desarrollo de las funciones\ny disposiciones que asignan a la institución la Ley N° 7319 y su Reglamento,\nDecreto Ejecutivo N° 22266-J.\n\nII.-Que, para el eficiente cumplimiento de las atribuciones y competencias\ndel órgano, la Defensora de los Habitantes tiene la potestad organizar la\ninstitución y adoptar las medidas administrativas que sean necesarias para\ngarantizar el cumplimiento de los principios constitucionales de continuidad,\nregularidad, eficiencia y adaptación a los cambios de la gestión pública,\ndentro de las cuales se encuentra el nombramiento, la autorización de\nsuplencias y el recargo de funciones que se requiera.\n\nIII.-Que la Defensoría de los Habitantes tiene como atribución legal\ngeneral la protección y defensa de los derechos e intereses de los habitantes,\na partir de la casuística que ingresa a la institución a través de las quejas\ninterpuestas por estos, así como también a través de investigaciones de oficio\nque la institución considere necesario realizar en temas de alta complejidad,\nde interés y relevancia nacional.\n\nIV.-Que las actuaciones de la Defensoría de los Habitantes deben estar\ndebidamente fundamentadas en criterios técnicos y sus informes y recomendaciones\napegados a principios, normas y valores que integran el bloque de juridicidad\ndel ordenamiento jurídico costarricense y el marco de convencionalidad de\ntutela de los derechos humanos.\n\nV.-Que desde 1992, los países adscritos al sistema de las Naciones Unidas\nreconocieron que los cambios del clima de la Tierra y sus efectos adversos son\nuna preocupación común de toda la humanidad y manifestaron su preocupación por\nque las actividades humanas han ido aumentando sustancialmente las concentraciones\nde gases de efecto invernadero en la atmósfera, y porque ese aumento\nintensifica el efecto invernadero natural, lo cual da como resultado, en\npromedio, un calentamiento adicional de la superficie y la atmósfera de la\nTierra.\n\nVI.-Que el Grupo Intergubernamental de Expertos sobre el Cambio Climático (IPCC, por sus siglas en\ninglés), ha confirmado de manera inequívoca en sus informes que el cambio climático es real y que su\nprincipal causa son las emisiones de gases de efecto invernadero producto de la actividad humana,\nentre cuyas repercusiones adversas se encuentran: la mayor frecuencia de fenómenos meteorológicos\nextremos y desastres naturales, el aumento del nivel del mar, las inundaciones, olas de calor,\nsequías, la desertización, la escasez de agua, y la propagación de enfermedades tropicales y de\ntransmisión por vectores.\n\nVII.-Que la Oficina del Alto Comisionado de Naciones Unidas para los\nDerechos Humanos (ACNUDH) ha indicado que los fenómenos generados por el cambio\nclimático amenazan directa e indirectamente al disfrute pleno y efectivo de una\nserie de derechos humanos por parte de personas de todo el mundo, incluidos los\nderechos a la vida, el agua potable y el saneamiento, los alimentos, la salud,\nla vivienda, la autodeterminación, la cultura, el trabajo y desarrollo.\n\nVIII.-Que la Defensoría de los Habitantes de Costa Rica es la Institución\nNacional de Derechos de Costa Rica (INDH) y forma parte de la Alianza Global de\nInstituciones Nacionales de Derechos Humanos (GANHRI), la cual reúne a más de 110\nINDH de todo el mundo.\n\nIX.-Que las instituciones nacionales de derechos humanos, en la Conferencia\nAnual de la GANHRI sobre el cambio climático: el papel de las instituciones\nnacionales de derechos humanos, celebrada el 4 de diciembre de 2020,\nsuscribieron una declaración en la que manifiestan que \"el cambio\nclimático y sus efectos son uno de los mayores desafíos hoy en día y afectan\ndirecta e indirectamente al pleno disfrute de los derechos humanos, en\nparticular los derechos sociales, económicos y culturales, así como los\nderechos civiles y políticos, el derecho al desarrollo y el derecho a un\nambiente saludable\".\n\nX.