Asimismo, de conformidad con la Ley Nº 59, el IGN es la\ndependencia científica y técnica rectora de la cartografía nacional, destinada\na la ejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el\ndesarrollo de políticas nacionales de carácter cartográfico, geográfico,\ngeodésico, geofísico y de índole similar que tenga relación con dichas obras,\ncon el fin de apoyar los procesos de planificación.\n\n2°-Que la Ley Nº 59 constituye al IGN de manera permanente y en\nrepresentación del Estado, como la autoridad oficial en materia geodésica y de\nla representación espacial de la geografía de la República de Costa Rica,\nextendiéndose su autoridad a las actividades de cualquier orden que tengan por\norigen los trabajos confiados a su cargo.\n\n3°-Que de conformidad con la Ley Nº 59; el artículo 62 del Decreto\nEjecutivo N° 7841-P denominado Reglamento a la Ley sobre la Zona Marítimo\nTerrestre se reconoce la competencia del IGN para la delimitación de la zona\npública de la Zona Marítimo Terrestre, y su oficialización a través de\npublicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto\nEjecutivo N° 7841-P señala que el Instituto Geográfico Nacional deberá publicar\naviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en\nque haya demarcado la zona pública.\n\n4°-Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre, se establece según el artículo 18 que para la delimitación de la\nzona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos\nmetodologías de ejecución, que se indican en los artículos 19 y 20,\ncorrespondientes a la delimitación de la zona pública de la Zona Marítimo\nTerrestre a través de la colocación de mojones y/o a la delimitación digital\ngeorreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar\nmayor seguridad técnica a los interesados.\n\n5°-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa\nRica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio\nInternacional de Rotación de la Tierra (IERS) para la época de medición 2005.83, el cual entre otros\naspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección\ncartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas\nde todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país,\nseñalando específicamente en artículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal\nCR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de\ncoordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los\nlevantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional\ntoda dependencia pública, persona o entidad privada nacional o extranjera.\" ; mientras que el\nartículo 7 indica que \"Conforme se produzcan datos cartográficos en el nuevo sistema de proyección\ncartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella\ninformación que se ha oficializado.\"\n\n6°-Que el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema\nGeodésico de Referencia Horizontal Oficial para Costa Rica declara en su\nartículo 1 que El sistema geodésico de referencia horizontal oficial para Costa\nRica, denominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), para la época de\nmedición 2014.59, y en adelante, los cambios y su actualización, se regirán de\nacuerdo a las nuevas definiciones del ITRF que se implementen en la red\ncontinental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS)\ndenominada SIRGAS-CON; mientras que el artículo 2 establece que El sistema de\nproyección cartográfica CRTM05 seguirá siendo el oficial para la representación\ncartográfica del territorio nacional continental, extendido para efectos de\naplicación de esta proyección cartográfica, hasta la línea de base del mar\nterritorial en el océano Pacífico y el mar Caribe, definida esta línea conforme\na los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el\nDerecho del Mar, como punto de partida para el cómputo de la anchura máxima de\ntodas las áreas marinas jurisdiccionales del Estado costarricense.\n\nPor su parte, el artículo 12 del decreto de cita, refuerza la aplicación de\nla proyección cartográfica CRTM05 como el sistema nacional de coordenadas\noficial a la cual se deben referenciar en el territorio continental de nuestro\npaís, al señalar que El sistema de referencia horizontal CRSIRGAS y su\nproyección cartográfica asociada CRTM05 para el territorio continental\nextendido hasta la línea de base del mar territorial y, la proyección\ncartográfica \"Universal Transversal de Mercator\"\n(UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el\nocéano Pacífico y el mar Caribe, constituirán el único sistema oficial de\ncoordenadas para la República de Costa Rica, a partir del cual, se deben\nreferenciar todos los levantamientos y actividades cartográficos y geodésicos\nque desarrollen en el territorio nacional toda dependencia pública, persona o\nentidad privada, nacional o extranjera, que emprendan o contraten trabajos\ngeodésicos y cartográficos, contribuyéndose a evitar el gasto público y\nobteniendo, por otra parte, información geográfica confiable, uniforme y\ncomparable, que sea de utilidad general y que apoye la toma de decisiones en\nlos distintos niveles del Estado.