artículos 2° y 3° de la Ley N° 5695 Ley de Creación del\nRegistro Nacional de fecha 28 de mayo de 1975 y sus reformas.\n\nConsiderando:\n\n1º-Que mediante Ley N° 8905 se establece\nel Instituto Geográfico Nacional, en adelante IGN, como una dependencia del\nRegistro Nacional, quien suscribirá los contratos y convenios necesarios para\nel ejercicio de sus funciones. Asimismo, de conformidad con la Ley N° 59, el\nIGN es la dependencia científica y técnica rectora de la cartografía\nnacional, destinada a la ejecución del Mapa básico oficial y la Descripción\nbásica geográfica de la República de Costa Rica y a los estudios, las\ninvestigaciones o labores y el desarrollo de políticas nacionales de carácter\ncartográfico, geográfico, geodésico, geofísico y de índole similar que tenga\nrelación con dichas obras, con el fin de apoyar los procesos de planificación.\n\n2º-Que la Ley N° 59 constituye al IGN de\nmanera permanente y en representación del Estado, como la autoridad oficial en\nmateria geodésica y de la representación espacial de la geografía de la\nRepública de Costa Rica, extendiéndose su autoridad a las actividades de\ncualquier orden que tengan por origen los trabajos confiados a su cargo.\n\n3º-Que de\nconformidad con la Ley N° 59; el artículo 62 del Decreto Ejecutivo N° 7841-P Reglamento\na la Ley sobre la Zona Marítimo Terrestre se reconoce la competencia del\nIGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su\noficialización a través de publicación en el Diario Oficial La Gaceta;\nel artículo 63 del Decreto Ejecutivo N° 7841-P señala que \"El Instituto\nGeográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción\nde la zona marítimo-terrestre en que haya demarcado la zona pública.\"\n\n4º-Que en el Decreto Ejecutivo N°\n36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de\nla zona pública de la Zona Marítimo Terrestre, se establece según el\nartículo 18 que para la delimitación de la zona pública de la Zona Marítimo\nTerrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican\nen los artículos 19 y 20, correspondientes a la delimitación de la zona pública\nde la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la\ndelimitación digital georreferenciada, esto con el fin de agilizar las\ndelimitaciones y proporcionar mayor seguridad técnica a los interesados.\n\n5º-Que en el Decreto Ejecutivo N°\n33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el\nCR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del\nServicio Internacional de Rotación de la Tierra (IERS) para la época de\nmedición 2005.83, el cual entre otros aspectos determina, a la Red Geodésica\nNacional de Referencia Horizontal CR05, y su proyección cartográfica asociada\nCRTM05, como el sistema oficial al cual deben estar referidas las coordenadas\nde todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten\nen nuestro país, señalando específicamente en artículo 11 que: \"La Red\nGeodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección\ncartográfica CRTM05, constituirán el único sistema oficial de coordenadas para\nla República de Costa Rica a partir del cual se debe referenciar todos los\nlevantamientos y actividades cartográficos y geodésicos que desarrollen en el\nTerritorio Nacional toda dependencia pública, persona o entidad privada\nnacional o extranjera.\"; mientras que el artículo 7° indica que \"Conforme se\nproduzcan datos cartográficos en el nuevo sistema de proyección cartográfica\nCRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella\ninformación que se ha oficializado.\"\n\n6º-Que el Decreto Ejecutivo N° 40962-MJP Actualización\ndel Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara\nen su artículo 1 que \"El sistema geodésico de referencia horizontal oficial\npara Costa Rica, denominado como CR05 y su materialización mediante la Red\nGeodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), para la época de\nmedición 2014.59, y en adelante, los cambios y su actualización, se regirán de\nacuerdo a las nuevas definiciones del ITRF que se implementen en la red\ncontinental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS)\ndenominada SIRGAS-CON\", mientras que el artículo 2° establece que \"El\nsistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la\nrepresentación cartográfica del territorio nacional continental, extendido para\nefectos de aplicación de esta proyección cartográfica, hasta la línea de base\ndel mar territorial en el océano Pacífico y el mar Caribe, definida esta línea\nconforme a los artículos 5°, 6° y 7° de la Convención de las Naciones Unidas\nsobre el Derecho del Mar, como punto de partida para el cómputo de la anchura\nmáxima de todas las áreas marinas jurisdiccionales del Estado costarricense.