgue facultades\nsuficientes para realizar la solicitud.\n\nb) Fines\ndel material a ser filmado.\n\nc)\nIndicación de la cantidad de días que se pretende realizar filmación. d)\nIndicar medio para recibir notificaciones.\n\nAdemás,\ndeberá adjuntarse a la solicitud los siguientes documentos:\n\na)\nCertificación registral de la personería jurídica en caso de personas\njurídicas.\n\nb) Copia\ndel guion de filmación. La solicitud debe hacerse utilizando el formato\nestablecido en el Anexo N°1 del presente Reglamento.\n\nAl momento\nde presentación de la solicitud, deberá presentarse la cédula de identidad del\nsolicitante en caso de persona física nacional, pasaporte en caso de persona\nfísica extranjera, o del representante legal en caso de persona jurídica, a\nefectos de que el funcionario que recibe la gestión verifique la identidad y\ndeje constancia de la constatación.\n\nEn caso de\nque la solicitud sea presentada de manera incompleta se prevendrá al\nsolicitante para que en un plazo máximo de 3 días hábiles presente los\nrequisitos faltantes, subsane cualquier información requerida; bajo\napercibiendo del archivo de la solicitud en caso de no cumplimiento.\n\nArtículo\n38.- La filmación periodística (con fines noticiosos) requerirá una\nautorización escrita por parte del Administrador de la RBLB. Para tal efecto,\nel interesado deberá solicitar la autorización llenando el formulario que para\ntal efecto se dispondrá en la Administración de la RBLB y que contendrá lo\nsiguiente: a) Nombre y calidades del solicitante. En caso de que pertenezca a\nun medio de comunicación, detallar las calidades de la empresa. b) Fines del\nmaterial a filmar. c) Indicación del medio para recibir notificaciones; para lo\ncual, el solicitante utilizará el formato establecido en el Anexo N°1 del\npresente Reglamento. El plazo para aprobación por parte de la Administración será\nde dos horas. Al momento de presentarse la solicitud, también deberá presentar\nla cédula de identidad del solicitante en caso de persona física nacional,\npasaporte en caso de persona física extranjera, o del representante legal en\ncaso de persona jurídica, a efectos de que el funcionario que recibe la\ngestión, verifique la identidad y así lo haga constar.\n\nArtículo\n39.- Las filmaciones de aficionados que pretendan únicamente la preservación de\nun recuerdo de la visita al Área Silvestre Protegida, estarán exentas de pago\nde tarifa según lo dispuesto en el Decreto Ejecutivo N°38295-MINAE, con la\nsalvedad de que las mismas no podrán ser utilizadas para fines comerciales o de\nlucro.\n\nArtículo 40.- Se\nencuentra prohibida la filmación con drones dentro de la RBLB, excepto cuando\nla filmación es realizada por la Administración o si los fines son científicos\ny ello se encuentra debidamente contemplado dentro de la metodología de la\ninvestigación que haya sido debidamente aprobada por la Dirección del ACAT.\n\nSECCIÓN VI\n\nActividades Prohibidas\n\nArtículo\n41.- Respecto a las especies de vida silvestre, dentro de la RBLB queda\nestrictamente prohibido:\n\na) El\ncomercio y trasiego de cualquier producto de vida silvestre de origen acuático\ny terrestre.\n\nb) Pescar,\ncazar, extraer, manipular, acosar, y hostigar a individuos de cualquier tipo de\nespecies animales acuáticas o terrestres.\n\nc) Extraer\ny manipular organismos de cualquier tipo de especies vegetales acuáticas o\nterrestres.\n\nd) Extraer\ny manipular cualquier especie perteneciente al reino Fungi\n(hongos).\n\ne) Extraer\ncualquier tipo de material orgánico o inorgánico, incluye arena, piedras para\ncualquier tipo de uso.\n\nf) El uso\nde jaulas para la observación de fauna, salvo para fines científicos o\neducativos, siempre y cuando, cuenten con el permiso respectivo otorgado por la\nautoridad competente.\n\ng)\nAlimentar a los organismos acuáticos y terrestres.\n\nh) Ingresar\ncon cualquier tipo de mascota al Área Silvestre Protegida.\n\nSe exceptúa\nde las anteriores prohibiciones las actividades con fines científicos,\neducativos o de manejo realizadas por parte de personal del SINAC o por\ninvestigadores que cuenten con la respectiva autorización y que sean conformes\na la aplicación de la Ley de Conservación de Vida Silvestre N°7317 y su\nreglamento, Decreto Ejecutivo 40548-MINAE, de manera que no se encuentren\nprohibidas o constituyan delito o contravención de acuerdo a dichas normas.\n\nArtículo\n42.- En relación con el uso de la RBLB, queda absolutamente prohibido:\n\na) Realizar\ncualquier tipo de marca en árboles, rocas y cualquier otro elemento dentro de\nlos límites de la RBLB.\n\nb) La portación ni el uso de ningún tipo de arma (tales como armas de fuego, armas blancas, armas de\naire comprimido o resorte, flechas de liga, arbaletas) excepto que éstas se usen con fines de manejo\nautorizado por el ACAT o el control y vigilancia ejercido por el Estado.\n\nc) La venta\ny consumo de drogas. Se exceptúan de la presente disposición aquellas\nsustancias de tratamiento médico.\n\nd) Acampar\no encender fogatas dentro de los límites del área silvestre protegida. e) El\nnudismo.\n\nf)\nCualquier tipo de contaminación ambiental producida por residuos sólidos o\nlíquidos.\n\ng) La\ngeneración de ruidos excesivos salvo los que se generen por razones\nadministrativas.\n\nh) El\ningreso de alimentos que contengan semillas.\n\ni) El\ningreso de alimentos preparados. Salvo la alimentación mínima que deba ser\ningresada por personas con alguna afectación de salud que amerite el ingreso de\ndeterminados alimentos.\n\nj)\nDesviarse fuera del ancho de los senderos durante las caminatas guiadas.\n\nArtículo\n43.- Quedan prohibidas de forma general todas aquellas actividades que se\nencuentren así consideradas por la normativa ambiental vigente o que\nconstituyan contravenciones o delitos según el ordenamiento jurídico nacional.\n\nCAPÍTULO\nIV\n\nPotestades\nde la Administración\n\nArtículo 44.- Las\npersonas funcionarias de las oficinas centrales del ACAT y de la Reserva\nBiológica Lomas Barbudal constituyen el personal\nencargado de velar por el cumplimiento de la normativa jurídica vigente para\ntodas las actividades que se realicen dentro de las Áreas Silvestres\nProtegidas, lo anterior, sin perjuicio de las facultades de otros cuerpos\npoliciales y órganos judiciales.\n\nArtículo 45.