Zona\nMarítimo Terrestre del 2 de marzo de 1977, con su respectivo reglamento y;\nartículos 2 y 3 de la ley N° 5695 Ley de Creación del Registro Nacional de\nfecha 28 de mayo de 1975 y sus reformas.\n\nConsiderando:\n\n1.-Que\nmediante ley Nº 8905 se establece el Instituto Geográfico Nacional, en adelante\nIGN, como una dependencia del Registro Nacional, quien suscribirá los contratos\ny convenios necesarios para el ejercicio de sus funciones. Asimismo, de\nconformidad con la ley N.º 59, el IGN es la dependencia científica y técnica\nrectora de la cartografía nacional, destinada a la ejecución del Mapa básico\noficial y la Descripción básica geográfica de la República de Costa Rica y a\nlos estudios, las investigaciones o labores y el desarrollo de políticas\nnacionales de carácter cartográfico, geográfico, geodésico, geofísico y de\níndole similar que tenga relación con dichas obras, con el fin de apoyar los\nprocesos de planificación.\n\n2.-Que la ley N° 59 constituye al IGN de\nmanera permanente y en representación del Estado, como la autoridad oficial en\nmateria geodésica y de la representación espacial de la geografía de la\nRepública de Costa Rica, extendiéndose su autoridad a las actividades de\ncualquier orden que tengan por origen los trabajos confiados a su cargo.\n\n3°-Que de conformidad con la ley N° 59; el\nartículo 62 del Decreto Ejecutivo N° 7841-P denominado: Reglamento a la Ley\nsobre la Zona Marítimo Terrestre se reconoce la competencia del IGN para la\ndelimitación de la zona pública de la Zona Marítimo Terrestre, y su\noficialización a través de publicación en el Diario Oficial La Gaceta; el\nartículo 63 del Decreto Ejecutivo N° 7841-P señala que El Instituto\nGeográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción\nde la zona marítimo-terrestre en que haya demarcado la zona pública.\n\n4°-Que en el Decreto Ejecutivo N°\n36642-MP-MOPT-MINAET \"Reglamento de Especificaciones para la Delimitación de la\nzona pública de la Zona Marítimo Terrestre\", se establece según el artículo 18°\nque para la delimitación de la zona pública de la Zona Marítimo Terrestre, el\nIGN podrá acudir a dos metodologías de ejecución, que se indican en los\nartículos 19 y 20, correspondientes a la delimitación de la zona pública de la\nZona Marítimo Terrestre a través de la colocación de mojones y/o a la\ndelimitación digital georreferenciada, esto con el fin de agilizar las\ndelimitaciones y proporcionar mayor seguridad técnica a los interesados.\n\n5°-Que en el Decreto Ejecutivo N°\n33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica\nNacional de Referencia Horizontal CR05, y su proyección cartográfica asociada\nCRTM05, como el sistema oficial al cual deben estar referidas las coordenadas\nde todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten\nen nuestro país, señalando específicamente en artículo 11 que: \"La Red\nGeodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección\ncartográfica CRTM05, constituirán el único sistema oficial de coordenadas para\nla República de Costa Rica a partir del cual se debe referenciar todos los\nlevantamientos y actividades cartográficos y geodésicos que desarrollen en el\nTerritorio Nacional toda dependencia pública, persona o entidad privada\nnacional o extranjera.\" ; mientras que el artículo 7 indica que \"Conforme se\nproduzcan datos cartográficos en el nuevo sistema de proyección cartográfica\nCRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella\ninformación que se ha oficializado.\"\n\n6.-Que el Decreto Ejecutivo Nº 40962-MJP Actualización\ndel Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara\nen su artículo 1 que El sistema geodésico de referencia horizontal oficial para\nCosta Rica, denominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), para la época de\nmedición 2014.59, y en adelante, los cambios y su actualización, se regirán de\nacuerdo a las nuevas definiciones del ITRF que se implementen en la red\ncontinental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS)\ndenominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de\nproyección cartográfica CRTM05 seguirá siendo el oficial para la representación\ncartográfica del territorio nacional continental, extendido para efectos de\naplicación de esta proyección cartográfica, hasta la línea de base del mar\nterritorial en el océano Pacífico y el mar Caribe, definida esta línea conforme\na los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el\nDerecho del Mar, como punto de partida para el cómputo de la anchura máxima de\ntodas las áreas marinas jurisdiccionales del Estado costarricense.