\"\n\nPor su parte, el artículo 12 del decreto de cita, refuerza la\naplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas\noficial a la cual se deben referenciar en el territorio continental de nuestro\npaís, al señalar que \"El sistema de referencia horizontal CRSIRGAS y su\nproyección cartográfica asociada CRTM05 para el territorio continental\nextendido hasta la línea de base del mar territorial y, la proyección\ncartográfica \"Universal Transversal de Mercator\" (UTM), zonas 16 y 17 para las\náreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar\nCaribe, constituirán el único sistema oficial de coordenadas para la República\nde Costa Rica, a partir del cual, se deben referenciar todos los levantamientos\ny actividades cartográficos y geodésicos que desarrollen en el territorio\nnacional toda dependencia pública, persona o entidad privada, nacional o extranjera,\nque emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose\na evitar el gasto público y obteniendo, por otra parte, información geográfica\nconfiable, uniforme y comparable, que sea de utilidad general y que apoye la\ntoma de decisiones en los distintos niveles del Estado.\"\n\n7º-Que la georreferenciación al sistema\nnacional de coordenadas como mecanismo para delimitar la zona pública de la\nZona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública\na los efectos de la elaboración de planes reguladores, el visado de planos de\nagrimensura, el otorgamiento de concesiones en la Zona Restringida y otros\naspectos de ordenamiento territorial costero.\n\n8º-Que la información digital\ngeorreferenciada sobre delimitación de la zona pública de la Zona Marítimo\nTerrestre con que cuenta el IGN, se le denomina Geodatabase Digital\nGeorreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona\nMarítimo Terrestre (ZMT).\n\n9º-Que la Geodatabase Digital\nGeorreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona\nMarítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la\nregulación establecida por: a) el Decreto Ejecutivo N° 7841-P Reglamento\na la Ley N° 6043 sobre la Zona Marítimo Terrestre, b) el Decreto\nEjecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa\nRica, el CR05, y su proyección cartográfica asociada, CRTM05; y c)\nel Decreto Ejecutivo N° 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones\npara la Delimitación de la zona pública de la Zona Marítimo Terrestre\".\n\n10.-Que el artículo 16 de la Ley Forestal,\nLey N° 7575 del 13 de febrero de 1996 y sus reformas, establece que el\nMinisterio del Ambiente y Energía (MINAE) delimitará en el terreno los linderos\nde las áreas que conforman el Patrimonio Natural del Estado.\n\n11.-Que según el artículo 11 del Capítulo\nI, Disposiciones Generales de la Ley N° 6043, establece que la \"Zona pública\nes también, sea cual fuere su extensión, la ocupada por todos los manglares de\nlos litorales continentales e insulares y esteros del territorio nacional.\"\n\n12.-Que el Decreto Ejecutivo N° 36786-MINAET Manual para la\nclasificación de tierras dedicadas a la conservación de los recursos naturales\ndentro de la Zona Marítimo Terrestre en Costa Rica publicado en La\nGaceta N° 217 del 11 de noviembre del 2011, establece entre sus objetivos \"Identificar\ndentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como\nbosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares,\nesteros, rías, marismas, lagunas costeras, pantanos, bosques anegados,\nsalitrales), para certificarlos e incorporarlos como parte del Patrimonio\nNatural del Estado (PNE).\"\n\n13.-Que el Decreto Ejecutivo N°\n36786-MINAET en el Punto III.-Competencias para la delimitación y certificación\nestablece que \"La clasificación de los terrenos dentro de la ZMT\ncorresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de\nConservación (SINAC) y a profesionales privados debidamente acreditados por los\nColegios Profesionales respectivos para que clasifiquen los bosques, terrenos\nde aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías,\nmarismas, lagunas costeras, pantanos, bosques anegados, salitrales) y\nhumedales.\n\nLa validez de los documentos de\nclasificación emitidos por profesionales privados quedará sujeta a la\naprobación que emita el AC que por competencia territorial le corresponda. A\nlas AC del SINAC con jurisdicción en la ZMT les competerá, además, la\nverificación, fiscalización, deslinde y certificación de las tierras del\nPatrimonio Natural del Estado y las zonas de protección.\n\nLa ubicación y delimitación de las áreas\ndel Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe\nrealizarse como parte del proceso de aprobación del Plan Regulador Costero\n(PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el\ninstrumento de ordenamiento territorial, que define y ubica todas las zonas a\nconcesionar dentro de la ZMT y para la clasificación de ésta a nivel de los\nplanos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y\nexpresamente, las áreas del PNE para no contabilizarlas en el área total a\nconcesionar.\"\n\n14.-El Instituto Geográfico Nacional,\nutilizó la metodología de Delimitación Digital, para delimitar la zona pública\nde la Zona Marítimo Terrestre correspondiente al ecosistema de estero/manglar\nBoca Vieja - Quepos, distrito 01° Quepos, cantón 06° Quepos, provincia 06°\nPuntarenas.