  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 004\n\n                        Delimitación de un sector de zona pública correspondiente al Estero-Manglar\nCopal, distrito 04° quebrada honda, cantón 02° Nicoya, provincia 05° Guanacaste\n\nINSTITUTO GEOGRÁFICO NACIONAL\n\nAVISO N.º 004-2023\n\nZONA MARÍTIMO TERRESTRE\n\nDelimitación de un Sector De Zona Pública\n\nCorrespondiente al Estero-Manglar Copal,\n\ndistrito 04º quebrada honda, cantón\n\n02º Nicoya, provincia\n\n05º Guanacaste\n\nCon fundamento en lo dispuesto en los artículos 140 y\n240 de la Ley Nº6227 Ley General de la Administración Pública de fecha 2 de\nmayo de 1978 y sus reformas; Ley Nº59 Ley de Creación y Organización del\nInstituto Geográfico Nacional del 4 de julio de 1944 y sus reformas; Ley Nº8905\nReforma del artículo 2 de la ley N° 5695, Creación del Registro Nacional, y sus\nreformas; y modificación de la ley N° 59, Creación y Organización del Instituto\nGeográfico Nacional, de 4 de julio de 1944, y sus reformas de fecha 7 de\ndiciembre del 2010; Ley Nº6043 Ley sobre la Zona Marítimo Terrestre del 2 de\nmarzo de 1977, con su respectivo reglamento; y artículos 2 y 3 de la Ley Nº5695\nLey de Creación del Registro Nacional de fecha 28 de mayo .-e 1975 y sus\nreformas.\n\nConsiderando:\n\n1°-Que mediante Ley Nº8905 se establece el Instituto\nGeográfico Nacional, en adelante IGN, como una dependencia del Registro\nNacional, quien suscribirá los contratos y convenios necesarios para el\nejercicio de sus funciones. Asimismo, de conformidad con la Ley Nº59, el IGN es\nla dependencia científica y técnica rectora de la cartografía nacional,\ndestinada a la ejecución del Mapa básico oficial y la Descripción básica\ngeográfica de la República de Costa Rica y a los estudios, las investigaciones\no labores y el desarrollo de políticas nacionales de carácter cartográfico,\ngeográfico, geodésico, geofísico y de índole similar que tenga relación con\ndichas obras, con el fin de apoyar los procesos de planificación.\n\n2°-Que la Ley Nº59 constituye al IGN de manera\npermanente y en representación del Estado, como la autoridad oficial en materia\ngeodésica y de la representación espacial de la geografía de la República de\nCosta Rica, extendiéndose su autoridad a las actividades de cualquier orden que\ntengan por origen los trabajos confiados a su cargo.\n\n3°-Que de conformidad con la Ley Nº59; el artículo 62\ndel Decreto Ejecutivo N°7841-P denominado Reglamento a la Ley sobre la Zona\nMarítimo Terrestre se reconoce la competencia del IGN para la delimitación de\nla zona pública de la Zona Marítimo Terrestre, y su oficialización a través de\npublicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto\nEjecutivo N°7841-P señala que El Instituto Geográfico Nacional deberá publicar\naviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en\nque haya demarcado la zona pública.\n\n4°-Que en el Decreto Ejecutivo N°36642-MP-MOPT-MINAET\nReglamento de Especificaciones para la Delimitación de la zona pública de la\nZona Marítimo Terrestre, se establece según el artículo 18 que para la\ndelimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá\nacudir a dos metodologías de ejecución, que se indican en los artículos 19 y\n20, correspondientes a la delimitación de la zona pública de la Zona Marítimo\nTerrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada,\nesto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad\ntécnica a los interesados.\n\n5°-Que en el Decreto Ejecutivo N°33797-MJ-MOPT Declara\ncomo datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional\nde Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la\nTierra (IERS) para la época de medición 2005.83, el cual entre otros aspectos\ndetermina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su\nproyección cartográfica asociada CRTM05, como el sistema oficial al cual deben\nestar referidas las coordenadas de todos los trabajos geodésicos, cartográficos\ny catastrales que se ejecuten en nuestro país, señalando específicamente en\nartículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y el\nsistema de proyección cartográfica CRTM05, constituirán el único sistema\noficial de coordenadas para la República de Costa Rica a partir del cual se\ndebe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública,\npersona o entidad privada nacional o extranjera.\" ; mientras que el artículo 7\nindica que \"Conforme se produzcan datos cartográficos en el nuevo sistema de\nproyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por\nlos medios adecuados aquella información que se ha oficializado.\"\n\n6°-Que el Decreto Ejecutivo Nº40962-MJP Actualización\ndel Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara\nen su artículo 1 que El sistema geodésico de referencia horizontal oficial para\nCosta Rica, denominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), para la época de\nmedición 2014.59, y en adelante, los cambios y su actualización, se regirán de\nacuerdo a las nuevas definiciones del ITRF que se implementen en la red\ncontinental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS)\ndenominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de\nproyección cartográfica CRTM05 seguirá siendo el oficial para la representación\ncartográfica del territorio nacional continental, extendido para efectos de\naplicación de esta proyección cartográfica, hasta la línea de base del mar\nterritorial en el océano Pacífico y el mar Caribe, definida esta línea conforme\na los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el\nDerecho del Mar, como punto de partida para el cómputo de la anchura máxima de\ntodas las áreas marinas jurisdiccionales del Estado costarricense.