  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 43582\n\n                        Reforma Reglamento para la Operación de Actividades de Turismo de Aventura\n\nN° 43582\nS-TUR\n\nLA\nSEGUNDA VICEPRESIDENTA DE LA REPÚBLICA\n\nEN\nEJERCICIO DE LA PRESIDENCIA DE LA REPÚBLICA,\n\nEL\nMINISTRO aí DE SALUD Y EL MINISTRO DE TURISMO\n\nEn\nuso de las facultades conferidas en los artículos 46, 140 incisos 3) y 18) y\n146 de la Constitución Política; 25, 27 inciso 1), 28 inciso b) y 103 inciso 1)\nde la Ley Nº 6227 del 02 de mayo de 1978, \"Ley General de la\nAdministración Pública\"; 2, 4, 7, 322, 323, 324, 325, 326 y 355 de la Ley\nNº 5395 del 30 de octubre de 1973, \"Ley General de Salud\" y el\nartículo 2 inciso c) de la Ley Nº 5412 del 8 de noviembre de 1973, \"Ley\nOrgánica del Ministerio de Salud\".\n\nCONSIDERANDO\n\nl.\nQue, el artículo 12 del Decreto Ejecutivo Nº 39703-S-TUR del 22 de febrero del\n2016 y sus refo1mas, \"Reglamento para la Operación de Actividades de\nTurismo de Aventura\", establece que para desarrollar cualquier actividad\nde turismo aventura, el prestador de servicios turísticos debe contar con la\nintervención de guías capacitados y calificados para cada actividad específica\nque se realiza, los cuales deben tener la debida licencia o credencial de guía\nturístico otorgada por el Instituto Costarricense de Turismo en la categoría\nrespectiva, de conformidad al Decreto N° 31030-MEICTUR del 17 de enero del\n2003, \"Reglamento de los guías de turismo\" y sus reformas.\n\nII.\nQue mediante Decreto Ejecutivo Nº 42487-S-TUR del 27 de julio del 2020, se\nmodificó el Transitorio único del Decreto Ejecutivo Nº 39703-S-TUR del 22 de\nfebrero del 2016 y sus reformas, \"Reglamento para la Operación de\nActividades de Turismo de Aventura\" (en adelante el Reglamento),\nestableciendo un plazo, hasta el 6 de junio de 2022, en apego a lo establecido\nen el artículo 12 del mismo reglamento, para que los prestadores de servicios\nturísticos de las actividades de turismo de aventura, contaran con la\nintervención de guías capacitados y calificados para cada actividad específica\nque se realiza, los cuales debían tener la debida licencia o credencial de guía\nturístico otorgada por el Instituto Costarricense de Turismo en la categoría\nrespectiva, de conformidad al Decreto N° 31030-MEIC-TUR del 17 de enero del\n2003, \"Reglamento de los guías de turismo\" y sus reformas.\n\nIII. Que, como consecuencia de la emergencia nacional provocada por la pandemia Covid 19, muchas de\nlas capacitaciones necesarias para el otorgamiento de la licencia o credencial de guía turístico\notorgada por el Instituto Costarricense de Turismo fueron suspendidas o reducidas como medida\nsanitaria preventiva, por lo que resultó imposible finalizar el proceso de capacitaciones\nplanificado para el período de los últimos dos años del Transitorio que finalizó este 6 de junio,\npor lo cual surge la necesidad de adicionar al Reglamento un Transitorio que otorgue un nuevo plazo\nde 3 meses para la ejecución de dicho proceso.\n\nIV.\nQue los procesos de coordinación y construcción de las capacitaciones\nrequeridas para la licencia o credencial de guía turístico que otorga el\nInstituto Costarricense de Turismo, deberán además incluir los alcances e\nimplementación de los protocolos sanitarios exigidos para el desarrollo de\ncualquier tipo de actividad turística, para lo cual deberá tomarse en cuenta\nlas últimas actualizaciones en las normativas sanitarias del país y los\nrequerimientos particulares de cada actividad turística, en esta nueva etapa de\nreactivación por motivo de la COVID 19, por lo que es necesario contar con un\nnuevo Transitorio de tres meses para el cumplimiento del requisito referido a\nla licencia o credencial de guía turístico establecido en el artículo 12 del\nReglamento.\n\nV.\nQue, como resultados derivados de esta reforma al Reglamento, se espera contar\ncon herramientas técnicas y de capacitación actualizadas y ajustadas a las\nnecesidades actuales de la reactivación del sector turismo frente a la COVID 19.\n\nVI.\nQue, de conformidad con el artículo 12 bis del Decreto Ejecutivo Nº\n37045-MPMEIC del 22 de febrero del 2012, \"Reglamento a la Ley de\nProtección al Ciudadano del Exceso de Requisitos y Trámites\nAdministrativos\" y su reforma, se considera que por la naturaleza del\npresente reglamento no es necesario completar la Sección I denominada Control\nPrevio de Mejora Regulatoria, que conforma el formulario de Evaluación Costo\nBeneficio, toda vez que el mismo no establece trámites ni requerimientos para\nel administrado.\n\nPor tanto,\n\nDECRETAN:\n\nREFORMA AL TÍTULO DEL\nTRANSITORIO UNICO Y ADICIÓN DE UN\n\nTRANSITORIO II DEL\nDECRETO EJECUTIVO Nº 39703-S-TUR\n\nDEL 22 DE FEBRERO DEL\n2016 Y SUS REFORMAS\n\n\"REGLAMENTO PARA\nLA OPERACIÓN DE ACTIVIDADES DE TURISMO\n\nAVENTURA\"\n\nArtículo 1°-Modifiquese el título del Transitorio Único\ndel Decreto Ejecutivo Nº 39703-S-TUR del 22 de febrero del 2016 y sus reformas,\nReglamento para la Operación de Actividades de Turismo de Aventura, quedando el\nresto de la norma invariable y para que en lo sucesivo se lea:\n\n\"Transitorio\nI: ( ... )\n\n( ... )\"\n\nArtículo 2.   "body_en_text": "... in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 43582\n\n                        Reform of the Regulation for the Operation of Adventure Tourism Activities\n\nN° 43582\nS-TUR\n\nTHE\nSECOND VICE-PRESIDENT OF THE REPUBLIC\n\nIN\nEXERCISE OF THE PRESIDENCY OF THE REPUBLIC,\n\nTHE\nMINISTER OF HEALTH aí AND THE MINISTER OF TOURISM\n\nIn\nuse of the powers conferred by Articles 46, 140 subsections 3) and 18), and\n146 of the Political Constitution; 25, 27 subsection 1), 28 subsection b), and 103 subsection 1)\nof Law Nº 6227 of May 2, 1978, \"Ley General de la\nAdministración Pública\"; 2, 4, 7, 322, 323, 324, 325, 326, and 355 of Law\nNº 5395 of October 30, 1973, \"Ley General de Salud,\" and\nArticle 2 subsection c) of Law Nº 5412 of November 8, 1973, \"Ley\nOrgánica del Ministerio de Salud.\"\n\nCONSIDERANDO\n\nI.\nThat Article 12 of Executive Decree Nº 39703-S-TUR of February 22,\n2016, and its amendments, \"Reglamento para la Operación de Actividades de\nTurismo de Aventura\" (Regulation for the Operation of Adventure Tourism Activities) (hereinafter the Regulation), establishes that to develop any adventure tourism activity, the tourism service provider must have the participation of trained and qualified guides for each specific activity carried out, who must hold the corresponding tourist guide license or credential issued by the Instituto Costarricense de Turismo in the respective category, in accordance with Decree N° 31030-MEICTUR of January 17,\n2003, \"Reglamento de los guías de turismo\" and its amendments.\n\nII.\nThat by Executive Decree Nº 42487-S-TUR of July 27, 2020, the sole Single Transitory Provision (Transitorio único) of Executive Decree Nº 39703-S-TUR of February 22, 2016, and its amendments, \"Reglamento para la Operación de\nActividades de Turismo de Aventura\" (hereinafter the Regulation), was amended,\nestablishing a deadline, until June 6, 2022, in accordance with the provisions of Article 12 of the same regulation, so that tourism service providers for adventure tourism activities would have the participation of trained and qualified guides for each specific activity carried out, who were required to hold the corresponding tourist guide license or credential issued by the Instituto Costarricense de Turismo in the respective category, in accordance with Decree N° 31030-MEIC-TUR of January 17,\n2003, \"Reglamento de los guías de turismo\" and its amendments.\n\nIII. That, as a consequence of the national emergency caused by the Covid 19 pandemic, many of\nthe training sessions necessary for the granting of the tourist guide license or credential issued by the Instituto Costarricense de Turismo were suspended or reduced as a preventive sanitary measure, making it impossible to complete the training process planned for the last two years of the Transitory Provision that ended this June 6,\nwhereby the need arises to add to the Regulation a Transitory Provision that grants a new deadline of 3 months for the execution of said process.\n\nIV.\nThat the processes of coordination and construction of the training\nrequired for the tourist guide license or credential granted by the\nInstituto Costarricense de Turismo must also include the scope and\nimplementation of the sanitary protocols required for the development of\nany type of tourism activity, for which the latest updates in the country's sanitary regulations and the particular requirements of each tourism activity must be taken into account, in this new stage of reactivation due to COVID 19, therefore it is necessary to have a new Transitory Provision of three months for compliance with the requirement referring to the tourist guide license or credential established in Article 12 of the\nRegulation.\n\nV.\nThat, as results derived from this reform to the Regulation, it is expected to have\nupdated technical and training tools adjusted to the current needs of the reactivation of the tourism sector in the face of COVID 19.\n\nVI.\nThat, in accordance with Article 12 bis of Executive Decree Nº\n37045-MPMEIC of February 22, 2012, \"Reglamento a la Ley de\nProtección al Ciudadano del Exceso de Requisitos y Trámites\nAdministrativos\" and its amendment, it is considered that due to the nature of the\npresent regulation, it is not necessary to complete Section I, called Control\nPrevio de Mejora Regulatoria, that makes up the Cost-Benefit Evaluation form, since it does not establish procedures or requirements for the administered party.\n\nPor tanto,\n\nTHEY DECREE:\n\nREFORM OF THE TITLE OF THE\nSOLE SINGLE TRANSITORY PROVISION AND ADDITION OF A\n\nTRANSITORY PROVISION II TO EXECUTIVE DECREE Nº 39703-S-TUR\n\nOF FEBRUARY 22, 2016, AND ITS AMENDMENTS\n\n\"REGLAMENTO PARA\nLA OPERACIÓN DE ACTIVIDADES DE TURISMO\n\nAVENTURA\"\n\nArticle 1°- Amend the title of the Single Transitory Provision (Transitorio Único)\nof Executive Decree Nº 39703-S-TUR of February 22, 2016, and its amendments,\nReglamento para la Operación de Actividades de Turismo de Aventura, the rest of the regulation remaining unchanged and so that henceforth it shall read:\n\n\"Transitory Provision\nI (Transitorio I): ( ... )\n\n( ... )\"\n\nArticle 2.