- La\nAdministración de la RBLB podrá realizar evaluaciones periódicas sobre la\ncalidad en el servicio de guiado de turistas por parte de guías generales,\nespecializados y locales; siendo que de encontrar irregularidades, así lo\ncomunicará al Departamento respectivo del Instituto Costarricense de Turismo\npara lo que corresponda, con respecto a la credencial, y a los procedimientos\nadministrativos y legales a seguir.\n\nArtículo\n46.- La Dirección del ACAT, previa recomendación del Comité Técnico Científico,\ntiene la potestad de autorizar la apertura de nuevos sitios destinados para la\nrealización de las actividades previstas en el presente Reglamento, así como\ncerrar aquellos sitios de uso restringido que considere necesarios para fines\nde manejo o conservación.\n\nArtículo 47.- La\nadministración de la RBLB puede en cualquier momento, restringir las\nactividades y sitios de uso público, ello siguiendo los principios que rigen en\nmateria ambiental y los objetivos establecidos en el Plan General de Manejo. Si\nla restricción requiere ser aplicada para un plazo mayor de un mes, la dictará\ny la pondrá en conocimiento del Comité Técnico Científico del Área de\nConservación para que recomiende a la Dirección del ACAT prorrogar su vigencia\npor el tiempo que se considere necesario, a la luz de los principios que rigen\nla materia ambiental y la sana crítica.\n\nArtículo 48.- El\npersonal de la RBLB, debidamente identificado, podrá cuando lo estime\nnecesario, realizar cualquier otra inspección que la Administración considere\nnecesaria para dar cumplimiento al presente reglamento y la normativa conexa,\npara lo cual tiene facultad de acceso a toda el área protegida. Los voluntarios\nque se encuentren coadyuvando en las labores que desarrollan los funcionarios\nen sus diferentes programas, podrán de igual manera accesar\na las diferentes zonas y sectores geográficos de la RBLB, según lo requiera y\ndisponga la Administración.\n\nArtículo 49.- La\nDirección del ACAT tendrá la potestad de ordenar el cierre temporal o\npermanente de las actividades permitidas en la RBLB, si mediante el criterio\ndel personal técnico de la RBLB, o de especialistas, a través del monitoreo\nambiental y otras actividades técnicas propuestas en el Plan de Manejo, o en\notros estudios técnicos necesarios para el adecuado manejo de los recursos\nbiológicos, se detecte algún impacto negativo o deterioro en la integridad de\nlos mismos o en correcta aplicación de los principios preventivo y precautorio\nque rige la materia. También podrá ordenarse el cierre cuando sea necesario\npara la ejecución de las acciones recomendadas por los programas de manejo,\ncuyo buen desarrollo pudiera ser afectado por la presencia de visitantes en el\nárea.\n\nArtículo 50.- En caso\nde emergencia, la Administración de la RBLB tendrá la potestad de ejecutar el\nplan de contingencia establecido para tal fin, con el propósito de salvaguardar\nla integridad física de las personas usuarias y/o funcionarias. Estas\ndisposiciones administrativas podrán incluir el cierre parcial o total del área\nsilvestre protegida por el tiempo que se considere conveniente\n\nArtículo 51.- Cualquier\nfuncionario del ACAT, podrá expulsar de los límites de la RBLB a aquellas\npersonas que presentes en el área protegida, efectúen actividades prohibidas u omitan\nobedecer disposiciones emitidas por los funcionarios en cumplimiento oportuno\nde sus labores. Asimismo, podrá suspenderse la autorización de permanencia y la\nrealización de actividades por motivo de condiciones climáticas adversas o\ncualquier otra razón debidamente justificada, sin que ello genere\nresponsabilidad para la Administración.\n\nArtículo 52.- De manera\nobligatoria, todo visitante deberá acatar las indicaciones de seguridad y\norientación dadas por el funcionario, guía o docente autorizado, a cargo del\ngrupo. El incumplimiento a esta disposición será causal para suspender la\nautorización de permanencia dentro del área silvestre protegida.\n\nArtículo 53.- La\nadministración de la RBLB podrá autorizar horarios de ingreso y salida\ndistintos al establecido para el ejercicio del ecoturismo en el artículo 10 del\npresente Reglamento, cuando el objeto de ingreso sea la filmación,\ninvestigación o ejercicio de la academia; ello previa solicitud debidamente\njustificada del permisionario.\n\nArtículo 54.- El SINAC\na través del ACAT y la administración de la RBLB podrá realizar dentro de los\nlímites de la RBLB actividades de capacitación y entrenamiento dirigidas a funcionarios,\nComités de Vigilancia de Recursos Naturales (COVIRENAS) y voluntarios, para la\nadecuada gestión del área silvestre protegida. Dichas actividades respetarán\nlos criterios técnicos de zonificación y conservación previstos en el Plan\nGeneral de Manejo.\n\nCAPÍTULO\nV\n\nDisposiciones\nfinales\n\nArtículo 55.- Las\nprohibiciones dispuestas serán sancionadas conforme a lo establecido en el\nartículo 9 de la Ley del Servicio de Parques Nacionales N°6084, en los\ncapítulos XI y XII de la Ley de Conservación de Vida Silvestre Nº7317 y sus\nreformas, así como con la aplicación de cualquier otra norma sancionatoria\nvigente en la fecha de los hechos.\n\nArtículo 56.- Rige a\npartir de su publicación en el Diario Oficial La Gaceta.\n\nDado en la Presidencia\nde la República.   "body_en_text": "throughout the text\n\n                    -\n\n                        Complete Text of Regulation 43234\n\n                        Regulation for the exercise of permitted activities within the Lomas Barbudal Biological Reserve\n\nNº 43234-MINAE\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND\nENERGY\n\nIn exercise of the\npowers conferred upon them by articles 50, 140 subsections 3) and 18) and 146 of the\nPolitical Constitution; articles 27 subsection 1) and 28 subsection 2) paragraph b) of\nthe General Law of Public Administration Nº 6227 of May 2, 1978,\narticles 1, 32 and 35 of the Organic Law of the Environment N°7554 of October 4,\n1995; articles 1 and 3 subsection d) of the National Parks Service Law\nN°6084 of August 24, 1977; articles 1 and 49 of the Biodiversity Law\nNº7788 of April 30, 1998; article 1, second paragraph of the Forest Law\nNº7575 of February 13, 1996, Executive Decree N°16849 of January 23,\n1986 declaring Lomas Barbudal Biological Reserve; and the Regulation to the Biodiversity Law,\nExecutive Decree Nº34433-MINAE of March 11, 2008.\n\nConsidering:\n\nI: That the Lomas Barbudal Biological Reserve was created by Executive Decree\nN°16849-MAG of January 23, 1986.