San José, a\nlas quince horas con treinta y cinco minutos del día veintisiete de setiembre\nde dos mil veintidós.\n\nConoce esta Dirección General\nlos oficios Nos. DIGECA-OTO-050, DIGECA-OTO-070 y DIGECA-OTO-094, del\n01/04/2022, 23/06/2022 y 27/09/2022, suscritos por la Licda. Shirley Soto\nMontero, en su condición de Directora de la Dirección de Gestión de Calidad\nAmbiental (DIGECA), del Ministerio de Ambiente y Energía (MINAE), mediante el\ncual solicita a esta Dirección General de Aduanas la implementación de las\nNotas Técnicas N°0073 y N°0038 y exclusión de la Nota Técnica N°0038 a varias\nsustancias químicas, con fundamento en los compromisos asumidos por Costa Rica\na nivel internacional y la normativa nacional vigente que regula las sustancias\nquímicas que agotan la capa de ozono.\n\nCONSIDERANDO\n\n1. Que de conformidad con\nlos artículos 11 de la Ley General de Aduanas y 7 de su Reglamento, sus reformas\ny modificaciones vigentes, la Dirección General de Aduanas es el órgano\nsuperior jerárquico nacional en materia aduanera y dentro de sus funciones le\ncompete la coordinación de acciones con los Ministerios, órganos y demás entes\nrelacionados con el proceso aduanero, con el fin de armonizar las políticas\naduaneras.\n\n2. Que la Oficina Técnica\ndel Ozono (OTO) está adscrita a la Dirección General de Calidad Ambiental del\nMinisterio de Ambiente y Energía (MINAE) y entre otras funciones le corresponde\nimplementar mecanismos para la reducción gradual de Sustancias Agotadoras de la\nCapa de Ozono (SAO).\n\n3. Que mediante oficios Nos.\nDIGECA-OTO-050, DIGECA-OTO-070 y DIGECA-OTO-094, del 01/04/2022, 23/06/2022 y\n27/09/2022, suscritos por la Licda. Que mediante oficio DGT-DTA-151-2022\ndel 12/09/2022, el Departamento de Técnica Aduanera remite a la Dirección de\nGestión de Calidad Ambiental (DIGECA), del Ministerio de Ambiente y Energía\n(MINAE), la propuesta de las aperturas y asociación de incisos arancelarios a\nlas Notas Técnicas 0038 y 0073 para su respectiva valoración y aval.\n\n5. Que mediante oficio\nDIGECA-OTO-094, del 27/09/2022, la Licda. Shirley Soto Montero, en su condición\nde Directora de la Dirección de Gestión de Calidad Ambiental (DIGECA), da\nrespuesta a la solicitud, avalando las modificaciones a realizar en el Sistema\nInformático TICA y a la vez solicita que la implementación de la Nota Técnica\nN° 0038 sea aplicada únicamente en los Regímenes de Importación y Exportación y\nno al Régimen de Tránsito como originalmente se había solicitado.\n\nPOR TANTO\n\nCon fundamento en las\nconsideraciones de hecho y derecho de cita, potestades y demás atribuciones\naduaneras que otorgan los artículos 6 y 8 del Código Aduanero Uniforme\nCentroamericano IV, así como el artículo 5 de su Reglamento y los ordinales 6,\n9, 11 de la Ley General de Aduanas, Nº 7557 del 20 de octubre de 1995 y sus\nreformas, en uso de las facultades y atribuciones que le concede la legislación\nque regula la materia aduanera, EL DIRECTOR\nGENERAL DE ADUANAS RESUELVE:\n\n1. San José, at\nfifteen hours and thirty-five minutes on the twenty-seventh of September\nof two thousand twenty-two.\n\nThis General Directorate has received\nofficial communications Nos. DIGECA-OTO-050, DIGECA-OTO-070 and DIGECA-OTO-094, of\n01/04/2022, 23/06/2022 and 27/09/2022, signed by Licda. Shirley Soto\nMontero, in her capacity as Director of the Environmental Quality Management Directorate\n(DIGECA), of the Ministry of Environment and Energy (MINAE), by which\nshe requests this General Directorate of Customs to implement\nTechnical Notes No. 0073 and No. 0038 and to exclude Technical\nNote No. 0038 for various\nchemical substances, based on the commitments undertaken by Costa Rica\nat the international level and the current national regulations governing chemical\nsubstances that deplete the ozone layer.\n\nCONSIDERING\n\n1. That in accordance with\narticles 11 of the General Customs Law and 7 of its Regulations, its reforms\nand current modifications, the General Directorate of Customs is the higher\nhierarchical national body in customs matters and within its functions it\nis responsible for coordinating actions with the Ministries, bodies and other entities\nrelated to the customs process, in order to harmonize customs\npolicies.\n\n2. That the Technical Office\nof Ozone (OTO) is attached to the General Directorate of Environmental Quality of\nthe Ministry of Environment and Energy (MINAE) and among other functions, it is responsible\nfor implementing mechanisms for the gradual reduction of Ozone-Depleting Substances (ODS).\n\n3. That through official communications Nos.\nDIGECA-OTO-050, DIGECA-OTO-070 and DIGECA-OTO-094, of 01/04/2022, 23/06/2022 and\n27/09/2022, signed by Licda. That through official communication DGT-DTA-151-2022\nof 12/09/2022, the Department of Customs Technique sent to the\nEnvironmental Quality Management Directorate (DIGECA), of the Ministry of Environment and Energy\n(MINAE), the proposal for the tariff subheadings and association of tariff items\nto Technical Notes 0038 and 0073 for their respective assessment and endorsement.\n\n5. That through official communication\nDIGECA-OTO-094, of 27/09/2022, Licda. Shirley Soto Montero, in her capacity\nas Director of the Environmental Quality Management Directorate (DIGECA), responded\nto the request, endorsing the modifications to be made in the\nTICA Computer System and at the same time requesting that the implementation of Technical Note\nNo. 0038 be applied only in the Import and Export Regimes and\nnot to the Transit Regime as originally requested.\n\nTHEREFORE\n\nBased on the\nconsiderations of fact and law cited, powers and other customs\nauthorities granted by articles 6 and 8 of the Central American Uniform Customs Code\nIV, as well as article 5 of its Regulations and numerals 6,\n9, 11 of the General Customs Law, No. 7557 of October 20, 1995 and its\nreforms, in use of the faculties and authorities conferred by the legislation\ngoverning customs matters, THE GENERAL\nDIRECTOR OF CUSTOMS RESOLVES:\n\n1.