\n\n15.-Que la delimitación del estero/manglar\nBoca Vieja corresponde a una sección de los manglares ubicados en el cantón de\nQuepos, de acuerdo a lo indicado por la Sala Constitucional según Resolución N°\n2021002741 de las 09:15 horas del 12 de febrero de 2021, se ordenó al Área de\nConservación Pacífico Central (ACOPAC) y al Instituto Geográfico Nacional (IGN)\nlo siguiente: \"que de manera\nconjunta y coordinada realicen las actuaciones correspondientes\npara que, en el plazo máximo de tres meses a partir de la\nnotificación de esta sentencia, delimiten el ecosistema de manglar de la zona\nde Quepos.\" (El resaltado es suplido)\n\n16.-La delimitación digital del ecosistema\nde estero/ manglar Boca Vieja corresponde al informe técnico oficios\nDIG-TOT-INF-001-2023 de fecha 09 de enero de 2023 y\nSINAC-ACOPAC-IRT-PNE-098-2022 de fecha 20 de diciembre de 2022, generados por\nel Subproceso de Límites Oficiales del Departamento Topográfico y Observación\ndel Territorio del Instituto Geográfico Nacional (IGN) y la Oficina Programas\nInformación y Regularización del Territorio, Programa Patrimonio Natural del\nEstado de Área de Conservación Pacífico Central (ACOPAC), respectivamente.\n\n17.-Que el artículo 140 de la Ley N° 6227 Ley\nGeneral de la Administración Pública, señala que \"el acto administrativo\nproducirá su efecto después de comunicado al administrado, excepto si le\nconcede únicamente derechos, en cuyo caso lo producirá desde que se adopte\",\ndisposición que necesariamente debe relacionarse con el numeral 204 inciso 1)\ndel mismo cuerpo normativo, que define el instrumento idóneo para comunicar\nactos de naturaleza genérica al señalar que: \"Se comunicarán por publicación\nlos actos generales y por notificación, los concretos\".\n\nCOMUNICA:\n\n1º-Que, durante\nel mes de febrero de 2022, se realizó el trabajo de campo en conjunto el IGN y\nACOPAC para delimitar el ecosistema de manglar perteneciente a la zona pública\nde un sector de estero/manglar Boca Vieja, distrito 01° Quepos, cantón 06°\nQuepos, provincia 06° Puntarenas.\n\n2º-El Instituto Geográfico Nacional\npublica la delimitación digital georreferenciada de la zona pública del sector\n1, comprendido entre los poblados El Cocal y Boca Vieja que forma parte de un\nsector del ecosistema de manglar ubicado en el SECTOR OF THE PUBLIC ZONE\n\nCORRESPONDING TO THE BOCA VIEJA ESTUARY-MANGROVE,\n\nDISTRICT 01° QUEPOS, CANTON 06° QUEPOS,\n\nPROVINCE 06° PUNTARENAS\n\nBased on the provisions of articles 140 and 240 of Law N° 6227 General Law of Public Administration of May 2, 1978, and its amendments; Law N° 59 Law of Creation and Organization of the National Geographic Institute of July 4, 1944, and its amendments; Law N° 8905 Reform of Article 2 of Law N° 5695, Creation of the National Registry, and its amendments; and modification of Law N° 59, Creation and Organization of the National Geographic Institute, of July 4, 1944, and its amendments of December 7, 2010; Law N° 6043 Law on the Maritime Terrestrial Zone of March 2, 1977, with its respective regulations; and articles 2 and 3 of Law N° 5695 Law of Creation of the National Registry of May 28, 1975, and its amendments.\n\nConsidering:\n\n1.—That by means of Law N° 8905, the National Geographic Institute, hereinafter IGN, is established as a dependency of the National Registry, which shall sign the necessary contracts and agreements for the exercise of its functions. Likewise, in accordance with Law N° 59, the IGN is the scientific and technical dependency governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica, and for studies, investigations, or labors and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, for the purpose of supporting planning processes.\n\n2.—That Law N° 59 constitutes the IGN on a permanent basis and in representation of the State, as the official authority in geodetic matters and in the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any order that originate from the works entrusted to its charge.\n\n3.—That in accordance with Law N° 59; Article 62 of Executive Decree N° 7841-P Regulations to the Law on the Maritime Terrestrial Zone recognizes the competence of the IGN for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta; Article 63 of Executive Decree N° 7841-P states that \"The National Geographic Institute must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\n4.—That in Executive Decree N° 36642-MP-MOPT-MINAET Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone, it is established according to Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, which are indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of markers (mojones) and/or through georeferenced digital delimitation, this for the purpose of expediting the delimitations and providing greater technical security to interested parties.\n\n5.