\n\nII: That the Biodiversity Law Nº7788 of April 30, 1998, in its\narticle 22 created the National System of Conservation Areas (SINAC), as a\ndecentralized and participatory institutional management and coordination\nsystem, which integrates competencies in forestry, wildlife,\nprotected areas, and the Ministry of Environment and Energy, for the purpose\nof issuing policies, planning, and executing processes aimed at achieving\nsustainability in the management of Costa Rica's natural resources.\n\nIII: That the General Management Plan for the Lomas Barbudal Biological Reserve\nhas been issued by resolution N° R-SINAC-CONAC-24-2016 published in the\nOfficial Gazette N°211 of Thursday, November 3, 2016.\n\nIV: That the Organic Law of the Environment N°7554 provides that the creation, conservation,\nadministration, development, and monitoring of Protected Wilderness Areas shall have the objectives of conserving natural environments, ensuring\nthe balance and continuity of the evolutionary and ecological processes upon\nwhich some wild species depend.\n\nV: That the Organic Law of the Environment N°7554 determines the Management Categories,\nas well as the competencies, regulations, and responsibilities designated\nto the State through the Ministry of Environment and Energy (MINAE) and\nSINAC, to achieve compliance with its conservation objectives.\n\nVI: That the 2016-2026 Five-Year Strategic Plan of the National System of\nConservation Areas includes, as a strategic action, the development of the\nsustainable tourism program in protected areas.\n\nVII: That the Sustainable Tourism Policy establishes that tourism\nmanagement in protected wilderness areas (ASP) must be developed within\na framework of sustainability, integrated with their areas of influence, and articulated\nwith national conservation and tourism policies, plans, and programs.\n\nVIII: That in accordance with policy 6 of the Policies for the\nProtected Wilderness Areas of the SINAC, the management of protected wilderness\nareas will be supported by a solid base of scientific, technical, and traditional\nknowledge that allows for continuous improvement and greater levels of\neffectiveness and efficiency in the conservation of biodiversity. Thus, research is constituted as a priority action within the Lomas Barbudal Biological Reserve.\n\nIX: That technically, the Biological Reserve management category constitutes\na restrictive management category, such that activities must be\nstrictly regulated to guarantee the conservation of the focal management elements.\n\nX: That it is necessary to issue rules that regulate the exercise of\npermitted activities within the Lomas Barbudal Biological Reserve, in\naccordance with what is established in the General Management Plan of this protected wilderness\narea, in relation to the activities that the management category technically admits.\n\nXI: That this regulation responds to the highest environmental principles\nprovided in articles 9 and 11 of the Biodiversity Law N°7788, for the adequate\nconservation of the protected wilderness area; fully complying with the provisions\nof Directive N°052-MP-MEIC.\n\nXII: That in accordance with the Regulation to the Law for the Protection of Citizens\nfrom Excessive Requirements and Administrative Procedures, Executive Decree Nº37045-MP-MEIC\nand its amendments, this proposal complies with the principles of regulatory\nimprovement according to the positive report DMR-DAR-INF-063-2021 of May 12, 2021,\nissued by the Department of Regulatory Analysis of the Directorate of Regulatory Improvement\nof the MEIC.\n\nTherefore,\n\nDECREE:\n\n\"Regulation for the Exercise\nof Permitted Activities within the Lomas Barbudal\n\nBiological Reserve\"\n\nCHAPTER I\n\nGeneral Provisions\n\nArticle 1.- This Regulation establishes the provisions for the use of the\nservices provided, permitted activities, restricted activities, and\nprohibited activities within the boundaries of the Lomas Barbudal Biological Reserve.\n\nArticle 2.- The provisions of this Regulation and the instructions issued by\nthe officials of the Lomas Barbudal Biological Reserve to persons\nentering said Protected Wilderness Area, in accordance with said instrument and\ncurrent regulations, are mandatory in nature.\n\nArticle 3.- Every person entering the Lomas Barbudal Biological Reserve must\ncomply with the provisions indicated in this Regulation, as well as the\norders issued by the officials with police authority of the National\nSystem of Conservation Areas in accordance with current regulations\nas well as with the duly issued policies, guidelines, directives, and\nplans of the protected area, in conformity with the provisions\nof articles 25 subsections 5) and 8) and numeral 30 subsections 5) and 6) of the Biodiversity Law\nN°7788.\n\nArticle 4.- The payment of\nfees corresponding to the activities authorized in light of this\nprovision shall be made in accordance with the provisions of\nExecutive Decree N°38295-MINAE of January 15, 2014 and its amendments\nentitled \"Fees for Entry Rights and other services offered in the\nProtected Wilderness Areas under the Administration of the National System of\nConservation Areas\".\n\nArticle 5.- For the purposes of this Regulation, the following\nnomenclatures and abbreviations will be used:\n\na) MINAE: Ministry of Environment and Energy\n\nb) SINAC: National System of Conservation Areas.\n\nc) CORACAT: Regional Council of the Arenal Tempisque Conservation Area.\n\nd) ACAT: Arenal Tempisque Conservation Area.\n\ne) RBLB: Lomas Barbudal Biological Reserve.\n\nf) ICT: Costa Rican Tourism Institute.\n\nArticle 6.- For the purposes of this Regulation, the following terms are defined:\n\na. Academy: Activity oriented towards teaching or training in theoretical\nand practical knowledge of biodiversity components.\n\nb. Harass (Acosar): The action of cornering, trapping, pursuing, or trying to extract an animal from its natural habitat.\n\nc. Open-air classroom (Aula abierta): An outdoor site where the academy exercise is carried out.\n\nd. Hunting (Caza): The action, for any purpose, of harassing (acosar), capturing, or killing\nwild animals, as well as the collection of products or subproducts\nderived from them.\n\ne. Campfires (Fogatas): Fire generated with sticks, branches, leaf litter, charcoal, and\nother fuels.\n\nf. Contaminate (Contaminar): Negatively altering the natural conditions of\nan environment, landscape, or ecosystem, whether physically or chemically.\n\ng. Extract (Extraer): Removing wildlife, its parts, products, or derivatives.