\n\nPor su parte, el artículo 12 del decreto\nde cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el\nsistema nacional de coordenadas oficial a la cual se deben referenciar en el\nterritorio continental de nuestro país, al señalar que El sistema de\nreferencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05\npara el territorio continental extendido hasta la línea de base del mar\nterritorial y, la proyección cartográfica \"Universal Transversal de Mercator\"\n(UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el\nocéano Pacífico y el mar Caribe, constituirán el único sistema oficial de\ncoordenadas para la República de Costa Rica, a partir del cual, se deben\nreferenciar todos los levantamientos y actividades cartográficos y geodésicos\nque desarrollen en el territorio nacional toda dependencia pública, persona o\nentidad privada, nacional o extranjera, que emprendan o contraten trabajos\ngeodésicos y cartográficos, contribuyéndose a evitar el gasto público y\nobteniendo, por otra parte, información geográfica confiable, uniforme y\ncomparable, que sea de utilidad general y que apoye la toma de decisiones en los\ndistintos niveles del Estado.\n\n7.-Que la georreferenciación al sistema\nnacional de coordenadas como mecanismo para delimitar la zona pública de la\nZona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública\na los efectos de la elaboración de planes reguladores, el visado de planos de\nagrimensura, el otorgamiento de concesiones en la Zona Restringida y otros\naspectos de ordenamiento territorial costero.\n\n8°-Que la información digital\ngeorreferenciada sobre delimitación de la zona pública de la Zona Marítimo\nTerrestre con que cuenta el IGN, se le denomina Geodatabase Digital\nGeorreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona\nMarítimo Terrestre (ZMT).\n\n9.-Que la Geodatabase Digital\nGeorreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona\nMarítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la\nregulación establecida por: a) el Decreto Ejecutivo N° 7841-P \"Reglamento a la\nLey N° 6043 sobre la Zona Marítimo Terrestre\", b) el Decreto Ejecutivo N°\n33797-MJ-MOPT \"Declara como datum horizontal oficial para Costa Rica, el CR05,\ny su proyección cartográfica asociada, CRTM05\", y c) el Decreto Ejecutivo N°\n36642-MP-MOPT-MINAET \"Reglamento de Especificaciones para la Delimitación de la\nzona pública de la Zona Marítimo Terrestre\".\n\n10.-Que el artículo 16° de la Ley\nForestal, Ley N° 7575 del 13 de febrero de 1996, establece que el Ministerio\ndel Ambiente y Energía delimitará en el terreno los linderos de las áreas que\nconforman el Patrimonio Natural del Estado.\n\n11.-Que según el artículo 11 del CAPÍTULO\nI, Disposiciones Generales de la ley N° 6043, establece que la Zona pública\nes también, sea cual fuere su extensión, la ocupada por todos los manglares de\nlos litorales continentales e insulares y esteros del territorio nacional.\n\n12.-Que el Decreto Ejecutivo N°\n36786-MINAET titulado Manual para la clasificación de tierras dedicadas a la\nconservación de los recursos naturales dentro de la Zona Marítimo Terrestre en\nCosta Rica publicado en La Gaceta N° 217 del 11 de noviembre del 2011,\nestablece entre sus objetivos Identificar dentro de la Zona Marítimo Terrestre\naquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos\nClase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas\ncosteras, pantanos, bosques anegados, salitrales), para certificarlos e\nincorporarlos como parte del Patrimonio Natural del Estado (PNE).\n\n13°-Que el Decreto Ejecutivo N°\n36786-MINAET en el punto III.-Competencias para la delimitación y certificación\nestablece que La clasificación de los terrenos dentro de la ZMT corresponderá a\nlas Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación\n(SINAC) y a profesionales privados debidamente acreditados por los Colegios\nProfesionales respectivos para que clasifiquen los bosques, terrenos de aptitud\nforestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas,\nlagunas costeras, pantanos, bosques anegados, salitrales) y humedales.\n\nLa validez de los documentos de\nclasificación emitidos por profesionales privados quedará sujeta a la\naprobación que emita el AC que por competencia territorial le corresponda. A\nlas AC del SINAC con jurisdicción en la ZMT les competerá, además, la\nverificación, fiscalización, deslinde y certificación de las tierras del\nPatrimonio Natural del Estado y las zonas de protección. La ubicación y\ndelimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona\nMarítimo Terrestre, debe realizarse como parte del proceso de aprobación del\nPlan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan\nRegulador Costero es el instrumento de ordenamiento territorial, que define y\nubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de\nésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero\ndebe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en\nel área total a concesionar.\n\n14.