fecha\n2 de mayo de 1978 y sus reformas; Ley N° 59 Ley de Creación y Organización\ndel Instituto Geográfico Nacional del 4 de julio de 1944 y sus reformas;\nLey N° 8905 Reforma del artículo 2 de la ley N° 5695, Creación del Registro\nNacional, y sus reformas; y modificación de la ley N° 59, Creación y\nOrganización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus\nreformas de fecha 7 de diciembre del 2010; Ley N° 6043 Ley sobre la Zona\nMarítimo Terrestre del 2 de marzo de 1977, con su respectivo reglamento; y artículos\n2 y 3 de la Ley N° 5695 Ley de Creación del Registro Nacional de fecha\n28 de mayo de 1975 y sus reformas.\n\nConsiderando:\n\n1.-Que mediante Ley N° 8905 se establece el Instituto\nGeográfico Nacional, en adelante IGN, como una dependencia del Registro\nNacional, quien suscribirá los contratos y convenios necesarios para el\nejercicio de sus funciones. Asimismo, de conformidad con la Ley N° 59, el IGN es\nla dependencia científica y técnica rectora de la cartografía nacional,\ndestinada a la ejecución del Mapa básico oficial y la Descripción básica\ngeográfica de la República de Costa Rica y a los estudios, las investigaciones\no labores y el desarrollo de políticas nacionales de carácter cartográfico,\ngeográfico, geodésico, geofísico y de índole similar que tenga relación con\ndichas obras, con el fin de apoyar los procesos de planificación.\n\n2.-Que la Ley N° 59 constituye al IGN de manera\npermanente y en representación del Estado, como la autoridad oficial en materia\ngeodésica y de la representación espacial de la geografía de la República de\nCosta Rica, extendiéndose su autoridad a las actividades de cualquier orden que\ntengan por origen los trabajos confiados a su cargo.\n\n3.-Que de conformidad con la Ley N° 59; el artículo 62\ndel Decreto Ejecutivo N°7841-P denominado Reglamento a la Ley sobre la Zona\nMarítimo Terrestre se reconoce la competencia del IGN para la delimitación\nde la zona pública de la Zona Marítimo Terrestre, y su oficialización a través\nde publicación en el Diario Oficial La Gaceta; el artículo 63 del\nDecreto Ejecutivo N° 7841-P señala que El Instituto Geográfico Nacional\ndeberá publicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública.\n\n4.-Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET\nReglamento de Especificaciones para la Delimitación de la zona pública de la\nZona Marítimo Terrestre, se establece según el artículo 18 que para la\ndelimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá\nacudir a dos metodologías de ejecución, que se indican en los artículos 19 y\n20, correspondientes a la delimitación de la zona pública de la Zona Marítimo\nTerrestre a través de la colocación de mojones y/o a la delimitación digital\ngeorreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar\nmayor seguridad técnica a los interesados.\n\n5.-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT Declara\ncomo datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco\nInternacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de\nRotación de la Tierra (IERS) para la época de medición 2005.83, el cual\nentre otros aspectos determina, a la Red Geodésica Nacional de Referencia\nHorizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema\noficial al cual deben estar referidas las coordenadas de todos los trabajos\ngeodésicos, cartográficos y catastrales que se ejecuten en nuestro país,\nseñalando específicamente en artículo 11 que: \"La Red Geodésica Nacional de\nReferencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05,\nconstituirán el único sistema oficial de coordenadas para la República de Costa\nRica a partir del cual se debe referenciar todos los levantamientos y\nactividades cartográficos y geodésicos que desarrollen en el Territorio\nNacional toda dependencia pública, persona o entidad privada nacional o extranjera.\"\n; mientras que el artículo 7 indica que \"Conforme se produzcan datos\ncartográficos en el nuevo sistema de proyección cartográfica CRTM05, el\nInstituto Geográfico Nacional publicará por los medios adecuados aquella\ninformación que se ha oficializado.\"\n\n6.