\n\nh. Manipulate (Manipular): Operating with hands or any instrument on wild flora or\nfauna species.\n\ni. General Management Plan (Plan General de Manejo): Planning instrument that guides the management of the RBLB\ntowards the fulfillment of its long-term conservation objectives. It is based\non strategic lines of action in the medium term and on management objectives for the\nnatural and cultural elements included within the area, as well as on the\nrelationship of the latter with their socio-environmental surroundings. It is the basis for\nthe development of other planning and regulation instruments for the RBLB.\n\nj. Volunteer (Voluntario): refers to the natural person who voluntarily and without\nfinancial remuneration collaborates with the National System of\nConservation Areas (SINAC), supporting the actions carried out by the\nSINAC personnel, both in the Protected Wilderness Areas (ASP) and in the rest\nof the administrative offices of SINAC.\n\nCHAPTER II\n\nEntry to the Lomas Barbudal Biological Reserve\n\nArticle 7.- The Administration of the RBLB shall be responsible for approving or denying\nentry to the RBLB.\n\nArticle 8.- Entry to the RBLB is permitted only for the exercise of the activities\npermitted according to the provisions of Chapter III of this\nRegulation or for activities carried out by the Public Administration in the\nexercise of its competencies.\n\nArticle 9.- Entry to the RBLB for filming, photography, research,\nand ecotourism purposes may only be made through the official entrance of the RBLB\nlocated in San Ramón de Bagaces, Guanacaste, or another official operational post that\nthe Administration officially establishes.\n\nArticle 10.- Any natural person wishing to enter the\nRBLB for ecotourism reasons may do so during the following hours: from Monday to\nSunday, entering between 8:00 a.m. and 4:00 p.m. In any case, the deadline\nto present oneself at the official exit site shall be 4:30 p.m.\n\nCHAPTER II\n\nEntry to the Lomas\nBarbudal Biological Reserve\n\nArticle 11.- For the purposes\nof entering the RBLB, and to demonstrate their nationality or place\nof origin, visitors must show the officials\nat the entry booth their identity card, residency card, or\npassport, as applicable and when required.\n\nArticle 12.- In the following cases, for entry to the RBLB, the interested party must\nmake requests for additional permits under the terms indicated below:\n\na) To carry out commercial, scientific, educational,\ntouristic, or journalistic filming, the interested party must complete the procedures provided\nin section V of Chapter III of this Regulation.\n\nb) To carry out research and scientific or academic collection\nmust be governed by the provisions of articles 19 and 20 of this\nRegulation.\n\nc) To carry out guided walks, regardless of their purpose,\nthe interested party must complete the procedure provided in articles 24 and 25 of this\nRegulation.\n\nArticle 13.- Officials of the RBLB may deny entry to persons when it is\napparent that they are under the influence of some narcotic, psychotropic substance,\nor drug of unauthorized use.\n\nArticle 14.- The Administration of the RBLB will permit the entry of persons into this\nprotected area, following the provisions established by the\nterrestrial carrying capacity studies or visitation flow studies made official by\nCORACAT. The Administration of the RBLB will maintain an updated control\nsystem, which will allow it to determine, at all times, the number of\nvisitors present.\n\nArticle 15.- Within the Lomas Barbudal Biological Reserve, the\nentry of bicycles, horses, or vehicles of any type is not permitted, except for\ncontrol and monitoring tasks, fire prevention, emergency response, or by\nexpress authorization from the Administration of the RBLB or the Directorate of the ACAT.\nThe entrances through the sectors of Agua Fría, Balas de Cañon, Papayito,\nMarañonal, Madroño, Cabuyo, and Las Mesas will have gates that will limit\naccess to the Lomas Barbudal Biological Reserve.\n\nCHAPTER III\n\nRegulation of Permitted\nActivities within the Lomas Barbudal Biological\n\nReserve\n\nSECTION I\n\nPermitted Activities\n\nArticle 16.- According to the provisions of the General Management Plan (Plan General de Manejo) of the Lomas Barbudal Biological Reserve\nas well as current regulations, only the activities of research, training, and low-impact ecotourism are permitted for the administered parties.\n\nArticle 17.- For the purposes of authorization and application of the activities permitted\nin this Regulation, the zoning established in the General Management Plan (Plan General de Manejo) of the RBLB shall be considered binding;\nin accordance with the following classification:\n\na) Absolute Protection Zone (ZPA).\n\nb) Special Use Zone (ZUE).\n\nc) Restricted Use Zone (ZUR).\n\nd) Buffer Zone (ZA).\n\nSECTION II\n\nThe Exercise of Research\n\nArticle 18.- Research activities and scientific and academic collection\nare permitted within the entire geographic zoning of the Lomas Barbudal Biological Reserve.\nTo exercise this activity, the interested party\nmust have the respective duly issued and\nvalid permits and licenses.\n\nArticle 19.- Research activities and scientific and academic collection shall be\ngoverned by the provisions of Executive Decree N°32553-MINAE of March 29,\n2005, entitled \"Manual of Procedures for Conducting\nResearch on Biodiversity and Cultural Resources in Conservation\nAreas,\" and the Wildlife Conservation Law N° 7317 and its\namendments, or failing that, by the current regulations governing said activity in\nprotected wilderness areas.\n\nArticle 20.- Research requiring access to the biochemical and genetic elements\nof biodiversity shall be governed in accordance with the provisions of the Biodiversity Law N°7788 and its regulation.\n\nArticle 21.- In addition to the obligations to which the researcher is\nsubject in accordance with the rules referred to in the previous articles; in\nthose investigations whose results, at the discretion of the administration,\nare relevant for the conservation and management of the ecosystems and/or\nspecies present in the RBLB, the researcher must make an in-person\npresentation to the staff of the RBLB upon completion of the research. For this purpose,\nthey must coordinate with the Administrator of the Protected Area to\ndetermine the date and place. The presentation must contain at least:\n\na) Results obtained during the research.