—That in Executive Decree N° 33797-MJ-MOPT Declaring CR05 as the official horizontal datum for Costa Rica, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: \"The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the National Territory by any public dependency, person, or private national or foreign entity must be referenced.\"; while Article 7 indicates that \"As cartographic data is produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish, by appropriate means, that information which has been made official.\"\n\n6.—That Executive Decree N° 40962-MJP Update of the Official Horizontal Geodetic Reference System for Costa Rica declares in its Article 1 that \"The official horizontal geodetic reference system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, the changes and its updating shall be governed according to the new definitions of the ITRF that are implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) called SIRGAS-CON\", while Article 2 establishes that \"The cartographic projection system CRTM05 shall continue to be the official system for the cartographic representation of the continental national territory, extended for the purposes of applying this cartographic projection to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this baseline being defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for the computation of the maximum width of all jurisdictional marine areas of the Costa Rican State.\"\n\nFor its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which works must be referenced in the continental territory of our country, stating that \"The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea, and the 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the national territory by any public dependency, person, or private entity, national or foreign, that undertake or contract geodetic and cartographic works must be referenced, thus contributing to the avoidance of public spending and obtaining, on the other hand, reliable, uniform, and comparable geographic information that is of general utility and that supports decision-making at the different levels of the State.\"\n\n7.—That the georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of the elaboration of regulatory plans (planes reguladores), the approval of survey plans (planos de agrimensura), the granting of concessions in the Restricted Zone, and other aspects of coastal land-use planning.\n\n8.—That the georeferenced digital information on delimitation of the public zone of the Maritime Terrestrial Zone that the IGN possesses is called the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n9.—That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree N° 7841-P Regulations to Law N° 6043 on the Maritime Terrestrial Zone, b) Executive Decree N° 33797-MJ-MOPT Declaring CR05 and its associated cartographic projection, CRTM05, as the official horizontal datum for Costa Rica; and c) Executive Decree N° 36642-MP-MOPT-MINAET \"Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\".\n\n10.—That Article 16 of the Forestry Law (Ley Forestal), Law N° 7575 of February 13, 1996, and its amendments, establishes that the Ministry of Environment and Energy (MINAE) shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State.\n\n11.—That according to Article 11 of Chapter I, General Provisions of Law N° 6043, it establishes that the \"Public zone is also, whatever its extension, that occupied by all mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory.\"\n\n12.—That Executive Decree N° 36786-MINAET Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica published in La Gaceta N° 217 of November 11, 2011, establishes among its objectives to \"Identify within the Maritime Terrestrial Zone those lands that are classified as forests, of forest aptitude (Class VII and VIII soils), wetlands (mangroves, estuaries (esteros), rias, salt marshes (marismas), coastal lagoons, swamps (pantanos), flooded forests (bosques anegados), salt flats (salitrales)), to certify them and incorporate them as part of the Natural Heritage of the State (Patrimonio Natural del Estado, PNE).\"\n\n13.—That Executive Decree N° 36786-MINAET in Point III.—Competencies for delimitation and certification establishes that \"The classification of lands within the ZMT shall correspond to the Conservation Areas (Áreas de Conservación, AC) of the National System of Conservation Areas (SINAC) and to private professionals duly accredited by the respective Professional Colleges to classify forests, lands of forest aptitude (Class VII and VIII soils), (mangroves, estuaries (esteros), rias, salt marshes (marismas), coastal lagoons, swamps (pantanos), flooded forests (bosques anegados), salt flats (salitrales)) and wetlands.\n\nThe validity of the classification documents issued by private professionals shall be subject to the approval issued by the AC that corresponds by territorial competence. The ACs of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, supervision (fiscalización), demarcation (deslinde), and certification of the lands of the Natural Heritage of the State and the protection zones.