-Que el Decreto Ejecutivo N° 40962-MJP Actualización\ndel Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara\nen su artículo 1 que El sistema geodésico de referencia horizontal oficial para\nCosta Rica, denominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica, enlazado al Marco\nInternacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición\n2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a\nlas nuevas definiciones del ITRF que se implementen en la red continental del\nSistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada\nSIRGAS-CON, mientras que el artículo 2 establece que El sistema de proyección\ncartográfica CRTM05 seguirá siendo el oficial para la representación\ncartográfica del territorio nacional continental, extendido para efectos de\naplicación de esta proyección cartográfica, hasta la línea de base del mar\nterritorial en el océano Pacífico y el mar Caribe, definida esta línea conforme\na los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el\nDerecho del Mar, como punto de partida para el cómputo de la anchura máxima de\ntodas las áreas marinas jurisdiccionales del Estado costarricense.\n\nPor su parte, el artículo 12 del decreto de cita,\nrefuerza la aplicación de la proyección cartográfica CRTM05 como el sistema\nnacional de coordenadas oficial a la cual se deben referenciar en el territorio\ncontinental de nuestro país, al señalar que El sistema de referencia\nhorizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el\nterritorio continental extendido hasta la línea de base del mar territorial y,\nla proyección cartográfica \"Universal Transversal de Mercator\" (UTM), zonas 16\ny 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico\ny el mar Caribe, constituirán el único sistema oficial de coordenadas para la\nRepública de Costa Rica, a partir del cual, se deben referenciar todos los\nlevantamientos y actividades cartográficos y geodésicos que desarrollen en el\nterritorio nacional toda dependencia pública, persona o entidad privada,\nnacional o extranjera, que emprendan o contraten trabajos geodésicos y\ncartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra\nparte, información geográfica confiable, uniforme y comparable, que sea de\nutilidad general y que apoye la toma de decisiones en los distintos niveles del\nEstado.\n\n7.-Que la georreferenciación al sistema nacional de\ncoordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo\nTerrestre, posibilita la correcta delimitación de la zona pública a los efectos\nde la elaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n8.-Que la información digital georreferenciada sobre\ndelimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el\nIGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto\nGeográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).\n\n9.-Que la Geodatabase Digital Georreferenciada (GDG)\ndel Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT)\nse fundamenta técnicamente en aplicación de la regulación establecida por: a)\nel Decreto Ejecutivo N° 7841-P Reglamento a la Ley N° 6043 sobre la Zona\nMarítimo Terrestre, b) el Decreto Ejecutivo N°33797-MJ-MOPT Declara como datum\nhorizontal oficial para Costa Rica, el CR05, y su proyección cartográfica\nasociada, CRTM05, y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento\nde Especificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre.\n\n10.-Que el artículo 16 de la Ley Forestal, Ley N° 7575\ndel 13 de febrero de 1996 y sus reformas, establece que el Ministerio del\nAmbiente y Energía delimitará en el terreno los linderos de las áreas que\nconforman el Patrimonio Natural del Estado.\n\n11.-Que según el artículo 11 del Capítulo I,\nDisposiciones Generales de la Ley N° 6043, establece que la Zona pública es\ntambién, sea cual fuere su extensión, la ocupada por todos los manglares de los\nlitorales continentales e insulares y esteros del territorio nacional.\n\n12.-Que el Decreto Ejecutivo N° 36786-MINAET Manual\npara la clasificación de tierras dedicadas a la conservación de los recursos\nnaturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La\nGaceta N° 217 del 11 de noviembre del 2011, establece entre sus objetivos\nIdentificar dentro de la Zona Marítimo Terrestre aquellos terrenos que\nclasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII),\nhumedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos,\nbosques anegados, salitrales), para certificarlos e incorporarlos como parte\ndel Patrimonio Natural del Estado (PNE).\n\n13.-Que el Decreto Ejecutivo N° 36786-MINAET en el\npunto III.