  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 040\n\n                        Decreta veda de pesca de sardina con cualquier arte de pesca\n\nINSTITUTO COSTARRICENSE DE PESCA  Y ACUICULTURA\n\nAJDIP/040-2023.-Puntarenas, a los veintiocho días del mes\nde febrero de dos mil veintitrés.\n\nConsiderando:\n\n1º-Que mediante acuerdo de Junta Directiva AJDIP/049-2020,\nse estableció una veda para la pesca semi-industrial\nsardinera bolichera (cerco), en el área comprendida por una línea imaginaria\nque va desde Punta Agujas (84°38´57´´Longitud Oeste, 09°43´46´´ Latitud Norte)\nal Faro de la Isla Negritos afuera (84°49´35´´ Longitud Oeste, 09°49´14´´\nLatitud Norte) y desde ahí hasta la parte Este de Punta Cuchillo en la\nPenínsula de Nicoya (09°50´03\"Latitud Norte, 084°53´42\" Longitud\nOeste) y de estas líneas aguas adentro hasta la desembocadura del río Tempisque;\na partir del 01 de marzo hasta el 31 de mayo\n\n2º-Que el acuerdo de Junta Directiva AJDIP/049-2020, estableció la veda de sardina de manera\npermanente durante al menos 5 años, hasta tanto no se tengan nuevas investigaciones científicas que\ndeterminen el cambio del acuerdo.\n\n3º-Que de forma adicional se presenta oficio INCOPESCA-DOPA-009-2023, en\nrelación al estudio realizado por el Departamento de Investigación, para la\ncaracterización de las capturas realizadas por la flota semi-industrial\nsardinera durante los meses de junio y julio (veda de pequeña escala), en la\nzona C del Golfo de Nicoya, según lo dispuso el acuerdo de Junta Directiva\nAJDIP/100-2021.\n\n4º-Que de conformidad con el considerando anterior, un biólogo observador\ndel Departamento de Investigación Pesquera del INCOPESCA, trabajó a bordo de\ncada una de las embarcaciones de pesca semi-industrial\nsardinera bolichera (cerco), durante el periodo ya indicado para determinar la\nrelación de captura entre especie objetivo (sardina Ophistonema\nsp) y especies no objetivo o pesca incidental\n(corvina, jureles, macarela, barracuda, entre otros).\n\n5º-Que la captura incidental para la pesca de sardina del estudio realizado\nen el año 2022 representó menos del 3% de la captura total de las embarcaciones\ny se ubica dentro del 10% máximo del margen de tolerancia conforme a lo\nestablecido mediante acuerdo de Junta Directiva AJDIP/049-2020.\n\n6º-Que la Dirección de Ordenamiento Pesquero y Acuícola, adicionalmente\nestablecerá las medidas correspondientes para efectos de que todas las\ndescargas que se realicen como parte de este acuerdo sean debidamente\ninspeccionadas por el Departamento de Fiscalización. Este acceso será utilizado en franjas diurnas de 12\nhoras cada una de forma semanal alterna por cada embarcación de modo que no\npodrán estar dentro de dicha área las 2 embarcaciones en la misma semana y de\nprevio a su ingreso, deberán sus propietarios, armadores o Capitán; coordinar\nla semana en que ingresará cada embarcación y deberán notificar al Departamento\nde Registro y al Departamento de Fiscalización del Incopesca\nel cronograma con la fecha y hora de ingreso de cada embarcación a la zona\nestablecida durante la temporada de veda.\n\n3º-Que todas las descargas que se realicen por parte de la flota semi-industrial bolichera de\nsardina serán debidamente inspeccionadas por parte de los inspectores de la Institución. Dicha\ninspección debe cubrir no solo las descargas de sardina, sino también la de fauna de acompañamiento.\nA su vez el Departamento de Investigación Pesquera realizará muestreos biológicos de dichas capturas\npara evaluar el comportamiento reproductivo de las sardinas y el cumplimiento de la talla legal de\nprimera captura.\n\n4º-Mientras no se cuente con nuevas investigaciones, se recomienda mantener\nla veda de sardina en las condiciones establecidas en el acuerdo AJDIP/049-2020.\n\n5º-Acuerdo\nen firme.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 040\n\n                        Decrees a closed season for sardine fishing with any fishing gear\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nAJDIP/040-2023.-Puntarenas, on the twenty-eighth day of the month\nof February two thousand twenty-three.\n\nConsidering:\n\n1º-That through Board of Directors agreement AJDIP/049-2020,\na closed season was established for semi-industrial\nsardine purse-seine (bolichera (cerco)) fishing, in the area comprised by an imaginary line\nrunning from Punta Agujas (84°38´57´´Longitud Oeste, 09°43´46´´ Latitud Norte)\nto the outer lighthouse of Isla Negritos (84°49´35´´ Longitud Oeste, 09°49´14´´\nLatitud Norte) and from there to the eastern part of Punta Cuchillo on the\nNicoya Peninsula (09°50´03\"Latitud Norte, 084°53´42\" Longitud\nOeste) and from these lines seaward to the mouth of the Tempisque River;\nfrom March 1 through May 31\n\n2º-That Board of Directors agreement AJDIP/049-2020 established the sardine closed season on a\npermanent basis for at least 5 years, until such time as new scientific research\ndetermines a change to the agreement.\n\n3º-That additionally, official memorandum INCOPESCA-DOPA-009-2023 is presented, in\nrelation to the study carried out by the Research Department, for the\ncharacterization of catches made by the semi-industrial\nsardine fleet during the months of June and July (small-scale closed season), in\nZone C of the Golfo de Nicoya, as provided by Board of Directors agreement\nAJDIP/100-2021.\n\n4º-That in accordance with the preceding considering clause, a biologist observer\nfrom the Fisheries Research Department of INCOPESCA worked aboard\neach of the semi-industrial sardine purse-seine (bolichera (cerco))\nvessels during the aforementioned period to determine the\ncatch ratio between the target species (sardina Ophistonema\nsp) and non-target species or bycatch\n(corvina, jureles, macarela, barracuda, among others).\n\n5º-That bycatch for sardine fishing in the study conducted\nin the year 2022 represented less than 3% of the total catch of the vessels\nand falls within the maximum 10% tolerance margin as\nestablished by Board of Directors agreement AJDIP/049-2020.\n\n6º-That the Directorate of Fisheries and Aquaculture Management will additionally\nestablish the corresponding measures to ensure that all\nlandings made as part of this agreement are duly\ninspected by the Enforcement Department. Surpluses may be\nmarketed for other purposes as established in Board of Directors\nagreement AJDIP/100-2021. This access will be used in 12-hour daytime\nwindows, each on an alternating weekly basis by each vessel, such that the 2 vessels\nmay not be within said area in the same week, and\nprior to their entry, their owners, shipowners, or Captain must coordinate\nthe week in which each vessel will enter and must notify the\nRegistration Department and the Enforcement Department of Incopesca\nof the schedule with the date and time of entry of each vessel into the established\nzone during the closed season.\n\n3º-That all landings carried out by the semi-industrial sardine purse-seine fleet will be\nduly inspected by the Institution's inspectors. Said\ninspection must cover not only sardine landings, but also that of the bycatch fauna.\nIn turn, the Fisheries Research Department will conduct biological sampling of said catches\nto evaluate the reproductive behavior of sardines and compliance with the legal minimum size\nof first capture.\n\n4º-As long as no new research is available, it is recommended to maintain\nthe sardine closed season under the conditions established in agreement AJDIP/049-2020.\n\n5º-Agreement\nis final. Let it be published and communicated. Takes effect as of March 01,\n2023."