\n\nb) Recommendations for the management of the protected area in light of the\nfindings discovered.\n\nArticle 22.- During the execution period of the investigations and without needing\nto notify the researcher, the Directorate of the ACAT, the Directorate of the ASP of\nthe ACAT, or the Administration of the RBLB may designate officials for the\noversight of the investigation to control that it is carried out following\nthe authorized methodology.\n\nSECTION III\n\nThe Exercise of Ecotourism\n\nArticle 23.- Ecotourism activities are permitted in the RBLB under the\nfollowing terms:\n\na) In the Absolute Protection Zone (Zona de Protección Absoluta), the\nexercise of any ecotourism activity is totally prohibited.\n\nb) In the Restricted Use Zone (Zona de Uso Restringido), only restricted ecotourism is authorized,\nand by exception. According to the following list of activities\nby zone:\n\nb.1. Guided Walks: On the trails called Gigantes del Bosque, La\nCatarata, El Toledo, El Corral, Caoba, research trail.\n\nb.2. Entry and bathing in bodies of water: In the La Poza sector.\n\n--*--\n\nArticle 24.- Guided walks for ecotourism purposes are restricted under the\nfollowing terms:\n\na) Any person conducting activities as a tour guide within the\nLomas Barbudal Biological Reserve must have the tour guide\ncredential issued by the Costa Rican Tourism Institute (Instituto Costarricense de Turismo), for which they must\ncomply with the accreditation process and requirements before that entity according to\nthe provisions of the Regulation for Tour Guides, Executive Decree\nN°41369-MEIC-TUR.\n\nb) The uniform worn by tour guides in this protected area\nmay not, at any time, be similar or alike in shirt and pants color\nto that of the officials of the Administration of the Lomas Barbudal Biological Reserve.\n\nc) The guide must have a prior site recognition accreditation\nissued by the Administration of the Lomas Barbudal Biological Reserve. Such\naccreditation shall be granted in accordance with the provisions of article 26 of\nthis Regulation.\n\nd) Groups shall consist of a maximum of 15 people per\nguide.\n\ne) During the ecotourism activity, unmanned\naerial vehicles (drones) may not be used.\n\nArticle 25.- Any person interested in conducting guided walks under the\nconcept indicated in the previous article must submit a request for\nentry authorization to the protected area. The request must be submitted\nat least 15 calendar days in advance of the date on which the\nactivity is intended to be carried out and contain the following requirements:\n\na) Name and qualifications of the applicant. If the applicant is\na legal entity, the request must be signed by the legal\nrepresentative or, failing that, by whoever holds a general or special power of attorney granting them\nsufficient authority to make the request.\n\nb) Name of the tour guide, identification number, and number of the\ntour guide credential assigned by the Costa Rican Tourism Institute\n(ICT).\n\nc) Number of ecotourists in the group.\n\nd) Date on which the activity is intended to be carried out.\n\ne) Number of the prior site recognition accreditation issued by\nthe Administration of the RBLB.\n\nf) Signature of the applicant.\n\ng) Means for receiving notifications.\n\nArticle 26.- If the tour guide does not have the accreditation referred to\nin subsection e) of the previous article, once the request is received, the\nAdministrator of the RBLB shall notify the interested party, within a period of three business days, of the date and time they\nmust conduct the familiarization tour in\nthe company of a RBLB official. Upon completion of the familiarization tour,\nthe corresponding accreditation shall be issued, which shall be valid for 3 years.\n\nArticle 27.- If the request is submitted incomplete, the applicant shall be\nwarned to submit the missing requirements within a maximum period of 3 business days,\ncorrecting any required information; under warning of the request being archived in case of non-compliance.\n\nAll requirements established in article 25 of this Regulation having been met, the\nAdministration of the RBLB shall proceed to authorize or deny the request by\nduly substantiated administrative resolution, which must be issued\nwithin a period not exceeding five calendar days once all\nrequirements are met. If, for due reasoning, it is not possible to authorize the\necotourism activity for the requested date, the Administrator shall suggest in\nthe same administrative act another date for consideration by the\ninterested party.\n\nArticle 28.- Entry and bathing in the La Poza sector is only permitted for local ecotourists\nas it constitutes a cultural use of the site. The exercise of this\nactivity does not require a tour guide.\n\nArticle 29.- The following provisions apply for bathing in the La Poza sector:\n\na) The use of soap, shampoo, repellents, or other chemicals is not permitted\nwhile entering the water. Nor is the washing of clothes or shoes with soap\nor other detergents authorized.\n\nb) Amorous scenes or the use of obscene language that\nthreatens the stay and morals of other visitors is not permitted.\n\nc) The use of tires or articles used for\nfloating is not permitted, except for life jackets\nor flotation devices attached to the body.\n\nd) Jumping from the riverbanks, trees, or rocks to\nperform \"diving\" actions is not permitted.\n\ne) In the La Poza sector and nearby areas, building campfires (fogatas)\nor carrying out picnic activities is not permitted.\n\nf) The ecotourist entering La Poza does so at their\nexclusive responsibility.\n\nArticle 30.- Official personnel of the ACAT, duly identified and without prior\nnotice, may accompany the ecotourists, when they deem it\nconvenient, in order to oversee, control, and monitor the activities\nthey carry out, as well as to guide and provide environmental information to the\nvisitors. This work may also be performed by volunteers, but\nthey may not exercise actions pertaining to the police function.\n\nSECTION IV\n\nThe Exercise of the Academy\n\nArticle 31.- The trails designated by the General Management Plan (Plan General de Manejo) as restricted use\nzones (zonas de uso restringido) may be used as an open-air classroom (aula abierta) by academic centers\nor non-governmental organizations. This activity is restricted under the\nfollowing terms:\n\na) The teacher guiding the\nactivity must have a prior site recognition accreditation\nissued by the Administration of the Lomas Barbudal Biological Reserve.