veintitrés.\n\nCONSIDERANDO\n\n1. Que la Dirección de\nOrdenamiento Pesquero y Acuícola luego de coordinar una reunión con los representantes\nde pesca comercial de pequeña escala y la flota semiindustrial\nde sardina; así como, la Comisión Nacional de Vedas, mediante oficio\nINCOPESCA-DOPA-040-2023 recomienda las condiciones para la veda en el Golfo de\n-Nicoya, ratificando además el criterio técnico brindado por el Departamento de\nInvestigación mediante oficio INCOPESCA-DOPA-DINV-024-2023.\n\n2. Que el INCOPESCA cuenta\ncon estudios científicos que fundamentan el establecimiento de este periodo de\nveda en las fechas propuestas.\n\n3. Que mediante oficio DOPA-014-2023, se presentan los resultados de la investigación sobre la\ncaptura de fauna de acompañamiento en la pesca semi-industrial de las especies de Sardina del\ncomplejo Ophistonema sp., en el Golfo de Nicoya, realizado por el Departamento de Investigación, en\nel cual se volvió a confirmar que la captura incidental para la pesca de sardina, representa menos\ndel 3% de la captura total de dichas embarcaciones; lo cual no es significativo y se ubica dentro\ndel 10% máximo del margen de tolerancia permitido conforme a lo normado mediante el punto 1.4. del\nacuerdo de junta directiva 100-2021\n\n4. Que mediante el acuerdo\nde Junta Directiva AJDIP/040-2023, de fecha 28-02-2023, se ratificó el informe\nde investigación citado anteriormente.\n\n5. Que se presenta para\nestudio y valoración la propuesta de veda total en el Golfo de Nicoya, para la\npesca durante el año 2023.\n\n6. Que en la actividad\npesquera del Golfo de Nicoya se ha venido desarrollando una nueva actividad de\npesca comercial turística de pequeña escala, quienes se han incorporado al seno\nde la Comisión Nacional de Vedas.\n\n7. Que una vez discutida y\nanalizada la propuesta por los señores directores, Junta Directiva del\nInstituto Costarricense de Pesca y Acuicultura, POR TANTO;\n\nACUERDA\n\n1. Establecer una veda\ntotal para la pesca deportiva y pesca comercial en pequeña escala, excepto para\nla pesca turística comercial de pequeña escala, en el periodo que va desde el\n01 de mayo hasta el 31 de julio del 2023, ambas fechas incluidas, en el área\ndelimitada por una línea recta imaginaria que va desde Punta Torres conocida\ncomo Peñón (09°53´31\" Latitud Norte, 084°43´52\" Longitud Oeste) al\nFaro de la Isla Negritos afuera (09°49´14\" Latitud Norte, 084°49´35\"\nLongitud Oeste) y desde ahí hasta la parte Este de Punta Cuchillos en la\nPenínsula de Nicoya (09°50´03\" Latitud Norte, 084°53´42\" Longitud\nOeste) y de ahí aguas adentro hasta la desembocadura del río Tempisque, según\nse observa en el mapa adjunto.\n\n2. Durante los meses de junio y julio del 2023, se permite el ingreso a las embarcaciones\nsemiindustriales sardineras, para faenar únicamente en el área definida por una línea imaginaria que\ninicia en Punta Torres conocida como Peñón (09°53´31\" Latitud Norte, 084°43´52\" Longitud Oeste) al\nFaro de la Isla Negritos afuera (09°49´14\" Latitud Norte, 084°49´35\" Longitud Oeste) y desde ahí\nhasta la parte Este de Punta Cuchillos en la Península de Nicoya (09°50´03\" Latitud Norte,\n084°53´42\" Longitud Oeste) y de ahí hasta el Faro de Puntarenas (9° 58´ 36.03´´ Latitud Norte 84°\n51´ 03.93´´Longitud Oeste), a efectos que suplan sardina para carnada a la flota pesquera nacional y\nlos excedentes podrán ser comercializados para otros fines según lo establecido.\n\n3. Que todas las descargas\nque se realicen por parte de la flota semi-industrial\nbolichera de sardina serán debidamente inspeccionadas por parte de los\ninspectores de la Institución. Dicha inspección debe cubrir no solo las\ndescargas de sardina, sino también la de fauna de acompañamiento. A su vez el\nDepartamento de Investigación realizará muestreos biológicos de dichas capturas\npara evaluar el comportamiento reproductivo de las sardinas y que las tallas\ncapturadas cumplan con las tallas legales de primera captura.\n\n4. Que se establece una\ncuota de captura incidental máxima del 10%, con respecto a la captura total de\nsardina por parte de los barcos de la flota semi-industrial\nbolichera de sardina.\n\n5. Se autoriza únicamente\nla pesca de barracudas o candado (Sphyraena\nensis) a los pescadores que así lo tengan\nautorizado en su licencia de pesca para faenar con cuerda de mano, durante los\nmeses de mayo, junio y julio del 2023.