Como parte de\ndicho convenio, se incluyó el financiamiento de la ejecución de operaciones\nindividuales de la red vial cantonal por la suma de doscientos millones de\ndólares estadounidenses (USD 200.000.000,00).\n\nII.-Que la primera etapa del referido\nfinanciamiento, por sesenta millones de dólares estadounidenses (USD\n60.000.000,00), se concretó por medio del Contrato de Préstamo 2098/OC-CR\nPrograma Red Vial Cantonal PRVC-I, que fue aprobado por la Asamblea Legislativa\nmediante la Ley N° 8982, etapa que se completó al 31 de diciembre de 2017.\n\nIII.-Que como consecuencia de lo anterior,\ncon fundamento en las mismas Leyes N° 8757 y N° 8982, el Ministerio de Hacienda\nformuló solicitud para la segunda etapa del Programa por los restantes ciento\ncuarenta millones de dólares estadounidenses (USD 140.000.000,00), siendo que\nentonces el Gobierno de la República y el BID suscribieron el Contrato de\nPréstamo 4507/OC-CR, Resolución DE-8/18, de fecha 20 de setiembre de 2018, que\nha contado con las aprobaciones por parte del Banco Central de Costa Rica, de\nla Autoridad Presupuestaria, Crédito Público y del Ministerio de Planificación\nNacional y Política Económica (MIDEPLAN).\n\nIV.-Que de conformidad con el numeral (b)\nde la cláusula 3.01 de las Estipulaciones Especiales del Contrato de Préstamo\n4507/OC-CR, como parte de las condiciones especiales previas al primer\ndesembolso de los recursos del Préstamo se incluye el que se haya formalizado\nla Unidad Ejecutora del Programa dentro de la estructura del Ministerio de\nObras Públicas y Transportes (MOPT) y el que se cuente con la formalización del\nprocedimiento especial de adquisiciones para la ejecución de los procesos de\ncontratación.\n\nV.-Que mediante la resolución del\nMinisterio de Obras Públicas y Transportes N° 002125 de las 13:15 horas del 12\nde noviembre del 2018, se formalizó la Unidad Ejecutora y de Coordinación del\nPrograma Red Vial Cantonal II (PRVC-II).\n\nVI.-Que lo transcrito implica la necesidad\nde establecer coordinación y colaboración con los gobiernos locales, dado que\nlos recursos provenientes del préstamo deberán ser invertidos por el MOPT en la\nred vial cantonal.\n\nVII.-Que conforme lo anterior y en\naplicación de la coordinación que debe imperar entre el Ministerio de Obras\nPúblicas y Transportes y las Municipalidades para la ejecución de los recursos\nprovenientes del programa BID-Cantonal, resulta indispensable en primera\ninstancia, determinar las obras en las cuales se invertirán dichos recursos,\nobedeciendo tal definición a razones de conveniencia y razonabilidad.\n\nVIII.-Que conforme los antecedentes\ndestacados en los Considerandos anteriores, dentro de los proyectos que se\nestán ejecutando a través del Programa de la Red Vial Cantonal (PRVC-II), con\nla Municipalidad de Jiménez, se incluye el proyecto \"Sustitución del puente\nsobre el río Pejibaye, en el Camino 3-04-043, De: Calles Urbanas - Cuadrantes\nA: Pejibaye Centro, longitud de 60 m. Cantón de Jiménez\".\n\nIX.-Que el puente se ubica entre las\nestaciones 2+140 y 2+200 del camino inscrito en el Registro Vial Cantonal de la\nDirección de Planificación Sectorial del Ministerio de Obras Públicas y\nTransportes con el código C.3-04-043, cuya longitud total es de 3,5 km.\nActualmente, el puente modular de dos vanos de 50 m y 10 m de longitud se\nencuentra en malas condiciones, además, presenta una superficie de ruedo de\ntablones de madera y ancho de carril insuficiente para el paso de vehículos en\nambos sentidos simultáneamente, por otra parte, no cuenta con una pasarela\npeatonal, lo que obliga a los peatones a cruzar sobre la estructura\ncompartiendo el mismo carril con los vehículos.\n\nX.-Que el proyecto beneficiará a una población\ntotal 3.245 habitantes del distrito de Pejibaye, cantón de Jiménez, de acuerdo\ncon el Censo 2011.\n\nXI.-Que el\nProyecto denominado \"Sustitución del puente sobre el río Pejibaye, en el Camino\n3-04-043, De: Calles Urbanas - Cuadrantes A: Pejibaye Centro, longitud de 60 m.