Que de acuerdo a lo establecido en el Decreto Ejecutivo N° 38863-MINAE,\nReglamento para el trámite de los permisos y control del aprovechamiento\nmaderable, en terrenos de uso agropecuario, sin bosque y situaciones especiales\nen Costa Rica y Oficialización del \"Sistema de información para el control del\nAprovechamiento Forestal (SICAF), artículo 27 sobre los requisitos para\ncertificados de origen, en su inciso e) establece que los Certificados de Origen\npresentados a la Administración Forestal del Estado para aprovechamiento de\nsistemas agroforestales de árboles regenerados en forma natural, deberán\ncumplir los requerimientos técnicos y ajustarse a la lista oficial de especies\nque defina y publique la AFE, en el Diario Oficial La Gaceta, por lo cual se\nhace necesario dicho listado de especies.\n\nCONSIDERANDO:\n\nPRIMERO. Que la Ley Forestal N° 7575, en su artículo primero, establece como\nfunción esencial y prioritaria del Estado, velar por la conservación,\nprotección y administración de los bosques naturales y por la producción, el\naprovechamiento, la industrialización y el fomento de los recursos forestales\ndel país destinados a este fin, de acuerdo al principio de uso adecuado y\nsostenible de los recursos naturales renovables.\n\nSEGUNDO. Que de conformidad con el artículo 3 de la Ley Forestal 7575, el\naprovechamiento maderable, es toda acción de corta, eliminación de árboles\nmaderables en pie o utilización de árboles caídos, que genere o pueda generar\nalgún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la\nrealiza o para quien ésta representa.\n\nTERCERO. Que en el Diario Oficial La Gaceta Nº 66 del 7 de abril del 2015 se\npublicó el Decreto Ejecutivo Nº 38863- MINAE, correspondiente al Reglamento\npara el trámite de los permisos y control del aprovechamiento maderable, en terrenos\nde uso agropecuario, sin bosque y situaciones especiales en Costa Rica y\nOficialización del \"Sistema de Información para el control del Aprovechamiento\nForestal\" (SICAF).\n\nCUARTO. Que en el artículo 27 del Decreto Ejecutivo Nº 38863-MINAE sobre los\nRequisitos para Certificados de Origen, en su inciso e) establece que los\nCertificados de Origen presentados a la Administración Forestal del Estado para\naprovechamiento de sistemas agroforestales de árboles regenerados en forma\nnatural, deberán cumplir los requerimientos técnicos y ajustarse a la lista\noficial de especies que defina y publique la AFE, en el Diario Oficial La\nGaceta.\n\nQUINTO. Que de acuerdo al artículo 11 de la Ley General de la Administración\nPública N° 6227 del 02 de mayo de 1978 la Administración Pública actuará\nsometida al ordenamiento jurídico y sólo podrá realizar aquellos actos o\nprestar aquellos servicios públicos que autorice dicho ordenamiento, según la\nescala jerárquica de sus fuentes.\n\nSEXTO: Que en la Ley General de la Administración Pública N° 6227 en su\nartículo 16 establece que en ningún caso podrán dictarse actos contrarios a\nreglas unívocas de la ciencia o de la técnica, o a principios elementales de\njusticia, lógica\n\nSÉTIMO: Que mediante la Resolución R-SINAC-DE-108-2017 del 03 de noviembre de\n2017 publicada en el Alcance: 281 de La Gaceta N° 220 del 21 de noviembre de\n2017, se oficializó la Lista de especies cultivadas o regeneradas naturalmente que\nlas Áreas de Conservación han establecido oficialmente para los Certificados de\nOrigen en Sistemas Agroforestales.\n\nOCTAVO. Que se ha determinado por parte de los Directores de Recursos\nForestales y Vida Silvestre de las Áreas de Conservación del SINAC, la\nnecesidad de actualización de la Lista de especies cultivadas o regeneradas\nnaturalmente que las Áreas de Conservación han establecido oficialmente para\nlos Certificados de Origen en Sistemas Agroforestales, Resolución R-SINAC-DE-108-2017\ndel 03 de noviembre de 2017 publicada en el Alcance: 281 de La Gaceta N° 220\ndel 21 de noviembre de 2017.