\n\n7°-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n8°-Que la información digital georreferenciada\nsobre delimitación de la\nzona pública de la Zona Marítimo\nTerrestre con que cuenta el\nIGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto\nGeográfico Nacional (IGN) sobre\nla Zona Marítimo Terrestre\n(ZMT).\n\n9°-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre\nla Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación\nestablecida por: a) el Decreto Ejecutivo N° 7841-P Reglamento a la Ley N° 6043 sobre la Zona\nMarítimo Terrestre, b) el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial\npara Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05, y c) el Decreto Ejecutivo\nN° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la\nZona Marítimo Terrestre.\n\n10.-Que el artículo 16 de la Ley Forestal, Ley N° 7575 del 13 de febrero de\n1996 y sus reformas, establece que el Ministerio del Ambiente y Energía\ndelimitará en el terreno los linderos de las áreas que conforman el Patrimonio\nNatural del Estado.\n\n11.-Que según el artículo 11 del Capítulo I, Disposiciones Generales de la\nLey N° 6043, establece que la Zona pública es también, sea cual fuere su\nextensión, la ocupada por todos los manglares de los litorales continentales e\ninsulares y esteros del territorio nacional.\n\n12.-Que el Decreto Ejecutivo N° 36786-MINAET Manual para la clasificación\nde tierras dedicadas a la conservación de los recursos naturales dentro de la\nZona Marítimo Terrestre en Costa Rica, publicado en La Gaceta Nº 217 del\n11 de noviembre del 2011, establece entre sus objetivos Identificar dentro de\nla Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de\naptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros,\nrías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para\ncertificarlos e incorporarlos como parte del Patrimonio Natural del Estado\n(PNE).\n\n13.-Que el Decreto Ejecutivo N° 36786-MINAET en el punto III.-Competencias\npara la delimitación y certificación establece que La clasificación de los\nterrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del\nSistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados\ndebidamente acreditados por los Colegios Profesionales respectivos para que\nclasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y\nVIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques\nanegados, salitrales) y humedales.\n\nLa validez de los documentos de clasificación emitidos por profesionales privados\nquedará sujeta a la aprobación que emita el AC que por competencia territorial\nle corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá,\nademás, la verificación, fiscalización, deslinde y certificación de las tierras\ndel Patrimonio Natural del Estado y las zonas de protección.\n\nLa ubicación y delimitación de las áreas del Patrimonio Natural del Estado\ndentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de\naprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que\nel Plan Regulador Costero es el instrumento de ordenamiento territorial, que\ndefine y ubica todas las zonas a concesionar dentro de la ZMT y para la\nclasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador\nCostero debe indicar clara y expresamente, las áreas del PNE para no\ncontabilizarlas en el área total a concesionar.\n\n14.-A solicitud de parte de Philip W. Fite, (único apellido), cédula número 184000829316, el Área de\nConservación Tempisque, de Sistema de Áreas de Conservación lleva a cabo el proceso de demarcación\nen campo del área de manglar para la delimitación del manglar en Estero Cosechas cerca de la Playa\nJunquillal, ubicado en el distrito 03° Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º\nGuanacaste.\n\n15.-El IGN utilizó la metodología de Delimitación de Mojones\nGeorreferenciados, para delimitar la zona pública de la Zona Marítimo Terrestre\ndel estero-manglar Cosechas, en el distrito 03° Veintisiete de Abril, cantón\n03° Santa Cruz, provincia 05º Guanacaste.\n\n16.-Que la delimitación cuenta con aval técnico interno conforme el informe\nde Revisión Técnica N° DIG-TOT-INF-0145-2022 del 14 de noviembre de 2022,\nemitido por el Subproceso de Límites Oficiales del Departamento Topográfico y\nObservación del Territorio del Instituto Geográfico Nacional.   "body_en_text": "of the entire text\n\n                    -\n\n                        Full Text of Norm 011\n\n                        Delimitation of a public zone sector corresponding to the Cosechas estuary-mangrove\ndistrict 03 Veintisiete de Abril, canton 03 Santa Cruz, province 05 Guanacaste\n\nINSTITUTO GEOGRÁFICO NACIONAL\n\nDEPARTAMENTO TOPOGRÁFICO\n\nY OBSERVACIÓN DEL TERRITORIO\n\nNOTICE No. 011-2022\n\nZONA MARÍTIMO TERRESTRE\n\nDELIMITATION OF A PUBLIC ZONE SECTOR\n\nCORRESPONDING TO THE COSECHAS ESTUARY-MANGROVE\n\nDISTRICT 03º VEINTISIETE DE ABRIL,\n\nCANTON 03º SANTA CRUZ,\n\nPROVINCE 05º GUANACASTE\n\nBased on the provisions of articles 140 and 240 of Law No. 6227, the General Public Administration Law of May 2, 1978 and its amendments; Law No. 59, the Law of Creation and Organization of the Instituto Geográfico Nacional of July 4, 1944 and its amendments; Law No. 8905, Reform of Article 2 of Law No. 5695, Creation of the National Registry, and its amendments; and amendment of Law No. 59, Creation and Organization of the Instituto Geográfico Nacional, of July 4, 1944, and its amendments of December 7, 2010; Law No. 6043, the Law on the Zona Marítimo Terrestre of March 2, 1977, with its respective regulation; and articles 2 and 3 of Law No. 5695, the Law of Creation of the National Registry of May 28, 1975 and its amendments.\n\nConsidering:\n\n1º—That Law No. 8905 establishes the Instituto Geográfico Nacional, hereinafter IGN, as a dependency of the National Registry, which shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical agency governing national cartography, destined for the execution of the official Basic Map and the basic geographic description of the Republic of Costa Rica, and for studies, research, or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.\n\n2º—That Law No. 59 permanently constitutes the IGN, on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, extending its authority to activities of any order that originate from the work entrusted to its charge.\n\n3º—That in accordance with Law No. 59, and Article 62 of Decreto Ejecutivo N° 7841-P denominated \"Reglamento a la Ley sobre la Zona Marítimo Terrestre,\" the competence of the IGN for the delimitation of the public zone of the Zona Marítimo Terrestre is recognized, and its officialization through publication in the Diario Oficial La Gaceta; Article 63 of Decreto Ejecutivo N° 7841-P indicates that the Instituto Geográfico Nacional must publish a notice in the Diario Oficial for each portion of the Zona Marítimo Terrestre in which it has demarcated the public zone.\n\n4º—That in Decreto Ejecutivo N° 36642-MP-MOPT-MINAET, \"Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre,\" it is established according to Article 18 that for the delimitation of the public zone of the Zona Marítimo Terrestre, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Zona Marítimo Terrestre through the placement of markers (mojones) and/or georeferenced digital delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.\n\n5º—That Decreto Ejecutivo N° 33797-MJ-MOPT declares CR05 as the official horizontal datum for Costa Rica, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for measurement epoch 2005.83, which, among other aspects, determines the Red Geodésica Nacional de Referencia Horizontal CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: \"The Red Geodésica Nacional de Referencia Horizontal CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, based on which all cartographic and geodetic surveys and activities developed in the National Territory by any public agency, person, or national or foreign private entity must be referenced.\"; while Article 7 indicates that \"As cartographic data is produced in the new CRTM05 cartographic projection system, the Instituto Geográfico Nacional shall publish, through appropriate means, that information which has been made official.\"\n\n6º—That Decreto Ejecutivo Nº 40962-MJP, \"Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica,\" declares in its Article 1 that the official horizontal geodetic reference system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08) for measurement epoch 2014.59, and henceforth, changes and its updating shall be governed according to the new ITRF definitions implemented in the continental network of the Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominated SIRGAS-CON; while Article 2 establishes that the CRTM05 cartographic projection system shall continue to be the official one for the cartographic representation of the continental national territory, extended for the purposes of applying this cartographic projection to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum width of all jurisdictional marine areas of the Costa Rican State.\n\nSimilarly, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which referencing must be made in the continental territory of our country, by indicating that the CRSIRGAS horizontal reference system and its associated CRTM05 cartographic projection for the continental territory extended to the baseline of the territorial sea, and the \"Universal Transverse Mercator\" (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, based on which all cartographic and geodetic surveys and activities developed in the national territory by any public agency, person, or private entity, national or foreign, that undertake or contract geodetic and cartographic work must be referenced, thereby contributing to avoiding public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information that is of general utility and supports decision-making at the various levels of the State.