\nCantón de Jiménez\", al amparo del artículo 17 de la Ley Orgánica del Ambiente\nN° 7554, cuenta con la respectiva viabilidad ambiental emitida por la\nSecretaria Técnica Nacional Ambiental (SETENA), según resolución N°\n0878-2021-SETENA de las nueve horas cuatro minutos del nueve de junio del año\ndos mil veintiuno (expediente administrativo N° D1-0251-2021-SETENA).\n\nXII.-Que de conformidad con el oficio N°\nACC-PNE-C-012-2022 del 02 de mayo de 2022, la Dirección Regional del Área de\nConservación Central del Sistema Nacional de Áreas de Conservación (SINAC),\nhizo constar que: \"... el proyecto supra citado se encuentra FUERA DE CUALQUIER\nÁREA SILVESTRE PROTEGIDA SEA CUAL SEA SU CATEGORÍA DE MANEJO ADMINISTRADA POR\nEL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC) Y FUERA DE TERRENOS\nPATRIMONIO NATURAL DEL ESTADO (PNE)\".\n\nXIII.-Que los artículos 19 inciso b) y 34\nde la Ley Forestal N° 7575 prohíben el cambio de uso de suelo en terrenos\nprivados cubiertos de bosque, así como la corta de árboles en las áreas de\nprotección definidas en el numeral 33 del mismo cuerpo normativo, exceptuando\naquellos proyectos estatales o privados que el Poder Ejecutivo declare de\nConveniencia Nacional, constituyéndose en estos, aquellos proyectos cuyos\nbeneficios sociales sean mayores que los costos socio ambientales.\n\nXIV.-Que en atención al Considerando\nanterior, el desarrollador elaboró la evaluación económica-social del citado\nproyecto, misma que fue sometida por parte del Ministerio de Ambiente y Energía\na valoración, en aras de ponderar que los beneficios sociales sean superiores a\nlos costos socio-ambientales, al amparo del inciso m) del artículo 03 de la Ley\nForestal N° 7575, lo anterior a efecto de que se emitieran las recomendaciones\nrespectivas, mismas que en lo conducente, refirieron que el procedimiento\nutilizado por el desarrollador fue adecuado para la demostración del bienestar\nsocial, y a la postre se concluyó:\n\n\"En conclusión, el estudio presentado muestra que\nexiste un beneficio social positivo. Permite mejorar la conectividad,\ntransitabilidad, seguridad y nivel de servicio, del puente sobre Río Pejibaye y\npor lo tanto, el tránsito de personas, bienes y servicios de las comunidades\naledañas. Por tal motivo, el proyecto puede considerarse de conveniencia\nnacional... Por tal motivo, considerando lo anterior y debido a que los\nresultados del proyecto (TIRE y VANE) fueron positivos, se considera que al\nproyecto puede otorgársele la declaratoria de conveniencia nacional\"\n\nXV.-Que de conformidad con el Reglamento a\nla Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites\nAdministrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012 y\nsus reformas, se determinó que la presente propuesta no establece ni modifica\ntrámites, requisitos o procedimientos, que el administrado deba cumplir,\nsituación por la que no se procedió con el trámite de control previo. Por\ntanto,\n\nDecretan:\n\nDeclaratoria de\nConveniencia Nacional del Proyecto denominado \"Sustitución del puente sobre el\nrío Pejibaye, en el Camino 3-04-043, De: Calles\n\nUrbanas - Cuadrantes A: Pejibaye Centro,\n\nLongitud de 60 m. Cantón de Jiménez\"\n\nArtículo 1°-Se\ndeclara de Conveniencia Nacional el proyecto de obra pública denominado\n\"Sustitución del puente sobre el río Pejibaye, en el Camino 3-04-043, De:\nCalles Urbanas - Cuadrantes A: Pejibaye Centro, longitud de 60 m. As part of said agreement, the financing of the execution of individual operations of the cantonal road network was included for the sum of two hundred million United States dollars (USD 200,000,000.00).\n\nII.-That the first stage of the aforementioned financing, for sixty million United States dollars (USD 60,000,000.00), was materialized through Loan Contract 2098/OC-CR Cantonal Road Network Program PRVC-I, which was approved by the Legislative Assembly through Law No. 8982, a stage that was completed as of December 31, 2017.\n\nIII.