Lo anterior, con recursos del contrato de\npréstamo 4864/OCCR, que financian el Programa de Infraestructura Vial y\nPromoción de las Asociaciones Público-Privadas (PIV-APP), suscrito entre el Gobierno\nde la República y el Banco Interamericano de Desarrollo, aprobado por la Ley\n9899, Aprobación del Convenio de Cooperación para el Financiamiento de Proyectos\nde Inversión (Cclip} Cr-00005 del Programa de Infraestructura Vial y Movilidad\nUrbana y del Contrato de Préstamo N° 4864/Oc-Cr que Financia la Primera\nOperación Individual bajo el Cclip denominada Programa de Infraestructura Vial\ny Promoción de Asociaciones Público Privadas, de 10 de setiembre de 2020.\n\nARTÍCULO 4- Los gastos y las acciones para la rehabilitación, protección y el manejo activo del\nsitio al que se refiere el artículo 2 de la presente ley, durante la fase constructiva y operativa,\nestarán a cargo del Ministerio de Obras Públicas y Transportes (MOPT) y deberán realizarse en\ncoordinación y siguiendo las recomendaciones técnicas que establezca el Sistema Nacional de Áreas de\nConservación (Sinac), para determinar los parámetros dentro de los cuales se deben ejecutar las\nmedidas de prevención, mitigación y lo descrito en el plan de compensación equivalente.\n\nUna vez\nfinalizada la etapa constructiva, de garantía y de rehabilitación, el\nMinisterio de Ambiente y Energía (Minae), a través\ndel Sistema Nacional de Áreas de Conservación (Sinac),\nserá el responsable de gestionar y proteger el área de compensación equivalente.\n\nARTICULO 5- El Poder Ejecutivo dictará las reglamentaciones\nnecesarias para la autorización de acciones de rehabilitación ecosistémica,\ngestión adaptativa y manejo activo en las áreas de compensación que requieran\nacciones de esta naturaleza.\n\nRige a partir de su\npublicación.\n\nDado en la Presidencia de la República, San José, a los veintiún\ndías del mes de diciembre del año dos mil veintidós.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 10338\n\n                        Authorization of urgent and nationally convenient infrastructure works in\nthe La Culebra wetland and establishment of equivalent compensation measures\n\nNo. 10338\n\nTHE LEGISLATIVE ASSEMBLY OF\nTHE REPUBLIC OF COSTA RICA\n\nDECREES:\n\nAUTHORIZATION OF URGENT\nINFRASTRUCTURE WORKS AND\n\nOF NATIONAL CONVENIENCE\nIN THE LA CULEBRA WETLAND AND\n\nESTABLISHMENT OF EQUIVALENT\nCOMPENSATION MEASURES\n\nARTICLE 1- The construction of the Bernardo Soto-Sifón Abundancia highway is authorized, including its passage through the La Culebra wetland, located between stations 29+000 and 31+000 of the highway alignment and situated between the following coordinates in CRTM 05 projection:\n\nNote: the tables are not corrected\n\nARTICLE 2- The sector of the La Culebra wetland, where the layout of the section described in Article 1 will be carried out, must be compensated through the creation, conservation, and management of a protected area for aquatic birds, for the protection and recovery of the wetland ecosystem located between the coordinates described in the following tables.\n\nARTICLE 3- For purposes of environmental compensation, the Ministry of Public Works and Transport (MOPT) is authorized to proceed with the necessary legal actions to acquire, in favor of the State, the lands delimited by the coordinates detailed in Article 2 of this law.\n\nThese lands shall be administered by the Ministry of Environment and Energy (Minae), through the National System of Conservation Areas (Sinac), once the prevention, mitigation, and monitoring measures have been applied, both for the La Culebra wetland and for the area to be compensated. The foregoing, with resources from loan agreement 4864/OCCR, which finances the Road Infrastructure and Public-Private Partnership Promotion Program (PIV-APP), signed between the Government of the Republic and the Inter-American Development Bank, approved by Law 9899, Approval of the Cooperation Agreement for the Financing of Investment Projects (Cclip) Cr-00005 of the Road Infrastructure and Urban Mobility Program and of Loan Agreement No. 4864/Oc-Cr Financing the First Individual Operation under the Cclip called Road Infrastructure and Public-Private Partnership Promotion Program, of September 10, 2020.\n\nARTICLE 4- The expenses and actions for the rehabilitation, protection, and active management of the site referred to in Article 2 of this law, during the construction and operational phases, shall be the responsibility of the Ministry of Public Works and Transport (MOPT) and must be carried out in coordination with and following the technical recommendations established by the National System of Conservation Areas (Sinac), to determine the parameters within which the prevention, mitigation measures and what is described in the equivalent compensation plan must be executed.\n\nOnce the construction, warranty, and rehabilitation stage is completed, the Ministry of Environment and Energy (Minae), through the National System of Conservation Areas (Sinac), shall be responsible for managing and protecting the equivalent compensation area.\n\nARTICLE 5- The Executive Branch shall issue the necessary regulations for the authorization of ecosystem rehabilitation, adaptive management, and active management actions in compensation areas that require actions of this nature.\n\nIt takes effect upon its publication.\n\nGiven at the Presidency of the Republic, San José, on the twenty-first day of the month of December of the year two thousand twenty-two."