-El IGN utilizó la metodología de\nLíneas Digitales Georreferenciadas, para delimitar la zona pública de la Zona\nMarítimo Terrestre del estero/manglar Tamarindo, en el distrito 09 Tamarindo,\ncantón 03 Santa Cruz, provincia: 05º Guanacaste.\n\n15.-Que el Parque Nacional Marino Las\nBaulas incluye dentro de sus límites el Estero Tamarindo, según lo establece la\nLey N° 7524. La determinación de los límites de esta área protegida fue objeto\nde análisis durante la ejecución del Proyecto de Regularización de Catastro y\nRegistro. Como parte de ese proceso, una comisión nombrada para tal fin elaboró\nel documento \"Informe Final Comisión Multidisciplinaria: Propuesta de Límites\ndel Parque Nacional Marino Las Baulas de Guanacaste\" con fecha 18 de octubre\ndel 2013.\n\n16.-Que los límites recomendados en el Informe\nFinal Comisión Multidisciplinaria: Propuesta de Límites del Parque Nacional\nMarino Las Baulas de Guanacaste, se encuentran oficializados mediante la\npublicación de la resolución del Consejo Nacional de Áreas de Conservación\nR-SINAC-CONAC- 29-2019, en el Diario Oficial La Gaceta N° 118 del 25 de\njunio 06 de 2019, Alcance 142.\n\n17.-Que la\ndelimitación cuenta con aval técnico interno conforme el informe de Revisión\nTécnica N° DIG-TOT-INF-0137-2022 del 26 de octubre de 2022, emitido por el\nSubproceso de Límites Oficiales del Departamento Topográfico y Observación del\nTerritorio del Instituto Geográfico Nacional. Likewise, in accordance with Law N.º 59, the IGN is the scientific and technical dependency governing national cartography, intended for the execution of the official basic Map and the basic geographical Description of the Republic of Costa Rica and for the studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.\n\n2.-That Law N° 59 constitutes the IGN permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any order originating from the work entrusted to its charge.\n\n3°-That in accordance with Law N° 59; Article 62 of Executive Decree N° 7841-P entitled: Regulation to the Law on the Maritime Terrestrial Zone recognizes the competence of the IGN for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta; Article 63 of Executive Decree N° 7841-P indicates that the National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\n\n4°-That in Executive Decree N° 36642-MP-MOPT-MINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\", it is established according to article 18° that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through digital georeferenced delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.\n\n5°-That in Executive Decree N° 33797-MJ-MOPT, which among other aspects determines the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically stating in article 11 that: \"The National Geodetic Horizontal Reference Network CR05 and the cartographic projection system CRTM05, shall constitute the sole official coordinate system for the Republic of Costa Rica from which all surveys and cartographic and geodetic activities developed within the National Territory by any public agency, person, or private national or foreign entity must be referenced.\"; while article 7 indicates that \"As cartographic data is produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish by appropriate means that information which has been made official.\"\n\n6.-That Executive Decree Nº 40962-MJP Update of the Official Horizontal Reference Geodetic System for Costa Rica declares in its article 1 that The official horizontal reference geodetic system for Costa Rica, denominated CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, the changes and updates shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) denominated SIRGAS-CON, while article 2 establishes that The cartographic projection system CRTM05 shall continue to be official for the cartographic representation of the continental national territory, extended for purposes of application of this cartographic projection, up to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined according to articles 5, 6 and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum width of all jurisdictional marine areas of the Costa Rican State.\n\nOn the other hand, article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which all work on the continental territory of our country must be referenced, by stating that The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended up to the baseline of the territorial sea and, the \"Universal Transverse Mercator\" (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities developed in the national territory by any public agency, private person or entity, national or foreign, that undertake or contract geodetic and cartographic work must be referenced, thereby contributing to avoiding public expenditure and obtaining, furthermore, reliable, uniform, and comparable geographic information, which is of general utility and supports decision-making at the different levels of the State.