-Que en la declaración de la Conferencia Anual de la GANHRI sobre el\ncambio climático, las INDH, incluida la Defensoría de los Habitantes, se\ncomprometieron a contribuir con los esfuerzos de acción climática de acuerdo\ncon las obligaciones de derechos humanos y los principios de no discriminación\ny participación, a actuar como puente y proporcionar una plataforma de\nintercambio entre los responsables de la formulación de políticas, la sociedad\ncivil y otras partes interesadas, incluida la población y los grupos más\nafectados por el cambio climático y la degradación ambiental, y a participar,\nincluso colectivamente a través de las redes GANHRI e INDH, en procesos\nnacionales, regionales e internacionales para promover los derechos humanos y\nuna mayor ambición para la acción climática.\n\nXI.-Que el 7 de diciembre de 2021, la Defensora de los Habitantes, señora\nCatalina Crespo Sancho, lanzó la Iniciativa Cocos \"Derechos Humanos y\nCambio Climático: protegiendo nuestros océanos, el medio ambiente y la\nhumanidad\", con el fin de que se prohíba la pesca de arrastre de fondo\nen todo el mundo, por ser una práctica que libera el carbono almacenado en\nfondo marino y, por ende, contribuye al incremento del cambio climático y a la\nvulneración de los derechos humanos.\n\nXII.-Que en la construcción de una percepción objetiva y razonada del\nimpacto que el cambio climático tiene sobre el disfrute pleno y efectivo de los\nderechos humanos y de la forma en que la Defensoría de los Habitantes puede\nincidir en la protección y promoción de los derechos humanos ante la amenaza\ndel cambio climático, es necesario un proceso de retroalimentación que oriente\nadecuadamente y sustente el quehacer de la Defensoría de los Habitantes.\n\nXIII.-Que mediante Acuerdo N° 6-DH del 27 de mayo de 1993, publicado en La\nGaceta N° 162 del 25 de agosto de 1993, el entonces Defensor de los\nHabitantes señor Rodrigo Alberto Carazo Z., conformó con personas de amplia\nexperiencia y solvencia profesional, ajenas a la estructura interna de la\ninstitución, un Consejo Asesor como órgano consultivo externo que le permitiera\ncontar con una visión complementaria, objetiva, y crítica respecto a la\nintervención de la misma en asuntos específicos, temas de impacto general,\npolíticas institucionales y, en general, la orientación de su quehacer.\n\nXIV.-Que mediante Acuerdo N° DH-1606 del 22 de noviembre de 2010, publicado\nen La Gaceta N° 241 del 13 de diciembre de 2010, se dispuso la\nposibilidad de que la entonces Defensora de los Habitantes, Ofelia Taitelbaum Yoselewich, nombrara\nen calidad de asesores externos a personas recomendadas por algún director o\ndirectora de Área, para colaborar con la institución en una tarea específica.\n\nXV.-Que mediante Acuerdo N° 2435, publicado en La Gaceta N° 73 del\n22 de abril de 2022, la Defensora de los Habitantes, Catalina Crespo Sancho,\nestableció un Consejo Asesor Ambiental, compuesto por un cuerpo de asesores externos\ncon reconocida experiencia y capacidad profesional, para asesorar a la\nDefensora de los Habitantes sobre temas ambientales, particularmente en\nrelación con los océanos, el calentamiento climático y su impacto sobre el\npleno disfrute de los derechos humanos, así como sobre la incidencia que la\nDefensoría pueda tener en which are included the appointment, the authorization of\nsubstitutions, and the overload of functions that is required.\n\nIII.-That the Defensoría de los Habitantes has as a general legal attribution\nthe protection and defense of the rights and interests of the inhabitants,\nbased on the casuistry that enters the institution through the complaints\nfiled by them, as well as through ex officio investigations\nthat the institution considers necessary to carry out on topics of high complexity,\nof national interest and relevance.\n\nIV.-That the actions of the Defensoría de los Habitantes must be\nduly grounded in technical criteria, and its reports and recommendations\nadhere to the principles, norms, and values that make up the legality block\nof the Costa Rican legal system and the conventionality framework for\nthe protection of human rights.\n\nV.-That since 1992, the countries adhering to the United Nations system\nrecognized that changes in the Earth's climate and their adverse effects are\na common concern of all humankind and expressed their concern that\nhuman activities have been substantially increasing the concentrations\nof greenhouse gases in the atmosphere, and because that increase\nintensifies the natural greenhouse effect, which results, on\naverage, in additional warming of the Earth's surface and atmosphere.