\n\n6. En el caso de la pesca\ncomercial turística de pequeña escala que se ha venido incorporando a la\nactividad pesquera en el Golfo de Nicoya, dado que no se ha establecido un\nanálisis en el seno de la Comisión de Veda para evaluar adecuadamente las\ncaracterísticas de esta actividad en el sentido de si pueden calificar para el\nauxilio económico que se otorga durante esta prohibición y dado que son pocos\nlos permisionarios, se les autorizará la pesca únicamente en el área definida\npor una línea imaginaria que se extiende desde el Faro de Puntarenas (9° 58´\n36.03´´ Latitud Norte 84° 51´ 03.93´´Longitud Oeste) hasta el extremo este de\nPunta Cuchillo (09°50´03\" Latitud Norte, 084°53´42\" Longitud Oeste)\naguas afuera hacia la parte oceánica.\n\n7. En esta veda no se\nincluye la extracción de pianguas. Los cultivos de\norganismos marinos que se desarrollan en el Golfo de Nicoya no están sujetos a\nesta veda.\n\n8. Tomando en consideración\nla difícil situación socioeconómica de las comunidades costeras, se permitirá\nen la zona comprendida en el punto 1 de este acuerdo, la pesca para el consumo\ndoméstico durante la presente veda. Quienes opten por realizar esta pesca,\ndeberán cumplir con la normativa según lo establecido por el acuerdo de Junta\nDirectiva AJDIP-511-2017.\n\n9. Realizar las\ncoordinaciones pertinentes entre el INCOPESCA, SENASA y el Ministerio de\nSeguridad Pública, con el fin de garantizar los operativos de control y vigilancia\ndurante la época de veda.\n\n10. Se deja sin efecto\ndurante este año 2023, lo establecido en el acuerdo AJDIP-166-2017\n\"Regulación para el cumplimiento del Servicio de Trabajo Comunal por parte\ndel pescador inscrito en Veda\".\n\n11. En el caso de aquellos pescadores que teniendo\nen su licencia de pesca la posibilidad de realizar faenas de pesca fuera de la\nzona objeto de veda, establecida en el inciso número uno del presente acuerdo y\ndecidan no acogerse a la veda, podrán realizar la entrega directa de los documentos\nque corresponda al Departamento de Registro del INCOPESCA para su tramitación,\no bien coordinar con las Asociaciones de Pescadores que los representan para\nque dicha organización prepare una lista de los pescadores en esta condición.\nDicha lista debe contener el nombre y número de cedula de cada pescador, el\nnúmero de carne de pesca comercial y su fecha de vencimiento, nombre de la\nembarcación y número de matrícula, asimismo, todos tripulantes están obligados\na portar el carné de pesca vigente. La organización deberá presentar dicha\nlista ante el Departamento de Registro del Incopesca,\nasí como, los permisionarios que decidan realizar el trámite personalmente, con\nel fin de poder ejercer la actividad de pesca fuera del área vedada, conforme a\nlas condiciones establecidas en la licencia de pesca respectiva y poder\nsolicitar el beneficio del combustible a precio competitivo. El Departamento de\nRegistro, deberá trasladar dicho listado al Servicio Nacional de Guardacostas.\nLo establecido en el presente inciso aplica únicamente para aquellas\nembarcaciones que puedan faenar fuera de la zona objeto de la presente veda.\n\n(Así reformado el párrafo anterior por acuerdo N° AJDIP/092-2023\ndel 2 de mayo de 2023)\n\n12. That the Directorate of\nFisheries and Aquaculture Management, after coordinating a meeting with representatives\nof small-scale commercial fishing and the semi-industrial sardine fleet;\nas well as the National Closures Commission, by official communication\nINCOPESCA-DOPA-040-2023 recommends the conditions for the closure in the Gulf of\nNicoya, also ratifying the technical opinion provided by the Research\nDepartment by official communication INCOPESCA-DOPA-DINV-024-2023.\n\n2. That INCOPESCA has\nscientific studies that support the establishment of this closure\nperiod on the proposed dates.\n\n3. That the proposal for a total closure in the Gulf of Nicoya for\nfishing during the year 2023 is presented for study and assessment.\n\n6. That in the fishing\nactivity of the Gulf of Nicoya, a new activity of\nsmall-scale commercial tourist fishing has been developing, whose representatives have joined the\nNational Closures Commission.\n\n7. That once the proposal was discussed and\nanalyzed by the directors, the Board of Directors of the\nCosta Rican Institute of Fisheries and Aquaculture, THEREFORE;\n\nAGREES\n\n1. To establish a total\nclosure for sport fishing and small-scale commercial fishing, except for\nsmall-scale commercial tourist fishing, during the period from\nMay 1 to July 31, 2023, both dates inclusive, in the area\nbounded by an imaginary straight line running from Punta Torres known\nas Peñón (09°53´31\" North Latitude, 084°43´52\" West Longitude) to the\nIsla Negritos Outer Lighthouse (09°49´14\" North Latitude, 084°49´35\"\nWest Longitude) and from there to the eastern part of Punta Cuchillos on the\nNicoya Peninsula (09°50´03\" North Latitude, 084°53´42\" West\nLongitude) and from there inshore to the mouth of the Tempisque River, as\nshown on the attached map.