-That as a consequence of the foregoing, based on the same Laws No. 8757 and No. 8982, the Ministry of Finance submitted a request for the second stage of the Program for the remaining one hundred forty million United States dollars (USD 140,000,000.00), and then the Government of the Republic and the IDB signed Loan Contract 4507/OC-CR, Resolution DE-8/18, dated September 20, 2018, which has received approvals from the Central Bank of Costa Rica, the Budgetary Authority, Public Credit, and the Ministry of National Planning and Economic Policy (MIDEPLAN).\n\nIV.-That in accordance with numeral (b) of clause 3.01 of the Special Stipulations of Loan Contract 4507/OC-CR, as part of the special conditions prior to the first disbursement of the Loan resources, it is included that the Program Executing Unit has been formalized within the structure of the Ministry of Public Works and Transport (MOPT) and that the formalization of the special procurement procedure for the execution of contracting processes is in place.\n\nV.-That through resolution of the Ministry of Public Works and Transport No. 002125 of 1:15 p.m. on November 12, 2018, the Executing and Coordination Unit of the Cantonal Road Network Program II (PRVC-II) was formalized.\n\nVI.-That the foregoing implies the need to establish coordination and collaboration with local governments, given that the resources coming from the loan must be invested by the MOPT in the cantonal road network.\n\nVII.-That in accordance with the above and in application of the coordination that must prevail between the Ministry of Public Works and Transport and the Municipalities for the execution of the resources coming from the IDB-Cantonal program, it is essential, in the first instance, to determine the works in which said resources will be invested, such definition being based on reasons of convenience and reasonableness.\n\nVIII.-That according to the background highlighted in the preceding Considering clauses, among the projects being executed through the Cantonal Road Network Program (PRVC-II), with the Municipality of Jiménez, the project \"Replacement of the bridge over the Pejibaye River, on Road 3-04-043, From: Urban Streets - Quadrants A: Pejibaye Centro, length of 60 m. Cantón de Jiménez\" is included.\n\nIX.-That the bridge is located between stations 2+140 and 2+200 of the road registered in the Cantonal Road Registry of the Sectoral Planning Directorate of the Ministry of Public Works and Transport with code C.3-04-043, whose total length is 3.5 km. Currently, the modular bridge with two spans of 50 m and 10 m in length is in poor condition; furthermore, it has a running surface of wooden planks and an insufficient lane width for the passage of vehicles in both directions simultaneously; on the other hand, it lacks a pedestrian walkway, forcing pedestrians to cross over the structure sharing the same lane with vehicles.\n\nX.-That the project will benefit a total population of 3,245 inhabitants of the district of Pejibaye, cantón of Jiménez, according to the 2011 Census.\n\nXI.-That the Project called \"Replacement of the bridge over the Pejibaye River, on Road 3-04-043, From: Urban Streets - Quadrants A: Pejibaye Centro, length of 60 m. Cantón de Jiménez\", under the protection of Article 17 of the Organic Law of the Environment No. 7554, has the respective environmental feasibility granted by the National Environmental Technical Secretariat (SETENA), according to resolution No. 0878-2021-SETENA of nine hours four minutes on June ninth, two thousand twenty-one (administrative file No. D1-0251-2021-SETENA).\n\nXII.-That in accordance with official letter No. ACC-PNE-C-012-2022 of May 2, 2022, the Regional Directorate of the Central Conservation Area of the National System of Conservation Areas (SINAC), certified that: \"... the aforementioned project is located OUTSIDE ANY WILD PROTECTED AREA REGARDLESS OF ITS MANAGEMENT CATEGORY ADMINISTERED BY THE NATIONAL SYSTEM OF CONSERVATION AREAS (SINAC) AND OUTSIDE STATE NATURAL HERITAGE (PNE) LANDS\".\n\nXIII.