\n\nVI.-That the Intergovernmental Panel on Climate Change (IPCC, for its acronym in\nEnglish), has unequivocally confirmed in its reports that climate change is real and that its\nmain cause is greenhouse gas emissions resulting from human activity,\namong whose adverse repercussions are: greater frequency of extreme weather\nphenomena and natural disasters, sea level rise, floods, heat waves,\ndroughts, desertification, water scarcity, and the spread of tropical and\nvector-borne diseases.\n\nVII.-That the Office of the United Nations High Commissioner for\nHuman Rights (OHCHR) has indicated that the phenomena generated by climate\nchange directly and indirectly threaten the full and effective enjoyment of a\nrange of human rights by people around the world, including the\nrights to life, potable water and sanitation, food, health,\nhousing, self-determination, culture, work, and development.\n\nVIII.-That the Defensoría de los Habitantes de Costa Rica is the National\nHuman Rights Institution of Costa Rica (NHRI) and is part of the Global Alliance of\nNational Human Rights Institutions (GANHRI), which brings together more than 110\nNHRIs from around the world.\n\nIX.-That the national human rights institutions, at the GANHRI Annual\nConference on Climate Change: The Role of National\nHuman Rights Institutions, held on December 4, 2020,\nsigned a declaration in which they state that \"climate\nchange and its effects are one of the greatest challenges today and affect\ndirectly and indirectly the full enjoyment of human rights, in\nparticular social, economic, and cultural rights, as well as\ncivil and political rights, the right to development, and the right to a\nhealthy environment.\"\n\nX.-That in the declaration of the GANHRI Annual Conference on\nclimate change, the NHRIs, including the Defensoría de los Habitantes,\ncommitted to contributing to climate action efforts in accordance\nwith human rights obligations and the principles of non-discrimination\nand participation, to act as a bridge and provide a platform for\nexchange between policymakers, civil\nsociety, and other interested parties, including the population and groups most\naffected by climate change and environmental degradation, and to participate,\neven collectively through the GANHRI and NHRI networks, in national,\nregional, and international processes to promote human rights and\ngreater ambition for climate action.\n\nXI.-That on December 7, 2021, the Defensora de los Habitantes, Ms.\nCatalina Crespo Sancho, launched the Cocos Initiative \"Human Rights and\nClimate Change: Protecting Our Oceans, the Environment, and\nHumanity,\" with the aim of banning bottom trawling\nworldwide, because it is a practice that releases the carbon stored in\nthe seabed and, therefore, contributes to the increase of climate change and the\nviolation of human rights.\n\nXII.-That in the construction of an objective and reasoned perception of the\nimpact that climate change has on the full and effective enjoyment of\nhuman rights, and of the way in which the Defensoría de los Habitantes can\ninfluence the protection and promotion of human rights in the face of the threat\nof climate change, a feedback process is necessary to adequately\nguide and sustain the work of the Defensoría de los Habitantes.\n\nXIII.-That through Agreement No. 6-DH of May 27, 1993, published in La\nGaceta No. 162 of August 25, 1993, the then Defensor de los\nHabitantes, Mr. Rodrigo Alberto Carazo Z., formed, with people of broad\nexperience and professional solvency, external to the internal structure of the\ninstitution, an Advisory Council as an external consultative body that would allow him\nto have a complementary, objective, and critical vision regarding the\nintervention of the same in specific matters, topics of general impact,\ninstitutional policies, and, in general, the orientation of its work.\n\nXIV.-That through Agreement No. DH-1606 of November 22, 2010, published\nin La Gaceta No. 241 of December 13, 2010, the\npossibility was provided for the then Defensora de los Habitantes, Ofelia Taitelbaum Yoselewich, to appoint\nas external