\n\nPor su parte, el artículo 12 del decreto de cita,\nrefuerza la aplicación de la proyección cartográfica CRTM05 como el sistema\nnacional de coordenadas oficial a la cual se deben referenciar en el territorio\ncontinental de nuestro país, al señalar que El sistema de referencia horizontal\nCRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio\ncontinental extendido hasta la línea de base del mar territorial y, la\nproyección cartográfica \"Universal Transversal de Mercator\" (UTM), zonas 16 y\n17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y\nel mar Caribe, constituirán el único sistema oficial de coordenadas para la\nRepública de Costa Rica, a partir del cual, se deben referenciar todos los\nlevantamientos y actividades cartográficos y geodésicos que desarrollen en el\nterritorio nacional toda dependencia pública, persona o entidad privada,\nnacional o extranjera, que emprendan o contraten trabajos geodésicos y\ncartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra\nparte, información geográfica confiable, uniforme y comparable, que sea de\nutilidad general y que apoye la toma de decisiones en los distintos niveles del\nEstado.\n\n7°-Que la georreferenciación al sistema nacional de\ncoordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo\nTerrestre, posibilita la correcta delimitación de la zona pública a los efectos\nde la elaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n8°-Que la información digital georreferenciada sobre\ndelimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el\nIGN, se le denomina Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT)\nse fundamenta técnicamente en aplicación de la regulación establecida por: a)\nel Decreto Ejecutivo N°7841-P Reglamento a la Ley No. 6043 sobre la Zona\nMarítimo Terrestre, b) el Decreto Ejecutivo N°33797-MJ-MOPT Declara como datum\nhorizontal oficial para Costa Rica, el CR05, y su proyección cartográfica\nasociada, CRTM05, y c) el Decreto Ejecutivo N°36642-MP-MOPT-MINAET Reglamento\nde Especificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre.\n\ntext-align:\njustify;text-indent:36.0pt'>10.-Que el artículo 16 de la\nLey Forestal, Ley N°7575 del 13 de febrero de 1996 y sus reformas, establece\nque el Ministerio del Ambiente y Energía delimitará en el terreno los linderos\nde las áreas que conforman el Patrimonio Natural del Estado.\n\n11.-Que según el artículo 11 del CAPÍTULO I,\nDisposiciones Generales de la Ley N°6043, establece que la Zona pública es\ntambién, sea cual fuere su extensión, la ocupada por todos los manglares de los\nlitorales continentales e insulares y esteros del territorio nacional.\n\n12.-Que el Decreto Ejecutivo N°36786-MINAET Manual\npara la clasificación de tierras dedicadas a la conservación de los recursos naturales\ndentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta Nº217\ndel 11 de noviembre del 2011, establece entre sus objetivos Identificar dentro\nde la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques,\nde aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros,\nrías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para\ncertificarlos e incorporarlos como parte del Patrimonio Natural del Estado\n(PNE).\n\n13.-Que el Decreto Ejecutivo N°36786-MINAET en el\npunto III.-Competencias para la delimitación y certificación establece que La\nclasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de\nConservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales\nprivados debidamente acreditados por los Colegios Profesionales respectivos\npara que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase\nVII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos,\nbosques anegados, salitrales) y humedales.\n\nLa validez de los documentos de clasificación emitidos\npor profesionales privados quedará sujeta a la aprobación que emita el AC que\npor competencia territorial le corresponda. A las AC del SINAC con jurisdicción\nen la ZMT les competerá, además, la verificación, fiscalización, deslinde y\ncertificación de las tierras del Patrimonio Natural del Estado y las zonas de\nprotección. La ubicación y delimitación de las áreas del Patrimonio Natural del\nEstado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del\nproceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley\n6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento\nterritorial, que define y ubica todas las zonas a concesionar dentro de la ZMT\ny para la clasificación de ésta a nivel de los planos de catastro. Por tanto,\nel Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE\npara no contabilizarlas en el área total a concesionar.\n\n14.