\n\nPOR TANTO:\n\nLA SECRETARÍA EJECUTIVA DEL\n\nCONSEJO NACIONAL DE AREAS\nDE CONSERVACION\n\nRESUELVE:\n\nPRIMERO: Publicar la modificación de la resolución R-SINAC-DE-108-2017 DEL 03\nde noviembre de 2017 Lista de especies cultivadas o regeneradas\nnaturalmente que las Áreas de Conservación han establecido oficialmente para\nlos Certificados de Origen en Sistemas Agroforestales:\n\nMODIFICACIÓN DE LA\nRESOLUCIÓN R-SINAC-DE-108-2017 DEL 03 DE NOVIEMBRE DE 2017 LISTA DE\n\nESPECIES CULTIVADAS O\nREGENERADAS NATURALMENTE QUE LAS ÁREAS DE CONSERVACIÓN\n\nHAN ESTABLECIDO\nOFICIALMENTE PARA LOS CERTIFICADOS DE ORIGEN EN SISTEMAS\n\nAGROFORESTALES\n\nSEGUNDO. That according to the provisions of Decreto Ejecutivo N° 38863-MINAE,\nRegulation for the processing of permits and control of timber harvesting\n(aprovechamiento maderable), on agricultural lands without forest and special situations\nin Costa Rica and Officialization of the \"Information System for Forest\nHarvesting Control (SICAF), article 27 on the requirements for\ncertificates of origin, subsection e) establishes that Certificates of Origin\nsubmitted to the State Forest Administration for the harvesting of agroforestry systems of naturally regenerated trees must\ncomply with the technical requirements and conform to the official list of species\ndefined and published by the AFE, in the Official Gazette La Gaceta, therefore\nsaid species list is necessary.\n\nCONSIDERANDO:\n\nFIRST. That the Ley Forestal No. 7575, in its first article, establishes as an\nessential and priority function of the State, to ensure the conservation,\nprotection, and management of natural forests and the production,\nharvesting, industrialization, and promotion of the country's forest resources\ndestined for this purpose, according to the principle of adequate and\nsustainable use of renewable natural resources.\n\nSECOND. That in accordance with article 3 of the Ley Forestal 7575, timber\nharvesting (aprovechamiento maderable) is any action of cutting, removal of standing timber trees, or use of fallen trees, that generates or may generate\nsome profit, benefit, advantage, utility, or gain for the person who performs\nit or for whom that person represents.\n\nTHIRD. That in the Official Gazette La Gaceta No. 66 of April 7, 2015,\nDecreto Ejecutivo Nº 38863-MINAE was published, corresponding to the\nRegulation for the processing of permits and control of timber harvesting, on\nagricultural lands without forest and special situations in Costa Rica and\nOfficialization of the \"Information System for Forest Harvesting Control\"\n(SICAF).\n\nFOURTH. That article 27 of Decreto Ejecutivo Nº 38863-MINAE on the\nRequirements for Certificates of Origin, in its subsection e), establishes that\nCertificates of Origin submitted to the State Forest Administration for\nharvesting of agroforestry systems of naturally regenerated trees, must\ncomply with the technical requirements and conform to the official list of\nspecies defined and published by the AFE, in the Official Gazette La\nGaceta.\n\nFIFTH. That according to article 11 of the General Law of Public\nAdministration No. 6227 of May 2, 1978, the Public Administration shall act\nsubject to the legal system and may only perform those acts or\nprovide those public services that said system authorizes, according to the\nhierarchical scale of its sources.\n\nSIXTH: That the General Law of Public Administration No. 6227 in its\narticle 16 establishes that in no case may acts be issued contrary to\nunequivocal rules of science or technique, or to elementary principles of\njustice, logic\n\nSEVENTH: That through Resolution R-SINAC-DE-108-2017 of November 3,\n2017 published in Supplement: 281 of La Gaceta No. 220 of November 21,\n2017, the List of cultivated or naturally regenerated species that\nthe Conservation Areas have officially established for Certificates of\nOrigin in Agroforestry Systems was made official.\n\nEIGHTH. The Administration, within the legally established timelines,\nwill proceed to coordinate a technical visit to verify whether or not the site corresponds\nto an agroforestry system, and based on this evaluation, it will determine whether\nto accept or reject the document as such. In both cases, the forest regent will be formally\nnotified of the decision.\n\nSIXTH. In those cases where a Certificate of\nOrigin for regenerated or cultivated trees under agroforestry systems is submitted to the AFE and\nit contains forestry species not included in the official list of the respective\nConservation Area, the AFE is obliged to conduct the necessary field\nvisits to verify that the information contained in the certificates of\norigin is reliable, and thus comply with the constitutional mandate for a healthy\nand ecologically balanced environment.\n\nSEVENTH.
