  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 092\n\n                        Reforma Establece veda total para la pesca deportiva y pesca comercial en\npequeña escala, excepto para la pesca turística comercial de pequeña escala, en el periodo que va\ndesde el 01 de mayo hasta el 31 de julio del 2023, ambas fechas incluidas\n\nINSTITUTO COSTARRICENSE DE PESCA Y\nACUICULTURA\n\nAJDIP/092-2023.-Puntarenas, a los dos días\ndel mes de mayo de dos mil veintitrés.\n\nConsiderando:\n\n1.-Que mediante Acuerdo de Junta Directiva\nAJDIP/086-2023, se establece una veda total para la pesca deportiva y pesca\ncomercial en pequeña escala, excepto para la pesca turística comercial de\npequeña escala en el Golfo de Nicoya, correspondiente al presente año 2023.\n\n2.-Que en el por tanto número 11 del\nAcuerdo de referencia, se determina el procedimiento a seguir en el caso de\naquellos pescadores que teniendo en su licencia de pesca la posibilidad de\nrealizar faenas de pesca fuera de la zona de veda, decidan no acogerse al\nperiodo de veda establecida, con el fin de poder ejercer la actividad de pesca\nfuera del área vedada, conforme a las condiciones establecidas en la licencia\nde pesca respectiva y asimismo poder solicitar el beneficio del combustible a precio\ncompetitivo.\n\n3.-Que en dicho Por Tanto, se determinó\nque serán a través de las Asociaciones de Pescadores, quienes remitan las\nlistas de los pescadores agremiados que decidan acogerse a tal tramite, sin\nembargo, lo anterior no enerva la posibilidad que puedan ser los mismos\npermisionarios interesados directos quienes puedan entregar los documentos para\nacogerse a tal opción.\n\n4.-Que consideran\nlos Señores Directivos, la viabilidad y conveniencia de adicionar al Por Tanto\n11 del Acuerdo supra, la posibilidad de que además de las Asociaciones, los\npermisionarios como interesados directos puedan realizar la entrega de los\ndocumentos que corresponda para no acogerse al periodo de veda establecida,\npara lo cual se debe cumplir en todo momento con los requisitos establecidos.\n\n5.-Que una vez discutida, analizada y\nvalorada por los Señores Directores, sobre la necesidad de modificar el Acuerdo\nde veda supracitado; para que aquellos permisionarios cuya licencia de pesca\ncomercial en pequeña escala les permita faenar fuera del área vedada, no se\nvean impactados negativamente durante los meses de veda; la Junta Directiva del\nInstituto Costarricense de Pesca y Acuicultura. Por tanto,\n\nACUERDA:\n\n1°-Modificar el Por Tanto 11°, del Acuerdo\nde Junta Directiva AJDIP/086-2023, publicado en el Alcance N°.76 del Diario\nOficial La Gaceta N° 74 del 28 de abril de 2023, para que en lo sucesivo\nse lea de la siguiente manera:\n\n11°. \"En el caso de\naquellos pescadores que teniendo en su licencia de pesca la posibilidad de\nrealizar faenas de pesca fuera de la zona objeto de veda, establecida en el\ninciso número uno del presente acuerdo y decidan no acogerse a la veda, podrán\nrealizar la entrega directa de los documentos que corresponda al Departamento\nde Registro del INCOPESCA para su tramitación, o bien coordinar con las\nAsociaciones de Pescadores que los representan para que dicha organización\nprepare una lista de los pescadores en esta condición.   "body_en_text": "across the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 092\n\n                        Reform Establishes a total closure for sport fishing and small-scale commercial fishing, except for small-scale commercial tourism fishing, during the period from May 1 to July 31, 2023, both dates inclusive\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nAJDIP/092-2023.—Puntarenas, on the second day of May of two thousand twenty-three.\n\nConsidering:\n\n1.—That by Board of Directors Agreement AJDIP/086-2023, a total closure is established for sport fishing and small-scale commercial fishing, except for small-scale commercial tourism fishing in the Gulf of Nicoya, for the current year 2023.\n\n2.—That in the por tanto number 11 of the referenced Agreement, the procedure to be followed is determined in the case of those fishers who, having on their fishing license the possibility of conducting fishing operations outside the closure zone, decide not to avail themselves of the established closure period, in order to be able to engage in fishing activity outside the closed area, in accordance with the conditions established in the respective fishing license and likewise to be able to request the benefit of fuel at a competitive price.\n\n3.—That in said Por Tanto, it was determined that it will be through the Fishers' Associations that the lists of member fishers who decide to avail themselves of such a process are sent; however, the foregoing does not negate the possibility that the interested permit holders themselves may be the ones who deliver the documents to avail themselves of such an option.\n\n4.—That the Members of the Board consider the feasibility and advisability of adding to Por Tanto 11 of the aforementioned Agreement the possibility that, in addition to the Associations, the permit holders as directly interested parties may deliver the corresponding documents to not avail themselves of the established closure period, for which the established requirements must be met at all times.\n\n5.—That once discussed, analyzed, and evaluated by the Members of the Board, regarding the need to modify the aforementioned closure Agreement so that those permit holders whose small-scale commercial fishing license allows them to operate outside the closed area are not negatively impacted during the closure months, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture.