-That Articles 19 subsection b) and 34 of the Forest Law No. 7575 prohibit land-use change (cambio de uso del suelo) on private lands covered by forest, as well as the felling of trees in the protection areas defined in numeral 33 of the same regulatory body, excepting those state or private projects that the Executive Branch declares of National Convenience, being constituted as such, those projects whose social benefits are greater than the socio-environmental costs.\n\nXIV.-That in consideration of the preceding Considering clause, the developer prepared the economic-social evaluation of the cited project, which was submitted by the Ministry of Environment and Energy for assessment, in order to weigh that the social benefits outweigh the socio-environmental costs, under the protection of subsection m) of Article 03 of the Forest Law No. 7575, the foregoing for the purpose of issuing the respective recommendations, which, as pertinent, stated that the procedure used by the developer was adequate for demonstrating social welfare, and ultimately it was concluded:\n\n\"In conclusion, the submitted study shows that there is a positive social benefit. It allows for improving connectivity, passability, safety, and level of service of the bridge over the Pejibaye River and, therefore, the transit of people, goods, and services of the surrounding communities. For this reason, the project can be considered of national convenience... For this reason, considering the foregoing and because the project results (TIRE and VANE) were positive, it is considered that the declaration of national convenience can be granted to the project\"\n\nXV.-That in accordance with the Regulation to the Law for the Protection of Citizens from the Excess of Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, and its amendments, it was determined that this proposal does not establish or modify procedures, requirements, or formalities that the citizen must fulfill, a situation for which the prior control procedure was not carried out. Cantón de Jiménez\"\n\nArticle 1.-The public works project called \"Replacement of the bridge over the Pejibaye River, on Road 3-04-043, From: Urban Streets - Quadrants A: Pejibaye Centro, length of 60 m. Cantón de Jiménez\", is declared of National Convenience, as well as the associated works of prevention, mitigation, compensation, and maintenance required by it within the project area, which will be executed by the Executing Coordination Unit PRVC-II, MOPT/IDB.\n\nArticle 2.-By virtue of the declaration of National Convenience of this project and in accordance with Articles 19 subsection b) and 34 of the Forest Law No. 7575, the felling or removal of trees located on lands covered by forest or in the protection areas defined in Article 33 of the Forest Law No. 7575 is authorized, which must be carried out in a limited, proportional, and reasonable manner, after processing the respective permits before the pertinent Conservation Area of the National System of Conservation Areas, and provided that the trees are not located on State Natural Heritage lands.\n\nArticle 3.-The Ministry of Public Works and Transport, through the Executing Coordination Unit PRVC-II, MOPT/IDB, must comply with the requirements of the National Environmental Technical Secretariat, as well as with the obligations contracted in the Environmental Impact Study, the Sworn Declaration of Environmental Commitments, and the approved environmental mitigation and compensation measures.\n\nArticle 4.-In the event that the cut of the existing forest resource is usable, coordination must be made with the Ministry of Environment and Energy (MINAE) for the delivery of said resource, in accordance with subsection q) of Article 6 and numeral 65 of the Forest Law No. 7575, amended by Law No. 9927 of December 18, 2020.\n\nArticle 5.-It becomes effective upon its publication.\n\nIssued at the Presidency of the Republic.-San José, on the fourteenth of November of the year two thousand twenty-two." }