\n\n7.-That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone, enables the correct delimitation of the public zone for the purposes of elaborating regulatory plans (planes reguladores), the approval of surveying plans, the granting of concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal territorial planning.\n\n8°-That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is denominated the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n9.-That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree N° 7841-P \"Regulation to Law N° 6043 on the Maritime Terrestrial Zone\", b) Executive Decree N° 33797-MJ-MOPT \"Declares CR05, and its associated cartographic projection, CRTM05, as the official horizontal datum for Costa Rica\", and c) Executive Decree N° 36642-MP-MOPT-MINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\".\n\n10.-That article 16° of the Forest Law (Ley Forestal), Law N° 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall demarcate on the ground the boundaries of the areas that constitute the Natural Heritage of the State (Patrimonio Natural del Estado).\n\n11.-That according to article 11 of CHAPTER I, General Provisions of Law N° 6043, it establishes that the public zone (zona pública) is also, whatever its extension, that occupied by all mangroves (manglares) of the continental and insular coastlines and estuaries (esteros) of the national territory.\n\n12.-That Executive Decree N° 36786-MINAET titled Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica published in La Gaceta N° 217 of November 11, 2011, establishes among its objectives Identifying within the Maritime Terrestrial Zone those lands that classify as forests, of forest aptitude (soils Class VII and VIII), wetlands (mangroves, estuaries, rías, marshes, coastal lagoons, swamps, flooded forests, salt flats), to certify them and incorporate them as part of the Natural Heritage of the State (PNE).\n\n13°-That Executive Decree N° 36786-MINAET in point III.-Competencies for delimitation and certification establishes that The classification of lands within the ZMT shall be the responsibility of the Conservation Areas (AC) of the National System of Conservation Areas (SINAC) and of private professionals duly accredited by the respective Professional Colleges to classify the forests, lands of forest aptitude (soils Class VII and VIII), (mangroves, estuaries, rías, marshes, coastal lagoons, swamps, flooded forests, salt flats) and wetlands.\n\nThe validity of classification documents issued by private professionals shall be subject to the approval issued by the AC with corresponding territorial competence. The AC of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, oversight, demarcation (deslinde), and certification of the lands of the Natural Heritage of the State and the protection zones. The location and delimitation of the areas of the Natural Heritage of the State within the Maritime Terrestrial Zone, must be carried out as part of the approval process of the Coastal Regulatory Plan (PRC), defined by Law 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all zones to be concessioned within the ZMT and for the classification thereof at the level of cadastral plans. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas in order not to count them in the total area to be concessioned.\n\n14.-The IGN used the methodology of Georeferenced Digital Lines, to delimit the public zone of the Maritime Terrestrial Zone of the Tamarindo estuary/mangrove, in district 09 Tamarindo, canton 03 Santa Cruz, province: 05º Guanacaste.\n\n15.-That the Las Baulas National Marine Park includes within its limits the Tamarindo Estuary, as established by Law N° 7524. The determination of the limits of this protected area was the subject of analysis during the execution of the Cadastre and Registry Regularization Project. As part of that process, a commission appointed for this purpose prepared the document \"Final Report Multidisciplinary Commission: Proposed Limits for the Las Baulas National Marine Park of Guanacaste\" dated October 18, 2013.\n\n16.-That the limits recommended in the Final Report Multidisciplinary Commission: Proposed Limits for the Las Baulas National Marine Park of Guanacaste, were made official through the publication of the resolution of the National Council of Conservation Areas R-SINAC-CONAC- 29-2019, in the Official Gazette La Gaceta N° 118 of June 25, 2019, Alcance 142.\n\n17.-That the delimitation has internal technical endorsement according to the Technical Review report N° DIG-TOT-INF-0137-2022 of October 26, 2022, issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute.
