  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 247\n\n                        Reforma Reglamento para el seguimiento, control y vigilancia de\nembarcaciones pesqueras de las flotas nacional y extranjera\n\nINSTITUTO COSTARRICENSE DE\nPESCA  Y ACUICULTURA\n\n(Esta norma se dejó sin efecto por acuerdo N° AJDIP/031-2023 del 21 de febrero de 2023)\n\nAJDIP/247-2022.-Puntarenas, a los nueve días del mes de\nnoviembre de dos mil veintidós.\n\nConsiderando:\n\n1º-Que mediante el\nacuerdo AJDIP/077-2020 se aprobó por parte de Junta Directiva el \"REGLAMENTO PARA EL\nSEGUIMIENTO, CONTROL Y VIGILANCIA DE EMBARCACIONES PESQUERAS DE LAS FLOTAS\nNACIONAL Y EXTRANJERA\".\n\n2º-Que el acuerdo AJDIP/077-2020, fue modificado por\nmedio del Acuerdo AJDIP/076-2022, con el objetivo de contar con un acuerdo que\narmonice y reglamente las medidas sobre seguimiento control y vigilancia de las\nembarcaciones de la flota pesquera nacional y extranjera, además de solventar\nuna serie de vacíos que se presentaban en algunas normativas, a la luz de las\nnuevas regulaciones y disponibilidad de tecnologías. Estableciéndose dentro de\notros aspectos en su Transitorio II: \"Para las embarcaciones de Pesca\nDeportiva y Turística, el presente reglamento será aplicable seis meses después\nde su entrada en vigencia\".\n\n3º-Que se recibe solicitud de prórroga por parte de la\nAsociación Nacional de Operadores de Transportes Acuáticos de Quepos (ANOTA),\nfundamentada principalmente en las dificultades económicas que ha representado\npara el sector el afrontar las consecuencias generadas en el contexto de la\npandemia del Covid-19, así como, para llevar a cabo las coordinaciones que\nimplica la implementación de las balizas, en cuanto a la instalación de equipos\ny software.\n\n4º-Que en base a lo solicitado y habiendo realizado el\nanálisis técnico y socioeconómico que implica el tema, mediante oficio\nINCOPESCA-PE-DOPA-126-2022, se recomienda por parte de la Dirección de\nOrdenamiento Pesquero y Acuícola, así como, el Departamento de Extensión\nPesquera y Acuícola, se proceda con la prórroga solicitada, con el fin de\nextender el plazo de obligatoriedad de uso e instalación de la baliza satelital\npara las embarcaciones de Pesca Deportiva y Turística.\n\n5º-Que, debidamente analizada la modificación propuesta y\npor considerarla procedente, la Junta Directiva del Instituto Costarricense de\nPesca y Acuicultura, Por tanto;\n\nACUERDA\n\n1º-Aprobar la solicitud de prórroga solicitada y\nmodificar el acuerdo de Junta Directiva del Instituto Costarricense de Pesca y\nAcuicultura AJDIP/076-2022, en su Transitorio II, para que en lo sucesivo se lea\nde la siguiente manera:\n\nTransitorio II:\n\"Para las embarcaciones de Pesca Deportiva y Turística, el presente\nreglamento será aplicable a partir del día martes 28 de febrero del año\n2023\".  \n\n(Nota de Sinalevi:\nMediante acuerdo N° AJDIP/030-2023 del 7 de febrero del 2023 se establece lo\nsiguiente: \" Que en relación a lo dispuesto en el Acuerdo de Junta\nDirectiva AJDIP/247-2022, el mismo será aplicable únicamente para las\nembarcaciones de mediana escala de la Pesca Turística y Deportiva, para las\ncuales lo establecido en dicho acuerdo empezará a regir a partir del 28 de\nfebrero del año 2023\")",
  "body_en_text": "in the entirety of the text\n\n-\n\nComplete Text of Regulation 247\n\nReform Regulation for the monitoring, control and surveillance of fishing vessels of the national and foreign fleets\n\nINSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA\n\n(This regulation was rendered without effect by agreement N° AJDIP/031-2023 of February 21, 2023)\n\nAJDIP/247-2022.-Puntarenas, on the ninth day of November of two thousand twenty-two.\n\nConsidering:\n\n1º-That through agreement AJDIP/077-2020, the Board of Directors approved the \"REGLAMENTO PARA EL SEGUIMIENTO, CONTROL Y VIGILANCIA DE EMBARCACIONES PESQUERAS DE LAS FLOTAS NACIONAL Y EXTRANJERA\".\n\n2º-That agreement AJDIP/077-2020 was amended by means of Agreement AJDIP/076-2022, with the objective of having an agreement that harmonizes and regulates the measures for the monitoring, control and surveillance of vessels of the national and foreign fishing fleet, in addition to resolving a series of gaps present in some regulations, in light of new regulations and technology availability. Establishing, among other aspects, in its Transitory Provision II: \"For Sport and Tourism Fishing vessels, this regulation shall be applicable six months after its entry into force\".\n\n3º-That a request for an extension was received from the Asociación Nacional de Operadores de Transportes Acuáticos de Quepos (ANOTA), based mainly on the economic difficulties the sector has faced in dealing with the consequences generated in the context of the Covid-19 pandemic, as well as to carry out the coordination involved in implementing the beacons (balizas), regarding the installation of equipment and software.\n\n4º-That based on the request and having carried out the technical and socioeconomic analysis the matter implies, through official communication INCOPESCA-PE-DOPA-126-2022, the Dirección de Ordenamiento Pesquero y Acuícola, as well as the Departamento de Extensión Pesquera y Acuícola, recommend proceeding with the requested extension, in order to extend the mandatory use and installation deadline for the satellite beacon (baliza satelital) for Sport and Tourism Fishing vessels.\n\n5º-That, the proposed amendment having been duly analyzed and deemed appropriate, the Board of Directors of the Instituto Costarricense de Pesca y Acuicultura, Therefore;\n\nAGREES\n\n1º-To approve the requested extension and amend the agreement of the Board of Directors of the Instituto Costarricense de Pesca y Acuicultura AJDIP/076-2022, in its Transitory Provision II, so that henceforth it reads as follows:\n\nTransitory Provision II: \"For Sport and Tourism Fishing vessels, this regulation shall be applicable as of Tuesday, February 28, 2023\".\n\n(Note from Sinalevi: Through agreement N° AJDIP/030-2023 of February 7, 2023, the following is established: \"That in relation to the provisions of Board of Directors Agreement AJDIP/247-2022, the same shall be applicable only to medium-scale vessels of Tourism and Sport Fishing, for which the provisions of said agreement shall take effect as of February 28, 2023\")"