-Competencias para la delimitación y certificación establece que\nLa clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de\nConservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a\nprofesionales privados debidamente acreditados por los Colegios Profesionales\nrespectivos para que clasifiquen los bosques, terrenos de aptitud forestal\n(suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas\ncosteras, pantanos, bosques anegados, salitrales) y humedales.\n\nLa validez de los documentos de clasificación emitidos\npor profesionales privados quedará sujeta a la aprobación que emita el AC que\npor competencia territorial le corresponda. A las AC del SINAC con jurisdicción\nen la ZMT les competerá, además, la verificación, fiscalización, deslinde y\ncertificación de las tierras del Patrimonio Natural del Estado y las zonas de\nprotección. La ubicación y delimitación de las áreas del Patrimonio Natural del\nEstado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del\nproceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043,\nya que el Plan Regulador Costero es el instrumento de ordenamiento territorial,\nque define y ubica todas las zonas a concesionar dentro de la ZMT y para la\nclasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan\nRegulador Costero debe indicar clara y expresamente, las áreas del PNE para no\ncontabilizarlas en el área total a concesionar.\n\n14.-A solicitud de parte del Área de Conservación\nTempisque, del Sistema de Áreas de Conservación del Ministerio de Ambiente y\nEnergía lleva a cabo el proceso de demarcación en campo del área y delimitación\ndel manglar Playa San Miguel, ubicado Playa San Miguel, localizado en el\ndistrito 06º Bejuco, cantón 09º Nandayure, provincia 05º Guanacaste.\n\n15.-Se utilizó la metodología de Delimitación de\nMojones Georreferenciados, para delimitar la zona pública de la Zona Marítimo\nTerrestre del manglar Playa San Miguel, en distrito 06º Bejuco, cantón 09º\nNandayure, provincia 05º Guanacaste.\n\n16.-Que la delimitación cuenta con aval técnico\ninterno conforme el informe de Revisión Técnica N° DIG-TOT-INF-087-2023 del 27\nde abril de 2023, emitido por el Subproceso de Límites Oficiales del\nDepartamento Topográfico y Observación del Territorio del Instituto Geográfico\nNacional. Likewise, in accordance with Law No. 59, the IGN is\nthe scientific and technical dependency governing national cartography,\ndestined for the execution of the official Basic Map and the basic geographical\nDescription of the Republic of Costa Rica and for the studies, investigations\nor works and the development of national policies of a cartographic,\ngeographical, geodetic, geophysical, and similar nature that have a relationship\nwith such works, in order to support planning processes.\n\n2.-That Law No. 59 constitutes the IGN permanently\nand in representation of the State, as the official authority in geodetic matters\nand in the spatial representation of the geography of the Republic of\nCosta Rica, its authority extending to activities of any order that have as\ntheir origin the works entrusted to its charge.\n\n3.-That in accordance with Law No. 59; article 62\nof Executive Decree No. 7841-P called Regulation to the Law on the Maritime\nTerrestrial Zone recognizes the competence of the IGN for the delimitation\nof the public zone of the Maritime Terrestrial Zone, and its officialization through\npublication in the Official Gazette La Gaceta; article 63 of\nExecutive Decree No. 7841-P indicates that The National Geographic Institute\nmust publish a notice in the Official Gazette, for each portion of the maritime-terrestrial\nzone in which it has demarcated the public zone.\n\n4.-That in Executive Decree No. 36642-MP-MOPT-MINAET\nRegulation of Specifications for the Delimitation of the public zone of the\nMaritime Terrestrial Zone, it is established according to article 18 that for the\ndelimitation of the public zone of the Maritime Terrestrial Zone, the IGN may\nresort to two execution methodologies, which are indicated in articles 19 and\n20, corresponding to the delimitation of the public zone of the Maritime Terrestrial\nZone through the placement of boundary markers (mojones) and/or the georeferenced digital\ndelimitation, this in order to expedite the delimitations and provide\ngreater technical security to the interested parties.\n\n5.