-A solicitud de parte de Geiner Montes Cárdenas,\ncédula número 602300034, el Área de Conservación Tempisque, del Sistema de\nÁreas de Conservación del Ministerio de Ambiente y Energía lleva a cabo el\nproceso de demarcación en campo del área y delimitación del manglar Copal, ubicado\ncerca de Copal, localizado en el distrito 04° Quebrada Honda, cantón 02º\nNicoya, provincia 05º Guanacaste.\n\n15.-Se utilizó la metodología de Delimitación de\nMojones Georreferenciados, para delimitar la zona pública de la Zona Marítimo\nTerrestre del manglar Copal, en distrito 04° Quebrada Honda, cantón 02º Nicoya,\nprovincia 05º Guanacaste.\n\n16.-Que la delimitación cuenta\ncon aval técnico interno conforme el informe de Revisión Técnica\nN°DIG-TOT-INF-0035-2023 del 28 de febrero de 2023, emitido por el Subproceso de\nLímites Oficiales del Departamento Topográfico y Observación del Territorio del\nInstituto Geográfico Nacional.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 004\n\n                        Delimitation of a sector of public zone corresponding to the Copal Estuary-Mangrove,\n04° district Quebrada Honda, 02° canton Nicoya, 05° province Guanacaste\n\nINSTITUTO GEOGRÁFICO NACIONAL\n\nNOTICE No. 004-2023\n\nMARITIME TERRESTRIAL ZONE\n\nDelimitation of a Sector of Public Zone\n\nCorresponding to the Copal Estuary-Mangrove,\n\n04º district Quebrada Honda, canton\n\n02º Nicoya, province\n\n05º Guanacaste\n\nBased on the provisions of articles 140 and 240 of Law No. 6227, General Public Administration Law of May 2, 1978, and its amendments; Law No. 59, Law for the Creation and Organization of the Instituto Geográfico Nacional of July 4, 1944, and its amendments; Law No. 8905, Amendment of article 2 of Law No. 5695, Creation of the National Registry, and its amendments; and modification of Law No. 59, Creation and Organization of the Instituto Geográfico Nacional, of July 4, 1944, and its amendments, dated December 7, 2010; Law No. 6043, Law on the Maritime Terrestrial Zone of March 2, 1977, with its respective regulations; and articles 2 and 3 of Law No. 5695, Law for the Creation of the National Registry of May 28, 1975, and its amendments.\n\nConsidering:\n\n1°—That through Law No. 8905, the Instituto Geográfico Nacional, hereinafter IGN, is established as a dependency of the National Registry, which shall sign the necessary contracts and agreements for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is the scientific and technical dependency governing national cartography, destined for the execution of the official basic Map and the basic geographic Description of the Republic of Costa Rica, and for studies, research, or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to such works, in order to support planning processes.\n\n2°—That Law No. 59 permanently constitutes the IGN, in representation of the State, as the official authority in geodetic matters and in the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any order originating from the work entrusted to it.\n\n3°—That in accordance with Law No. 59; article 62 of Executive Decree No. 7841-P, denominated Regulations to the Law on the Maritime Terrestrial Zone, recognizes the competence of the IGN for the delimitation of the public zone of the Maritime Terrestrial Zone, and its formalization through publication in the Official Gazette La Gaceta; article 63 of Executive Decree No. 7841-P indicates that the Instituto Geográfico Nacional must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone where it has demarcated the public zone.\n\n4°—That in Executive Decree No. 36642-MP-MOPT-MINAET, Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone, it is established according to article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may use two methodologies of execution, indicated in articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or georeferenced digital delimitation, this in order to streamline delimitations and provide greater technical security to interested parties.\n\n5°—That in Executive Decree No. 33797-MJ-MOPT, Declares CR05 as the official horizontal datum for Costa Rica, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, which among other aspects determines the National Geodetic Network for Horizontal Reference CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in article 11 that: \"The National Geodetic Network for Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the National Territory by any public agency, person, or private national or foreign entity must be referenced.\" ; while article 7 indicates that \"As cartographic data is produced in the new cartographic projection system CRTM05, the Instituto Geográfico Nacional shall publish, through appropriate means, any information that has been made official.\"\n\n6°—That Executive Decree No. 40962-MJP, Update of the Official Horizontal Reference Geodetic System for Costa Rica, declares in its article 1 that the official horizontal reference geodetic system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, changes and its updating shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) denominated SIRGAS-CON, while article 2 establishes that The cartographic projection system CRTM05 shall continue to be official for the cartographic representation of the national continental territory, extended for the purposes of applying this cartographic projection to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance with articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for computing the maximum breadth of all jurisdictional marine areas of the Costa Rican State.