  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 005\n\n                        Nombramiento de la comisión de donaciones del Ministerio de Ambiente y\nEnergía\n\nMINISTERIO DE AMBIENTE Y ENERGÍA\n\nA- 005-2022-MINAE\n\nNOMBRAMIENTO DE LA COMISIÓN DE DONACIONES\n\nDEL MINISTERIO DE AMBIENTE Y ENERGÍA\n\nDe conformidad con las atribuciones que le confiere el\nartículo 28 inciso 2) aparte a) y 89 de la Ley Nº 6227, Ley General de la\nAdministración Pública del 02 de mayo de 1978 y sus reformas; así como los\nartículos 25 incisos e) y d), 26, 39 del Decreto Nº 40797-H \"Reglamento\npara el Registro y Control de Bienes de la Administración Central y reforma al\nartículo 144 del Decreto Ejecutivo Nº 32988 Reglamento a la Ley de\nAdministración Financiera de la República y Presupuestos Públicos del 31 de\nenero del 2006\", publicado en el Alcance Digital N° 24 a La Gaceta Nº\n20 del 02 de febrero del 2018.\n\nConsiderando:\n\nI.-Que mediante Acuerdo Nº001-P, publicado en el Alcance\nDigital N° 91 a La Gaceta N° 85 del 10 de mayo del 2022, se nombra al\nseñor Franz Tattenbach Capra,\ncédula de identidad 1 0622 0325, en el cargo de Ministro de Ambiente y Energía,\na partir del 08 de mayo del dos mil veintidós.\n\nII.-Que el nombramiento de la Comisión de Donación del Ministerio de\nAmbiente y Energía, es competencia del máximo jerarca de la Institución,\nconforme lo dispone los numerales 25 incisos e) y d) y 39 del \"Reglamento\npara el Registro y Control de Bienes de la Administración Central y reforma al\nartículo 144 del Decreto Ejecutivo Nº 32988, Reglamento a la Ley de\nAdministración Financiera de la República y Presupuestos Públicos del 31 de\nenero del 2006\", según Decreto Ejecutivo Nº 40797-H del publicado en el\nAlcance Digital Nº 24 del 02 de febrero del 2018.\n\nIII.-Que el numeral 53 del Reglamento Orgánico del Ministerio de Ambiente,\ny Energía, Decreto Ejecutivo N° 35669-MINAE, publicado en La Gaceta del\n6 de enero del 2010; dispone sobre las funciones que le corresponde a la\nOficialía Mayor-Dirección Ejecutiva, entre éstas, la coordinación de las\nactividades administrativas ministeriales que permitan cumplir con las\npolíticas, lineamientos, directrices y estrategias en materia administrativa en\nlos niveles superior, gerencial, ejecutivo y regional para el cumplimiento de\nlos objetivos y metas institucionales y sectoriales. De igual forma,\ninstrumentar el desarrollo de personal, la adquisición, control y salvaguarda\nde los recursos materiales, prestación de servicios, desarrollo organizacional,\ncontrol del gasto de servicios básicos, contraloría de servicios, así como\nejercer como superior inmediato para efectos administrativos de los\nfuncionarios del nivel ejecutivo, y cualquier otra establecida por el ordenamiento\nlegal, que correspondan a la materia.\n\nIV.-Que el Ministerio de Hacienda en su carácter de Órgano Rector del\nSistema de Administración Financiera y la Dirección General de Administración\nde Bienes y Contratación Administrativa, ha venido ajustando el uso de los\nsistemas informáticos de apoyo a la gestión, a efectos de implementar la firma\ndigital y documentos electrónicos, conforme a lo preceptuado en la Ley de\nCertificados, Firmas Digitales y Documentos Electrónicos, Ley Nº 8454 y su\nReglamento, a efectos de propiciar la eficiencia y eficacia y transparencia\n\nV.-Que el artículo 28 inciso 1) y 2) aparte a) de la Ley General de la\nAdministración Pública dispone que el Ministro es el órgano jerárquico superior\ndel respectivo Ministerio, correspondiéndole dirigir y coordinar todos los\nservicios del Ministerio.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 005\n\n                        Appointment of the donations committee of the Ministry of Environment and\nEnergy\n\nMINISTRY OF ENVIRONMENT AND ENERGY\n\nA-005-2022-MINAE\n\nAPPOINTMENT OF THE DONATIONS COMMITTEE\n\nOF THE MINISTRY OF ENVIRONMENT AND ENERGY\n\nIn accordance with the powers conferred by\nArticle 28, subsection 2), sub-item a) and Article 89 of Law No. 6227, the General Public Administration Act (Ley General de la\nAdministración Pública) of May 2, 1978, and its amendments; as well as\nArticles 25, subsections e) and d), 26, and 39 of Decree No. 40797-H, \"Regulation\nfor the Registration and Control of Assets of the Central Administration and amendment to\nArticle 144 of Executive Decree No. 32988, Regulation to the Law on Financial Administration\nof the Republic and Public Budgets of January\n31, 2006\" (Reglamento para el Registro y Control de Bienes de la Administración Central y reforma al artículo 144 del Decreto Ejecutivo Nº 32988 Reglamento a la Ley de Administración Financiera de la República y Presupuestos Públicos del 31 de enero del 2006), published in Digital Supplement (Alcance Digital) No. 24 to La Gaceta No.\n20 of February 2, 2018.\n\nConsidering:\n\nI.