\nSuch accreditation shall be granted in accordance with the provisions of article 33 of\nthis Regulation.\n\nb) Groups shall consist of a maximum of 30 people.\n\nc) During the activity, wildlife or geological\nmaterial may not be manipulated (manipular). The teacher must\nuse special equipment such as binoculars, a telescope, a guide to birds, plants,\ninsects, or other guides to taxonomic groups to show the elements of\nnature they wish to show with primary interest to the students.\n\nExcepted from the\nprovisions of subsection c) above are those cases where the teacher has\na research or academic collection permit; in such a case, the\nresearcher may carry out the manipulation (manipulación) or capture following the rules\nestablished in the permit or license that has been issued by the SINAC.\n\nArticle 24.- Guided walks\nfor ecotourism purposes are restricted under the following terms:\n\na) Any person conducting activities as a tour guide within the Lomas Barbudal Biological Reserve must have the tour guide credential issued by the Costa Rican Tourism Institute, for which they must comply with the accreditation process and requirements before that entity according to the provisions of the Regulation for Tour Guides, Executive Decree N°41369-MEIC-TUR.\n\nb) The uniform worn\nby tour guides in this protected area may not, at any time,\nbe similar or alike in shirt and pants color\nto that of the officials of the Administration of the Lomas Barbudal Biological Reserve.\n\nc) The guide must have\na prior site recognition accreditation issued by the\nAdministration of the Lomas Barbudal Biological Reserve.\nSuch accreditation shall be granted in accordance with the provisions of article 26 of\nthis Regulation.\n\nd) Groups shall consist\nof a maximum of 15 people per guide.\n\ne) During the ecotourism activity, unmanned\naerial vehicles (drones) may not be used.\n\nArticle 25.- Any person interested\nin conducting guided walks under the concept indicated in the previous\narticle must submit a request for entry authorization to the protected\narea. The request must be submitted at least 15 calendar days in\nadvance of the date on which the activity is intended to be carried out and contain the\nfollowing requirements:\n\na) Name and qualifications of the\napplicant. If the applicant is a legal entity, the\nrequest must be signed by the legal representative or, failing that, by\nwhoever holds a general or special power of attorney granting them sufficient authority for\nmaking the request.\n\nb) Name of the tour guide, identification number, and tour guide credential number\nassigned by the Costa Rican Tourism Institute (ICT).\n\nc) Number of ecotourists in the group.\n\nd) Date on which the\nactivity is intended to be carried out.\n\ne) Number of the\nprior site recognition accreditation issued by the Administration\nof the RBLB.\n\nf) Signature of the applicant.\n\ng) Means for receiving\nnotifications.\n\nArticle 26.- If the tour guide does not have the accreditation referred to in subsection e) of the\nprevious article, once the request is received, the Administrator of the RBLB\nshall notify the interested party, within a period of three business days, of the date and time\nthey must conduct the familiarization tour in the company of a RBLB official. The teacher must\nuse special equipment such as binoculars, a telescope, a guide to birds, plants,\ninsects, or other guides to taxonomic groups to show the elements of\nnature they wish to show with primary interest to the students.\n\nExcepted from the\nprovisions of subsection c) above are those cases where the teacher has a\nresearch or academic collection permit; in such a case, the\nresearcher may carry out the manipulation (manipulación) or capture following the rules\nestablished in the permit or license that has been issued by the SINAC.\n\nArticle\n32.- Any\nacademic center or non-governmental organization that is interested in\ncarrying out open-air classroom (aula abierta) activities under the concept indicated in the\nprevious article must submit the authorization request to the Administration\nof the Protected Wilderness Area. The request must be submitted at least\none month in advance of the date on which the activity is intended to be carried out and\ncontain the following requirements:\n\na) Name of the academic\ncenter or non-governmental organization and the name and qualifications of the\n\nteacher who will\nconduct the activity.\n\nb) Specific objectives\nintended to be achieved with the academic activity.\n\nc) Number of students\nin the group.\n\nd) Date on which the\nacademic activity is intended to be carried out.\n\ne) Number of the\nprior site recognition accreditation issued by the Administration\nof the RBLB.\n\nf) Signature of the teacher\nresponsible for the academic activity with the approval of the Directorate of the\nAcademic Center or non-governmental organization.\n\ng) Means for receiving\nnotifications.\n\nArticle 33.- In the event that the teacher who will guide the group does not have the accreditation referred to in subsection e) of the previous article, once the request is received, the RBLB Administrator shall notify the interested party, within a period of three business days, of the date and time at which they must carry out the reconnaissance tour (gira de reconocimiento) in the company of an RBLB official. Upon completion of the reconnaissance tour, the due accreditation shall be issued, which shall be valid for 5 years.\n\nArticle 34.- Having fulfilled the requirements established in Article 32 of these Regulations, the RBLB Administration shall proceed to authorize or deny the request by means of a duly reasoned administrative resolution, which must be issued within a period not exceeding ten calendar days, once all the requirements have been met. In the event that the request is incomplete, a single written notice (prevención) shall be made to the applicant to complete the omitted requirements in the request or to clarify or rectify the information, granting a reasonable period of up to ten days to complete or clarify. Said notice shall temporarily suspend the period for resolution. In the event that the notice is not addressed by the applicant, the proceeding shall be archived. In the event that, under due reasoning, it is not possible to authorize the academic activity for the requested date, the Administrator shall suggest, in the same administrative act, another date for consideration by the interested party.