-That in Executive Decree No. 33797-MJ-MOPT Declares\nas the official horizontal datum for Costa Rica, the CR05, linked to the International\nTerrestrial Reference Frame (ITRF2000) of the International Earth\nRotation and Reference Systems Service (IERS) for the measurement epoch 2005.83, which\namong other aspects determines, the National Geodetic Horizontal Reference Network\nCR05, and its associated cartographic projection CRTM05, as the official system\nto which the coordinates of all geodetic, cartographic, and cadastral\nworks executed in our country must be referenced,\nspecifically stating in article 11 that: \"The National Geodetic Horizontal Reference\nNetwork CR05 and the cartographic projection system CRTM05,\nshall constitute the sole official coordinate system for the Republic of Costa\nRica, based on which all surveys and\ncartographic and geodetic activities that are carried out in the National\nTerritory by any public dependency, person, or private entity, national or foreign, must be referenced.\"\n; while article 7 indicates that \"As cartographic\ndata is produced in the new cartographic projection system CRTM05, the\nNational Geographic Institute shall publish by appropriate means that\ninformation that has been officialized.\"\n\n6.-That Executive Decree No. 40962-MJP Update\nof the Official Horizontal Geodetic Reference System for Costa Rica declares\nin its article 1 that The official horizontal geodetic reference system for\nCosta Rica, denominated as CR05 and its materialization through the National Geodetic\nNetwork, changes its acronyms to CRSIRGAS, as the official horizontal reference\nsystem for the Republic of Costa Rica, linked to the International\nTerrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch\n2014.59, and henceforth, the changes and its update, shall be governed according to\nthe new ITRF definitions that are implemented in the continental network of the\nGeocentric Reference System for the Americas (SIRGAS) denominated\nSIRGAS-CON, while article 2 establishes that The cartographic projection\nsystem CRTM05 shall continue being the official one for the cartographic\nrepresentation of the continental national territory, extended for the purposes of\napplication of this cartographic projection, up to the baseline of the territorial\nsea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance\nwith articles 5, 6 and 7 of the United Nations Convention on the\nLaw of the Sea, as the starting point for computing the maximum width of\nall the jurisdictional marine areas of the Costa Rican State.\n\nFor its part, article 12 of the cited decree,\nreinforces the application of the cartographic projection CRTM05 as the official national\ncoordinate system to which they must be referenced in the continental territory\nof our country, by stating that The horizontal reference system\nCRSIRGAS and its associated cartographic projection CRTM05 for the\ncontinental territory extended up to the baseline of the territorial sea and,\nthe cartographic projection \"Universal Transverse Mercator\" (UTM), zones 16\nand 17 for the jurisdictional marine and insular areas in the Pacific Ocean\nand the Caribbean Sea, shall constitute the sole official coordinate system for the\nRepublic of Costa Rica, based on which, all\nsurveys and cartographic and geodetic activities that are carried out in the\nnational territory by any public dependency, person, or private entity,\nnational or foreign, that undertake or contract geodetic and\ncartographic works must be referenced, contributing to avoiding public expense and obtaining, on the other\npart, reliable, uniform, and comparable geographic information, that is of\ngeneral utility and that supports decision-making at the different levels of the\nState.\n\n7.-That georeferencing to the national coordinate\nsystem as a mechanism to delimit the public zone of the Maritime Terrestrial\nZone, enables the correct delimitation of the public zone for the purposes\nof the elaboration of regulatory plans, the approval of survey plans (visado de planos de agrimensura), the\ngranting of concessions in the Restricted Zone and other aspects of\ncoastal territorial planning (ordenamiento territorial costero).\n\n8.-That the georeferenced digital information on\ndelimitation of the public zone of the Maritime Terrestrial Zone held by the\nIGN, is denominated the Digital Georeferenced Geodatabase (GDG) of the National\nGeographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n9.