-That by Agreement No. 001-P, published in Digital Supplement (Alcance Digital) No. 91 to La Gaceta No. 85 of May 10, 2022, Mr. Franz Tattenbach Capra,\nidentity card 1 0622 0325, is appointed to the position of Minister of Environment and Energy,\neffective as of May 8, two thousand twenty-two.\n\nII.-That the appointment of the Donations Committee of the Ministry of\nEnvironment and Energy is the responsibility of the highest-ranking authority of the Institution,\nas provided in articles 25, subsections e) and d), and 39 of the \"Regulation\nfor the Registration and Control of Assets of the Central Administration and amendment to\nArticle 144 of Executive Decree No. 32988, Regulation to the Law on Financial Administration\nof the Republic and Public Budgets of January 31,\n2006\", according to Executive Decree No. 40797-H, published in\nDigital Supplement (Alcance Digital) No. 24 of February 2, 2018.\n\nIII.-That article 53 of the Organic Regulation of the Ministry of Environment\nand Energy, Executive Decree No. 35669-MINAE, published in La Gaceta of\nJanuary 6, 2010, sets forth the functions corresponding to the\nOffice of the Official Mayor-Executive Directorate (Oficialía Mayor-Dirección Ejecutiva), among these, the coordination of\nministerial administrative activities to ensure compliance with\npolicies, guidelines, directives, and strategies in administrative matters at\nthe senior, managerial, executive, and regional levels for the fulfillment of\ninstitutional and sectoral objectives and goals. Likewise, to\nimplement personnel development, the acquisition, control, and safeguarding\nof material resources, provision of services, organizational development,\ncontrol of basic service expenditures, service comptrollership, as well as\nacting as the immediate superior for administrative purposes of\nexecutive-level officials, and any other functions established by the legal\norder that pertain to the matter.\n\nIV.-That the Ministry of Finance (Ministerio de Hacienda), in its capacity as Governing Body of the\nFinancial Administration System, and the Directorate General of Goods Administration\nand Procurement (Dirección General de Administración de Bienes y Contratación Administrativa) have been adjusting the use of\ncomputer systems supporting management, for the purpose of implementing digital\nsignatures and electronic documents, in accordance with the provisions of the Law on\nCertificates, Digital Signatures, and Electronic Documents, Law No. 8454, and its\nRegulation, to promote efficiency, effectiveness, and transparency.\n\nV.-That Article 28, subsections 1) and 2), sub-item a), of the General Public Administration Act (Ley General de la\nAdministración Pública) provides that the Minister is the highest hierarchical body\nof the respective Ministry, responsible for directing and coordinating all\nservices of the Ministry. Therefore:\n\nTHE MINISTER OF ENVIRONMENT AND ENERGY\n\nHEREBY AGREES:\n\nI.-To appoint the Donations Committee of the Ministry of\nEnvironment and Energy, which shall be composed of the officials occupying\nthe following positions: Official Mayor (Oficial Mayor) of MINAE or their representative, who\nshall preside, Institutional Supplier of MINAE, Coordinator of the\nInstitutional Asset Management Unit (Unidad de Administración de Bienes Institucionales) or their representative, who shall\nbe responsible for recommending donations at the institutional level, in accordance with\nthe provisions of article 25 of the Regulation for the Registration and Control of Assets of the\nCentral Administration, Executive Decree No. 40797-H.\n\nII.-The Donations Committee of MINAE shall have the following main functions:\nA) To be aware of the list of assets eligible for decommissioning by\ndonation. B) To select the recipient institution (institución donataria) from the Registry of\nInstitutions Eligible to Receive Donations (Registro de Instituciones Aptas para Recibir Donaciones, RIARD), maintained for these purposes by the Directorate\nGeneral of Goods Administration and Procurement (Dirección General de Administración de Bienes y Contratación Administrativa) of the\nMinistry of Finance. C) To recommend to the Ministerial Authority the institution\nselected for the respective donation, for the signing of the Donation\nRecord (Acta de la Donación).\n\nIII.-The Donations Committee of MINAE shall be convened to meet whenever its\nChairperson deems it necessary. The Committee's sessions may be\nin-person or virtual, according to their convenience. The respective documentation\nmay be signed physically or digitally, in accordance with the provisions of\nthe Law on Certificates, Digital Signatures, and Electronic Documents, Law No. 8454\nand its Regulation.\n\nIV.-It shall take effect upon its publication in the Official Gazette (Diario Oficial) La Gaceta.\n\nV.-Let it be published and communicated to the Directorate General of Administration\nof Goods and Procurement (Dirección General de Administración de Bienes y Contratación Administrativa) of the Ministry of\nFinance."