\n\nFor its part, article 12 of the cited decree reinforces the application of the cartographic projection CRTM05 as the official national coordinate system to which referencing must be made in the continental territory of our country, by stating that The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea and, the \"Universal Transverse Mercator\" (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the national territory by any public agency, person, or private entity, national or foreign, undertaking or contracting geodetic and cartographic work must be referenced, thereby contributing to avoiding public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information that is of general utility and supports decision-making at different levels of the State.\n\n7°—That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), the approval of cadastral plans (planos de agrimensura), the granting of concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal territorial planning.\n\n8°—That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n9°—That the Digital Georeferenced Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P, Regulations to Law No. 6043 on the Maritime Terrestrial Zone, b) Executive Decree No. 33797-MJ-MOPT, Declares CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05, and c) Executive Decree No. 36642-MP-MOPT-MINAET, Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone.\n\n10.—That article 16 of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, and its amendments, establishes that the Ministry of Environment and Energy shall delimit in the field the boundaries of the areas that constitute the Natural Heritage of the State (Patrimonio Natural del Estado).\n\n11.—That according to article 11 of CHAPTER I, General Provisions of Law No. 6043, establishes that the public zone is also, whatever its extension, that occupied by all mangroves of the continental and insular coastlines and estuaries of the national territory.\n\n12.—That Executive Decree No. 36786-MINAET, Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica, published in La Gaceta No. 217 of November 11, 2011, establishes among its objectives to Identify within the Maritime Terrestrial Zone those lands that classify as forests, of forestry aptitude (Class VII and VIII soils), wetlands (mangroves, estuaries, rías, salt marshes, coastal lagoons, swamps, flooded forests, salt flats), to certify them and incorporate them as part of the Natural Heritage of the State (PNE).\n\n13.—That Executive Decree No. 36786-MINAET, in point III.—Competencies for delimitation and certification, establishes that The classification of lands within the ZMT shall correspond to the Conservation Areas (Áreas de Conservación, AC) of the National System of Conservation Areas (SINAC) and to private professionals duly accredited by the respective Professional Associations to classify forests, lands of forestry aptitude (Class VII and VIII soils), (mangroves, estuaries, rías, salt marshes, coastal lagoons, swamps, flooded forests, salt flats), and wetlands.\n\nThe validity of classification documents issued by private professionals shall be subject to the approval issued by the AC with corresponding territorial jurisdiction. The ACs of SINAC with jurisdiction over the ZMT shall also be responsible for the verification, oversight, demarcation (deslinde), and certification of the lands of the Natural Heritage of the State and protection zones. The location and delimitation of the areas of the Natural Heritage of the State within the Maritime Terrestrial Zone must be carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all zones to be concessioned within the ZMT and for its classification at the level of cadastral maps (planos de catastro). Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the areas of the PNE so as not to count them in the total area to be concessioned.\n\n14.—At the request of Geiner Montes Cárdenas, identity card number 602300034, the Tempisque Conservation Area (Área de Conservación Tempisque) of the System of Conservation Areas of the Ministry of Environment and Energy carries out the process of field demarcation of the area and delimitation of the Copal mangrove, located near Copal, located in 04° district Quebrada Honda, 02º canton Nicoya, 05º province Guanacaste.\n\n15.—The methodology of Georeferenced Boundary Markers (Mojones) Delimitation was used to delimit the public zone of the Maritime Terrestrial Zone of the Copal mangrove, in 04° district Quebrada Honda, 02º canton Nicoya, 05º province Guanacaste.\n\n16.—That the delimitation has internal technical endorsement according to the Technical Review Report No. DIG-TOT-INF-0035-2023 of February 28, 2023, issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the Instituto Geográfico Nacional.