-That the Digital Georeferenced Geodatabase (GDG)\nof the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT)\nis technically based on the application of the regulation established by: a)\nExecutive Decree No. 7841-P Regulation to Law No. 6043 on the Maritime\nTerrestrial Zone, b) Executive Decree No. 33797-MJ-MOPT Declares as the official horizontal datum\nfor Costa Rica, the CR05, and its associated cartographic projection,\nCRTM05, and c) Executive Decree No. 36642-MP-MOPT-MINAET Regulation\nof Specifications for the Delimitation of the public zone of the Maritime Terrestrial\nZone.\n\n10.-That article 16 of the Forest Law (Ley Forestal), Law No. 7575\nof February 13, 1996, and its amendments, establishes that the Ministry of\nEnvironment and Energy shall delimit on the ground the boundaries of the areas that\nmake up the Natural Heritage of the State (Patrimonio Natural del Estado).\n\n11.-That according to article 11 of Chapter I,\nGeneral Provisions of Law No. 6043, it establishes that the public Zone is\nalso, whatever its extension, that occupied by all mangroves of the\ncontinental and insular littorals and estuaries (esteros) of the national territory.\n\n12.-That Executive Decree No. 36786-MINAET Manual\nfor the classification of lands dedicated to the conservation of natural\nresources within the Maritime Terrestrial Zone in Costa Rica published in La\nGaceta No. 217 of November 11, 2011, establishes among its objectives\nTo identify within the Maritime Terrestrial Zone those lands that\nclassify as forests, of forest aptitude (Class VII and VIII soils),\nwetlands (mangroves, estuaries (esteros), rias, salt marshes (marismas), coastal lagoons, swamps (pantanos),\nflooded forests, salt flats (salitrales)), to certify them and incorporate them as part\nof the Natural Heritage of the State (PNE).\n\n13.-That Executive Decree No. 36786-MINAET in\npoint III.-Competencies for delimitation and certification establishes that\nThe classification of the lands within the ZMT shall correspond to the Conservation\nAreas (AC) of the National System of Conservation Areas (SINAC) and to\nduly accredited private professionals by the respective Professional\nAssociations to classify forests, lands of forest aptitude\n(Class VII and VIII soils), (mangroves, estuaries (esteros), rias, salt marshes (marismas), coastal\nlagoons, swamps (pantanos), flooded forests, salt flats (salitrales)) and wetlands.\n\nThe validity of the classification documents issued\nby private professionals shall be subject to the approval issued by the AC that\nby territorial competence corresponds. The AC of the SINAC with jurisdiction\nin the ZMT shall also be responsible for, the verification, oversight, demarcation (deslinde), and\ncertification of the lands of the Natural Heritage of the State and the protection\nzones. The location and delimitation of the areas of the Natural Heritage of the\nState within the Maritime Terrestrial Zone, must be carried out as part of the\napproval process of the Coastal Regulatory Plan (PRC), defined by Law 6043,\nsince the Coastal Regulatory Plan is the territorial planning instrument,\nwhich defines and locates all the zones to be concessioned within the ZMT and for\nthe classification of this at the level of cadastral plans. Therefore, the Coastal\nRegulatory Plan must clearly and expressly indicate, the areas of the PNE in order not to\ncount them in the total area to be concessioned.\n\n14.-At the request of the Tempisque Conservation Area (Área de Conservación\nTempisque), of the System of Conservation Areas of the Ministry of Environment and\nEnergy, the process of in-field demarcation of the area and delimitation\nof the Playa San Miguel mangrove is carried out, located Playa San Miguel, located in the\n06º Bejuco district, 09º Nandayure canton, 05º Guanacaste province.\n\n15.-The Georeferenced Boundary Markers (Mojones) Delimitation methodology was used,\nto delimit the public zone of the Maritime Terrestrial Zone of the Playa San Miguel mangrove, in 06º\nBejuco district, 09º Nandayure canton, 05º Guanacaste province.\n\n16.-That the delimitation has internal technical endorsement\nin accordance with the Technical Review Report No. DIG-TOT-INF-087-2023 of April\n27, 2023, issued by the Official Limits Sub-process of the\nTopographic and Territory Observation Department of the National Geographic\nInstitute.