\n\nThe location and delimitation of the areas of the Natural Heritage of the State within the Maritime Terrestrial Zone must be carried out as part of the approval process of the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the land-use planning instrument that defines and locates all the zones to be concessioned within the ZMT and for its classification at the cadastral plan level. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so as not to count them in the total area to be concessioned.\"\n\n14.—The National Geographic Institute used the Digital Delimitation methodology to delimit the public zone of the Maritime Terrestrial Zone corresponding to the Boca Vieja - Quepos estuary/mangrove ecosystem, district 01° Quepos, canton 06° Quepos, province 06° Puntarenas.\n\n15.—That the delimitation of the Boca Vieja estuary/mangrove corresponds to a section of the mangroves located in the canton of Quepos, in accordance with what was indicated by the Constitutional Chamber (Sala Constitucional) pursuant to Resolution N° 2021002741 of 09:15 hours on February 12, 2021, it was ordered to the Central Pacific Conservation Area (ACOPAC) and the National Geographic Institute (IGN) as follows: \"that jointly and in a coordinated manner, they carry out the corresponding actions so that, within the maximum term of three months from the notification of this judgment, they delimit the mangrove ecosystem of the Quepos zone.\" (Emphasis supplied)\n\n16.—The digital delimitation of the Boca Vieja estuary/mangrove ecosystem corresponds to technical report official communications DIG-TOT-INF-001-2023 dated January 9, 2023, and SINAC-ACOPAC-IRT-PNE-098-2022 dated December 20, 2022, generated by the Official Limits Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute (IGN) and the Office of Information and Land Regularization Programs, Natural Heritage of the State Program of the Central Pacific Conservation Area (ACOPAC), respectively.\n\n17.—That Article 140 of Law N° 6227 General Law of Public Administration states that \"the administrative act shall produce its effect after being communicated to the administered party, unless it grants only rights, in which case it shall produce it from the moment it is adopted,\" a provision that must necessarily be related to numeral 204 subsection 1) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature, stating that: \"General acts shall be communicated by publication, and specific acts by notification.\"\n\nCOMMUNICATES:\n\n1.—That, during the month of February 2022, the IGN and ACOPAC jointly carried out the field work to delimit the mangrove ecosystem belonging to the public zone of a sector of the Boca Vieja estuary/mangrove, district 01° Quepos, canton 06° Quepos, province 06° Puntarenas.\n\n2.—The National Geographic Institute publishes the georeferenced digital delimitation of the public zone of sector 1, located between the towns of El Cocal and Boca Vieja, which forms part of a sector of the mangrove ecosystem located in district 01° Quepos, canton 06° Quepos, province 06° Puntarenas, based on the Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone and the methodology used and validated by the Central Pacific Conservation Area (ACOPAC) of SINAC-MINAE.\n\n3.—That the delimited public zone corresponds to a sector of the Boca Vieja estuary/mangrove ecosystem, district 01° Quepos, canton 06° Quepos, province 06° Puntarenas, in accordance with official communications N° DIG-TOT-INF-001-2023 dated January 9, 2023, issued by the Official Limits Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute (IGN) and N° SINAC-ACOPAC-IRT-PNE-098-2022 dated December 20, 2022, issued by the Central Pacific Conservation Area (ACOPAC) of SINAC-MINAE.\n\n4.—The sectors located in Quepos, district 01° Quepos, canton 06° Quepos, province 06° Puntarenas, that to date have a delimitation of the public zone of the Maritime Terrestrial Zone through the placement of markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.\n\n5.—That the public zone of the Maritime Terrestrial Zone concerning the sector of the mangrove ecosystem verified and delimited by the Central Pacific Conservation Area corresponds to the following coordinates in the official cartographic projection system of Costa Rica CRTM05:\n\nBOCA VIEJA ESTUARY/MANGROVE SECTOR\n\n| CRTM05 Coordinates | North (m.) | East (m.) |\n| --- | --- | --- |\n| Start | 1045054.817 | 479872.867 |\n| End | 1043009.414 | 481878.976 |\n\n6.—The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone of the Boca Vieja estuary/mangrove ecosystem located in Quepos, district 01° Quepos, canton 06° Quepos, province 06° Puntarenas, have been registered in the Georeferenced Digital Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN in a file with vector shape format, under the coding: RN/IGN_GDG-IGN-ZMT_digital lines.\n\n7.—Takes effect as of its publication.\n\nGiven in Curridabat, on the 9th day of February, 2023." }