\n\n7º—That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Zona Marítimo Terrestre enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, endorsing cadastral survey plans, granting concessions in the restricted zone (Zona Restringida), and other aspects of coastal land-use planning.\n\n8º—That the georeferenced digital information on the delimitation of the public zone of the Zona Marítimo Terrestre held by the IGN is called the Geodatabase Digital Georreferenciada (GDG) of the Instituto Geográfico Nacional (IGN) on the Zona Marítimo Terrestre (ZMT).\n\n9º—That the Geodatabase Digital Georreferenciada (GDG) of the Instituto Geográfico Nacional (IGN) on the Zona Marítimo Terrestre (ZMT) is technically based on the application of the regulation established by: a) Decreto Ejecutivo N° 7841-P, \"Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre,\" b) Decreto Ejecutivo N° 33797-MJ-MOPT \"Declares CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05,\" and c) Decreto Ejecutivo N° 36642-MP-MOPT-MINAET, \"Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre.\"\n\n10.—That Article 16 of the \"Ley Forestal,\" Law No. 7575 of February 13, 1996 and its amendments, establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that constitute the Patrimonio Natural del Estado.\n\n11.—That according to Article 11 of Chapter I, General Provisions of Law No. 6043, the public zone (Zona pública) is also, whatever its extension, that occupied by all mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory.\n\n12.—That Decreto Ejecutivo N° 36786-MINAET, \"Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica,\" published in La Gaceta No. 217 of November 11, 2011, establishes among its objectives Identifying within the Zona Marítimo Terrestre those lands that classify as forests, of forest aptitude (Class VII and VIII soils), wetlands (mangroves, estuaries (esteros), rías, marshes, coastal lagoons, swamps, flooded forests, salt flats), to certify them and incorporate them as part of the Patrimonio Natural del Estado (PNE).\n\n13.—That Decreto Ejecutivo N° 36786-MINAET, in point III.-Competencies for delimitation and certification, establishes that the classification of lands within the ZMT shall correspond to the Conservation Areas (Áreas de Conservación, AC) of the Sistema Nacional de Áreas de Conservación (SINAC) and to private professionals duly accredited by the respective Professional Associations to classify forests, lands of forest aptitude (Class VII and VIII soils), (mangroves, estuaries (esteros), rías, marshes, coastal lagoons, swamps, flooded forests, salt flats), and wetlands.\n\nThe validity of classification documents issued by private professionals shall be subject to the approval issued by the AC that corresponds by territorial competence. The ACs of SINAC with jurisdiction in the ZMT are also responsible for the verification, oversight, demarcation (deslinde), and certification of lands belonging to the Patrimonio Natural del Estado and protection zones.\n\nThe location and delimitation of areas of the Patrimonio Natural del Estado within the Zona Marítimo Terrestre must be carried out as part of the approval process for the Plan Regulador Costero (PRC), defined by Law 6043, since the Plan Regulador Costero is the territorial planning instrument that defines and locates all areas to be concessioned within the ZMT and for its classification at the cadastral map level. Therefore, the Plan Regulador Costero must clearly and expressly indicate the PNE areas so as not to count them in the total area to be concessioned.\n\n14.—At the request of Philip W. Fite, (sole surname), ID number 184000829316, the Área de Conservación Tempisque, of the System of Conservation Areas, carries out the process of field demarcation of the mangrove area for the delimitation of the mangrove in Estero Cosechas near Playa Junquillal, located in district 03° Veintisiete de Abril, canton 03º Santa Cruz, province 05º Guanacaste.\n\n15.—The IGN used the methodology of Delimitation by Georeferenced Markers (Delimitación de Mojones Georreferenciados) to delimit the public zone of the Zona Marítimo Terrestre of the Cosechas estuary-mangrove (estero-manglar), in district 03° Veintisiete de Abril, canton 03° Santa Cruz, province 05º Guanacaste.\n\n16.—That the delimitation has internal technical endorsement according to Technical Review Report No. DIG-TOT-INF-0145-2022 of November 14, 2022, issued by the Official Limits Sub-Process of the Departamento Topográfico y Observación del Territorio of the Instituto Geográfico Nacional.