\n\n2. During the months of June and July 2023, semi-industrial sardine purse seiner vessels are permitted to enter to operate solely in the area defined by an imaginary line that\nstarts at Punta Torres known as Peñón (09°53´31\" North Latitude, 084°43´52\" West Longitude) to the\nIsla Negritos Outer Lighthouse (09°49´14\" North Latitude, 084°49´35\" West Longitude) and from there\nto the eastern part of Punta Cuchillos on the Nicoya Peninsula (09°50´03\" North Latitude,\n084°53´42\" West Longitude) and from there to the Puntarenas Lighthouse (9° 58´ 36.03´´ North Latitude 84°\n51´ 03.93´´ West Longitude), for the purpose of supplying sardine for bait to the national fishing fleet and\nany surplus may be marketed for other purposes as established.\n\n3. That all landings\nmade by the semi-industrial sardine purse seiner fleet shall be duly inspected by the\nInstitution's inspectors. Said inspection must cover not only\nthe landings of sardine, but also those of bycatch (fauna de acompañamiento). In turn, the\nResearch Department will carry out biological sampling of said catches\nto evaluate the reproductive behavior of the sardines and to ensure that the sizes\ncaught comply with the legal minimum catch sizes.\n\n4. That a maximum\nincidental catch quota of 10% is established, relative to the total catch of\nsardine by the boats of the semi-industrial\nsardine purse seiner fleet.\n\n5. Fishing for barracuda or candado (Sphyraena\nensis) is authorized only for fishers who are\nauthorized in their fishing license to operate with handline, during the\nmonths of May, June, and July 2023.\n\n6. In the case of small-scale\ncommercial tourist fishing that has been developing as part of the\nfishing activity in the Gulf of Nicoya, given that an\nanalysis has not been established within the Closures Commission to adequately evaluate the\ncharacteristics of this activity in terms of whether they can qualify for the\neconomic aid granted during this prohibition and given that there are few\npermit holders, they will be authorized to fish solely in the area defined\nby an imaginary line extending from the Puntarenas Lighthouse (9° 58´\n36.03´´ North Latitude 84° 51´ 03.93´´ West Longitude) to the eastern end of\nPunta Cuchillo (09°50´03\" North Latitude, 084°53´42\" West Longitude)\noffshore towards the oceanic part.\n\n7. The extraction of pianguas (pianguas) is not included\nin this closure. Marine organism cultivation\nactivities carried out in the Gulf of Nicoya are not subject to\nthis closure.\n\n8. Taking into consideration\nthe difficult socioeconomic situation of the coastal communities, fishing for domestic\nconsumption will be permitted in the zone covered in point 1 of this agreement\nduring the current closure. Those who choose to carry out this fishing\nmust comply with the regulations established by Board of Directors\nagreement AJDIP-511-2017.\n\n9. Carry out the\npertinent coordination among INCOPESCA, SENASA, and the Ministry of\nPublic Security, in order to guarantee control and surveillance operations\nduring the closure period.\n\n10. What is established in agreement AJDIP-166-2017,\n\"Regulation for the fulfillment of Community Work Service by the\nfisher registered during Closure,\" is rendered without effect\nduring this year 2023.\n\n11. In the case of fishers who have in\ntheir fishing license the possibility of carrying out fishing operations outside the\nzone subject to closure, established in point one of this agreement, and\nwho decide not to avail themselves of the closure, they may directly submit the documents\nas appropriate to the Registration Department of INCOPESCA for processing,\nor coordinate with the Fishers' Associations that represent them so\nthat said organization prepares a list of the fishers in this condition.\nSaid list must contain the name and identification number of each fisher, the\ncommercial fishing license number and its expiration date, the name of the\nvessel and registration number, likewise, all crew members are required\nto carry a valid fishing license. The organization must submit said\nlist to the Registration Department of Incopesca,\nas well as the permit holders who decide to carry out the process personally, so\nas to be able to engage in fishing activity outside the closed area, in accordance with\nthe conditions established in the respective fishing license and to be able to\nrequest the benefit of competitively priced fuel. The Registration\nDepartment must forward said list to the National Coast Guard Service.\nWhat is established in this point applies only to those\nvessels that can operate outside the zone subject to this closure.\n\n(Thus amended the preceding paragraph by agreement No. AJDIP/092-2023\nof May 2, 2023)\n\n12.