\n\nArticle 35.- The RBLB Administration may, in any case, integrate up to three institutional officials or volunteers into the academic activity as a knowledge management mechanism. Under no circumstances may the authorized educational center or non-governmental organization charge any fee for the presence of these persons assigned by the Administration to participate in the activity.\n\nSECTION V\n\nOn the Exercise of Filming\n\nArticle 36.- Filming within the RBLB is permitted under the terms set forth in Executive Decree No. 38295-MINAE. This activity may be carried out only under the following circumstances: a) By those who, while carrying out another activity that has been authorized for them, wish to film for the sole purpose of preserving a memory.\n\nb) Commercial, scientific, educational, or tourist filming activities duly authorized by the ACAT Directorate in the zones permitted by the General Management Plan (Plan General de Manejo).\n\nc) Journalistic filming activities duly authorized by the RBLB Administrator.\n\nIf, for maintenance, protection, or conservation reasons, filming permits are restricted, filming for scientific research and management activity purposes shall have priority over commercial filming.\n\nArticle 37.- To carry out commercial, scientific, educational, or tourist filming activities, the user must process a permit before the ACAT Directorate at least 15 calendar days in advance and pay the corresponding fee. The ACAT Directorate shall grant or deny the requested permit by means of a duly reasoned resolution, which shall be issued within a maximum period of 10 calendar days after the submission of the request made completely and correctly.\n\nSaid request must contain the following data:\n\na) Name and qualifications of the applicant. In the event that the applicant is a legal entity, the request must be signed by the legal representative or, failing that, by whoever holds a general or special power of attorney granting them sufficient authority to make the request.\n\nb) Purposes of the material to be filmed.\n\nc) Indication of the number of days intended for filming. d) Indicate the means for receiving notifications.\n\nIn addition, the following documents must be attached to the request:\n\na) Registration certification of legal status in the case of legal entities.\n\nb) Copy of the filming script. The request must be made using the format established in Annex No. 1 of these Regulations.\n\nAt the time of submitting the request, the applicant's identity card must be presented in the case of a domestic natural person, passport in the case of a foreign natural person, or that of the legal representative in the case of a legal entity, so that the official receiving the submission can verify the identity and record the verification.\n\nIn the event that the request is submitted incompletely, the applicant shall be notified (prevención) to submit the missing requirements within a maximum period of 3 business days, or to rectify any required information; under warning of the request being archived in case of non-compliance.\n\nArticle 38.- Journalistic filming (for news purposes) shall require written authorization from the RBLB Administrator. For this purpose, the interested party must request authorization by filling out the form that will be provided for this purpose at the RBLB Administration, which shall contain the following: a) Name and qualifications of the applicant. In the event that they belong to a media outlet, detail the company's qualifications. b) Purposes of the material to be filmed. c) Indication of the means for receiving notifications; for which, the applicant shall use the format established in Annex No. 1 of these Regulations. The period for approval by the Administration shall be two hours. At the time of submitting the request, the applicant must also present their identity card in the case of a domestic natural person, passport in the case of a foreign natural person, or that of the legal representative in the case of a legal entity, so that the official receiving the submission can verify the identity and record it as such.\n\nArticle 39.- Amateur filming solely intended to preserve a memory of the visit to the Protected Wild Area shall be exempt from the payment of fees as provided in Executive Decree No. 38295-MINAE, with the exception that the same may not be used for commercial or for-profit purposes.\n\nArticle 40.- Drone filming within the RBLB is prohibited, except when the filming is carried out by the Administration or if the purposes are scientific and this is duly contemplated within the methodology of the research that has been duly approved by the ACAT Directorate.\n\nSECTION VI\n\nProhibited Activities\n\nArticle 41.- Regarding wildlife species, the following is strictly prohibited within the RBLB:\n\na) The trade and trafficking of any wildlife product of aquatic or terrestrial origin.\n\nb) Fishing, hunting, extracting, manipulating, harassing, and molesting individuals of any type of aquatic or terrestrial animal species.\n\nc) Extracting and manipulating organisms of any type of aquatic or terrestrial plant species.\n\nd) Extracting and manipulating any species belonging to the Kingdom Fungi (fungi).\n\ne) Extracting any type of organic or inorganic material, including sand, or stones for any type of use.\n\nf) The use of cages for fauna observation, except for scientific or educational purposes, provided that they have the respective permit granted by the competent authority.\n\ng) Feeding aquatic and terrestrial organisms.\n\nh) Entering the Protected Wild Area with any type of pet.\n\nExcepted from the foregoing prohibitions are activities for scientific, educational, or management purposes carried out by SINAC personnel or by researchers who have the respective authorization and that are in compliance with the application of the Wildlife Conservation Law (Ley de Conservación de Vida Silvestre) No. 7317 and its regulation, Executive Decree 40548-MINAE, such that they are not prohibited or constitute a crime or contravention according to said norms.\n\nArticle 42.- In relation to the use of the RBLB, the following is absolutely prohibited:\n\na) Making any type of mark on trees, rocks, and any other element within the boundaries of the RBLB.