  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 244\n\n                        Reforma Reglamento para la solicitud y aprobación de torneos de pesca\ndeportiva - turística\n\nINSTITUTO COSTARRICENSE DE PESCA  Y ACUICULTURA\n\nAJDIP/244-2022.-Puntarenas,\na los cero uno días del mes de noviembre de dos mil veintidós.\n\nConsiderando:\n\n1º-Que\nmediante el Acuerdo AJDIP/073-2014, se establece el \"Reglamento para la\nsolicitud de realización de torneos de pesca deportiva - turística\".\n\n2º-Que\ndicho reglamento fue publicado en el Diario Oficial La Gaceta Nº.148 del\n04 de julio de 2014.\n\n3º-Que\nen el marco de la necesaria simplificación de trámites, resulta conveniente y\nsobre todo oportuno, el modificar el Acuerdo supra, buscando con ello\ngarantizar al administrado una mayor celeridad en cuanto a la atención y\ntramitación de sus solicitudes de aprobación de torneos de pesca deportiva y turística.\n\n4º-Que dentro de sus competencias y\natribuciones, la Junta Directiva tiene la facultad y potestad de asignar su\norganización y funcionamiento a las Comisiones que constituya, en el ámbito de\nlas competencias asignadas a cada una de ellas.\n\n5º-Que\nen ese sentido, conjuntamente con la constitución de la Comisión Nacional de\nPesca Deportiva - Turística, se estableció, mediante el Acuerdo AJDIP/073-2014,\nel mecanismo reglamentario para la tramitación de las solicitudes de\nrealización de torneos de pesca deportiva - turística.\n\n6º-Que\nhabiéndose analizado dicho reglamento en concordancia con los considerandos\nprecedentes; estiman los señores miembros de Junta Directiva, la necesidad de\nmodificar el Acuerdo AJDIP/073-2014, a fin de darle una mayor agilidad, no solo\na las resoluciones de solicitudes de realización de los diversos torneos de\npesca deportiva - turística; sino de legitimar y reconocer las acciones\nemanadas del seno de la Comisión Nacional de Pesca Deportiva - Turística, por\nlo que la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por\ntanto;\n\nACUERDA:\n\n1º-Modificar\nel Acuerdo AJDIP/073-2014, denominado \"Reglamento para la solicitud de\nrealización de torneos de pesca deportiva - turística\", de la siguiente\nmanera:\n\na)\nSe modifica el Por Tanto 1.-, del título del Reglamento, para que en lo\nsucesivo se lea: \"Reglamento para la solicitud y aprobación de torneos de\npesca deportiva - turística\".\n\nb)\nModificar el por tanto 3.-; para que se lea correctamente: \"Corresponde al\nINCOPESCA el control de la actividad pesquera en aguas marinas interiores y\nexteriores y agua dulce, por lo cual antes de realizarse un torneo de pesca,\ndeberá tramitarse ante la Comisión Nacional de Pesca Deportiva Turística, la\nsolicitud de autorización del torneo, con al menos un mes calendario de\nanticipación. En caso del recurso de revocatoria le corresponderá a la Presidencia\nEjecutiva, su resolución; en tratándose de recurso de apelación, será la Junta\nDirectiva quien en definitiva resuelva.   "body_en_text": "of the entire text\n\n                    -\n\n                        Full Text of Standard 244\n\n                        Amendment to the Regulation for requesting and approving sport-tourist fishing tournaments\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nAJDIP/244-2022.-Puntarenas,\non the first day of November of two thousand twenty-two.\n\nWhereas:\n\n1º-That\nby Agreement AJDIP/073-2014, the \"Regulation for requesting sport-tourist fishing tournaments\" is established.\n\n2º-That\nsaid regulation was published in the Official Gazette La Gaceta No. 148 of\nJuly 4, 2014.\n\n3º-That\nwithin the framework of the necessary simplification of procedures, it is convenient and,\nabove all, timely to modify the above-mentioned Agreement, thereby seeking to\nguarantee the administered party greater speed in the attention and\nprocessing of their requests for approval of sport and tourist fishing tournaments.\n\n4º-That within its competencies and\npowers, the Board of Directors has the authority and power to assign its\norganization and functioning to the Commissions it constitutes, within the scope of\nthe competencies assigned to each of them.\n\n5º-That\nin this sense, jointly with the constitution of the National Commission for Sport-Tourist Fishing, the regulatory mechanism for processing requests for\nsport-tourist fishing tournaments was established through Agreement AJDIP/073-2014.\n\n6º-That\nhaving analyzed said regulation in accordance with the preceding whereas clauses,\nthe members of the Board of Directors consider it necessary\nto modify Agreement AJDIP/073-2014, in order to provide greater agility, not only\nto the resolutions of requests for holding the various sport-tourist fishing tournaments,\nbut also to legitimize and recognize the actions\nemanating from within the National Commission for Sport-Tourist Fishing.\nTherefore, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture,\nTherefore;\n\nAGREES:\n\n1º-To modify\nAgreement AJDIP/073-2014, called \"Regulation for requesting\nsport-tourist fishing tournaments\", in the following\nmanner:\n\na)\nThe Therefore 1.-, of the title of the Regulation, is modified so that henceforth it reads: \"Regulation for requesting and approving sport-tourist fishing tournaments\".\n\nb)\nTo modify therefore 3.-; so that it correctly reads: \"INCOPESCA is responsible for controlling fishing activity in interior and exterior marine waters and fresh water; therefore, before a fishing tournament is held,\nthe request for authorization of the tournament must be processed before the National Commission for Sport-Tourist Fishing,\nat least one calendar month in\nadvance. The National Commission for Sport-Tourist Fishing, once\nthe request is acknowledged and it complies with the provisions and requirements\nestablished in this regulation, shall proceed to forward said request\nwith the respective recommendation for approval or denial, at least\ntwenty-two days in advance of the date scheduled for the tournament's celebration, to the Executive Presidency, who shall make the final decision, as\nappropriate, and may justifiably depart from the recommendation issued\nby the Commission. The Executive Presidency must resolve every request for\nsport-tourist fishing tournaments forwarded to it, at least\nfifteen days in advance of the date scheduled for the tournament's celebration.\nIn those cases where the Executive Presidency, based on\ntechnical, legal, or opportunity criteria, denies the approval of a\nsport fishing tournament, the administered party, in accordance with the provisions of\nTitle Eight, Chapter One of the General Public Administration Law,\nLaw 6227, may file an appeal for reversal or an appeal for review, or\nboth. In the case of an appeal for reversal, its resolution shall correspond to the Executive Presidency; in the case of an appeal for review, it shall be the\nBoard of Directors that makes the final decision. The decision by the Board of Directors shall not be subject to further appeal, thus exhausting the\nadministrative process.\n\nc)\nTo modify the final paragraph of therefore 4º, so that it correctly reads:\n\"The tournament organizer must submit to the Executive Presidency, a\nreport of the event results, as well as a copy of the respective\npermits, which it shall forward to the Department of Fisheries Statistics and\nto the Directorate of Fisheries and Aquaculture Management, for matters within their\ncompetencies.\"\n\n2º-Publish.