\n\nb) The carrying or use of any type of weapon (such as firearms, bladed weapons, compressed air or spring weapons, slingshot arrows, crossbows) unless they are used for management purposes authorized by the ACAT or for control and surveillance exercised by the State.\n\nc) The sale and consumption of drugs. Excepted from this provision are those substances for medical treatment.\n\nd) Camping or lighting campfires within the boundaries of the protected wild area. e) Nudism.\n\nf) Any type of environmental pollution produced by solid or liquid waste.\n\ng) The generation of excessive noise, except that which is generated for administrative reasons.\n\nh) The entry of food containing seeds.\n\ni) The entry of prepared foods. Except for the minimum sustenance that must be brought in by persons with a health condition that warrants the entry of certain foods.\n\nj) Deviating outside the width of the trails during guided walks.\n\nArticle 43.- All activities that are considered as such by the current environmental regulations or that constitute contraventions or crimes according to the national legal system are generally prohibited.\n\nCHAPTER IV\n\nPowers of the Administration\n\nArticle 44.- The officials of the central offices of the ACAT and the Lomas Barbudal Biological Reserve constitute the personnel responsible for ensuring compliance with the current legal regulations for all activities carried out within the Protected Wild Areas, without prejudice to the powers of other police forces and judicial bodies.\n\nArticle 45.- The RBLB Administration may conduct periodic evaluations of the quality of tourist guiding services provided by general, specialized, and local guides; and if irregularities are found, it shall communicate them to the respective Department of the Costa Rican Tourism Institute (ICT) for appropriate action regarding the credential, and the administrative and legal procedures to follow.\n\nArticle 46.- The ACAT Directorate, upon prior recommendation of the Scientific Technical Committee (Comité Técnico Científico), has the power to authorize the opening of new sites intended for carrying out the activities provided for in these Regulations, as well as to close those restricted-use sites it deems necessary for management or conservation purposes.\n\nArticle 47.- The RBLB Administration may, at any time, restrict public-use activities and sites, following the principles governing environmental matters and the objectives established in the General Management Plan. If the restriction needs to be applied for a period longer than one month, it shall issue it and bring it to the attention of the Scientific Technical Committee of the Conservation Area for recommendation to the ACAT Directorate to extend its validity for the time deemed necessary, in light of the principles governing environmental matters and sound judgment.\n\nArticle 48.- RBLB personnel, duly identified, may, when deemed necessary, carry out any other inspection that the Administration considers necessary for compliance with these regulations and related regulations, for which they have the authority to access the entire protected area. Volunteers who are assisting in the work carried out by officials in their different programs may likewise access the different geographical zones and sectors of the RBLB, as required and arranged by the Administration.\n\nArticle 49.- The ACAT Directorate shall have the power to order the temporary or permanent closure of permitted activities in the RBLB if, through the criteria of the RBLB technical personnel or specialists, by means of environmental monitoring and other technical activities proposed in the Management Plan (Plan de Manejo), or in other technical studies necessary for the adequate management of biological resources, any negative impact or deterioration is detected in their integrity or in the correct application of the preventive and precautionary principles governing the matter. Closure may also be ordered when necessary for the execution of actions recommended by the management programs, whose proper development could be affected by the presence of visitors in the area.\n\nArticle 50.- In case of emergency, the RBLB Administration shall have the power to execute the contingency plan established for this purpose, in order to safeguard the physical integrity of users and/or officials. These administrative provisions may include the partial or total closure of the protected wild area for the time deemed appropriate.\n\nArticle 51.- Any ACAT official may expel from the boundaries of the RBLB those persons who, being present in the protected area, carry out prohibited activities or fail to obey provisions issued by officials in the timely performance of their duties. Likewise, the authorization for stay and the carrying out of activities may be suspended due to adverse weather conditions or any other duly justified reason, without this generating liability for the Administration.\n\nArticle 52.- Obligatorily, every visitor must comply with the safety and orientation instructions given by the official, guide, or authorized teacher in charge of the group. Failure to comply with this provision shall be grounds to suspend the authorization for stay within the protected wild area.\n\nArticle 53.- The RBLB Administration may authorize entry and exit hours different from those established for the exercise of ecotourism in Article 10 of these Regulations, when the purpose of entry is filming, research, or academic activities; this upon a duly justified prior request from the permit holder.\n\nArticle 54.- SINAC, through the ACAT and the RBLB Administration, may carry out within the boundaries of the RBLB training and instruction activities for officials, Natural Resource Vigilance Committees (COVIRENAS), and volunteers, for the adequate management of the protected wild area. Said activities shall respect the technical criteria for zoning and conservation provided for in the General Management Plan.\n\nCHAPTER V\n\nFinal Provisions\n\nArticle 55.- The stated prohibitions shall be sanctioned in accordance with the provisions of Article 9 of the National Parks Service Law (Ley del Servicio de Parques Nacionales) No. 6084, in Chapters XI and XII of the Wildlife Conservation Law No. 7317 and its amendments, as well as with the application of any other sanctioning regulation in force on the date of the events.\n\nArticle 56.- Effective as of its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic.
